headlines today, some local, some national. Locally, you've got Attorney
General Phil Wiser. Another of these high publicity lawsuit filings

that I don't think is going anywhere, this one against
Trump saying, hey, you can't move Space Command because you're
punishing us for having melon ballots, so it's unconstitutional. I
think that that lawsuit is destined to fail because there
are separate, independent reasons to move Space Command. I don't
think it should be moved. I think it should be
kept here in Colorado. I wish it would be kept

here in Colorado. But the reality is this lawsuit isn't
going to keep it here. Even if they get an
initial injunction, it's not going to keep it here long term.
Why Because the Inspector General, Independent by Nature, Department of
Defense investigated whether the move to Huntsville, Alabama of Space

Command was improper, politically motivated, etc. And the Inspector General
determined that the move from Colorado because Peterson Air Force
Space Command had been the interim location of Space Command
after its formation, after it was all pulled together, and
the Inspector General of Department of Defense found that there

was good reason for the move. I think it was
called factually sound and well justified. But anyway, Wiser's running
for governor and he has this big attention getting lostuit
out there. But my point is it's just another example
of why we can be sure that the policies and
Wisers and all these elected Democrats at the highest levels

don't really care about you or the people of Colorado,
because if they did, they would not have gone out
of their way to attack Donald Trump. Because you know,
if Donald Trump's elected president, Donald Trump is going to
get to make these decisions and lots of other decisions
that affect the flow of federal money to Colorado. So
that doesn't mean you need to agree with him on everything,

of course not, and you shouldn't be punished for normal
political discourse. But going out of your way to savage
the guy going out of your way to say you
can't even be on our ballot here, what do you
expect to happen, and again I wish the Trump administration
had left it here. But these Yeah, these Democrats are
interested in their own headlines and ingratiating themselves with the

radical secular left that runs the Democratic Party nationally and
controls the flow of big money. They don't care about
what effect their attacks on Trump have on you here
in Colorado, which, guess what, there's not going to be
any upside to you or to this state from all

reason for moving Space Force to Alabama is the current

and Space Command, which is a space command is a

that has to be exciting. Working for Space Force.

Worked since space they stood up and they worked for
the Air Force since for thirty five years. I'm that
project manager for the project. Actually, all the numbers everybody
talks about, those are my numbers.

So the real reason why it's not coming to Carile
Springs is because it makes absolutely no economical sense. Okay,
we're already betting down multiple Space Force missions and we
don't have enough space for all the people that are here.
We have them in lease space around the city in
the region, and we don't we don't have enough space

to how all the missions that are being stood up
at Peterson Space Force space, and we don't have any
more space, and there's not any space available around Peterson
to expand Peterson's space space. In fact, the vast majority,
except for like twenty or thirty four acres, the vast
majority of the land that Peterson sits on is leased

from the airport, from the city. And anyway, if we
were to put the command here, it would be about
a two point eight billion dollar project. Those are not
my numbers. I did the calculations. We would have to
have a product to build a new substation, and we
would have to get CSU to support us to bring
a whole new feed to support that Slika's We're talking

about eighteen hundred new people for just that one command,
and we would have to build a new gate, new roadways,
we would have to reconstruct the sanitary sewer, the water lines,
the gas lines just to accommodate them on Peterson. And
if we do build that, sales can take up a
significant portion of the small available space. We have all

those missions that are coming that we have no cons
for that's congressionally a poo new construction. We wouldn't have any.

Wow, Peterson, and you're saying that this Redstone Arsenal in Huntsville,
they just have more of these more land, more infrastructure
options exactly.

And plus our area costs factor for construction is significantly
higher than the still by about eighteen percent. So basically,
if they build it here, the taxpayer is going to
pay about eight hundred million more dollars to build it here,
almost a billion more dollars to build it here, and
it's going to consume all the available space we have

on Peterson's space force space, and all those missions that
are slated they are already here, but we have them
operating out of these spaces and scattered to the four wins,
and we're supposed to consolidate them so that they can
you know, perform the mission correct or critical space force missions.
That would throw a huge monkey lench in that. So

it's a terrible decision to put it here from just
facility and from an economic stance. And it's just amazing me.
I listen to everybody talk and like these politicians speak
and they have absolutely no clue.

