family and then he went into the directing and he
has directed some really high end film So he's an
A list director. And his son, their son, Nick thirty
two years old, lived with them, and he has a
history of mental issues. Well, what he has been accused
of is murdering his parents after an altercation and stabbing

them to death. And so there is the allegation of murder.
So quite often whenever people are indicted or alleged and
a complaint is issued against them the accusation, they can
change the accusation and add other terms. It's a superseding indictment,
which means, okay, we're going to take count number one

and we're going to add another count. Well, in this case,
that's exactly what the authorities did. Count number one was murder.
Count number two was lying in weight to commit the murder.
Now that puts it in a whole different category because
for simple murder you can't get the death penalty. You

have to have special circumstances to get the death penalty.
Every state is different, and so circumstances now did change
because lying in wait is considered an enhancement. Lying in
weight is a special circumstance, which now makes Rob Ryder
or Nick Ryder eligible for the death penalty. And upon conviction,

only one or two things can happen, life imprisonment without
possibility of parole or the death sentence. And with a
murder you can get life imprisonment and with parole now you're.

Going to be in jail for a long time.

But with the enhancement, with the special circumstances, you can't.
So they've just added the death penalty. Is it actually
going to happen?

First of all, there's a moratorium, Governor Newsom. Interesting enough,
he hasn't said there there is none. He just said
there's a moratorium. It won't happen during his tenure. So
we've got California. I know seven hundred, seven hundred and
fifty people on death row, not that they're ever going
to be executed. Which, by the way, I went to
an execution. I witnessed an execution. I highly recommend it,

very entertaining. I felt great about it. Afterwards. I almost
turned to one of the news camera people on the
way out and said, I'm going to Disneyland. It was
a lot of fun, entertaining, It's all of it is terrific.
Enjoyed it. So it turns out that is it's very
difficult to get the death penalty. I mean, it has

to be a very heinous crime. I mean the man
that I saw executed a guy by named William Bonnen,
and he was convicted. I mean, you talk about serious crime.
He was convicted of picking out picking up teenage boys
up and down the coast of California, kids who were
hitch hiking, and then murdering them after raping them, sexually

assaulting them and raping them. And even we found out
I think he admitted to this that one of the
kids came out of a burger king with a sack
of burgers and fries and he was hitch hiking, and
bonn and picked him up and took him to a
secluded spot and before he raped and murdered him said
die like a man. I mean, pretty horrific stuff.

And so the.

Lying in wait is it going to fly? No, they're
not going to ask for the death penalty. They're simply not.
But it's kind of interesting that the argument, well maybe
the lying in wait.

Enough to ask for the death penalty because there's too
many other circumstances involved. You've got the mental illness, you
have a single incident, there are two people, and that
is I think that's an enhancement. And then of course

I was going to ask you that no breathalyzer simply
on the testimony of the you smelled like alcohol and
you had your breath and they searched your car.

because I'm assuming you didn't show them a little bottle
had your name on it, right, right? Okay, okay, So

you got arrested, they charged you. You've been indicted for
drunk driving. Also, was it in possession of the controlled
substance for the oudall?

Were you charged for that too?

the jury's going to believe one or two of you,
one or the other. And you're right, this is Georgia.

to come back. I mean I'm assuming obviously you may bail.

So now all right, so now you have two choices. Okay,
real simple choice Number one. You go back to Georgia
and you fight it and hopefully you get the charges

reduced or thrown out, which it should be, because if
the testimony is some guy who says you smell like
like beer, that's not enough to even arrest you. But
they did okay, Yeah, your question is no, you're right,
they don't have the right to do that, but they
did it anyway, and so you have to argue they

didn't they didn't have a right to do it, okay.

And a judge either agrees with you or disagrees.

With you, and then you get convicted or you don't
get convicted because it's small town. Once again, Georgia, local
police force, local judge, and you know, you might or
may not get jailed, You may may not be convicted.
And then the other side is to ignore it and
there'll be a warrant for your arrest and never drive
in Georgia again.

That's a problem. That's a problem, and so you get
to fight it. I know, you get to fight it.
You have no choice, you know. And his question was
do they have a right to do that? Well, under
those circumstances, they don't. But you know, what are you
going to do? Hire a civil rights lawyer. I mean,
you're stuck between a rock and a hard pace, a
hard place. Now, let me tell you what else you

can get stuck with is a car accident or a
slip and fall, or going to a big box store
and getting a big box falling on you. And so
there you are injured, clearly not your fault. And what
do you do. Well, you go against the store or
the people that hit you, and now you're going to
be talking to their insurance company.

It's one of the few cases where insurance companies actually
call and we'll pay for your car repair. We'll pay
for your medical expenses, and they're going to offer you
some pain and suffering. And this is where the difference
comes in because they're going to offer you thirty five
cents and it's only about money. And now, how do
you get the money you deserve under the law and
you should get Well, that's where you bring a lawyer in.
