And it's a way for us to take our power back,
you know, because we are in crazy times.

gonna do what we have to do each and every day,

don't always have to succumb to what they said, because
you know what makes me sad is when people really
disparage Memphis and say things that are negative. And we
do have our challenges do but I think that we all,
you know, everywhere we go, we have challenges. It doesn't
matter the city, big or small, people are going to

have their challenges. So to be able to support our
local our local people is important to me. Let's spread
some positivity about the nine oh one.

But what I want to talk about for our soapboxes
this is we have Valentine's Day that is coming up
on Friday, and many of us are in relationships, and
then many of us are not. And I want to
talk to the ones that are not in a relationship
because I don't want you to use this one day
out of three hundred and sixty five days to feel

as though you are now anything less than a child
of God. Right does not matter if you're with your
significant other or you're insignificant other. I think let's utilize
this day as a day of love, and it's also
to love ourselves because many of us are in relationships
and really and truly we would be doing better by ourselves.

Let's not just look at someone else from the outside
and think, oh wow, their life is perfect. Now on
the flip side, somebody they may have a genuine connection
with their spouse or their significant other, and let's celebrate that.
But right now, I'm just talking to you. So you
may say, well, still Valentine's Day. What am I going
to do on Valentine's Day? You know if I'm alone? Well,

number one, you have yourself and the one thing that
you can do with yourself is learn how to love yourself.
So if you have time on Valentine's Day, I have
an itinerary for you. So once work is done on
that Friday, or shall I say, even today, I want
you to start planning to go out on a date
with yourself.

What does that look like?

It looks like this.

Ask yourself what makes you happy? What is one activity
that you can do that brings you joy? And then
I want you to plan that activity. So you may say, well,
you know, I really love to go swimming. Well, if
you really love to go swimming. When was the last
time you went swimming? You may say, Earth, where am
I gonna go swimming on a Friday at four o'clock pm? Well,

the YMCA has indoor pools, So call around find out
community centers have indoor pools. Some of them are free,
and then some of them may have a one week
pass or one day pass.

That you can sign up for. You may say, well,
you know, I always wanted to learn how to you know, paint.

Speaker 9 (10:23):
I see those paint and SIPs.

Speaker 10 (10:25):
Look at one eleven Madison, Downtown, Memphis, Tennessee. Let's explore
the things that you enjoy. Oh, I always wanted to
go to Italy and Ursula. Think you saying I should
buy a ticket? Nope, But I tell you something about YouTube.
Go to YouTube google Italy. Pop over a bottle of
wine or have a great glass of water if you want,

and you sit there and you have a date with
yourself in Italy and allow yourself to truly be meshed
in that moment. I'm talking about. Order you an Italian meal,
you know, do a door dash or cook one yourself.
You could even make it a cooking day where you
YouTube how to make a traditional Italian pasta, go to
the grocery store, get all the ingredients you have to

eat anyway, and then making a traditional Italian meal. As
you watch the scenes in Italy, you know there are
so many options right at our fingertips that we can
explore to make ourselves happy. You may say, well, how
do I make myself? Are there any other ideas? Of course,
why not make Friday? Even in a self help day?
Why not get a book? So, since we're talking about books,

that I thought I got some ideas, all right, So
I just hung up with Bishop Porter, Bishop Brandon Porter,
that is a staple in our community within the Kojak Church,
and he was sharing with me about a book that
he wrote, the Wisdom of Enough, The Wisdom of Enough.
So shout out to Bishop Brandon Porter if you all
can get his book, run, don't walk, and go get

that book. But one of the things that Bishop Porter
was sharing with me was about the knowledge of being
like a tree, you know, planted by the water, you know,
always producing fruit. Right, and if you follow the Bible,
then you'll understand that principle. But even if not, the
basic principle is we're like a tree, just planting by
the water because we're constantly being nourished.

So even though it may be times.

Speaker 10 (12:15):
Of drought, if we're planning by the water, then we
have a source that's other than what we see with
our eyes because it's coming up from the ground. So
then when you're constantly being water, then you know that
that tree and also biblical that you know a tree
by its fruit.

And so one of the things that.