And it's a tragedy. But it just by me being
so intimate with this project, it just gives me insight
into how incompetent our political leadership is.

Let me get back to some of those texts as well,
and then I want to work in some of these
other topics. But we've spent most of the day so
far on this lawsuit. Colorado's Attorney General Phil Wiser just
filed against the Trump administration. I think that's number twenty nine.
How many did he file against Biden? I think there

would be zero? Right, Yeah, nothing to see here anyway.
So he files this lawsuit saying, hey, you can't move
space command because it's been temporary at Peterson. You can't
move space Command to Alabama. Because then you're punishing us
in Colorado for having mail in voting.

And the hook that Wiser has is.

When Trump made the announcement that the permanent Space Command
would be in Alabama, Trump mentioned Colorado's mail in balloty
and he went off on it, And so that's Wiser's hook.
The fatal flaw I think Wiser has in this lawsuit
is that the DoD Inspector General, independent by nature, has
already investigated the decision to move it to Huntsville, because

Trump had initially made that during the first term and
found that it was factually sound and well justified. So again,
I expect this lawsuit will eventually fail and Space Command
will be in Huntsville. But I was blown away here
because I started the show saying it should be in Colorado,
and everything I read made me believe that, And also

I live here. I want this state to succeed, and
this state has this proud tradition of a large military
presence serving the nation very well, and Space commands Bennett Peterson,
So why move it right? Ain't broke, don't fix it?
And then we've had so many callers with intimate knowledge
and experience, including our last caller and yeah, I don't

have a way to like vet these people independently, right,
other than Colonel Kirkdale, who I know. But you can
decide for yourself and I can decide for myself. And
they all sound one authentic but common denominator is they
all say that no, Colorado's not the right location for
space command. So I'm glad we've had the benefit of

these callers text or Dan well, multiple knowledgeable callers, especially
Daniel indirectly saying it's not a political decision by a
businessman who has every right to stick it to Colorado
leadership Democrats. It was a nice jab and bait for
childish folks about mail in balloting. Pardon Tina Peters, says
the Texter Dan. And then we've got some more text

on that I'll get to in a second, but no enlightening.
And that's been one of the great things for me
and talk radio over the decades, is if I'm wrong
about something. And I don't say this to be a jerk,
but it's been very, very rare because I work hard
to prepare for the show. I think about these things,
I do research, I talk to experts. So fortunately, over
the decades I've been right the vast, vast, vast majority.

But the beauty is it's tested by fire. It's one
thing to say you're right. It's another thing to go

be located in Alabama. This lawsuit is not ultimately going
to stop it because they're good independent grounds. Now at
that point I was just basing it on the DoD

while it's spending Colorado. Yeah, it's it's hard for me
to root against Colorado, Right, But then you listen to
somebody like Daniel, and he, from his perspective, believe strongly
it's it's better off in Alabama.

to be safer. They just did a evaluation between Denver
and Cheyenne, Wyoming. For a family of four making one
hundred and twenty thousand dollars a year, it is thirty
seven thousand dollars. That's thirty percent cheaper for a family
to live in Cheyenne than in Denver. These people are

I'm saying there are so many good lawyers in the
AG's office who are doing an awful lot of good

comes to the top, guy Phil Wiser, he's such a
political animal that you're right, things he should be using
the full force of the office, and he has a

very talented office, the full force of the office to attack.
He doesn't for political reasons. And that's such a waste
for the state. Because you look at some state offices
and you say, boy, I wish they had some more
talent in there. You look at the AG's office. They
got a ton of talent. He just won't use it
for the things that we really need him to use

Yeah. Well, and then you see him also several years
ago he got one that attorneys out of Chicago for
goodly Raye, Oh my goodness, Elijah and McLay. Yeah, it's
like we really that I don't know, you seem to
be pretty darn successful. Yeah, I guess most of your

lawyers are located in Colorado.

Oh my goodness, in the office. Well, what I could
never thank you for remembering that election lawyers.

What I couldn't figure out is they've got a lot
of talented lawyers in that AG's office. So why did
he go to It was Chicago? You're right, why do
you go to Chicago for those lawyers? And it's been
a minute, but didn't they lose or at least lose
one of the cases. You could have found Colorado lawyers
to lose it.

Yeah, yeah, at a much cheaper rate too.

