California Congressman Eric Swalwell has officially ended his bid for Governor, announcing on X late Sunday that it’s his fight to face false allegations, not his campaign’s. Swalwell is facing a criminal investigation in Manhattan for an alleged rape of a former staffer in 2024 and a possible expulsion vote in Congress this week. DHS has also opened an investigation into the Congressman over the legal status of his Brazilian nanny.

It is Monday, April thirteenth, and a breaking story that
we saw coming for the past several days. Eric Swalwell
has dropped out of the race for California governor. And
with that, welcome to this episode of Amy and TJ.

Dropped out because of serious allegations, including a rape allegation
burn Robes. It's important and we'll get into dropped out
of the race, did not resign from Congress. We'll get
into all of that. But this is news. He didn't
have any other choice today.

Uh No, there was not one ounce of support from
anyone coming from anywhere, and the calls were coming from
his own party, from the highest echelons, asking him, telling him,
urging him to drop out of the governor's race. But
it's interesting because just by dropping out of the governor's
race that doesn't end his problems.

In fact, so many are just beginning.

As you mentioned, he's facing a criminal investigation here in Manhattan.

In California, DA is now saying they're looking into possible charges,
a Department of Homeland Security probe, and an expulsion vote
in Congress because as you point out, yes, he is
still a sitting member of Congress. His term does not
end until January of twenty twenty seven.

Most populous state in the US, right, California. Yes, this
is a big deal that we have. It's happening in
a state. No, it's happening out there. It's in California.
This is obviously one of the most influential places in
all of the country. And robes when you have a

household name, he is almost a household face. And robes
when this is going to have ripple effects because this
is a guy who's possibly this state has been in
Democratic hands for a while with Newsom, he's one of
the most prominent governors in the country right now.

Yes, Governor Newsom, who is stepping down, most people believe
to run for president in this next presidential election. And
so Eric Swalwell was the leading Democrat in the run
to replace Newsom.

There were I believe.

Eight Democrats running right now in this primary election. Voting
begins in just a matter of weeks and the primary
is being held on June second. But yes, he was
the top Democrat, the largest name of the bunch.

And you said, so many Democrats are running, but he
was starting to as of late recent weeks, pull in
that traditional mainstream or base of support from the Democratic Party.
He was making his way and a lot of people
were fearful that they were going to lose the state
House in California because the top two vote getters are
the ones who are going to move on to face

each other in the election later this year. And Rose
right now, the top two polling are Republicans. He was
the one making his way up. Who is the democrats
big hope from rolling on? So Robes, This isn't just
some candidate dropped out. I was trying to put that
in context. This is a big deal.

This may and almost well, I shouldn't say assuredly, but
this may end any hope of retaining the governorship there
are for Democrats in the state of California. This pretty
much ended their hope of doing that. He was their hope.
I don't know if anyone in a matter of weeks
could possibly emerge as another big enough name, someone who

carries enough weight to take on these two Republicans who
are leading right now.

Aan Rojie, like you said, they're always crying, He said,
I don't know if anybody can, but it's so many
of them that are splitting all that support. And right
now again the top two vote getters are the Republican
at least that comes to polling. Roj you'd listed all
these things. He's facing a criminal investigation, possible expulsion. He
is facing another criminal investigation you talked about. You'll hit
on in California as well. Rose, You're talking about all

and he's now lost the chance to become governor of.

And the DHS probe too.

There's a DHS pro You named all of those things
happening at the top of the list outside of the headline.
Shit be his family, this dude, all you listed a
hell of a week he has and even life ahead.
But Robs right now, all that coming at him his priority.

He's got young kids, he's got a wife who's got
a family that is pissed right now he's trying. I
don't know how he's managing all of that, which is
right now has to be most important.

I cannot imagine.

And most people say when, when when this was all
his doing? But my goodness, yes, we forget about the
human element that's going on right now. The fact that
Eric swall saw. I can never say the same. Eric
Swalwell is a husband, he is a father of three,
and I think we talked yesterday the fact that you know,
he's a son, he's a son in law, he's a brother.

You know, he is so many things to so many people,
and everyone in that family is reeling with this. I mean,
just imagine I was actually on his his ex page
and on his social media and it still says he's
running for go even though the statement is there.

And you just think about, my God.

On Thursday, just a few days ago, he could never
imagine this was his Monday where all of this now
is piling on top of him. We should probably just
read his statement that he put out on X Late yesterday,
we woke up to the news where he said, I
am suspending my campaign for governor to my family, staff,

friends and supporters. I am deeply sorry for mistakes and
judgments I've made in my past. I will fight the
serious false allegations that have been made, but that is
my fight, not a campaigns. And of note, he said
he put his family first, to my family, staff, friends and.