Bishop Porter share with me was and was really impactful,
and it kind of just like stopped me in my tracks,
which is he said, I've never seen a tree eat
its own fruit. Right, so he's never seen a tree
eat its own fruit, meaning that the gifts that God
has given us, the gifts that we have inside of us,
is not just for our own selfish purpose, but it

is for us to be able to be a blessing
to others. So I encourage those within the sound of
my voice to remember that the gifts that you have
is to serve others. And so when you're and out
and you're depressed, one of the reasons why is because
you're only looking at your current circumstance. Look beyond your
circumstance and look to give your use your gift to

be able to use it for the world. And so
with that said, if on Friday you say acts of service,
it's something that you enjoy. Take one of your gifts
and then bless another person with it. If you have
the gift of conversation. I have elderly clients that would
love for you to call them because I talked to
some of them on a weekly basis. You know, call Auntie,

you know the great one, Nah, not that one, the
one they live in Detroit, that you hadn't talked to
in a while.

Call her, check on her.

Speaker 10 (13:36):
See how she's doing. It's Valentine's Day for her as well.
So when you're talking about reaching out during Valentine's Day,
put a smile on somebody else's face and be patient
when you call our elders, right because they want to
ramble and they want to share the story that they've
always shared.

Just sit and listen.

So I could go on and on about ideas for
Valentine's Day, but I just want those who are single
to be encouraged that you do have options.

And ladies, this is somebody who got who has a
significant other too. You don't like listen, so you can
still be in a relationship. You still love yourself.

Be your own best friend.

and I've talked to it so they're out of a relationship.

Look, learn to love yourself and what what it is
you like about yourself and love about yourself, what you're
gonna take or not.

You can get another relationship.

Because one thing is guaranteed. The one person that you
take with you into every single relationship is you. You
better get to know. And guys, let me tell y'all.

they say I talk too much, they say I cut
people off, they say I'm rude, whatever the negative is.

a good job because I put my heart into that speech.
But I talked to them about let them, meaning the
same thing that you're saying, which is allow people to
be who they are and then you focus on what
you need to make you happy and what your boundaries are.

And so we talked about that. So with that said,
we're going to have a book club. So if anybody

are going to have a book club meeting on March eighth.
On March eighth, so make sure you go to the

I want to highlight bankruptcy.

Good.

The reason why this may sound unusual, but the reason
why I want to highlight bankruptcy is because right around Christmas,
we spend a lot of money.

Speaker 9 (20:52):
We will break the bank.

Speaker 10 (20:55):
And then after that, because we know that we're going
to get what our tax refund so says, we know
the tax refund is coming, then we spend the money accordingly. Well,
in addition to that, we I was watching today and
I saw that these checks are coming through. So they're
telling people go to the IRS dot gov. You need

(21:15):
to you know where is your return check it because
some people got dates as early as the twelfth to
be able to get their money, you know, for their
tax refund. So I want to encourage everybody definitely check
your date, know that that money is coming, get ready
to get your tax returned. But then after that, we
have a huge increase in bankruptcy filings, so people always

(21:38):
want to know, you know, how quickly can I file bankruptcy?
I have to get my tax return, can I get
can I file bankruptcy? What are the steps for filing bankruptcy?
Can I keep my house? So we're going to talk
about all of that, but in addition to that, I
want to talk about the emotions because one of my
friends DMed me and told me because if y'all go

(21:59):
to the bankrupt Law firm Instagram page and TikTok, you'll
see that I do have some videos that are jokes,
you know, like where we you know, just having a
good time. Yeah, and one of my girlfriends because let
me back up, So I just eliminated about one hundred
and fifty thousand dollars worth of debt for a twenty

(22:19):
seven year old and like a twenty five year old.

Speaker 9 (22:23):
Now she was like twenty four to twenty five. I
don't judge.

Speaker 5 (22:25):
We listen and we don't judge. So they had a
lot of debt.

Speaker 9 (22:29):
Well, so my girlfriend's like, wall. It makes it seem
like it's so easy. It's not easy.

Speaker 10 (22:33):
No, you know, it's not easy. It's a tough decision
to make. But it's not a But filing the bankruptcy, yes,
that's easy. You provide me with your driver license, your
Social Security card, two years worth a tax returns, six
months worth of paycheck stuffs, and I can get you
filed with bankruptcy, so long as I.

Speaker 5 (22:51):
Can get you approved, okay.

Speaker 10 (22:53):
But what's tough is the emotions, right getting to the
point where we decide, you know what, I've tried.

