ruling state? Pretty much the exact opposite of what everybody thinks.
It states the tariffs were not struck down today. In fact,
nobody knows exactly how many tariffs were struck down. Best guests,

roughly sixty percent of all of President Trump's tariffs. In
a six' to three decision today authored By Chief Justice
John roberts and joined in his opinion, by of, course
The court's three, liberals but also you Had Amy Coney
barrett as well As Neil gorsich joining the. Majority, here

The court ruled that what is known AS. Iepa you
have probably HEARD iepa mentioned quite a. Bit, no it
is not the new female rapper who's tearing up the.
Charts it is Ieepa International Emergency Economic Powers. Act this
is a law from nineteen seventy, seven and in basic,

terms what the court ruled was THAT iipa does not
authorize The president to imposed triffs in the way that
he did. So NOW iepa specifically says that The president
does have the inherent authority to regulate importation during a
declared national, emergency but that this power is not granted

to him unilaterally to impose tariffs of any unlimited scope
or amount or. Duration in, fact the court rested heavily
on WHAT i believe the correct interpretation of The constitution.
Is congress has several enumerated powers that are expressly granted

to it Through article, One section. Eight the very first among,
these The congress shall have power to lay and collect, taxes, duties,
imposts and excises to pay the debts and provide for
the common defense and general welfare of The United. States

this means that all tariff authority comes from The. Congress

and it can only delegate its authority in a limited.

International Emergency Economic Powers ACT, aepa, though only allows for
executive imposed terrorists without the consent of The congress under

the traditional definition of that is the obvious. One if
we are at war with a country and we need
to economically punish, them we can't wait For congress to.
Deliberate we can't wait through the possibility of A senate.
Filibuster The president needs to, act and he needs to
act very very. Quickly this is why we have emergency.

Powers but The president saying that there was a significant
trade balance or imbalance with certain, countries or the fact
that The United states was importing far too many goods
that didn't have a specific national security component to, them
that is not enough to trigger what is a true.

Emergency The president also claimed in his argument before the
court that there is an inherent authority to set trade
policy via. Tariffs, so in, short there's no emergency that
would have necessitated the seizure of this expressly delegated power
to The. Congress this, is broadly, speaking the correct. Answer

this is the correct ruling from The Supreme court on
the merits of what it was that was brought before the. Court, now,
this you might, recognize says nothing about the wisdom of,
tariffs about the policy impact of, tariffs about the national
security impact of, tariffs because there is a set aside
for true national security apparatus need for a, tariff and in,

fact all of the tariffs that The president put on
things that are in the national security supply, chain things
that we would need in case there is a war

An Emergency Economic Powers. Act, essentially there was no. Emergency in,
fact there was a fantastic question that was raised during
ear oral arguments of this case a couple of months

wrote a concurring opinion and joined with the majority in
striking down the president's use OF. Iepa he actually, asked,
well what if A democrat president said there was a
climate change? Emergency could said president then declare that we
need to have ninety five percent tariffs on all things

that go towards polluting industries manufacturing in an effort to
assuage the devastating impacts of this climate. Emergency it was
a fantastic, question and this is what sort of gets
to the heart of what this constitutional issue is ultimately all.

said today he's going to sign an executive order imposing
under this section a ten percent global tariff over and,
above he, said are normal tariffs already being. Charged, now
what this provision does is it acts sort of like
an emergency. Authority The president is allowed to impose up

to a fifteen percent tariff on all imports up to
one hundred and fifty days to address quote large and
serious balance of payments. Deficits this is What President trump
should have used all along and then gone to The.
Congress after one hundred and fifty, days the tariffs expire

under section one twenty, two we want these tariffs to,
continue the tariffs. Continue there is also section two thirty
two of The Trade Expansion act of nineteen sixty, two
and this is Why President trump's existing tariffs that are

based on national security steel aluminum is another big. One
those remain in full. Force Both trump And Treasury Secretary Scott,
bessant as well as THE Us Trade representative all stressed
today that these are going to, continue and in, fact
all of them have survived prior legal. Challenges today during

his press, Conference President trump said exactly what he was
going to, do including using section three oh one of
The Trade act of nineteen six seventy four to launch
investigations into unfair trade. Practices that is another avenue by
Which President trump can act unilaterally and THE Us Trade

unfair trade practice looking at, You, china that would be
the one that The president would be able to turn
to and, say, okay well we can identify all manner
of unfair trade practices That china is engaged. In so

Justified we had no idea how SERIOUS covid nineteen was

safer At home order under this public health, emergency actually

State Supreme. Court safer At home order was declared to
be null and void and un constitutional because the public
health emergency had expired and the state legislature had not.
Consented When Governor evers decided that he wanted a statewide mask,
mandate and you might remember that initially leftists were not

about i'd, say about five six months into the, pandemic
actually probably About, midsummer when they decided that everybody needed

without having to go through the state. Legislature it was
one of the most egregious oversteps of executive authority in
the history Of. Wisconsin it just was the governor was

pretending there was a new. Emergency there clearly was no.
Emergency by the summer of twenty twenty, one there was
no emergency with respect TO covid. Nineteen so it would
be awful hypocritical FOR us conservatives to, say all, right,
well we hated the fact that the governor Of wisconsin
was declaring phantom, emergencies but we love the idea that

The president of The United states is, saying, well because
we have a trade deficit with all of these, countries
this constitutes a national. Emergency it. Doesn't and the court
was correct in, that and the court actually stuck up For.
Congress congress has delegated a whole lot of its authority on,
tariffs which is expressly and explicitly authorized and under The,

constitution exclusively the domain of The congress to levy taxes
and to levy, tariffs to levy. Duties this Is congress

are the specifically enumerated powers of The United States. Congress

is part of the power of the. Purse so if
this is raising money for The United, states it falls

that you're able to circumvent this If congress doesn't explicitly
say to The, President, okay in this specific, authority in

there has to be an actual. Emergency and there clearly
wasn't any sort of. Emergency but the big question now
is what exactly is going to happen to all of

billion dollars in tariff revenue that is now in.

even going to deviate from my planned remarks on terrists
because fundamentally nothing is going to.