Speaker 2 (05:43):
Supporters, and that's the right thing to do right now,
everybody saw this obviously coming. He said he was going
to take the weekend, spend time with friends and family
and figure this out. But the statement now is an
acknowledgment of some poor behavior, not necessarily saying which of
it that we're talking about in that behavior, and he

has to be very careful about that. I guess now
rogans because now you're talking about a criminal investigation. He
is being investigated for a serious violent crime, right.

Speaker 1 (06:15):
That's right.

Speaker 3 (06:15):
The Manhattan District Attorney's Office this weekend announced it was
officially launching an investigation into a rape into a sexual assault.
This occurred, according to the victim, in twenty twenty four
in a New York City hotel room.

Speaker 1 (06:30):
And look, the DA in Manhattan.

Speaker 3 (06:32):
Even put out a statement which was pretty pretty interesting,
asking any other survivors or anyone else with knowledge about
these allegations or other conduct like that, to contact their
Special Victims Unit to basically join with this young woman
in any incident they may have experience. That was, they

(06:54):
literally threw out a net for other potential victims of Swallwell's.
And then in California, the Alameda County District Attorney's Office
says they are now evaluating whether any alleged criminal conduct
occurred within the Bay Area because this same young woman
claims something happened to her as well. A sexual assault
happened to her in twenty nineteen in California.

Speaker 2 (07:16):
That's the one, right, She says, they were out drinking heavily.
She doesn't remember how she got from the bar to
waking up the next morning naked in bed with him.
That is her story, at least about that incident. She
says she remembers nothing after the bar and wakes up

(07:36):
with him. So what that suggests. I don't think that's
the one where she's h you please remind me. I
know the other incident she's saying he raped me, But
how is she describing this one as an assault that
night as well?

Speaker 3 (07:46):
Yes, it was non consensual sex, is how she describes
it because she did not give her consent. She could
not give her consent, and she has text saying I
do not remember last night, so we don't know. And
the DA out in Californy isn't saying whether or not
they believe this rises to the level. But the Manhattan DA,
the incident that occurred, according to her in twenty twenty

four is now officially investigating that incident where she claimed
she does have a flash of memory of saying no
and trying to push him off her and robes.

Speaker 2 (08:18):
Congress is back in session today. No word on is
he going to show up to work. I would have
a hard time believing that. But Congress is back in
session today, and everyone they have an exact number, I
think it's twenty one. Every single person in Congress that
endorsed him pull their endorsement. Like they were all chomping

at the bit to put out statements to say, we
got nothing to do with this guy you mentioned as well,
his staff continues to work for his office. But they
also put out a great extraordinary statement that we got
nothing to do with the guy that we technically still
work for.

Speaker 1 (08:55):
Yeah, I think it was fifty plus.

Speaker 3 (08:56):
Senior's staff of Swallow, from his congressional staff to his
gubernatorial campaign staff joined forces put out this pretty, yes,
remarkable statement where they said we stand with our former colleague,
we urge you to stand with her as well.

Speaker 1 (09:14):
It was well, they didn't mince words.

Speaker 2 (09:17):
Yeah, I loved how they did say, we are working
for this district. We want you to know that this
guy you voted for. Obviously, isn't putting you first right now,
and he can't. I thought that was just a nice
touch that they were saying they were representing the district
as a whole. I thought that was nice.

Speaker 3 (09:35):
It was well done, but also very telling in terms
of where they stood on the subject. And that has
been the case with just about, well not just about,
with every single person who has spoken up. They have
spoken out against him and the allegations being made, and
in fact, Republican from Florida, Anna Paulina Luna, she had
said over the weekend that she is going to bring

(09:57):
emotion to the House to expel swallow Well. It would
need two thirds vote in favor to pass, but we've
already heard from several several House members who have signaled
that yes, they would be open to expelling Swallwell. They
also included Tony Gonzalez out of Texas for his sexual
misconduct allegations as well, so they likely will bring that

(10:20):
vote on both of those congressmen, which is pretty remarkable.

Speaker 2 (10:25):
We shall see if they go through with it. There's reason, folks,
that a lot of folks aren't necessarily optimistic about the
idea of members of Congress being expelled because of their behavior.
You know why. It's a numbers game and it's a

midterm year. We'll explain to you why Swalwell's expulsion could
set off a whole string of events there.

