Hey, So I got to get a divorce.

Speaker 7 (07:46):
She's driving me crazy.

Speaker 4 (07:50):
We have a twelve year old in public school and
she's now talking about sending the kid to private school.
I'm pretty sure she's doing this because she knows that
I'll be the one paying for it. Is this something
that a judge decides? I mean, if she has primary custody,
does she just get to decide where the kid goes

(08:11):
to school?

Speaker 3 (08:11):
Sure?

Speaker 6 (08:12):
Well, let's jump over a few bridges that I think
you already have in your own mind. A judge never
speaks to something while the two of you are married,
so this issue is either something that you guys work
out by agreement while you're married, or if it's one
of those issues that causes a split. Let's say that
your child has not been going to public school or
excuse me, not been going to private school up till now,

(08:33):
but now that you're involved in a divorce, if she's
seeking to try and change that enroll them in private school,
it's not likely to happen for a couple of different reasons.
Number one, of course, is the additional cost to the
two households. Now, when you've got two households, it's already
a bit of a financial hardship compared to what you've
got now. But secondly, and perhaps more importantly, is in

(08:56):
the context of a divorce, even if she's the primary parent,
both of you have the ability to have what's called
joint decision making, and that includes things like religion, non
emergency health care, and then you know, per your question, education,
So it is something that's considered just sort of a
vital discussion that parents should have and should have an

(09:16):
agreement on.

Speaker 1 (09:17):
And well that also factor in like that is that
the same thing for college and deciding like who's paying
for college? And is that something you decide at this
stage as well while the kid is twelve.

Speaker 3 (09:28):
Yeah, well what you can do.

Speaker 6 (09:29):
And a lot of a lot of divorces with with
younger children, they'll say the issue is there is reserved
and can be brought up later, so long as you
bring it up before the child is eighteen or finishes
high school, so long as regular child support has not concluded.

Speaker 1 (09:43):
So all right, Robert, I guess that's good news. It

Yeah, So, I don't want to get it into too
much detail here, but i was in an accident a
few years ago and I'm about to get this big settlement,
and as you might guess, I'm also headed for a divorce.
Can she get half that or can I keep it?

Speaker 6 (10:15):
You know, there's a great question. You know, it goes
back to the larger topic of what's separate property, what's
community property, et cetera. Usually in a situation like this,
and you may still have time to manipulate it for
lack of a better word. When it comes to some
sort of a settlement, there's often a definition of what
is it that you're being paid for. So, for example,

(10:36):
if what you're being paid for is the pain and
suffering that you've already incurred, and let's say you're fine
now going forward, it's not going to affect any other
part of your life, so you're paid for prior pain
and suffering, then yes, that's community property because it was
earned and incurred if you want to call it that
while married.

Speaker 2 (10:53):
He's the one with the pain.

Speaker 6 (10:54):
Yeah, let's she probably had to live with it too.
How's Matt doing?

Speaker 2 (11:00):
Yeah, it's my broken foot.

Speaker 6 (11:03):
But let's say it's something different, which is it's actually
created a disability. It has now hindered your future income,
and that's that's the key there. And your future income
is your future income. So to the extent that you're
talking to an attorney, you may want to talk about
the situation you're in and have them maybe do a
little deeper dive. But it's a it's real good that

(11:24):
you asked that question for you today.

Yeah, that's that is interesting.

Speaker 1 (11:28):
I would have assumed if it's from an accident and
it was just him that he was just going to
keep all the money, is what Alex was hoping to
hear today.

But if it's a future, then it is possibly good. Okay, interesting.

Hi, Good morning, Good morning.

So my husband doesn't hold up his end of the
parenting agreement. He skips weekends, he's laid on support, he
has in show over school functions. I'm wondering how I
can remedy this without spending an arm.

Speaker 1 (12:07):
And a leg.

Speaker 6 (12:08):
Sure, well, I mean what you're talking about. Your your
remedy really is what's called contempt. So if there's a
court order in place that he's not living up to,
you can bring an action, which unfortunately means you've got
to go to court and basically allege that he's in
contempt of the parenting plan or in contempt of child support.
I'm gonna break it down a little bit, which is

(12:29):
when it just comes to the child support side of things,
you may want to get in contact with the state
dshs here in Washington and let them know what's going on.
Does he pay through the state or does he pay
you directly?

Speaker 9 (12:43):
I pay for the state.

Speaker 6 (12:44):
Okay, so you may want to, you know, say hey guys, everybody,
look what's going on. Is there anything you can do
to help me? And there are occasions where they'll assign
basically a prosecutor an attorney. You know, what they're really
trying to do is to to go after those dollars
and get those dollars in. But it almost comes off
as an attorney for yourself without having to be out
of pocket for it. When it comes to the parenting

(13:06):
plan issues. Yeah, you bringing a motion for contempt in
the court is really your only remedy.

Speaker 1 (13:10):
Oh okay, well, good luck, Jessica. I think I feel
like we've heard that before, where just there's some people
who don't want to pay and stop paying and you
got to figure it out, all right. We've got Amanda

What's your question for him?

So there's a strong possibility that my husband is not
the father of his adult children. Can we go after
payment of child support after the fact?

