A 25-year-old man accused of assaulting a woman unprovoked on the Miami Metromover may remain out of jail on bond, according to Local 10 on Wednesday (September 30).

A Miami-Dade judge ruled that the suspect, Joshua King, must undergo mental evaluations if he is to stay out of jail.

King, 25, was arrested and charged with assault for allegedly attacking Andrea Puerta and possibly two others on September 4. Surveillance video shows the suspect beating on Puerta relentlessly and even throwing her against the other side of the car.

Reports show King had a full magazine for a Glock handgun on his person when he was arrested, but authorities didn't find a firearm.

People were outraged when they heard King was released on a $1,500 following his arrest. The judge cited King's lack of criminal history as a factor in the bond's amount.

“Even if a crime is committed on videotape, the defendant is presumed innocent,” Judge Alberto Milian said. “And unless it’s one of the numerated offenses by statute, they are entitled to bond.”

Local 10 reported King was involuntarily hospitalized in Delray Beach after the incident. After media coverage of the attacks, his family drove to Miami to bond King out of jail and bring him back to Tallahassee.

"King from Tallahassee and did not let anyone from his family know he was going to Miami... They had him hospitalized in Delray Beach due to the danger he posed," according to the website. They added that the suspect is back home in Tallahassee.

King's attorney said the 25-year-old is becoming aware of his actions and taking full responsibility. His next hearing is scheduled to be held in two weeks.