Speaker 5 (23:02):
I've tried, and.

Speaker 10 (23:03):
At the end of the day, I don't have enough
money to cover these bills. Ursula said, to a budget.
You know, so you saved up your thousand dollars emergency money,
you blew through that. You looked at your budget and
at the end of the day, the amount of money
that you're making is not increasing, and yet the gas
is going up and the grocery bills are ridiculous. And

(23:24):
not to mention, if you have children, they want to
be involved in various activities, and all of that costs money.
So when you're in an unfortunate position in which you
have too much, too many bills, and too little money,
then the one thing you got to do is get
rid of some of these bills. Still, so how can
you do it? You have to either call and see
if anybody would you know, just so happen to forgive.

Speaker 9 (23:45):
The debt are better? Yet you have to call and
file bankruptcy.

Speaker 10 (23:49):
And we have two options for most consumers for bankruptcy,
which is a Chapter seven or a Chapter thirteen. But
you may say, well, I'm a shame you know I
have You know if I foil bankruptcy, everybody's gonna know.
Oh to begin, everybody is not going to know. But
is it public information? Yes it is, but most people
aren't going to check the bankruptcy website to see who

(24:10):
has filed bankruptcy. So the shame that you have is
really coming from inside. The one thing that is absolutely
true is that people are going to have problems from
one day to the next, whether they tell you or
whether they don't tell you, they do have problems. And
then as a result of the shame because you're thinking

(24:30):
you're the only one. You've made this decision. Oh my god,
I knew I shouldn't have paid for the funeral expenses,
but I did, and now I'm broke. Well, okay, let's
move towards solution. We got the facts, we know what
has happened. What is the solution. The solution is either
to make more money to pay off the debt, work

(24:51):
out a payment arrangement, or you can say, earthlaw, forget
all of that. I'm gonna be just like my President Trump.
And because he is fil bankruptcy. A few times you
may say, well, I'm going to be like President Trump
and I'm going to file bankruptcy, And I say, you
have every right.

Speaker 9 (25:04):
Let me sign that executive order right now.

Speaker 10 (25:07):
Because the federal government has put in provisions to allow
us to be able to thrive in America and not
have to be burdened by the weight of that debt.
Do you know that shame will kill you? So instead
of being in a place where you're saying, hey, I
cannot the anxiety is crippling, instead of being in that place,
I want you to move from a place of shame
and then move over into a place of solution, So

(25:30):
don't sit in shame. So y'all want you to move
to a place of solution. The next is that we're
gonna talk about the solution in a minute. The next
is people have regret, right, and so that's another emotion
that people experience once they're in a position of unfortunately
having money problems, they regret the decisions. Again, the way
that we get out of that place of regret is

(25:51):
by moving towards the solution. Okay, so, yes, you did
the thing that you did, but you are not who
they say that you are. So it's no need to
walk around with shame nor regret for the act that
was done. Because now you can really move towards solution.
And if these things are crippling you to the point
where you can't move, therapy is real. Therapy works. Don't

(26:12):
let some dusty person tell you that therapy does not work. Now,
you know, and I created equal.

Let me say this so when you talk about because
that's that's one of my heart and soul. Therapy works, Amen,
therapy works, and attorney ursua that I'm hoping that the
thirty eight years I've been doing this show, I hope

our listeners have took that to heart because therapy works.

things that stand out to you with therapy that you like.
What's a nugget that you want to share with us
from therapy.

I think therapy helps you to.

Get into yourself and deal with what other whatever issues
you have been dealing with, because a lot of our
issues start in childhood.

Oh amen, it's starts in.

Childhood, and as we get an adult, sometimes we have
not let them go and you have to learn how
to let them go, and therapy helps you to deal
with that.

Speaker 7 (28:22):
So it's okay. But remember all of a lot of
our issues began with childhood.

Speaker 10 (28:29):
Yes, as children, I agree, And then we have to
learn how to work past that. Because even though today,
at the big age of twenty five, fifty two, sixty two,

they say that you get superhero hero strength when your

how could that woman pick up a car because her
child was under the car.

What happens is everything in you.

In that moment of emergency, all your other systems shut down.
You don't need to be digesting food. What happens is
your heart rate increases. You know, you have this anxiety,
but it gives you the motion to do what you
need to do. If that's run, well, imagine being a
people that are living like that every day, you know,

because we are we are a very high anxious society
and we are living in this high stressful situation daily
without getting any relief, you know, And unless you know that,
and so go back to the therapy, how do you
know that If you don't know that that's what's happening
to you, and how do you know what to do

with it?

