guzzling pickup truck like Jared Poulus does.

I didn't have enough room in any of the cars.

So I was like, oh, my dad had one of
those cool vans.

I'm going to go find one of those. And there's
a company in Nebraska that customizes them. So anyway, still,
even though it's that old of a car, I drive
up to the Valet and the valet guys are like, dude,
that is such an amazing car.

They love it. And yeah, but anyway, where was I
going with that?

Oh?

Yeah, so I have that car, and then I have
I have a Rivan. Have you heard of those? No,
they're pretty cool, they're bigger. So I did have a
Tesla and that's when I was driving all over the state,
and it was it was helpful with gas and everything,
and it was so f asked some fun. I'm a
car geek. I've always loved cars. I've had all kinds
of different cars. My dad gave me that disease. In fact,

my favorite car that I've ever had was a sixty
six Mustang with a black hardtop and candy like the silver.

The metallic silver was beautiful.

But had the Tesla traded in on the Rivon, which
is like a camping car. They have the actual the front,
the front where the engine usually is opens up and
it's a cooler. You can make it into a cooler,
and then it has a speaker that pulls out that
you can use when you're camping.

It has a bike pump in the back. It's pretty cool.
Speaker 4 (02:36):
It's pretty cool, but it's really not cool when you
have like five miles left on the car and you
got to get home and you're like, oh no, I
mights and.

You have to stop at these charging stations and sit
and do do doo do do do do do?

It takes a while, but anyway, so yes, I've got
my I'm both hats on that end. So Ryan, Oh
my gosh. It was another one of those news days.
There's so much going on. Of course, the big news
is that Tina Peters is out of prison, and we
are going to have John Case on her attorney at
four thirty five to talk about that.

Then we're going to have Robin.

Carnes in Live in the studio at five oh six
to talk about the redistricting ballot initiatives, which are kind
of flying under the radar right now, and it's really
really important that people pay attention because the Democrats are
they're sliding it under the radar, and they are going
to steal three of our four congressional seats if.
Speaker 3 (03:30):
We're not careful.
Speaker 4 (03:31):
They literally created a ballot initiative that will move the
redistrictings so that we go from having eight congressional seats
that are split four and four to basically seven Democratic
seats and one Republican seat. It would combine CED four
and CED five if it's the way they propose it,
which is Douglas County in Olpaso County basically would be

one district and that would be our only red district
in Colorado and that would start in twenty eight and
go through twenty thirty. They did it, and this was
pretty sly. They didn't do it as a permanent measure.
They did it as a temporary measure, blaming it on
the redistricting efforts that Trump put forward. So it's basically,
let's pay back Donald Trump and play his game and
then we'll get back to playing nice, which you know,
(04:16):
they will never go back to give it. They won't
give up those seats if they take them, So we've
got to pay close attention to that. And then at
five thirty five, we've got Craig stein Or the new
GOP share and we're going to have a cofun conversation
with Craig talk about his plan for turning the party around.
And he seems like a pretty mellow dude, like pretty calm, cool, chill.

Maybe that's what the doctor ordered for our party. Maybe
it's not. Maybe we needed a fighter. I don't know,
but we're going to find.

Out pretty quickly here over the next couple months, headed
into this midterm if if it's.

Going to go well or not.

And then our buddy Victor, Oh my Ryan, what do
you think the odds are that he's shows up for
the debate tomorrow night?

With Kyle Clark five percent? He shows up ninety five percent?

Wow, you're pretty sure? Yeah, yeah.

I talked to a couple insiders and they agree. They
think he's probably not.

And he did that poll, that kind of silly pole
where he put it out his own Facebook page put
it out, and I think it was eighty nine percent
of his supporters said yeah, go do it. And I
think he was expecting the opposite, and so they pulled
the pole down. Is that right?

And both Kyle Clark and Marshall Zellinger, who will be
moderating a debate for nine News, called him out on
it and talk about your all time backfires, just like

He did not see combat, So anybody he claims to
have killed, Heidi would have been as a civilian.

You know, when the killing moon appears, it usually comes

apparently for Victor Mark's same deal. So what is he
trying to do there, Heidi? Because we know he's lying. Okay,
let's just put that out there. He's lying everything. He's
talking about this mythology that he's built. You know, he
claims to have killed a guy when he was seven
years old. I think that's a liar of fabrication, exaggeration,

something round.

Now, well, the cat head wearing the cat.

Okay, these are fantastical tales. There's no way to disprove them.
There's no way to prove them. You just got to
take his word for it. It's on his website, it's
in a documentary video, whatever. But when he won't answer,
how many men have you killed in your adult life?
Does it matter worse the answer possible? Because yeah, of
course it matters. So let's put that aside for a moment.

But let's just say he did. And these morons coming
out of the woodwork. Ben Albright right across the way,
army veteran, he's telling me all the veterans he knows,
he knows people in intel agencies, they've never heard of
the guy. They don't know the guy, they don't support
the guy. He does not have any military combat kills.
So all these freaks coming out of the woodwork saying,
how dare you ask about his service and how many

people he killed in combat. He wasn't in combat, so
miss me with that crap. And if he killed anybody
as an adult, again, it would have been as a civilian.
And he's going into these outlandish descriptions with Kyle Clark.
You got to watch this twenty nine minutes if you
haven't already. This is the stuff of pure fiction and fantasy.

