I get a little bit upset about stuff. So I'm

better now, It's okay. At the Inner Ratio a couple
of weeks ago, I grab some good interviews and one
of them with har Meat Dylon. She's the Assistant US
Attorney General at the Department of Justice, and she is
I don't know, somewhere between a crocheting bulldog because you
post pictures of all the crocheting he does there and knitting.

(01:01):
But she is tough as nails. It was a fun interview.
Here you go. Hey, we the NRA annual meetings in Houston,
and unbelievably we have well It's easy to say rock star,
but you are Harmy. Dillon is the Assistant Attorney General
in charge of Civil Rights Division, and within that you
have the Second Amendment Section. Now we talked at Shot Show.

(01:22):
Things have been happening since Shot Show. The big thing
everybody wants to know about is what's going on in Virginia.

Speaker 3 (01:29):
Yeah. Well, you know, Virginia used to be a place.

Speaker 4 (01:31):
I mean, of course it changes hands with the governor
every four years, but it used to be a place
where hunting was respected. You know, I have colleagues in
my office who have a you know, AR fifteen's and
their homes and and you know, you know, enjoy hunting
and enjoy self defense. And suddenly we have this new

(01:52):
governor who is in the mode of a California or
a New York style crackdown on fire arms, and so
she has encouraged legislature to send her this package of
radical bills that really strip not just gun owners of
their freedoms, but also take square at gun manufacturers, require

(02:16):
gun owners to render their firearms inoperable, you know, imposed
liability that is at odds with federal law regarding manufacture,
and even a law that impacts so called ghost guns
and gun manufacture of parts. And so this package of
bills is very radical, and you know when I learned
about it, I sent after the legislature passed their package,

(02:40):
I sent a letter to the governor on just like
last week of less than two weeks ago, warning her
that if she signed some of these bills, we would
file suit. And so she has signed two of these
bills that I think are concerning. She sent the so
called assault weapons ban back to the legislature with some

(03:00):
technical admits, right, make it worse it worse.

Speaker 3 (03:03):
Makes it worse.

Speaker 4 (03:04):
Since she hasn't gotten that back yet, and even if
it gets past the other sneaky thing about the legislature
and the governor's scheme is that they have a referendum
going on right now regarding redistricting. So they've literally set
the effective date out of these bad bills to be
just beyond.

Speaker 2 (03:21):
That because they don't want to be judged on the
gun ban. They don't want people to say, oh, you
did of a gun band, so we're going to vote against
you on that. Right. I want to set this up
make sure that people understand because I was there thirty
years ago when the gun control group I call them the
gun band Lobby, instituted a number of lawsuits against manufacturers,
and they were very clear at the time. They said

(03:43):
was our plan is to put them out of business.
We want to bankrupt entire industry. And that's how we
got the Protection Lawful Commerce and Arms Act, a federal law,
which goes to you're saying, what they're trying to do
at the state level actually is in conflict with federal
law now well.

Speaker 4 (03:59):
On the liability protections for gun manufacturers. So you know,
what this does is basically eviscerate.

Speaker 3 (04:06):
That federal law.

Speaker 4 (04:07):
And I think that's a real problem because federal law
is obviously supreme in our system of government visa the
state law, and so I think that's a very easy
knockout for that particular law. But I mean, imagine if
you have the right to bear arms, but they're criminalizing
magazines that are widely in use. California has effectively rendered

(04:29):
blocks a firearm. I have two blocks. I bought them
in California. Now I can't go back to California with them,
you know. So, I mean, these are real problems for
gun owners. And the Supreme Court has recognized that the
right to any particular right. Is it nugatory if you
can't buy it, or acquire it or enjoy it. I mean,
what if you have a right to, you know, drink alcohol,

(04:52):
but no one's allowed to manufacture it in the United States.
That's kind of an empty right. So I think it's
kind of a similar situation.

Speaker 2 (04:58):
All right. So as they try to ban semi automatic firearms,
they'd like to call it your ars. But basically I'll
send me automatic firearms. And the Supreme Court and Heller
said you can't ban guns that are in common use
for lawful purposes.

Speaker 3 (05:10):
Right.

