Speaker 1 (00:00):
Here.
Speaker 2 (00:00):
It's a nine thirty two. It's at about this point
each Wednesday we present Ask the Lawyer with Bruce Elshiner,
Attorney for the Injured. And when something happens, you could
take that attitude, oh is whatever it is, or you
could reach out to somebody who can provide some help
for you. And that's what this segment is all about,
largely answering questions provided by you. I'll tell you how
to submit a question coming up here in just a
(00:21):
quick moment, but first help me. Welcome Bruce Elshiner, Attorney
for the Injured. Good morning, Bruce.
Speaker 1 (00:29):
Hey, good morning Todd.
Speaker 2 (00:30):
How are you today?
Speaker 1 (00:32):
I'm doing excellence. Thank you. I appreciate your asking.
Speaker 2 (00:36):
As if I didn't already know the answer to that one.
He's mister positivity, got to be honest with you on
that also brings a positive approach to all of these
questions that we ask, plus a lot a wealth of experience,
many many decades in the business. So got another situation today. Unfortunately,
these are always a little bit of a tugget heartstrings
(00:56):
when there's a child involved. Are you ready for.
Speaker 1 (00:58):
Today's I am ready, Todd.
Speaker 2 (01:00):
Okay, here comes the email. My neighbor's twelve year old
daughter was riding her bike on the sidewalk when a
pickup truck pulled out of a driveway without stopping and
ran over her front tire. She broke her arm and
lost several teeth. The driver says he didn't see her
and blamed her for riding too fast. Are there laws
(01:21):
protecting children in cases like this? Can the lawyer help
the family? Again, It's just it's so sad to hear
when there's a child. She must have been awfully scared
when this happened too. So what do you make of this?
Speaker 1 (01:32):
Well? I make that the driver's excuse is absurd. Okay,
how fast could a young girl ride her bike on
the true? On the sidewalk? True? You know we hear
this every week. It's just, Hey, I did a bad thing,
but I don't want to be held responsible. Yeah, that
(01:57):
driver is absolutely respond for all the medical bills that
the poor young girl's going to accumulate. Gonna be responsible
in the past and the future. Being involved in a
in a serious accident like that could have psychological damages
(02:20):
to the young girl.
Speaker 2 (02:21):
Yeah, I was wondering about that.
Speaker 1 (02:22):
Yeah, she may may need treatments for that. He's responsible
for all that. Plus you know pain is suffering and
all the anxiety and aggravation the young girl's going to
go through.
Speaker 2 (02:35):
Yeah, yeah, that's sad. You mentioned psychological impact in it,
and it occurred to me this is this is a trial.
He probably is going to say from now on, I
don't want to ride my bike anymore. And obviously that's
that's something we don't want a child to have to face.
So might involve that certainly involves all the rest of
what you just said. So the best thing to do
would be the contact a legal professional pretty quickly on this.
Speaker 1 (02:58):
That would be the best advice I could be.
Speaker 2 (03:00):
The thing I like about you, Bruce, and I didn't
mention this before because you didn't have any idea. You
know what we're going to ask here is but you
also are extremely compassionate when it comes to these kinds
of things, and working with a child requires even an
added degree of compassion. But I know you've worked with
countless children in your long career.
Speaker 1 (03:20):
It is I have, and you know you have to
spend extra time and make sure you know you treat
the child rights so that they could come out of
this situation. The best they possibly can not.
Speaker 2 (03:34):
To mention that you, being a proud grandfather, have a
special soft spot in your heart for kids.
Speaker 1 (03:39):
I know I love my grandkids absolutely.
Speaker 2 (03:42):
Well, let's pass along that advice. Then hopefully they're listening
and they will reach out to a legal professional as
soon as possible, and I'll give you a number out here.
Again in the moment, I want to take the opportunity
to thank you though, Bruce, for weighing in today.
Speaker 1 (03:56):
Oh it's my pleasure time and I look forward to
your interesting and challenging question next Wednesday.
Speaker 2 (04:02):
Absolutely, you have a good week. Say hi everybody, Thank
you again.
