But we begin today with the what I would say
is farcicle continuation of the New York City case against
Donald Trump. We have had Stormy Daniels on the witness
stand and absolutely insanely ridiculous continuation of the sham law

(00:52):
fair that has been taking place in New York City.
And before we get into Stormy Daniels and what she
might have have said to me, the story here Buck,
and we talked about this quite a lot yesterday with
Andy McCarthy, is they haven't to me, really proven any
criminality on Donald Trump's behalf. And I'm gonna lay into

that in a moment, But you know that I like
to look at the odds markets you can gamble on
basically anything, and the odds that there is going to
be a felony conviction of Donald Trump have dropped to
seventy five percent likely. That sounds still like a lot,

(01:35):
but it means and the chances here have now, according
to the gambling markets moved up to a quarter that
there is no conviction at all. And I think that's
because people are paying attention here and again it comes
down to the jury and how well they apply the law.
But they haven't actually proven anything. And I want to

(01:57):
play a couple of cuts here, cut four. Here is
Trump speaking before he went in today using sorry cut
three left wing media reports about how the trial isn't
going well for prosecutors. This is him reading cut three.

Speaker 3 (02:15):
Some of the statements made about this witch hunt on
CNN Fake New CNN Michael Barre said the proof of
falsifying records has not been accomplished. On Good Morning America,
they said, we heard the expense payments to lawyers are
legal expenses. Also, NBC Today show the challengers that there

is no smoking gun, no email or tape to prove
the president's in tenth they don't have a way to
prove that. That's NBC Today's show. And then Fox News
Kadecha Casski said that the gag order is unconstitutional, which of.

Speaker 1 (02:57):
Course it is.

Speaker 2 (03:00):
I think all that's true, Buck, and I will play
a couple of those cuts that he referenced here in
a moment. But ultimately, I think what even left wing
political commentators who have some legal basis and knowledge are
having to recognize is what we've told you for some time.
This is an incredibly weak case. But even within that context,

prosecutors are not doing a very good job actually proving
a crime was committed here.

Speaker 1 (03:25):
Well, I think it really does matter to look at
the language we say this when it comes to immigration,
for example, illegal immigration. Right now, they want you to
say newly arrived, and before that it was undocumented, and
before that it was illegal immigrant, and before that it
was legal alien. And they've been winning the argument by

changing the language. Right. That's true on many things. The
left is unfortunately better at this than we tend to be,
because there's something underhanded about it. I mean, they're shifting
language without addressing the argument. But I just think, Clay,
we talked about a hush money trial. A hush money
isn't a crime, correct, So that's not you know, it's

(04:07):
almost like saying the stormy Daniels alleged affair trial. Well,
hold on a second. An affair not the you know,
it's not a good thing, but an affair is not illegal.
So it's not an affair trial. It's not a hush
money trial. It is a business records trial. And even
when people say it was it's about a campaign finance violation.

(04:30):
The campaign finance violation component of it is assumed right.
The falsification of the business record allegedly occurred so that
it wouldn't get into the realm of a reportable campaign
finance issue. And therefore there's a broader scheme here, which
is how he turns it into a felony, and that

(04:50):
this is legal alchemy. This is turning a nothing burger
into a nothing burger with cheese. And we are seeing
this all all unfold before our very eyes in a
way that once again I think Democrats you're starting they're
starting to be concerned about the outcome here. You're seeing
some of the legal analysts. There are legal analysts who

go on MSNBC, for example, whose only goal is to
say whatever they think the brainwash lib audience wants. There
are some who want to do that, but also don't
want to look like total jackasses and say things that
make a fool of them when the facts actually come out.
There aren't many of them, but there are a few.
You've already started to see them. I think Clay Hedging

a little bit saying, Oh, I wish this was really
about the January sixth case and not this. Oh, hold
on a second, I thought that Alvin Bragg was, you know,
the new sheriff in town to get justice. Uh, this
is slowly. I wouldn't say it's falling apart, but there
are there are cracks in the wall here. Something's happening.

Speaker 2 (05:56):
And remember the only reason this is not a misdemeanor
is because they're claiming that there was a second crime
that was committed while not necessarily really claiming and proving
the second crime, which feels to me like legally untenable terrain,
which is why I said yesterday, I think this is
going to get tossed. And here's the other thing that

I think is well. Well, first of all, let's play
that cut that Trump referenced. I believe it is cut five.
This is Attorney Michael Moore, not the filmmaker, saying that
proof of Trump falsifying records hasn't been accomplished yet.

