Speaker 1 (00:00):
You're list Saints KF I AM six forty.

Speaker 2 (00:03):
The bill handles show on demand on the iHeartRadio f
This is handled on the law marginal legal advice where
I tell you you have absolutely no case.

Speaker 1 (00:16):
Now if you go to the Netherlands.

Speaker 2 (00:18):
Netherlands kind of interesting place, Holland, and it's pretty liberal.
I mean they well, I'll tell you where they're really liberal.
Great safety, safety and at socialist country, et cetera. And
that is it was the first country that allowed assisted death,
where people could go in and request to die, have
a doctor help them die. Now heretofore it would never

(00:41):
have happened. First of all, anybody helping anybody else die
is considered murder if they have any part of it.
And the Netherlands and a lot of the medical community
as well as me as well as I believe that
people should have the right to pull the plug and
have doctor help them because I believe that death is

(01:03):
part of life. And there are plenty of people that
go nope, life is sacricanct and you do all the
heroic measures you can, both morally and just.

Speaker 1 (01:12):
Because you don't want to give up the ghost.

Speaker 2 (01:14):
So for those people that have requested to die, we
have a Die with.

Speaker 1 (01:20):
Dignity Act here in California. We're amongst several states.

Speaker 2 (01:23):
You look back to the Netherlands because they created the model,
and the model is pretty simple in California's case, I
don't know netherlands exact case, but it's all pretty similar.
Two doctors have to ascertain that number one, you have
a terminal illness. You have to be able to articulate
that you want to die. It has to obviously be

(01:45):
a reasonable choice. You have to have an illness where
it is terminal in our case, I think six months,
and you have to have those two doctors say yep,
he or she knows what she's doing about it. Okay,
here you go, and they give you that wonderful cocktail
of drugs that end up killing you very pleasantly. You
go to sleep, you just don't wake up. Well, here's

(02:06):
what also is happening with the Netherlands. The first child
to have assisted death has been reported. The Netherlands actually
has a law that says that children between the ages
of one and twelve can be put to death. Now,

(02:30):
who makes that decision? The parents. Now, sometimes it's easy
to make that decision. For example, in the case of
Taysacs disease among Jewish East European folks. It's endemic to
Jewish people, much like sickle cell anemia is primarily an
African American disease or people of African descent. And so

(02:53):
you have a kid with taysacs probably not going to
live beyond six years of age. It's going to be
a devast period of time and the kid's gonna die painfully.
So do the parents say, Okay, it's time to pull
the plug, or it's time to help him die, it's
time to make him die, because how does the kid
of five or six or eight have in any kind

(03:14):
of informed consent?

Speaker 1 (03:15):
You can't.

Speaker 2 (03:17):
So really interesting story, by the way, it was in
twenty twenty where the Dutch government announced plans which are
now in place, to allow doctors to d the lives
of terminally old kids under thirteen. And that's a tough decision.
But I mean, is that where it's going to go?

(03:37):
Do I draw the line there? That's a tougher one
than just the general okay, go ahead and die. See
I think if you're an adult and you decide you're
going to pull the plug, Hell yeah. They should sell
these drugs at Walmart under the suicide aisle. I don't
have a problem with that. Okay, Let's take a phone
call Steve.

Speaker 3 (03:57):
Hi, Steve, welcome, good morning.

Speaker 1 (04:01):
Ye Yes, sir, what can I do for you?

Speaker 4 (04:04):
Yes, So, I wanted to find out if I needed
to sue his small claims or superior cord. I rented
a house, I moved out. I had a seven thousand
dollars deposit, and the landlord tried to keep they were
a legend that there was a lot of damages. Some
of the damages that the alleged.

Speaker 3 (04:23):
Re existed, okay.

Speaker 4 (04:24):
And several of the ones, sir, okay.

Speaker 2 (04:27):
I'm sorry, and several of the ones I didn't let
you finish. Some pre existence are somewhat.

Speaker 4 (04:33):
Some of the ones that they were a legend, they
never showed the evidence of the damage. So he tried
to keep my seven thousand dollars.

Speaker 2 (04:41):
Okay, How is it right now?

Speaker 1 (04:44):
Is all seven thousand dollars being held by the landlord?

Speaker 3 (04:48):
Yes, sir, okay, all.

