Speaker 1 (00:00):
Boom, shack a laka.

Speaker 2 (00:01):
It's our number two. Our number two is ready for you.
Thumbs up or thumbs down? Does Fernando to tease of
the Padres have a winnable case? He took two million
dollars in return, he had to pay ten percent of
his future earnings. He made it, and so now he's

(00:22):
got to pay thirty some million dollars. He's suing, saying
he was just young and stupid and she shouldn't have
to pay that money. Alex Rodriguez believes the Hall of
Fame could have added five years to Pete Rose's life.
What say you on this outrageous claim by a rod
And if suspended, Race star Wander Franco gets five years

(00:44):
in prison, as is being recommended in the Dominican What
are the chances then he gets another chance at Major
League Baseball. We'll examine that and more right now here,
it is our number two. You have to pay the man,
but you don't want to pay the man. You'd rather
pay your lawyer. Welcome in the beginning of another.

Speaker 1 (01:06):
Hour of the Ben Mahlor Show.

Speaker 2 (01:09):
We are in the air everywhere blathering as we are
in the Hayes Zone. Although he is not on hold
right now, coast to coast, border to border and beyond
on the vast and tremendously powerful microphones of fsre ammating
live from the marbles, So we lose our marbles every

(01:33):
hour on the hour from the Fox Sports Radio studios,
as approved by podcast Spacoli, who says, because he listens
during the day, he doesn't really matter that much. And
I don't know anyone would disagree with him on that.

Speaker 1 (01:46):
Now.

Speaker 2 (01:46):
This portion of the Ben Malor Show made possible in
part by our friends at tire Rack. For over forty years,
Tyraq has been helping customers find the right tires for how,
what and where they drive. Ship fast and free back
by free Road has a perfection of protection with convenient
installation options like mobile tire installation tire rack dot com

(02:08):
the way tire buying should be. So our lead this
hour is from the court room. What kind of the
court room. That's not really getting into the good stuff
right now, But we have a humdinger, humdinger of a
story out of San Diego. The face of the friars

(02:28):
has lawyered up, and we're all about that action, boss,
We're all about that action. A legal battle over over
thirty million dollars. That's pretty good, right, that's get your
bucket of popcoring good. So, if you didn't hear about this,
possibly not. We learned that steroid cheat of the Padres,
Fernando Tatiste junior Fernando Todis junior of the San Diego Padres, Well,

(02:54):
he has filed a high profile legal complaint again, something
called Big League Advance. I remember we talked about this
a couple of years back. Had forgotten about. It wasn't
something that was in the front of my mind.

Speaker 1 (03:09):
So I went back and I looked.

Speaker 2 (03:10):
At some of my notes, and so this is a
group we'll call them BLA Big League Advance.

Speaker 1 (03:17):
It's a coming.

Speaker 2 (03:17):
It offers minor league players upfront payments. You get your
money right now, and in exchange, they are betting that
you're going to make it, and if you make it,
you have to pay them, like they're the Mormon Church.
You have to give them a percentage of your future
earnings in Major League Baseball. Well, Fernando Tatis happened to

(03:41):
make it, and now he owes over thirty million dollars
to these guys because he agreed to a deal back
in twenty seventeen. So Tatise is lawyered up. He'd rather
pay some lawyers than pay the debt that he agreed to.
And he's filed a lawsuit in Superior Court in San

(04:02):
Diego claiming that the BLA organization is exploitive, predatory, and
shamelessly pushing illegal loans to young, vulnerable athletes. He's playing
the naive card from the bottom of the deck. And
they sent out a press release, this is from his
own pr people from the law firm, as I understand it,

(04:24):
saying that this group is picking on economically disadvantaged Latin
American players from Latin American countries.

Speaker 1 (04:31):
So let us discuss the question.

Speaker 2 (04:33):
Thumbs up or thumbs down on Fernando Tite's having a
winnable case?

