This site or application is owned or managed by iHeartMedia, Inc. and its affiliates and subsidiaries ("iHeartMedia", "we", "us", or "our"). This Privacy Notice covers personal information we process about you, including via our websites, mobile applications (“Apps”), and interactive features (collectively, the “Services”). This Privacy Notice covers users and customers of the iHeart Companies including, for example, when you visit or use our Services, listen to our radio stations, interact with our advertisements, interact with us through social media, participate in consumer research, promotions, contests, or otherwise access or use one of our Services. This Privacy Notice also applies to personal information we collect about individuals with whom we have a business relationship. 

2. INFORMATION WE COLLECT ON OUR PLATFORMS

Information You Provide To Us 

We may collect Personal Information (information that can be used to identify you as an individual) such as your name, email, telephone number, home address, demographic information (such as marital status, age and gender), location information, or payment information (such as account or credit card number).  

We may also collect other Personal Information, such as your photos or videos when you choose to submit them to us, and your voice when you contact our customer service centres, call into our radio programs, or affirmatively activate voice controls on your device. The types of Personal Information we collect may vary depending on your use of the features of the Platforms.  For example, we post customer testimonials/video testimonials on our Platforms which may contain Personal Information but will obtain your consent via email prior to posting your name alongside your testimonial. 

If you do not provide us with all of the Personal Information that we collect in order to provide the Services, this might impact our ability to provide you with our Services. 

 

Information We Collect Automatically 

Usage Information: Whenever you visit or interact with the Platforms, we, as well as any third-party advertisers and/or service providers, may use a variety of technologies that automatically or passively collect information about how the Platforms are accessed and used (“Usage Information”). Usage Information may include Device Identifiers (as defined below) browser type, device type, operating system, application version, the page served, the time, the preceding page views, and your use of features or applications on the Platforms, such as song history, interaction with friends and group activities. This information helps us keep our Platforms fresh and interesting to our visitors and allows us to tailor content to a visitor’s interests. 

Device Identifier: We automatically collect your IP address or other unique identifier (“Device Identifier”) for the Device (computer, mobile phone, tablet or other device) you use to access the Platforms. A Device Identifier is a number such as AD-ID or IDFA that is assigned to your Device when you access a website or its servers, and our computers identify your Device by its Device Identifier. We may use a Device Identifier to, among other things, administer the Platforms, help diagnose problems with our servers, analyze trends, track users’ web page movements, help identify you and your shopping cart, and gather broad demographic information for aggregate use. 

Location Information: By downloading our App or using the Platform, you acknowledge that we will collect and use your Device location information. We may also collect or infer information about the general location of your Device when you access or use the Platform; or if you choose to turn on your Bluetooth, Wi-Fi or other geolocation functionality when you use the App, subject to your consent, the App may collect, infer, and use more precise geolocation information. We may use and share your coarse location with certain third-parties for analytics, attribution and advertising purposes. 

Cookies; Pixel Tags: The technologies used on the Platforms to collect Usage Information, including Device Identifiers, include but are not limited to: cookies (data files placed on a Device when it is used to visit the Platforms), mobile analytics software and pixel tags (transparent graphic image, sometimes called a web beacon or tracking beacon, placed on a web page or in an email, which indicates that a page or email has been viewed). Cookies may also be used to associate you with social networking sites like Facebook and X and, if you so choose, enable interaction between your activities on the Platforms and your activities on such social networking sites. We, or our vendors and third party partners, may place cookies or similar files on your Device for security purposes, to facilitate site navigation and to personalize your experience while visiting our Platforms (such as allowing us to select which ads or offers are most likely to appeal to you, based on your interests, preferences, location, or demographic information), as well as for market research related purposes. A pixel tag may tell your browser to get content from another server. 

We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your Device until you delete them). The types, use, and duration of the cookies used are as follows: 

Type: Session Cookies 

Purpose of Use: 

Session cookies ensure that you are recognized when you move from page to page within the Platforms and that any information you have entered is remembered. For example, session cookies ensure that items placed in a shopping basket don’t disappear by the time you reach the checkout. You can choose to accept session cookies by changing the settings in your browser. 

Duration: Session Cookies expire once you close your web browser 

Type: Persistent Cookies, including Language Recall Cookie and Login (Remember Me) Cookie 

Purpose of Use: 

Persistent cookies help the Platforms remember your information and settings when you visit them in the future. This results in faster and more convenient access. 

Features of the Platforms made possible by persistent Cookies include authentication, language selection, theme selection, menu preferences, internal site bookmarks or favorites, among others. Cookies may enhance your online experience by saving your preferences while you are visiting a particular site. 