Speaker 1 (04:49):
Right, this gets easy. Yes, it is small claims court.

Speaker 2 (04:53):
That's that's a simple one because that's within the jurisdictional limits. Now,
when you say it's pre existing, I'm assuming you have
photos or a video of when you moved in to
prove that these were pre existing correct?

Speaker 4 (05:07):
That is that is correct? Okay?

Speaker 1 (05:11):
Okay.

Speaker 2 (05:11):
And now he is saying damages and you're going, no,
there are no damages, or you can't prove there are damages.
And he then is going to say you did these
and you.

Speaker 1 (05:23):
Go, no, I didn't. I didn't.

Speaker 2 (05:26):
So now when he took over the property when you left,
did he go in and photograph all the damage?

Speaker 1 (05:33):
And if he.

Speaker 2 (05:33):
Did, you're screwed because he's going to get those damages
depending on how well he was able to put that
on the record.

Speaker 4 (05:44):
Yes, sir, but I have pictures that would show the
very same location.

Speaker 1 (05:48):
Okay, Then sue him, all right, Then let him defend.

Speaker 2 (05:51):
You're the one that's suing him, and you go, here's
my proof, and they have to refute it, and they're
gonna have to come up with some kind of evidence
saying no, Steve is wrong, and here is what we show,
and maybe the judge is looking at two sets of
photographs and then makes a decision saying, now Steve, Steve's right, No, no,
landlord's right, or the judge splits it down the middle,

(06:11):
that's what you're looking at.

Speaker 3 (06:13):
Yes, I read that. A gusuf for bad faith.

Speaker 1 (06:18):
No, no, not.

Speaker 2 (06:19):
In small claims court, and bad faith is almost impossible.
What you have is you have a breach. That's all
you have, Steve, is you have a breach of contract.

Speaker 1 (06:28):
That's it.

Speaker 3 (06:30):
Okay, he doesn't want to pay you.

Speaker 2 (06:31):
You want to get paid. He says, No, that's not
bad faith. That's a straight out dispute. So yeah, that's
that's not going to happen. Bad faith is one of
those that people try to come up with, like punitive damages.
He didn't pay me or the company didn't pay me.
I want punitive damages. No, don't waste your time. Why

(06:53):
ask for punitive damages when it doesn't even fall within
the definition of the law.

Speaker 1 (06:58):
The scope of the damages don't even come close to that.

Speaker 2 (07:02):
Now, talking about making money, making money for you is
what lawyers do. Whenever you get into a car accident
or a slip and fall, let's say you've been rear
ended or whatever. It's only about money. I mean, you know,
lawyers can't do anything else. The doctors do what they
can to fix you. But your damages are money. The

(07:22):
cost of your medical repairing your car, and then what's
pain and suffering, what you get for the hurt of
all of this, and how long you've been incapacitated. And
so you go against the person who did the damage,
and they have insurance, and you're going to get a
call from the other side, the other insurance company, and
they're going to start offering you money. And you're crazy

(07:43):
to talk to these people because they're experts, experts at
not paying you, and so you really do need help.
I mean, that's legitimate, that's good advice. So let me
suggest visiting handle on the law dot com. Handle on

Speaker 1 (08:24):
Law Marginal Legal. Advice, Michael, Hello, Michael.

Speaker 5 (08:29):
Yeah, Hi my question IS i live in the apartment
second story and they were about to finish off the
replacing The robberts cement flooring when it crossed over with
the city expecting the.

Speaker 1 (08:43):
Apartment, WELL i don't know what that. Means it crossed.
Over what does that?

Speaker 3 (08:47):
Mean that means?

Speaker 5 (08:48):
THAT i mean that means that as they were about
to finish my balcony work the city the following day
or two days, later the city had an appointment in
coming out did inspecting the. Building and when they sent the,
inspector he went ahead and was about to, finish and
he was taking a look at what was going on
in my, balcony and the individual who was showing him

(09:12):
he wasn't aware of. It he was just, happening walking
walking around the. Inspector so the inspector shut it. Down,
okay and he, said you know, What i'm gonna require
additional permits for what you're doing. Here. Okay so we're
going on third on the third, year and he hasn't been,
done has.

Speaker 1 (09:29):
Three years without a, balcony.

Speaker 5 (09:33):
Three years without that balcony being, finished.

