So and so versus so and so, so and so. There were a
lot of people taking each other ontoday apparently at the Supreme Court. And
Josh Hammer, host of America onTrial with Josh Hammer, joins me right
now to discuss it. Okay,Josh, I don't even know where to
begin. I don't know what halfthese names mean. So I'm just gonna

hand you the show what happened today? Jesse. It's always good to join
you, my friend. Look,there were two opinions of political note.
I guess you would say today we'restill winning on most of the big opinions.
I mean most of the terms.Marquee cases have not dropped yet.
The Trump community cases the biggest ofthem all, of course, that will

almost surely come this week. We'restill waiting on the Fisher case, which
is the case involving the j stixers, there being a lot of are being
prosecuted with this Dulius two thousand andtwo law that has to do with corporate
accounting. It's a very dubious useof the underlying statute there, so hopefully,
hopefully we will get a good rulingon that, which by the way,
matters for Trump too, actually,because that statue that the Jay sixers

are being charged with is also thebasis for two of Jack Smith's for indictment
against Donald Trump, or two ofhis four charges in the Washington DC case.
And then we're waiting for a bigadministrative state case that pertains to a
lawyer's call so called Chevron deference.We have an abortion case out of Idaho,
some massive, big tech cases outof Texas and Florida. So we're
waiting on, honestly, most ofthe big cases, and I was hoping

that we'd get even more today,to be honest with you. But the
two cases that drop today, becauseapparently next week is is going to be
an absolute flurry of huge opinions casessay that I think are worth pointing to.
What is the immigration case called Departmentof State versus Munnos. The basic
question here was whether or not aUS citizen has some sort of well established,

historical and therefore constitutional rights to haveyour non citizen aka your alien spouse
immigrate here. And the court veryreasonably holds that you do not. So
this was a six to three decision. It split along quote unquote gideological lines.
That's how the media portrays the sisterthree opinions extraordinarily reasonable opinion. And

by the way, the timing isa little odd, is how an opinion
on basically the exact same subject dropsa few days after President Joe Biden did
that executive amnesty earlier this week.Again pertains this exact same issue pertaining to
the spouse, the illegal alien spouseof a US citizen. So the timing
is a little odd there. Itmakes you kind of wonder whether whether or
not the President's kind of but perhapsmaybe new I'm a leaker because we saw

that this court can leak in theDobbs case. Maybe there was a leaker
leaking to the President that this opinionwas coming. But in an event,
a totally common sense ruling, theopinion that I suspect is going to be
more controversial in our circle's jetsey amongconservatives is the gun case US versus Raheemi.
So this case comes out of theFifth Circuit, which is the court

that I clerked on myself six yearsago. In fact, the judge who
I clerked for, Judge Jim Hoe, was actually on the Fifth Circuit panel
that ruled on this case. SoI've been tracking this case for a long
time. So Raheemi is a caseinvolving eighteen US Code Section nine twenty two
G eight, which is the federalstatute that prohibits individuals with a domestic violence

restraining order from possessing a firearm.And this is a case that comes in
the context of the big Second Amendmentcase that we had two years ago,
the Brewin case where they basically announceda history and tradition test for gun regulation.
What they said in Bruin was thatfor any firearm regulation to be proper
in today's day and age, youhave to essentially have a historical analog,

meaning you can't just make it up. There could be some basis historically for
the regulation, and the Fifth Circuitlast year ruled three to zero on the
panel that this statute was unconstitutional underthat test, but the Supreme Court reversed
in an eight to one decision prettylobsided. To be honest with you,
you had Clarence Thomas right a thirtytwo page, pretty lengthy descent, a

solo descent, basically saying that thisis an incorrect application of Bruin because there's
no historical law like this. I'llbe honest with you, Jeffie, I
think it's a close call. I'mnot entirely sure that the Court got it
wrong here. You have to understandthat there is actually a long tradition in
Anglo American law for prohibiting violent peoplefrom getting guns. And while I'm obviously

a huge gun guy, I carrymy handgun basically everywhere I go. I
own an ar fift team with lotsof large magine. I'm a huge gun
guy. Your rights obviously do onlyexist to a certain point. I mean,
you don't have a Second Amendment rightto launch a surface to air missile
to take down an American Airlines flight, for instance. Right, So I'm
not convinced that the court got itwrong, but I think that it's a
place where concerns can probably reasonably disagree. Okay, why can't I have a

surface to air missile. I don'twant to shoot down airplanes, but I
feel like that's something I should beallowed to own. Why is that band,
Josh? Well, look, Imean, if you're going to be
a literalist on the Second Amendment,your right to keep and bare arms shall
not be infringed. I mean,if you're approach to conscert interpretation really is
to take the words as literally asthey mean, then I agree with you.

