Speaker 5 (00:24):
Now, Tom Martine, Hello, what is going on?

Speaker 3 (00:29):
I'm Tom Martino, forty five years fighting for you, solving problems,
answering questions, taking complaints. And I got major Mark major
back at the ranch, the main studio with UH with
some guests coming up hill six at best here. Yeah,

(00:49):
you got a lot going on, Mark, So do we
have guest scheduled? I know we had some scheduled.

Speaker 6 (00:55):
Tom, we have a new refer list member who's gonna
be here shortly to introduce them.

Speaker 3 (01:00):
Then that'll be great. Well, thank you guys for being
here as always.

Speaker 7 (01:05):
Uh.

Speaker 3 (01:06):
By the way, this is unbelievable what I've been saying
imposter scams or phishing scams or scams in general. The
FTC says, where do most of them come from? Where
they come from? Social media? Social media? Here's what they're

(01:28):
flagging as the top sources for consumer scams. You know
what Number one is? Facebook? Marketplace? My god? That think
you know what? I don't hear a lot of right now? Though,
Remember saying, wait, excuse me, Craigslist. What the heck's going
on Craigslist? Does anyone use Craigslist anymore? Because I don't.

(01:50):
We don't really get a lot of complaints about.

Speaker 2 (01:53):
We give stuff away on it a lot.

Speaker 3 (01:56):
Okay, cool. Facebook Marketplace absolutely one of the most prolific
sites for consumer scams. Start on Facebook Marketplace. The next one,
they say, Instagram with ads, Instagram ads and sometime messages.

Speaker 2 (02:20):
By the way, we're here to solve problems.

Speaker 3 (02:23):
So let's give out that number because we want you
to give us a call. Three oh three seven one
three talk now. That's the iHeart number, three oh three
seven one three A two five five. But you can
call this other number, three oh three Martino. You can
call twenty four to seven, no matter when you're listening
to the show. If you think you know what, I
really want to chime in, or I need a problem solved,

(02:45):
or I need an answer a question answered, what you
can do is call three oh three Martino three oh
three six two seven eight four sixty six. And if
we're on the Eric comes straight through, so you'll get
through us right now. Or if you call one word
not on the air, you'll get our voicemail or our
office or someone, and we will get back to you.

(03:06):
So that's an easy way to stay in touch. Three
oh three Martino three oh three six two seven eight
four six six. So Mark, is there anything particular on
your mind? I'm going over to scams Phil and it's
every go ahead.

Speaker 8 (03:21):
Filter, layer upon layer of dirt. I've never seen so
much dirt in a studio in my life. I can't
believe it, and I'm sick of not talking about it.
Quite frankly, studio dirt.

Speaker 3 (03:32):
Give me, like, what are people like, uh not respecting
the snow.

Speaker 2 (03:36):
He's got nothing to do with any host sitter on here.

Speaker 8 (03:39):
I have looked at the same dirt in this triangle now,
for my god, I don't think it's ever been cleaned
one single.

Speaker 2 (03:46):
Time, not one time. I find it amazing.

Speaker 3 (03:50):
Uh oh wow, dirt in the studio people, that's a
third world problem. What is on your mind today? Instagram?
Have you ever been ripped off by Instagram? I'm raising
my hand. I have been. I have been ripped off
by these ads. The biggest ripoff was the flashlight where
they show this giant flashlight. This girl's holding this flashlight,

(04:14):
and then this guy's holding flashlight it's a really big
powerful flashlight, and then they show it pointing at balloons
and busting the balloons, and they show it in the forest,
lighting up the forest. And I swear to you when
I got it it was they were. It was a tiny,
tiny little flashlight that takes triple A batteries. But the

(04:35):
ads were just an out and out flat ripoff. Here's
the good thing that I have found about Instagram charges.
You know, when you order from these ads, you know
what it is.

Speaker 2 (04:49):
It's absolutely foul safe, and that is.

Speaker 3 (04:53):
You. You can contest the charge and they will never answer, so.

Speaker 2 (05:00):
You get the product free. I swear to you.

Speaker 3 (05:03):
I have a challenge now because of ripoffs and misrepresentation.
Five products. They take it off your charge and the
merchants will never get back to Capital one or to
whoever you are chas or whoever you have your card with,
and when the merchant does not respond, the charge stays off,

(05:26):
so you literally get free products.

Speaker 2 (05:28):
Now I'm not saying you do that to be dishonest.

Speaker 3 (05:30):
If I got a product that was advertised and I
got it and it was as advertised, I would keep it.

Speaker 2 (05:39):
One of the biggest ripoffs.

Speaker 3 (05:40):
They're sighting is this one about a puppy, a life
a lifelike puppy, a little white dog that you know
supposedly is noise activated, sound activated, and it's like life like.
And that is the biggest ripoff that people are citing.
The other one flashlights on Instagram. Now, these ads don't

(06:04):
always come up on Instagram. You might see the ads
when you go to play a game, and before the
game comes up or before the new cycle of a game,
you get these ads. But online ads are being named
as the biggest source now of ripoffs. You know, I
remember back in the day, my number one ripoff was

(06:24):
mail order. I mean you think about that. If we
used to mail order from magazines and from you know,
TV or radio, and then they would not get what
they ordered or they'd get some kind of scam. I
remember one time, this piano was advertised for people who
are learning to play piano, and they said it's an

(06:46):
unbelievable price of twenty nine dollars ninety five cents and
they show this unbelievable piano and when you got it,
it was it looked like a little calculator. It was
the size of a calculator and you had to play
with your fingers and it made little beef sound b
and I swear to you they were charging thirty bucks

(07:07):
for this thing back back then, years and years ago,
and there was nowhere to complain. You know. Over the years,
the Internet and technology has taken over for all every
scam you can think of, whether it's investing scams, whether
it's buying and selling scams, whether it's phishing with a

(07:27):
pH where they gather information. It is the number one
source of ripoffs. So Facebook, marketplace, Instagram or online ads.
Instagram is the number one place, but you get them
when you're playing games. And then TikTok promotions number three
on the scam list according to the Federal Trade Commission,

(07:48):
TikTok unbelievable.

Speaker 4 (07:51):
You almost everything you see.

Speaker 3 (07:52):
On TikTok these promotions are ripoffs. Then they say investment scams, sleek, gold,
silver and other things. These investments or crypto is a big,
big deal. And then believe it or not. Romantic encounters

(08:13):
romance scams. These are scams where people make you feel
like you're special and they want to meet you, and
then they want you to pay to help them get
a plane ticket to come and see you. Let's talk
to Darlene now three to oh three, seven to one
to three, Talk Darlene, what's going on in your life? Welcome?

(08:35):
What's happening?

Speaker 9 (08:36):
Okay, I hired a plumber in twenty twenty. Again, I
know this guy and I always thought he was the plumber.

Speaker 3 (08:47):
Wait wait, wait, you hired a plumber in two thousand,
in twenty twenty.

Speaker 9 (08:52):
Twenty twenty.

Speaker 3 (08:53):
Yes, okay, and what was this for?

Speaker 9 (08:57):
For a toilet and to snake my showers? And became
brack and he set my price for breaking and so
we repaired the pride to the shower to the main
line under the floor. But he when he got there
and he told us that it was messed up so
he could change it. And I told him, well, I

(09:18):
don't have that kind of money right now. But he goes,
I'll trd you twelve thousand. That takes the main line
all the way to the street.

Speaker 10 (09:26):
So he did.

Speaker 3 (09:27):
Wait a minute, you spent twelve thousand, twelve thousand dollars, Darlene,
back in twenty twenty in order to get your sewer
line replaced. Is that right?

Speaker 11 (09:38):
Yeah?

Speaker 9 (09:40):
And okay, okay, So a month ago we've been talking
to these people to see if they and to the
company he works. Now, well, when we have to go
to the courthouse and he took out some papers, turns
out he's not even a plumber.

Speaker 12 (09:57):
All these years I thought he was.

Speaker 13 (10:00):
Wow.

Speaker 3 (10:02):
Yeah, but I think it might be it might be
too late to do anything.

Speaker 2 (10:07):
But I have a few questions.

Speaker 3 (10:09):
To ask first, very basic questions, whether he's a plumber
or not. Did he do the job back in twenty twenty.
Did he actually dig up the dirt and replace the pipe?

Speaker 9 (10:20):
Yes, but he did it in the evening when it
was getting dark outside, and they did it in the dark.
And I thought he was supposed to be with somebody
because he They turned out he's what is the primer.
He needs to have somebody that over he needs to
help him. He had three guys and when he put

(10:42):
the pipe to the street, I was watching them from
my door, and another car turned up and told him, no,
I ain't there, it's over.

Speaker 4 (10:51):
Here, and so hold on, hold on.

Speaker 3 (10:54):
So that it was replaced, did it did you have
backups after he replaced the sewer or did it start working?

Speaker 9 (11:03):
It was working, but then it started like sometimes it's
partet would okay, are.

Speaker 3 (11:07):
You having a problem? Are you having a problem with
the brain.

Speaker 9 (11:10):
Now, yeah, it came all the way into my house
because I kept from snelling it for months.

Speaker 3 (11:19):
And wait a minute, so you're having you're having a
sewer back up?

Speaker 4 (11:22):
Now, yeah, it.

Speaker 9 (11:24):
Came up to my bathroom, my bathroom on the shower.
So we called the guy and his cat say we
didn't do my pipe inside the house, only outside. So
his company only got paid seven thousand, five years.

Speaker 3 (11:39):
Right, hold on, Darlene, I need to take this break
and I'll come back to you. I'm not sure we
can do anything about this after all this time, but
I want to know if you have the contract and
what it says and then acts, if you could talk
to her off the air. She sounds awfully hollow to me.
And I'm not sure if she's using bluetooth or a speaker,

(12:01):
but whatever it is, if we if she could clear
that up, let's see if we can do that. I'm

three oh three seven one three talks seven one three
eight two five five. As we've been doing for many, many, many,
many many many years, solving problems, answer question tak complaints.

(13:27):
Darlene has an issue with a plumber. She said back
in twenty twenty, she hired a guy to snake the drains,
and he says, hey, you need a new drain line.
And I believe she spent like twelve grand. She says
to have a new sewer line put in, and she's
having problems again. And the guy said, wait a minute,
you just paid to have the sewer line replaced. We

(13:49):
didn't snake the inside of your house. Meanwhile, she did
some investigating and found out the guy's not a plumber.
By the way, plumbers, you don't have to be a
play to do plumbing work. You have to have a
master plumber in the company somewhere to oversee the work.

Speaker 2 (14:08):
But I believe all you need is.

Speaker 8 (14:10):
They did excavation as well. I mean, I don't even
know the scope of work they did.

Speaker 4 (14:15):
Sure.

Speaker 3 (14:16):
Yeah, So exactly what did they do exactly for you,
Darlene the twelve grand What did they do for you
back then, back in twenty twenty.

Speaker 9 (14:24):
Okay, he dug up my basement, put the vine from
the shower to get the main line under the ground, and.

Speaker 4 (14:35):
He worked.

Speaker 9 (14:36):
He did that with his son in the evening.

Speaker 3 (14:39):
But did he also do did he also do the
main line out to the street.

Speaker 9 (14:44):
Yes, he took that whole line only out to the street,
But he did the basement first, and then he took
that line in the basement, connected it to the other
line with that white with a white pole or what
is that white pipe right?

Speaker 2 (15:00):
Whatever it is, Yeah, it's a TVC or whatever he
did in.

Speaker 9 (15:04):
The night outside they had.

Speaker 3 (15:07):
So what are you looking for right now? I mean
it might be too late to go back on that
twelve thousand dollars job. Are you saying that he didn't
do it right? Or what are you complaining about today?

Speaker 9 (15:16):
Okay? I called the plumber because it backed up into
my house. A plumber came and cleaned it, and he
said the pipe, the main pipe, was not put on right.
They didn't hit that.

Speaker 10 (15:28):
I don't know how.

Speaker 3 (15:29):
Did they did. Did the plumber you hired? Now, did
that plumber tell you what was wrong?

Speaker 4 (15:37):
Yeah?

Speaker 9 (15:37):
He told me the whole pipe was messed up. That's
why he wanted to change it. So why did he
changed it?

Speaker 10 (15:43):
No?

Speaker 3 (15:43):
No, I mean what did he say the plumber did wrong?

Speaker 9 (15:47):
Oh, he didn't put that main pipe that goes through
the street in right. I got too tell.

Speaker 3 (15:56):
And what do they say? What do they say it's
going to take to fix?

Speaker 9 (16:00):
Oh? I asked another one and he said, that's if
it's fixable, because under the ground, we don't know what
damage is under the ground. And he goes it might
run up to forty to fifty thousand dollars?

Speaker 2 (16:14):
Do they not scope it?

Speaker 14 (16:17):
Day? What does that scope it?

Speaker 3 (16:19):
There's no way it's going to be forty or fifty grand.
I mean, you got to get somebody out there who's honest.
That's the very first thing we have to do. I'm
not going to listen to any of these people you called,
how did you find how did you find this plumber
that came out?

Speaker 2 (16:33):
And how did you find the plumb? Did they run
a camera? For God's sake?

Speaker 9 (16:37):
They ran the camera twice?

Speaker 8 (16:39):
And what are they sayings wrong with it? Is there
a belly in the line? What are they saying?

Speaker 9 (16:44):
It's going like a roller coaster from in my house
alway to spend more.

Speaker 2 (16:49):
So it sounds like there's multiple bellies in a time,
right right? But my mark forty or fifty grand?

Speaker 3 (16:55):
My god?

Speaker 2 (16:55):
How long ever run is it?

Speaker 3 (16:58):
Well?

Speaker 9 (16:58):
This company he worked for said that he didn't do
the stunning inside my house, and I told him he
did with his son outside. He didn't have nobody to
watch him. Two friends that helped him for three and
then the inspector came in the night, stopped his car,
ran to where they were standing and said the past

(17:19):
the main pipe wasn't right there.

Speaker 4 (17:21):
They have to Darlene, let me.

