U.S. District Court Judge George O’Toole, who proceeded over Tsarnaev’s death penalty case, is in the midst of investigating whether two jurors were biased during the 2015 trial. The Bomber’s defense attorneys are pushing for the death penalty to get thrown out and are seeking a recusal for Judge O’Toole, who they claim made comments about the case on podcasts and during public events.