But historically, Jesse, that's justnot the way that we interpret individual
rights. I mean, historically weunderstand that individual rights necessarily exist only to
a to a point, and thatpoint is going to be debatable. It's
going to be a case by caseinstance. But look, I mean the
legal stuff asigned talking about the publicpolicy here. Jesse. You're my good

You served honorably overseas. I haveno doubt that you would be perfectly safe
with a service to air missile.And let me if I have to go

think you probably have to wonder aboutwhether or not it would be a good

good answer. I mean, noone knows the answer to this other than
the justices and maybe their own lawclerks themselves. But I mean, they
have a flair for the dramatics.You know, we've seen time and time

again how they love to save theirhighest opinions for the very end. This
is a miittly doubling down on that. I mean, we have a ton
a lot of really juicy, highprofile opinions left. This coming week is
going to be absolutely crazy. Idon't know. I mean, you know,
some people might speculate that they've beena little distracted by all these left
wing attacks on the court involving ClarenceThomas and sam Alita. That's possible,

but I think that it's probably alittle more simpler than that. They're just
saving the big stuff until the veryvery end. They want to go off

to this doozy before we dig into. There's a lot of political talk,
but this is an interesting one,Hi, Jesse. Is it true that
FDR knew that Japan was going toattack Pearl Harbor? If so, why
did he allow that to happen,knowing there would be a terrible loss of
American lives and great damage to ourmilitary? Did he believe that that would

ensure our entry into World War too? Okay, let's talk about this first.
This is not a disclaimer. Ijust kind of want to spoil at
least my own personal thoughts on it. I've read a lot on this,
a lot on this Pearl Harbor,different perspectives, FDR. All this stuff

that does not make me some kindof an expert. I don't know more
than you. I've just read alot, all right, I'm dug into
it. I do not believe.I do not believe FDR intentionally put our
aircraft carriers out to see doing maneuverson the day they were attacking Pearl Harbor,

on the day the Japanese were attackingPearl Harbor, because that's where that
can I don't even want to callit a conspiracy theory because so many of
those end up coming true. That'sthe theory. They attacked Pearl Harbor,
the Japanese attacked Pearl Harbor. FDRknew they were going to do it,
so he took the aircraft carriers andled him out into the ocean because they
were the most important thing, andhe allowed the Pearl Harbor attack to commence

because he wanted to get us intoWorld War two, but he wanted our
aircraft carriers to be safe. Thatis really the theory behind it. Just
again state I don't believe that.From everything I've read, I don't believe
that. I think it would bevery, very difficult to cover that up
because of how many different layers betweenFDR and the boats themselves there are.

That's a lot of people that wouldhave to be in on that. However,
However, let's do discuss this fromkind of an alternate angle, you
said, why did he allow itto happen? Knowing there would be a
terrible loss of American lives and greatdamage to our military. What I'm about
to say is not just about communists, although it definitely applies to them.

What I'm about to say it's aboutleaders of men historically, leaders of men,
leaders of nations, leaders of empires. Historically, they rapidly develop a
god complex. After all, I'llnever be there, You'll probably never be

do whatever you want. It wouldget to your head, wouldn't it.
The danger is that it gets toyour head, and powerful men have marched

historically. Look, honestly, let'slook at modern day. You know,
I don't talk a lot of Russia, Ukraine, Ahputin, we're fighting democracy.

let's talk about Vladimir Putin. Doyou have any idea how many Russians have

died? Those are his own citizens? He decided he wanted a portion of
Ukraine. He invaded Ukraine, andnow what one hundred thousand, two hundred

up with the nation's young men,gone, just because he wanted it,
because he wanted Ukraine. In America, before World War Two, there was
World War One, Americans used tohave the correct view of foreign policy.

up to the middle of the twentiethcentury was non intervention. We don't get
involved. Whatever's going on, wedon't get involved. Oh you've got a