Speaker 3 (17:23):
Just get let me get right to the heart of
the matter. This is the unfortunate reality. Most likely this
plumber that you hired back in twenty twenty, he's a
clown and maybe he didn't do it right. But the
chances of you getting any money back are slim to none.
These guys don't have any money.

Speaker 4 (17:42):
But they don't know what that time.

Speaker 8 (17:44):
Why would it have lasted five years and he only
charged her twelve grand? You know how much a sewer
line can be. I mean, that sounds like a very
reasonable price. It lasted five years. Yeah, but what I
don't understand.

Speaker 14 (17:58):
He told me.

Speaker 9 (17:59):
I understand. He said, Oh, we'll put this. It's a
it's a the whole blue pipe that will last longer
and you know, we won't have no problems. While he
did do the job, but towards the five years, we
have plugging out toilets that we have to use the
plumb tanger and sometimes we have to go it.

Speaker 10 (18:21):
Was I don't know.

Speaker 15 (18:21):
I don't know what to do.

Speaker 4 (18:23):
Listen, Darlene, what we have Mark.

Speaker 3 (18:24):
I think what we need to do is she needs
to get somebody out there with a camera who knows
what they're doing.

Speaker 4 (18:30):
I don't want to.

Speaker 2 (18:31):
I don't know what plumber did what?

Speaker 3 (18:33):
And the most recent plumber that you had out there, Darlene,
how did you find that most recent plumber? Uh?

Speaker 9 (18:40):
My daughter was handling that and she got one from us.

Speaker 16 (18:44):
What is it?

Speaker 10 (18:45):
A blue sky.

Speaker 4 (18:47):
And one blue sky? Oh boy?

Speaker 2 (18:49):
You know what.

Speaker 8 (18:50):
Let's get euro out there, a plumb line. Let's get
a company out there.

Speaker 4 (18:53):
Darlene.

Speaker 3 (18:54):
We're going to put you on hold and we're going
to give you a recommendation. We can't go forward until
we know where we stand. Okay, And because there are
so many ripoffs in the drain business, we literally need
to know the person to help you out. And we
will help you, but you need we need to know
where we're starting from. We need to know what was done,

(19:16):
what's wrong? Where is she? Where is she at? Where
do you reside?

Speaker 4 (19:24):
Ask her where her house is or whatever?

Speaker 2 (19:26):
We'll hold on. Where where's your house?

Speaker 4 (19:28):
At?

Speaker 9 (19:30):
Twenty seven Nationwade Thorton, Colorado, shortin?

Speaker 4 (19:34):
Okay, hold on, she's in Thornton.

Speaker 8 (19:36):
All right, let's take a break and let's stay on
time and I'll get a I'm going to try to
get euro or someone out there, whoever I can get it,
hold it first.

Speaker 3 (19:43):

(20:55):
introduce our studio guest Mark.

Speaker 8 (21:00):
Jess Terran, and he's with Terror Construction. Here's what I
love about these guys. He's new to the referral list
and Jess is the actual owner. But here's what's really cool.
They do cement, cement in cement and foundation repair. In fact,
Jess someone to help them with that. Mike, in your
own words, what do you guys do? What is your

(21:21):
main thing at Terran Construction?

Speaker 4 (21:25):
We do flatwork, foundational work, ornamental concrete, dirt work, and
just anything related to civil construction.

Speaker 2 (21:34):
Do you do a lot of commercial stuff too?

Speaker 4 (21:36):
We we do. We we did, and you know we're
kind of slowly converted to maybe some uh maybe some
more HOA stuff and residential stuff.

Speaker 8 (21:48):
We bet we's a foundation guy for a while. So
this guy can go in there and fix foundations, which
is remarkable. Then if you're building like a big building
or a barn or an r V garage like I did,
I would.

Speaker 2 (21:59):
Assume you can absolutely and you can actually do it.

Speaker 3 (22:02):
Yeah, we can.

Speaker 2 (22:03):
Very cool.

Speaker 4 (22:03):
We can dig it and we can build them.

Speaker 3 (22:05):
Hey, Jess, you had an opinion on this sewer call.
What what were you going to chime in with?

Speaker 4 (22:10):
Well, I was just wondering if the you know it's
She said, it's been holding for five years, so that's
quite a long time.

Speaker 2 (22:19):
Yeah, that's the part I don't understand.

Speaker 3 (22:22):
Why after five years is it developed being problems, Darlene.
Did the guy say the new plumber, did he say,
why you're having problems right now?

Speaker 2 (22:34):
It was like a roller coaster.

Speaker 9 (22:37):
Yeah, he didn't want to come and check it. We
called him because he worked for another company that paid
He paid that other company.

Speaker 8 (22:47):
I can't even follow half the stuff she's saying. We
got to know what we was talking about it.

Speaker 3 (22:51):
Let's get All I want to know is did the
newest plumber tell you what was wrong with it?

Speaker 9 (23:01):
He said, the pipe wasn't put in right. Okay, we
hired two people.

Speaker 3 (23:06):
Did he use a camera to tell you that? Did
he tell is that what he did?

Speaker 10 (23:11):
Yeah?

Speaker 8 (23:12):
Two plumbers, but he said it was going to be
fifty or sixty thousand dollars.

Speaker 9 (23:17):
That their plumber came and he looked at the footy
gist and that's when I told him, how can we
fix that main pipe? And he goes in the first place.
When they did it, they didn't put it in right.

Speaker 8 (23:29):
Oh my god, Darlene, what are they saying it's going
to take to fix it? How much is it going
to be to fix it? Okay, let's get Steve up
real quick.

Speaker 3 (23:39):
Hey, Steve is.

Speaker 8 (23:40):
With euro Plumbing. Steve, I'm going to put you on
the spot. He's out there in Thornton. We have no
idea what's going on over there. Can you guys get
someone out there in the next day or two scope
it and give her a reasonable price to.

Speaker 2 (23:52):
Fix it if it has to be replaced.

Speaker 8 (23:55):
We have no idea what's going on, but we have
other people telling her fifty sixty grand.

Speaker 2 (24:01):
Yeah, that's a lot of money, Steve.

Speaker 11 (24:02):
That's a lot of money. And I don't think, just
off the top of my head, I don't think it
should be that. And what we'll do is we'll come
on out today or tomorrow, we'll figure out when the
best time for her is, and we'll give her an
actual price for what it would actually take if there
is something wrong, and what is actually wrong.

Speaker 8 (24:15):
Well, you know that I love about these guys now,
honest to God, and thank you Steve for doing that.
At a minute's notice. But Tom, they have just launched
on their website. They will give you not just an estimate,
they will give you a price now, and that's going
to be the price.

Speaker 2 (24:31):
Whether it's a water heater, whether it's a repipe.

Speaker 8 (24:34):
They are doing actual pricing that they lock into.

Speaker 4 (24:38):
Yeah.

Speaker 3 (24:39):
And by the way, speaking of repiping, they do Pecks,
the best Pecks plumbing on the market. They also do
water heaters starting at fourteen ninety nine. I mean, these
guys are unbelievable. Steve, A quick question for you on this,
What can you fathom would cost fifty grand if they
gave her and said it's going to cost around fifty grand.

(24:59):
Can can you imagine what could possibly cost fifty grand
in a normal residential environment.

Speaker 11 (25:09):
It would have to be really deep cuts. You'd have
to really dig lots of driveway, lots of tree something else.
I mean it would be that would be more of
a commercial price. It's just I would have to see
it for most residential situations. On a multi major, multi
family with tons and tons of asshole moving moved. I
just I don't know what it would be.

Speaker 3 (25:28):
Yeah, it sounds ridiculous. By the way, you're all plumbing
Colorado dot Com seven to zero, five hundred three thousand,
seven to zero, five hundred three thousand, the guaranteed best
prices and plumbing. Thank you, Steve, appreciate it and I
appreciate Jess Tron in the studio giving his opinion. Now

(25:48):
let's go to Sarah. Sarah, let's talk what's going on
with you?

Speaker 2 (25:53):
Sarah, Welcome to the show.

Speaker 14 (25:56):
Good morning Tom. I have a situation and I need
to ready past you see if you can tell me
what my recourse is or how I should proceed. Back
in March, I intended a health seminar. There was talking
about some equipment that if you use it would help

(26:18):
improve your help. Well, I was very interesting in improving
my health, I always and that's why I attended to send.

Speaker 4 (26:28):
And what was it they were selling? What was it
they were selling?

Speaker 14 (26:32):
They were selling there was a red light therapy panel
and wife rating drum.

Speaker 4 (26:41):
Yeah, yeah, so what about it?

Speaker 14 (26:44):
I nevertheless, I paid me this harsh fifteen thousand dollars.

Speaker 2 (26:49):
Oh no, oh, my gosh.

Speaker 8 (26:51):
We bought one on Amazon for nineteen bucks.

Speaker 3 (26:56):
And by the way, red light therapy, red light therapy,
far infraredive, that's what you're talking about. It's to stimulate circulation,
and it doesn't go deep into the tissues.

Speaker 2 (27:08):
It's sadly exaggerated.

Speaker 3 (27:10):
It does have limited therapeutic value near the surface of
the skin, and it does have some value there, but
it's sadly, sadly over exaggerated by a lot of these doctors.
Did you spend fifteen grand, Sarah, yes.

Speaker 14 (27:28):
At the tom of sale, Tom, the guy who was
selling it, his name taught as Tat Tanner. He said,
they have a lifetime warranty on all the machines, and
instead of a thirty day money back guarantee, they do
six month money back guarantee.

Speaker 3 (27:48):
All right, so if you went in March, why don't
you just go get your money back.

Speaker 16 (27:54):
I let me get to that.

Speaker 14 (27:58):
After using it for eight by the week or so,
I ended up in an emergency room because it sent
my blood pressure to genderous levels. I contacted. I tried
to contact the company. None of the numbers that they
had given us anybody answered. I Google search the owner

(28:21):
of the company, number, any number for the company.

Speaker 4 (28:24):
What's the name of the company. What's the name of
the company.

Speaker 14 (28:30):
The name of the company is Vibrant Health. So Health Systems, Inc.

Speaker 8 (28:38):
Let's guide off here and take a quick break time
and come back and see if we can't find this
guy selling fifteen thousand dollars red light therapy.

Speaker 3 (28:46):
Well, it sounds like it took go. What is his name,
by the way.

Speaker 14 (28:50):
Brian Oaks, I have a number if you could contact
because yeah.

Speaker 4 (28:55):
Hold on, hold on, we'll come. Well, that's what we'll do.

Speaker 3 (28:58):
During the break, we'll try to call the guy and
find out what the hell is going on.

Speaker 2 (29:02):
This sounds crazy. By the way.

Speaker 3 (29:04):
Dan McKenzie does wills and trusts and can help you

(30:21):
So what what the heck? Sarah? Uh this seminar. I
just can't believe you would buy a machine for fifteen grand.

Speaker 2 (30:31):
Uh.

Speaker 3 (30:32):
This is the red light machine. By the way, how'd
you there have been people she paid fifteen grand?

Speaker 2 (30:37):
She said?

Speaker 10 (30:37):
No?

Speaker 2 (30:38):
I mean, how though?

Speaker 8 (30:38):
It was it like in a credit card? Are they
monthly payments? I mean did you just come out of pocket?

Speaker 13 (30:43):
No?

Speaker 14 (30:43):
No, no, it was paid in full. It was paid
in full. Here's the interesting part. After many tries trying
to get a hold of somebody to tell them that
it doesn't work for me, they sent me shipping labels
to send the equipment back, and they said they would
be fun me. They amount minus fifteen percent restocking fee

(31:04):
for just using it for two weeks. And after I
send the equipment back and it shows that they have
received it, I received emails from them that they have
received it, that the check is in the mail, so
the check has been returned. They sent me a check
for twelve seven hundred and fifty that has been returned.
I can't. Oh, I'm really upset that the check has

(31:29):
been returned, they say, and I will not accept anything
but the cashier check. They sent me another regular check
and I just came from their bank that they would
not return it. They could not fund it.

Speaker 17 (31:44):
They have.

Speaker 4 (31:44):
They're writing you a bad check for twelve grand. That's
what's going on.

Speaker 6 (31:48):
They're willing to give her a refund minus fifteen percent
restocking fee mark, but their check keeps bouncing.

Speaker 2 (31:54):
Let's get them on the air, ax man.

Speaker 8 (31:56):
Let's try to get them on the air and figure
out why they can't write a check that doesn't ounce.

Speaker 3 (32:03):
Go ahead, I did.

Speaker 4 (32:04):
I just I was just on the phone with him.
Hold on, hold on, hold on, man.

Speaker 3 (32:08):
What happened?

Speaker 1 (32:09):
So what happened was I called him, and you know, I
was giving him the whole talk about Oh, we just
wanted you to hear your side and whatever. He seemed
at first at first concerned and wanting to help. He
was what he was like, well, why can't she get
in touch with us? I was like, he said, he
does not want to come on the air. So I said,
I can I give her your information to talk to her?
And she's like yeah, I said, just give me a

(32:29):
sex so I can push you on hold when he
was listening. He hung up after that, so he.

Speaker 3 (32:34):
Was Okay, So, Brian, this guy's name is Brian ox
o c H s or Oaks. Is that how you
pronounce it?

Speaker 16 (32:50):
I believe So?

Speaker 2 (32:50):
Is that who you talked to?

Speaker 1 (32:52):
Yeah, that Brian's who I talked to you.

Speaker 8 (32:53):
Let's try him one more time before we ask our
listeners to quietly call him.

Speaker 2 (32:58):
Okay, that's a good idea.

Speaker 3 (33:00):
Let's do that three three seven to one three talk
seven one three eight two five to five. By the way, really,
I want to make this clear. Red light therapy has
very very limited therapeutic therapeutic properties, and so many people
go to these seminars. Mark, I don't know if you remember,

(33:21):
but we had this one lady that one time that
spent like twenty grand on it, and this was a
chiropractor selling it.

Speaker 8 (33:28):
There are mostly we got them a refund that was outrageous.
But that chiro practor I forget the name did come
through and refund it.

