all that good stuff. And letme say good morning, sisters, Good
morning in Unison. Yes, weare thinking today. Monika is using her
skills from when you were in achoir Russ College. Russ College, the
(05:56):
world famous a cappella choir acappella. That's right, we were famous. So
I was not on anybody's choir,so I can't. That's how it did
not know you were. So that'sI was. I was. I was
really in the choir rush as wellas out. Okay, you guys,
we need to get them at therocket chair. We want to see hear
y'all sing. We want to hearto hear y'all sing on face. Yeah,
(06:18):
okay, okay, yeah we didour singing day when when when you
were there, Attorney Monika, whowas the director? You forgotten? I
forgot his It was a it wasa male, say Bannon, But that's
the coach. Coach Bannon was theYah. Yeah, it was the coach.
But you are he was a male. You had a mail director,
yes, okay, yes we did. I can't remember his name though.
(06:41):
Wow. Okay, think I'm youknow Asian? Yeah, yeah, so
that was in nineteen ninety one, nineteen ninety two. Okay, okay,
it's been a minute, it's beena minute. Who is the director when
you were then, it was uhuh Lassie Homes Lassie Home. Yeah.
(07:03):
She was the daughter of Natalie Dotsi, who founded it was found at the
choir. Oh wow, so yeah, the legacy continued, that legacy continue.
But yeah, yeah, I wasthinking, I can't remember, but
wait a Mary, I'm trying tobut you know what I'm trying to.
You were there in ninety one, yes, ma'am. I started in nineteen
(07:26):
ninety Yes, ma'am. I graduatedin ninety four, and I pledged Alpha
Kappa Alpha in nineteen ninety two.I love that place. Well the reason
I did, I did too.I'm saying that because I was there.
Oh really, I was teaching RadioMass Communications Department and RUSS. I taught
at RUSS for seven years sister,Oh, I missed that part I taught.
(07:51):
So you attended, and you areyou just I attended. I graduated
from RUSS, got my bachelor's huh, and came back in. I graduated
in the seventies. Yeah anyway, yeah, right, but I taught to
when they when they first I helpedthem to with that the mass communications department.
(08:11):
Matter of fact, I helped themto get the radio station. I
wrote a proposal for them. Yeah. But I was there in ninety one
because I started started there eighty seven. I'm thinking eighty seven, yeah,
yeah, yeah. The mass communicationprogram was very impressive. Yeah. One
of my best friends was on theradio show. We had a RUSS College.
(08:35):
I had a radio show in aTV station, a TV STA.
Yeah. Another one of my soarswhen she graduated and she was in the
mas com program there as well. She went straight to Chicago for like NBC
News or ANBC News. Yeah.RUSS had a good mass community. Good.
Yeah. And I remember if youremember Kelvin buck Well, I'm gonna
(09:00):
tell you Kevin. I taught Kevin. Kelvin was in my class and then
he was over the television station. Then he became the mayor of Holly Well
before it became the mayor. Hewas became a state representative of Mississippi.
Then when it left there became themayor of Holly Springs. But yeah,
I taught. My last year atRUSS was ninety four. Really, I
(09:24):
cannot believe we missed each other. We missed it because I guess my classes
were at night, Yes, inthe evening. So yeah, but I
taught at Russ College, yes,ma'am, Yes, ma'am. I hate
I missed it. I was anEnglish major, so I didn't take many
of I wish I had taken communication. That's what my degree is in English
(09:45):
literature, yes, ma'am, Yes, ma'am, Yes, ma'am. So
we bear cats, yes, lifefor life. But yeah, we were
in the choir and and I cansay that it was one of the best
experiences I've had in life because Ihad never been to Mississippi in my life,
(10:07):
right, because you were coming fromMichigan. H So you know what
kind of thoughts I had? Yes, yes, I know you did.
And my mother said it's gonna beokay. And I told her, said,
Mama, you know they hang, yes, yeah in Mississippi, you
know, because yeah, no,it was real, but very real.
But one thing, Attorney Ursul, that that I just sticks in my mind
(10:31):
always. Mister Rayford, he wasthe admissions director and when my mother brought
me down there because she's a graduateof RUSS. My mother was a graduator,
and he told my mother we aregoing to take care of her.
Yes, they meant that. Hemeant that, and y'all they took care
(10:54):
of me and rust they took careof me. Attorney Ursula, they took
care of me at RUSS Collins. When he told her that, he said,
don't you worry about nothing. We'regoing to take care of her.
And they took care of me.It's a family is a big fan.
The curfews and all we didn't understand. Yeah, we had a man no
(11:16):
co ed dorms school, yes,a Methodist school, and we had a
curfew. We had a curfew andI met locked out all night. If
you miss her few, well Igot locked out. We have Cora Nachelle
Perry who is watching on Facebook. She is a RUSS site. She said,
(11:37):
I am a graduate of Russ College. So Cora Perry, congratulations and
thank you for joining us and lettingus know that we had to talk about
our little HBCU. I'm an HBCUgirl. You're double a double. You
know what. It's so interesting thatwhen we talk about Russ and I think
about my life, the reason whyI'm in radio. I'll go back to
(12:03):
Rust College because Chuck Holmes, whowas director of development, he called me
in his office. He said,Jackson State has a new mass communications department
and they're going to have a graduatedegree. They're giving away money graduate assistant.
Oh wow, you apply, rightright right? Chuck told me to
(12:26):
apply. I applied. I'm goingto like Jackson. I applied, was
accepted, got a graduate assistance atJackson State University where I started radio.
So there hadn't been for Russ.I rusted to Jackson State. What and
the rest is history is history? How many years you've been in this area
(12:48):
and now you're part of the whatin this in radio Tennessee this year,
this year, it will be fortyeight years radio years? Congratulations? Forty
eight years in radio, y'all hearme? I don't even hear me.
Forty eight years when I was bornis with you decided to get out there?
(13:09):
You know what? Attorney Ursulain turnthem on Nikka, this is all
I know. All I know isradio and teaching. That's the only jobs
I've had, the only radio andteaching besides the job I had in high
school. Well, that's because that'syour gift. Yes, And you're walking
(13:30):
in your purpose. It's more thanjust all that you know, it's where
you're thriving and where you feel comfortable. And when you feel comfortable in a
certain space, why why should youend the party? You just keep it
going and you capitalize on what you'vealready done. But it's no need to
end what's and then look how manylives you touch as a result. You
know. That's why I say whenI taught with seven years at RUSS,
(13:54):
thirty two years at Southwest Tennessee CommunityCollege. Yes, oh wow. So
education, So giving back to thecommunity in one capacity or another has always
been your thing as a matter offes'ton a radio or in a classroom,
right, yes, right. Andyou have integrity and you make sure that
the guests that you bring on,that you invite on are up to part.
(14:15):
Like that's a big thing because ifyou look at some of the radio
and how it has manifested to wherewe are now, it's shameful, you
know. And I'm not just itand I'm not just saying that you can't
have a difference of opinion. Youunderstand, you do not have to agree,
you know, conservative liberal. Thatis not what I'm referring to.
What I'm referring to are the youknow, inaccuracies, the lies, you
(14:37):
know. And we're not even sayingpeople are joking, and you know,
we're saying when you're passing off alie as the truth just to manipulate people,
that is not right. You know, that is not right. You
can have your opinion, and it'sokay to expound on your opinion, but
it is not okay to be untruthful. In order to mention that with with
my listeners, we were talking aboutthat yesterday. It says it's okay to
(14:58):
have an opinion, right, butbut as I said yesterday Tony Ursela,
in my age, now I'm gonnadeal with facts. What's true? Amen?
You know? Amen? Well, okay, you have your opinion.
I have my opinion, but whenit comes down, what's the truth,
what are the facts that's right? That's right? Yeah. So so that
was my so I guess today, soap box, I like that soap box,
(15:22):
my solf. You know, mysoap boxes is really short and sweet
today, okay, and it isLeed Freedom Ring. And when we say
lead freedom Ring, what we're sayingis what I'm trying to share with you
is is about forgiveness. And I'mnot saying forgive another person. I'm talking
about forgiving yourself. There are certaindecisions that you've made in life that have
led you into a certain direction thathas made you less than ideal. You
(15:46):
know that is you have fallen shortof your own expectations. But I want
to say today that you are free. Don't be your own worst hater.