Speaker 1 (09:36):
Correct, okay but you still have use to the. Balcony.

Speaker 5 (09:39):
Correct, well they went ahead and laid down just.

Speaker 2 (09:44):
Plywood, okay do you Still, okay they laid plywood, down
so you're walking on plywood if you go out on
the balcony.

Speaker 3 (09:51):
Right right in case that's going out all.

Speaker 1 (09:53):
Right so what's your, question pastic?

Speaker 3 (09:55):
Cover?

Speaker 5 (09:56):
Okay question is one of the one of the reasons
that they were replacing the rubber is because underneath some
of the beams that could go across how to be
replaced the rotting of the.

Speaker 3 (10:08):
Water i'm very exposed to the, rain so.

Speaker 5 (10:13):
Knowing that it's it doesn't have its layer of rubber
cement which protects it from the water and the weather,
exposure that right. There whatever they put it doesn't necessarily.
Cover but you think that the city that the permits
in the city would BE i don't, know attentive on.

Speaker 1 (10:32):
That, yeah they probably.

Speaker 2 (10:33):
Would you're, right the city would be. Attentive that's. Correct,
actually it's not the city that's. Attentive it's the landlord
that has to be. Attentive all the city does is
shut it down and say when you and pull. Permit
when you pull, permit we'll say it's. Okay other than,
That i'm shutting down this, project all. Right So i'm
assuming that's.

Speaker 3 (10:49):
What your west lord is. Waiting they go back and
forth with the city and.

Speaker 1 (10:55):
Yeah that's not your. Problem that's not your, Problem.

Speaker 5 (10:58):
MICHAEL, i, okay AND i understand that the, city uh
Is i've already had two hearings with a hearing judge Where.

Speaker 3 (11:06):
I'm on the, phone and so the, landlord.

Speaker 1 (11:08):
What do you have to do with?

Speaker 6 (11:09):
It?

Speaker 2 (11:09):
Why let me ask me how did you get involved
in the hearing with the?

Speaker 1 (11:13):
Judge where where are you in all of? This this
is between the city and the landlord.

Speaker 3 (11:20):
Because you can be as you, know as a, resident
you can be on the phone and you can.

Speaker 1 (11:24):
They bring you in.

Speaker 2 (11:25):
It, Okay so you're not a, party so that city
allows you as a resident to come.

Speaker 1 (11:29):
In so you're basically a. Witness, Okay so what's your?

Speaker 5 (11:32):
Question my question is the hearing judge said after the
second hearing it could go to THE da for maybe Criminal.

Speaker 2 (11:42):
Okay all, Right so, OKAY i don't know how it
can be, criminal but, okay uh it's, okay so it
can be.

Speaker 1 (11:49):
Criminal so what's your? Question my question, IS.

Speaker 5 (11:56):
I know that you could get rank control if there's
certain things your.

Speaker 1 (12:00):
Call either there is rent control or there is not rent.

Speaker 2 (12:04):
Control not red, control rent. Reduction that's, right you. Can't,
yes you. Can it's not you can get you take.
It and whether if there's a lawsuit you fight it
or the judge that gives it to you or doesn't
give it to. You on the, Reduction uh so, yes
you can file for rent. Reduction and is that your?
Question CAN i file for rent?

Speaker 3 (12:25):
Reduction the question is?

Speaker 5 (12:27):
This is? It it can be done on things that
like if it's a stove or here things yes you, need.

Speaker 2 (12:32):
Yes can it be? Done are you let me ask you?
Again can you use your balcony all the way back
to the? Beginning can you use your? Balcony?

Speaker 7 (12:39):
Correct?

Speaker 5 (12:40):
Correct can you especially especially when it's?

Speaker 1 (12:43):
Weather, OKAY i.

Speaker 2 (12:44):
Understand can you use your balcony because or do you
deem it unsafe because they never finished?

Speaker 8 (12:48):
It?

Speaker 3 (12:48):
Well, NO i MEAN i could step out, there BUT
i know.

Speaker 5 (12:51):
That.

Speaker 2 (12:51):
Okay understand you're fearful because there is rotty. Woid, okay
that's your fear and so therefore you don't use your balcony.

Speaker 3 (12:58):
Of, contracting you, CAN'T i.