On this and developing in Pole County Tonight, an elementary
school teacher will remain in the classroom. The school district
investigated her after she's sang a birthday song to a student.
It's a version the child's parent claims is offensive and
racially insensitive.

And new tonight. Paul County School says they found no
evidence that this teacher meant any harm. Ten David Bay
News reporter Angelusia Bruten joins US Live from district headquarters
this evening in Angalusia. You have the human resources report
break down those findings for US.

Courtney Pole County School says that the investigation included several
interviews with students as well as the teacher, Kimberly Langston.
It says that the intent does not erase the impact,
but the teacher did not have any ill intent. Sived
a written reprimand for a lack of judgment in photographing
and relaying several student images without parental consent. The policies

she violated are students safety and welfare, staff technology, acceptable
use in safety, and student records. Investigation says other videos
were shared of the teacher singing happy Birthday to students.
Langston's written statement says she has been singing this song
to students for twenty two years. The district says, although
this is a long standing practice, she is not allowed

to sing this song or film students moving forward.

His mother does ray pray their says, the teacher sent
her the video and she went straight to the main office.

I automatically said that's unacceptable and I don't feel I
don't think nothing's funny about it.

Speaker 10 (27:10):
Crayther says, there's a history of black people being described
that way, which makes it extremely upsetting.

Speaker 9 (27:16):
My skin is boiling.

Speaker 11 (27:17):
I don't even like racism and to know where we
come from in our ancestors and for us to be
labeled like that because Lane Cools lady based saying that
we're ugly, we're at like a monkey and all this,
and that I don't like that at all.

Speaker 10 (27:30):
Polk County Public Schools District staff and the HR department
are reviewing this.

Speaker 1 (27:35):

And developing in Polk County tonight, an elementary school teacher
will remain in the classroom. The school district investigated her
after she sang a birthday song to a student. It's
a version the child's parent claims is offensive and racially insensitive.

Speaker 8 (28:01):
Happy birth, Thank you you, you liven buzz you you
tlcome monkey.

Speaker 10 (28:11):
I so want to.

Speaker 8 (28:15):
Club everybody.

Speaker 1 (28:18):
How awful of this mother to do this to her child? Right,
because if you watch this video, if you get a
chance to see this video at home, looks like this
wonderful little boy. And you see the video of him
in class when Happy Birthday is being sung and he's
so happy, and then his mother just turns this all

(28:40):
ugly for him.

Speaker 6 (28:43):
Hi, legend, did you have a birthday last week?

Speaker 10 (28:46):
Yes, Legend, Whittaker just turned six years old.

Speaker 8 (28:49):
Can we take happy birthday to you?

Speaker 10 (28:51):
He attends Floral Avenue Elementary in bartow where his class
and teachers celebrated with a song.

Speaker 2 (28:57):
And then it goes on from there.

Speaker 1 (28:58):
The point of that sound is, why are they putting
this six year old on camera? This is the mother
putting this child on camera. All the teacher was doing
was having the class and happy birthday. Then she asked
him if he wanted the special funny birthday song. He
said yes. You could tell he was loving it, and

(29:20):
the teacher sent it to his mom, send it to
his mom, and then she goes and runs to the
school and claims its racism.

Speaker 2 (29:27):
But my point is just what about putting the child first?

Speaker 1 (29:33):
And why would the mother put the child on camera
in a TV interview? How is that any good for
the child? And to just turn this into a racial
thing for the child just kind of poisoning things.

Speaker 2 (29:47):
In the classroom for him. That's what ticks me off.

Speaker 1 (29:51):
And I've brought this up on air before over the
years in lots of different context when parents have put
their young children in the middle of stuff.

Speaker 2 (29:58):
It has nothing to do with race.

Speaker 1 (30:00):
We've talked about white parents who've done it, Brown parents
who've done it, at black parents. It's just parents who
choose to use their child as kind of a leverage
in a story like that just bugs me. And the
underlying issue come on obviously that there wasn't anything racist
about it, any racist intent, anything like that. So yeah,

(30:22):
just so sad for the teacher who's just trying to
be a good teacher and make class fun for those kids,
and you could hear the affection in her voice. And
then for the child you know who now has been
on TV and all of that, and imagine, you know
what he hears everywhere he goes Jesse, do you.

Speaker 2 (30:41):
Remember that song? Anybody ever sing that?