We always want to talk about thosethat are saying this and that and the
other and who posted and there wasa subliminal message. But what are the
messages that you're telling yourself? Whatdo you say to yourself at night when
(16:07):
you get in bed and you know, with your bottle of wine or whatever
it is to soothe your soul forthat evening? What is replaying and ruminating
in your head? Stop the crazyloop? So I want to share with
you all what I have learned.Last week I spent some time away on
vacation and I call it a wellnesstour. I was on a wellness tour
(16:30):
and what I learned I want toshare with you. This is not my
original idea. These are things thatI learned last week. But Number one,
when you wake up in the morningtime, do a body skin how
do you how do you how doesbell fail today? Are you tired?
Are you anxious? Do you feelthat energy coming back up your spot?
How do you feel today? Setyour intention for the day. Oh,
(16:55):
I do feel a little tense today. My intention is to relax and remind
yourself of that, build yourself up. So here's the steps. Number one,
when you lay down, relax thetongue in your mouth. Your tongue
controls your mood in a certain way, right when, right now, if
you're sitting at your desk or ifyou're driving. This is something all of
(17:15):
us can do. If your tongueis at the roof of your mouth,
that means that you're in thinking mode. Immediately, just relax your tongue and
let it lie softly at the bottomof your you know, at the base
of your mouth, do not haveit pressed at the top. Then the
next thing you are to do,if if you can safely do this is
(17:36):
close your eyes. If you're driving, don't do it. But if you
seated, close your eyes and youbegin to listen for at least four sounds.
Do you're not relaxed until you canidentify at least four sounds with your
tongue relaxed. And then once youcan identify those four sounds, take your
time with it. Then for oneminute, two minutes, however, time
(17:59):
you need five minutes. Begin tojust be aware, aware of what you
And when I say aware aware,I'm saying sensory wise, like what do
you feel, what do you hear? What do you smell? It's about
relaxing. You need to do thaton a daily basis, simply to take
a break, and whenever you feelnervous or anxious, or those thoughts begin
(18:19):
to ruminate again, you go backto that. If you're going to take
a sixty second break, if it'sa five minute break, then that is
what we need to do to putourselves in a place in which we can
relax. The next is forgive yourselffor the mistakes that you have made.
Forgive yourself for not being where youthink that you should get bet, Forgive
(18:40):
yourself for spending all of your money. Forgive yourself for taking that man back
ten times when he shouldn't have beentaken back one. Forgive yourself, my
brother, if you know that you'repaying her, and you shouldn't be,
because she got another man and ahusband. Forgive yourself. If you have
put yourself in a position which youhave mistreated the very one that love you.
Forgive your and understand that you haveanother day, another opportunity to do
(19:03):
it over. And if your doit over, it's just simply to forgive
yourself. Then do that. Peoplecannot put you to shame, only you
put yourself to shame. You'll beamazed at how much people are not thinking
about you. Most people think thatit's about them. It's not. It's
about the person who is looking inthe mirror, which is themselves. They
not thinking about what you're wearing, how you're wearing, and where you're doing,
(19:25):
And what they're thinking about is whothey are and what they're doing and
how they're doing it. Stay inyour own lane, fight your own race.
Forgive yourself, and if you cannotforgive yourself, then forgive yourself.
Every time you remember whatever that thingis you did, you may have done
it in high school. Guess what, we are not in high school anymore.
If you're in high school and youdid do it, that was then
today is a different day. Thisis a different moment. If you ride
(19:48):
in the car with your mamma andyou did do what you did this morning
and she fussed at you, takeaccountability, mama, I'm sorry and forgive
yourself. So today I just wantto say left freedom ring hmm. You
are free from your mental slavery. That's a free from the mental slavery.
This is your emancipation day, freeand last, free and last, Thank
(20:10):
God almighty, you are free atlast. I love it. I love
that soapbox. Fabulous attorney. Youknow you always let me just add a
little bit to that. Okay.So as she was talking, it made
me think about this book called ThePower of Now. I don't know if
(20:30):
anybody's ever read that, but it'sthe Power of Now. And you know,
when we really get to the pointwhere we realize that all we really
have is this moment now, rightnow, right that's all me. Walking
out of this door is not promiseto me. You know, yesterday is
gone. So when you really beganto live in the now, then you're
(20:56):
no longer living with the depression andthe regrets and think it, because that's
living in the past. Any Timeyou're wor you know, you're you're,
you're, you're, you're depressed,you're living in the past. When you're
worried and you're anxious, you're livingin the future because you're just already imagining
what may happen or how am Igoing to do this? In the way,
(21:17):
in the worst way possible. Butif you just live in the now
and you breathe, as Attorney Woodssaid, and you realize, you know
that I have everything that I needin this moment right like I am breathing.
Yes I have God has provided.Yes, God has provided, and
(21:37):
his grace is sufficient. Yes,ma'am. Good soap box. Yeah,
I love it. I love it. Well, we're gonna pause when we
come back. We're going to getinto our agenda today, okay. And
if you just tuned in, theladies are here. I love these sisters,
the bad man with jamas. AttorneyUrsula Woods is here, Attorney Monika
(22:00):
Johnson is here. We are talkingwith you all, and get ready to
listen and get ready to talk.Five three, five nine, three four
two eight hundred five zero three ninethree four two eight three three five three
five nine three four two are thenumbers to double d. I A.
(22:47):
We're asking the experts on the BEVJohnson Show only on w D I A
m hm, youde. I hatethe thing. I mean, I'm telling
(23:19):
you everyone I see and talking Yo. Everyone, good morning and welcome back.
We are asking the experts. Theyare Attorney Ursula Woods, Attorney Monika
(23:41):
Johnson. We're going to our phonelines to talk to brother Bernard. Good
morning, brother Bernard, ben ChoundsA good morning to see good morning.
It's you know what, it's apleasure. I had to applaud the ladies.
I had no questions. But whenI heard I was leaving breakfast and
I heard the the ladies elaborating andsharing the insight, uh, and they
(24:08):
sort of reminded me of that storyin the East, and they were talking
about, Uh, those that aresuffering from depression are are are worrying about
the matters of the past, andthose that are under the agony of anxiety
are worried about the unstate of theof the future. And that's that's exactly
(24:33):
right. You know, these thesewomen are sharing some some real knowledge,
some real insight, and so Iapplawed them and I just encouraged them to
keep on going and uh and pushingforward and uh, thank you miss Johnson
for having them on and and y'allladies don't stop, keep on keeping on
and uh and sure they word thankyou, Brother Bernard. Yes, we
(24:57):
really areciate them. Yeah we do. We need the encouragement. Sometimes we
need the you know, the highfive, because you never know if what
you're saying is landing where it needsto be. So thank you for sharing,
Brother Brenard. All right, allright, ladies, let's start today.
How are we rocking and rolling? How are we rocking and rolling?
So today I realized that it's taxseason and individuals are trying to catch up
(25:22):
on bills, and I want toalso talk to a certain sector of individuals
who if you're in the housing market, a real estate agent and an appraiser,
a loan officer. Twenty twenty threewas not the best of times for
us. So I want to talkto that particular sector of individuals because you
know, of course I'm writing,I'm right here with you, I'm in
the trenches. I'm a real estateattorney. That's what I that's where I
(25:45):
started practicing was in real estate, and the finances are tough. So because
of that that marketing, that sectorhas gone down, went down in twenty
twenty three. That means that hairstyleis bid, braid, olig just you
know, nail tags, grocery.Everyone has suffered as a result. And
I want to tell you just becauseyou did great yesterday does not mean that
(26:10):
you're going to be great tomorrow. But it also doesn't mean that you're going
to be horrible the day after. So let's just sit with what has happened.
Has happened financially, if you've lostyour job, or if you're in
a position in which your income isless than what is needed in order to
meet the bills, we need tostart thinking about how are we going to
get out of the hole. Whenis it time to say enough is enough?
