(00:45):
personally came before me to undersigned notarypublic. Hector, having been duly sworn
according to the laws of the countryof Mexico, does make the nose of
truth to the following half David's statements. My full legal name is Hector.
My day of birth is I wasborn in the city of Encarnacion de Villas,

(01:11):
Jalisco in the country of Mexico.I currently live in Tijuana, Mehico.
My BI California driver's license number ismy Selluar phone number is. I
am making this affidavit of my ownfree will, without pressure from any individual
or source. At the time ofthis statement, I am not under the

(01:33):
influence of prescription medication alcohol, legalor illegal substances. I have important new
information to share in the case andconviction of Louis Salinas in the shooting of
William Towar. I know Louis Selenasfrom the neighborhood where I grew up in,
which is the West Lake District ofLos Angeles. On January twenty nine,

(01:57):
two thousand and five, I wasthe only shooter of a thirty eight
special fire shooting William toward Louis Salinas. Was not involved in the shooting in
any way. I'm coming forward inthe Louis Salinas case after being contacted by
Attorney Matthew Barhoma while in US federalcustody at a United States Prison Beaumont in

(02:22):
Beaumont, Texas in December of twentytwenty. I was deported to Mexico.
Upon my release in early twenty twentyone, I was recently contacted by private
investigator Lisa de Bentidi's I'm coming forwardwillingly in hopes to clear Louis Alenas in

(02:44):
the attempted murder of William Toward.Louis Salina did not shoot William Tolward.
He was not involved in the shootingof William Tolwart. He never had a
gun or fired a gun on Januarytwenty nine, two thousand and five.
Louis Selenaz did not know that Iwould be shooting mister toward or jumping in

(03:07):
his car telling him to get meout of here on January twenty nine,
two thousand and five. On Januarytwenty nine, two thousand and five,
around two thirty am, I wason thirty at Winner Street. I lived
on that street. I grew upon that street, and I was shot
by rivals on that street. Ilived at Witmer Street in Los Angeles,

(03:30):
California, nine doublow seventeen, inan apartment with my parents. It was
a Friday night, early Saturday morning. I was outside with my friends drinking.
Witmer Street has always been a verydangerous and active street to live on.

(03:51):
As far back as I can remember, it was active mainly with shootings
and getting activity, and unfortunately Iwould that route myself off. I haven't
seen friends killed by rebels coming intothe neighborhood looking for anyone to kill.
At the time of the shooting ofWilliam Tower, there had been several shootings

(04:11):
that week alone, so I wason high alert. And defense mode on
the lookout for any suspicious individuals orcars. That night, January twenty ninth,
two thousand and five, I hada thirty eight Special Revolver on me
for self defense. I was tryingto avoid being the next victim on the

(04:32):
block. While outside department building,a friend and I spotted a guy.
A friend and I spotted a guythat was not familiar standing by the street.
He looked suspicious. My friend andI were across the street from the
department where I used to live.We approached him, asking him who he

(04:54):
was and what he was doing onthe block. Suddenly, a white pickup
truck pulled up to and I toldmy friend to watch out. There's a
truck coming up. It was lateat night, there were no cars on
the street. He was coming fromSixth Street going towards Third Street on Wimer.
The driver was about to pass usby and suddenly stopped. He hit
the brakes right in front of us. I again told my friend, hey,

(05:15):
watch out. The driver stopped infront of us and then put the
truck in reverse. We were onthe passenger side of the truck on the
sidewalk. As the driver pulled backa little bit I stopped him reached towards
the passenger side. It was darkand I didn't know what he was doing,

(05:39):
and he did not have a passengeron the passing side of the truck.
He looked like he was getting somethingafter he stopped. Suddenly, I
was a high alert. My gutinstinct told me I was about to get
shot. I heard the driver yellsomething, but couldn't hear what he was
saying. Nobody does that on thestreet. Nobody was going to stop like
that here reversed through all these maneuvers, if they mean well. I did

(06:02):
not pay attention to what he said. At that time, my generalan was
rushing and I had tunnel vision.I was thinking, I don't want to
get shot. I instantly pulled outmy thirty eight Special Revolver and shot.
Once I shot low towards the truck. I was standing approximately parallel to the