Speaker 3 (33:38):
Yeah, but they the claims they make are incredible, and
as we said, you can buy the damn things, the
same exact things for you know, less than one hundred
dollars on Amazon. And again they only go partially into
the skin. They're not this end all. My god, they

(33:58):
make it sound like a miracle, miracle thing, like it's
gonna cure everything. I'm interested to see what they promised
Sarah or what the literature looks like. If she could
forward us any of the claims, I'd love to see it. Now,
she's already returned the equipment, so you know, that's a
positive sign at least that she was able to find

(34:22):
them and get the equipment delivered or sent back.

Speaker 2 (34:27):
That's a positive sign. Even a bad.

Speaker 3 (34:30):
Check in a way is a positive sign that they're
not ghosting it.

Speaker 2 (34:35):
I'm curious.

Speaker 8 (34:35):
We haven't had Frank ball on in a while, but
I think I smell treble damages.

Speaker 3 (34:40):

Whatever is going on in your life, we want to
hear about it. We call the everyday aches and pains
really the things that make you take the things that

(36:04):
tick you off. I've been saying that for forty five years.
In fact, some guy sent me some archives of the
show he found from twenty five years ago. Really he did.
I'm going to hold on, let me play with something
real quick here. I'm just gonna randomly, honest to god,
these are these are definitely my show is hold on, listen,

(36:24):
let's see real.

Speaker 4 (36:26):
That is a whole time.

Speaker 3 (36:28):
I'm trying to Thomas, my.

Speaker 7 (36:30):
Uncle Vinnie's got an apartment house. Why can't I invest
in it? I think there's something to do with owning
part of it or making decisions.

Speaker 4 (36:36):
Anyway, that's just this little sponge.

Speaker 3 (36:38):
Yeah, I thought maybe i'd hear anyway, I have artist ways.
I went through these and I can't believe it. I mean,
the problems are all the same. People never learn.

Speaker 2 (36:51):
I want to hear about uncle Vinnie.

Speaker 3 (36:54):
Yeah, I know, I know that was funny. And I
just keep spot checking these and I'm trying to and
and by the way.

Speaker 4 (36:59):
I have that right.

Speaker 7 (37:04):
And it's and it's not good speeding correct And I
don't blame you say I'm willing to pay. But you
know what, I don't know, because I think according to ADA,
they just have to make reasonable accombinations.

Speaker 3 (37:14):
Anyway, I don't think my voice changed at all over
the years. It has you think you hear a difference.
I think something it's more.

Speaker 18 (37:26):
I took h like a regular screw driver the backside
of the plastic and I smacked I think it's right
on the throttle b and that worked, And that worked.
I shut up, turned back on. I haven't had the
problem since.

Speaker 13 (37:38):
I'm pretty sure that's what it is.

Speaker 7 (37:40):
Wow, maybe you could have solved this where Ford engineers can't.

Speaker 3 (37:46):
Yeah, he smacked it with a screw driver anyway. So
by the way, Sarah unfortunately already spent the money that
she sent the machine back. Look, I'm going to tell
you something, man, just don't don't buy any of these machines.

Speaker 4 (38:01):
I mean, just don't at these seminars.

Speaker 3 (38:04):
I want you to translate seminar for these health things
as the most they're mostly scams. In fact, I don't
know of any that do seminars that are real. They
just need to get you in a room and talk
into something.

Speaker 8 (38:20):
Hey asks, what happened when you called up this Brian
Oachs at Vibrant Health Systems?

Speaker 2 (38:26):
Is he coming on?

Speaker 8 (38:27):
Are they going to refund it? I heard you say
something like they don't write checks.

Speaker 3 (38:31):
What's the deal?

Speaker 1 (38:32):
He's been all over the place with me. I'm going
I've called him two or three times, and he keeps
hanging up as soon as I put him on hold. So,
but he said the reason that they're doing he said,
they don't do cashier checks. They said they don't write it.
They said the regular check. That's why they said that
cashier check is the one that's bouncing. But apparently that's
not true, Sarah.

Speaker 4 (38:53):
Did they say regular story twice?

Speaker 14 (38:58):
They said system the bank doesn't fund it. They said that.
I went to their own branch of bank, which is
different from my bank, very bank. They told me that
there is a two thousand dollars limit on how much
the check can be. You can open an account here

(39:19):
and we can deposit it. I opened an account with
their bank, and when I went to deposit it, they said, no,
you have to contact check the major because they can't.
They told me that they can they cannot find positive
pay for this check. I don't know what that means.

Speaker 3 (39:41):
We need know what it means. It means not enough money,
that's what it means. So people beware of Vibrant health systems.
Do they have a website?

Speaker 2 (39:54):
Is that their phone number? There's four to one two, No,
that's uh no.

Speaker 14 (39:59):
These are the numbers that I had to find by googleing.

Speaker 3 (40:05):
Do you know what their website is?

Speaker 4 (40:06):
Can you give us?

Speaker 3 (40:07):
Do you have their website?

Speaker 16 (40:11):
I don't.

Speaker 14 (40:12):
While I was doing I found out that they have
a F rating better Business Girl and they have numerous
complaints fit Attorney General.

Speaker 3 (40:23):
Oh of course, of course, you know. Isn't that something
when you sell something that you know people are gonna
hate as soon as you sell it. This money back
guarantee doesn't mean anything because they're not giving the money back.

Speaker 4 (40:36):
I just need to know.

Speaker 3 (40:38):
There are so many places called vibrant health online. X.

Speaker 8 (40:42):
Man found the right people? X. Can you say for
sure you talk to the right person that knew.

Speaker 2 (40:48):
What we were talking about?

Speaker 15 (40:49):
Or no?

Speaker 1 (40:50):
He seemed like he knew what was going on because
when I said that the cashier check, He's like, no,
we sent to regular checks before, so I'm assuming he knows.

Speaker 3 (40:57):
Okay, But do we have the web site? Guys? Does
anyone have the website?

Speaker 1 (41:02):
Trying to look for one right now?

Speaker 3 (41:04):
Yes, Well, there's all kinds when you look for well,
when you google vibrant Health systems, you'll find all kinds.

Speaker 8 (41:10):
So I don't know which one it is, but you know,
I'm a little confused. Sarah Sarah, Sarah Sarah. Did they
send you two regular checks?

Speaker 2 (41:22):
Yes or no?

Speaker 10 (41:24):
Yes?

Speaker 16 (41:25):
Yes?

Speaker 8 (41:25):
And the two regular checks you couldn't cash because why
they bounced.

Speaker 14 (41:32):
The bank told me there is enough funds in the accounts,
but they can't test it because not found on positive page.
They are referring me back to the maker, and the
maker of the check, Brian Oaks, is not responding, is
not picking up the phone. He knows my number because

(41:54):
I talked to him once before. He's the one who said,
if you have used the machines and sell it to anyone,
that's why I'm charging their resucking feet. Yet they have
sent me labels to send the machines back, of course.

Speaker 6 (42:10):
And if I understand positive pay correctly, Tom and Mark,
this is what I think's happening. They have to tell
the bank, hey, we wrote this check for this amount
to this person. That way, when she goes to cash
the check, the bank says, okay, they told us that
this is check is good.

Speaker 2 (42:26):
It's not Rod.

Speaker 6 (42:27):
I think that's what positive pay means. And they have
not told their bank lady, we wrote the check too,
needs to cash the check.

Speaker 2 (42:35):
I think what number did you call?

Speaker 1 (42:38):
Ax man one on screener, but she says she has
multiple numbers, so maybe.

Speaker 2 (42:43):
Yeah, but you talk to someone on that number, right,
that's Brian's number and that's who.

Speaker 8 (42:48):
Actually signed the checks, correct Sarah. Yes, Okay, Tom. I
think it should have people called Brian up and ask
them what's going on.

Speaker 3 (42:58):
Or do a live on Airy you and say, hey,
we heard about your system. The problem is vibrant Health
has so many hits on Google, and I know they're
not all vibrant Health. One is an actual warning letter
from the FTC saying you know your product doesn't work

(43:18):
and you know and I don't know if that's there.
And then it comes from FDA. US FDA says unapproved
misbranded products and this is going back to to twenty twenty,
so you.

Speaker 4 (43:32):
Know, I don't know that. Are they out of Arizona?

Speaker 10 (43:36):
Do you know?

Speaker 3 (43:36):
Do you know who the actual company is?

Speaker 10 (43:38):
If Florida out of Man Florida, God first Florida.

Speaker 3 (43:44):
What a scam based place Florida is? I swear to
God people down there, That's why, ah Man, So we
got to figure it out. Do you have a number
to the main office by the way in Florida?

Speaker 14 (43:57):
I have several members.

Speaker 3 (43:59):
Yes, I have to all right, so let's let's start
trying these numbers.

Speaker 2 (44:04):
And do you have access talking to the guy? He
just won't come on air.

Speaker 3 (44:09):
Yeah, I know, but maybe we find somebody else. We
don't know this guy as the head guy. We don't
know who he is. He could just be a salesperson.
Now what about Sarah? Do you have a website for
these people?

Speaker 14 (44:21):
Well, no, I don't, Tom, but I have. I have
searched a secretary of faith. Brian is the principle and
it is out of Florida. But I have also talked
to bet And who supposedly is one of the people
who works in the office. Her number is four eight
four six nine five one seven five six. I have

(44:45):
also talked to a girl named Patty. Her number is
eight one three five six zero zero seven one four.
And another important person, the person who actually sold us
they the equipment and said that there's a six month
money back guarantee, that there is a lifetime warranty on

(45:06):
the equipment. His name is Tad Tanner. He is supposed
to be a chiropractor, and of course there's seven two
seven two two nine three zero zero four to one.
He also doesn't return calls.

Speaker 3 (45:21):
No, they're not going to return a call once they
got your money. I mean that's the that's the bottom line.

Speaker 2 (45:27):
And can I ask you what was it? What was
it though, Sarah?

Speaker 3 (45:32):
You never met these people before, you go to a
seminar and spend fifteen grand what made you trust them?

Speaker 6 (45:42):
Well?

Speaker 14 (45:42):
I was hoping to get improvements on my health issues?

Speaker 3 (45:47):
What are your health is?

Speaker 2 (45:48):
They just prayed that and I.

Speaker 4 (45:52):
I'm sorry they want to hurry you, because yes, they
did pray on you.

Speaker 2 (45:58):
But what issues are you having?

Speaker 3 (46:00):
Sarah?

Speaker 14 (46:01):
I have polycytimio vera, which is a form of blood cancer.
And I talked to the guy. He said that he
has had other people with that issue that has helped
them so much they didn't even need the medication.

Speaker 8 (46:16):
Can you believe these I want to say this, they're
a bunch of ass whatever to sell an old lady
something saying it's going to cure blood cancer.

Speaker 2 (46:24):
You can't be a bigger scumbag.

Speaker 3 (46:27):
Oh, by the way, somebody gave me a website here.
I found him. I found that Brian. Now, thank you,
Brian Oaks, biohackers of the world. He's a speaker. Brian
Oaks has been an advocate of wellness for over six
years and has sound ways to help the consumers stay healthy.

(46:50):
He does this by doing extensive research on wellness products
designed to improve our health. He was this is biohackers
dot org world. Who found him? Is this something? Did
you find this axe?

Speaker 16 (47:05):
Yeah?

Speaker 1 (47:05):
This was one of the things when I was searching
up his name.

Speaker 4 (47:08):
And it's yeah, and this is the.

Speaker 2 (47:09):
Same spelling of sounds like a snake oil salesman to may.

Speaker 3 (47:13):
Yeah, yep, Yeah, he looks like a clown. These seminars
are just ripoffs, just freaking ripoffs. So discover insights from
the speakers. Okay, hold on, I'm clicking his clicks to
see what he shows here.

Speaker 8 (47:31):
Yeah, and he's got all these checks that aren't good.
Did Brian Oates or whatever his name is signed? I
wonder if we can get trouble damages and asks Frank
Ball about.

Speaker 2 (47:40):
A collection on this He is isoltely I probably.

Speaker 3 (47:45):
He is listed as the founder of Vibrant Health Systems,
so that is that is it.

Speaker 12 (47:54):
He is.

Speaker 3 (47:55):
He is the founder, so there is no boss above him.
And he he's a young guy. He looks like he's
in his thirties and uh, you know he's selling these
scam machines. No one, no one can show any kind
of clinical proof that they work. He has a he
has a store. This guy, this guy is just a

(48:17):
classic classic snake oil, classic snake oil. I want to
give out his number. People. I want you, I want
you to call Brian Oaks and tell him what you
think of him. Four one two five two three zero
four six eight. Tell him his numbers up, tell him
that we found out who he is and what he's

(48:37):
all about.

Speaker 4 (48:37):
I'm going to help her come after him for a
bad check.

Speaker 3 (48:41):
That's right, Brian Oaks, O c HS or OX or
however you pronounce it, Brian o c HS.

Speaker 2 (48:52):
Four one two five two three zero four six eight.

Speaker 4 (48:59):
I want to kill you.

Speaker 8 (49:00):
I want to picture of this fifteen thousand dollars machine.
And I think we should get a picture of Brian.
That shouldn't be hard. You just said you saw that
and came him up on the sleeves brigade. I know
it easier for people to find him.

Speaker 2 (49:13):
You know that's a good idea. Mark and yeah, this.

Speaker 4 (49:18):
Older Yeah, we get it.

Speaker 2 (49:20):
They literally told her it. What's your blood situation?

Speaker 10 (49:23):
Again?

Speaker 3 (49:23):
Is it a cancens or. She said, Mark Blood.

Speaker 2 (49:26):
Oh yeah, it solves that.

Speaker 8 (49:28):
Yeah, I got a black light I can sell you
not only does it find cat herein, but it cures
cancer as well.