Speaker 2 (05:12):
Is this where doj steps in and says, wait a minute,
you can't do that.

Speaker 3 (05:16):
We've already done that. Actually we aren't waiting on this issue.

Speaker 2 (05:19):
Now.

Speaker 4 (05:19):
The Court hasn't squarely ruled as a whole Supreme Court
on semi automatic rifles, but Justice Thomas has separately opined
in cases, and you know, including recent cases, that the
AR fifteen is the most widely used in popular rifle
in the United States, and by definition and the extension
of the holdings in Heller and Bruin, you.

Speaker 3 (05:42):
Know, it's presumptively legal.

Speaker 4 (05:44):
And that's exactly what I argued in the Seventh Circuit,
Seventh Circuit, there was the Illinois Assault Weapons Ban, so
called assault Weapons Band, similar to the law that Virginia
is about to pass, and it outlaws, you know, over
a thousand in different types of firearms and firearm parts, silencers,
et cetera. And you know, we argued in that case

(06:07):
more than six months ago. I personally argue Seventh Circuit.
I argued in the Seventh Circuit. I think we have
a very good argument. The judges didn't love it, but
you know, the judges understand that that's where the court
is going. The court is going. I think if that
case we're in front of the Supreme Court, a majority
of the court would have ruled that consistent with those
prior precedents, the AR fifteen meets that test or similar firearms, right,

(06:31):
So I think that's where the Court's going. And so
we just have to frankly pray that this court gets
that case and that these justices get the opportunity to
current make with its current makeup, or better to imagine it.

Speaker 2 (06:45):
All right, let me switch to something that's a little
bit more fied. Okay, you're posting pictures of you out
there shooting. Yeah, you're having a good time shooting.

Speaker 3 (06:52):
I am having a good time shooting.

Speaker 4 (06:54):
I'm a firearms owner and I brought my firearms with
me from California, and I I have a CCW permit
for all of my you know, pistols in DC can't
carry them very far, but you know I can't carry them,
and you know, I just like to keep in good practice.
We can always improve. So I had an NRA female

(07:15):
firearms instructor meet me at the range out in Fairfax, Virginia,
which is a significant distance. So like my assistant and
I had to take them half a day off and
go drive out there and tried out. I tried out
to twenty two. I don't have a twenty two. I
have all nine millimeter firearms, but I took a couple
of mine and I tried a couple of hers, and
you know, we had a good time, and I was

(07:36):
just trying to get a sense of you know, what
range I'm accurate at. Obviously for self defense in the home,
it's a short range, but you know, for other purposes
you want to be good. So anyway, I got a
little bit of a flack from your online community on
the quality of my shooting and my aim and my
stance and so forth.

Speaker 3 (07:54):
That's why we trained, That's why we train.

Speaker 4 (07:56):
And I think, you know, I do think it's important
that the community encourage women in self defense. And you know,
women often field more comfortable training with other women, women instructors.

Speaker 3 (08:08):
We need more women instructors. Yes, I have a good friend.

Speaker 4 (08:10):
Who's a female instructor in California. And you know, we
have to enjoy these rights proudly. And so I encourage
all women who are watching this to not be deterred
by the male critics out there, and you know, go
out there and get it done. And you know, I
mean I got a lot of feedback.

Speaker 2 (08:31):
Okay, and you can't say but I could say it,
and all you guys knock it off. You know, when
a new person is learning to shoot, we all started somewhere,
We all were not terribly good. But to somewhahow mock
or hold up to ridicule somebody who's trying to learn
doesn't make you look better. It just makes you look less.

Speaker 4 (08:51):
That Yeah, I mean, look, I'm pretty, I'm not very
thin skinned, and you know, I let's just say it
had been a few years in California it's become increasingly
difficult to get to a range. So my husband and
I had the firearms at home, but to get to
a range you have to like drive three counties over
and so you get out.

Speaker 3 (09:08):
Of practice a little bit.

Speaker 4 (09:10):
So I've had the opportunity now since that went viral.
If my local US marshalls people were like, hey, there's
an FBI firearms range right across the street, this Dylan.
So they've taken me over to the FBI range and
so I've had the opportunity to train and get feedback
from some of our FBI experts. And you know, the

thing I'm debating now is to whether to put those
red dot sites on my leapons or.