(06:23):
mortar, between the front of thecar and the windshield. I did not
want to get shot, so Ishot before he could. That guy yelled
out something and the truck went intoverse, and then he put the truck
and drive, then drove forward, and he drove forward. I shot a
second time through the front windshield andI heard him yell something again. I

(06:45):
don't know if he was pointing hisfinger or what, but I saw his
hand extended towards me. I wasin the front. I was in front
of the truck, but not directlyin front of it. I was on
the sidewalk. I never went intothe street. We are now about a
car length away from each other. The guy hit the gas, going forward,
almost running me over. I hadnot I had no intention in killing

(07:08):
this man. I only shot toprotect myself. Both shots were him low.
I was shooting through the bottom ofthe truck so he could hear it
and get scared and leave. Iwas trying to get him away from me.
Although I am low, the thirtyExpecsial Revolver does have a little kick
on it. My intentions were notto shoot at his head. I was
aiming low, but did not havecontrol where the bully went, and his

(07:30):
vehicle was moving towards me. Iwanted to reiterate that my intentions were not
to shoot through the windshield or himat all. I'm the only person who
shot, and I only used athirty eight Special Revolver. Louis Selenas was
not with us, and no oneelse shot. Wasn't tower but me.

(07:53):
All this happened in a matter ofseconds. When I turned around to look
for my friend, I saw himand the other guy we were talking to
on the sidewalk running down the blocktowards Sixth Street. They did not know
what was going on or who wasshooting. They were trying to get out
of the area and took off runningdown the street. I don't know who
the other guy was that my friendand I approached. I don't know if

(08:16):
he was a witness in the Silenia'scase. I did not know William Towar
at all. I've never seen himin my life. I did not know
Louis Alenas was on the Winner Street. He was nowhere near me and the
other two men on the street,or near the white truck. I only
later found out he was parked upthe street. When I ran, I

(08:37):
remember hearing a car door slam ata distance. This is around two year
him, so any sound on alonely street as you on high alert.
When I saw my friend and theother guy running towards Sixth Street, I
started running in the opposite direction.I turned and ran towards Third Street.
As I ran towards Third Street, the pickup truck is taking off. He
gassed it towards the direction I'm learning. A few buildings away kul Wimmer,

(09:03):
I see Louise Selena's brown Cadillac parkedin the driveway of the apartment building over
the sidewalk. His car was blockingthe sidewalk between two apartment buildings. These
are pretty big buildings, so hewas far away from the shooting. I
ran to the car and Louise wasaside. I jumped in the passenger side.

(09:26):
I told Louise, get me outof here. Louise Salmas looked at
me and hesitated, like what's goingon? I told him again her real
up, let's go. I hadto tell him about three or four times
before he finally started the car anddrove towards Third Street. I asked Louise
to drop me off a few blocksaway in front of Belmont High School because

(09:46):
I had a friend who lived upthere. Louise pulled over in front of
Delmourt High School. As Louise pulledover, there was an LAPD cop behind
us. They flashed lights and tookoff. We were in a short high
speed pursuit during that pursuit, Ithrew the thirty eight Special War out of

(10:07):
the window around Colombia between Third andsix Street. We ended up slamming into
a life post a few blocks awayaround Temple and Alverado. If I'm not
mistaken, Louise got out of thecar. Luis got out of the car

(10:28):
because of the crash. I wasdazed and I was stuck in the car.
The officers dragged me out through thewindow and beat me repeatedly, punching
and kicking me. The cop said, you should have come out shooting,
motherfucker, you fucking pussy. Theywere rapidly pushing me and kicking me while
I was faced down on the concrete. That was the last time I saw

(10:48):
or spoke to Luisa Lunas. Rightbefore we crashed. I filed an internal
affairs complaint on the cops, butcould not recognize them because they were beating
me. Louise Selenas and I wereboth arrested, I believe, but not
certain. I was booked for attemptto murder on the shooting of William Toward.

(11:09):
I don't believe the gun was everrecovered by the police. I was
tested for gunshoy residue. But asI never but I was never told the
results, I assumed they were negativebecause I was released A couple of days
later, on February first, twothousand and five, I went to court
and I was released. I wastold I had a DA reject. As

(11:30):
soon as I was released, Ileft Los Angeles, not sure if I
would get arrested again for the shooting. There is a female witness, the
wife of one of my friends.I don't recall her name, but she
saw toward an ambulance from her balcony. Louise would know her full name because
she did testify in his case onthe first trial where he had a hung
jury. She did not testify inthe second trial where he was convicted.