How do you know what's happening in your body?

In your body right.

That you're that you're you know you're you're in. Stress
will kill you, yes, okay, oh yeah, it will. That worry,

So those racing thoughts, you know, those sleepless nights, and
and what I'm saying is, you know there might be
seasons for you. Everybody goes through something in life. Yours

deal with it in life. And I know a lot
of people do that, you know, spiritually, that's why they
go to church. I mean, there's a number of ways

that you can make sure you're keeping yourself built up.
But what I've learned, even with the spirit Man, that
the spirit Man tells me to go to the medical
doctor when I have an ailment, you know, I'm still
gonna believe God for my healing. I'm the spiritual component
is there, but the scientific component is also there. I

do not understand why as a people we do not
see it the same way with our mental healthy because
our mental health determines everything else, including our physical health.

Yes, that is good.

So if you are facing a situation in which you
have shame and regret about your financial situation, you have
just heard a powerful speech from Attorney Johnson and BEV
that are advocating to get rid of that pain. Should

our children's needs not realizing that as they grow older,
and even some that are young, their needs just really

become greeds. Mama wants your time, baby, I just gave
you two hours, Like mama gotta go. I got a
man too. I want to spend time with the one
that I love. Well, can you just please braive my hair? No, ma'am,
the promise was to do it on.

Saturday, and sometimes you have to put your feet down
and have a boundary.

Co signing debt. I am not a believer in co
signing debt for your children because they need to build
their credit. Is the interest rate gonna be hired? Yes,
you need to start building their credit when you're young.
We can get into all of that. You all have
operation hope.

people can do to save money and build a teen's credit.
But by no means should you be putting yourself in
a financial position in which you can pay your own bills,
because you're paying those of a child and of an
adult child. It's now time to teach responsibility. So there
are times in which we have hope for ourselves, but
we have shame and regret for others. But again, therapy

will work through all of that. So with all of
that said, we've worked through the emotions, You're like, okay, Urstena,
all right now, I'm ready to move towards a solution.
So what is a solution when you have too much
debt and not enough money?

Bankruptcy? Bankruptcy is definitely an option.

So how does it work?

Speaker 10 (36:39):
We have two different bankruptcies because Attorney Johnson, one of
my friends, said, I make it.

Speaker 9 (36:44):
Look too easy. I'm on Instagram.

Speaker 10 (36:46):
They laughing with me, and then I'm like, you know, like,
y'all gonna call me a million dollar baby in a minute.
I'm serious because we got rid of a million dollars
worth of debt at about three weeks ago. This week,
one of my when my young adults, got rid of
one hundred and fifty thousand dollars worth of debt. This is, really,
to be honest with you, stuff that we do every day.
I'm just now highlighting it. So she was like, will

(37:09):
you make it look so easy? I was like, you
know what, Well, let me what's the process of actually
filing bankruptcy?

Speaker 7 (37:15):
Is easy?

Speaker 9 (37:15):
I only need four pieces of documents. We're going to
go over that.

Speaker 10 (37:18):
But the emotions behind getting to the point when you're
making a decision, you know, the shame, the regret, the fear,
and then ultimately the hope. You have to go through
those stages in order to make that decision. So I
want to walk everybody through that. So now we work
through the emotions. We have Chapter seven, we got chapter thirteen.
Those are our options to get work us towards being

(37:39):
debt free. Chapter seven straight bankruptcy. One of my para
legals told me today, Ursula, do you know that the
chapter seven filings? You are a very prominent attorney because
you make sure that your clients filed chapter seven or
chapter thirteen. You don't just force them into a Chapter

(37:59):
three wage journer. So yes, if you're in the sound
of my voice and you're not in a chapter seven bankruptcy,
then you need to be asking your attorney why was
I was I eligible for a Chapter seven? Can I
convert to a Chapter seven? Because the answer is possibly yes.
So if you say, oh, I don't know why my
bankruptcy payment so high, which we're gonna deal with that,