Speaker 2 (13:00):
Understand so they're, yeah they're breaching the. Contract how much
rent reduction do you?

Speaker 5 (13:03):
Want, well just it would be a calculated to the
square Footage, okay that's.

Speaker 1 (13:09):
Fair what's a square.

Speaker 5 (13:10):
Footage that's probably eight hundred square feet apartment and it's.

Speaker 1 (13:15):
Okay so?

Speaker 2 (13:16):
Much, say, okay how much is what's the? Balcony what
square footage is the.

Speaker 3 (13:20):
Balcony is a pretty good.

Speaker 5 (13:22):
SIZE i would say it's five four feet wide by
twenty five feet.

Speaker 2 (13:29):
Length, okay one hundred square feet it's it's, okay one
hundred square feet fair. Enough and so you've got nine
hundred square feet one hundred to nine about eight percent
maybe or maybe twelve?

Speaker 1 (13:42):
Percent and how much rent are you?

Speaker 3 (13:44):
Paying one?

Speaker 2 (13:46):
Thousand, okay you knock twelve percent off a thousand because
you can't use the balcony because they have because it
hasn't been, finished and you rented it with the with
you with the expectation you're used in the.

Speaker 1 (13:59):
Balcony so you knocked the rent off twelve.

Speaker 2 (14:01):
Percent then you're gonna get sued unlawful, detainer three day
notice to pay rent or, quit and then it is
your choice if you go to, court and you may
win the. CASE i think you probably, would especially if
you bring all of the records that the.

Speaker 1 (14:18):
Guy just won't do what the city.

Speaker 2 (14:20):
Wants he just can't do it and refuses to do,
it and therefore you're entitled to your twelve percent. Reduction
and the court is gonna, say, yes all of. That
we got to and we took twelve minutes to do.

Speaker 1 (14:31):
That, wow.

Speaker 2 (14:36):
Only because the only REASON i kept. ON i kept
him on for so long IS i am a. Moron
USUALLY i call other people. Idiots i'm looking in the
mirror now AND i am screaming THAT i am a.

Speaker 9 (14:50):
Moroln, Hello, dave Hey, Bill, yeah my son thirteen years
old got caught, no fifteen other.

Speaker 10 (15:03):
Sons SO i got caught shoplifting at an amusement. PARK
i received a letter SAYING i needed to send a
NOMINAL i think it was tune or fifty dollars fee
to an attorney as their, cost and SO i sent
that to. Them that was three months. Ago they are

(15:23):
blaming the mail as to why they haven't cashed this,
check that it hasn't, arrived, okay And i'm wondering when
DO i CAN i cancel this?

Speaker 5 (15:31):
Check?

Speaker 1 (15:32):
Yeah what you? Doing that's?

Speaker 2 (15:33):
What first of, All, yeah you put a stop payment
on it and then you send another. Check you've got
to pay, This, dave that's. Statutory you got to pay,
it and you don't want to get into it by
not having, paid because my guess is a statute if
you don't, pay and in this, case you haven't, paid
and they're saying we never got, it and so they're,

(15:53):
saying go ahead and send. It i'm assuming they'll still
take a new. Check then that's where it, stops because
you owe the. Money, NOW i haven't read the, statute
But i'm willing to guess if you don't pay, it
they can take you to court and there are all
kinds of sanctions on. That you don't want to do.
That put a stop payment on. It call them up and, say,
HEY i just put a stop. PAYMENT i put a

(16:13):
new one in the. Mail thank you very much for your.
Patients that's what.

Speaker 1 (16:18):
You, do, okay, cool all, right all. Right that's a lot.

Speaker 2 (16:22):
Of people don't understand that my son or not have
got caught shoplifting and they want two hundred and seventy
five dollars and it was a packet of gum and
they were caught and it was, returned so the store
is out. Nothing guess what that's the lot two hundred
and seventy five bucks or two hundred and fifty dollars
and it's. Civil it's basically an administrative fee that the

(16:48):
store gets for dealing with. Shoplifters it's a really weird,
law but it's.