(26:36):
When is it time for you tobegin to realize that you cannot continue
to pay good money after bad Sometimesbankruptcy is the option. Sometimes bankruptcy is
the answer, other times budgeting isthe answer. Another time it may be
time for you to get a job. There is no shame in increasing your
(26:56):
income and shifting careers. I haveadded to my practice from real estate to
bankruptcy to personal injury. And nowI have a partner, Monique is doing
a state planning. We all havemultiple streams of income between all of us,
(27:17):
including BEV, and as a resultof that, we're trying to do
what not only survive, but thrive. So if you find yourself in a
situation in which your ends are notcoming up, you are coming up short,
bankruptcy may be an option. Okay, what is bankruptcy? Eersly,
I hear you talking about it.What is it? You have two types,
a chapter seven and a chapter thirteen. That's the only ones we're talking
(27:37):
about. Chapter seven is complete bankruptcy. You can become debt free. It
doesn't take but ninety days. It'seasy. Give me a call nine O
one five four to one help, ask for the BEV Johnson Special five four
to one, four three five sevenAsk for the BEV Johnson Special. We'll
make an appointment for free and wewill talk about how you become debt free.
We can get rid of your IRS, tax lien, we can get
(28:00):
rid of any old car repossessions, foreclosures, all of that can be wiped
out and eliminated. Medical bills.Yeah. See, you don't have to
sit with that. Huh huh.You can go on and rest well at
night. All the anxiety we weretalking about because you're worried about the future,
you can go into your future deadfree. See, twenty twenty four
(28:22):
can really be the year that youstart fresh because you can wipe out all
your debt. Why is now thebetter time because you don't not have any
money? Yeah, I mean youknow, let's just be you hadn't made
any See, we look at thelast six months of your income, and
the last six months been rough. So before we go into twenty twenty four,
(28:42):
when you're making your millions again, when and why don't we just wipe
out all that debt. Let's getrid of it, give yourself peace of
mind. A friend of mine herecently saw a friend of his who was
really depressed because his wife had overthree hundred thousand dollars in debt, in
student loan debt. And guess whatbecause of the program that Obama. I'm
(29:04):
telling you people debt free because ofthis student loan. So, Monica,
you want to elaborate if you,and I don't want to put you on
the spell, But how they canbegin that process. Well, I'm not
quite sure how you begin the process, but I can, but I can't
tell you. And I want togive my own personal testimon you know,
(29:27):
just just chime in here for amoment in full transparency. I too,
like many Americans, including our formerPresident Obama, when they went into the
office, I had some student loandebt. The majority of my students that
(29:48):
I've carried with me for years now, you know, making those minimum payments
and doing the things that you knowyou're required to do. The majority of
my debt was so that I couldsend my children to college quite frankly,
parent plus loans. And I wokeup one day, you know, just
(30:08):
I want everybody to know that thisstudent loan debt cancelation that the Biden administration
is currently undertaking is real. Itis happening. Let's pause. It is
really. I know somebody who gotthree hundred thousand dollars of their student loan
debt was forgiving, meaning they nolonger have that debt. It's and I
(30:33):
am a living testimony as well.In fact, I didn't believe it.
I screenshoted my letter that I sawin the email, and I sent it
to my best friend Urth, Isaid, can you believe this, my
student? You know, it's somethingI have been praying about the things that
we're telling you about. I hada budget, a plan, a payment
plan for you know, when Iwould have all of this paid off.
(30:56):
But for many families it has becomea huge, huge burden. You know,
we were told to get an education, and for a lot of us,
you know, our parents weren't welloff and couldn't necessarily afford that education,
and so we borrowed. You're talkingabout an eighteen year old, a
nineteen year old borrowing hundreds of thousandsof dollars, you know, and that
(31:21):
being like a weight on their neckas they moved through life. I'm a
witness. I woke up one morningI had an email from the student loan
people. I did not think itwas real because I had not applied,
you know, for anything. Iread it, then I went into my
student loan portal to verify and checkit again. I checked it again and
(31:44):
sure enough, my student loan debtwas canceled. So as she's talking about
bankruptcy, another if you have thatstudent that heavy student loan debt, another
thing you need to do is dothe research on this program that the Biden
administration has. If you haven't alreadybeen contacted, perhaps you should contact them
(32:06):
to see if you up eligible, are eligible for the cancelation or at least
a portion of it. Now Ididn't get full cancelation, you know,
full transparency, but enough of itwas canceled that I'm good. Yeah,
you know, and these are thingsthat can change your life. I was
reading about another young woman who gotthe same email. She's been you know,
(32:28):
she works in the government sector, she went to school, she's been
paying her student loans back I don'tknow, ten fifteen years and just a
little frustrated hadn't been able to buya home because she has this heavy student
loan debt. And she woke upand she had heard all of her debt
cleared, it was canceled, andshe was given the testimony about now how
(32:51):
her income to debt ratio has changedand now she can afford to buy a
house. That's how big of adeal this is with the student loan debt
cancelation. Yeah. So, eventhough you're in a financial hardship, what
we're sharing with you really is youhave resources, you have options, don't
be so depressed, are so anxiousabout the future that you can't be present
(33:15):
today to solve your problem. That'sif you can lay in that bed and
worry all night, you can openup that phone, go into your email
Google. I'm not Google, butyou know, put in that search bar
your student loan and you can findout if you got the email. And
if you don't have the email, then you call the student loan office and
find out if you can get appliedto get your student loan debt forgiven.
(33:38):
Because bankruptcy does not eliminate student loandebt, okay INNY and of itself,
all right, you can get youcan bankrupt student loan debt, but as
a very high bar you have andjust to explain, you have to have
a medical condition that is so seriousthat you can no longer use your degree.
(33:59):
So what I'm I'm talking about assomebody who's a paraplegic who cannot work,
you know, then yes, bankruptcywill work in that particular situation.
But if you're an able bodied individual, or if you just have a partial
disability but you can still walk talk, you know, no, the government
is not going to forgive it becauseof that. But you do have options.
But what I am sharing with youis I don't want anyone within the
(34:22):
sound of my voice to put themselvesin a position in which they think that
they don't have a way out becauseof financial debt. No. Chapter seven
bankruptcy will wipe out everything. Now, Chapter thirteen, there's a Chapter thirteen
wage earner. Chapter thirteen wage earner. What that will do is for my
brothers who owe child support. Thatwill allow you to continue to work,
(34:42):
have your driving license, be ableto get your driving record clear, and
yes, Chapter thirteen bankruptcy wage earnerwill help with that. We can bankrupt
child support under Chapter thirteen. Butwhat that means is you will be on
a payment plan to repay it.Will not be forgiven, it will not
be wiped out, but it willallow you to be on a payment plan
(35:02):
to repay it and still maintain yourdriver license and maintain your ability to have
an income, yet be able topay your child support under a structured order.
It'll all under Chapter thirteen. Ifyou're facing foreclosure, it'll stop that
foreclosure in its track. If you'refacing a repossession, it will stop the
(35:24):
repossession in its track, and you'llbe able to retain your vehicle. If
you're looking at eviction because you're renting, it will stop the eviction because you'll
be able to stay inside of yourapartment. So if you're facing any type
of life issues in which you wantto stay in the car, stay in
the house, then you would goto chapter thirteen. Route. If I've
(35:45):
said a lot and you're like urslain, I can't keep up, I have
one quick question, give me acall, Yes, ma'am. The question
is, and we've had a fewpeople call about this. Can you bankrupt
alimony? No? Not, Yes, it's a cord order, and it's
a great it's a great question.It's a cord order, to be honest
(36:07):
with you, it depends. Butjust give us a call and we will
see. More than likely we willnot. But it depends because that's a
cord order, and it depends uponwhat your court order says. And I
don't want to usurp that process, and I'm not about to go against the
judge right who is given that toyou. But that's a great question.
Great question. We are off toa good start, ladies. We are
(36:28):

(38:04):
A. We are asking the expertstoday. Our experts are attorney Ursula Woods
and Monica Johnson. But before wecontinue to talk, y'all, no,
let's see, it's lunchtime. It'slunchtime. Are you feeling a little hungry?
I know you are. Are youfeeling a little hungry for some southern

(39:13):

yam, some greens, macaroni andcheese, and cabbage and green beans and
northern beans and spaghetti. That's today. That's today. So if you are
hungry, let me tell you.We know we rock at the Rocking Cheer,
but they rock on soul food too. Now, if y'all hungry,
(39:36):
y'all need to get on over therein Soulsville. Yes, it's Soulsville fifteen.
Let me give you their address rightnow, So fifteen forty two Elvis

(39:58):

my favorite beverage as well, mylittle margaritas. Ye. But y'all,
I'm telling you, Miss Ann iscooking the food at the Rocking Chair.