Speaker 1 (04:40):
Does he have a winnable case?

Speaker 2 (04:42):
So I've got sci Fi wellness retreat and step brothers,
and we will combine all of these things together and
we will play ball, is what we're gonna do.

Speaker 1 (04:54):
We're gonna play ball.

Speaker 2 (04:55):
So at first glance, and I spent several minutes analyzed
seeing the available information that I could find on this lawsuit.
So I am going thumbs down. Now it's not a
winnable case. You can sue anybody for anything at any time.
As part of the greatness of Americas. Why every year
there are roughly sixty thousand new lawyers that passed the

(05:19):
bar in any.

Speaker 1 (05:20):
Given year, sixty thousand.

Speaker 2 (05:23):
And if you've ever been to la I have a
long drive in to the Mothership here, and when I
drive in, I sometimes, when I'm bored, I will count
all of the ambulance chasing lawyers who have billboards on
the side of the road, and I lose count.

Speaker 1 (05:40):
I can't even keep up. There's so many of them.

Speaker 2 (05:42):
But they're pretty much every city I've been to, other
than Santa Barbara because they don't have billboards in Santa Barbara,
so they don't allow that. But back to the point
at hand, So I'm going thumbs down here, this is
a fertilizer situation. To Tease signed a deal with Big
League Advanced when he was eighteen, he was an adult.
He took two million dollars. Now why he would need

(06:06):
to do this? His dad played in the major leagues.
His dad made a lot of money in the major leagues.
In fact, I saw his dad hit two Grand Slams
in the same inning on a Friday night at Dodger Stadium.

Speaker 1 (06:16):
I was a witness to that. It'll never happen again
in baseball. I saw it.

Speaker 2 (06:19):
So his dad made a lot of money in this
steroid era, and you know, like father like son, and
son like father.

Speaker 1 (06:25):
Whatever.

Speaker 2 (06:25):
The kid learned that and he picked up on he's
a steroid cheat. Two but eighteen signs a deal, gets
two million dollars up front, cold hard cash. Now, the
argument was that that helped him train, It gave him
everything he needed. The expenses were all covered, and then
he ended up signing a three hundred and forty million

(06:47):
dollar contract. Steroid sheet Fernando to tease, and now he
wants to cry foul. Now he wants to cry foul.
Playing me dumb. The dumb, dumb, dumb card is what
he's playing, poly is what I say. This was not
some kind of back alley transaction with some shady figure.

(07:07):
And now that the ink has dried, or in this case,
the DOCU sign has been filed away, the checks are
rolling in.

Speaker 1 (07:17):
Cha ching Chi ching chi ching to.

Speaker 2 (07:19):
Tease of the podres wants to pretend that he did
not sign the contract, or he was forced to sign
the contract so he is going sci fi. He's going
to sci fi. Quantum leap is what he's doing here.
It's not just revisionist history. That's one thing in revision
is history. But it's insulting. It's insulting to everyone, right,

(07:41):
you know, every man won't a job, but especially every
young baseball player that took a similar deal. And it
took a similar deal as to Tease, and they didn't
make it. And the way it works, if you don't
make it, you keep the money. You don't have to
worry about it. To Tease, his problem is he made it,

(08:01):
and when you make it, you gotta then pay the
money back. He made it right.

Speaker 1 (08:07):
Most of the.

Speaker 2 (08:08):
Time this company I was reading about the company. Most
of the time they lose because most of the players
that take loans out don't make the big leagues, or
if they make the big leagues, they're there for a
cup of coffee and they're gone and that's it. And
they don't make the big money. When they win, though,
and this is a this is a home run, This
is grand Slam. Obviously for the company. I signed a

(08:28):
three on forty million dollar contract. So they win. And
now the company is supposed to apologize because to Tease
is upset.

Speaker 1 (08:35):
He's got to pay the money.