And why is he trying to perpetuate this myth? I
maybe I killed a guy if he's a civilian and
was in self defense, Well, we want to know those circumstances, Victor.

And if you were abroad doing.

These missions, He's supposed to be saving Wlennen and children
and he's killing guys. Guys are shooting at him. There's
no military action involved in the United States government. The
State Department, according to Kelly Dore and John Fabricatory, don't
know about him.

How is that possible? I know, likely, not possible.

All things are possible, But how is this possible logistically?

Well, and here's the problem I keep going back to
for my friends that still support Victor, is what's going
to happen when we have four congressional seats that we
are trying desperately to hold on to and all these
down ballot candidates, and all we end up talking about
after the primary is Victor's kill record. I like his number,

Like that is not how we're going to win as
Republican in the.

I got to make sure we get this all out there,
because if you're supporting Victor Marx right now, either you
have a closed head injury that you don't know about,
or you have drank the kool Aid slash been retooled
with a prayer. Because there is no way any of
this is true, he says again, as a civilian.

Kyle Clark called him out.
Speaker 5 (13:18):
On this, and I know you and I are some
of the last people to give Kyle Clark credit, but this.

Is one instance where it does apply. He says.

It's a civilian he called in an air strike. This
is in his documented history. That is not possible. That
is not a thing that would ever happen. And when
Kyle Clark asked him about it, say can you tell
me more about this?

That was his one word answer, just.

story believe the mystique around here.

One other civilian that has ever called in a military
air strike from the United States wowed it cannot happen.

It goes back to though Ran like, this is how
we're going to spend our time from July first through
the first of November talking about whether things he said
are true or not, when we've got to be talking
about affordability and housing and crime and exactly how Spencer
Pratt is.

Running his campaign.

We'll find out how that plays out Tomorrow night is
the LA Mayor's election. But if you guys haven't checked
out his videos and his campaign talking points, he nails it.
He does exactly what we should be doing in Colorado.
That's taking pictures and video like do better Denver did
of all the bad stuff that's happening, and ask people,
is this.

What you want for your kids? Moms?
Speaker 4 (14:46):
Is this what you want for your children? Is this
what we want for our neighbors? Is this what we
want for our streets? Do we really want to go
to downtown Denver and be afraid for our lives?

No, But again it goes back to the old frogs
in boiling water that I keep talking about. The water
has to get hot enough for people to jump out,
and talking about Victor Marx and his fantastical stories is
not going to help us get the frogs to jump
out of the boiling water anytime soon. So I'm worried
about the four congressional seats. That's why I want Robin

to come onto at five oh six, because I wanted
to talk about how.

Dangerous this three districting is.

But also we're not doing ourselves any favor on the
ground either with some of the ways we're approaching the
congressional races, like battling it out.

Against each other. It's like we've got to battle them.

We are R plus five that means we will win
as a Republican most of the time by five points
in CD three, which is Pueblo and up the western
Slope that's Jeff Hurd, and R plus five in al
Paso County, which is Jeff Crank. I think we're somewhere
between R plus nine and R plus eleven in Douglas
County and up to Loveland that's Lauren Bobert that's CD four,

and we're even at CDA. So we are in a
war for these congressional seats and we've got to play
everything perfectly to keep those four congressional seats at least
for this next round until they redistrict us out. But
it's really really important that people pay attention to the
four congressional races, get involved, volunteer, and like I keep
saying over and over again, too, you are the leader

you've been waiting for, Like, get to know your neighbors,
own your neighborhood, work in your neighborhood.

Before you try and go out and win a statewide election.
Speaker 4 (16:28):
Like, it's really really important that we get back to
basic blocking and tackling. And that's what I hope to
talk to Craig Steiner about at five point thirty five
is I think we've got to get back to basic
blocking and tackling at the precinct level and win back
those local races before we.

Can win big in Colorado again.
Speaker 4 (16:46):
I also, I'm also interested to see what Tina Peters
has to say about where election integrity stands now versus
where it stood a year and a half ago when
she went into prison.

And I think there are some very very.

Significant things that have happened and been uncovered in Colorado
that are concerning and maybe she'll have some insight into
that because she talks to all the key people across
the country that are running the game. And Mark Cook's
going to be one of the ones at the festival.

you're and Dan's listeners, and just remember I'm one of
six lawyers that's part of a team, and we could
not have succeeded in obtaining Teama's release without everybody on
the team.