Persistent cookies also allow us to select which of our advertisements or offers are most likely to appeal to you and display them while you are using the Platforms. 

When a visitor logs in to the Platforms and checks the “Remember Me” box on the login page, we use a login cookie to remember a visitor’s login information between sessions, which can be erased by logging out. 

A language preference cookie is created when the user selects a language and allows our Platforms to display content to you in that language automatically in the future. This cookie is reset if the user signs in and asks for a different language. 

Type: Google Analytics 

Purpose of Use: 

The Platforms may make use of Google Analytics, a web traffic analysis product provided by Google, Inc. The analytics package may place cookies on the visitors’ browsers that are necessary as to its proper operation. These cookies are placed by and keyed to domains owned by Google, Inc. and not us.  

Further Cookie Information 

If you would prefer not to accept cookies, most browsers will allow you to: (1) change your browser settings to notify you when you receive a cookie, which lets you choose whether or not to accept it; (2) disable existing cookies by visiting the web page at https://www.networkadvertising.org/choices/ to remove all cookie data set by the Platforms; or (3) set your browser to automatically reject any cookies. However, please be aware that if you disable or reject cookies, some features and services on our Sites may not work properly because we may not be able to recognize and associate you with your Account.

To learn how to change your Device Identifier, please refer to your device’s help menu or other instructions. If you do disable or opt out of receiving cookies or change your Device Identifier, we will honor your request, however, please be aware that some features and services on our Platforms may not work properly because we may not be able to recognize and associate you with your iHeartMedia account(s). In addition, the offers we provide when you visit us may not be as relevant to you or tailored to your interests.

3. HOW WE USE THE INFORMATION WE COLLECT

We use the information we collect about and from you for a variety of business purposes such as to respond to your questions and requests; provide you with access to certain areas and features of the Platforms such as your favorite stations, your musical preferences, songs you have listened to, shared playlists and your interaction with other users; verify your identity; communicate with you about your account and activities on the Platforms and, in our discretion, changes to any iHeartMedia policy; market research, Platform analytics and operations; operate our business; tailor content, advertisements, and offers we serve you; improve the Platforms; comply with legal and licensing obligations; administer our sweepstakes, contests and promotions; for safety and security purposes; draw inference derived from other Personal Information that we have collected; and for purposes disclosed at the time you provide your Personal Information or otherwise with your consent. We may collect location based information about you to provide you with radio stations in your area and to tailor advertisements and offers we serve to you. Under certain circumstances we may share coarse location data with our third party partners for market research and other data analytics related purposes. 

4. SHARING OF INFORMATION

We may share Personal Information and non-Personal Information, such as aggregate data, with third parties. We may also share your information as disclosed at the time you provide your information, as set forth in this Privacy Policy, and in the following circumstances: 

ARN.  We have authorised Australian Radio Network Pty Limited (ACN 065 986 987) (“ARN”) to be the exclusive authorised licensee of iHeartMedia in Australia. We may share any information we have about you, including your Personal Information, with ARN for ARN's own purposes. ARN may also use your information as set forth in their privacy policy which may be found on its website at https://www.arn.com.au/about-us/privacy-policy/

Third Parties.  We may share your Personal Information with third parties that perform functions on our behalf (or on behalf of our partners) such as service providers that host or operate our Platforms, analyze data, process transactions and payments, fulfill orders or provide customer service; advertisers; sponsors or other third parties that participate in or administer our promotions, contests, sweepstakes, surveys or provide marketing or promotional assistance and "powered by" partners or partners in co-branded sites. Your Personal Information and location may also be used by us or shared with our subsidiaries, affiliates, vendors, sponsors, business partners, advertisers advertising networks, advertising servers, and analytics companies or other third parties in connection with marketing, promotional, and other offers, as well as product information, and for such third party’s analytics and market research, advertising, analytics and market research. These advertisers, advertising networks, advertising servers, and analytics companies use various technologies to collect data in order to send (or serve) relevant ads to users on our Platforms, or on platforms or websites operated by third parties. These technologies may include the placement of cookies or web beacons, the use of unique or non-unique personal identifiers, or the use of other technologies on our Platforms, which may be used to track user behavior, to track how our Platforms are being used, to link various devices you may use, build consumer profiles and possibly to serve you more relevant ads. 

Your Agreement To Have Your Personal Information Shared. While on our Platforms, you may have the opportunity to opt-in to receive information and/or marketing offers from someone else or to otherwise consent to the sharing of your information with a third party, including social networking sites such as Facebook or X. If you agree to have your Personal Information shared, your Personal Information will be disclosed to the third party and the Personal Information you disclose will be subject to the privacy policy and business practices of that third party. 