Speaker 4 (06:33):
Cut just about it was important because it starts to
connect some of the dots, and that is, you know,
can you actually put a pin in Donald Trump's hand?
Can you put a check in his hand? Under his signature?
But that really is not the crux of the government's case.
The case deals with heavy falsified records as it relates
to the federal election law, and so that has not

been accomplished yet.

I think that's important. Also, Bara, I might be mispronouncing
his name. Burra a longtime SDN Y prosecutor. Right, he
was high up and he.

Speaker 1 (07:07):
Was the US Attorney for the Southern District of New York. Yes,
here he is saying, you know, this is not the
crime of the century.

Speaker 5 (07:14):
I think based on what happened today and how uninspiring
the cross examination was. Because the documents largely speak for themselves,
the prosecution has basically proven the basic case, which is
falsification of business records, which people can argue is or
is not the crime of the century. It's a misdemeanor.
The NewYork law recognized it as a misdemeanor, and we
can argue and see how the evidence comes in with

respect to the next phase, which is whether that can
be accelerated into a felony if it was done for
the purposes of concealing or furthering some other crime, an
election law crime or a tax crime. But the basic
fundamental case, the elements of which were laid out in
crystallized form today in court, I think we're made.

Speaker 2 (07:56):
Out Okay, So what I would say buck is and
this is what we talked about a little bit with
Andy McCarthy. The more I read, and obviously we can't
listen to it because a lot of this is taking
place while we're on air and we're not able to
get audio. But to me, Trump has a really strong
argument here that the reason he paid Stormy Daniels was

not for election related reasons, but to try to avoid
family embarrassment. And he did that already for someone who
was a dorman claiming that he had an illegitimate child.
I think most people out there who were married, whether
it's true or not, would not want this story out there.

Yeah, you know.

But I also think we shouldn't lose sight of the
fact that prosecutorial discretion is a very powerful tool and
it should have been used here with all the facts
of the case presented to do exactly what the federal
government did, which is say, there's nothing to do here,
there's nothing to see here, there's no image, there's no crime,

there's no harm, there's no loss, and there's no argument otherwise.
By the way, I mean, this whole thing is an absurdity.
And I do think we're at the place now, we're
the same way that we to just keep it honest
and keep it real. Here. You know, we've wour gamed
what happens if he's found guilty. Will they send him
to prison, will they put him under house arrest? And

(09:22):
we've talked this through and we don't have the answers,
but we're looking at what the possible pathways are, what
the outcomes are here. I think we should also start
to think about what happens if they actually get a
not guilty verdict? Oh yeah, And what does that do
to the other prosecutions, which are clearly political? What does
that do to the meaning of art? You mean not

(09:44):
guilty or you mean that it is just a mistrial,
like I, oh, not guilty?

Speaker 2 (09:48):
If they got it not guilty verdict? If Trump won
this trial, twelve jurors said he didn't do this. I mean,
I think there's still is he row percent chance of that?

Speaker 1 (10:01):
Because I think zero percent, yeah, and I'm not I
wouldn't even say there's a zero percent chance that I
wake up tomorrow. So I think zero percent is a
little too strong.

Speaker 2 (10:09):
There's there is no way twelve New York City jurors,
it's possible to see a jury that doesn't hate Trump.

Speaker 1 (10:18):
One of I say he's guilty. I think what we
have seen, Yeah, but we've seen how this plays out
if one person says he's guilty and everyone else is like,
this is a sham, this is a scam. Look, I
think this is a one in ten shot. I'm not
trying to get too crazy. Okay, what could be like
twenty thousand? No, I think, yes, it's one zero, It

rounds down to zero. This is even if they hate Trump.
People who are you know they're showing up to these
core proceedings. There's you are way too optimistic all of
a sudden for that. I think I think it's ninety
percent that Trump is going to get convicted. And do
you think I'm too optimistic? I'm just saying no, I
used to be ninety nine, Okay, I used to be
ninety nine perio.

I would make say, I think there's a twenty five
percent chance all twelve won't say guilty, but for all
twelve to say not guilty, I think is around down
to zero, like one in twenty thousand or something like that.
Now I think there's a twenty five percent chance ish
maybe even higher, that there's at least one journey who
will refuse to say he's guilty.