(11:54):
The LPD had said William Toward hadpointed out Louise Selenas from the ambulance.
She was on her balcony, andsaid William Toowar was inside the ambulance with
the doors closed when the police pulledup to the ambulance with Louis Selenas.
They never took Louise out of thecar, and they never opened the back
doors of the ambulance. It ismy understanding that they had to rush William

(12:16):
toward to the hospital. Ye hadtoo much time, had it last between
the shooting, them finding him,and getting him treated. The police knocked
me out cold, so they nevertook me to the ambulance where William Thar
was being treated. I lost completeconsciousness. When I woke up, I
was hog tight in the back ofa police car with my hands tied behind

(12:37):
my back to the back of mylegs. It's been over seventeen years since
that night. I have thought alot about Louis. I know he ended
up getting a life sentence in prisonfor a crime he didn't commit. I
feel guilty that he ended up takingmy place and losing his life. Ruis
Selenas was only nineteen years old whenhe was arrested. I was arrested.
Throughout the years that have passed,I served several years in prison. I

(13:01):
really started to read. I reallystarted regretting not helping Louise. I felt
guilt and remorse and still do somuch time has passed. One when I
heard from Louis attorney in December twentytwenty, I was surprised. I spoke

(13:24):
to mister Barhoma and told him Iwas willing to help Louise and I was
testify in court if needed. MisterBarhoma said he would send me an affidavit
to sign. He told me Ishould make any changes if I felt were
necessary. I wrote a few linesfrom that affidavit and mounted back to him
with the letter asking for the changes. I ended up being released from prison

(13:46):
and deported to Mexico before hearing backfrom mister Barhoma. I never got in
contact with mister Barhoma. I didn'tleave him any contact information because I did
not know where in Mexico I wouldend up. I was recently contacted by
private investigator. I was told theyhad been trying to locate me since my
release. I'm sorry that Louis Helenashas spent so many years in prison.

(14:09):
I wish I had the courage tocome forward a while student. I was
not ready to take responsibility at thattime. I'm willing to know because of
my old personal experience being in custodyfor several years, it really had an
effect on me moving forward with mylife. I want to make things right.
I made a commitment to myself tochange my life for the better.

(14:33):
I want to see Louis Selena setfree. He doesn't deserve to spend life
in prison for something he had nothingto do with. I hope he comes
home. I came forward to givethis statement to hopefully be able to shine
some light on the actual events ofthat night. Louis Selena's got railroaded and
convicted for something he didn't do.For him to spend the rest of his

(14:54):
life in prison for something he didn'tdo is not right. I know it
has been some time, but it'snever too late to do the right thing.
I was on drugs at the time. I also believe I was smoked
with the night of the shooting,I wanted to try to get Louise home.
I unequivocally stayed. I and onlyI shot William Toward on Jerrard twenty

(15:16):
nine, two thousand and five.Only world firearm was used in the shooting,
which was a thirty eight Special Revolver. I had it in my possession.
I further unequivocally stayed. Louis Salinaswas not present at the time of
the shooting and had no involvement inthe shooting of William Toward. I had
no knowledge Louis Selinas was even onWinner Street until I started running away from

(15:39):
the shooting scene and saw his vehicle. I lastly, unequivocally stayed that after
I jumped in LUI selling this Cadillac. I never told Luislinas I committed her
shooting. Louis Salinas did not havea gun when I jumped into his vehicle,
and did not know I had agun until I threw it out of
the vehicle window. Louis Selinas hadabsolutely no involvement whatsoever in the shooting of

(16:02):
Rulling Toward. If called to testifyand a porter law about the statements in
this affidavit, I would be willingto do so. I hector swear under
the penalty of perjury under the lawsof the country of Mexico, that the
information I provided in this affidavities ofmy own free will, and the statements
made here and are true and correct. My look, I tell a man,

(16:30):
no trouble. I don't want tobeach man. I just want vibes,
big man like me. No needfor the telephone, hide, I
got too much get in online.Who won't rule the dnimal side? Wrong
move? I bet they're gonna ride. No, no,