Business Transfers. We may share your Personal Information with other entities and our affiliates primarily for business and operational purposes. In the event that iHeartMedia is involved in a bankruptcy, merger, acquisition, reorganisation or sale of assets, your information may be sold or transferred as part of that transaction. 

Legal Disclosure. We may transfer and disclose your information to third parties to comply with a legal obligation; when we believe in good faith that the law requires it; to verify or enforce our Terms of Use or other applicable policies; to address fraud, security or technical issues; to respond to an emergency; or otherwise to respond to an emergency; or otherwise to protect the rights, safety, or security of us, third parties, visitors to our Platforms or the public. 

Nielsen.  Our Platforms may include Nielsen’s proprietary measurement software which may allow you to contribute to market research. To learn more about the information Nielsen’s software may collect and your choices with regard to it, please visit https://www.nielsen.com/digitalprivacy

5. INFORMATION WE RECEIVE FROM THIRD PARTIES

We may receive information about you from third parties (including to generate insights and inferences about you). For example, if you are on another website and you opt-in to receive information from iHeartMedia, that website will submit to us your email address and other personal information about you so that we may contact you as requested. You may also choose to participate in a third party application or feature (such as one of our Facebook or X applications or a similar application or feature on a third party website) through which you allow us to collect (or the third party to share) information about you, including Usage Information, Device Identifiers, and Personal Information such as lists of your friends, “likes”, comments you have shared, groups and location. Services like Facebook Connect give you the option to post information about your activities on our Platform to your profile page to share with others within your network. In addition, we may receive information about you if other users of a third party website give us access to their profiles and you are one of their “connections” or information about you is otherwise accessible through your “connections’” web page, profile page, or similar page on a social networking or other third party website or interactive service. We may supplement the information we collect about you through the Platforms with such information from third parties (including to generate insights about you) in order to enhance our ability to serve you, to tailor our content to you and/or to offer you relevant advertisements and opportunities to purchase products or services that we believe may be of interest to you. 

6. YOUR PRIVACY RIGHTS

Australian and New Zealand privacy laws provide individuals with the right to request access, right to request correction, right to opt out (if you are based in Australia) and right to complain. If you are based in New Zealand, the Unsolicited Electronic Messages Act 2007 also gives you the right to opt out of electronic commercial messages.  

If you request access to your Personal Information or ask us to correct information about you, we may need to verify your identity. In some circumstances, there may be a valid reason for us to deny your request to access or correct your information. If we do this, we will tell you why. 

Right to Request Correction 

If you wish to modify, verify or seek correction of any of your Personal Information collected through the Platforms, you may (1) correct your registered user information in your account on the Platforms; or (2) submit a request through our webform. Depending on the options you choose, your information will be generally available within the timeframe of your country’s applicable law or sooner. If you request access to your Personal Information or ask us to modify or correct information about you, we may need to verify your identity. In some circumstances, there may be a valid reason for us to deny your request to access or correct your information. If we do this, we will tell you why.  

Right to Request Access 

If you wish to access any of your Personal Information collected through the Platforms, you may (1) log into any registered account on the Platforms to access your account information; or (2) submit a request through our webform. Depending on the options you choose, your information will be generally available within the timeframe of your country’s applicable law or sooner.  

Right to Complain

You have the right to make a complaint.  You may (1) submit it through our webform; or (2) email us at privacy@iheartmedia.com. We will promptly acknowledge the complaint, review the matter, and inform you of our decision. You also have the right to lodge a complaint with:

Right to Opt-Out  

From time to time, we may also use or disclose your Personal Information to tell you about offerings, products and services we think may be of interest to you, but we will stop if you request us to. We may contact you by various means, including by mail, telephone, email, SMS or other electronic means, such as through the App or social media.  

Commercial Electronic Messages 

You may direct us not to provide you with marketing information or offers in newsletters, emails or other commercial electronic communications by: (1) submitting a request through our webform; (2) following the removal instructions in a communication that you may receive (such as clicking the “UNSUBSCRIBE” or similar link in the email); (3) clicking on “Your Privacy Choices” in the footer below; or (4) sending us an email at privacy@iheartmedia.com. Your opt-out request will be processed within 5 days of the date on which we receive it. 

Targeted Advertisements 

We may also use third party ad network providers to help present ads on the Platforms, as well as other service partners to evaluate and provide us with information about the use of the Platforms, viewing of our content and to track and improve ad effectiveness. We, our service providers, and advertising partners may place cookies and similar tracking technologies on your computer or device in or order to collect information about your online web-browsing activities over time and across different websites and online services or mobile applications, in order to serve you ads or other content personalized to your interests. This form of advertising is referred to as Interest Based Advertising (“IBA”).    