Speaker 2 (08:37):
What kind of upside down world is that? Now, this
is a significant lawsuit that is involving massive amounts of compensation. Again,
if you're late to the party, to Tease Owes big
League Advance BLA approximately thirty four million, thirty four million.
Because of the agreement, he received two million in exchange

(09:00):
for ten percent of all future Major League Baseball earnings
ten percent. So you did the malor math on that,
and list Ttiz was a young guy. He agreed to
the deal. He was not alone in some cave somewhere
when he agreed to the contract. He did not have
a machete to his neck or a gun to his head.

Speaker 1 (09:21):
It did not happen.

Speaker 2 (09:22):
He had advisors, as I understand from what I read,
he had advisors, He had representation. He also had a
choice take the money or don't take the money. He
took the money, all right. He cashed a check for
two million dollars. And now he wants to rewrite the
terms because he actually made it and he doesn't want
to give up all that money. And I get it.

(09:43):
You don't want to give him money. Don't agree to
the deal man.

Speaker 1 (09:45):
He didn't. He did not bet on himself.

Speaker 2 (09:48):
If he bet on himself, he's I don't need the money,
I'll make more money than that. Screw you.

Speaker 1 (09:54):
He took the money. And you don't get to double dip.

Speaker 2 (09:58):
H No, I mean, you don't get handed a parachute
after you've made it. You've worked your way up at
all that stuff, and then you're gonna sue the guy
the company here. You're gonna sue them who packed the parachute,
if you will, and you just happen to land on
a pile of gold bouyon and you're on your way.

(10:21):
I mean, my god, all right now, page two, turning
to another bizarre story. There is a cosmic event upcoming,
as our cosmic insider likes to tell us, But Alex
Rodriguez has a very interesting theory, very unique theory. A
rod believes that the Hall of Fame could have added

(10:44):
five years to the life of Pete Rose, that the
fact that they waited till Rose dropped dead, that Rose
would have lived another five years if they had put
Rose Pete Rose in the Hall of Fame as he
was alive.

Speaker 1 (10:58):
According to Alex Rodriguez, what say y out all right.

Speaker 2 (11:02):
So, uh, this is another one of those cases where
we have entered the stratosphere of oddball alley.

Speaker 1 (11:11):
It's just oddball. It's just oddball logic is what it is?

Speaker 3 (11:15):
Like?

Speaker 1 (11:15):
What the were up, Jackie Slavery?

Speaker 2 (11:17):
What nowhere up? So a Rod thinks the Hall of Fame,
I guess, is like a wellnessed retreat that you get
into the Hall of Fame in Cooperstown. Just by walking
into the doors of Cooperstown. You suddenly if you have
like clogged arteries, those all get unclogged t da, just
like that.

Speaker 1 (11:36):
No, no clogged arteries. Uh.

Speaker 2 (11:38):
And Doc Mike is there handing out pineapple fruit smoothies
when you walk into the Hall of Fame. Now, using
ben logic on this, if Alex Rodriguez is it believes
this is he not saying that Rob Manford is responsible
for the untimely demise of Pete Rose, that Rob Manford

(11:59):
waited till Pete Rose croaked, till Pete Rose crossed the
pearly gates to give him the opportunity to get in
the Hall of Fame, right to remove the suspension? So
is a Rod not indirectly?

Speaker 1 (12:11):
Am I wrong? I feel like I'm saying the right
thing here.

Speaker 2 (12:13):
Ay Rod says if Rose had gotten into the Hall
of Fame, he'd be living.

Speaker 1 (12:17):
Five years longer.

Speaker 2 (12:18):
And the person that stonewalled Pete Rose was Rob Manford.
So is a Rod not accusing Rob Manford, the Commissioner
of Baseball, of being culpable in the untimely demise of
Pete Rose? That's what it sounds like to me. Is
a Rod also confusing this with some kind of like
make a wish situation?

Speaker 1 (12:36):
Is there?