Speaker 4 (30:44):
I remember it? Yeah, one hundred percent. I think we've
all sung it, depending on our age, right, Yeah, yeah,
I had heard it for a while exactly that teacher
didn't have any bad intent.

Speaker 1 (30:53):
Yeah, yeah, I have not heard that for a while,
But since we have the great Jesse Thomas here.

Speaker 4 (30:58):
Ryan is off I think at a political right and yeah,
he went up north to moderate something with I think
Georgia Particler andbody else.

Speaker 2 (31:07):
Yeah. Sheriff Reames, Yeah, there you go. A great crew.

Speaker 1 (31:10):
While I was in trial for that long long trial,
Sheriff Reemes and DJ Brockler did a show together here
filling in for me, and I heard it was instant
classic stuff. So we've got to reunite them. But big
news today right on the Michael Brown Show this morning.

Speaker 4 (31:26):
Yeah, they're rearranging the deck chairs, so to speak. So
Michael Brown gets to sleep in a couple more hours
in the morning and he'll be over at KOA between
what nine a m.

Speaker 6 (31:37):
Till noon? Now.

Speaker 4 (31:38):
Prior to that, it is Colorado Morning News with Gina
Gondek from five am to six a m. And then
Ross Kamisky will come in and he will go six
to nine with Gina, I'm told, and Dragon Redbeard will kind.

Speaker 2 (31:52):
Of oversee all that as far as what we do.

Speaker 1 (31:55):
When does that start?

Speaker 6 (31:57):
November tenth?

Speaker 1 (31:58):
Oh?

Speaker 2 (31:58):
November tenth, wow.

Yeah, And then there's going to be open auditions for
this prime morning drive spots six thirty KITSCHW in Denver six.

Speaker 4 (32:08):
Am to ten am open tryouts for a little bit.

Speaker 1 (32:11):
So we'll talk tomorrow about Hey, who would you like
to see in that time slot? You know, that is
one of the prime time slots in all of radio
in Colorado six to ten am on six thirty KHW Denver,
which we're very proud carries the name KAPLA show along
with other iHeart stations, but the legendary Peter Boyles had
that time slot for years. It was you know, must

(32:32):
hear radio throughout the city, So it's a very very
important timeslot. Michael Brown has done a tremendous job there
and he will be at Dynamite of.

Speaker 2 (32:40):
Course on KOA. So who would you like to see there?

Speaker 1 (32:43):
And we'll get into depth tomorrow And don't feel like
you're limited any particular pool of people. I'm on record
is saying if Ryan Schuling wants that spot, I have
to believe he's a favorite because he's such a great
talent and very well respected and established. But you and
I share a belief that he may not be a
morning guy.

Speaker 4 (33:03):
It'd be a little rough, he'd have to make some
significant adjustments. Yeah, and I hope somebody tells the people
down at Circle K on the corner that Michael Brown
will not be in at five thirty in the morning
anymore to get his giant diet coke.

Speaker 2 (33:16):
Yeah, it'll send the authorities after him. Will be brutal.

Speaker 1 (33:19):
Michael Brown and Donald Trump key to success diet coke Texters. Dan,
we used to sing that song to all of our
friends growing up. Skin skin color did not matter. Nineteen seventies, Dan,
mother is raising a thin skin son and galvanizing his victimhood.
She could have used it as a teaching moment. The
boy looks like an absolutely wonderful child, and I just
feel so bad that he's been put in the middle

(33:40):
of this. And I do blame the mom for that,
not the teacher.

Speaker 4 (33:44):

Speaker 1 (33:44):
That teacher should be tested for sanity singing that song
in this day and age, any student is criminally stupid,
completely disagree texture. But that tells me is you've got
a teacher who's completely colorblind. That's what doctor King wanted,
That's what we're all supposed to be, is completely color blind.
And so I think what you got there was just

(34:06):
purity from that teacher.

Speaker 2 (34:08):
I don't think.

Speaker 1 (34:08):
Anybody can honestly suggest there was anything racial from the teacher.

Speaker 2 (34:14):
Dad.

Speaker 1 (34:14):
I used to sing that song to my friends all
the time. It was fun that mom is looking for
a handout, just so sad for the child looks like
just a wonderful child. And to be thrown on camera
like that and everything else. But Jesse, great to work