Speaker 3 (49:35):

love about this show is I swear to you we
are so proud of all of the companies we represent
and we love them so we want you to use
them and save yourself problems. And when you you know,

(51:41):
there's a reason for that. There are so many liars
and cheets and ripoffs out there. You know, Sarah, she
bought this red light therapy machine for fifteen grand. What
are you kidding me? And you know, it does nothing.
It does nothing. What I'm saying is what they do

(52:02):
many times is they find something that has limited therapy
and then they extrapolate it or they exaggerate about it.
They have these seminars, they sell them at unbelievably high prices.
But this goes with everything, you know, really and truly,
people just exaggerate. And what you have to do is
do your research. So many people, so many of them,

(52:28):
are just liars, and you have to you have to
pin them down. You just do. You have to ask
for specifics or clinical trials, especially medical devices. There are
so many medical devices out there that don't work. And
by the way, speaking of medical okay, so I've had
no less no less than two dozen texts and concerned emails,

(52:52):
and I really appreciated people they were They're very, very
concerned and they want to know if I found out
about this new drug therapy for pancratic cancer. And I
do appreciate people's concern and they say, Tom, you know,
get in on this. This is going to be wonderful.
And I did want to address that just a bit
because I've done a ton.

Speaker 2 (53:12):
Of research on it.

Speaker 3 (53:13):
Way back when I was getting my surgery and they
were starting and they have two major types going on
right now. They have this pill, this once a day
pill that you take, and then they also have the
in addition to once a day pill, they have an
mr NA vaccine. The mr NA is less heard about

(53:34):
in the news right now, but that's a vaccine that
is programmed to read the beginnings of cancer and then
they trigger your T cells, which are killer cells, to
go after the cancer. This is a vaccine that you
just take once I believe or once a year or something,
but it stays in your system. And that was, by

(53:56):
the way, originally what mr Anda it was meant for.
It really wasn't meant for COVID. The COVID thing came
about when President Trump said we need to get something
and we need to get it quickly. So what he
did was or what they did, the government allowed them
to speed through the mRNA technology to use to identify

(54:19):
COVID virus instead of cancer.

Speaker 2 (54:22):
But it was originally meant for the cancer.

Speaker 3 (54:24):
Now, the other pill, I don't even know how to
pronounce the damn pill, but it's a derossib or whatever. Anyway,
this pill is for advanced cases of pancratic cancer. So
they've already I've already talked to the doctors at the study,
the intake team, and they said, I can't have it

(54:47):
done because and it's kind of good news because my
cancer was so early and so isolated and I had
a successful whipple surgery that got one hundred percent of
all the margins that they are not using it for
people like me. They're using it for people with more

(55:11):
likelihood of reoccurrence. Now I'm not saying, you know, I'm
home free, you know, look at me. I'm not bragging
or anything, but they truly want people where there is
more of a chance of cancer coming back. And so
what this does is it works on a unique system.

(55:33):
It's called an adjacent cell protein and it forms. What
it does is it shuts down this cell that fuels tumors.
To make a long story short, as soon as that
cell pops up, which is conducive to growing tumors, it
shuts down that cell. And they actually have had great results,

(55:56):
nearly doubled the overall survival in patients that were treated
for metastatic pancratic cancer. These are people who've had it
spread normally that's a death sentence. When it's metastatic, it
is a very aggressive cancer, and there was no hope.
Now this is this is there's a lot of hope

(56:18):
with this drug. So due to the unprecedented results, the
US FDA, the Federal Drug Administration, has fast tracked it
and will get it on the market as soon as possible. Okay, Now,
the mr NA is a vaccine, it's completely different, but
there's a massive wave of hope for this one. And

(56:42):
unlike preventive vaccines, these are treatment vaccines. So you see,
that's why when they called it a vaccine for COVID,
they were wrong.

Speaker 4 (56:53):
It was never mr NA.

Speaker 3 (56:55):
Technology was never meant to be a classical vaccine. It's
a vaccine therapy, meaning it triggers therapy, that's what it does,
and it triggers your own body.

Speaker 4 (57:08):
To go after things.

Speaker 3 (57:09):
So what this does is identifies the unique tumor sequence
and that when it starts forming, it rapidly manufactures cells
to kill it. Your person, the patient's own T cells
track down and destroy it. Now how do they know

(57:30):
it works because every time your T cells are activated,
there is a telltale sign left in your cellular history,
and they can tell how many times it worked, and
in long term trials they have found that it really
went to work, killing constantly these cancer cells. So the

(57:51):
mRNA technology to me is a bit more promising because
that almost anyone can take. You don't even have to
have the cancer to take that, and it will identify
the precursors of this cancer.

Speaker 8 (58:07):
Go ahead, it will be beyond even that. If you
think about it, any other viruses or even the flu.
mRNA has the technology after a while to eradicate almost anything.

Speaker 3 (58:21):
I mean, the guy that developed it, it's unbelievable. He
was kind of disappointed that they rolled it out for COVID.
That gave mr NA a bad name. I mean, it
really is the bomb. Yea great doctor Fauci gave it
all a bad name. Yeah, mr NA when when you
actually use it for what it's used for, what it does,

(58:43):
as Mark says, not just cancer, but you can program
it to identify precursors of disease. So if you identify
a precursor of a disease, not even not even the
elements of a disease, precursors, and then you attack it

(59:04):
at that route, you have great clinical outcomes. And by
the way, I was interviewed for this study by Memorial
Sloan Kettering. I did zooms and I wanted to get
in on this one, but again they said they're usually
that the rollout of these therapies are mainly going after

(59:27):
more critical clients because they're the ones most in danger.
And I understand that I'm not like I said, I'm
not saying I'm in the free or I'm absolutely cured,
because as with any cancer, they're always concerned that it
might show up again, but they want to go after
the people where it most likely will show up again,

(59:51):
and they're going to help those people first. So maybe
later on I'll get in on the mRNA that seems
to be the one that would be more apropos for me.
And of course, many of the people that I've met
through this journey, they're hoping. Many of them were metastatic,
some of them have since deceased, but they're hoping to

(01:00:12):
get in on this and that's the latest on that technology.
I love that medical research is still going on to
the extent it is right now. Of course, heart disease
and cancer are the two biggies. Here is the good
news about heart disease that is preventable, way more than cancer.
I mean, they say cancer is preventable, but really and truly,

(01:00:34):
I mean I was doing everything right. I mean, I
got to tell you that something happens with cancer where
cells go crazy. Who knows what it is in our lifestyle.
It could be just the environment. But when it comes
to heart disease, that is mostly preventable. Now, there are
some hereditary heart problems that you can't help, but man,

(01:00:56):
I would say ninety percent.

Speaker 2 (01:00:58):
Of it's preventable. Okay, So, uh, we're done with Sarah.

Speaker 8 (01:01:02):
Really, I don't know what else we can do. We're
going to uh what I think we put chop on it.
And I'm not kidding chop. Reach out to this doctor Brian,
uh maybe even doctor in the break and see if
I called him a doctor Seuss whatever, But call this

Speaker 2 (01:01:24):

house is cracking. It's caused a lot of problems with
the walls. She had a choke ball out of her

Okay, Carol, Carol, how old? How old is this house?

I'm not real sure, but it's not old.

It's uh okay, you know where that is.

And and all of this cracking just started.

About four months ago, and she lay really she had
hear the crack and wow, up in the morning she
had wrecked in the molding and the wall.

Speaker 2 (01:04:03):
Does she want to move?

Speaker 10 (01:04:06):
Oh?

Speaker 12 (01:04:06):
Yes, she wants to get out of there.

Speaker 10 (01:04:08):
She should.

Speaker 2 (01:04:09):
I mean, Tom, do you think she could get out
of the lease?

Speaker 4 (01:04:12):
It sounds like she can, Mark, I don't know why, Carol, Carol,
did she just sign a new lease?

Speaker 10 (01:04:19):
No, she did not.

Speaker 12 (01:04:21):
She's gonna move, Okay. She has the fireplace in the

Speaker 3 (01:04:56):
Carol? When is the lise up.

Speaker 4 (01:04:59):
August?

Speaker 3 (01:04:59):
Well, isn't it? Isn't it good enough that she's going
to leave? Or did you want something done before that?

Speaker 12 (01:05:09):
No, we want to She wants to get out, but
she wants to break the leaf, and she won't. They
tell her imitation almost says. They tell her that's not true.
They sent a guy out that didn't speak English too well,
told her yes, this mold. Goes back and tells the
company no, no mold. Well, she got a mold hit

(01:05:30):
and tested that it's testing black, white and pinks red mold.

Speaker 2 (01:05:36):
Did she do did she do a mold test?

Speaker 3 (01:05:39):
Carol? Did she do a mold test of the air?

Speaker 10 (01:05:43):
Yeah? If they care as well.

Speaker 4 (01:05:46):
Well, here's the thing, Carol, here's the thing.

Speaker 3 (01:05:50):
In order to break the lease under the Warranty of
Habitability Act, it's gonna take her just about the amount
of time that her lease is up almost it's going
to take a month or so, and her lease is
up in August. Why doesn't she just wait and then
just not you know, just leave at the end of

(01:06:11):
the lease. That would be so much easier.

Speaker 12 (01:06:16):
Well, they're telling her she had to Chia sixty days ago.

Speaker 5 (01:06:21):
More.

Speaker 3 (01:06:22):
No, here, here's what they're saying. Yeah, hold on, they
cannot evict her. What they're saying is they have to
give her sixty days notice. That's what they're telling her
in order to raise the rent for the new lease.
If she doesn't sign it, that doesn't mean they can
make her leave. They can't. She has the right to

(01:06:45):
stay up to the end of that lease. And she
simply tells them she's leaving at the end of the lease.
She does not have to sign an extension. When they
give you an extension sixty days in advance. They're doing
that because that's what the law requires. Now, it requires

a sixty day notice in order for them to raise

(01:08:25):
in August. She wants to get out with warranty of
habitability and I look that up to start the process.

Speaker 2 (01:08:32):
First, you got to give him a reasonable.

Speaker 3 (01:08:33):
Amount of time to fix it, and then you have
the right to withhold rent to fix it. You can't
withhold rent just to withhold rent. A lot of people
make that mistake, but I think right now it's feudal.
On June second, to withhold excuse me to start the
Habitability Act action in order to be out soon or

(01:08:59):
soon ower than the August deadline. If her lease is
up in August, then get out in August. That's really
the easiest thing. Unless this was such a health and
safety issue that every day they spend there is that
much more dangerous, and usually that doesn't happen, especially with mold.

(01:09:22):
I can't stress this enough. Mold is so exaggerated as
to the harm it does you. Yes, there are people
with sensitivities. Yes it can cause problems, but they're normally
temporary problems and don't become permanent problems unless you are
exposed to excessive levels of mold for years and years

(01:09:47):
and years.

Speaker 5 (01:09:49):
You know.

Speaker 3 (01:09:50):
That's truly the way it is. So if I was her,
I would just wait out my time, give them notice,

Speaker 2 (01:11:55):
And how about pricing? Are you as good as anybody else?

Speaker 7 (01:11:59):
Uh?

Speaker 4 (01:12:00):
Pretty centered? I mean, you know we're not the most
expensive and we're not the cheapest.

Speaker 2 (01:12:05):
How about spawling. I've been wanting to ask a cement
guy this forever.

Speaker 8 (01:12:08):
How come some driveways in the same neighborhood, like you know,
a big home builder, they can do fifty driveways in
the infrastructure all at the same time. Some of them
end up spaulding horribly within I don't know, within a
year or two. Other ones look brand new ten years later.

Speaker 2 (01:12:25):
What causes that?

Speaker 4 (01:12:27):
Well, you know, spawling is sometimes it's a finishing issue
where you finish it with you put water on top
to finish, you know, to help you finish it. Right now,
there's a lot of spawling too because of the the
stuff they use on the road to Macclora mac chloride,
and it's really mean. You know, it gets on your

(01:12:48):
tires and you park your car on the on the
drive and it just seats it up.

Speaker 2 (01:12:52):
What kind of warranty do you have on stuff like that?

Speaker 4 (01:12:55):
Uh, we do a one year warranty on spawling. It's uh,
you know, it just we cure it. We like to
cure our concrete, you know, with the if you can,
with the white cure, and that really does help it.
You know, it gives it that that uh, that layer,
and it's we use it on all of commercial projects.
I wish homeowners would be cost No, no, not really.

(01:13:22):
You know, it's just a spray that right after you're
done finishing and your you spray with that cure.

Speaker 2 (01:13:27):
Why wouldn't a homeowner want that?

Speaker 4 (01:13:28):
Because it's a white cure and it makes it white?

Speaker 8 (01:13:31):
Oh okay, they don't like the look, they don't like
to look, but that can take care of the spawling.

Speaker 4 (01:13:36):
That really does help, yes, And that's why they use
it on you know, and I'll see dot jobs because
I mean, you have to cure your concrete.

Speaker 3 (01:13:44):
Can't couldn't they do a color and then put the
cure on it or would that cure wash out the color?

Speaker 1 (01:13:52):
Uh?

Speaker 3 (01:13:54):
Say again, Tom, I'm sorry, Like like you say that
it makes it white. But what if we started out
with a darker concrete to begin with, Like you put
a color? Can you put colors in the concrete?

Speaker 6 (01:14:06):
Uh?

Speaker 10 (01:14:06):
Yeah?

Speaker 4 (01:14:07):
But the the curing is a is a white agent,
so it just it just turns it white, so it'll
take out any color you put it in there. Yes,
they also have a clear cure, but it's not as effective.
And there is a cure, a clear cure that's a
c DOT approved.

Speaker 3 (01:14:23):
And when we're talkingering, is that the same thing as
sealing it?

Speaker 18 (01:14:29):
Uh?

Speaker 4 (01:14:29):
Yeah, but no, not the white here that the white
here is just a it's just for caring and there
is a clear uh cure and seal and usually that
gives it a little bit of achine. So you know,
some clients don't like that either.

Speaker 3 (01:14:46):
Okay, I wanted to ask you something.

Speaker 8 (01:14:49):
I want to go back to this because I'm curious
on this, how can there be a road like I
twenty five that twenty years later still looks brand new.
You know, I'm not talking about the potholes like on
I seventy but something poured and the road looks brand new.
But a driveway generally looks like crap in five years.

Speaker 16 (01:15:08):
Why is that?

Speaker 2 (01:15:09):
Is it cheaper concrete? Is it the coding you're talking about?

