Marion "Pooch" Hall is facing some serious jail time.

The Ray Donovan actor was criminally charged with felony child abuse and DUI on Wednesday (October 24) after allegedly endangering his child earlier this month, TMZ reports.

Pooch, who is also known for his starring role on The Game, was arrested on October 3 after a witness allegedly saw him driving with his two-year-old son on his lap in Burbank, California. Witnesses reported that they saw a man weaving in and out of traffic while a small child held the vehicle's steering wheel. The car eventually veered off the road and smashed into a parked car. Fortunately, no injuries were reported.

After police arrived at the scene, they reportedly smelled a strong odor of alcohol and observed that Pooch could barely walk. They then tested the 41-year-old actor's blood and alcohol level and found it was more than three times the legal limit. He was subsequently cuffed and sent to jail while his son was released into his wife's custody.

“Mr. Hall displayed obvious signs of alcohol intoxication and was unable to perform standardized field sobriety tests,” a Burbank Police Department spokesperson told People after the incident. “Mr. Hall’s 2-year-old son was riding in the car with him at the time of the collision and was determined to have been riding in the vehicle unrestrained, as required by law.”

Pooch is scheduled to make a court appearance on Thursday (October 25).  He faces a maximum of six years in state prison if convicted.