Speaker 1 (16:57):
There all.

i started listening to. You Thank god for art. MEDIA
i can listen to you guys on my, computer and
recently it started kind of breaking, up AND i, thought you,
KNOW i need to have my computer. Fixed SO i

(19:17):
went down to one of the big box stores AND
i went to them because, recently you, KNOW i had
the big SCREEN. Tv they installed. It they did a wonderful,
job and SO i went down there AND i was
waiting get the counter for one of the people to
come up are. WELL i came out in stall THE.
TV i went down to ask them a question that
how much would you charge to fix? It AND i

(19:40):
was waiting there for about fifteen. Minutes the next THING
i know is security guard came up and asked me
to leave the. STORE i, said what's going? On and he, said,
well one of the sales associates said that you were
recording on your phone AND i, said, No i'm not. Recording.
Here take my. Phone it's. Unlocked look at it and you'll.
See and he, SAID i can't take your. Phone and

(20:00):
about that time a manager came up AND i, said
look at my. Phone you're. Welcome it's. Open you, KNOW
i give you total permission to go through everything in
my phone to see THAT i wasn't. Recording AND i,
said IF i were, recording my friend has these classes
that you can come in record nobody'll. Know BUT i,
said why WOULD i record? You so they, said, well
we'd like for you to leave our. Store and never come.

Speaker 1 (20:22):
Back, wow, okay fair.

Speaker 7 (20:25):
Enough, Yeah and SO i wrote a letter to corporate
and they, said, well we'll look into. It and that
was about a month. Ago SO i don't know If
i'll be able to go into the store. Again and
it just kind of really takes me.

Speaker 2 (20:39):
Off, yeah, NO i would. Too, no let me tell,
YOU i would. Too And i'm surprised which store is.
It by the, way you can go ahead and, say.

Speaker 7 (20:48):
Okay it's Best, buy and okay Best.

Speaker 1 (20:51):
BUY i mean that's you, know these are legitimate. Stores you,
know they're not small.

Speaker 2 (20:55):
Stores i'm just shocked surprised that they would do, that
especially since you handed the phone you, Go i'm not
and they didn't take your word for.

Speaker 1 (21:05):
It it's very.

Speaker 2 (21:06):
Unusual and let me give you A costco, story big box.
STORE i go in and they make you show your membership.
Card now you have to show. It SO i walk
in and the guy you, know, saying show your membership,
card AND i, started you, know, saying, hey it's never happened.

Speaker 1 (21:25):
BEFORE i, wasn't you, know this is.

Speaker 2 (21:28):
NEW i always walk through and he, goes, oh you
have to say show, it AND i, go you, know
it doesn't make a lot of.

Speaker 1 (21:32):
Sense he was so obnoxious and so rude to.

Speaker 2 (21:35):
ME i went to a manager and, said, hey you,
KNOW i understand his, position but you really want someone like.
That i've been going to this store now for thirty five,
years and you have just made an enemy out of,
me AND i tell people about.

Speaker 1 (21:49):
It why would you do? That why would you have?

Speaker 2 (21:52):
Him that manager jumped so, fast went to talk to
the Guy i'm. Shopping the manager tracks me down and, said,
HEY i just went and talked to. Him he'd like
to apologize to. YOU i told him that this is
not going to happen. AGAIN i, mean that's the reputation

(22:14):
of these big stores when something like that.

Speaker 1 (22:16):
Happens.

Speaker 2 (22:17):
NOW i don't know much about Best, buy But i'm,
stunned And i'm obviously giving kudos To. COSTCO i Love.
Costco i'm in there three days a. Week it's my
therapy is.

Speaker 1 (22:27):
To go To. Costco. YEAH i love. It and you,
know you go for lunch and you even have to.

Speaker 7 (22:32):
Use a membership card now for the food, court WHICH
i think is.

Speaker 1 (22:34):
Great you, know yeah they do so you don't have
a million people.

Speaker 2 (22:37):
There, Yeah AND i like, that AND i particularly like
standing in line for, well they really crap. Stuff you
get the, samples no one's. There but if they're doing
chicken nuggets or burritos or, something then then you're standing in.
Line and then people of certain, ethnicity WHICH i can't
mention because radio is that way. Anymore push you out
of the way and you push back is. Fabulous the

(22:59):
point is THAT i am. Stunned and if management has not,
answered and they've done that, legally can you do.

Speaker 1 (23:09):
Anything, no it's a private.

Speaker 2 (23:10):
Company, uh they can, say you, know it's it's not
a governmental.

Speaker 1 (23:13):
Entity they can say get out of.