Speaker 3 (01:15:13):
Is it thicker?

Speaker 2 (01:15:14):
Is it a whole different poor it's not as hot?

Speaker 13 (01:15:17):
Uh?

Speaker 4 (01:15:18):
Yeah, you know, when you pour a highway, there's just
a lot to it, you know, as far as inspections,
as far as the you know, you're using a at
least a forty five hundred sea dot mix on highways
and they you know, they pour a bunch of tear
on there.

Speaker 3 (01:15:32):
That does help.

Speaker 4 (01:15:33):
And I think just the driving, you know, the consistent
driving on the road keeps it from spaulding.

Speaker 8 (01:15:39):
You know, when you said a forty five hundred mix,
what does that mean compared to what would my driveway be?

Speaker 4 (01:15:45):
Well, you know, there's a lot of contractors that will
pour a thirty five hundred mix, a thirty five hundred
p assign mix, that's what it is.

Speaker 8 (01:15:53):
Or for a driveway, for a driveway, why not forty
five hundred? Is that Once again it comes into cost.

Speaker 4 (01:15:58):
It's not much more as far as we buy it
for you know, the price per yard. But It makes
a big difference as far as the quality in the
you know, how long it last. And it's easier to
finish too. You know, you get more cream up on
the top than you do with the with the thirty
five three thousand mix.

Speaker 8 (01:16:14):
Hey, Tom, when you would do neighborhoods, uh, the infrastructure,
would you would you be the guy that literally gets
bids from guys like uh yeah, construction?

Speaker 3 (01:16:24):
Yeah, but we very seldom did. Uh did concrete streets.
We did the asphalt, but we did Curban gutter concretely,
Curbon gutter was concrete, and then they would have the
asphalt in the middle. But man, I'm telling you, uh,
it's asphalt. That's another one. You know, I see so

(01:16:48):
many asphalt roads and driveways and concrete failing. And why
is that? You know, here's somebody told me something that
you're never gonna get. Someone actually told me this, You're
never going to get a perfect concrete pour in Colorado
for patios, stairs, walkways. They say, you're just never gonna

(01:17:12):
do it. And and I think that's kind of a
defeatist attitude. What are are they just doing it because
they don't know how to do it? Is there a
way to fixed slab that's not going to crack or move.

Speaker 4 (01:17:25):
Uh, I think you could get. Colorado actually has really
good weather, you know, except for the winner. But as
far as cracking and moving, you know, you got to
reinforce your concrete and uh, the wire mesh helps it
a lot, rebar helps it even more.

Speaker 3 (01:17:41):
And it just what about fiber? What about that fiber they.

Speaker 2 (01:17:44):
Put in it?

Speaker 4 (01:17:45):
Fibers? Okay, it's all concrete and you know the only
thing you can warrant you is that it's going to
crack or guarantee it me. But you know, you put
reinforcement in it so if it does crack, it doesn't
pull away.

Speaker 3 (01:17:57):
And uh, okay, can those cracks? Can those cracks be repaired?
The ones that that you know reinforced concrete, it's not
pulling away. Can you repair those cracks? Yeah, you can.
You can.

Speaker 4 (01:18:10):
You can grind them. You can grind them colking. You know,
it's still not gonna look as it did when you
first parted. But usually those are little hairline cracks. When
it's got good reinforcement in it, they're just hairline, which
really doesn't change the appearance.

Speaker 3 (01:18:27):
So okay, still cosmetic.

Speaker 2 (01:18:28):
I those are the flat work in our big garage.

Speaker 4 (01:18:31):
Yeah, you start getting cracks that are an eighth of
an inch or sexteenth of an inch, and you know
you got a little bit of a problem there.

Speaker 8 (01:18:38):
How about somebody is these guys do asphalt too, So
if someone does an asphalt driveway and someone does a
concrete driveway, same exact house, how long does the asphalt last?
How long does the concrete last? I mean I would
assume concrete last a hell of a lot longer.

Speaker 4 (01:18:53):
Yeah, concrete, you know, a good slab will last thirty
plus years.

Speaker 2 (01:18:57):
So if the asshole ten times cheaper not now, you know,
with the because of the oil, Yeah, I mean it's affected,
but it's it's been a it's probably about a third.

Speaker 3 (01:19:09):
A third of the price, a third of the price
right now. Remember, asphalt is designed mark to keep moving
a little and to keep the substraight shape. So if
you have a bad if you have a bad substraight,
if you have a bad substraight, you're you're you know,
that's not that's going to be bad news too, that'll
crumble away. I want to know about the flowing walkway

(01:19:34):
this guy's asking about. He doesn't want sidewalks, he wants
it a flowing walkway with a slight elevation.

Speaker 2 (01:19:42):
It goes up around his house.

Speaker 3 (01:19:44):
Can you make a walkway like that without having individual pieces,
you know, without having sidewalks, a flowing walkway? Yeah, flowing
meaning just one continuous flow of a walkway without the joints,
are right?

Speaker 4 (01:20:03):
Well? The only problem about not putting joints in your
concrete is concrete cracks and it's supposed to crack on
the joints. So so really you can pour the slab
without the joints and then you come back and saw
cut them, you know, with a thin blade where you
can barely see that they're there. Okay, and that's what
I would recommend. But yeah, you have to put either

(01:20:23):
tool joints in there. You got to too them in
when you're born it, or you have to come back
and cut them all right.

Speaker 3 (01:20:30):
Have I noticed something that was all the rage years
ago at all the home shows, and I don't see
as much of it anymore, patterned concrete or stamped concrete.
Has that lost some of its luster over the years
or do people still do a lot of it.

Speaker 4 (01:20:49):
I think it has lost some of its luster. It
used to be real popular. I don't know fifteen years ago,
ten years ago.

Speaker 3 (01:20:58):
And I still like it.

Speaker 4 (01:20:59):
You know, we don't ate that much, but uh, you
know it's a messy application when you do it, and
and uh and it's real sensitive. I mean, if you
screw that up, you're you know, it's hard to fix.

Speaker 2 (01:21:15):
You're eating it.

Speaker 7 (01:21:16):
Yeah.

Speaker 3 (01:21:17):
So but I still like it.

Speaker 4 (01:21:18):
I like the way it looks. And there's a lot
of cool stamps now you know that that weren't around
back then, and and new techniques colors and whatnot is there.

Speaker 3 (01:21:28):
So you're still you're still doing pattern concrete.

Speaker 4 (01:21:30):
Yeah, we still do it every now and then when
we get a customer. That's generally for a patio, right. Uh,
there's some commercial applications too, Okay, Yeah, you know there's
uh some golf courses we did for you know, at
the clubhouse.

Speaker 8 (01:21:44):
And so yeah, there's what is that called inside of Walmart?
I mean Walmart has gone back to basically concrete floors.

Speaker 2 (01:21:52):
What is that coding they kind of put over it?
Do you have any idea?

Speaker 3 (01:21:55):
You know what the what they do?

Speaker 4 (01:21:56):
A lot of these big stores home depot Walmart, they
go in in there and they after they pour it
and it's a few years afterwards, they go in there
and they use these machines at buff them.

Speaker 2 (01:22:08):
They buffs the floor, yeah, yeah, which is crazy. In fact,
they drive around all the time buffing the floor.

Speaker 4 (01:22:14):
Yeah, so they they there's contractors that just specialize in that.

Speaker 8 (01:22:18):
How about asphalt? Is there can you reuse asphalt? Can
you reuse concrete? Is there any secondary market that's cheaper?
I would assume with concrete you can't. But with asphalt,
can you just like add to it and then steamroll
more over to fix it?

Speaker 10 (01:22:34):
No?

Speaker 13 (01:22:35):
You can.

Speaker 4 (01:22:36):
You can heat some spots up that are you know
maybe uh not right. You could heat them up and
re roll them. But no, for the most part, you can't.
I mean they'll grind it up.

Speaker 16 (01:22:47):
You know we have.

Speaker 4 (01:22:49):
They'll uh like they'll mill it. Yeah, road a mill
or or recycled asphalt, but rot a mill. The one
they're doing. They rode a mill and they like when
they rode a mill street. That stuff is really good
if you reapplied and rule it because it's real, it's
got all the oil in the tack to it.

Speaker 3 (01:23:08):
Still. Oh wow.

Speaker 4 (01:23:09):
So when you recycle the asphalt though, it's mixed in
with a lot of dirt and I mean, it's good
for a road base, but it's not good to do
your driveway with.

Speaker 3 (01:23:18):
You got it right.

Speaker 2 (01:23:19):
I was going to say recycled concrete.

Speaker 3 (01:23:22):
Our excuse me, recycled asphalt is really good for road base.
In fact, recycled concrete too. We used to use a
lot of that on the road base and then they
would go over that and anyway, we have more coming.

Speaker 2 (01:23:35):

Tom Martino here, Welcome to the show. Let's talk to Kathy. Kathy.
What's going on with you?

Speaker 5 (01:24:51):
Hi?

Speaker 3 (01:24:52):
Mom?

Speaker 9 (01:24:52):
Hey, Hi Kathy, good morn a, good afternoon.

Speaker 19 (01:24:57):
You told me to get back with you regard being
the guy you had sent out the plumber.

Speaker 6 (01:25:03):
He did come out.

Speaker 3 (01:25:05):
And when was this, Kathy? When did when did you
first call in?

Speaker 19 (01:25:12):
I can't remember what day it was, It wasn't too
long ago.

Speaker 3 (01:25:16):
And what was it about the kitchen drain? Was this
the kitchen drain that clogged up? Yes, sir, and you
called with did you call with Kevin?

Speaker 4 (01:25:29):
Yes?

Speaker 3 (01:25:31):
Okay, right, And we wanted somebody we could trust to
go out there and check it out.

Speaker 19 (01:25:37):
Yes, And he did come out, and he went under
the kneath to cross base and he said it costs
more than what he could do.

Speaker 2 (01:25:50):
What costs more.

Speaker 19 (01:25:53):
Fixing the problem? He said, the piping is laying flat
and it should have an angle.

Speaker 3 (01:26:05):
Oh, this is the drain pipe.

Speaker 2 (01:26:07):
I have no idea where we're at here.

Speaker 3 (01:26:09):
She's talking about the drain. It was backing up and clogging,
and it did not have the right tilt on it
or the right slant.

Speaker 4 (01:26:18):
Is that what he's saying?

Speaker 19 (01:26:21):
Yeah, and we can't figure out what that when he
put when the other guy from my church came out
and he put a sink down there and he was
hitting something. And I told your guy about it, right,
he said, well, it could be hitting that pipe.

Speaker 2 (01:26:42):
Who went out there? Who did we send out.

Speaker 3 (01:26:46):
Though? I thought it was Demotar?

Speaker 2 (01:26:48):
Maybe who I think it was, but hold on, my
brother's got his card.

Speaker 3 (01:26:53):
I think it was europlumbing.

Speaker 2 (01:26:55):
So but why would they say they can't fix it?

Speaker 16 (01:26:57):
Then?

Speaker 14 (01:26:59):
Well they good?

Speaker 19 (01:27:00):
But cost in the long run.

Speaker 4 (01:27:03):
Okay, it costs more than to replace, is what it
sounded like to me.

Speaker 3 (01:27:07):
Mark. Yes, if we don't have the fund to do it,
how much city say it would cost.

Speaker 19 (01:27:14):
Over two thousands?

Speaker 3 (01:27:17):
And you have to believe that's cheap compared to the
rest because he has great pricing. So did he say
what needed to be replaced? Kathy?

Speaker 19 (01:27:27):
Probably is that pipe and make it elevated.

Speaker 10 (01:27:33):
And true, you are all plumbing, that's you're plumbing.

Speaker 3 (01:27:40):
Well, Kathy, I'm going to tell you, and I mean this.
Those guys are honest and they're good. And if he
said it would be cheaper to replace that that kitchen
drain line, it would be cheaper to replace it than
to try to fix the one that's there. Is that
what he's saying.

Speaker 19 (01:28:00):
I don't know for sure, Tom, but in a way,
let's get him on.

Speaker 4 (01:28:06):
Who do you know who went out there? Uh, maybe
we should get him on.

Speaker 16 (01:28:18):
E E R E N R M.

Speaker 3 (01:28:24):
Let's try to find out ax who went out there
from death. Let's call euro Plumbing and give them their address.
They'll have it listed by address. Let's just see what
they tell us. Kathy, thank you for calling us back.
Hold on, We're going to try to get it. I
don't get it, dude. Is she just not going to
use the sake. I'm a little well, that's what we

(01:28:45):
don't That's what we don't know. I mean, that's what
I'm trying to get at. I don't know if they
could temporarily fix it. And I don't know what the
hell that plumber said. He backed that. The other plumber
said when he put a snake in there, it came
up again, something hard. And I think what Kathy is
saying is that Europlumbing said it was probably where the

(01:29:09):
pipe turns. He was coming up against the end of
the pipe and wasn't making the turn because it has
to be elevated more.

Speaker 2 (01:29:17):
I just think it sounds like it's just got to
be redone and it's two thousand bucks.

Speaker 3 (01:29:23):
But here's what I want to know, Kathy, why did
it just start? How long have you been in that house? Okay,
we'll take this break and see if in fact we
can get some information from Europlumbing. But it sounds like

(01:29:43):
the kitchen drain that goes to the main or the
main house drain doesn't have.

Speaker 2 (01:29:49):
Enough elevation on it.

Speaker 3 (01:29:51):
There has to be a certain drop for it to
drain properly, and if it's put into flat it will
have a tendency to back up sometimes. So that's what
we're going to do. I have a quick question for
tearing construction, Jess, if you could answer this. Somebody wants
to know if they have an old slab and the

(01:30:12):
top was just spawling like crazy, and what they have
now is exposed aggregate. It's all rough. Can you do
a new lift on top of that? They say it's
solid and it's reinforced, but the top kind of came
off and there's a lot of exposed aggregate. Do you
ever have success pouring over that or not?

Speaker 4 (01:30:35):
Uh, you can pour over it if you know, if
the room allows, if you can pour at least maybe
a three inch Yeah, he gravel mixed or something with
small rock and then okay, and then put some wire
mesh in there. It'll hold.