Well, you did a miracle. So tell us how this evolved.
What can you tell us about how this finally came
to be.
Speaker 2 (19:56):
Well, we went through our appeal in the Colorado Court
of Appeals, and that court ruled on April second that
Tina's sentence was illegal because the judge in sentencing her
based her sentence on words that she used to criticize
(20:16):
the voting system in Colorado. Here's if I can quote
exactly what the judge said. He said, this is what
makes missus Peters such a danger to our community. It's
the position she held that has provided her the pulpit
from which she can preach these lies, the undermining of
our democratic process, the undermining of the belief and confidence
(20:38):
in our election systems. Prison is for those folks where
we send people who are a danger to all of us,
whether it be by the pen or the sword or
the word of the mouth. That's what the judge says.
You're going to prison because of what you say.
Speaker 4 (20:54):
Which this is America, isn't it? Don't we have a
first Amendment?
Speaker 2 (20:58):
Well, the Court of God bless him, said yes, we
still have a first Amendment, even in Colorado. Now, this
is what Jenna Griswold said this morning in response to
Tina's release from the Department of Corrections. These are Jenna
Griswold's words, not mine quote. The governor's grand of clemency
(21:22):
to Tina Peters is an affront to our democracy, the
people of Colorado, and election officials across the country. It
sends a dangerous message about accountability for those who would
attack elections. Peter's release will also embolden the election denial movement.
Since the grand of clemency, she has continued to spread
(21:44):
election falsehoods and conspiracies. So that's basically the same thing
the judge said when he sentenced her. You belong in
prison because of what you are saying.
Speaker 4 (21:57):
Yeah, and in this judge, this judge is still is
still involved in the case. Or how does this work
with the probationary hearing or that panel, et cetera.
Speaker 2 (22:07):
Well, Tina is on parole, so she reports to a
parole officer in the community where she is residing, which
is confidential, and so she's going to be a model parole,
just like she was a model prisoner at the Vista
Correctional Facility. And hopefully she'll be off parole sooner than
(22:34):
the authorities want her to be off. So far, the
process has worked the way it should.
Speaker 4 (22:42):
And John, are there any restrictions on what she can
say or talk about or do?
Speaker 6 (22:46):
Like?
Speaker 4 (22:47):
Is she having to live at a secure facility? Or
can she go to the mall or go to dinner?
Speaker 3 (22:51):
Like? What does this look like?
Speaker 2 (22:55):
Well? Now, her freedom is unrestricted except for travel, and
I can't comment on what the exact conditions are, but
there's no restriction on what she can say. Good, And
she's resting now. I haven't even spoken with her because
she's going to rest for two weeks and try to
(23:17):
recover the health that she lost at La Vista. You know,
she's seventy years old. For five hundred and something out
of the six hundred and ten days that she was incarcerated,
she slept on a two inch from mattress on top
of a steel slab that was her bed, and she
(23:40):
ate nothing but processed food. No fresh vegetables, no fresh fruits,
no fresh meat, just processed food. And it took a
pretty serious toll on her health. So hopefully, after a
couple of weeks of rest and a healthy diet, she'll
(24:01):
recover a lot of her health. And I think in
a few weeks you'll be hearing from Tina again. She's
going to talk about prison reform and election transparency.

John, What uh? What did she want to eat when
she first got out? Was there something she was just
dying to have?
Speaker 2 (24:18):
Yes, A nice thick steak.

And then how and she this is kind of a
this is a camp Bawa Heidi question.

But doesn't she have a dog that she hasn't seen

Yes, and she's with the dog now.

Yeah, that makes my heart so happy. Thank you, thanks

Yet, so what happens as far as the parole, Like
how often does she have to meet with them? Can
they decide at some point like that they don't like
how she's acting even if she does nothing wrong? And
turn this around like, what's the biggest fear around this?
Speaker 2 (25:00):
Well, there are objective standards. She has to follow the rules,
which she's going to do right, and she doesn't violate
the rules, then she remains on parole, no matter how
badly this upsets the Secretary of State and the Attorney
General Phil Wiser. As long as she follows parole rules,

she's a free person.
Speaker 4 (25:24):

What the judge did was really wrong? Is that true?

Well, we have so the court Colorado Court of Appeals
said that her sentence was illegal because it was based
on her speech, so she had to be re sentenced.
And then on May fifteenth, Governor Polus God bless him, said,
(26:18):
it is wrong to put somebody in prison for what
they say, no matter how strongly I disagree with Tina Peters.
It's everybody's liberty that is at stake in her case.
If you can sentence Tina Peters, for what she's saying.
You can sentence anybody for speech, and that's why I
(26:38):
am commuting her sentence. So he you know, he he
commuted her sentence, meaning she got out of prison on
April first, and I'm sorry June first today and is
now on prole So he defended everybody's free speech liberty.
(26:58):
The governor did and taken a lot of heat for it,
and you know, he's courageous. He did the right thing.
Speaker 4 (27:04):
No, I agree, and I got to give it to Jared.
He did the right thing, and I was, yeah, I
was very I was proud of him in that moment
and still am for that decision and grateful. And I
think it was definitely the right thing to do. We've all,
we all think it was the right thing to do.
But obviously most of the Democrats in Colorado don't agree,
and so if Jenna Griswold.