(38:21):
you may want to ask, is it possible for me
to convert to a Chapter seven bankruptcy, which is a
straight bankruptcy. If and that means that you don't have
to pay anybody every month, that means that you are
completely debt free. Well, is it Chapter seven worse than
the Chapter thirteen, No, ma'am. They're all bankruptcy. They will
all be on your credit for the next ten years.
No one works better than the other, you know, as

(38:43):
far as credit wise, it's a It will affect your credit,
but not one is better than the other. But Chapter
seven is ideal because you completely get rid of all
your debt. Then you have the Chapter thirteen wage journer
where you take one payment that you pay towards the
bankruptcy court every month, and it takes care of all
of your credit card bills, old medical bills, old repossessions,

(39:06):
stops garnishments. I mean, bankruptcy will stop it all and
then you can keep more of the money. So to
become debt free, bankruptcy may be an option Chapter seven
straight bankruptcy. You can keep your car, you can keep
your house. You can and keep your investment properties under
a Chapter seven if you're eligible. When you hire US

pushing a button to value to determine if you're eligible,
because you'll never be in a position in which, oh,
somebody's taking your home, somebody's taking your car. No, you
will know exactly what is happening, so you can keep

my in my husband's name only. I moved in this
his house after we married. We will be scheduling and
an appointment with your office to get a will to
include me on the property as of now, since I'm
not on the deed. If something was to happen to

both of us, me and my husband, will my children
have rights to come into the house and get my
belongings such as clothes, jewelry, pictures, and any paperwork and

for the letter, but I want to kind of break
down a few things in this letter. Okay, So one
is you said the first thing. The first thing you
said that you want to schedule the appointment to get
a will to include you on the property. All right,
So Attorney Johnson is going to speak more about how

that's going to work with a will. But a will
will not add you onto the house, okay while the
person is living, right, a will becomes effective once someone
passes away. They're no longer with us. So if you
want to be added to the house while your husband
is alive, then we need to do that with a

(54:18):
quick claim deed or any other type of deed of transfer.
So sometimes people become uncomfortable when we start talking about
quick claim deeds. But quick claim deeds are definitely acceptable
to accept when you are getting it from someone like
an attorney who has done a background check on the
house to make sure that the person who's transferring it
to you actually owns it. Because that's what gets scary.
So the first thing I want to say is, yes,

(54:40):
we can add you to the house. A will is
definitely necessary. Attorney Johnson is going to speak about that,
But a quick claim deed or any other type of
deed or transfer is what's going to transfer you to
the house. And then You're go on to say, and now,
since I'm not on the deed, if something was to
happen to both of us, me and my husband, will
my children have rights to come into the house to

(55:02):
get my belongings and then you know, close jewelry, pictures
and then my paperwork, personal things belong to me. So
now I'm getting ready to pivot and give it to
Attorney Johnson so that she can address these issues.

Okay, these are very very good questions, and we do
find that, you know, there are a lot of blended
families and a lot of times, you know, we find
love later in life. We have adult children elsewhere, so
I understand the scenario. It is quite common. So these
are very good questions, and I bet someone else out

there has them. First of all, you need to know
that as a spouse, regardless to whether or not you're
on the deed, if your spouse passes away without a
will or a trust, you are one. You may be

(55:59):
the soul, but you are one of the heirs at law.
So what that means as far as the home that
you are residing in is that if your husband passes away,
you do not automatically inherit that home because you're not
on title. He owned it before you moved in. But
as espouse, you are one of his heirs. So what

will happen in that situation is that you will inherit
that home with his adult children. Okay, you will inherit
that home with his adult children. And then the question becomes, well,
then what happens, because can his adult children put me
out of the out of the home. As a spouse,

(56:42):
you have something called spousal rights, and you have a
homestead allowance or a homestead exemption, okay, and because that
is your place of residence, there's some extra protection for you.
And so what that means is that if you allege

(57:03):
your homestead rights, then the children would either have to
pay the homestead allowance in Tennessee, I believe it's thirty
five thousand dollars right now, or you know, there could
be a homestead what we call a homestead what we
call set aside, which means the court would set aside

(57:25):
the home for you to live in the home for
a period of time, and sometimes it could be for
that surviving spouse's life. You know, you know a lot
of circumstances are considered, but I wanted you to know
that doesn't mean the children won't inherit, because the children
will still inherit when that spouse, you know, when those
spousal homestead rights are over.

Speaker 7 (57:47):
So that's number one. Number two.