You can opt out of receiving targeted advertising through our Platforms by: (1) submitting a request through our webform; (2) using the Global Privacy Control opt-out preference signal; (3) by clicking the “Your Privacy Choices” link in the footer of this webpage; or (4) sending us an email at privacy@iheartmedia.com. If you opt-out, you will continue to receive advertisements, but they may not be as relevant to you. 

7. THIRD PARTY OPT-OUTS

Such providers may also place and access cookies, pixel tags, or similar technologies on your Device to serve you ads or other content personalized to your interests which they infer from your browsing on the Platforms and other sites you have visited. In doing so, the provider collects or has access to non-Personal Information such as your Usage Information. The use of cookies, pixel tags, or similar technologies by these providers is subject to their privacy policies, not ours. 

You may opt out of some network advertising programs that use your information by going to https://optout.aboutads.info.  You can also opt out of being tracked for targeted ads on mobile apps by going to https://youradchoices.com/appchoices. Another way to opt out of targeted ads is by clicking on the Advertising Options Icon featured on certain iHeartMedia ads on third-party websites. When clicked it (1) describes the collection and uses of data gathered at the relevant party website and (2) provides a way for you to opt out of data collection and use by the other parties listed for the purposes of targeted ads.

Many of our websites use Google Analytics. Information about Google Analytics’ current opt-outs for web is available here. We are not responsible for the efficacy of third party opt out tools.  

Please note that even if you opt out of IBA, you may still see advertisements from us; they just won’t be customized based on your web-browing activities on third-party websites. Please note that we may still track your visits to the Platforms for our own analytics, operations and security purposes.  

Your browser may offer you a "Do Not Track" option setting.  Please note that our Service is not designed to respond to “Do Not Track” settings.  

Third Party Social Media Platforms Have Their Own Privacy Policies and Procedures 

Please note, we do not control certain privacy settings and preferences maintained by our social media partners like Instagram and X. If you wish to make changes to those settings and preferences, you may do so by visiting the settings page of the respective social media site. You may delete your Facebook account and personal information we received from Facebook by following the steps outlined in this help site article

Choices you make are device-specific and browser-specific  

If you use different browsers on your computer, or multiple computers and devices, you will need to opt out of IBA from each browser on each of the computers and devices that you use.  

Voice Data  

Voice control features will only be enabled if you affirmatively activate voice controls by giving us access to the microphone on your device. You can disable our access to your voice data by turning off our access to your microphone on your device at any time by using the operating system settings on your device or by muting your microphone.  Push Notifications  

If you use our Apps, we may send you push notifications from time to time. If you no longer wish to receive push notifications, you can turn them off at the device level in your App settings.   

 Location Information  

We may infer your approximate location when you use the Apps. You can stop the collection of approximate location information at any time by going to the settings feature on your device and changing your preferences. If you do so, certain features of our Apps may no longer function as intended. You also may also uninstall or remove our Apps from your device. 

8. CHILDREN

The Services that link to this Privacy Notice are intended for a general audience and are not geared toward children under 13.  We do not knowingly collect personally identifiable information from anyone under 13 years of age or the equivalent minimum age in the individual's jurisdiction of residence. If we learn that we have collected personally identifiable information from a minor under the applicable age limit, we will take reasonable steps to delete or de-identify that information.

9. SECURITY OF YOUR INFORMATION, ACCESS AND CORRECTION

We take information security seriously and use certain reasonable security measures to help protect your Personal Information. For example, we restrict physical access to our offices, employ firewalls, secure databases, password protect our IT systems, use anti-virus software and use cyber security services. However, no electronic data transmission or storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure or warrant the security of any information you transmit to us. Subject to our obligations under applicable privacy laws, you use the Platforms and provide us with your information at your own risk. 

10. CONSENT TO PROCESSING AND TRANSFER OF INFORMATION

This Site is intended only for individuals residing in Australia and New Zealand and businesses located in Australia and New Zealand.  Although the Site may be accessed from around the world, you should not use it if you do not reside or conduct business in Australia or New Zealand. Given that we are an international business, our use of your information necessarily involves the transmission of data on an international basis. If you are located outside of Australia or New Zealand, please be aware that information we collect may be transferred to and processed in Australia, New Zealand and/or the United States.

11. CHANGES

This Privacy Notice is subject to change at our discretion. We will indicate material and minor changes to the Privacy Notice by updating the effective date at the beginning of this Privacy Notice. We will notify you by email of any material changes.  After notification, your use of our Services after any update to this Privacy Notice will constitute your acceptance of our changes.