Actually actually a great many of them do agree. My
Colorado Fading Stars hockey team is mostly Democrats, and I
would say almost all of them agree that Governor Polish
did the right thing and that Tina should be free

because you can't punish somebody for what they say.

me a couple of questions to ask if that's okay.
The first The first one is the commutation gets Tina
out today, but the seven convictions stand. What does the
dirt petition ask the color to Supreme Court to do that?
Speaker 3 (28:52):
The commutation did not.
Speaker 2 (28:56):
Our petition for Surcharira in the Colorado Supreme Court asks
the Colorado Supreme Court to reverse and vacate all of
her convictions.
Speaker 3 (29:06):
Nice.
Speaker 4 (29:07):
Great, and when what's the timeline for that?
Speaker 2 (29:12):
Whenever the Supreme Court acts?
Speaker 3 (29:15):
Oh, we have no control, lovely all right?
Speaker 4 (29:18):
Next question, Police cited the appeals Court's first Amendment finding
as his rationale. DA Rubinstein says, Police overstated what the
court ruled. How do you read what the Court of
Appeals actually found on protective speech?
Speaker 2 (29:32):
It was a clear the court actually said that the
trial judge punished Tina Peters for her speech, and that
is illegal for a court to do that in the
United States of America. That's why they reversed her sentence.
Speaker 4 (29:52):
Okay, So with resentencing overtaken by the commutation, is the
motion to disqualified Judge Barrett now a closed chapter or
does it carry into the cert petition?
Speaker 2 (30:04):
No, that is a closed chapter because the judge refused
to disqualify himself. So if the case, if there's ever
another proceeding in the Mason County District Court, Judge Barrett
will preside over it.
Speaker 3 (30:20):
John, is, what are.
Speaker 4 (30:22):
Some practical things Tina do you think Tina, and you,
as an incredibly talented attorney, suggests we should do to
prepare for the midterms, Like what do we actually have
control over as voters in Colorado that we could actually
do to make a difference here.
Speaker 2 (30:38):
Well, get your neighbors to go to the polls, but
talk to your neighbors Republicans and Democrat about this uncertifiable
voting system that we're still using in Colorado. It is
the same, basically the same smartmatic software that was used
(31:00):
to rig elections in Venezuela, and Colorado continues to use it,
and the Secretary of State has made it as illegal
for anyone to conduct an audit of an election or
to look at the system, have an expert look at
the system, or do a recount unless she says it's
all right. And of course that's not going to happen
(31:22):
if a Democrat's elected. There's never going to be an
audit and there's never going to be a recount.
Speaker 4 (31:28):
Yeah, John, we tried that in twenty two in my
race and got shut down, even but with a Republican clerk,
we got shut down.
Speaker 3 (31:34):
It was so annoying.
Speaker 4 (31:35):
But John, what this ruling about Trump's executive order that
it could go forward. What does that mean for Colorado,
if anything, in our elections.
Speaker 2 (31:48):
Well, there's two aspects to it. One is the court
of public opinion. What I believe we're going to see
in the next ninety days are releases of shaw information
about the rigging of the twenty twenty election and the
use of electronic voting systems to help rig that election.
(32:09):
And of course that's what the Democrats are calling lies,
and that's why Tina went to prison for making that claim.
But I think the public is going to see the proof.
And there's a great new book at out by a
guy named Seth Ketschel, for former Army intelligence officer who
served in Afghanistan, who predicted the twenty sixteen election, the
(32:33):
twenty twenty four election, and who has done a painstaking
job of exposing the fraud in the twenty twenty election.
And the title of that book, for your listeners, is
The American War on Election Corruption. It is a shocking book.
Speaker 4 (32:50):
And John, we're actually hosting Seth at the Freedom Fast
that we're having June twenty six and twenty seven. He'll
be one of our speakers on Friday, June twenty six,
And of course with love to have you there as well,
but we're really excited to hear what he has to
say and how it ties to Colorado. So what's the
other implication you said there were two? When was the
pr side? What about the legal side from the ruling
(33:13):
over the executive order with Trump?
Speaker 2 (33:16):
Well, I believe that we'll see a new executive order
that prohibits mail in ballots and hopefully prohibits electronic vote
tabulation and requires voter ID before a ballot can be cast.
(33:37):
So I think if we have those safeguards in place,
and we have hand counting in Colorado instead of machine tabulation,
regardless of the outcome, people will be able to trust
the result. But right now, we can't trust the result
because you don't know what happens inside those computers. There's
no way to tell, and the Secretary of State won't
(33:58):
let anybody look and see what's going on, so you
just have to take their word for it that this
is a fair election. But nobody knows how the votes
were tabulated on those computers, and it's the same software
that was used to reg elections in Venezuela. So why
should we accept that? Why did Colorado citizens accept a
(34:19):
corrupt voting system.
Speaker 3 (34:22):
That's a great question.
Speaker 4 (34:23):
And man, when I was running in twenty two, if
I even whispered about questions on the election, I got
destroyed by the liberal media.
Speaker 3 (34:32):
I'm glad we can at least have.
Speaker 4 (34:34):
The conversation now, but I am worried that the Colorado
leadership will just snub their noses at any executive order
that comes through and not allow any of that to
be pushed through in Colorado.
Speaker 3 (34:47):
What do you say about that?
Speaker 2 (34:50):
Well, if Trump's executive order is if a federal court
holds that it is a lawful executive order, and state
authorities refuse to conduct a federal elections in a federal
election in accordance with that order, uh, there's gonna be
a big mess because if they don't follow the rules
(35:14):
set down by the executive order, then the election how
can how can the federal election be valid if they disobey.

I didn't have enough room in any of the cars.

So I was like, oh, my dad had one of

I'm going to go find one of those. And there's
a company in Nebraska that customizes them. So anyway, still,
even though it's that old of a car, I drive
up to the Valet and the valet guys are like, dude,
that is such an amazing car.

