Speaker 1 (00:00):
Time for our Ask the Lawyer segments we present every
week at this time, presented to you by Bruce el Shiner,
Attorney for the Injured. Maybe today is the day you
get your question answer. We're certainly going to cross our
fingers on that, and we are about to find out.
Would you please help me? Welcome Bruce Elshiner, Attorney for
the Injured. Good morning, Bruce, Hey.
Speaker 2 (00:19):
Good morning Todd. How are you doing this beautiful morning?
Speaker 1 (00:22):
I'm really loving this slightly cooler air we're getting. I
know it's not everybody's cup of tea, but I'm liking it.
I feel good.
Speaker 3 (00:28):
What about you?
Speaker 2 (00:29):
I don't think we could. I don't think we could
have a nicer day than today. Is beautiful.
Speaker 3 (00:34):
I know it. I know it.
Speaker 1 (00:36):
Let's hope we can hang on to it. I think
through the weekend it's gonna stay really nice. So that's
the good news, and it's great to be able to
get out and enjoy it. Not everybody is as fortunate,
such is the case with a victim in our email
of the week. Are you ready to take it on?
Speaker 2 (00:53):
I am ready, Todd.
Speaker 1 (00:54):
This is right up your alley, being the biker's lawyer
and everything. Here's what it says. I was, I think
my Harley Davidson on US forty one when another driver
blew a stop sign, causing me to run into him.
The other driver was uninsured. As a result, I sustained
a serious neck injury that required surgery. I'm a carpenter
(01:15):
and I'll be out of work for several months. I
own a pickup truck insured with Progressive and a car
insured with All State. I had stacking uninsured motors coverage
on my pickup truck and on my car. However, my
Harley was uninsured. Since the other driver was uninsured and
I had no insurance on my Harley?
Speaker 3 (01:36):
Am I out of luck? Wow?
Speaker 1 (01:39):
There's a lot of insurance entanglements going on here.
Speaker 3 (01:42):
Can you make sense out of this?
Speaker 2 (01:44):
I make great sense out of it. And this Harley
driver is very lucky because he fits into an unusual
situation because he has that and that's the critical term.
Because he has stacking uninsured motors on both his car
(02:08):
and his pickup truck, he's entitled to stack, which means
to add one coverage to the other coverage to make
a recovery, even though he has no insurance on his Harley.
So let me say that again. He has no insurance
on his Harley, but he has stacking on two other vehicles,
(02:33):
even though they're different companies. He can stack the Ulctate
on top of the Progressive and recover from both. So
he's a very fortunate person. He'll be able to recover
his extensive medical bills because of his neck surgery. He'll
(02:54):
be able to recover for his loss of work as
being a carpenter us. He was smart enough to obtain
stacking uninsured motorists coverage. Wow, that's the key, that's the
key word of the day. Unfortunately, when people go to
their insurance agents, insurance agents discourage people from getting uninsured
(03:20):
motors coverage, discourage people from getting stacking. But stacking uninsured
motors coverage is the best thing a consumer could bye.
Speaker 1 (03:32):
Well, there's sort of a life lesson in here, and
that the accident occurred with and uninsured driver. And as
you've pointed out so many times, there are so many
uninsured drivers unfortunately on the road.
Speaker 2 (03:43):
Yeah, one in five cars on the road have no insurance.
Speaker 1 (03:47):
Scary, fortunately, very scary, very scary. Well, it looks like
a brighter future for this gentleman. So we're so glad
that we reach out to you like the biker's lawyer.
As I say, I knew you'd have an answer for this.
As always, we appreciate your time. I'm in your wisdom
and your knowledge.
Speaker 2 (04:02):
It's my pleasure, Todd. And the keyword today is stacking uninsured.
Speaker 1 (04:07):
Well if you bet, you can't emphasize that enough. Thank
you so much, Bruce. You have yourself a great week,
My pleasure. Take care.
