coming up here in just a moment, but first it
needs your help and welcoming. Bruce el Shiner, Attorney for
the Injured. Good morning, Bruce.
Speaker 2 (00:19):
Hey, good morning, Cad. How are you doing this morning?
Speaker 3 (00:21):
Excellent? Just excellent? How about you?
Speaker 2 (00:25):
I'm doing better than that.
Speaker 1 (00:28):
I was trying to think how you could one up excellent,
But then again, you're Bruce Shiner, mister positivity, so I
should have known.
Speaker 3 (00:34):
I just should have known.
Speaker 1 (00:37):
Your legendary positivity, wisdom, knowledge, experience with the law definitely
going to come into play with this question that we
have today. And it's also something that I've often wondered
about myself. Are you ready to get into it?
Speaker 2 (00:49):
I am ready to.
Speaker 3 (00:50):
Here's what our email says. Today.
Speaker 1 (00:53):
My daughter and a friend were biking on Tammy Emmy
Trail when a food delivery driver pulled out from a
shop plaza and knocked her over. My daughter has a
fractured wrist, collar bone, and fractured knee, which we'll need surgery.
The driver was on a delivery for a third party app.
The driver told police he was on a delivery. His
(01:14):
insurance denies the claim because he wasn't covered for using
his car for deliveries.
Speaker 3 (01:20):
Can a lawyer help prove that he was working at
that time.
Speaker 1 (01:23):
I'm sure you've dealt with this before as sort of
a no brainer to you, but this is awful confusing
to me.
Speaker 3 (01:28):
What do you make of this?
Speaker 2 (01:29):
Well, you know, today, in today's world, there's so many
delivery drivers working for companies like Overeats and other apps,
and unfortunately these guys and ladies are are not paying
attention because they're more concerned about delivering what they have
(01:53):
to deliver and finding an address.
Speaker 3 (01:55):
And getting the quickly.
Speaker 2 (01:57):
Yeah, so they're not sayings like they should be and
a lot of times they don't even realize it. But
their own personal insurance doesn't cover because there's an exclusion
for commercial use of the vehicle. But fortunately these apps
(02:20):
all have pretty high levels of insurance, so the victims
are covered. But you need an experienced personal injury lawyer
to be able to navigate through that, get to the
right company and you know, make a substantial recovery for
(02:42):
these people. I think you know, someone injured like that
is entitled to get all their medical bills that they've
incurred in the past paid, and the future medical bills paid.
Loss of income if they've been working, and the big
eye that is pain and suffering for all the aggravation
(03:05):
that they're put through. Sure, but there is light at
the end of the tunnel for this poor person. They
just have to, you know, connect with an experienced personal
and lawyer.
Speaker 3 (03:17):
Well, I'm really glad to hear that.
Speaker 1 (03:18):
Like I said, I've often wondered about with all the
I mean, I use delivery services just as much as
the next person. I've wondered are they adequately covered? I know,
when I sign up a renew insurance there's all kinds
of exclusions. You can't participate in a timed raise, you
can't make deliveries, that kind of thing. But the delivery
company should have this covered, is.
Speaker 3 (03:37):
What you're saying.
Speaker 2 (03:39):
Yes, And in my experience they all do that pretty
substantial coverage.
Speaker 1 (03:44):
Good good, good, But like you said, getting hold of
somebody at that company who can help in this case.
You need a pro absolutely all right, Bruce well, thank
you for enlightening us. I feel better about the situation,
the scenario, and I feel better about my own knowledge
of this.