Speaker 2 (23:14):
Here and you're gonna, say, well they did it Because

Speaker 6 (24:03):
Him i'm, Sorry i'm.

Speaker 8 (24:04):
Sorry.

Speaker 5 (24:05):
Hi. Hi.

Speaker 6 (24:06):
Hey when you when you get a, judgment a favorable
judgment at a small claims, court what's the best way
to actually?

Speaker 1 (24:16):
Collect, yeah well it's on. You that's that's for.

Speaker 2 (24:19):
Starters and the best way to collect is hopefully have
the guy that you soon won against pay you and if,
not you get to track down the. Money and so
if you know of a bank, account you can attach
the bank account with the.

Speaker 1 (24:33):
Judgment if he is.

Speaker 2 (24:36):
Working, uh then you can try to garnish, wages although
there are all kinds of.

Speaker 1 (24:41):
Exemptions. Uh if there is a business business it's a.

Speaker 2 (24:44):
Business, uh you can have you actually can pay for
a marshall to go in and park in the. Business
it's a it's called a, receiver and they'll just grab
the money coming. In the best way to do it
is to find out bank. Accounts that's where you.

Speaker 5 (25:04):
Go but the.

Speaker 1 (25:04):
Courts don't help, You.

Speaker 2 (25:06):
Lauren the court will help you with the judgment but,
then but then you're on your.

Speaker 5 (25:10):
Own, yeah that's WHY i called.

Speaker 1 (25:12):
You, yeah, NO i know What i'm telling.

Speaker 2 (25:14):
You you're ON i have sued people who have no
money or it was impossible to get, money AND i
just gave it. UP i just, Said, okay it's not worth.
It it's gonna cost me more money to collect That
i'm going to. Get so how much money are we talking?
About how much did you?

Speaker 8 (25:27):
Win?

Speaker 6 (25:28):
Lauren, well it's it's a little. Tricky it's a it's
an electric. Bike it's three, thousand little over three thousands.

Speaker 2 (25:36):
A se you got a. Judgment what is the judgment?
For there is a dollar figure on that.

Speaker 6 (25:42):
Judgment, yeah WHAT i sued for was three thousand.

Speaker 1 (25:46):
Dollars what did you?

Speaker 6 (25:47):
Get, WELL i don't know. YET i, MEAN i haven't
done it. Yet i'm a.

Speaker 2 (25:51):
Shoe, Okay, well it's going to be it's going to
be whatever you it's it's going to be whatever the
judge gives. You you're going to. Argue, here here ARE i?
Damage it is so damaged THAT i want a new,
one or it's going to COST x dollars to. Repair
that's your lawsuit and then you're on your. Own, Yeah,
okay so that's. It, yeah, Yeah, OH i don't haven't

(26:15):
go on to court. YET i haven't sued. Yet what
DO i? Do, okay thank you for. That, okay let
me tell you about a problem THAT i. Had this
happens to a lot of. People SO i put my
mother into an assisted living facility because she needed, it
AND i didn't know where to.

Speaker 1 (26:32):
GO i, MEAN i had no.

Speaker 2 (26:33):
Idea SO i chose one near my house because that
was the easiest thing to.

Speaker 5 (26:37):
Do it was.

Speaker 1 (26:38):
Horrible it was the wrong.

Speaker 2 (26:39):
One SO i had to get her out of that
one and put her in another one again near my
house because it's, convenient and you know, what that didn't
work out so well. Either and she made it easy
for me because she ended up dying a little bit later.
On but the point is IS i truly didn't know
where to put my, mother And i'm willing to bet
there are a whole lot of people out, there because reality,

(27:01):
is you have to research, it you have to, evaluate
and keep in mind you're spending six to nine thousand
dollars a month to keep your loved, one your senior
loved with in one of these. Places so let me
SUGGEST slc placement help, you and they're going to refer
the right place to. You and not only do they
know what they're talking about and take all that pressure

(27:22):
off of, you but the referral costs you. Nothing so
you get to figure out or they get to figure
out the best, place and there is no fee for the.

Speaker 1 (27:30):
Referral that's what makes so much. Sense that's L slc.

Speaker 2 (27:35):
Placement and if you're in that position LIKE i, was
and it was a nightmare trying to figure all this,
out let me SUGGEST slc placement called a d eight
eight two three three six' nine four zero eight eight
eight two three three six nine FOUR zero slc placement.
DOT com slc placement. Dot com this is handle on.

