I've been a licensed firearm todoula for the last 18 years.
In this podcast, we talk about.
All things related SecondAmendment, as well as anything
else going in the world, asports story or anything else
that I might find interesting.

So been a beat since I did anepisode.
Things have been just a littlecrazy around here.

Been a little out of outta myroutine.
Some things, you know.
Have transpired in all honesty.
Along with that and the CharlieKirk assassination just been a
little off and haven't reallybeen able to get back into the
groove again.
But, but here we are, we'resitting down recording something
that I'm, should have talkedabout last week when this really

developed.
But it's, it's such a big thing.
At least it's always been one ofthese things that's been on my
radar that I wanted to talkabout and, and.
And what is that?
Well, we got a massive victoryjust last week.
And what we're talking about isa recent ruling in the Firearms
Policy Coalition Inc.
Et all versus Bondy.

There's, this is where a federaljudge just struck down the
ridiculous ban on, on carryingfirearms and post offices and on
postal property, and if you everlike felt like big governments
turning every corner of yourpublic life into a gun free
zone.
Well this one's for you.
So let's break it down.
So first, here's the quickbackstory on the case, the

Firearms Policy C Coalition, andthose guys do great work.
Along with the Second AmendmentFoundation.
Another great group and a coupleTexas citizens.
Gavin Pate and George Mandrifiled a lawsuit back in 2024.
These guys just like you and me,law abiding folks, conceal carry
license, who wanted to exercisetheir right to self-defense

anywhere they go including whenthey were dropping off packages
or buying stamps.
But no, the Fed said not in ourpost offices.
And so they were challenging twokey pieces of, of regulation.
The US Postal Regulation from1972.
That bans firearms on any postalproperty, including parking lots
and a, and a federal statute 18USC nine 30 a, which makes it a

crime to possess a gun infederal facilities like post
offices.
And you violated and you'relooking at jail time or fine.
Cr crazy, right?
The defendant, well it wasoriginally a, it was Merrick
Garden Garland and now you knowit went to Pam Bondy and has
heard role as Attorney Generaland you know, yes, things change

at the top.
The fight stays the same.
These plaintiffs argued thatthis blanket ban violates the
Second Amendment, especially inlight of the Supreme Court
Bruins decision back in 2022.
For those who need a refresher.
Bruins said that any gunregulation has to pass a history
and a tradition test.
The government can't just makeup rules.
They have to show that similarrestrictions existed when the

Second Amendment was ratified in1791, and this is where it gets
good.
Chief Ju district Judge ReidO'Connor in the Northern
District of Texas, God blessTexas, handed down this ruling
at the end of September, just,you know, a few weeks ago, and
he applied the room test justlike a hammer.
Step one, does the SecondAmendment cover carrying her

firearm for self-defense in apost office?
Absolutely.
It's presumptively protected.
Step two, can the governmentprove that this ban lines up
with any of our nation'shistorical traditions?
Nope.
Not even close.
Judge O'Connor pointed out thatpost offices have been around
since before the founding.
Ben Franklin was the firstpostmaster general in 1775 for

crying out loud.
And there were threats in themail back then, like robberies
and disruptions, but did thefounders ban gun and post
offices?
Nope.
They didn't even think about it.
The first Royal Federalbuilding, federal Building, gun
bans didn't show up until the1960s, and the postal specific
one was in 1972.
That's way too late to count.

(04:09):
As a tradition, the governmenttried to argue that post offices
are sensitive places likeschools courthouses or polling
places where Rahimi and Bruinsay some restrictions might,
might apply, but the judge shutthat down.
He said Post offices aren'tdoing heavy duty government
business like trials orelections.
They're just places whereregular folks handle everyday
mail.
No historical analog means noban.

(04:32):
They even tried, that this thelame property own argument that
the government owns the buildingso they can do what they want
under property clause or postoffice clause.
Judge O'Connor, he wasn't havingit.
The postal service is still agovernment actor bound by the
Constitution.
You can't just wave away theSecond Amendment because you own
the dirt under the building.

(04:52):
Boom.
Unconstitutional as applied tocarrying firearms in ordinary
post offices and their property.
We're talking your standardneighborhood post office, not
ones on military basis or onrestricted federal complexes.
And the final hammer to drop thecourt granted summary judgment
to the plaintiffs, denied it tothe government and issued a
permanent injunction.
That means the feds can'tenforce this ban against FPC

(05:14):
members or the in individualplaintiffs in these ordinary
post office.
It's a targeted wind, but it's acrack in the armor of all these
arbitrary gun zone.
So folks, this is huge.
It shows that post Bruin.
The courts are finally holdingthe line against overreach.
No more treating law abidingcitizens like criminals just for

(05:36):
wanting to protect themselveswhile picking up the A certified
letter.
Imagine the implications if postoffices aren't off limits.
What about other public spaces?
The Antis love to disarm SinParks, libraries.
This ruling reinforces theSecond Amendment.
Isn't a second right class,right?
Second class, right?
It's absolute.
And the burden is on thegovernment to justify the

(05:58):
infringement.
Of course, you are gonna expectappeals.
The Biden era holder ofs orwhoever's left in the DOG might
fight this tooth and nail.
But I don't know, with Bondy atthe helm, who knows?
Either way, it's a reminder.
Join groups like FPC orS-A-A-F-A support these lawsuits
and stay legitimate.