Speaker 3 (01:30:51):
Okay, but that's good to know about three inches. And
so you have to have the room to do that.
But would you go in and knock as much as
that loose stuff off the top first?

Speaker 15 (01:31:02):
Yes?

Speaker 4 (01:31:03):
Yeah, we would have to either powerwass or try to
take it off or just okay, some other type of
mechanism could.

Speaker 3 (01:31:10):
Okay, So that's what I would let Jesse or somebody
from tar and take a look at it. Their number
is three oh three eight seven seven zero seven seven

Speaker 20 (01:32:43):
Two five five. Hey, my earpiece fell out? Okay, your
earpiece fell out? Yeah, I didn't know we were on
the air anyway. So did we get a hold of
uh euro Plumbing on this one?

Speaker 3 (01:32:56):
Based on the address?

Speaker 10 (01:32:57):
I think you?

Speaker 3 (01:33:00):
Okay, good, We'll see what they did there, because basically
it was just the kitchen line and not the whole
drain two thousand dollars. If if EU A Plumbing did
quote that, then you know it would be probably twice
that anywhere else. They have incredible prices, and uh, we've

(01:33:24):
shown that over the past. So in any case we'll
take that. Any other problems, question or complaints, give us
a call at three oh three seven one three talk
three oh three seven one three eight two five five.
And I do have a couple more texts. You answered
the one about that walkway pattern concrete as well. What

(01:33:45):
do you recommend around a pool deck?

Speaker 4 (01:33:50):
Uh, I mean you go with pattern concrete, you go
with the there's a they do a lot of it.
They used to do a POxy. I don't think they
do that anymore.

Speaker 2 (01:34:00):
Pebble like a pebble epoxy.

Speaker 4 (01:34:02):
Yeah. And now they're even putting that stuff that's on
the playgrounds, you know, with the rubber and uh. Oh,
I forget what it's called.

Speaker 3 (01:34:10):
It's called yeah, that that kind of raw composite code.
It's like, yeah, it's a rubberized thing almost. It's it's
almost like a roof.

Speaker 4 (01:34:20):
Yeah, but you lay it down like concrete. So uh,
they use that, and they're starting to use that around
the pool dicks.

Speaker 16 (01:34:26):
Uh.

Speaker 4 (01:34:27):
But as far as concrete, I would just use great
concrete around the pool dick.

Speaker 3 (01:34:31):
I mean, someone wants to know if you've ever done
asphalt for landscaping around the house, so instead of concrete,
if they want to do a walkway with landscape with asphalt,
can you do that?

Speaker 4 (01:34:44):
Yeah you can. I mean I don't think it's looks
looks the greatest, but yeah you can.

Speaker 3 (01:34:50):
I you know, they might who knows, You're right, it
could start crumbling away. As far as the no, it'll
hold tom Oh it will.

Speaker 4 (01:34:59):
Yeah, it's it's just harder to apply, you know, because
you're not doing it with the You got to probably
put it in a in a wheelbarrow and then tamp
it down with the hand tamper. Does it have any
effect on a snowblower going over it or no? Versus concrete, No,
not at all.

Speaker 3 (01:35:12):
Okay, okay, So as far as curb and gutter, do
you do any decorative curbing. Somebody wants to know.

Speaker 4 (01:35:23):
Oh, we don't. There's guys that specialize that, and they
got they got their little machines that go out in
different molds.

Speaker 7 (01:35:31):
They don't.

Speaker 3 (01:35:31):
So you're mainly you're mainly concrete and asphalt. You can
do pattern concrete, yes, and you can do walkways or
you can do driveways aprons, garage floors, all of that, right.

Speaker 4 (01:35:45):
Yeah, you know city stuff, any rideaway stuff and just
flat working walls.

Speaker 3 (01:35:50):
Yes, what about straightening out concrete or lifting it? Do
you guys do any of that at Taran? No, we don't.

Speaker 4 (01:35:56):
Once again, there's guys that specialize in that. They do
the foam where they do the the other stuff, you know,
where they drill a hole, they bump concrete in there.

Speaker 3 (01:36:06):
Okay, someone said they were told not to put sidewalks up.
They wanted to put a walkway around their house, not
to put it right up against the house.

Speaker 2 (01:36:17):
I don't know why they were told that. They want
to know if that's true.

Speaker 4 (01:36:21):
No, that's not true. I mean I would do it's
just to keep the rain in the snow away from
your foundation.

Speaker 3 (01:36:26):
Because you can do it with a slight slope, right
and actually keep everything out of there.

Speaker 4 (01:36:31):
Yeah, you want to do like a two percent slope
at least.

Speaker 3 (01:36:35):
And then you would have your Yeah. So I don't
know why someone would tell them that. I think they're
probably talking about people that don't know what they're doing,
because you could create a water problem if you don't
do it right. You can.

Speaker 4 (01:36:47):
Yeah, so you got to be careful. You got the
right slope, and then you want to put a piece
of expansion joint between the walk and the foundation, so
it doesn't you know, either your foundation moves or your
sidewalk moves. It does, and it doesn't move both of them.

Speaker 3 (01:37:02):
Somebody wants to know. In a heavily treed lot where
they don't think you're gonna get a big truck up there,
how far can you pump concrete?

Speaker 4 (01:37:13):
Oh that's a good question. Uh, probably h three hundred feet.

Speaker 3 (01:37:19):
Oh man, that's way far. I didn't know you could
go that far.

Speaker 4 (01:37:23):
You can, but you're gonna need a big pump.

Speaker 3 (01:37:27):
So is it is it difficult to do those kinds
of remote jobs in the in the hills where there's
a lot of trees.

Speaker 4 (01:37:33):
No, No, not really no. Like I said, just get
a big pump and you could do it.

Speaker 3 (01:37:41):
There's one thing on there's one thing that the retaining
walls that I see on your website. Tell me about
your retaining walls. Are they poured or are they laid
down with a decorative rock? Is that a pattern?

Speaker 4 (01:37:54):
I see?

Speaker 3 (01:37:55):
How do you do those retaining walls?

Speaker 16 (01:37:57):
Yeah?

Speaker 4 (01:37:57):
So you you form them up just like you would
type of concrete foundation retaining wall and then you put
a liner in there.

Speaker 7 (01:38:04):
Uh.

Speaker 4 (01:38:05):
Those liners are expensive, but they're re usable. Some of
them are. I think the one that you see on
the website that was for a park and commerce city
that we have to throw the liner away after one use.
But yeah, there's different type of liners with different different patterns,
and so.

Speaker 3 (01:38:20):
You can actually give your wall a pattern exactly. Yeah. Yeah,
there's a lot of really nice patterns do and can
you okay, so at a residential, do you put up
because it's strong and it's concrete, can you put up
just one wall for the.

Speaker 2 (01:38:38):
Hill or do you have to terrace it?

Speaker 4 (01:38:40):
It depends on the slope of the hill. You might
have to terrace it every you know, five six feet.
It just depends on the slope.

Speaker 3 (01:38:49):
And I noticed that you have some rounded.

Speaker 4 (01:38:53):
Forms. I've never seen that would go ahead. That wall
was a particular It was round and it was pretty
hard to do. But yeah, that was a special wall.
And how do you how do you make the rounded forms?
Is that is is that wood that just bending or
is that composite or plastic?

Speaker 10 (01:39:09):
No?

Speaker 4 (01:39:09):
That was uh oh those were one x twelves. I
think we used on that and how they held you
curve them, they bend, you know, they got some gift
to them, so and wow, yeah you gotta. Yeah, it
was a special wall and it turned out pretty good though.

Speaker 2 (01:39:24):
So you do foundations for houses, then, uh, we do for.

Speaker 4 (01:39:28):
Uh you know, there's guys that specialize in just you know,
they can do one hundred foundations in a month. I
mean we're not right, but you know we'll do like
a lot of additions and stuff like that, you know,
for uh, for garages and whatnot.

Speaker 3 (01:39:42):
Okay, so if someone's adding on a garage, you can
do that or a patio absolutely, yeah, yeah, yes, And
and can you tie into the existing house?

Speaker 6 (01:39:52):
Uh?

Speaker 4 (01:39:52):
Yeah, that's what the engineer requires, you know.

Speaker 3 (01:39:55):
So what do you do drilling for the new rebar
or how do you do that?

Speaker 16 (01:39:59):
Yeah?

Speaker 4 (01:39:59):
Most of you drill in. You epoxy your rebar in
there and uh two top rebars, two bottom, some in
the center and uh, just we just go by the
drawings and then you pour right up against it.

Speaker 3 (01:40:12):
Yes, yes, okay. And someone wants to know in a
crawl space that they dug out they're digging out, can
you put a floor in those? Yeah you can.

Speaker 4 (01:40:21):
Yeah, there's companies that do that all the time they
used to. I sometimes you dig them out a little
bit if you eat a little more room in it.
You know, you can you know where your walls allow
it to. You know, you still have free foot of foundation.
Wallet's buried. You can dig out a little bit and
then give you more room in there and then just
pour your your slab in there so you can store

(01:40:42):
whatever you want. You know, you don't have to store
it on the dirt.

Speaker 3 (01:40:46):
Yeah. Now, someone says here that converse that that concrete
A lot of people have lost the ability to finish
concrete and they just use water and water it down.
What are they talking about? Are there people that just
don't know how to work concrete anymore?

Speaker 10 (01:41:04):
Uh?

Speaker 4 (01:41:05):
Yeah there is, you know. But yeah, you can't use water.
You don't want to use water on top of concrete.
I mean you could, but that's what they do to
cheat to keep the curing longer.

Speaker 3 (01:41:15):
Right.

Speaker 4 (01:41:16):
Well, yeah, you know they make products now that you
could spray on your concrete if it's getting really hot
on you, and those actually work without having your concrete
be you know, spawled later or flake off.

Speaker 2 (01:41:28):
I had some done probably, I don't know, maybe a
year ago and he wanted me to literally water it
like every three or four hours, or maybe it was
twice a day for a few days.

Speaker 8 (01:41:43):
I thought he was kidding with me, and I said,
water concrete, Why would he have me do that?

Speaker 4 (01:41:49):
Well, no, that's a good idea. After you pour it,
it's hard. Yeah, yeah, because it keeps it moist. You know,
it keeps it.

Speaker 15 (01:41:55):
But what does that.

Speaker 4 (01:41:56):
Ultimately slows down the curing, right, it slows down the
carrying better. It cures better. And see that's why those
the carrying compounds that we put on them, like the
white caring compound to keep That's what that does.

Speaker 3 (01:42:07):
I gotcha all, we gotta take this quick break. Okay,
we gotta take this break.

That's the part that confused me. Did it just happen

Give us a call.

Speaker 3 (01:45:01):
Yeah, you want to get some help from Mark and
I and the gang. You call three oh three seven

two five five, or call twenty four to seven three
oh three Martino three oh three six two seven eight
four sixty six. We have deputies hanging out in the
studio to help Mark and SEUs. And when we have

(01:45:21):
we have a guest in the studio as well. From
Terarin Construction that does they do all kinds of concrete
and asphalt, commercial and residential. They're moving more into the
residential space with walkway sidewalks, pool decks and driveways and
aprons and pattern concrete whatever you need patios they can do.
When it comes to concrete and concrete, you know, is

(01:45:45):
really a tough thing. I mean, over the years we've
had so many complaints about concrete contractors because for some reason,
I guess, people get into the business and they don't
stand behind their work and their work doesn't hold up.
I mean, I'm looking at this website for Terran. It's

(01:46:08):
a great website, beautiful work. And I was once told
and I don't know why I was told this, I
forget the reason why, but they said that Colorado is
a very difficult state to do concrete. And I think
they said something about the freeze, the freeze thaw cycle.
You have so many of them so close together that

(01:46:29):
it doesn't just freeze all winter and then thaw and
then stay unfrozen. Sometimes it freezes and thaws and freezes
and thaws within a week, and that can have a problem.
So what about that. Jess Terran, owner of Terran Construction
dot com, also at referrals dot com. When we talk
about freeze thaw cycles, is that something that can cause

(01:46:54):
a problem with concrete, especially if there's little hairline cracks
in it, it's.

Speaker 4 (01:47:00):
Frozen and you pour over it, it won't be any good.
You know, as soon as it does, it's gonna crack.

Speaker 3 (01:47:08):
So the freeze saw cycle I'm talking about though, well,
go ahead, huh. Yeah, it's like explain how that wears
down concrete because we have so many freeze saw cycles
within a short amount of time.

Speaker 4 (01:47:21):
It's not like it gets frozen for the whole winter, no,
but when.

Speaker 16 (01:47:26):
You pour it.

Speaker 4 (01:47:27):
So when you pour the concrete and then you know
it's gonna be cold at night or or for a
week or whatever, you definitely.

Speaker 16 (01:47:33):
Have to cover it.

Speaker 3 (01:47:34):
You know, you have to cover that's when you put
it in. When I'm talking about I'm talking about concrete
that's established. Once it's established, If there are cracks in
it and water gets down in it and freezes, it's
gonna break that concrete up eventually.

Speaker 6 (01:47:48):
Yeah.

Speaker 4 (01:47:48):
Sometimes you know, you gotta pour six in slab, which
is what you know the sidewalks are your city sidewalks,
your sea dot work.

Speaker 3 (01:47:57):
You have to pour it.

Speaker 4 (01:47:58):
And I'm a big believer in not doing no four
inch slab, you know, because sometimes four inch slabs turn
into three and a half inch slabs because your two
boy fours are three and a half inches, and you know,
you get water in there and it damages them. But
you know, once you get yourself a good slab, like
a five inch slab with some wire mass six inch slab,
that free thought that doesn't really affect it, then.

Speaker 3 (01:48:21):
Okay, well that's good to know. See a lot of
these clowns over the years probably didn't know that. And
then as far as preventing the spawling, you says, it's.