So today say I'm gonna go toa new place for lunch, and I'm
(40:19):
gonna support my folks. So supportthe brothers over there at the Rocking Cheer
today. Today catfish baked, thefried chicken, fried or smothered pork chops,
turkey necks. Yeah, they gotturkey necks, buffalo fish, yams,
greens, macaroni and keys, cabbage, green beans, northern beans,
spaghetti and corn bread too. Sohead over to my favorite place. You're
(40:44):
not the only rock with good entertainment. They rock with good soul food too.
Tell them Bev Johnson sent you tothe Rocking Cheer. It is located
fifteen forty two Elvis Presley. Lunchis going on now until four PN.
So I'm gonna ask y'all check outthe Rocking Chair, my new favorite place,
(41:05):
ladies, y'all hungry? Yes,oh my god, yes, so
y'all have to so one day forlunch, y'all have over there to the
rocket absolutely turkey necks. Oh yeah, they have some turkey decks. Okay,
the bombay miss and be cooking.I can't wait at the rocket chair.
We were talking about bankruptcy Attorney Earthen, and I want to go back
(41:28):
to something. I want to beclear on something you said. Could you
say you could bank rub i RSdebt? You can. You can bankrupt
the Internal Revenue Service under your Chapterseven bankruptcy, even though there're Chapter thirteen.
You can be on a repayment plan, but under chapter seven you can
completely eliminate it. You do haveto qualify. You do have to qualify.
(41:49):
But we have gotten several individuals becomedebt free as a result of filing
bankruptcy for their IRS debts. Sogive us a call at nine zero one
five four one help five four onefour three five seven, and we will
analyze and see if we can geteliminated your IRS debt. But what I
what I wanted to say is,and especially to your listeners, especially to
(42:13):
your listeners, listen a lot ofyou own your house free and clear,
or either a lot of you thatare listening. You may have parents or
grandparents who own their home free andclear, and they're struggling to pay back
their tax, their property tax debt. Okay, So I want to tell
you a few things. The firstis, let me just get that out
the way. Yes, you canbankrupt the tax debt, but listen,
(42:37):
it's under a Chapter thirteen wage earnerand it's Look, we'd rather have your
parents keep their home or have youkeep your home, than for you to
lose your home in a tax cell. If you do lose your home in
a tax sell you need to callAttorney Johnson because she has an option.
But before we get there, so, if you have tax debt, you
(42:58):
cannot pay the tax det the firstline before yes, of course, you
know I want you to call me, but before calling me to foul bankruptcy,
I really want you to call theShelby County and City of Memphis and
see if you can work out aplan directly with them, a repayment plan.
If they're like, no, youknow, we're not gonna work with
you. It's been too long,or they're demanding too much of your money.
(43:20):
Then definitely give me a call atnine zero one five four one four
three five seven, and I canmake sure that you get on a payment
plan for you to first off, keep your house and then second of all
repay that tax debt or repay theirrear just for the mortgage. But say,
for instance, if you're like Ursula, it's too late, don't talk
about me. I really already lostmy house in the tax seal. I
(43:42):
hadn't even told my family. Igot a year to redeem. I want
you to hear what Attorney Johnson, because she has a solution for you.
I think it's important to remember whatthis is right. This is real estate,
and it's it's a legacy that canlive well beyond our own years.
We know that people you know acrosstime have fought over land, over property.
(44:08):
It is how you build wealth. It is how you leave wealth to
your children. So if your parent, mom, if you have worked,
scrimped and saved, and you havepaid your mortgage off, you have purchased
this house, you have it nowfree and clear. But now you're retired,
you're on a fixed income, youreally can't afford to pay the taxes
(44:30):
on the property. There are acouple of options for you. Of course,
we've already talked about the bankruptcy tryingto work out a payment plan,
going to bankruptcy option. But mom, let's say you were too embarrassed,
you didn't tell your children what wasgoing on, and now your house has
been sold to a third party foryour delinquent taxes. Well, let me
(44:53):
just tell you it's still not over. We can help you, but you
must act fast. And I'm notsaying that because I just want your business.
I'm saying that because there is astatute of limitations and you have a
very limited time to respond once thishas occurred. So if this has occurred
to you or a family member andthey've lost their house in a tax sell,
(45:16):
we can assist you with filing apetition with the court in order to
redeem your property out of the taxseal. But what does that mean.
That means we're going to go tothe court and tell the court, Hey,
we're going to pay the back taxes. Please, you know, give
us give us the house back, you know, but you have to be
(45:36):
prepared to pay the back taxes. So a lot of times we would have
clients go and borrow the money inorder to here's the thing. You do
not want to lose your house toa tax seal, right, and even
if you decided, okay, Idon't want to borrow the money, you
know, I just want to sellmy house at this point, you know,
(45:58):
think about that as well before weget to this point, because then
you can at least take the equityout of the home. And what is
equity. Equity is the difference betweenyou know, what you owe or what
what the leans are on the propertyand what the property is valued at.
So if your taxes are ten thousanddollars, you have ten thousand dollars in
(46:19):
back taxes. Do we really wantto give up a house that's worth two
hundred thousand dollars because you owe tenthousand, you have one hundred and ninety
thousand dollars in equity, you know, and many times they don't even realize
how much money they have in equity. To be honest with you, I've
talked about this before in which Ipurchased a house where I think about sixty
(46:40):
thousand, maybe it was thirty fivethousand. The point is the house is
now worth between one eighty to oneninety and that's a huge jump from what
I paid and what it was worth. And I'm not talking about the fanciest
neighborhood either. So when you thinkthat that house is in work with anything,
you think that Grandma's house is dilapidated, is run down. No,
(47:04):
it is worth something and you needto get it sold. And even if
it's worth one thousand dollars, it'sa thousand more than you had a moment
ago. So why not make surethat we get those taxes paid up.
So depending on where you are inthe process, and if you're having a
hard time with the taxes, youknow, give us a call because bankruptcy
may be an option for you.If banker, if it's too late to
(47:27):
file the bankruptcy, still give usa call because we may be able to
redeem your property from that tax cell. Our telephone number is nine O one
five for one help because we arehere to help you. That's nine O
one five four one four three fiveseven got it? You got it?
I want to go to our phonelines. We have a caller waiting WDIA
(47:51):
Hi caller. Let me say,how you doing, young lady. I'm
doing fabulous bird legs? How wereyou I'm doing? I woke up everything
else. That's bet as a bonus. Yes it is. Hey, Monica
and Erstan, how you doing.I'm doing great, doing great. I
hadn't talked to Ersa since I washeaded the Tupelo to that very fine concert
(48:14):
down there one evening. Yes,ma'am, I remember it. You co
signed me and I appreciate that.Oh yeah, one thing for sure.
And I've been listening in the babyfacefor years. I don't believe she's gonna
have anybody on her show that shedon't believe in. It's kind of like
my yes, kind of like mypastor, Robert Jones Jr. Anybody can't
(48:36):
come to this pull upit. Andthat's just the way it is. It's
a responsibility, responsibility. It's verymuch responsibility because he feels responsible for our
souls. That's right. Take thisout. The reason I actually called.
I heard MONIQA say that she receivedan email regarding her student loans that some
(48:57):
of them had been canceled. Isthat did you say that? Yes,
I did I do anything? Youjust you just received an email. I
received an email, yes, ma'am. And it says it. You know,
I didn't think it was real.It says congratulations, you know.
And then it had the amount ofthe debt that was canceled, you know.
And it had in there that infact, I might have the letter.
(49:19):
I might be able to read aportion of it online if I can
on while we're on the air.But it did say that it was from
the Biden administration and it was partof the program that he has right now.
Okay, because I've been I've beenlistening and listening, I heard Stan
Bill say something about it as well. Let me just say this here,
which has nothing to do with that. But it took me ten years to
get my first degree from Southwest CommunityCollege. I was raising my daughter,
(49:43):
but guess what I got it.You got it, amen, Amen.
It took me ten years, butI got it. Then I turned around
later and went to the morn onand guess what graduated from there with my
bidess administrationations congratulating. I'm so proudof myself, even though I'm retired.
But at the same time I saythis, Tama Sawyer I said on the
(50:06):
On the Stand show this morning thatif she win, I'm coming out of
retirement to come back to general Sessionsbecause I loved that job. When you
got a job that you love. It's really not a job that you're right.
