ATF assistant director. Rich. Welcometo the program. How are you,
sir, Great Preston, thank youso much for having me. It's an
honor. I appreciate your time,Rich, and thank you for serving our

country. I'm going to assume you'reone of the good guys ATF. Not
everybody there has my favor, butyou're talking on behalf of House Bill one
thousand and seven here that is infront of Governor Rond de Santis. Before
we talk about the bill, let'sfirst disclose and make sure everybody knows your

perspective. Who are you representing here? I represent law enforcement. I teach
at Georgetown University. I work withthe industry, retailers, school counselors,
law enforcement, school resource officers,several several groups that under stand that this
is one of our biggest threats tonational security right now, and that China

is using our children to fund notjust organized crime, but Chinese Communist Party.
I absolutely buy into the notion thatChina is an adversary of the highest
order. I buy into the difficultiesthat TikTok presents. Help me understand the
threat that other than the obvious ofhooking kids to products through vaping. But

this bill in particular is about,if I'm not mistaken, rich, it
narrows the scope of the products thatcan be sold to an FDA approved list.
That is that your understanding as well, Yes, and I applug the
SDA for doing one thing right,and that is to creat a list and

identify the products that one there havebeen approved for use as a tobacco harm
reduction device, and also identifying productsthat the kids are using that are dangerous
these disposable devices, all made inChina, all distributed by organized crime.
That we're taking a stand in.One thing I have to, you know,

emphasize it's very very important, isthe governor having the ability right now
and showing demonstrating to people that he'snot a manager, he's not a babysitter,
evil leader, because a lot ofstates are you know, indecisive about
coming up with a registry or tryingto identify this product and get it off
the shelves. The great thing aboutwhat is happening in Florida right now is

you have a governor who is aleader. Nobody's going to step up to
the play. An individual is goingto make a decision and understand what's in
the best interest of the people ofFlorida. Help me out here, though,
First, I go into this witha massive distrust of the FDA.
COVID had a lot to do withit. They lied to the American people

rich across the board, they alteredpolicies. It's demonstrable. So how do
we place trust in quote the listto begin with, Well, it's very
very easy because the ones that arecoming from China, we don't even have
to use the FDA understand that they'remanufacturing an illegal product, product that's wrong,

a product that's in kids on nicotineto the amounts that we've never seen
before. They're making devices out therethat our children are using that contain five
thousand puffs. There's seventy excuse me, seven hundred million electronics cigarette disposable cigarettes

manufactured by China right now, whichand they're making over three hundred billion dollars
a year on the back of ourkids. It's really simple to understand,
even from the FDA's perspective, andI understand where you're coming from, to
see what has been granted authority tokeep people away from combestibles cigarettes and what

is addicting our children. Industry rightnow is not making fruit to d gummy
bears else far all these youth enticingflavors, it's all being made by criminal
organizations. So even let's have FDAstep out of the box right here and
say we don't want to listen tothem, we don't bl but we can

see just by talking to our children, talking to our school resources in high
schools, talking to our counselors,what the young adults are getting addicted to,
and it's all Chinese criminal product,and every dollar of that money is
being shipped back against our number onenational security threat. This is how they're
making their money, and that's whatthis administration is lacking in enforcement. And

this is what I'm pleased seeing GovernorDeSantis stepping up to the plate, identifying
who the offender is, identifying whatthe problem is, and saying, hey,
look, this stuff does not shouldnot in any way be around our
youth in Florida. We've got toget it off. The show. The
new mayor of Realville dispensing information atthe speed of sound, and if you're

lucky, he'll be wearing his ClarkKent glasses. Today the Morning Show with
Preston Scott talking about House Bill onezero zero seven. It is in front
of the govern earth. The questionbecomes does he sign it or does he
veto it? You're talking with RichMariano sees formerly with ATF he wants Governor

DeSantis to sign the bill. Letme ask you this, Rich, the
products that are on the list bythe FDA, if I set aside my
reservations, which I think we probablyboth agree there's a reason for them,
but if we accept that the productson this list fall within the appropriate criteria.

One of the things that concerns meabout the list is that there are
no products that aren't put out byPhilip Morris Altria R J. Reynolds,
otherwise known as the big tobacco producers. Is that just a coincidence or is
no one else making them? Noother people are making them. The ones

(06:53):
that you're speaking about have passed thepre market assessment in the FDA's looked at
again as a tobacco harm reduction deviceto get people away from combustible Okay,
let me ask you can I I'msorry, I'm sorry to interrupt, but
I have to ask. Because Iused to work with a client that that
sold vaping devices. They were prohibitedby federal law from claiming that those devices

are to stop smoking. They're nota smoking cessation device. Has that changed?
No, I'm just looking at someof the studies. I don't know
if it's changed or not. I'mnot a doctor one and I'm just a
professor that teaches intelligence and organized crime. But what I can't say is the
studies that I've read, and whenwe look in my class and at the

university and we look at this organizedcrime element, we see that the studies
that have shown that we've read atthat the FDA has approved on do work
in getting people away from combustoris.Okay, and this is what and to
make your point a little bit stronger. None of these companies, like if

you go on the web today andyou type in made in China dot com,
there's over four hundred thousand disposable ecigarettes, disposable devices being solved,
and not one has had any criticaltesting whatsoever by any entity, whether it
be the FDA or the Los AngelesDodgers or the Florida Army, whatever you

(08:24):
may say. And the point isin the aspect of what you're talking about
in terms of theisation device, thesehave been looked at by the FDA and
they've been granted approval for sale,and they've done the test and they've went
through the process. None of theseChinese products, these criminal products, have
ever went through the process. Andthat is the danger to our youth.

(08:46):
We don't know what's behind what's inthese things, and are there any regulations.
Absolutely not. They're all designed asan addictive entity to get into our
kids' minds that are disrupting schools,descrupting the time for law enforcement. You
talk to a school resource officer,he doesn't even have time to look at
online threats and bullying right now becausethe majority now are writing referrals for vake

devices. That is unacceptable. Wewant them serving, protecting, not regulating
an arressment. Let me have tochange this dynamic. We got thirty seconds
left. Let me just ask you, what do you say to those out
there that are they're with you inphilosophy, but they also are holding to
the philosophy of free market. Whynot just ban products from China? Because

you know what, I'm not afree market guy. I'm a cop.
I'm an agent at heart. Andwhat I look at is how China and
Chinese organized crime and our number onethreat to national security is threatening the United
States. In this case, theyare in this avenue. And when you
see a product making three hundred billiondollars a year on the back of our
kids, let's stop the flow ofmoney to a national security threat. Rich,
