A San Antonio man decided to drop his lawsuit against H-E-B.
Joe Albert Lopez accused a H-E-B cashier of hitting him with an English cucumber in 2019. According to the original complaint, Lopez was in the checkout lane when he asked the cashier if she scanned the green veggie twice.
The cashier then “grabbed the cucumber and whacked his right hand with it. She did so with great force. The cucumber (which is covered in plastic shrink wrap) ruptured and pieces flew all over the place.”
The grocery store employee "insisted it was (Lopez’s) ‘fault’ for questioning her about properly scanning the groceries,” the San Antonio Express News reported.
Lopez was originally asking for damages ranging from $200,000 to $1 million, but he dropped the suit in February.
This isn't the only time that H-E-B has been sued for strange grocery related injuries. Another San Antonio man sued the store chain and Coca-Cola after a glass coke bottle “suddenly, violently, and without warning, exploded" in 2018.
