Speaker 1 (00:00):
Good morning.

Speaker 2 (00:00):
It's nine twenty nine and just about nine thirty, and
that means on Wednesdays it's time for Ask the Lawyer
with Bruce L. Shiner, where we get answers for tricky
questions evolving the law from somebody who really knows this stuff. Questions.
They are largely contributed by you, and I'll tell you
how to send your question in for possible future consideration
here in a moment. But I don't want to keep

(00:21):
Bruce waiting any longer than is necessary. Would you please
help me? Welcome Bruce EL Shiner, Attorney for the Injury.
Good morning, Bruce, Hey.

Speaker 3 (00:28):
Good morning card. How are you doing this morning?

Speaker 2 (00:31):
Just fine? How about you?

Speaker 3 (00:33):
I'm doing great, Thank you.

Speaker 2 (00:34):
Which is the answer I always expect from positivity. And
we've got a question here today that is right up
your alley. I know you're going to have some great
feedback for us. It's also kind of scary in the
sense because it's the kind of thing that can happen
to any one of us. Are you ready?

Speaker 3 (00:51):
I'm ready to all right.

Speaker 2 (00:52):
Says My wife was shopping with a friend at a
large hobby store when she slipped and fell due to
a large puddle on the floor. Her friend, who almost
lipped as well, got the manager, who then called an ambulance.
My wife has a shattered kneecap and as a result,
we'll have to have replacement surgery, the manager said. The
roofing company was supposed to have fixed the leak two

(01:15):
days ago. The manager said the company would handle all
the medical bills. Still, when we contacted the corporate offices,
they indicated the roofing company was responsible and we would
have to contact them. We feel like we are getting
the run around. Oh boy, is that common? Can a
lawyer help us? What do you make of this?

Speaker 3 (01:36):
Well? I make it. You know, it's typical. And the
most important thing to realize is that when you face
a significant trauma, you need to call a professional right away. Sure,
because there's a lot of things that are developing. So

(01:58):
in this particular case, the store.

Speaker 1 (02:02):
Knew that there was a roof leak, so that they
should have put up a big sign wet for They
should also have cordoned off the area. And the store
is responsible. And you know, it's like when we talk

(02:23):
about insurance companies, their model is we never paid, call
the roofer, call uncle Jack.

Speaker 3 (02:31):
We don't want to give. We don't want to give
you any money. They created a debt to this poor
customer when this poor customer fell in a wet area
that they should and did know about and didn't do
anything to protect their customer. So that person is entitled

(02:56):
to have their medical bills paid, both past medical future
medical lost learnings if they're out of work, pain and suffering,
and all the other intangible damages.

Speaker 2 (03:10):
I think it's important to remember, and this is something
I've learned from the over a decade's worth of conversations
that you and I have had together that any place,
any store, any retail shop, or anything like that, they
have an obligation to provide a safe environment for you
to shop in. Anything they do that that goes against that,

(03:31):
they're on the hook for.

Speaker 3 (03:32):
That, absolutely, absolutely.

Speaker 2 (03:36):
So quickly reach out to a professional to kind of
get things started. Is this one of those cases where
there might be some responsibility on behalf of the roofer
or does that not figure into this at all?

Speaker 3 (03:45):
You don't. We have to know more facts whether the
roofer would be have any responsibility. But you know, you
have a big store that you know, as sufficient askedts,
and I'm sure has great insurance, Miron, My attention would

(04:06):
be focused on the store where they were shopping, that
all of them with duty.

Speaker 2 (04:13):
That's right, and that's what this person needs is somebody
to focus all of their attention on her case and
get started and do it quickly. Okay, Bruce, sounds good.
Thank you again, my pleasure, Tyle.

Speaker 3 (04:24):
Looking forward to your next challenging question next week.

Speaker 2 (04:28):
As we are already as well.

Speaker 3 (04:30):
You have a good one now, Thanks Tyle.

Speaker 2 (04:32):
Take care, bye, bye, ladies and gentlemen. Bruce el Shiner,
Attorney for the Injured. If you'd like to submit a
question for future consideration, you're welcome to do so. We'd
love to have it to pass on to Bruce see
what he says, and you can do so through the
station website. Just put Bruce in the keyword search box.
But if you're injured, I wouldn't wait for that to happen.

(04:53):
What I would do is call the Port Charlotte Office
of Associates and Bruce el Shiner right away nine four
one seven four three seven seven seven seven. The question
was ash Am I getting the run around? Well, if
you are, this stops at quickly. One phone call nine
four one seven four three seven seven seven seven. Please

(05:17):
remember to tell them that Todd Matthews sent you