I'll just tell you this. I mean, I saw what
was going on in the States with Colorado and Maine,
and my inclination was so do Mayor and Catanji Brown
Jackson are the most left wing and clearly politicized jurists
who have ever sat on the Supreme Court. And even

they said, guys, this is too gross. You can't do
this because of what it does to the system, a
system that even the craziest leftists want to yes corrupt
but use for their own purposes down the line. This
trial is such a joke that I do think the
outlier possibilities need to be considered. I'm not betting you

a steak on this one because I just like collecting
steaks from you. I don't like it to go the
other way Trump, I'm merely saying, guilty verdict. It would
they would, it would, I would there be glorious. I
don't even know what they would do on MSNBC. I
think they might just in the network effectively. I mean,
a hung jury would be is a win. It's a

win for sure, and it's pretty darn close, uh in
terms of the effect. I don't think the effect afterwards
of a not guilty versus a hung jury matters to
Trump all that much under the circumstances. But I'm just
saying this is it's so weak. And now we're now
we're not able to see the court proceedings, so everything
is what's being reported on. But this, this is the

honestly the dumbest criminal trial I have ever heard of
in my life. I've never heard of someone being prosecuted
for a felony for less than Donald Trump is right now.
I cannot And I was in counter terrorism cases where
people lied to the FEDS about things and they got
jammed up, and people did financial structuring and they got

jammed up, and you know, I've seen some stuff that's
pretty borderline. This is the most absurd felony prosecution of
anyone that I can think of, and they're doing it
to a leading presidential candidate in the election year. It's
so gross that you have to think that there are
some possibilities here that people wake up. It's so wrong

that I think you have to leave open that chance.
But again, the odds are with you. But then again,
how did your horse do there, mister odds guy? Horse
lost by like a head.

I mean it was a three way tie and it
was a ten to one payout that I almost hit on.
So carry had some had some good success. I think
she won the most, went three for three on bat
out at the Kentucky Derby, So I should I should
just let her run the stock portfolio. Anyway, we'll see.

like like you can tell they're unsteady on their feet
and they're flailing, and you feel like it will be

the one hand, I feel a little bit. But on
the other hand, she's insulting everyone's intelligence and doing so
in a way that's both condescending and for any going
to say, why are you guys talking about it? I

when a vice president to be as many people about

was getting his butt kicked out of the speaker chair
after just getting it back? Where were those voices? You know,
we get some of these callers, Oh, you're tearing down Republicans.
I'm sorry. Mitt Romney voted to convict Donald Trump in
the Senate. Should we not criticize that because oh, why
are you tearing down Republicans. That is a dumb talking point.

If you use that enough, you get nowhere in politics.
We have primaries, we have presidential picks for cabinet and
vice president. We're gonna talk about these things within the family.
I don't want to, you know, tearing down people gratuitously
or nastily is one thing. She has created this entire
mailstrom herself. She will not stop. She has not apologized.

Has anyone heard her say, Guys, I'm sorry I made
some errors of judgment here, but I've done a great
job for South Dakotas, I'll do a great job for you.
I've learned in this process. And the journalists and the
commentators who have been pushing on this, they're asking fair questions.
We should know what my judgment is, we should know
what my truthfulness is. I take full responsibility, and I
think Donald Trump sees me for who I am and

going forward, I'd be a great vice president. If she
said that, this whole thing goes away, and I'm like, wow,
maybe she has grown, Maybe she has learned. No, she
goes on Varney's show and kicks British mister Rogers in
the shins. British mister Rodgers a great example.

I would also say this to people like we had
a call her and finished off yesterday's show. And by
the way, you're welcome to call in and agree or
disagree with anything we say on the show. First Amendment
should be alive and well in this country. We're not MSNBC.
But you don't want I don't think to go somewhere
where it is state sponsored radio. We're not gonna be Pravda.

I want Donald Trump to win. If Donald Trump says
something stupid and we think it hurts his chances to win,
we should be talking about it in a way that
would make it more likely for him to win.

around reading about this, texting about this, talking to all
the sources that we have in media and politics, and

point was not on board with it. He was saying no, no,

said we got to do ballot harvesting, and other people
we know said, look, I think he's wrong with that.
And guess what. Trump came around and said, you know what,
We've got to do beautiful ballot harvesting. He came around.
He's on board, he gets it, he wants to win.

We got to be able to have those conversations among
the family. We got to be able to speak the
truth about these things, or else what are we really doing?
Like we're just you know, you can, on the one hand,
criticize the Republican Unit Party and you know, Mitch McConnell
and all and the swamp and say, how dare you
criticize a Republican because it's a Republican that you've backed
in the past. That doesn't work.

Speaker 2 (28:02):
I agree, And I would even take it in the
context of sports, somebody plays crappy, even if you root
for the team, you got to call out the quarterback
of the coach for the decisions that were made. And
right now, Christino was the favorite to be a heartbeat
away from the presidency if Donald Trump had been elected
based on the last week.

Do any of you feel comfortable.