They love it. And yeah, but anyway, where was I
going with that?

Oh?

Yeah, so I have that car, and then I have
I have a Rivan. Have you heard of those? No,
they're pretty cool, they're bigger. So I did have a
Tesla and that's when I was driving all over the state,
and it was it was helpful with gas and everything,
and it was so f asked some fun. I'm a
car geek. I've always loved cars. I've had all kinds
of different cars. My dad gave me that disease. In fact,

my favorite car that I've ever had was a sixty
six Mustang with a black hardtop and candy like the silver.

The metallic silver was beautiful.

But had the Tesla traded in on the Rivon, which
is like a camping car. They have the actual the front,
the front where the engine usually is opens up and
it's a cooler. You can make it into a cooler,
and then it has a speaker that pulls out that
you can use when you're camping.

It has a bike pump in the back. It's pretty cool.

It's pretty cool, but it's really not cool when you
have like five miles left on the car and you
got to get home and you're like, oh no, I
mights and.

You have to stop at these charging stations and sit
and do do doo do do do do do?

It takes a while, but anyway, so yes, I've got
my I'm both hats on that end. So Ryan, Oh
my gosh. It was another one of those news days.
There's so much going on. Of course, the big news
is that Tina Peters is out of prison, and we
are going to have John Case on her attorney at
four thirty five to talk about that.

Then we're going to have Robin.

Carnes in Live in the studio at five oh six
to talk about the redistricting ballot initiatives, which are kind
of flying under the radar right now, and it's really
really important that people pay attention because the Democrats are
they're sliding it under the radar, and they are going
to steal three of our four congressional seats if.
Speaker 3 (03:30):
We're not careful.
Speaker 4 (03:31):
They literally created a ballot initiative that will move the
redistrictings so that we go from having eight congressional seats
that are split four and four to basically seven Democratic
seats and one Republican seat. It would combine CED four
and CED five if it's the way they propose it,
which is Douglas County in Olpaso County basically would be
(03:53):
one district and that would be our only red district
in Colorado and that would start in twenty eight and
go through twenty thirty. They did it, and this was
pretty sly. They didn't do it as a permanent measure.
They did it as a temporary measure, blaming it on
the redistricting efforts that Trump put forward. So it's basically,
let's pay back Donald Trump and play his game and
then we'll get back to playing nice, which you know,
(04:16):
they will never go back to give it. They won't
give up those seats if they take them, So we've
got to pay close attention to that. And then at
five thirty five, we've got Craig stein Or the new
GOP share and we're going to have a cofun conversation
with Craig talk about his plan for turning the party around.
And he seems like a pretty mellow dude, like pretty calm, cool, chill.

Maybe that's what the doctor ordered for our party. Maybe
it's not. Maybe we needed a fighter. I don't know,
but we're going to find.
Speaker 4 (04:45):
Out pretty quickly here over the next couple months, headed
into this midterm if if it's.

Going to go well or not.
Speaker 4 (04:52):
And then our buddy Victor, Oh my Ryan, what do
you think the odds are that he's shows up for
the debate tomorrow night?

With Kyle Clark five percent? He shows up ninety five percent?

Wow, you're pretty sure? Yeah, yeah.

I talked to a couple insiders and they agree. They
think he's probably not.

And he did that poll, that kind of silly pole
where he put it out his own Facebook page put
it out, and I think it was eighty nine percent
of his supporters said yeah, go do it. And I
think he was expecting the opposite, and so they pulled
the pole down. Is that right?

And both Kyle Clark and Marshall Zellinger, who will be
moderating a debate for nine News, called him out on

claims to have killed a guy when he was seven
years old. I think that's a liar of fabrication, exaggeration,

course it matters. So let's put that aside for a moment.

army veteran, he's telling me all the veterans he knows,
he knows people in intel agencies, they've never heard of
the guy. They don't know the guy, they don't support
the guy. He does not have any military combat kills.

people he killed in combat. He wasn't in combat, so
miss me with that crap. And if he killed anybody
as an adult, again, it would have been as a civilian.
And he's going into these outlandish descriptions with Kyle Clark.
You got to watch this twenty nine minutes if you
haven't already. This is the stuff of pure fiction and fantasy.
(12:05):
And why is he trying to perpetuate this myth? I
maybe I killed a guy if he's a civilian and
was in self defense, Well, we want to know those circumstances, Victor.

And if you were abroad doing.

These missions, He's supposed to be saving Wlennen and children
and he's killing guys. Guys are shooting at him. There's
no military action involved in the United States government. The
State Department, according to Kelly Dore and John Fabricatory, don't
know about him.

How is that possible? I know, likely, not possible.
Speaker 5 (12:34):
All things are possible, But how is this possible logistically?

Well, and here's the problem I keep going back to
for my friends that still support Victor, is what's going
to happen when we have four congressional seats that we
are trying desperately to hold on to and all these
down ballot candidates, and all we end up talking about
after the primary is Victor's kill record. I like his number,

Like that is not how we're going to win as
Republican in the.
Speaker 5 (13:02):
I got to make sure we get this all out there,
because if you're supporting Victor Marx right now, either you
have a closed head injury that you don't know about,
or you have drank the kool Aid slash been retooled
with a prayer. Because there is no way any of
this is true, he says again, as a civilian.