You're right and yes, and Ilove that. So when I'm gonna
change and not say if Tama sawyou, and you're probably listening when you
(50:29):
win, bird Legs is coming outof retirement, I'm coming back, all
right. All right. With thatbeing said, I'm gonna be watching my
email to see if I get thatcongratulatory letter. You all have a girl
and it's great talking with you byfate. Yes, ma'am, I'm gonna
check you out at the Rocking Chair. And Rocking Chair is such a beautiful
place I love. And you knowwhat, bird Legs. The next time
(50:52):
I'll be there hosting will be nextmonth with Big Rob and cheek Rogers Big
Robe to check you out. Yeah, it's it's the it's the weekend.
Yeah, Big Robber. It isgoing to be February tenth. I'm gonna
be there. I love Big Rob, Big Rob and cheap Rob. Yes
(51:14):
he does, yes he does.Mark your calendar. That's right, mar
calendar, that's right. Thank you, Monika, y'all be gore, thank
you, thank you. I appreciateyou. Monika. I'm sorry on no
no, because I the information. That's right, Attorney Johnson has pulled because
(51:37):
because it's important for you read that. Because I just got an email and
they wanted to know, says askattorney Monika. Where do you find the
information on on about the forgiveness?Okay, so I'm not sure you know.
There may be different student loans serviceproviders. Okay. My service provider
(51:58):
happens to be Mohella and it saysFederal Student Aid. How do you find
it? I have a portal withthe student loan with Mohella where I would
make payments for my student loans. So I was able to go in the
portal and see all of my communications, all the mail that they've sent out
to me, and this letter waswas in there. I also received an
(52:22):
email. The letter says, MonikaJohnson, Congratulations, the Biden Harris administration
has forgiven your federal student loans listedbelow with Mohella in full. Wow,
those weren't all my loans, butthe majority of the loans were forgiven.
(52:42):
And then it has the loan numbersand the amounts. Go ahead. This
changes. I want you to lookat it be but let me say this.
If if you see this number, look at this number, Okay,
this is a bit. This isa big number. This is a big
(53:02):
number that she got forgiven. Lookat that bell, beb that's like hitting
the lottery. Whoa, that islike hitting the lottery. Hey who.
I would like to give a shoutout to Sweet Magnolia Gelato, Hugh Bob
Rock at Crosstown. So all ofthe small businesses that have been closed as
(53:25):
a result of the week that wehave been out, make sure you all
get out and support our small businesses. So the rocking chair we have them.
Make sure you get out and supportthem. Make sure you go out
to sweep Magnolia Gelatto. These smallbusiness owners need you to come back to
their restaurants, go back, soshop local by local, so that we
(53:45):
could support our community, to makesure that we are giving back to those
that give to us and we arerecycling our Memphis dollars. Yeah yeah,
I like that. But Monique, you see that number. I saw the
number, and I want to say, when people say, what is President
Biden done? What is Vice president? Tell you what they did for me?
(54:07):
I know, well that number, but student forgiveness and I was gonna
say I saw it on Sunday theyhad a sister on Sunday morning on CBS.
Hers was forgiven and she had abig number. She said she didn't
know what she was going to do, and she was a doctor. Wow,
she had her student loans forgiven.Yes, you are taking it.
(54:30):
So let's let's just say this sothat we won't get everybody scammed up.
Yeah, maybe Attorney Johnson can lookonline and see what the the the general
web or I think I should goto the official US Okay, Sonia is
going to look that up while we'reso that we can get probably the US
what Department of Education. I don'tknow you as a Department of Education.
(54:52):
But I don't want people just goingto any website live for and because while
Attorney Johnson is researching that, whenand I other things that want to talk,
I'm sorry, do we have anyI don't want to Well, okay,
I do have the email adger,I mean the website. Okay,
what you should do and this isthe same place where you file your fast
FAT and all of that. Youshould go to studentaid dot gov g o
(55:16):

dot gov. Student s t UD E N T A A, I,
D, DOT G O V.And when you go on there and
you log in, it will itwill direct you to who your service provider,
Who your student loan service provider is, okay, And if you can't
(55:38):
log in because you don't have one, simply call them and look for their
number on that site and you calland you find out and let them step
you through that process. Do notthis is this is not the year for
you to stick your head in thatground, right, this is the year
do you to put on your biggirl panties if I can say that,
put your big girl patties over, put on the trap on your booth.
(56:00):
Time it gets to work, andit's time to figure out the solutions to
the problems that you have. Timeout for anxiety and depression. Some things
are chemical and as a result ofissues that are outside of the issues that
you're dealing with with life. Butin the words of my pastor life be
life, and but God be Godden. That's right. It's the less take
advantage of what Biden has done, which has helped us eliminate the student loanday,
(56:22):
hold on, ladies, we aregoing to take a break because I

at the rocking Chair. Oh wonderful, Thank you, George. Yeah,
(01:00:13):
you know what I should have said. You can get carried out. You
can go and get it to carryout to go. You don't have to
sit there. You can get itto you. You know, I'm past,
I'm pastor forty years. I'm gonnasend my associates over there to get
it. I'm gonna say, youlook at this TV listening to you and
my associates going over to get that. But on number two levels, guess
what what, Monika. I lovewhat you all are doing because you know,
(01:00:37):
I've been in entertainment and clergy, both worlds. But here we go,
Tony Braxton, there is life afterbankruptcy. Yes, yes, I
mean even you see people on TV. You know, my good friend going
to glory, Curtis Mayfield, hesaid, I'm going home and I'm gonna
take a second look. A manof god, a legendary writer, producer,
(01:01:01):
you know, let's do it again. But he had some financial situation.
You were you. You were noteven out of school. I listened
to y'all talked, you know wherewere you Monica in nineteen sixty nine?
(01:01:21):
Were you weren't here? Yeah?We parents' mind. Oh have mercy.
I know where I like, Hey, George, I know where I wasn't.
Where were you in sixty nine?I was in the eleventh grade?
Look at you? Were you good? Were you bad? I was good?
I was I was good. Iwas good in my friend Curtis Mayfield
could have used your expertise. Butyou hadn't gotten your diploma yet. Like
(01:01:45):
I told old Bell. You knowBell? Where were you when I got
married? July to fourteenth, nineteenseventy four, I said, I do,
I do? I do? Nineteenyears old. I don't know how
to communicate with no female. That'sright, that's right. What are you
doing? What are you doing atUnion Valley three o'clock in the afternoon,
July fourteenth, talking about I doI will? Oh, she's so cute,
(01:02:06):
she's so cute. Wait, George, don't kiss right now, let's
finish, I said, Land,Rev Leland. Get to the good part.
I now pronounce you man and wife. Now the postman is coming.
My Nikka. All right, thankyou, and get that luck and get
that lunch and dinner at the rockingchair. I'm gonna get it all right.
Bye bye, Thanks George. Ladies, I have this email, and
(01:02:29):
let me read this email from Melanie. She says, I bought my new
home in February of twenty twenty three. Do I need to file an income
tax this year because I am onSocial Security? Now, I haven't been
filing Social Security because it's a taxableincome, ask attorney Ursler. Could she
(01:02:49):
explain to me a little more aboutabout on first buying a home. You
all understand I don't know, Yes, I do, Okay, So to
begin, I'm on a tax attorney. I do practice in the areas of
real estate, personal injury, bankruptcy, wills, estate planning, you know,
legacy, continuing and building up thelegacy. So my first answer would
(01:03:12):
be for her to definitely call whothe person who prepares her taxes, be
it the irs or either her accountantor wherever else she goes to get her
taxes prepared, or she has notdone it recently because she is receiving her
Social Security but she needs to goto or call who she used prior to
then, now, if you havea house, what are your tax ramifications.
(01:03:37):
Well, you get tax deductions becauseof the property taxes that you pay.
You get a tax deduction, soit helps you with your taxes.
In addition, you get a taxdeduction because of the interests that you pay
on the home if you have aloan. So these are areas in which
the federal government has given you spaceto save money because you have spent money.
(01:04:02):
But to hear about the legality ofhow that actually is applicable to you
as an individual, you would needto call an accountant or a tax attorney
or whomever prepares your taxes for thatanswer. But I will tell you this.