Welcome back everyone to this episode of Amy and TJ,
where the fallout continues for Representative Eric Swalwell, a congressman
out of California who was the top Democrat making a
run for governor there in California. He has officially dropped out,
making the announcement late yesterday on X. But he is
facing a whole other slew of issues from a criminal

(11:25):
investigation in Manhattan, a potential one brewing in California. And
we mentioned a DHS investigation. Yeah, the US Department of
Homeland Security has announced that it is investigating allegations that
Eric Swalwell kept his Brazilian nanny in the States well
after her visa expired. And here is what they said.

(11:47):
They say the agency has been collecting information on allegations
involving Congressman Eric Swalwell's hiring of a Brazilian national as
a nanny without lawful work authorization. No, no one is
above the law, including a member of Congress. These allegations
are serious. USCIS has referred this matter to DHS Law

(12:08):
Enforcement for investigation.

Speaker 2 (12:11):
It just keeps coming. I mean, it just won't stop
coming from this guy who last Thursday was making headway
in the race for California. Last Thursday, it's Monday. He
didn't just lose the race. He's about to possibly lose
his family, lose his freedom, he's about to lose his job.
He was sweetheart. This is stunning. Now, is it possible

(12:33):
that none of this is true? Is it possible that
he is not guilty of criminal behavior if he's possibly
guilty of some behaving very badly when it comes to
his job in relationship?

Speaker 3 (12:48):
The problem for Eric swallwell, it isn't just as he said,
she said with this one young former staffer coming forward
talking to initially the San Francisco Chronicle and Nancy and end.
But you also have three other women who spoke out
saying they were sexually harassed by him, one that he
kissed her in public without her consent, to others that

(13:08):
he sent them unsolicited photos and videos of his penis.
So look, and now we have the Manhattan DA throwing
out a net for other women potentially to come forward
as well. So this has the possibility of even getting bigger.
So it isn't just one voice, it's multiple voices. And
that's a big problem for Eric Swalwell.

Speaker 2 (13:28):
Well Barbin for a problem possibly for Congress now Democrats. Yes,
you bring up an expulsion right now on Monday, the
morning that all of this goes down, rolled it's fresh
on people's mind. Of course he should be kicked out
of Congress, is what a lot of at least Americans
might say right now. It might not be what members

(13:49):
of Congress say. You all and everybody well understands ropes,
how tight the margins are, how tight things are in Congress.
Of the last special election ended up things of two
seventeen two fourteen, Republicans have a very small margin. If
you kick him out, that's one more vote less for Democrats.

(14:09):
So what are Democrat's going to do. They're going to
try to even things up, robes and try to then
go after they've already said Tony Gonzalez, who made all
kinds of headlines because he had an affair with a
staffer who then turned around and killed herself by setting
herself on fire. Yes, and I haven't moved to expel

(14:29):
that guy.

Speaker 3 (14:30):
Yes, and it's a clear violation, and he has ultimately
admitted it. He denied it for a very very very
long time. He finally admitted to that affair, apologizing to
his wife. But that is a clear violation of his
congressional duties.

Speaker 2 (14:43):
Yes, so tit for tat is going to get possibly
set off robes in Congress. The thing is about the
expulsion now of Eric Swallell, who is going to vote
to keep him in in a midterm election year, who
is going to go before their voters and said, yep,
that guy who at that point might be charged with rape.
Say yeah, I voted to keep him as a member

(15:07):
of the US House of Representatives.

Speaker 1 (15:08):
You're gonna lose your female constituency.

Speaker 3 (15:10):
You are going to lose and I shouldn't say just women,
but a lot of women and sure some men as well.
But you are really putting your reelection in jeopardy.

Speaker 2 (15:19):
Okay, So kick him out, Kick out Gonzales. What's gonna happen?
Then they're gonna come back and go after another member
of each party. You got a Florida congressman who is
in another I think a sex scout. I can't remember
his name, but then you have I can't remember where
she's from. The Democrat who is facing like millions of doubts,
like federal charges, fraud charges, fraud charges, she has been testifying,

(15:42):
she's been brought before ethics committee. There are they gonna
go after her. So they are very hesitant robes. And
it actually makes sense, hesitant to kick out members of
Congress of that house because the people voted him in.
If the people want to vote them out, let their
own constituents do so that kind of makes.

Speaker 3 (15:59):
Sense, does And once you start down this slope, as
you just detailed, it is a very slippery one. So
to think that Swolwell will be out in January, regardless
his term ends, they wouldn't have to do anything. It's
a matter of tolerating him now for a matter of months.

Speaker 2 (16:18):
And tolerating him because we want his vote. You're going
to correct, They're going to have to say that as well,
and that's not a good look either.

Speaker 3 (16:25):
It will be interesting to see how each member of
Congress chooses to proceed, and they know the voters are watching,
and so with that we will too. Of course, thank