Kyle Clark called him out.
Speaker 5 (13:18):
On this, and I know you and I are some
of the last people to give Kyle Clark credit, but this.
Speaker 7 (13:22):
Is one instance where it does apply. He says.

It's a civilian he called in an air strike. This
is in his documented history. That is not possible. That
is not a thing that would ever happen. And when
Kyle Clark asked him about it, say can you tell
me more about this?

What did he say?

That was his one word answer, just.

No, Oh, We're just gonna leave that hanging. Come on, man,
this guy's a fraud.

Well, a lot of people do believe him, believe his
story believe the mystique around here.

One other civilian that has ever called in a military
air strike from the United States wowed it cannot happen.

It goes back to though Ran like, this is how
we're going to spend our time from July first through
the first of November talking about whether things he said
are true or not, when we've got to be talking
about affordability and housing and crime and exactly how Spencer
Pratt is.
Speaker 3 (14:22):
Running his campaign.
Speaker 4 (14:23):
We'll find out how that plays out Tomorrow night is
the LA Mayor's election. But if you guys haven't checked
out his videos and his campaign talking points, he nails it.
He does exactly what we should be doing in Colorado.
That's taking pictures and video like do better Denver did
of all the bad stuff that's happening, and ask people,
is this.

What you want for your kids? Moms?
Speaker 4 (14:46):
Is this what you want for your children? Is this
what we want for our neighbors? Is this what we
want for our streets? Do we really want to go
to downtown Denver and be afraid for our lives?

No, But again it goes back to the old frogs
in boiling water that I keep talking about. The water
has to get hot enough for people to jump out,
and talking about Victor Marx and his fantastical stories is
not going to help us get the frogs to jump
out of the boiling water anytime soon. So I'm worried
about the four congressional seats. That's why I want Robin
(15:18):
to come onto at five oh six, because I wanted
to talk about how.

Dangerous this three districting is.
Speaker 4 (15:23):
But also we're not doing ourselves any favor on the
ground either with some of the ways we're approaching the
congressional races, like battling it out.
Speaker 3 (15:33):
Against each other. It's like we've got to battle them.
Speaker 4 (15:36):
We are R plus five that means we will win
as a Republican most of the time by five points
in CD three, which is Pueblo and up the western
Slope that's Jeff Hurd, and R plus five in al
Paso County, which is Jeff Crank. I think we're somewhere
between R plus nine and R plus eleven in Douglas
County and up to Loveland that's Lauren Bobert that's CD four,
(15:58):
and we're even at CDA. So we are in a
war for these congressional seats and we've got to play
everything perfectly to keep those four congressional seats at least
for this next round until they redistrict us out. But
it's really really important that people pay attention to the
four congressional races, get involved, volunteer, and like I keep
saying over and over again, too, you are the leader
(16:20):
you've been waiting for, Like, get to know your neighbors,
own your neighborhood, work in your neighborhood.
Speaker 3 (16:25):
Before you try and go out and win a statewide election.
Speaker 4 (16:28):
Like, it's really really important that we get back to
basic blocking and tackling. And that's what I hope to
talk to Craig Steiner about at five point thirty five
is I think we've got to get back to basic
blocking and tackling at the precinct level and win back
those local races before we.
Speaker 3 (16:42):
Can win big in Colorado again.

I also, I'm also interested to see what Tina Peters
has to say about where election integrity stands now versus
where it stood a year and a half ago when
she went into prison.

that are concerning and maybe she'll have some insight into
that because she talks to all the key people across