I like the way Melanie is thinking. And a lot of people who
are on Social Security do not realizethat you can utilize your Social Security as
(01:04:27):
a part of your income to purchasea home. And so my sisters that
are on Section eight, you caneven use your housing voucher as part of
your income in order to purchase ahome. So all of these things are
possible when you're looking at purchasing ahome. And the next is the interest
rates. The interest rates are verystable right now. I had a client
(01:04:48):
who are getting five point seventy fiveto six point three or so. If
you want to purchase your home, now is the time to buy before the
house prices skyrocket. You want tobuy before that happens, and the interest
rates is still pretty much stable, they're not skyrocketing anymore. So just give
(01:05:08):
us a call at the office atfive to four to one help five four
one four three five seven, andwe can point you in the direction of
a real estate agent as well, who can help find that dream home.
So, yeah, I can't tellher what to do. Yeah, but
I can't tell her where to call. Okay, good this question, Attorney
Ursula, says Attorney Ursulo, whatis the initial fee to file a Chapter
(01:05:30):
thirteen bankruptcy? And what is thatagain? Chapter thirteen? Okay, So,
a Chapter thirteen bankruptcy is also calleda wage earner, and the official,
the official, the beginning fee forus is two hundred dollars. It's
two hundred dollars. So you comein, you bring your two hundred dollars.
That's all we require upfront, andwe can get that process started under
(01:05:53):
a Chapter thirteen wage earner. AChapter thirteen wage earner will do several things
and it is a blessed. Ifyou're facing foreclosure, guess what you call
me at five four one help. You won't face foreclosure anymore because we can
stop that foreclosure. Oh your car, it's you're looking at repossession. Oh,
call us at five four one help. We can stop that repossession.
(01:06:16):

But you will be able to stopa garnishment with a bankruptcy. That's
(01:06:39):
the reason why we're encouraging everyone giveyourself the peace of mind by simply calling
us A nine oh one five fourone help five four one four three five
seven, ask for the BEV JohnsonSpecial. Go to our phone line to
talk with you. Hi caller,Hey, Hi caller. Hello, Yes
(01:07:00):
you're on the air. You havea question. Yes, I never doesn't
have anything to do with bankruptcy oranything, but I have know a few
black people that have lost their homesto h O A or back dudes of
stuff. I know African American ladyin North Carolina, where I'm from,
(01:07:21):
he had a homework four hundred thousanddollars and they sold her home from out
under her. Is that legal? You know? First of all, thank
you for that question. I don'tknow how. Yes, the answer is
yes and is devastating. So wellwe can expand on it. We'll expand
on that now. Thank you,Thank you for sure. Yes, it
(01:07:42):
is legal. So when you purchasea home. Thank you for your thank
you for your call. Oh yes, we're calling from Oh thank you for
listening in Seattle, Washington. Howdid you discover the show? Are you
from the south or you just youknow? How did you discover the show?
I'm from Memphis, from Memphis,Tennessee Graduate, Memphis nine oh one
(01:08:10):
in Seattle, so sleepless in Seattle. Thank you for calling in. Thank
you so much, and thank youfor listening. Yes now, and keep
okay, okay, but keep listening. I'm about to talk about it now,
all right, thank you, byebye. Oh that's nice. All
right, so let's talk about it. We've discussed this before, and there
(01:08:34):
is no better time than the presentto discuss this. If you have if
you paid your property taxes on time, you've paid your mortgage on time.
But the one person that you didnot pay is your homeowner association. They
have the legal right to come inand foreclose on that home because you are
(01:08:55):
under the subdivision rules and restrictions andcovenants that what we call run with the
land. That means that they havethat authority if you do not pay into
the association. I have a ladyright now that is being sued forgets how
much, probably like five hundred dollars. Guess what, No, it's for
one hundred dollars. Thank sued forone hundred dollars. She was an elderly
(01:09:16):
client who you know, she missedthe number and they're actually suing her.
So I have to call them inthe morning to discuss this hundred dollars balance.
But yes, so because of thesubdivision rules and restrictions, if you
do not pay your HOA, whichis a homeowner association dues, then unfortunately
(01:09:39):
the HOA can foreclothes on your home. Now, when they foreclose on the
home, they take that property subjectto meaning they would still have to pay
that mortgage, but they will sellthat house, pay the mortgage, pay
the mortgage off collect their dues andthen if if there's any extra then you
would get that after the attorney fee. So yes, So as a real
(01:10:01):
estate attorney attorney Ursula, Yes,do you advise when you're talking when people
are looking for homes think about ifyou want to be in a home association
right? Yes, absolutely, becausethat is more than a notion. Attorney
Johnson, do you want to expoundon some of the positive and negatives about
an HOA? Well, the positives, of course is that you have a
(01:10:24):
community that have they have a standardfor how they want to live, right,
So that's why you have the rulesand restrictions. You can beautify the
community. You might have all uniformmailboxes. There's a safety element associated with
it. Sometimes they're gated. Butthe downside is that when you obtain that
(01:10:49):
deed to that property, you're acceptingit with the subdivision restrictions. So you
have to adhere to that in acceptingthat proper. Some of those restrictions may
be you can't post. I'm sorry, you can't post. You can have
a basketball goal in the front ofyour house or on your driveway, because
(01:11:12):
esthetically that is not pleasing for mostindividuals. You may have a situation in
which you cannot paint your house anycolor other than a neutral, community acceptable
color. So even though purple maybe your favorite color, it may not
be acceptable to others within that community. Therefore, you must keep it a
muted color. You know, yourdark blues. White may be black.
(01:11:35):
And some one subdivision, our friend, they would not let him paint his
house white because they already had twoother white houses in the neighborhood. So
those are the type of restrictions.Yet, yes, as so Mo and
Monica collaborate as you desire. Well, one of the things that happened in
(01:11:58):
my neighborhood, and you know,I think that everyone should at least read
their HOA rules because this was concerningfor me as I was considering what to
do with my real estate, andI learned that we have this restriction,
and that is a restriction that preventsyou from leasing or renting your property.
(01:12:18):
We also have a restriction that doesn'tallow for short term rentals. No short
term rentals, which are like airbnbsin our neighborhood. Yeah, and then
all the same and also but youknow, if you're an investor, you
would want to know that you can'trent that only the deeded person and their
(01:12:41):
family can live in the property. You need to know that you can't rent
that property and make an income offof it. Those are very important restrictions.
So our caution anytime that we havea client that's interested in purchasing property
that has covenants and restrictions that theyneed to be familiar with and they need
to understand that they're going to haveto adhere to them, including and especially
(01:13:06):
making the payment for the dues.If you fail to pay your dues the
first line, they can immediately geta lean on your property. So if
you try to sell you at somepoint you're going to have to pay those
dues. They have a lot ofpower that has been given to them with
those restrictions on your deed. Soeither if you're going to refinance, you
have to pay it. If yousell that property, you have to pay
(01:13:28):
it. Yes, yes, Andso you should be aware of that whenever
you're purchasing property. Because unfortunately forthe caller, it is true that an
HOA can foreclose on your property andthis is not I know. The caller
did point out that it happened toa few of her African American friends or
her black friends. This is notexclusive to black people. Their foreclosure does
(01:13:54):
not have a color requirement. Itcan be white, black and everything in
between. Okay, go to ourphone life. W d I a high
caller. Yes, I think youhad a caller wanting to know whether they're
not their social Security benefits. Theyhave to file or something set US tact.
But they can refer to Publication ninetyfifteen that may or may not help
them. If not, like shestated, check with their accountant. But
(01:14:17):
publication nine fifteen. All right,I got publication. Thank you for share
love when we have ex very much. Bye, boy, thank you called
screener. W d I a highcaller. Oh, Bob, hey,
Barbara, how are you. I'mblessed, Thanks you, bab. I
just got there and listen to yourshow. Bab. I do not like
(01:14:43):
all these rules and regulations the ladieswere just mentioned in neighborhood. It seemed
like African American people don't change overto doing things and copycats out for other
graces of people. I don't.I'm living in the community to that they
got all these kind of rules andI don't like it bad. I really
don't. Now I'm just I don't. I don't mean no harm. But
(01:15:09):
for us, I'm concerned about mypeople much as I've been through, and
I'm going through a whole lot rightby not there. And it's about rental
property. I called it the bl T Black Landlords terror, and that's
what a lot of people going through, these black landlords is making all these
different kind of rules. And Idon't like it. Well, you gonna
(01:15:30):
tell me what I can't do it? And I'm paying rich for as I'm
concerned, and I'm gonna say this, Okay, the next time I've rent
something from somebody, I hope theyclue plus claims me. I rather live
around different kind of people. Letme get I do not like all these
(01:15:53):
different rules. Our people don't changeso much. Our people don't change so
much. I'm now I was toldthis until I got into this real apartment.