(27:57):
The law this is handle on. The law Marginal.

Speaker 1 (28:00):
Legal, Advice, Carol, Hello Carol welcome.

Speaker 3 (28:08):
Carol there how you?

Speaker 1 (28:09):
Do, it, Yes ma'am.

Speaker 5 (28:10):
I'm, HERE yes.

Speaker 8 (28:11):
I own i own a.

Speaker 5 (28:15):
Duly.

Speaker 8 (28:15):
Pickup truck and the title is in my name and
my grandson's name that he used it occasionally, or whatever you,
Know whatever, but anyway he recently got married and his
wife who occasionally helps drive the truck if they're on a.
TRIP somewhere i found out that she's a marijuana user every.

(28:38):
Single day what would happen if there's an accident and
she's driving. The, truck yeah.

Speaker 2 (28:44):
You're, liable yeah especially if you know she. Uses marijuana
she cannot drive that truck while. She's, high carol you
do not want her to drive. That truck and you
tell your son you let her drive. The truck you're
RESPONSIBLE and i.

Speaker 5 (29:03):
Am.

Speaker 1 (29:03):
Responsible okay so the insurance.

Speaker 2 (29:07):
And, the insurance the insurance may not even cover it
if it is known that you allowed her to drive
knowing that she. Gets, High, okay yeah so.

Speaker 8 (29:18):
You're right what if what if she's not high during,
the drive but it's still in?

Speaker 1 (29:22):
Her, SYSTEM well i mean that's. That's questionable and it
depends on where she.

Speaker 2 (29:29):
Gets tagged if it is if she's tagged in a
state where it's, still, illegal screwed, beyond screwed if it's
a state where recreational drugs. Are allowed let's say It's,
in california where let's say an accident and then, THEY.

Speaker 1 (29:49):
Well i don't even. Know why, you know she's going to.

Speaker 2 (29:52):
Argue because, the accidents depending on how serious the, accident
is do the police haul? Her in do they do
a drug test most of. The, Time no but in,
the end the safest thing to do is just not let.
Her drive, just, say hey please don't tell. Your son,
you know she's. Not high she's gonna, be okay even
if it's in. The system the argument issue was, not
high but why screw?

Speaker 1 (30:12):
With, IT yeah I mean I. Wouldn't, Rena, hi rena
welcome to handle on.

Speaker 11 (30:20):
The, law oh, thank you thank you for taking. My,
call sure we had a claim against an insurance company
and we had water and wind. Damage severely we're on
a flag lot and so we get the front of. The,
wind anyhow they had somebody come out eventually and check,

(30:49):
the damage and they're coming up with a lot less
than what an independent contractor said was needed to repair.
The damages we have a lot of inside damage as
well as. Roof damage they're coming up saying that they
will send me five. Thousand dollars it's originally ten, thousand

(31:13):
DOLLARS but i have a five thousand dollars deductible and
they're going to send me five thousand dollars. The, claim
actually the contractor said that it would be at least
fifty thousand to repair. The DAMAGE if i accept. The
check does that Mean That i've i've talked to the

(31:35):
adjuster several times and, he, says well you could just
accept the check and we'll get to the. Other.

Speaker 2 (31:41):
Thing, no, no no absolutely, not no because when you accept,
that check the paperwork says that that.

Speaker 1 (31:50):
Is it you have accepted the money and there's no.

Speaker 2 (31:53):
Further liability what you want to do when they say ten,
thousand dollars you, go no it's two.

Speaker 11 (31:59):
Thousand dollars and, he, said well you can come back to,
us later and no.

Speaker 7 (32:03):
You, Can't, la.

Speaker 1 (32:05):
No you can't because you.

Speaker 2 (32:06):
Sign.

Speaker 1 (32:07):
Off, yes yeah good for you.

Speaker 8 (32:10):
For.

Speaker 1 (32:10):
Calling no you just, say no.

Speaker 2 (32:14):
And if you, have to you go to arbitration because
there is an arbitration clause in your insurance policy that
says that, that says if there is a dispute between
you and your, insurance company you have the right to go.
To arbitration you go to arbitration and you're going to
show they're going to say ten thousand dollars because of.
The adjuster what a shocker that, their adjuster the insurance

(32:36):
company that's going to write, a check is going to
under report the actual cost and you're going to come
In with wait, a minute here's fifty thousand from, another
CONTRACTOR and i would get two or three.