Speaker 4 (01:48:30):
A matter of how they finish it right. Yeah. Sometimes,
And you know also in the wintertime, you got to
cover your concrete and you got to keep it covered
for a while until it cures, right because if you don't,
you know, it'll start spauling. And and it's just some
of the materials they're using on the road to you know,
the the mad clare, the madchloride. You know, you track

(01:48:51):
it on your tires, then it stays on your and
you drive away and then starts spauling. So there's a
lot of reasons for that.

Speaker 3 (01:48:57):
Somebody wants to know how long you should wait before
you out the concrete with you know, the polyspartic coatings,
the decorative coatings. Can you do it right away or
do you need to give that time to cure.

Speaker 4 (01:49:08):
Yeah, you got to give it at least thirty days
real quick.

Speaker 2 (01:49:11):
Though, to circle back what you guys were talking about
on hot cold, hot cold when you're pouring in the winter,
could you use hot water to make that better?

Speaker 1 (01:49:20):
Uh?

Speaker 4 (01:49:20):
You can, but it speeds up the process of it
drying on you, of its setting up.

Speaker 2 (01:49:24):
On you, So it might it might not be a
good thing to do.

Speaker 4 (01:49:28):
Well, you know from the concrete plant. The water comes
hot in the truck. Yeah, yeah, so when you add water,
because it keeps it from freezing, you know, in the truck.

Speaker 2 (01:49:35):
So Tom do you know he gets free concrete all
the time.

Speaker 3 (01:49:40):
Why.

Speaker 8 (01:49:41):
This is the craziest thing I ever heard. And I
looked it up while he was telling me about it.
These big there's only three big ones in the state,
right that make concrete or make cement.

Speaker 4 (01:49:52):
Yeah, there's three three four concrete suppliers and they don't
like to throw away their concrete.

Speaker 1 (01:49:59):
You know.

Speaker 4 (01:49:59):
Some times they got an order that that's a little old,
you know, maybe it goes past the hour, ninety minutes
or whatever, and they got to get rid of it
because they won't they won't let you pour it on
commercial jobs.

Speaker 8 (01:50:11):
And it costs more to It costs more to recycle
in landfills than to just give it away. But the
person you're giving it away too has to be set
up ready to go, because they got a poor it
like right then and there, right.

Speaker 16 (01:50:23):
Yeah.

Speaker 4 (01:50:23):
So I have a my brother in law owns a
very big toiwyard and we've paved quite a bit of
that toiyard, probably over two acres maybe, and.

Speaker 2 (01:50:34):
With free concrete, with free concrete, yea, that's incredible to me.

Speaker 3 (01:50:37):
So I mean you just you just wait until they
have batches they want to give away and you have
a place to put them.

Speaker 10 (01:50:42):
Yeah.

Speaker 4 (01:50:43):
Yeah, they'll they'll call me and they'll say, hey, yes,
I got twenty yards, I got thirty yards, I got
ten yards. Can you use it? I said, yeah, bring
it now.

Speaker 3 (01:50:49):
Do you already have it formed up ready to go?

Speaker 4 (01:50:52):
Yes, it's formed up, ready to go. And we got
some guys there and uh usually I can get it
from like you know, more than one supplier and it
it helps them, you know, so they don't have to
break it up and haul it away. And you know
Turby Cycling Center.

Speaker 3 (01:51:06):
That's very interesting. So you get But you couldn't possibly
time that with a residential job, could you? You have
to schedule?

Speaker 13 (01:51:13):
Yeah?

Speaker 4 (01:51:14):
No, not with a residential job. But there is like
some uh industrial areas that have dirt and you know
they'll say what kind of price can you give me
on on using some leftovers? And you know, will give
a price on that.

Speaker 3 (01:51:29):
Okay, three oh three seven one three talk. If you
have any questions at all or any problems you need
us to solve, you can also call three oh three
Martino at three oh three six seven eight four six
six Go ahead.

Speaker 4 (01:51:41):
I'm sorry.

Speaker 8 (01:51:41):
Have you ever poured like a like a safe house
inside of the house, like one of these safe rooms
that are like five six feet of concrete?

Speaker 2 (01:51:50):
I mean I've heard of homes that have them.

Speaker 8 (01:51:52):
I mean I've seen homes that have maybe actually her
cousin builds houses and they have a one foot one
but I've heard of these rooms. It can be you know,
ten feet. I mean like they're bunkers. Have you ever
done anything like that?

Speaker 4 (01:52:06):
Oh we haven't. No, I've seen them.

Speaker 2 (01:52:09):
But you have to get over there.

Speaker 3 (01:52:10):
And you, Marks, you would think a one foot concrete
wall would be enough all the way around. You think so,
oh my goodness, you would think so.

Speaker 2 (01:52:18):
Right, Like what a rocket launcher? What are we talking here?

Speaker 4 (01:52:21):
No, just a safe room from most anything.

Speaker 8 (01:52:25):
Yeah, you know, along with that guy Medello had when
we yanked him out of his country there in an hour, like.

Speaker 2 (01:52:32):
The fastest war ever.

Speaker 8 (01:52:34):
They said, if he got into that safe room, it
would have been a completely different scenario.

Speaker 3 (01:52:40):
Really yep.

Speaker 2 (01:52:41):
And he's how long was there? He was like right
there when they snagged him. I wonder how long he
could have sustained himself.

Speaker 8 (01:52:47):
Yeah, that's what I'm saying. I wonder how big it was.
Do you know, Scott, you were acting like you knew.

Speaker 4 (01:52:53):
No, No, I don't.

Speaker 2 (01:52:54):
I'm just that's an odd question to ask about that.
That's what most of them are.

Speaker 3 (01:53:01):
But listen, Mark, do you think are in safe rooms
and stuff? You know, I bought a house that had
one in there. I would have never put it in,
but I bought one that had a safe room. Do
people do that anymore.

Speaker 2 (01:53:15):
I think her, I think her cousin. They designed a
lot of homes that have them.

Speaker 8 (01:53:20):
In fact, i'd say almost every home they're out of Texas,
and I would say they're average homes maybe one five
to one six, which is three to four million here.
And yeah, pretty much everything they're building new has one.

Speaker 3 (01:53:34):
Okay, I want to come back to a problem that
we started yesterday with the wrong oil. Apparently this range
rover differential fluid is very persnickety. I mean the range
rover is if you don't use the right fluid, they
say it's going to ruin it.

Speaker 4 (01:53:54):
Now.

Speaker 3 (01:53:54):
Deputy d was here yesterday says if you want to
take to take them to Small Claim scot you better
have very specific information on what it caused as far
as damage. You can't just say, hey, the wrong fluid
was put in here. Now I want a new transfer case.
So we'll talk about that coming up on the Troubleshooter

(01:54:59):
follow up and with Doug. Now, this has to do
with the transfer case his two thousand and eight l
R two land Rover. He took it to Rocky Mountain Quicklube.
They changed the differential oil, but put in the wrong
fluid and blew out the differential. According to Doug, although

(01:55:24):
we wanted to know specifically what was done, the extent
of the damage, what it will take to fix, because
we believe this place should be responsible if they put
in the wrong fluid.

Speaker 4 (01:55:36):
What did you find out?

Speaker 3 (01:55:38):
Bow?

Speaker 10 (01:55:39):
Okay? So first I called Rocky Mountain Lube. I talked
to the owner yesterday Tray during the show. He authorized
his manager Marshall to talk to me and he would
not come on the air, but he did say that
all he worked on was the rear differential, not the
transfer case. But Rocky Mountain Loube did put in the

(01:56:01):
standard seventy five ninety gear oil and they said that
was perfectly fine for the rear differential. So then Doug
had problems and dougs on it.

Speaker 4 (01:56:13):
On hold with me, Doug, But wait a minute, let
me get this straight.

Speaker 3 (01:56:17):
Are you saying they did not work on the transfer
case or the or the differential or where.

Speaker 10 (01:56:25):
It's the rear differential the one that went bad.

Speaker 3 (01:56:28):
They said they never worked.

Speaker 10 (01:56:29):
On it, you know, the one that they worked on
did go bad, but it wasn't transfer got it?

Speaker 8 (01:56:38):
God, I don't have it. I don't understand. Did we
lose Tom? No, I'm here, Oh ooh, bo, I don't
understand what you're saying. What did the quick loop place
work on a rare differential and that's what actually broke.

Speaker 10 (01:56:56):
Yes?

Speaker 2 (01:56:56):
And did they put the wrong fluid in it?

Speaker 10 (01:57:00):
When Doug took it to the off to the Range
Rover and land Rover dealership in Longmont, he was having
trouble with it, whining and making all kinds of noise.
And they said that the first automotive shop put in
the wrong oil that it was supposed to be a
special range rover hydro hydro coupling oil. Heydeck's oil. But

(01:57:28):
the second dealership just went off the paperwork. They did
not actually test the oil. They just went off the
first shop's recommendation of what they put in. But the
first shop says they put in the oil for this
range rover is correct.

Speaker 3 (01:57:43):
But okay, so they they denied, They deny putting in
the wrong fluid.

Speaker 10 (01:57:50):
Yes, they denied it. They said they put in the.

Speaker 2 (01:57:52):
Right flutted.

Speaker 3 (01:57:56):
Right.

Speaker 10 (01:57:57):
So Doug is on the air with me. I told
Doug he needs to take it back to Alexander's and
have him open up the rear differential, get the oil out,
test it and make sure it is this the bad oil,
and then get some documentation so Doug can take the
first shop Rocky Mountain looped to small Claims court because

(01:58:19):
I do believe they did put in the wrong oil.

Speaker 3 (01:58:22):
Well, do you think there's just lying to you about it? No?

Speaker 10 (01:58:27):
I I uh, the first shop that did the did
the work. Tom did put in the wrong oil in
my opinion, But they.

Speaker 3 (01:58:37):
Think why do you say that, though? But Bo, why
do you say they put in the wrong oil. If
they claim they didn't, what what is your clue?

Speaker 10 (01:58:46):
The first clue is because Doug started having all kinds
of trouble with it after they put the oil in
and he had he took it to another stop. Is
that right, Doug? You're on?

Speaker 16 (01:58:57):
Are you still with her? Dear sir? Am?

Speaker 10 (01:59:01):
Is this all correct?

Speaker 16 (01:59:03):
Yes?

Speaker 3 (01:59:03):
Sir? And bo It also was on his receipt, right.
Did you look at the receipt, Doud?

Speaker 10 (01:59:10):
Couldn't I get you on?

Speaker 15 (01:59:12):
It's on the receipt, they said to Henry or differential
on the sheet receipt.

Speaker 4 (01:59:18):
Yeah.

Speaker 2 (01:59:18):
But did they say what kind of oil?

Speaker 16 (01:59:22):
Yeah?

Speaker 10 (01:59:22):
Yes?

Speaker 3 (01:59:23):
And what did they say?

Speaker 15 (01:59:27):
They were saying they put the oil that land Rover
says you cannot put in it, which is something five
ninety And.

Speaker 8 (01:59:36):
Now if I'm to understand this now, basically what they're
saying is, even though the invoice says this, that's not
what we actually put in. Right, that's right, Mark and
I and I'm not saying they did or didn't. I
have no idea at this point. It sounds like they
possibly put in the wrong oil because the problem came
up so quick. But I will say this, in my

(01:59:57):
good years, we would have a an oil change that
would print out with a certain code like four six
two hundred, and that would print out the words lube
oil filter, you know, five W thirty whatever. But we
would still look up the actual oil that would go
into that vehicle and use that oil. So I do

(02:00:19):
kind of understand how that could happen.

Speaker 4 (02:00:22):
Okay, So what do we do now?

Speaker 10 (02:00:26):
But what we do now is that Doug needs to
go back to the Range Rover dealership and have the
differential taking apart, have the oil tested, and have it
documented that the oil was indeed put in wrong or
the wrong type oil, so he can go to small
claims court. That's his only remedy against the first the
Rocky Mountain Lube place.

Speaker 3 (02:00:47):
Does Rocky Mountain Lube indicate did they were they sure
they put in the right stuff? Did you ask them
why the invoice had a different lube listed on there?

Speaker 4 (02:00:59):
Right?

Speaker 10 (02:01:00):
All right? They said the oil that they put in
as correct for this range Rover, which was seventy five
ninety weight oil, which is standard gear oil.

Speaker 3 (02:01:11):
Oh so they're saying they put the that it may
not be the one specified, but it's still okay, is
what they're saying.

Speaker 10 (02:01:20):
Not the one specified by range rover. Right, it's the
standard works on it and they swear by it. They
said they.

Speaker 3 (02:01:28):
Okay, I get it, I get it. So Mark, Mark,
they're not claiming they put in the land rover stuff.
They're just saying the stuff they put in was equivalent.

Speaker 2 (02:01:35):
What was the Well, yeah, and I'm reading it.

Speaker 8 (02:01:38):
So it basically says non electronic open diffs should take
seventy five W ninety gl five gear oil. But then
it says electronic locking diffs requires specific advanced fluids like
castor oil bot blah blah blah, goes on forever or ever.

Speaker 2 (02:02:00):
So what what kind of land rover was this? What
was the year making model?

Speaker 10 (02:02:08):
Go Ahead No A no A l R two and
it has that.

Speaker 15 (02:02:15):
It has the electronics.

Speaker 2 (02:02:17):
So did they did they go a step further?

Speaker 3 (02:02:20):
Bo when you said they said the fluid they used,
the oil they used was acceptable, did they go one
step further to say that they probably aren't responsible for
the damage? In other words, how do they how do
they reconcile the fact that it was making noise? Shortly after?

Speaker 10 (02:02:40):
They didn't have any comment about it, Tom, They just
said they put in the right oil for this two
thousand and eight range rover, and they said they use
it all the time, but it's not the OEM range
roll right.

Speaker 8 (02:02:52):
You know this actually says the fluid type on his
vehicle is a seventy five ninety fully synthetic.

Speaker 2 (02:02:59):
That's what it calls for.

Speaker 10 (02:03:01):
So Mark, that's what the That's what the Rocky Mountain
Loop shot put in his ranger over.

Speaker 8 (02:03:06):
That's what it says is supposed to be in there.
Let's get let's get Jeff Thick up again and ask
him please.