You can't do this and you can'tdo that, and you can do
you favor. Let's let's have anything. Let's just let's let's let's letsten what
I was gonna say. I wantto know. I just want to know
(01:16:15):
what are they restricting. Just giveme one thing that they're restricting. You
can't do that when I have whenI have company that uh clump with two
people part in front of the house. What I'm part of the person?
I know people, I know alot of people. I got seven children,
I got sixteen great children. Andyou need to tell me can't put
(01:16:36):
two people far? And the rulesthat this person gave me when the game
and the rule you should have toldme about the rules, I would have
not accept the play. It's twentyeight rules I got to go by just
to live in that they give me. Give me another one. Besides that,
give me another one. Oh thatI can't have a kind of I
(01:16:56):
can't have a sale of why Ifell unless I get PERMISSI. You can't
have a Oh you can't have amin a satellite. You can't attach a
satellite. No, I cannot help. I won't have the saleh god sale.
Oh yeah, yeah, well that'sokay. Yeah see, and that's
(01:17:18):
why that is true, Barbara, you know what and I can definitely understand.
But but can I share something withyou? So because this is also
just a hold on, let meback up, just to let you all
know we in addition to coming onthe show, we also go live on
Facebook as well as Instagram. Pleasefeel free to follow us at Ursula Woods
(01:17:39):
on Facebook or either preferred title ornine to one car Wreck on Instagram.
So this question will apply to youas well as we had an online question.
So the issue is were you givennotice within your contract? When you
sign a contract, you have tobe They are required to give you a
contract to sign, and it hasto have whatever the terms of that contract
(01:18:02):
is, the rent that you're goingto pay, the term meaning the beginning
and end of that lease. Andthen if there are rules and regulations that
should have been provided to you inthe front so that you could be aware.
It is very important that we readeverything that is given to us.
And I'm not going to co signand say we can debate it respectfully if
(01:18:26):
you want. I'm not going toco sign and say that as an African
American landlord, we are quote unquoteduplicating what white people do. But I
will tell you this, we dohave to have rules and regulations for various
reasons to make sure that things aredone decent and in order. I do
understand that you may have more thantwo guests and that will require more than
two cars in front of your home. I would assume that if you had
(01:18:49):
ten cars twenty cars on a holidayor birthday, that that could be unextendable.
But what the subdivision is trying toprevent. It's from you being in
at home with six adults with sixcars. Because we are in Memphis,
public transportation is there, but itis not as reliable, so most of
us have our own vehicles. Sothey don't want to have one house with
(01:19:13):
six adults and six cars parked allover the neighborhood. When you multiply that
times the number of people in yourneighborhood, that would crowd out the street.
Therefore, there are rules a garagecell. Some people feel as though
a garage sale is an eyesore.I am not saying that is me.
I am just sharing that some peoplefeel as though their subdivision should not be
(01:19:33):
one in which a garage sale hasoccurred. So it sounds like you're in
a very nice neighborhood. Kudos andcongratulations, but unfortunately you do have to
follow the rules that they have becausethey don't want that. And I'm not
going to be in agreement with sayingthat these are white or black rules.
I believe that these are just simplyrules that are in place. Lastly,
(01:19:55):
I would not support anything that thekukuz Klan would have because of their racist
belief and me having someone park acar is not going to usurp the fact
that I'm not going to support thecluecuts plan. So I do understand that
you're passionate about this issue. Idefinitely appreciate you for letting us know that.
But moving forward, I would encourageyou to ask for all of the
(01:20:16):
rules, read them. And thento my person who had the question about
HOA, this is very important, they said, where do you find the
rules for the subdivisions and restrictions?I prefer titland escrow. We do a
research on every property that you buy. We go back now one year,
now, five years, we goback thirty years, and we will provide
(01:20:36):
you right now. When I leavehere, I have a closing, and
I have the subdivision restrictions in mycar for all five of my closings that
I have to drive around this cityfor. But yes, I have all
five of those subdivision restrictions in there. So you can look online. If
you go to the Shelby County Registerof Deeds put in your property address,
you may find them there. Butthe easiest place, the easy place to
(01:21:00):
find out what the subdivision restrictions andrules are for your subdivision. If you
have an HOA, which is ahomeowner association, this is simply called the
association. And last, but certainlynot least, and this is to you
caller. If you're not happy withthe subdivision rules and restrictions, you may
consider joining the HOA. Unfortunately, you're renting, so you may not be
(01:21:21):
able to join the homeowner association group. But if you're owning a home and
you're buying a home, definitely jointhe HOA. You can then make sure
that the rules are fair and justmake sure that the fees are fair and
just. And if you're not aforeclosing type of president of the HOA,
then don't so I would encourage youto definitely read and when your lease is
(01:21:45):
up, move forward and make sureyou go into a neighborhood that allows what
you desire. Right, Can Isay one more things that they said we
can't put up just sham. Youknow how people put off or read something
on their doors, like you know, the holidays and s up that that
was a very restrictive. Yeah, the landlord, Yeah right, we're sorry,
(01:22:13):
Yeah, we are white behind OrangeMounts. Oh that's just your landlord.
Okay, okay, you wipe behindOrange Mound. And like I say,
and I must say this to me, I am not ever gonna rip
for another black person. They saidI could stay there for five years free.
Thank you have a YouTube, Barber, we are talking today. Hold
(01:22:36):
on, y'all. That's why youalways say, Attorney Ursela and Attorney Monika.
We have to read things, yesman, we don't. We shouldn't
take anything for granted. You know, sometimes we get in a hurry and
doing things. But again, canI can I make a point too about
(01:22:56):
black businesses? Yeah, because thisis near and dear to my heart.
Now people have an issue with businessesperiod, Black white small business, big
business have an issue with me,don't have an issue with me. Don't
let one person take you from anentire group, especially if you're a member
of that group. Because what you'resaying is there's some self hatred. If
(01:23:21):
you know that you're not the sameas someone that you hate, then what
makes you think that everybody else is? But you think you the exception.
No, So if you had abad here's my point. If you had
a bad experience at a business.I don't care if it was an Asian
business, a white business, ora black business. You don't just cancel
out all Asian restaurants because we hada horrible time at one Asian restaurant.
(01:23:44):
No that one Asian restaurant is notgood, and go to a different one.
I have. You know, let'sjust be honest. The nail salons,
there is a monopoly there with onerace of individuals. If I have
an issue with one nail salon,I'm not counseling out all nail salons.
Go to the next one until Ican find one that I am pleased with.
And sometimes we have to look atthe man in the mirror. I'm
(01:24:06):
gonna have a transparent moment. Iwas complaining about my nail tech. I
was talking to Pamela Webster and MarinaJefferys in my office today and I said,
my nail tech people ain't not thatnice to me. And then they
said, do you go in thereworking? I said, yeah, I'm
in there two hours. I'm onmy phone. I'm returning to emails calls.
(01:24:27):
She said, that's why they meanyou. You're not engaging, You're
not being nice. I said, well, I talked to Sharing, the
owner. She said, Okay,So now what they're saying is, oh,
she's not nice. She only talksto the owner, and I didn't
see it from that perspective. Youunderstand, it's not that I don't appreciate
the other employees, it's just thatSharing and I do. I knew her
when she was an employee at anotherNeil salon. Now she you know,
(01:24:50):
has been in business and so that'sthe reason why. But when the point
I'm making is the bad service thatI was getting, I'm thinking it's them
the whole time. They pointed outtoday, well maybe because I'm not being
friendly. So show yourself friendly ifyou want to be a friend, you
know. So sometimes just look atourselves and what we can do to make
a situation better. And I wantto encourage everyone to talk to management before
(01:25:13):
you go to Google and give anegative review. All right, we are
talking to the ladies. As weget ready to come back, we'll wrap
things up. Good show today,Yeah, Attorney Ursula Wood's attorney Monika Johnson,
and I'm Bev Johnson on w di A. You're listening to the
(01:25:34):
heart and soul of Memphis. SoBev Johnson Show exclusively. You're listening to
(01:26:04):
the Ben Johnson Show. Here's BevJohns and I'm going right to our phone
lines as we get ready to endup. King Harry, Oh are you
doing? Queen doing Vancouver? AndAttorney Johnson and hello, hello King.
