Morning Show. In ninety seventy five, AMoD man wielding machete disrupts graduation party.
This happened in Michigan, where afamily is celebrating a graduation and about
two o'clock in the afternoon at theGreen Township Hall, a man with a

machete shattered the glass of the frontdoor to the hall with his machete police
said, and opened the side doorto make his way inside, where the
graduation party was underway. That's whenhe started waving his machete and making statements
like everyone is going to hell.Three attendees used a chair to push the

man out of the building. Heleft before law enforcement arrived, but it
wasn't long before other authorities found him. The man drove onto the lawn of
the Macosta County Sheriff's office, wherea corrections officer started talking to him,
and at that point, the manthreatened the officer with the machete. Then
other law enforcement arrived to help calmdown the scene. Police were able to

subdue him without any injuries. Heis now sitting in jail pending multiple felony
charges. Thankfully, no one wasinjured in either of the incidentss special thanks
to the Micosta County Central Dispatchers andall involved agencies who worked diligently to bring

his way back and that's when Trooper'sgot a hold of and pulled him over.

when he stole the bus, andhe's he's getting charged with grand theft auto

it from a global perspective as welltoo. I mean, if you if
you've got an estate, a maritalestate, that is we're I'm just making
easy round numbers here. That's wortha million dollars and these party are going

that individual depending upon how that fivehundred thousand is broken up? Is it

it stocks, is at bond?Is it for one k? Is it
cash? Whatever it may be?Is it equity in the home? You
know, all that kind of stuff. The judge has to look at that
in addition to figure out, well, is there truly a need here for
getting a large chunk of stuff inthe marital settlement or the metal your marital
half? So will she get money? You know, I don't know the

reason I'd be I say that isbecause it all depends. Every case is
different number one and number two.You know, it would depend on how
much money she's making. You know, how long has she been working?
How much does she make? Haveyou guys been separated, If you've been

she's been living on her own justfine. I mean, there's a lot

it just it really is dependent uponthe people as far as the word amicable
is what it means simply because youknow, the parties involved in the case
have complete control over how nice it'sgoing to be, how hateful it's going
to be, how long it takes, how many motions have to be filed.

You know, all these things arecontrolled by the parties, not by
the attorneys. So you know,if you have any questions whatsoever, you

they're better off as friends and it'sthe best thing for their kids, and
they're they're they're fine getting out ofthe situation. But that's not the norm.

isn't. So you know, don'tyou know, if you can settle it

amicably, great, perfect, we'lldraft up the paperwork and make it happen.
But you know, again, amicablesonly as long as it lasts,
and only as long as the twoparties can get along, which could turn

as Native American but they didn't addressthat to the court. Is that what
happens then nothing, simply because thenthe tribes don't get involved in fraternity cases
and divorces the only times the tribes, I mean, what needs to if
you want to correct the record andmake it one hundred percent correct, and

a mended petition or something needs tobe filed with the court that notifies the
court of the child is of NativeAmerican heritage, but that no request has
been made to remove the children fromthe parents by the tribe. Again,
the tribes only get involved in guardianships, adoptions, juvenile cases. Anytime the
child is going to be involved insomething other than a divorce or paternity case,

they'll get involved in. But whenyou're dealing with just a divorce or
paternity it doesn't matter per se becausethey won't get involved and you don't have

have guardianship of my stepdaughter and custodyof my biological daughter. Am I supposed
to be getting child support for bothchildren. The answer would be yes,
and that should have been addressed inboth courts. I would need the individual
please call me un let's walk itthrough and see what's going on. But
typically whenever you've got a case likethat. Whenever custody has been granted in

whatever form or fashion, child supportis supposed to be taking care of them
as well. And in a guardianshipit's required under law for the guardian to
seek child support. Now, let'stalk about the guardianship for a little bit
more. Typically, what happens ina guardianship and child support is is that
you're supposed to contact DHS and Ihope you're listening, whoever, citizen contact

(01:47:14):
DHS and open up a case andthen they will work on collecting child support
from the biological parent at that pointor the other parent at that point.
So that's how you do it.There used to be a thing where the
counties would assign a certain amount ofchild support to be owed. Not all
counties do that, and it's noteven done in the small counties much anymore.
So you need to contact DHS andopen a case and they can start

(01:47:39):
collecting against the other parent and theguardianship. Additionally, you would probably want
to go ahead and open a casefor the biological child as well so they
can start collecting. They can pullany court records to see if there's any
child support in place, and ifnot, then they can start a child
support collection and enforcement action themselves.You know, that's one way to do

(01:48:00):
it. You could also give usa call. We can walk you through
every inch of that as well too. There was a little bit more in
that text that I intentionally left offbecause I wanted to follow up with it,
and it says when I tried talkingto my ex about child support,
all I was told by them wasover my dead body. I'm sorry,
over your dead body. So youknow, first of all, child support

is required, as we all knowthat of those of us that have kids,
and maybe those that don't, childrencost money. Okay, You've got
to feed them, clothe them,take them to school, pay for their
school supplies or activity. It's anendeavor to say the least. So child
support is required in any in allcases, okay, especially in guardianship cases.
It's required under the law. Samething with the wars is and maternity

cases. As far as over hisdead body, you know, that's a
threat. He can take that howeverhe wants. If he feels threatened,
he could probably go get a protectiveorder against her for her threat to harm

she may have screwed up and shedoesn't like it and she hates him,

talk about the reason you asked,how long the felony and what kind
of felony? Do certain felonies makedifferent answers? Well, they do.
I mean, if you've got aviolent felony, the chances of being a
guardian or next to zero. Ifit's a you know, felony like a
drug charge or you know, potentiallylike an auto theft charge or something,

there is a possibility that would allowyou to be a guardian. It's really
just based upon a case by casebasis, and as far as age is
concerned, you know, obviously theolder of the felony the better. I
had a case one time where Irepresented a client who had a felony from
thirty five years ago. That wasfor a car accident thing down in Texas.

