How are you doing this freezing morning?

Uh? I like you a little chilly, but I like
the change in the weather something different, so I'm not
going to complain.
Speaker 2 (00:30):
Well, I don't think this is high on the chamber
of commerces.
Speaker 1 (00:35):
This is when we're trying to keep a lid on
so that everybody else doesn't find out. We have our
cold days too. I get you, I get you. Well,
we've got another email here with somebody who has gotten
into a little bit of trouble. Thought we might be
able to help out. Would you like to hear today's question? Yes, sir,
all right, Here's what it says. My sixteen year old

daughter was skateboarding on the sidewalk when someone backing out
of a driveway on Midway Boulevard hit her. She suffered
a fractured wrist, a concussion, and a spinal compression fracture
out The driver claims they didn't see her, and their
insurance is denying responsibility, saying she shouldn't have been skateboarding.
There can a lawyer help clarify her rights. You know,

we have questions all the time about bicyclists, motorcycle riders.
Skateboarding hasn't come up an awful lot. What do you
make of this?
Speaker 2 (01:28):
Well, you know, we're still in the United States of America,
and I'm not aware of a law that prohibits our
young people from skateboarding, right, So I think that, as usual,
the insurance company has come up with a croc in

order to deny another claim. This person wasn't careful in
backing up, and you know, is negligent in causing these
significant injuries to this nice young person.
Speaker 1 (02:03):
If that was a bicycle rider or a pedestrian, it's clear.
So a skateboarder must fall into that kind of same philosophy,
same idea.
Speaker 2 (02:13):
Yes, of course, Okay, they have a free use of
the sidewalk, and any motor vehicle has to be careful
look where they're going, you know, It's not a free
day to wipe out skateboarders. If this person is entitled
to make a recovery or medical bills which are going

to be significant past and future pain and suffering inconvenience,
you know, this person was horribly negligent and really interfered
with this nice skateboarders life and causing these injuries.
Speaker 1 (02:52):
I'm glad you mentioned future too, because I was thinking
as a sixteen year old, she's got a lot of
life ahead of her, and who knows what kind of
long standing injuries may come out of this, and they
need physical therapy, that kind of thing down the road,
But that can be covered in this instance absolutely. Okay,
it does begin with contacting a professional because obviously the

insurance company is not going to work with the individual, right.
Speaker 2 (03:17):
They're not going to work with the individual. They already
told them. Yeah, that's true. In the United States, you're
not allowed to skateboard on the title.
Speaker 1 (03:25):
Apparently, not skateboard on the grass. That's safer. Listen, Bruce.
