Speaker 1 (00:00):
Good morning on Todd Matthews. It is nine thirty proper.
Somehow we were off scheduled earlier. We got back on
track and it's at this point on Wednesdays we've proudly
presented for over a decade. Now ask the lawyer with
Bruce L. Shiner, maybe your question will be the one
answered today we're about to find out. I'll also tell
you coming up in a moment, how to submit a
question for future consideration. If that's something you would like

(00:21):
to do, would you please help me in welcoming Bruce Elshiner,
Attorney for the injured.

Speaker 2 (00:27):
Good morning, Bruce, Hey, Good morning Todd. How you doing
this beautiful morning?

Speaker 1 (00:32):
Really good? I'm spen hot for me a bit lately,
but otherwise can't complain. How about you.

Speaker 2 (00:37):
I'm doing great. Thanks for asking.

Speaker 1 (00:39):
Everybody at home and in the office. I know you've
got a lot of staff supports to everybody doing okay.

Speaker 2 (00:43):
Everybody's doing very well. Thank you.

Speaker 1 (00:45):
Good glad to hear it. And PJ. Haven't talked to
him or about him in.

Speaker 2 (00:50):
A While's excellent.

Speaker 1 (00:51):
Good And the grand babies. I got to check on everybody,
the grand babies.

Speaker 2 (00:55):
The grand babies are doing great. They're summer theater program
and next week in they're putting on a show.

Speaker 1 (01:05):
Oh, that's gonna be so much fun for you. That's
going to be terrific. Make sure to spoil him afterwards.

Speaker 2 (01:10):
I'm sure you will Ice scream for the grid kids.

Speaker 1 (01:14):
There you go, there you go. Well, we need little
help with another sort of bad situation. I guess you'd
call it could be worse. But here's somebody who doesn't
know which direction to turn, and I think you can
be helpful. Are you ready for the question, Yes, sir,
all right. The email says my father in law was
riding his bike along Midway Boulevard when a landscaping truck
sideswiped him and caused him to crash. The driver had

(01:36):
just been fired that morning, but the company claims they
aren't responsible because he was no longer officially working. His
boss allowed him to take the truck to drop off
his belongings at home. My father in law has multiple
leg fractures and may never walk normally again. The medical
bills are already overwhelming, and he doesn't have health insurance.

(01:57):
Is there a way to hold the landscaping company accountable
for Well? These are the kinds of questions we present
to Bruce, and he always has got great answers.

Speaker 2 (02:06):
What do you say, Well, there's good news for this
unfortunately injured person. In Florida. There's a concept known as
dangerous instrumentality cool, and that means when you're the owner
of a motor vehicle, you are liable for whoever uses

(02:27):
it with your permission and consent. Okay, So even though
he was fired, the boss gave him permission to use
the vehicle, and the company is responsible. So their insurance
will have to respond and take care of this poor
injured person. They're going to have to pay for his

(02:49):
medical bills in the past, medical bills in the future,
loss of income, pain and suffering, and all the other
intangible days.

Speaker 1 (03:01):
One would hope that being a landscaping company, they would
have more than adequate insurance so there would be the
funds necessary to make a recovery here. But they're not
just going to fork it over, aren't it.

Speaker 2 (03:14):
No, they're not. You're going to need to experience personal
injury worrier to pry it out of it and get
a substantial recovery.

Speaker 1 (03:23):
Yeah, but it's there if you start working on this
right away. As we as we typically advise it's important
to move quickly on these things. Don't wait, get a
hold of a legal professional today, exactly. All right, Well, the.

Speaker 2 (03:39):
First thing they should do is call an experienced personal
injury attorney.

Speaker 1 (03:44):
And I'm sure you've seen this kind of thing happen before.
And then bosses end up maybe backtracking and saying, well
I didn't give them permission or whatever. But that's kind
of thing that you don't know how to deal with.
We know to leave that up to you.

Speaker 2 (03:56):
Thank you very much.

Speaker 1 (03:57):
All right, well, Bruce, hopefully they're listening and this gives
them a little bit of hope then they'll follow the advice.
And I thank you once again.

Speaker 2 (04:04):
Oh it's my pleasure, and I look forward to your
interesting and challenging questions. Next to way to say.

Speaker 1 (04:11):
As do we you take care and have fun with
those grand babies.

Speaker 2 (04:15):
Now, thank you, Okay, bye, bye.

Speaker 1 (04:18):
Ladies and gentlemen. Bruce el Shiner, Attorney for the Injured. Now,
if you would like to submit a question for future consideration,
it's really pretty straightforward. You go to the station website
and you put Bruce in the keyword search box. If
you've got an injury that is kind of happening like
in this case, and you need some immediate help, though,
I would recommend reaching out to the Port Charlotte Office