Speaker 1 (32:47):
Other, bids also three.

Speaker 3 (32:49):
Other, bids yes you get two or three other.

Speaker 11 (32:51):
Bids, with Them and i've had them for the last.

Speaker 1 (32:55):
Twenty years, Nobody, cares riina. Nobody cares these people. Don't
care you can have them for the last two. Hundred
year they. Don't, care.

Speaker 5 (33:02):
Well thank you for, all right you?

Speaker 1 (33:03):
Got, it yes she called before she. Did it Good
for rena because. USUALLY is i accepted the. Check bill
now WHAT do? I? Do? Nothing Uh? Mary, Bell Hello, mary, Bell,
welcome hi.

Speaker 12 (33:23):
GOOD morning i. Feel, okay, SO yes i filled out
HOW do i start as a lower level? Government agency
something was said to me and a very specific characteristic
of age was brought up, against ME and i did
speak with. HIGHER management i was given a form to

(33:47):
fill OUT if i wanted to file through THE. HR
eeoc i still. HAVE it i haven't. DONE anything i
contacted THE state. Eeoc division the woman on the, phone said,
oh my she sent me a link to file to
fill out and the file. A complaint i'm afraid of

(34:07):
doing all that for fear of losing. My, job yeah.

Speaker 2 (34:10):
IT'S legitimate i mean it's a, legitimate uh, you know
decision or.

Speaker 1 (34:14):
Legitimate fear so uh age?

Speaker 2 (34:17):
Was mentioned what happened to you as a result of
that age or was it just thrown? Out there were
you denied? A promotion were? You transferred?

Speaker 8 (34:26):
What?

Speaker 12 (34:26):
HAPPENED no i feel like they're treating me with kids' clubs.

Speaker 1 (34:32):
Right now they're treating you with. Kids, clubs yeah.

Speaker 12 (34:36):
That's GOOD whatever, i want.

Speaker 1 (34:37):
That's good so what's? Your QUESTION.

Speaker 3 (34:42):
If i?

Speaker 12 (34:42):
Do anything will that because they had me sign and
this was very strange, for me did non retaliatory a
non retaliatory FORM that i would not retaliate? Against, anyone, okay.

Speaker 2 (34:57):
Well filing a complaint for or misdeeds in a governmental
agency is.

Speaker 1 (35:02):
Not retaliatory.

Speaker 2 (35:06):
So and if they're treating you with kids gloves, Right Now,
mary bell then they think there's some kind. Of liability
just enjoy being treated with? Kids gloves what do?

Speaker 1 (35:16):
You care just, leave it just leave, it alone leave.

Speaker 2 (35:21):
It, alone, no, no no because here's. What happens you
file and you get people that are not going to
treat you with.

Speaker 1 (35:31):
Kids gloves.

Speaker 2 (35:34):
They're buying into they're now buying into a bureaucratic mess
that you put them into you may, be right but
they're going to have to deal with those consequences whatever
they did. To you and if they basically admit they're
doing something new without admitting it, by teaching by treating
you with, kids gloves just sit back and, Enjoy.

Speaker 12 (35:54):
It okay so just hold on.

Speaker 8 (35:58):
TO it.

Speaker 2 (35:58):
I would, i will and sort of wave it, in
there just hi and just, wave it, you know every
once in, a while and just watch out For the
you do have to look At the statute of limitations
on that because when you're dealing with complaining with the,
governmental agency you have to be very careful because if
it turns out you're one day late and then they
start treating you like crap then.

Speaker 1 (36:22):
And so it's, four days, it's not it's not what.

Speaker 12 (36:28):
It's not three hundred and sixty. FIVE days i think
it's three, Hundred, days okay whatever.

Speaker 2 (36:31):
It is so as you approach three, hundred days you
may want to talk to a discrimination attorney and see
what happens an employment.

Speaker 1 (36:39):
Discrimination attorney, but yeah.

Speaker 2 (36:43):
All right let me spend a minute or TWO and
i talk a lot about what's. Going on and you
go to, the internet you go online to, Find, Information