Thank you, Heidi. It's great to be with you and
you're and Dan's listeners, and just remember I'm one of
six lawyers that's part of a team, and we could
not have succeeded in obtaining Teama's release without everybody on
the team.
Speaker 4 (19:48):
Well, you did a miracle. So tell us how this evolved.
What can you tell us about how this finally came
to be.
Speaker 2 (19:56):
Well, we went through our appeal in the Colorado Court
of Appeals, and that court ruled on April second that
Tina's sentence was illegal because the judge in sentencing her
based her sentence on words that she used to criticize
(20:16):
the voting system in Colorado. Here's if I can quote
exactly what the judge said. He said, this is what
makes missus Peters such a danger to our community. It's
the position she held that has provided her the pulpit
from which she can preach these lies, the undermining of
our democratic process, the undermining of the belief and confidence
(20:38):
in our election systems. Prison is for those folks where
we send people who are a danger to all of us,
whether it be by the pen or the sword or
the word of the mouth. That's what the judge says.
You're going to prison because of what you say.
Speaker 4 (20:54):
Which this is America, isn't it? Don't we have a
first Amendment?
Speaker 2 (20:58):
Well, the Court of God bless him, said yes, we
still have a first Amendment, even in Colorado. Now, this
is what Jenna Griswold said this morning in response to
Tina's release from the Department of Corrections. These are Jenna
Griswold's words, not mine quote. The governor's grand of clemency
(21:22):
to Tina Peters is an affront to our democracy, the
people of Colorado, and election officials across the country. It
sends a dangerous message about accountability for those who would
attack elections. Peter's release will also embolden the election denial movement.
Since the grand of clemency, she has continued to spread
(21:44):
election falsehoods and conspiracies. So that's basically the same thing
the judge said when he sentenced her. You belong in
prison because of what you are saying.
Speaker 4 (21:57):
Yeah, and in this judge, this judge is still is
still involved in the case. Or how does this work
with the probationary hearing or that panel, et cetera.
Speaker 2 (22:07):
Well, Tina is on parole, so she reports to a
parole officer in the community where she is residing, which
is confidential, and so she's going to be a model parole,
just like she was a model prisoner at the Vista
Correctional Facility. And hopefully she'll be off parole sooner than
(22:34):
the authorities want her to be off. So far, the
process has worked the way it should.
Speaker 4 (22:42):
And John, are there any restrictions on what she can
say or talk about or do?
Speaker 6 (22:46):
Like?
Speaker 4 (22:47):
Is she having to live at a secure facility? Or
can she go to the mall or go to dinner?
Speaker 3 (22:51):
Like? What does this look like?
Speaker 2 (22:55):
Well? Now, her freedom is unrestricted except for travel, and
I can't comment on what the exact conditions are, but
there's no restriction on what she can say. Good, And
she's resting now. I haven't even spoken with her because
she's going to rest for two weeks and try to
(23:17):
recover the health that she lost at La Vista. You know,
she's seventy years old. For five hundred and something out
of the six hundred and ten days that she was incarcerated,
she slept on a two inch from mattress on top
of a steel slab that was her bed, and she
(23:40):
ate nothing but processed food. No fresh vegetables, no fresh fruits,
no fresh meat, just processed food. And it took a
pretty serious toll on her health. So hopefully, after a
couple of weeks of rest and a healthy diet, she'll
(24:01):
recover a lot of her health. And I think in
a few weeks you'll be hearing from Tina again. She's
going to talk about prison reform and election transparency.
Speaker 4 (24:12):
John, What uh? What did she want to eat when
she first got out? Was there something she was just
dying to have?
Speaker 2 (24:18):
Yes, A nice thick steak.
Speaker 7 (24:24):
That's lovely.
Speaker 2 (24:26):
Yes?
Speaker 4 (24:27):
And then how and she this is kind of a
this is a camp Bawa Heidi question.
Speaker 3 (24:31):
But doesn't she have a dog that she hasn't seen
in a long time?
Speaker 2 (24:35):
Yes, and she's with the dog now.
Speaker 3 (24:37):
Yeah, that makes my heart so happy. Thank you, thanks
for giving me that little cove.
Speaker 4 (24:42):
Yet, so what happens as far as the parole, Like
how often does she have to meet with them? Can
they decide at some point like that they don't like
how she's acting even if she does nothing wrong? And
turn this around like, what's the biggest fear around this?
Speaker 2 (25:00):
Well, there are objective standards. She has to follow the rules,
which she's going to do right, and she doesn't violate
the rules, then she remains on parole, no matter how
badly this upsets the Secretary of State and the Attorney
General Phil Wiser. As long as she follows parole rules,
(25:21):
she's a free person.
Speaker 4 (25:24):
Yeah, And listeners, I'd love for you to text in

higher level like I don't know if you call it
a lawsuit or complaint going on about the continuation about whether.

What the judge did was really wrong? Is that true?
Speaker 2 (25:57):
Well, we have so the court Colorado Court of Appeals
said that her sentence was illegal because it was based
on her speech, so she had to be re sentenced.
And then on May fifteenth, Governor Polus God bless him, said,
(26:18):
it is wrong to put somebody in prison for what
they say, no matter how strongly I disagree with Tina Peters.
It's everybody's liberty that is at stake in her case.
If you can sentence Tina Peters, for what she's saying.
You can sentence anybody for speech, and that's why I
(26:38):
am commuting her sentence. So he you know, he he
commuted her sentence, meaning she got out of prison on
April first, and I'm sorry June first today and is
now on prole So he defended everybody's free speech liberty.
(26:58):
The governor did and taken a lot of heat for it,
and you know, he's courageous. He did the right thing.
Speaker 4 (27:04):
No, I agree, and I got to give it to Jared.
He did the right thing, and I was, yeah, I
was very I was proud of him in that moment
and still am for that decision and grateful. And I
think it was definitely the right thing to do. We've all,
we all think it was the right thing to do.
But obviously most of the Democrats in Colorado don't agree,
and so if Jenna Griswold.
Speaker 2 (27:26):
Actually actually a great many of them do agree. My
Colorado Fading Stars hockey team is mostly Democrats, and I
would say almost all of them agree that Governor Polish
did the right thing and that Tina should be free
(27:49):
because you can't punish somebody for what they say.
Speaker 4 (27:52):

They pulled off quite the win today and Tina Peters
is out of prison and hopefully enjoying a steak dinner
with her pop and a nice comfy bed tonight.
Speaker 3 (28:35):