I love this conversation because I'm thevice president h o A. And we've
(01:26:29):
had renners in here, you know. And I had one guy in here
and he wants the parties eight Kingwill in his driveway and I told him
he couldn't do it. He calledme a boy, No, no,
we don't play that. This ain'tthat time of year, right, it
will never be that time of year. Uh uh, you know, I'm
sure, dude, but I don'tplay. I told him. I got
it told up out of there. What the lady was saying, she gonna
(01:26:53):
understand the h o A keeps yourneighborhood looking nice. He's wrecked basketball court
in front of yard. No,this ain't the hood. Don't be parking
up in your yard. And wehad the same thing. If your car
has parked that on the street fora certain amount of times, they don't
get told. Yeah, but Ithink I think that some can appreciate following
(01:27:15):
the rules and regulations because they understandthat it does keep the value of the
property up. But I think wherethe problem come in, to be honest
with you, is like say, friends, if you say, okay,
you can't have more than two carsin front of your yard, Like I
get why However, if I justneed to have the two cars in front
of my yard because my kids arein town from college and he brought a
(01:27:38):
friend and so instead of being twois now five. Well can you give
that person leniency on a Memorial Dayweek? Yeah? We do, We
don't just we're talking about on aregular correct. Correct? Yeah, they
parked out every day for months. No, what can't happen? It's exclusions
(01:28:00):
and uh what we have a Wehave about five owners that we have leans
on their houses because they haven't paidtheir dues and they don't realize you can't
sell that house. M Well, there, they can sell it, but
they have to pay they You cansell your house with the ho A lien.
However, at the closing, weare going to pay the h o
(01:28:21):
A lien that is on the titlebecause that lian runs with the land and
the next owner would be responsible. So you have to sell a home free
and clear of any liens or judgments. And so as a result that ho
A is going to get paid.So even though you're not paying them because
you're upset with them, remember thatthey have a remedy where they can foreclose
(01:28:42):
or you're gonna have to pay themeventually. And I have I have another
example. I'm sorry, go ahead, but no, what I was saying
is that, uh, what happened. This is a brand new neighbor When
I moved, it was on sixhouses and uh, there was some white
guy was over to h o Aand and then me and a neighbor we
didn't never know about that. Joeand I keep come around and next thing
(01:29:02):
we know, he gonna took offwith the money. So me and the
neighbor. He's the president, I'mthe vice president. We both would be
ok. And uh. And peoplein the other neighborhood don't like it.
But we got things taking care ofaround here now you know, entryways,
we got plants and stuff like that. We keep all everything, the streets
clean. Uh. But the onething is is that these people didn't like
(01:29:26):
it because us, like at firstthe first half of our complex, you
could not have nothing but a rawourn't fens. But over in part two,
you can have a propset since sowe got that quick uh done,
and we went to the law andwe changed the covenant so everybody could have
a wooden sense all right, soyou know if you work with them,
it works our find if you workwith them. And we also got our
attorney now because a lot of thesepeople bought these house to rent, and
(01:29:49):
so we're gonna change that. Onceyour renners move out, you have to
sell it. We don't want norunners in here because I agree with you,
and people need to understand that rentersdo not take care of the property
the same. No backup, Mostrenners don't take care of the property the
same as an actual owner. Donot call up here saying I rent and
I take care. I get thatyou do, but for the most part,
(01:30:12):
most individuals do not. Thank you, King Harry, make them cut
their graded to bring that up again, all right, thank you King,
Bye bye and hello David, youat to know my most beautiful asking advitor.
How are you doing today, Suster, I'm doing well, brother.
How are you? I'm doing well? Doing well? Good afternoon, attorneys
(01:30:36):
and Hampton mother, good Hello, good afternoon. Yes, I love Hampton
University. My son is a graduate. Look, I heard the sister to
call uh it just I'm really sadingby the timent, stating by anger her
(01:30:58):
disappointment. But let me ask youreturning, wouldn't that information have to be
in the actual leash designs or not? It should have been. It's all
the terms and conditions should be inthe rental agreement. There should not be
any questions. There should be,you know, it should it should dictate
(01:31:24):
who maintains the property, who's goingto be responsible for the HVAC system,
you know, I mean it shoulddictate literally every restriction, every term and
condition that's associated with that home. And that's one of the reasons why we
said, if you have any questionsabout the least that is being presented to
(01:31:45):
you, have us to review itbecause we're going to ask those questions.
If we learned that there's an HOAthat's attached to the property, we need
to make sure that all the documentsare included and that we understand saying what
those restrictions are. On the frontend. Well, I'm not considering ho
(01:32:06):
A, she said, she justwas dealing with one landlord so that and
where she lived too, So that'snot like in ho A either. But
well, well we had the impressionthat maybe she was renting from the owner,
and the owner but the property stillcan be subject to ho A restrictions.
She just happens to be renting theproperty. And well, I'm sorry,
(01:32:30):
I'm learning something here. You're sayingthat that Orange Mound has h A
rule. Well, well, letme just say this. She did.
She mentioned that she's right behind O. But I will tell you this,
let's not despise that, because inthese neighborhoods, you will be shocked at
how these particular subdivisions have skyrocketed upwards. Now and so what was that what
(01:32:56):
was once not an upscale community isnow in ups scale community. I personally
own one that was rough, andnow it is not rough. I went
and literally, I swear it happenedwithin probably six months. I drove by
the property and people were jogging andwalking their dogs. I was. I
was in shock. I kid younot. I was in shock. And
then Attorney Johnson started telling me wholived And you remember that you were telling
(01:33:20):
me about the counseling that lived thenext black over. Yes, and yes,
I was like he's actually public officialbecause the sub changed and so they
go in and now they're creating whath o a's because they want to have
different rules and regulations for their street. We went to a home in white
Haven, very beautiful home. Yes, and I know they have to have
(01:33:44):
subdivision restrictions. They do. It'sand it's gated, you know, yes,
and it's very nice it well noteI've lived in understand that. But
that Orange well yeah, she said, behind on you, but that is
changing. I'm not I'm not tryingto turn down any community or any neighborhood.
(01:34:09):
I'm just saying, I know,I know what you're saying. She
has to the real problem here isthat, in my humble opinions, that
she didn't read the lease right, and that's not the responsibility of the landlord
to read the lease to her correctcorrect. You are absolutely right. Now,
let me say on the other sideof it, my mother, God
(01:34:30):
rest his soul, lived next toa house that was foreclosed on. It
was about through her foreclosure. Theinvestor did a good job and renovating the
home. He moved a young ladyand who possibly Section eight, had two
or three children. Nice young lady, but she had a problem with cutting
(01:34:53):
the grass. Right, So whatI did? I said, you know
what I cut you grass is fifteendollars. That's what I do because I
don't want my mom much living nextdoor to a freaking forest. Right.
Yeah, she couldn't. She couldn'teven pay me the fifteen dollars. Now,
(01:35:15):
here's my and I told her,if you can't pay me the fifteen
dollars, here's my phone number.Call me up before I start cutting.
No problem, We'll work it out. Do you think she called me no?
Now, So when the caller talksabout somebody being being too restrictive,
there's an example of the investor notbeing restrictive enough because I don't know how
(01:35:40):
you move into a house where yousee grass, don't know grass grow,
and don't know it's your responsibility tocut your freaking glass. Yes, common
sense is not coming. I rememberonce I had a close in and I
told the lady. Well, Ididn't tell her, but her real estate
agent said that the house has tobe clear of all the furniture. So
(01:36:01):
the lady put all of the trashand old fracture in the front yard.
Wow. Wow, So I'm sayingthat to say coming. Sense is not
coming, and that's disappointing. Didyou have to continue to cut the grass
for that for the lady, justso your mom could at least have some
decent, you know area, andnow were about snakes and things. No,
(01:36:26):
I cut the curve of Pill. And when she when she couldn't,
when she sent her dollar to tellme that she didn't have the money,
which was embarrassing to me, Isaid, you know what, I'm gonna
cut ther yard through the through theforth so she'll have a nice yard through
the fourth. I didn't accept anymore money, and I said that was
that was gonna be the deal.So I just cut it to make sure
