that I would to talk about this and it's a
serious matter. But as I continue to watch society just
just dive into the slime. This is going to become
a question we're going to have to face, absolutely going

if you're in the car right now, got the kids
with you, put in a CD or something, listen to
the podcast later. I don't know that I would. If
I had my little ones with me, I don't know
that I would. I'd be listening. Just being honest with
you because this is a rough story. My question, how

young is too young to be hauled into a courtroom
and taken to trial, even as an adult, if you
have not reached the age of eighteen. As you watched
the social media, there's constantly videos are out there, security

camera video and so forth, young people just being just
being animalistic, whether it's a bunch of people fighting in
a fast food place, hopping over the counter, stealing food,
beating up the employees walking in unmasked to a jewelry

store and them all breaking out glass and everybody just
grabbing a free for all, going into a department store,
grabbing arms full of clothes that I'm sure will pop
up on Craigslist or marketplace or something. We're seeing this constantly,
constantly now, and yet everything that I just say said

pales in comparison to the story that inspires this question.
How young is too young to try them as adults?
Stories out of Cleveland, I have not seen much in
the way of local coverage. I'm not saying nobody's covered it.
I'm saying I haven't seen much in the way of
local coverage. Spectrum One did cover it. I will take

the details of the story from their website. A Monday
social media post from a mother claims that her five
year old daughter was physically and sexually assaulted by a
group of other kids and left unconscious and unresponsive on

(02:37):
September thirteenth. The post has been shared more than a
hundred thousand times at the time of this writing. Spectrum
News One is not naming the mother of the victim.
Good for them. In her post, the mother said that
her daughter had been staying in the trusted family member's
home on the city's east side while the mother was

(03:00):
undergoing a medical procedure. Her post states that she got
a call that her daughter had walked out of the
house and could not be found, and the authorities had
been contacted. She said her daughter was approached by a
group of bigger kids around ages eight, nine, and ten,

who took her to a field where they beat and
sexually assaulted her eight nine and ten. When the mother
arrived on the scene, she said she approached an EMS
truck and found her daughter unconscious, unconscious, bruised, and bloody.

The mother stated in her post that when the family
member that had been seeking her daughter arrived, she ran
into two of the children and asked them if they'd
seen a little girl, and they said no. After that
family member had returned home awaiting authorities, the same children
came back with their mother and said that they did

(04:08):
in fact know where the girl was. According to the post,
they took the family member to a field where she
found this little girl. The mother said she didn't wish
to get the media involved, but she's done so because
she was informed that two of the boys, ages eight

and nine, would not be charged due to their age.
She says she's reached out to Cleveland Mayor Justin Bibbs's office.
The Cleveland Metropolitan Bar Association and others to get help.
In response to an inquiry about this case, Cleveland Police
Sergeant Freddie Diaz confirmed this via email. Here's his statement.

The Cleveland Division of Police Sex Crimes and Child Abuse
Unit is actively investigating the case, involving multiple children under
the age of ten as victims and as suspects of
the investigation. Given the sensitive nature of the matter, the
release of further information at this time could jeopardize the
integrity of the investigation and violate the constitutional rights and

privacy of those involved. Data on the Cleveland Division of
Police's a crime incident table showed following offenses near the
address of the mother's post on that day. Two assaults,
a felonious assault, a rape, sex offenses, and all other

(05:32):
offenses with a category. The case number associated with these
offenses also matches one provided by Diaz. In addition, the
County Prosecutor's Office has confirmed that they are aware of
the ongoing investigation. They say, we are aware of the incident.
Our office has not yet received the case and no
charging determinations have been made. That's from Alexi Bauer, who's
the communications manager at the Cuyahoga County Prosecutor's office. She

also said the case is still under investigation by the
Cleveland Division of Police Police. Once the case is submitted
to our office, we will review it for criminal charges.
Former Ohio Attorney General Mark dan said this case could
be difficult to prosecute. Years ago, he said he defended
an eight year old who was accused of rape. One
of the things that was really difficult was to wrestle

with was that whether an eight year old, a ten
year old, or a five year old has the mental
capacity to form the plan to commit a crime like that.
Since the suspects are so young, the parents could be
held responsible depending upon the what investigators find, which I
find personally unreasonable. I do there's only so much control

(06:42):
that you have, and these if you did not find
them guilty of in some way, shape or form, neglecting
or abusing or mistreating or misguiding their children, holding them
accountable for what these little animal children would have done,
that doesn't make sense to me. If the parents of

(07:04):
the children were negligent or were careless or worse involved
in an abuse over its sexual activity in their household,
they certainly had the mental capacity to commit a crime.
Unlike the children, Dan said in a Facebook post, the
mother said it would be unjust if those responsible were
to go unpunished. She is thanked the public for their
support and said her daughter is receiving therapy. To have

(07:31):
these children, if found guilty, walk away from substantial repercussions
is essentially where we are. They're not going to put
an eight year old in prison. What do you do

(07:55):
because we see two off I mean, how the Hyundai
and Kia thefts that were going on. They cooled down
a bit now, it seems at least the media is
not covering them the way they were. But how many
times do we see eleven, twelve, thirteen year old kids
in these cars stealing automobiles, operating automobiles, depriving the rightful

(08:23):
owner of their personal property worth tens of thousands of dollars?
Is it unthinkable that this is the next step? And
how far do you go? How far do you go
toward abolishing repercussions for the deeds that you do because

(08:49):
you're young? Mark Dan I believe is incorrect in his
assertion that it's hard to think that an eight year old,
nine year old, ten year old could even formulate plan
required to commit a crime like that. If you can
commit the crime, you can certainly plan it. And this

(09:10):
was group think. Perhaps one of them was the poison pill,
but the other two went along. Does that absolve them?
I know it's uncomfortable, I know it's frightening, I know
it's scary. I know it's distasteful. I know we really

(09:31):
don't want to do it. But isn't it time we
started formulating our plan on how to lock these kids up?
Prepare for it now, because you're going to need to
do it in the future. Unless you plan on waving
a wine and wand of some sort of changing the world,

(09:53):
you're gonna need to do this in the future. It's
only getting worse. And any nobody who's been on this
earth for a few decades you know that. You know that.
Don't put your head in the sand. And well, this
is just as one one case somewhere, Yeah, one case somewhere.

(10:18):
It's getting worse every day. Heaven only knows where we
will be ten years from now. Look what we've seen
over the last ten years. We have to do something
about it. Distasteful or not locking an eight year old

(10:40):
up until they're twenty one, Well maybe that's what it's
going to take. If you were capable of something like
this at eight, I don't know what you're going to
be capable of at fifteen. And frankly, I don't want
to find out how young is too young to lock
them up. Or maybe that's just me