Speaker 2 (12:37):
Is there some of that going on? Like is a
Rod now a baseball shaman? Is that what he has
become here?

Speaker 1 (12:43):
I don't know. Stay tuned all right?

Speaker 2 (12:45):
Now a final point, we go back back, back back
by we go back to a court case. I love
these court cases and I can't wait for the documentary
to come out. They can't make the documentary because the
story's still going on. So Wonder Franco Remember this guy
that the Rays were doing a promotion for kids and
he was taken out of the lineup because he was

(13:07):
apparently sleeping with a kid. Yeah, so wander Franco of
the race, the face of the Tampa Bay Rays who
had agreed to this massive contract. He's not technically suspended.
He's in the twilight zone. He's on the exemp list,
I guess the baseball version of the exemp list. And
so he's not suspended, he's not been released.

Speaker 1 (13:26):
It's like this weird thing.

Speaker 2 (13:28):
He's in the twilight zone, but he is facing the
legal system in the Dominican Republic. We've learned now that
the prosecutors and the Dominican are seeking a five year
prison sentence for Wander Franco on charges of sexual abuse,
sexual exploitation, and human trafficking of a minor. Now, it

(13:52):
is interesting to know those same prosecutors believe this dyke
Franco apparently was the one stooping the kid. The mom
should go to jail for ten years in prison, the
mom who was the mother of the girl. Now, Wander
Francom if he gets five years in prison. Now, even
if you get five years in prison, you know, I'm

(14:13):
not sure exactly how it works.

Speaker 1 (14:14):
In the Dominican Republic.

Speaker 2 (14:16):
I'm not an expert on their system, but I would
assume it's similar where you're not going to serve all
five years. You get out a little earlier than that.
But let's say he served all five years and he's convicted.
Everything it's going to happen this week on Thursday. So
what are the chances that he gets another opportunity in
Major League Baseball? I assume he got convicted five years.

(14:40):
Everyone agrees. Water Franco goes to the Gray Bar hotel
for five years, do we see him play in Major
League Baseball again? So this is one of those things
where you go down to the airport. It's the step
brothers that are there. The stepbrothers. Now, these step brothers
are named Slim and None, and if you go through
ts right there, you can see that Slim has already

(15:02):
left town. So ix nay on the comeback a. If
Trevor Bauer is not allowed back, why would they allow
Wander Franco.

Speaker 1 (15:11):
Now he is going to be though. If he goes
five years.

Speaker 2 (15:14):
You look at his age right now, he would be
somewhere in the neighborhood of twenty nine or thirty five
years from now. So if he went to jail, and
some of you boys in jail, you tell me that
you can work out a lot in jail. Let's get
your physique, and you're looking good there when you come
out of jail. So with the current mindset of Major
League Baseball, though, I would say forget about it. No
chance he could play somewhere in like the Mexican League,

(15:37):
or he could go somewhere overseas in one of the
leagues in Korea or something like that. They'd find it
way for him to play or whatever. But in Major
League Baseball now, now, five years from now, what is
the world going to be like? I mean, boy, it's
been wild the last fifteen years or so. I can
only imagine what the next, next ten, next five are
going to be like. And it's hard to imagine though,
public perception changing that much.

Speaker 1 (15:59):
And we'll see. But go no, no, xnay on that.

Speaker 2 (16:03):
It is the Ben Mather Show. And if you'd like

like He's, robinhood like he's helping out the other.

Speaker 1 (16:57):
Players i'm sure it has nothing to do with he
wants the thirty.

Speaker 2 (17:00):
Million how much you think he's gonna spend on, lawyers
Because i'm guessing that's a lot of billable, Hours, Right
he's not gonna spend thirty four million on.

Speaker 1 (17:08):
Lawyers but would.

Speaker 2 (17:09):
He spend four million on lawyers and then end up losing,
Anyway so then he's out thirty eight, Million, like how
much do you think he's gonna Spend i'm not a.