Voice, has followed the story very closely and she texted
me a couple of questions to ask if that's okay.
The first The first one is the commutation gets Tina
out today, but the seven convictions stand. What does the
dirt petition ask the color to Supreme Court to do that?
Speaker 3 (28:52):
The commutation did not.
Speaker 2 (28:56):
Our petition for Surcharira in the Colorado Supreme Court asks
the Colorado Supreme Court to reverse and vacate all of
her convictions.
Speaker 3 (29:06):
Nice.
Speaker 4 (29:07):
Great, and when what's the timeline for that?
Speaker 2 (29:12):
Whenever the Supreme Court acts?
Speaker 3 (29:15):
Oh, we have no control, lovely all right?
Speaker 4 (29:18):
Next question, Police cited the appeals Court's first Amendment finding
as his rationale. DA Rubinstein says, Police overstated what the
court ruled. How do you read what the Court of
Appeals actually found on protective speech?
Speaker 2 (29:32):
It was a clear the court actually said that the
trial judge punished Tina Peters for her speech, and that
is illegal for a court to do that in the
United States of America. That's why they reversed her sentence.
Speaker 4 (29:52):
Okay, So with resentencing overtaken by the commutation, is the
motion to disqualified Judge Barrett now a closed chapter or
does it carry into the cert petition?
Speaker 2 (30:04):
No, that is a closed chapter because the judge refused
to disqualify himself. So if the case, if there's ever
another proceeding in the Mason County District Court, Judge Barrett
will preside over it.
Speaker 3 (30:20):
John, is, what are.
Speaker 4 (30:22):
Some practical things Tina do you think Tina, and you,
as an incredibly talented attorney, suggests we should do to
prepare for the midterms, Like what do we actually have
control over as voters in Colorado that we could actually
do to make a difference here.
Speaker 2 (30:38):
Well, get your neighbors to go to the polls, but
talk to your neighbors Republicans and Democrat about this uncertifiable
voting system that we're still using in Colorado. It is
the same, basically the same smartmatic software that was used
(31:00):
to rig elections in Venezuela, and Colorado continues to use it,
and the Secretary of State has made it as illegal
for anyone to conduct an audit of an election or
to look at the system, have an expert look at
the system, or do a recount unless she says it's
all right. And of course that's not going to happen
(31:22):
if a Democrat's elected. There's never going to be an
audit and there's never going to be a recount.
Speaker 4 (31:28):
Yeah, John, we tried that in twenty two in my
race and got shut down, even but with a Republican clerk,
we got shut down.
Speaker 3 (31:34):
It was so annoying.
Speaker 4 (31:35):
But John, what this ruling about Trump's executive order that
it could go forward. What does that mean for Colorado,
if anything, in our elections.
Speaker 2 (31:48):
Well, there's two aspects to it. One is the court
of public opinion. What I believe we're going to see
in the next ninety days are releases of shaw information
about the rigging of the twenty twenty election and the
use of electronic voting systems to help rig that election.
(32:09):
And of course that's what the Democrats are calling lies,
and that's why Tina went to prison for making that claim.
But I think the public is going to see the proof.
And there's a great new book at out by a
guy named Seth Ketschel, for former Army intelligence officer who
served in Afghanistan, who predicted the twenty sixteen election, the
(32:33):
twenty twenty four election, and who has done a painstaking
job of exposing the fraud in the twenty twenty election.
And the title of that book, for your listeners, is
The American War on Election Corruption. It is a shocking book.
Speaker 4 (32:50):
And John, we're actually hosting Seth at the Freedom Fast
that we're having June twenty six and twenty seven. He'll
be one of our speakers on Friday, June twenty six,
And of course with love to have you there as well,
but we're really excited to hear what he has to
say and how it ties to Colorado. So what's the
other implication you said there were two? When was the
pr side? What about the legal side from the ruling
(33:13):
over the executive order with Trump?
Speaker 2 (33:16):
Well, I believe that we'll see a new executive order
that prohibits mail in ballots and hopefully prohibits electronic vote
tabulation and requires voter ID before a ballot can be cast.
(33:37):
So I think if we have those safeguards in place,
and we have hand counting in Colorado instead of machine tabulation,
regardless of the outcome, people will be able to trust
the result. But right now, we can't trust the result
because you don't know what happens inside those computers. There's
no way to tell, and the Secretary of State won't
(33:58):
let anybody look and see what's going on, so you
just have to take their word for it that this
is a fair election. But nobody knows how the votes
were tabulated on those computers, and it's the same software
that was used to reg elections in Venezuela. So why
should we accept that? Why did Colorado citizens accept a
(34:19):
corrupt voting system.
Speaker 3 (34:22):
That's a great question.
Speaker 4 (34:23):
And man, when I was running in twenty two, if
I even whispered about questions on the election, I got
destroyed by the liberal media.
Speaker 3 (34:32):
I'm glad we can at least have.
Speaker 4 (34:34):
The conversation now, but I am worried that the Colorado
leadership will just snub their noses at any executive order
that comes through and not allow any of that to
be pushed through in Colorado.
Speaker 3 (34:47):
What do you say about that?
Speaker 2 (34:50):
Well, if Trump's executive order is if a federal court
holds that it is a lawful executive order, and state
authorities refuse to conduct a federal elections in a federal
election in accordance with that order, uh, there's gonna be
a big mess because if they don't follow the rules
(35:14):
set down by the executive order, then the election how
can how can the federal election be valid if they disobey.
Speaker 3 (35:22):
A federal We've got to go to break.