Speaker 2 (09:36):
That's a whole that's how we start bar fight.

Speaker 4 (09:38):
I was actually more accurate with the manual site and
not the electronic one.

Speaker 3 (09:45):
So I'm kind of debating.

Speaker 2 (09:46):
That's a transition and when you start it's a little
bit more different. Let me ask you here before we
have to get out of here, what are you doing
at the NRA show? What are you doing here?

Speaker 5 (09:54):
Well?

Speaker 4 (09:55):
I actually am speaking in a little while at the
legal seminar that's happening on just you know, second Amendment
legal issues at the Department of Justice and what we're
doing and how we're ramping up.

Speaker 3 (10:06):
Everybody has an opinion. But I was there in the
morning and my colleagues at ATF also spoke.

Speaker 4 (10:11):
On a panel, and we're very committed at the Department
of Justice to standing up for Second Amendment rights.

Speaker 3 (10:17):
And so I'm here.

Speaker 4 (10:18):
The Acting Attorney General is here, Todd Blanchees here as well,
and a couple of his staff.

Speaker 3 (10:23):
I just saw them walk by.

Speaker 4 (10:25):
And you know, we were at SHATCHO, several of us
and one of my colleagues, my former law partners, is
a Deputy White House Counsel, Garylkowski.

Speaker 3 (10:34):
He's here.

Speaker 4 (10:35):
He and David Warrington, the White House Counsel, and I
all represented National Association or Gun Rights. So we are
longtime advocates for the Second Amendment community, and we're pretty
passionate about it.

Speaker 2 (10:46):
So I have said several times, and I've done this
for a long, long long time. I mean, my dad
interviewed President Reagan in the Oval Office about guns. So
that's how far back this goes. This is the most
pro Second Amendment administration we have had period as far
back becaus you can look back at hoh Shtree.

Speaker 4 (11:04):
I think that's right, and you know, the President's sons
are hunters, and there's just a lot of love for
the community. The President passed an executive order very early
on in his administration regarding the Second Amendment, and that's
why we have a Second Amendment section in the DOJ.

Speaker 3 (11:19):
We and people are very impatient in the community. They're like,
why now do this? Now do that?

Speaker 4 (11:24):
Now?

Speaker 3 (11:24):
Do that? Nook.

Speaker 4 (11:24):
We We're hiring up. We've hired some lawyers from the
Second Amendment community. Barry Errington from National Association of Gun
Rights just joined my department earlier this month, and so
we're drafting these lawsuits and filing them as fast as
we can. Even before we had the Second Amendment section,
I sued Los Angeles County Sheriff's Department for taking three
years to issue permit permit that should be shall issue quickly.

(11:48):
We filed an amicus brief in the Wolford case in
the Supreme Court, where Hawaii has, you know, made it
virtually impossible to carry under its flipping of the presumption,
and I'm very confident of a good outcome there. I
believe the court was very skeptical of Hawaii's position, and
you know, other places we look for opportunities like the

(12:09):
Illinois case I mentioned, and like others. And so we
have some bad circuits, like Virginia is doing what it's
doing because the Fourth Circuit Court of Appeals has some
very bad precedents. But you know, Fourth Circuit can't ignore
it Supreme Court eventually, so we have to.

Speaker 3 (12:21):
Bring these cases. Sometimes you lose them. Then we get
them up to the Supreme Court.

Speaker 2 (12:24):
And it is a long fight.

Speaker 4 (12:25):
It's a fight requiring a multi year and institutional commitment,
and that's what we have. We have three years left
to go.

Speaker 2 (12:34):
But I want it all and I want it right now.

Speaker 4 (12:36):
I know, I know, and you know nothing is permanent.
People also need the owners need to understand we have
a good Supreme Court right now because we have a
great president administration and if people sleep on those rights,
they will be taken from us, no questions ask.

Speaker 2 (12:52):
Bard that end. The way you make them somewhat more
permanent is to win the elections and get things done legislatively.

