Speaking of Tuesdays, next Tuesday is the twenty second. The
Tuesday after that's the twenty ninth, The following Tuesday after that,
that vaunted in November fifth election day where many will
be going to the polls and be saying what exactly
am I voting for?

Of course, we know the president, and you know, if
you're in the Omaha area, the Bacon Vargas Rays, you
know you're gonna have the Fish or Osborne race. You
got stuff that you know you're paying attention to, but
there are some things that you may not be super
familiar with. Got an email from a guy named Mike Moser.
He's the representative in the twenty the district twenty two
in the Nebraska legislature, and he just had some clarifications
(00:41):
about the abortion measures which you are going to find
on the Nebraska ballot. And he is on our phone line,
so I wanted him to call in to kind of
explain this because I feel like he could do it
better than I. Mike, can you explain kind of the
genesis of the email that you sent me and the
explanations that you shot over my way?
Speaker 2 (01:00):
Well? Thanks for having me. I appreciate that I've been
getting some calls from some constituents about the abortion constitutional amendments.
They were trying to understand what they do, and a
number of the pro life callers I got were hesitant
to vote for four thirty four because they didn't think

it was conservative enough. They wanted more abortion restrictions than that.
But because of the way that the two amendments compete
with each other on the ballot, I think it's important
if you are a pro life voter to vote for
four thirty four and against four thirty nine.
Speaker 1 (01:45):
Okay, can you kind of explain what differences there might
be so people can understand exactly what they are voting
for there.
Speaker 2 (01:53):
Four thirty four puts current state law, for the most
part into the Constitution. Four point thirty nine gives way
wider permission to get an abortion. It extends the time

that you can get an abortion until the fetus is
viable on its own, could live outside the womb, and
that's much longer than what the current calendar limits are.
And there are a bunch of other things that expand
the scope of abortion. It also says that the state
(02:40):
and its political subdivisions cannot interfere, so it actually makes
this constitutional clause superior to the sovereign state that uses
the Constitution. I'm not sure that that's a good idea,
but for those who are pro life, you should vote,
(03:02):
I believe, for four point thirty four because if both
questions get more votes for them than against them, the
one who gets the most votes is the one who wins,
so to speak, and gets put into the constitution.
Speaker 1 (03:19):
Right, and what if neither of them get more yes
votes than no votes, then.
Speaker 2 (03:27):
Both questions are moot. I mean their constitution is not modified.
Speaker 1 (03:31):
Okay, all right, so there's a chance. And then what
would happen there? We would just have we would you know,
they would create probably another initiative, you know, for the
next election cycle, but is there We would just go
back to the existing rule as is right now, state law.
Speaker 2 (03:49):
Is you know, current right now until it would be
if it would be replaced by a constitutional amendment that
was approved by more of the voters than those who
voted against it.
Speaker 1 (04:02):
Interesting, well, Mike, this is very interesting. I'm glad that
you brought this up to explain this to us. Again.

Absolutely, absolutely, Just to clarify, I did find this on
ballot Pedia, which is a pretty good website that you
can kind of learn about different measures and races that
you'll find on various ballots around the country, and initiative Nebraska.
Initiative four thirty four is the one that he said,
if your pro life you should be thinking about more
(04:40):
so than four thirty nine. Four thirty four would prohibit
abortions after the first trimester, except for medical emergencies or
cases related to rape or incests. There's those are seemingly
the exceptions that people are really talking about, especially Donald
Trump and some other high ranking Republicans. Four point thirty
(05:03):
nine would establish what they are calling a fundamental right
to abortion until fetal viability, like Mike mentioned, or when
protect when needed to protect the life or health of
the pregnant patient. So this is actually a pretty important
thing that is happening, not just because of the abortion
but also Secretary of State Bob Evden according to ballot
Pedia's list. Here, he says, this November general election ballot
(05:28):
will host two ballot measures that appear in direct conflict
with each other, which could be the first time that
this has happened in Nebraska's history. So you have two
measures that essentially are fighting each other here on this ballot,
and as Mike mentioned, the one that receives the most
votes will be implemented. Now, the measure also significant, you
(05:53):
know why. According to ballot Pedia, this is the first
time voters anywhere will decide on conflicting abortion related ballot
measures on the same ballot. This is the first time
that you've had two different initiatives for two different abortion rules,
and what that would potentially look like. And again, as
Mike also mentioned that the current status in Nebraska is
(06:15):
abortion banned after twelve weeks, and that was signed into
law back in May of last year, So there you go.
It also has exceptions for saving the life of the mother,
preventing serious risks to the physical health of the mother,
and if the pregnancy was the result of incessor rape.
So something to keep in mind. A lot of abortion
ballot's going to be out there around many states after
(06:38):
the overturning of Roe v. Wade. And you know that
on top of all of the contentious races, that we
are going to be paying attention to each and every
