How would you explain RFRA (i.e., the Religious Freedom Restoration Act) to a kindergartener?

(Scroll down for the answer)

Answer:  Here’s how the Supreme Court succinctly summarized RFRA in 2020:

The Religious Freedom Restoration Act of 1993 (RFRA) prohibits the Federal Government from imposing substantial burdens on religious exercise, absent a compelling interest pursued through the least restrictive means. 107 Stat. 1488, 42 U.S.C. § 2000bb et seq.

Tanzin v. Tanvir, 141 S. Ct. 486, 489, 208 L. Ed. 2d 295 (2020)

(00:01):
Welcome to another episode of the Religion Law Podcast, where you learn about
religious freedom and other religion law-related topics through a short question-and-answer format.
I'm your host, Michael Fielding.
Let's see how you do on today's quiz.
All right, welcome to Religion Law Quiz number 103. 103, as I mentioned,

(00:27):
we are going to be talking, or we are talking about the Supreme Court's 2020 Tanzan v.
Tanvir decision that dealt with the Religious Freedom Restoration Act, RFRA.
And as I've done on a few quizzes, I think it was number 91 and maybe 96,
you know, we always like the idea of how do you explain something to a kindergartner?

(00:48):
Because if you can explain it to somebody like a kindergartner or somebody much
less educated to you, and if you can explain it in easy-to-understand terms,
then that means you actually understand the concept.
And so we're going to ask that question for you today.
How would you explain RFRA, i.e. the Religious Freedom Restoration Act, to a kindergartner?

(01:10):
And the reason that is so important is because RFRA RFRA is a super important statute.
It's been adopted by several states in the country, but not all.
There are some states that don't have their own state RFRA decisions.
But we need to understand what RFRA is. And so the question is,
how would you explain it to a kindergartner?
Well, here's how the Supreme Court did it in 2020 in its decision.

(01:35):
Again, this is Tansin V. Tanvir. I'll have a citation in the show notes to the podcast,
quote, the Religious Freedom Restoration Act of 1993 prohibits the federal government
from imposing substantial burdens on religious exercise,
absent a compelling interest pursued through the least restrictive means, close quote. So.

(02:00):
What does that mean in layman's terms or stated differently?
And here it is. If the government wants to impose a burden on your practice
of religion, stop you from doing something that your religion would otherwise
say you need to do, then the government has to have,
number one, a compelling interest, which I like to put in layman's terms of

(02:21):
something super, super, super important, a super, super important compelling
interest for the government.
And the government has to do it through the least restrictive means.
So, in other words, the government has to do the minimal amount needed to accomplish
its goals so that it essentially minimizes the impact on your practice of your religion.

(02:45):
That's it in a nutshell. Now, that's me, Mike Fielding, explaining it to you.
My challenge to you is how would you explain RFRA to a kindergartner?
Just pause and think about that.
How would you explain it to somebody else? Because this whole concept of RFRA
is a core underlying point that just really pervades the practice of religion

(03:11):
in the United States today vis-a-vis religion and government regulations.
Okay, that does it for today's quiz. Short, but important.