Speaker 8 (57:50):
Your children. You asked the question about whether or not
your children would have any rights. Now, we're assuming that
your husband passed away first, and then we're saying that
you passed away second right, and so will your children.
I'm assuming that if your husband is alive, prayerfully, there

(58:11):
will not be an issue with him allowing your children
to come in and get your things. But assuming that
your husband has passed away and now you've passed away,
you want to know what rights your children will have. Okay,
if you pass away without a will, and let's say
you own you have a one third interest in the home,

(58:33):
because the children own the other two thirds, your one
third interest could go to your children. So that means
I know this gets complicated, but that means that your
children would now be owning your deceased husband's property with
their step children, step siblings, step siblings, yes, and so

(58:57):
will they have some rights to get your belongings absolutely,
they'll have rights to get your belongings out of the
home when you pass away. That doesn't automatically your personal
belongings are not inherited by your deceased husband's family. They
are inherited unless you have a will and you decide
to leave it to them. But they are inherited by

(59:18):
your children.

But what about the husband, what about the What if
the wife dies, husband is alive, kids want to come
in and get the jewelry. Cannot the husband and the
children inherit correct?

Speaker 8 (59:30):
That is correct without a will, both inherit the husband
and the children. And well, oh my goodness, when we're
talking about yeah, if he's not if he's not willing, okay.
This is the other thing that you have to know.
It depends on how long you've been married, okay, And
that you know will let you know how much of

the estate that you're entitled to. So if you've been
married for less than ten years, you may be entitled
to a third of the estate, but if you're married
more than ten years, you might be entitled to forty
up to forty percent of the estate.

And so when when wife dies and husband is still alive.

Husband can get thirty to forty percent of wife's assets,
and then wife's children can get the other. So Attorney
Wood said, well, what about the jewelry. Well, we look
at the assets as a whole and hopefully we're able
to divide them out in substantial equal value. So this

person may get the jewelry, this person may get the
big screen TV, this person may get the car, but
in substantial equal value, keeping in mind that that spouse
is going to have a right to.

Get between thirty to forty percent value.

doing in this particular situation and smart that they're just

want that. The answer is no, you cannot cherry pick.
You cannot specify which credit card you want and which
credit card you do not want under bankruptcy. As a
matter of fact, there are federal guidelines. I think, oh,
you'll see the video on tomorrow. There are federal guidelines

that tell you that you have to report all of
your assets, and you have to report all of your debt,
so you cannot cherry pick which credit cards you do
or do not. Matter of fact, the top two things
that you should never ever do if you're considering filing bankruptcy,
give me sixty seconds.

These are the two things that you should never do
so it'll keep you out of trouble before you file bankruptcy.
Do not sell your assets, meaning that you do not
want to say, oh, I'm going to go and scramble
transfer all my property to my relatives. They'll never know,
and then I can get away with this. Do not
do that because the bankruptcy court will know all of
that is a public record. How will they know because

(01:04:30):
all they have to do is look at the Shelby
County Registered website and they can see everybody's business from
the beginning of time through today. Well, I got it deleted, child,
This is twenty twenty five. There is no deleting. If
it's in there, it's in there forever. So do not
sell your assets prior to filing bankruptcy, because we can
end up ultimately having to get those assets back And

(01:04:50):
when I say prior to, I mean within the last
twelve to twenty four months, because that's the look back
period for the bankruptcy court to see what you have transferred. Now,
have you transferred to five years ago, you're fine, but
if you did so within the last twelve to twenty
four months, they can look at that. The second thing
I do not want you to do is do not
pay your credit card bills and loans and things like that,

(01:05:11):
and you know you're getting ready to file bankruptcy, because
why throw good money after bad If you know that
you're getting ready to file bankruptcy, why are we paying
bills that we know we're going to bankrupt?

You may say, well I was undecided, Well okay, but
we want to be able to preserve our dollars, our
resources for what we need, you know, food, gas, light, rent,
and then of course pay the credit I mean, do
not pay the creditors because we're getting ready to bankrupt them.

But on the on the good side, you are able.

Speaker 10 (01:05:39):
Because I had another question, Am I able to get
rid of property tax debt? So I want to Turney

they you know, they dug put the head down in
the hole like an ostrich and pretended like it wasn't happening.
And sometimes we do that because emotionally we need to
check out for a minute. It's too much pressure.