I don't feel comfortable if Kamala were president of the
United States, if something happened to Biden. I certainly don't
want Biden to win reelection. But this is why the
VP choice matters. Look, you and I may not agree
with everything.

Van says, we may not agree with everything. Tim Scott says,
we may not agree with any of the guys who
were all in the mix. Look, that's fine, that's healthy,
But I don't question their ability, their fundamental judgment and
fundamental character. When you make a public mistake and instead
of owning it, you just go and attack people, not

in the left wing media, but in Fox News, on
talk radio in other places, that shows a lack of
character because it shows you won't even take accountability. It
would be like if the coach at halftime was talking
to his team and you know, all of a sudden,
you're like, well, sir, you can't give us any criticism
because you're tearing us down.

Speaker 1 (29:17):
It's like, well, hold on a second. This is what
we're supposed to do. We're supposed to have these conversations
among ourselves. We're supposed to know whether someone is carrying
their weight or not. And if someone shows up drunk
to practice, that's a problem, even if they're on your team,
especially if you've ever and I get frustrated by this.

Speaker 2 (29:35):
You ever hear a coach get interviewed after his team
gets crushed by the team that has the rights to that,
and they're super easy going on him and they don't
ask any difficult questions. You're fired up. You should be
fired up. Nobody did this to Christy. No, she created
this entire mess for herself and keeps digging a bigger

(29:56):
hole because of her incompetence.

Speaker 1 (29:58):
We talked about the dog thing, and and you know,
there was more the dog lovers out there were very
upset by this. People that come from certain more rural backgrounds,
on the ranch or whatever were sometimes a little more
okay with it, sometimes even the supportive of it. Although
I could present to you she lied about that too,
Just so everyone's all clear. She just changed that story too,

so everyone's clear. I actually heard the audiobook narration of it.
She was angry at the dog for being bad at hunting.
The whole it was a danger to my kids thing
after the fact, But that's what I'm saying. The story
just keeps changing instead of saying I made a mistake.
And now you're saying, well, why are you talking about
it today? I don't know. Why is Fox News leading
with the last night? She keeps getting what you're blaming
if you blame us for talking about this, aren't there

more important things than her going on TV at this
moment in an election cycle that she's not even in
to try to clean up her mess. She's forcing herself
into the news cycle and keeps on making it worse,
keeps digging. And so after the dog thing, we weren't
going to talk about it again. And as I said,
if she had come forward and said I take full responsibility,

that was not the right way to put it forward.
Anybody would be crying their eyes out if they had
to shoot their own dog because of, you know, whatever,
these things that she was saying. I would have said,
all right, fine, but that's not her approach. And you know,
one thing is whether it's about will will it change
of the speaker of the House? Fix fix everything?

Some people wanted to hear that, some of the base
wanted to hear it. We said no, and it didn't. Obviously,
Now Marjorie Taylor Green's backed off getting rid of the
new guy Johnson. I mean, you know, this is a mess.
But we speak the truth as we see it always
and that comes from a respect for everyone who gives
us the time to listen. We speak to everyone as
peers and as fellow patriots and as people who love

this country. There is no condescension. We're all missed together.
We're all a team. Clay and I talk, You listen,
but some of you call in an email. You're all
a part of it too. We're all a team in this.
When you have a governor of any state going on
TV and you know, getting aggressive, lying to people's faces,
making it look making everyone look foolish, that bother me,
that's all. That's fundamentally that That's where I am with

this now. It's just so obvious and I'm happy to
never talk about it again. But I'm not going to
take any Oh but what you you know, maybe she
did meet with Kim Jong Unn. No she didn't. She
is lying. Okay, we operate in reality here, and the
fact that she's in a like got in a huff
with Stuart Varney British mister Rogers is a great way

of describing it thank you is I mean, she's losing it.
But I get I do get the frustration here because
you know, we have the whole horrible Biden economy and
we're going to talk about Bidenomics, and we have the situation,
we have all these big things going on, but the
news cycle is being focused on that has been focused
on this issue, not by us. And we will move

(32:45):
on to other things, assuming that we don't have more
primetime interviews where the Republican base is being lied to
by somebody who refuses to take accountability and refuses to
speak the truth. And it is that simple. So uh
jd vanced, Tim Scott, Tulsi Gabbard on I mean people,
If anything, I'm probably too pro Tolsi like, we have
so many people on the show that we're trying to

(33:05):
always elevate show in the best possible light because we're
all on the same team. There are limits to this, though, right,
There are limits to oh well, you know, like I said,
if someone shows up dunk drunk to practice on the
football team, it's not oh, we're all in this together.
It's there's got to be accountability. Argue with us if