(01:53:47):
It was some weird felony charge thatTexas had at the time, but
it was thirty five years old,and you know, the judge allowed the
guardianship because of you know, timehad passed and he hadn't had any other
charges become a model citizen and allthose kind of things. So you know,
the type of charge matters as wellas the amount of time matters absolutely,

(01:54:09):
And does treatment he mentioned this person, this individual was in treatment.
Does treatment ever play a factor inguardianships? Well, I mean potentially,
I mean, if she is intreatment, becoming a guardian over somebody might
not be appropriate at that particular point. But I need again, it's all

(01:54:29):
based on how much treatment does shehave left she get ready to finish up?
Is she you know, are theygetting ready to release her? I
mean where is she in her treatment? That is the big condition there.
But typically if somebody is in atreatment program, and especially if they're doing
it under a requirement of a criminalcourt, that may preclude them from being

(01:54:50):
a guardian at that time, butthat doesn't mean they couldn't serve down the
road. So you know, thisis really one of those situations where the
famous lawyer asks answer, is itreally does depend all the factors involved here
a little detail, But being intreatment doesn't mean you can't. It just
means, hey, we may needto lay it because at this time it

(01:55:10):
may not be best for everyone.Correct, that's a possibility. Absolutely,
yeah, that makes complete sense.This says we've been married for twenty years.
How will our stuff get divided betweenthe two of us? We have
no kids but have a lot ofassets assets. Is it as simple as
you get this, I get that, or does the judge pick? Well?
So, you know, typically wetry, first of all, in
Oklahoma, it's based upon the equitabledivision of the assets. And equitable and

Oklahoma typically means fifty to fifty allright, it's typically how that's handled it.
As far as dividing stuff up,you know, we always want people
to be involved in that decision making. In other words, if the two
parties can decide who gets what andnot fight over it and not have to
get the court involved, that's betterfor everybody involved. Not just because it

(01:55:55):
keeps anger and things like that atBay, it keeps cost down, eats
them out of the court system.And that's why we do things like mediation
and settlement conferences where we can tryand work with the parties to try and
help them reach an agreement of dividingthings up. It is always better for
the parties to handle those things ifthey can, simply because it puts them

in the driver's seed, as opposedto leaving it up to a judge who's
in a black bathroom, who knowsnothing about the parties and has to make
life altering decisions based upon a fewhours of testimony. So it is always
always better when the parties can makethose decisions or be helped to make those
decisions, as opposed to leaving itup to a judge. Every divorce is

uniquely different, Every guardianship is uniquelydifferent. Every adoption is uniquely different.

in law with the lethal dose ofheroin. God well, that's crazy.
Yeah. Came to light this monthwhen a woman came forward to the FBI

saying her neighbor and her sisters wantedthe husband of one of them dead.
The informant said that one of thewomen told her that her son in law
had assaulted their daughter and that theirchildren and drugged her, forcing her to
have sex with others. According tocourt documents, oh that's crazy. One

of the women allegedly drove with themto Louisiana to show there would be killer
the home of the intended target,passing by the location several times. They
told the woman that their target wasa drug user and they wanted her to
inject him with a lethal dose ofheroin. They also allegedly said that they
did not care if she had toslit his throat as long as she got

the job done. Oh that's crazy. They told her they had already paid
someone ten thousand dollars for the murder, but he ran off with the money.
The woman agreed to the plan,but demanded more money. Court documents
say that she got three hundred andfifty dollars in cash for the heroin after
she allegedly paid for the would bekiller's sick dog veterinarian bill in February.

heroine paid for the guys vet bill. Woman agreed to the plan, but
demanded more money. According to courtdocument YEA, they gave her a three

paid for my vet bill first.On a second trip, one of the
women allegedly wanted the woman to murderthe intended target outside a courthouse where he

killer refused the request, saying it'sdaylight and there were too many cameras.
After the trip, they allegedly deliveredthe woman a box with Christmas decorations.
At the bottom of the box wasa nine millimeter Phoenix Arms handgun with an

person who carries a lot of baggageas far as prior criminal history according to

woman stabbed her boyfriend and severed hispenis, gave it might be pro from

in Colorado's accused of killing her boyfriend, stabbing him and cutting off his penis
following an argument over whether or nothe was the father of the child.
The woman was taken into custody onTuesday and charged with one count's second degree
murder while in the heat of passionand one count of domestic violence. According
to the Police Department, officers atabout eight point fifty at night on the

fourteenth, responded to a call regardan unresponsive mail at a hotel about two
hundred and forty miles west of Denver. Upon arriving at the scene, first
responders said they located the male victim, who was suffering from an apparent knife

the investigation. Through the investigation,a suspect was identified. Thirty two year

in the leg, she cut offhis penis. After the violent attack,
she reportedly said that she left thehotel and went to a nearby park market,
claiming that he did not seem tobe in any pain. There,
she purchased supplies, including rubbing alcohol, antibiotics, and beer. She concealed

that she forgot to buy any bandagesfor the victim's injuries. Later that day,
the victim told her that he feltcold and thought he might die.

was off duty, thought he heardanother voice. He then asked to be
let out of the car, butthe driver kept driving. When the man
that's the former police officer, triedto open the door, it would not
open. After that, he reachedinto the back seat. The driver reached

fired his gun three times, sittingthe driver in the head. Oh god.
He broke a window and got outof the car, according to Affidavid,
A witness said that he waved herdown for help and told her he