Speaker 6 (13:41):
No, I don't make a laugh, but it's just, you know,
rare that there's one word answer, you know, to the
extent that they're already adult children, it really would have
been an issue of gosh, we've just discovered this when
when a child is ten years old, and then the question, frankly,
is whether or not you still may be on the

(14:01):
hook going forward. So yeah, unfortunately the time is gone
for any remedy.

Speaker 2 (14:07):
Amanda, how adult are we talking? They're like in their thirties,
they're in their twenties.

Speaker 9 (14:14):
Yes to both.

Speaker 3 (14:15):
Oh wow.

Speaker 1 (14:16):
So and here's the question I have, Rick, if she
knew and did this anyway, there's still no recourse, is
there any like you know what I'm saying, Like she
lied on purpose that they were his kids and they weren't.

Speaker 6 (14:29):
Yeah, I mean, I guess now it's going to fall
outside of family law, which is what we deal with
on the you know, the day in the day out.
But I could arguably see what's called a civil action
and argue for fraud. For example, if you can show
that she's in possession or communication history where it's like
I'm duping this guy and here's what's going on, then
you may be able to. But then the question, of course,

(14:51):
is is she going to be flush enough to actually have,
you know, being be able to recover anything.

Speaker 1 (14:57):
I mean, I know that sometimes it happens where you
find out later that you're not the parent but multiple children.
I wow, all right, good luck Amanda and Sean and Polsbo.

What's up?

Speaker 7 (15:12):
Hey? Rick, So if me and my seem to be
ex wife both get lawyers, do we still have to
go in front of a judge or a journey or whatever,
or could just can we just get divorced through the lawyers?

Speaker 6 (15:26):
Yeah, you can just get divorced through the lawyers. I mean,
the idea and the reason why, one of the many
reasons why people want to have an attorney is to
be able to take, you know, some of the hot
headedness away, some of the emotion and just get down
to the business, you know, because more than likely you
just both want to be done and you move on
with your life the next step, et cetera. So, yeah,

(15:46):
you can, you can hire attorneys. The attorneys are involved
in the negotiation. They communicate with their respective clients, of course,
but ultimately they can create a set of final papers. Basically,
here's the divorce, you in it to the court. You
submit what's called it a declaration in lou so that
you don't have to go to court and it can

(16:07):
be finalized without a court appearance.

Speaker 3 (16:09):
Wow.

Speaker 1 (16:09):
And so typically you wind up going to court if
you stop agreeing, like you can't come to an agreement
on this.

Speaker 6 (16:18):
Yeah, Well, the most you know, trials fairly infrequent when
it comes to family law. The odds are going to
a trial in a divorce case I put at about
two or three percent, so certainly less than five percent.
But so many times there's issues that need to be
resolved right away. You know, something happens, there's a smoke
and gun, so to speak, and you need to decide, okay,
well who's going to be in the house for now,

(16:39):
where the kid's going to be, what's the schedule, who's
responsible for the mortgage? And so there's usually what's called
a motion for temporary orders, which is almost like a
mini trial, but it's it's on paper, and then the
attorneys get to make argument on each side, and the
court commissioner interacts and ultimately says, well, here's the rules
and now you have a rule book from that point
going forward until you get your divorce completer to go

to trial.

Speaker 1 (17:02):
Wow, all right, if you have a question for Rick Jones,

I want to get remarried after not seeing my first
husband for five years.

Idea where he is.

I thought I heard you say once that you take
an ad out in the newspaper, But I'm thinking, like
that might be wrong because like, no one reads newspapers anymore,
so I wasn't sure.

Speaker 6 (17:40):
Well, your common sense is correct in terms of nobody
likely reading that, but the law hasn't caught up with that.
So there is still the ability to do what's called
a service by publication. And now you know his attorneys.
When we do that, are we expecting to be able
to have that person see it and respond? No, we're not,
but it's a hoop that we have to jump through.
What I will tell you, though, is there's a little

(18:02):
bit more scrutiny these days. You know, the modern time,
so to speak, of the expectation that you can still
find somebody. Right, So, whether it's hiring a private investigator,
you know, that's very adept and going and looking at
social media various you know, maybe governmental sites to be
able to track somebody down. So you have to demonstrate
to the court that you've jumped through those hoops even

(18:24):
before you're allowed to try to serve by publication.

Speaker 1 (18:27):
And does it matter like if Janice knows her husband
isn't in Washington anymore, does that matter, Like does she
have to take out something in the Seattle Times or
does she have to do something bigger if he's, say
in California.

Speaker 6 (18:40):
Yeah, well, if she knows where he's at generally now
obviously that sort of belies not being able to locate him.
But if she, if she is certain, for example, that
he's now in California, then yeah, just to cover all
your bases, you want to do that.

Speaker 1 (18:55):
So do you think janis the first step is to
hire a private investigator.

Speaker 2 (19:00):
That's I'm just saying that's out of pocket. That's thanks.

Speaker 6 (19:02):
Yeah, well, she wants to get remarried, so no, I mean,
the first thing she should do is hire an attorney,
because the attorney's going to have a pre existing relationship
with a private investigator, so it's likely to come at
you know, a less cost to her, So there's a
little bit of money savings. And then the attorney's also
going to be adept at navigating the service by publication.