Speaker 3 (02:03:13):
Yeah, I mean we can, we can. That's a good
idea put in.

Speaker 8 (02:03:16):
Its simple as that. If this guy dropped it off,
what would Jeff put in there? I mean, that's the
real question.

Speaker 3 (02:03:23):
It is three ozho three seven one three tonk three
oh three seven on three eight two five five. We've
got a half hour to go, and I want to
tell you about Appleair. That's air with any Apple Air.

Speaker 5 (02:03:34):
Uh.

Speaker 4 (02:03:34):
They do great furnaces that you're gonna love.

Speaker 3 (02:03:39):

Hi Tom Martino here, Welcome to the show. Three O
three seven one three talk three O three seven one
three eight two five five.

Speaker 4 (02:04:36):
So here's where we stand.

Speaker 3 (02:04:38):
Basically, Mark, you've done some looking up, and I did
right after you did. And even though somebody says that
fluid is the wrong fluid to use, it actually is specified.
If you look up that vehicle right.

Speaker 4 (02:04:53):
Mark, do you uh?

Speaker 3 (02:04:57):
Do you pick that up.

Speaker 4 (02:05:01):
Anyway? I don't know.

Speaker 3 (02:05:02):
Am I getting through to.

Speaker 2 (02:05:02):
You or I'm sorry, I'm sorry, Tom, I had my cough.

Speaker 8 (02:05:05):
So it's a seventy five ninety and it's got to
be a synthetic and then it's a GL five and
that's what it calls for. I mean, mobile one makes
one valveline. There's one hundred different brands. Back in the day,
I would have ordered that from Colorado Petroleum. It would
have been their own brand of whatever. It would have

(02:05:26):
been Colorado Petroleum, but it would have been fully synthetic
seventy five ninety GL five. And I assume Jeff, you
would do similar or what do you have to say
about Jeff, Jeff.

Speaker 3 (02:05:38):
Thick camera transmission?

Speaker 16 (02:05:39):
Go ahead, Jeff, Yeah, it's a GL five. I mean
it's literally the eighty ninety eight or seventy five ninety
eight ear oil. So sometimes when you've got a close
carrier or a positive here, you need to add an
additive to it. But aside from that, it's your oil.

Speaker 3 (02:05:55):
So why would they why would they tell him? Why
would they tell Doug that the fluid ruined his differential?

Speaker 16 (02:06:06):
I'm at a loss for what they told him. I mean,
I haven't heard whatever noise he's experiencing. I haven't seen
what the actual failure is. I mean there's a big
difference between. You know, if they were to put in
automatic transmission fluid, then you'd have an argument there. But
if they put in GEL five, then they put in
GIL five. The actual designation from land Rover is the EPX,

(02:06:27):
but that's no different that. Just as Mark was saying,
between going to mobile Wan, we're going to call it
out of petroleum.

Speaker 3 (02:06:34):
Yes, so, Doug, you might not have a strong, a
strong case. You may not have a strong case. If
this shop says we used this gear oil and it's
specified for this kind of transfer, then you don't have
an argument.

Speaker 4 (02:06:51):
I don't know what that other shop meant.

Speaker 16 (02:06:55):
Can I can I talk?

Speaker 3 (02:06:57):
Yes?

Speaker 15 (02:07:00):
I tell you what it says right on the internet
that that five gear oil that they're training guy's talking about.
It says that cannot be used in my system.

Speaker 16 (02:07:14):
And it says the gar oil it must.

Speaker 15 (02:07:16):
Be used in it and they're only in Jaguars, Bobos
and land Rovers, and it says specifically you cannot use.

Speaker 16 (02:07:25):
That gear oil.

Speaker 15 (02:07:27):
It's not the right it won't work with the clutches
and the pumps.

Speaker 10 (02:07:33):
So guys, Yeah, so Jeff Mark mentioned the seventy five
W ninety four synthetic g L four SLASH five oil.
That's what the first shop did put in. Now that's
I looked it up. That stuff's only eighteen dollars a quart,
but the land Rover differential oil that's eighty four dollars

(02:07:56):
a court. So there's got to be just price way,
there's got to be something.

Speaker 16 (02:08:00):
I'm looking at it right here on Mitchell one for
demand were Differential Gospel EPX eighty ninety.

Speaker 2 (02:08:10):
So that's what That's what the Mitchell Guide says.

Speaker 3 (02:08:13):
Use that. That's what the guide says.

Speaker 15 (02:08:16):
Robert says, that will not interchange.

Speaker 8 (02:08:18):
Well, then I guess you got to go after the
people that wrote the Mitchell's Manual at that point, because
that's what every shop in the world uses to know
what fluid they put in there.

Speaker 4 (02:08:28):
Yeah. I don't think they did anything reckless.

Speaker 15 (02:08:32):
And all right, well what kind of automatic transmissions.

Speaker 16 (02:08:35):
Do you work on?

Speaker 4 (02:08:37):
Listen, see, I'm all we're saying, is.

Speaker 15 (02:08:43):
This sitting on the internet demand Rover and what it
says on there you cannot use that according to doctor Google.

Speaker 16 (02:08:51):
I have wickets.

Speaker 3 (02:08:53):
Okay, but here's what I'd like to know. If a
normal shop, any shop, was to work on this and
they looked up the fluid, they may do the same thing.

Speaker 2 (02:09:03):
They would do the same thing.

Speaker 16 (02:09:06):
Yeah, Okay, if it's going to require something else other
than that this is going to be special. There will
be some sort of tag on the on the actual
box itself.

Speaker 3 (02:09:14):
I want to know, Chris. Bring Chris up. He has
a comment on this call. Chris, what did you want
to say? Listen, Doug, we understand what you're saying.

Speaker 4 (02:09:24):
You're saying that.

Speaker 3 (02:09:25):
Land Well, No, Doug is saying that land Rover specifies
only one fluid. Chris, what do you have to say?

Speaker 8 (02:09:31):
I don't find anything anybody out there, employees Google whatever
he's googling.

Speaker 1 (02:09:36):
It's an O.

Speaker 3 (02:09:38):
Yes, you're the ones.

Speaker 13 (02:09:40):
Who I'm gonna tell you came up with.

Speaker 21 (02:09:43):
You said something when you were looking something up. You said,
jail five is the one that's supposed to go in there,
except there's this other thing that's electric. That's what this
gentleman has been saying the whole time, that he has
the electric version and it doesn't.

Speaker 22 (02:09:57):
Take the According to everything in the world, there is
only one front in rear deferential and it's a held
X center differential system on an eight.

Speaker 2 (02:10:08):
Land Rover is his special Yeah, okay, I guess it is.

Speaker 3 (02:10:15):
Well, were there a few? Were there a few electric
units made? Were there a few electrics.

Speaker 13 (02:10:22):
What about when Mark was talking and he was looking
at something. He looked up and he said the jail five.
And then and you said any kind of fluid, and
you named off some names, and then you said, but
there's another thing here that says something about electrically you
have to use the specific fluid.

Speaker 2 (02:10:39):
Not on in O eight.

Speaker 8 (02:10:41):
That wasn't on in eight. That was a general question.
I asked ROC about different differentials they had. Then I
followed up with the question, how about in eight land
Rover l R two And the only one in there
is apparently the held X system.

Speaker 13 (02:10:59):
Okay, so the new ones are the only ones that
have that separate.

Speaker 2 (02:11:02):
I would guess.

Speaker 8 (02:11:03):
So that yeah, that's why I literally asked the guy
what was the year making model?

Speaker 16 (02:11:09):
Gotcha?

Speaker 3 (02:11:09):
See, he's gonna have thank you, Chris. He's gonna have
a tough time making the argument that this shop ruined
his differential because of all the everything.

Speaker 2 (02:11:21):
Listen and I can say this.

Speaker 8 (02:11:23):
I had five stores, We did more differential and transmission
services and on everyone. We do exactly what Jeff does now,
even though it was ten fifteen years ago. You go
to Mitchell or you go to all data, you put
in either the last aid of the vin or and
that's generally what we would do. Or you put in
your make model and it tells you what fluid to

(02:11:44):
put in there. I mean, it's not brain surgery, Jeff,
am I missing anything there?

Speaker 16 (02:11:50):
No, sounds pretty spot on from the side.

Speaker 3 (02:11:53):
Okay, well, you know what, We're gonna have a tough time,
Deputy Bow. You know what I'd like to do, bo,
I'd like to talk to the shop that he took
it to where they told him it was the wrong fluid.

Speaker 10 (02:12:08):
I did talk to Alexander Automotive and he specifically looked
at Doug's receipt and he immediately said that the first
shop rocking out Loube and put in the wrong oil.
They put in this seventy five ninety five oil, and
that's why he has thousands of dollars of damage.

Speaker 3 (02:12:25):
But that just doesn't make sense.

Speaker 10 (02:12:29):
I know, I could call the shop back. Maybe. You
know what Doug needs to do is take it like
the shirt and autoteker Jeff Fick's Kimber transmission get a
second opinion.

Speaker 4 (02:12:39):
I don't know if it is ruined or not. I
don't know if it is ruined.

Speaker 3 (02:12:43):
Here's the thing, that second shop that said it was
the wrong fluid.

Speaker 2 (02:12:47):
Wait, wait, what did you just say? I missed with
the I missed what Doug said.

Speaker 15 (02:12:52):
Yeah, I said, I'm probably not going to take to
the shop you guys recommend because I looked it up
on the internet.

Speaker 2 (02:12:58):
Okay, all right, yeah, can use Deputy Bow.

Speaker 8 (02:13:01):
God bless you. I'll leave it like that, Deputy Bow,
you are a saint. I don't know what else to say,
Jeff Vick, who have I don't know anybody else who
lives and breathes transmissions. But because Doug looks something up
on the internet, Doug is right, And what else are
we going to do at this point?

Speaker 3 (02:13:18):
You know, if the Mitchell catalog or the Mitchell computer
says that fluid's all right, I'd like to know, Deputy Bow,
if you get a chance, get the link that he's
looking on the internet. I want to see where he
is looking on the internet that says that. That will help. Okay,
I want to see it because we can't find it. Jeff,
we can't find.

Speaker 8 (02:13:38):
When you look it up on Mitchell, which you just
did in the last ten minutes or it feels like
five hours.

Speaker 2 (02:13:44):
Now, what did you see? Was there multiple options.

Speaker 16 (02:13:48):
There was a single option on there according to land
Rover's recommendations, and that is Castle EPX eighty ninety, which
has since been surpassed by the Sindtrack's long life.

Speaker 3 (02:14:00):
Okay, well, Doug doesn't want to work with our people,
so he's gonna have to go find his own solution here. Thanks,
We don't. We don't necessarily agree Doug that it was
the wrong fluid, but I'm willing to look at the
the ex he said he looked it up, Deputy Bow
find out exactly I want to read. Mark wants to

(02:14:21):
read where he's reading, because we're not reading the same thing.

on the line. Let's talk to Paul. What's going on?

Speaker 11 (02:15:03):
Man?

Speaker 16 (02:15:04):
Hey Tom?

Speaker 17 (02:15:05):
Thanks, I'm a long time caller or a.

Speaker 16 (02:15:06):
Listener, and thank you.

Speaker 17 (02:15:08):
I love everything you guys do. You guys have helped
me out on several occasions. Anyway, the situation I have
now is I'm a I'm a custom builder and I
want to build a home there in El Paso County.
And as I pull out their paperwork, they want I
look at their what the requirements are they want to pay?

(02:15:28):
They want one to pay the water taps and sewer
fees up front before you do anything before the county
gives you a permit right time I built the how home.

Speaker 16 (02:15:40):
Before that, they don't.

Speaker 17 (02:15:41):
You don't pay for the water tap for your the
sewer until you need it, which many many times it's
eight months or a year down the road. So you're
and then they want fifty thousand dollars nearly for the
water tap fee. So you're basically loaning them fifty thousand
dollars for a year and.

Speaker 16 (02:15:59):
You get nothing for it.

Speaker 3 (02:16:01):
But hold on a second. What they want to do
is reserve that right don't they have a limited.

Speaker 4 (02:16:08):
Number or not, you know, I don't know. I don't know.

Speaker 3 (02:16:13):
See, Paul, when I was developing, we had to pay
our taps at different times depending on the municipality. Now,
sometimes they let you wait until you tap and that's
when you pay it. At other times you had to
pay it with the building permit because they wanted to
make sure that once they issued the building permit that
those that that right or that right of connection was taken.

(02:16:39):
So it really is up to them. I don't think
there's a law that's going to cover you here. And
you say you're loaning the money, but technically the tap
is yours.

Speaker 17 (02:16:51):
Yeah, well they could easily just say say that you
know that it's a reserve for the tap, But.

Speaker 3 (02:16:56):
No, I know, Paul, it's a money grab, Paul, That's
what it is.

Speaker 13 (02:17:02):
Yeah.

Speaker 17 (02:17:02):
I've never talked to anybody that has you know, that
has had to do it that way.

Speaker 16 (02:17:05):
But maybe it's a new.

Speaker 17 (02:17:06):
Thing because I haven't built a house for about three
or four years.

Speaker 3 (02:17:09):
Did you ask them about it?

Speaker 17 (02:17:12):
No, I'm going to I'm going to contest that. See,
you know, I mean, there's no reason otherwise they would
stop a lot of building.

Speaker 4 (02:17:19):
From going on, you know, just on that, on that now, now, Paul,
I want you to keep something.

Speaker 3 (02:17:23):
I want you to listen to something carefully called the
Chevron deference. Now listen to what I'm saying. It's the
Chevron deference. And it was a Supreme Court ruling. And
here's what it said. That in the past, when laws
were written and they weren't clear, they allowed the agencies,

(02:17:45):
the government agencies, to decide how to implement them. The
Supreme Court said that is not the way it should
be done. It doesn't necessarily go with what they say.
Say it has to be part of the law.

Speaker 4 (02:18:03):
So if the law.

Speaker 3 (02:18:04):
Doesn't specify it, you may want to argue with them.
But good luck to you, because agencies make up their
policies all the time. Terranconstruction dot Com. Don't forget them,
and don't forget to call us when you need help.