Speaker 4 (12:59):
That's right, that's right too. We get a lot of flack,
why are you doing this? Why are you doing that?
Like we can do certain things at the Department of
Justice to attack bad state laws. We can't change federal
law through our activity. That's for Congress to do in
the president.

Speaker 2 (13:13):

shoot that fast, stuff But i'm not very good at,
that that's. Okay find where they're doing a steel. Challenge
it is the easiest thing in the. World you got
five steel targets and you can shoot a, pistol you
can shoot a twenty two, rifle you can shoot, drawing
you can shoot from low ready if you don't want to,
draw a lot of different ways you can go and

there will be people who are incredibly. Fast don't worry about.
It you don't have to be. Fast you can just
you're there to have. Fun at least that's the WAY
i approach. It the other Thing i'm with thinking that
you might want to try because there's a lot of
interest in long range, shooting and there's a lot involved.
There there's a lot to, learn and the learning part is,
fun and you just. Go you, KNOW i don't know

Sir? WELL i am. Good i'm better off than you
are because you're In virginia and you're having to put
up with that mess that's going on for somebody who's
not paying. Attention does you already know haven't been living?
There how do you explain what's happened In?

Speaker 13 (23:06):
Virginia probably the best way to explain it is That
democrats are trying to turn us Into california Or New.
York in the span of you, know one legislative. Session
so we had thirteen different gun control bills that were
passed by the legislature this.

Speaker 2 (23:25):
Year.

Speaker 13 (23:27):
And you, KNOW i suspect that all of them in
some shape or form going to become law as Of
july the. First and so this is everything from a
ban on In. Virginia they call them assault firearms and
large capacity, magazines where they've arbitrarily defined as anything over fifteen.
Rounds you've Got reciprocity is in danger now because The Attorney,

(23:50):
general it was extremely anti, gun is basically going to
be able to determine what statee spermits will. Recognize right
Now virginia's universal. Reciprocity we've got storage mandate's going to
effect gun, bands f eighteen to twenty year olds who
can no longer purchase handguns in private. Sales you've got

new carry. BANDS i, mean it's really you, know from
from top to, bottom they have just completely tried to
rewrite our gun.

Laws it sounds like the complete shopping list of the
gun band.

Speaker 13 (24:22):
Lobby the amazing thing is that they didn't pass everything
that was. INTRODUCED i guess they're saving some stuff for next.
Year but you, know they also had things like an
eleven PERCENT xis ax on farms, ammunition a five hundred
dollars tax on the purchase of, suppressors a permit to,
purchase a requirement for, handguns perhaps even all. Firearms so

you know there's more to, come, unfortunately but this really
is bad. ENOUGH i, mean this is a sea. Change
we've gone from a state with you, know pretty decent gun,
laws not constitutional, carry but you get open carry without a.
Permit there were no gun, bands no magazine there or capacity.
Restrictions for a, while we had one gun a, month
but then that went away and then went. Back but

(25:06):
the conscuco carro holders were, exempt and then you, know
LIKE i, said they're they're essentially trying to turn us
Into New. Jersey the one thing That i'm really surprised
we didn't see more of are are the establishment of
gun free. Zones there is one bill that essentially bans
the open carry or the carrying of quote unquote are
sold firearms on streets and sidewalks in the public. Parks

BUT i really expected that we would see legislation you
know that looks very similar To, maryland looks very similar
To New jersey in terms of restricting where concealed carry
holders can exercise the right to bear arms In.

legally own one if this you, know bill takes, effect.

in your, vote you support candidates that are going to

support The Second. Amendment you do what you can beyond,
voting whether it's cut and, check whether it's volunteering for

involved in the political, process, right that's the first. Step
and then, again get. Organized we are lucky to have

some first rate organizations of the state. Level and you,
know if you're not a member of a, group like In,
virginia we've got The Virginia Citizens Defense, League you've got
The Virginia Shooting Sports. Association if you're not a member
of the state level group in the state where you,
live then you need to get involved because they need.

to tell you the quick and easy way to, go
and it's going to be easy for you it's just
put a red dot on. It now you can adjust,
it do whatever you want to do with, it.