If you've done that, I'm not judging you for doing it.
I've done it before myself.

But if you have buried your head in the sand
and now your house has been sold for delinquent taxes,

we do if nothing else, if all else has failed,

responsible for paying the thirty five thousand dollars in what
exactly is the homestead?

So a homestead is the spousal right, one of the
spousal rights that a surviving spouse has. There's a couple
of rights that you have as a as a surviving spouse.
One of them is homestead. Another is elective share.

So the elective share that we talked about is that
the spouse gets to choose whether they take the thirty percent,
the forty percent, or just to take a child's share
if it's ten children, and she can just say we'll
all divided one tenths. So you have elective share. That's
elective share. You also have homestead. What that means is

(01:11:47):
if that home is sold so that all the airs
can be paid out. Then the wife will get an
additional thirty five thousand dollars. So let's say the wife's
share is already one third and the children are getting
two thirds. Well, her homestead is going to allow her

(01:12:10):
not only to get her one third, but an additional
thirty five thousand dollars from the sale of that house,
because that is the homestead exemption amount in Tennessee.

Speaker 11 (01:12:21):
Oh okay, I got you in Okay. So the kids
being would have to put that thirty five thousand dollars together,
or however it's got to come out of the coursetion come,
it will come, it would come.

Speaker 8 (01:12:35):
No, it would come from the estate. The children don't
have to come out of their pockets. It's what's this
is what she is due from the estate.

Speaker 11 (01:12:46):
Right right, I got you, I got you.

Speaker 7 (01:12:48):
And so if the estate, you.

Know, has lots of money and they don't want to
sell the house, but they want to, you know, give
her that you know, that thirty five thousand dollars exemption.

They can do that. The other thing that that homestead does.

Speaker 8 (01:13:04):
If you don't want to sell the house, if you
don't want the thirty five thousand dollars. Then what you
can do is you can ask for a homestead set aside,
which means I just want to live here. You know,
I'm seventy years old, my husband just died. I don't
have a job, I don't have credit, I'm not this

(01:13:28):
is I've been living in this house, you know, twenty years.
I don't want to leave, you know, And the court
would so you as a spouse because now if it's
investment property or rental property as a whole nother story.
This only applies if it's your marital home, then you
then the court would set aside a certain amount of

(01:13:49):
time to allow you to live in that home. And
a lot of times what happens is when you're negotiating
with the adult children that own the home with you.
These are your spouse's adult children. A lot of times
what happens that I've seen is those adult children are
not necessarily trying to put the surviving spouse out, so

(01:14:10):
they'll say, okay, we we will agree to allow you
to stay there, you know, for this period of time,
and we'll let you stay there for the rest of
your life. But that means you're gonna have to give
us all the interests in the home. So remember we
talked about that one third she could leave to her theirs.
If that Usually if those adult children, they'll say, hey,

(01:14:33):
you can stay for your life.

Speaker 7 (01:14:34):
You can say as long as you want to. But
the but when you pass away, all the home is
gonna come to us. Yes, yes, okay, yes, So just
keep that in mind, you know.

Speaker 8 (01:14:47):
But the best thing is, you know, I know that
spouses do have rights because of course, because over you know,
over time history there's been a need.

Speaker 7 (01:14:58):
For widowers to have some level of rights and not
just be left on the street.

Speaker 8 (01:15:02):
But you don't want to depend on that, you know,
And then you don't want to depend on having to
go to court and fight that or even having to
apply for a homestead exemption. The best thing to do
is if you're in a you know, if this is
your second marriage, or if you have outside children, the
best thing that you and your spouse could do is

(01:15:23):
come and and draft a trust for your property right
and then you know, have all of your decisions made
with respect to whose children get. The spouse is protected,
plus your children are protected and everybody's protected.

Well, well, uh, everything thoroughly, and I understand it because

but you would have to share those rental properties with

got two kids out, and then that means that you
all of those children along with yourself have to navigate
those rental properties. That also means if you're going to refinance, okay,
let's get let's get granular. So if you need oh, okay,
well I'm gonna take all these houses and refinance because
you know what, I'm gonna go in and buy an
apartment complex. Well, shure, slowly roll because now, unfortunately, this

is not the legacy that you and your husband built,
but this is now the legacy that belongs to his
entire estate, meaning his children in or outside of the marriage.
