Are you doing well, Rick, I am, yeah, awesome. Well,
we got some people who are lined up who would
like to talk with you. We do have some phone

two five. We'll start things off with Logan in renting.

Hey Logan, Hey, hey Rick. So here's the deal.

My son's nineteen, and he got married behind her back
and now he needs a divorce. So just a little
bit more about this. They've actually been married just under
a year, and we bought him an apartment where they've
been living. So they don't have any you know, big
jobs or any real money at all. So my big
question is is this going to be clear cut or

does she actually have a claim to this apartment that
we bought?
Speaker 9 (09:27):
Well, when you say you bought the apartment or did
you prepay rent or did you actually buy a condo?
Speaker 8 (09:33):
No, I bought it, okay, So yeah, I bought the condo,
got it okay?

And I assume that you were somewhat self protective when
you purchase this. In other words, is it in your
name and your yet?
Speaker 3 (09:47):

So you're on the mortgage and you have the obligation.

Yes, absolutely, you know.

I eventually I wanted to pass it into my son
and her name, frankly, but I haven't done that yet
because they've barely been married.

Sure, yeah, I mean it really should be a clear cut.

The problem is anytime you go through a divorce. You've
got two sides of a case, and you're not done
until both of them either agree or a court makes
a decision. But there really isn't a legal battleground, you
know for these two to fight. It really is one
of these things where neither of us have any money,
we don't have any children together. Let's just call this
a bad breakup.

So if he had put the name, put the condo
in his son's name, then it would be potentially a
different story.
Speaker 9 (10:26):
Yeah, Muddy's the waters because then the question is was
it intended as a gift to the community, to the marriage,
And if so, you know, all of a sudden it
becomes a piece of community value. But man, so early
in the process, especially, you know, when you can trace
it back to you know, good intentions, but covering himself
legal I think we're good.

has a kid who is not mine and they don't
get child support from the bio dad. She isn't currently working,
So obviously I've been paying for everything. Will I have

to pay child support when we get divorced? I never
adopted the kid.
Speaker 9 (11:27):
Yeah, no, you won't. You know, the fact that the
child obviously pre existed. There's no question in the world
is to as to whether you are the biological father.
There's really no angle for you to have an obligation
on this.
Speaker 1 (11:40):
So even though he's been paying for everything the whole time,
Mom just says to go out and get a job, Well,
he'll have to pay her something.
Speaker 9 (11:47):
Yeah. Well, and certainly, you know, who knows how the
finance is on a divorce might work out whether there's
going to be any sort of obligation from him to
her other than child support. But you know, take the
worst case, innarrea. Let's say she's got to go to
the state for public assistance. Well, the first thing that
state's going to do is to say, hey, let's let's
track down who this biological father is so that they

can get child support incoming rolling to basically cover the
taxpayer dollars that are going out her way.

Hey, Rick. I love listening to you and you're on
the show. Thank you, thanks for taking my call. Uh yeah,
I never really thought i'd have to call in the question,
but here I am. Long story short, my wife busted
me cheating and she is very very very very very mad,
and she's going to be up for blood. I know
(12:56):
that she's already contacted a lawyer, and I'm basically just
wondering if there's anything I can do to prepare myself
or safeguard myself in some way.
Speaker 9 (13:06):
Well, the best thing you can do is kind of
a step you've already taken, which is to call somebody. Now,
obviously we're not going to be able to do the
deep dive that you need, you know, right here on
the on the on the radio. But what you really
need to do is to sit down with somebody and say, Okay,
here's the lay of the land, Here's how long we've
been married, here's our financial circumstances. Do we have any children?
(13:26):
So somebody can really just then kind of spit that
back to you and give you maybe a diagnosis and say,
you know, here's how the law operates in your system
or in your particular fact pattern. And then ultimately there's
going to be follow up questions, et cetera, where you're
able to drill down, and then and only then is
an attorney going to be able to know whether there's
any good nuggets to give you right now, or or
(13:47):
even strategize. You know, the strategies can vary, just you know,
depending on something as silly as personalities. So pick up
you know, pick up the call, or pick up the phone,
call our office and let's spend some time with you
on the phone, you know, diagnose well.

And so the fact that he got busted cheating.
Speaker 1 (14:05):
He sounds like he's super bummed about getting busted, but
doesn't really play into it here in Washington.
Speaker 9 (14:11):
It doesn't play in legally. Washington's a no fault state,
which we've all heard now, you know, dozens of times.
But does it matter in the divorce absolutely, because like
he said, she's you know, she's gotten for him. Oh yeah,
and so yeah, no, it doesn't help.

So my ex husband just lost his job and this
is a couple questions about child support. Does that mean
he can stop paying child support?
Speaker 6 (14:57):
Does it like.
Speaker 11 (14:59):
Stop and then start again when he gets a new job,
or does he have to pay back child support once
he does get a job. I just have no idea.
Speaker 9 (15:07):
Yeah, how this works well?
Speaker 3 (15:09):
Right now?
Speaker 9 (15:09):
Child support is part of a court order, so there
is no change in terms of the obligation that he has.
So whatever the amount of child support is that's coming
due each and every month, and if he's not paying it,
then it becomes part of an overall judgment, in other words,
amount of money that he owes you. Now, let's kind
of flip the switch a little bit if he were
(15:31):
to call me right now and say, hey, I've lost
my job, I've got child support obligation. Is there any relief,
I'd be telling him. The first thing he needs to
do is to, well, I'm number one, get a job quicker, right,
if that's at all possible. But number two, if he
expects this is going to be any duration in time,
is to go into the court and seek a modification. Now,
the take home though for you is you don't have
(15:54):
to do anything for this to continue to accrue. It
would be up to him if he's trying to change
anything going forward. So as it stands, each month that
money is accruing and you can expect it, you know,
to have it hit your pocket.
Speaker 1 (16:06):
So what happens though, if if you are one of
the people who lives paycheck to paycheck, so Megan's X
does not have the money, what happens?
Speaker 9 (16:15):
Yeah, Well, you know, a couple of things can go on. Certainly,
the state has the ability to exert their own collection powers,
and that's things like garnished checks. You know, certainly even
to the point of garnishing tax returns. They can put
blocks on the ability to license. So there's a whole
(16:36):
lot of you know, hammers, I guess that they have
on their side. Hopefully it doesn't get there, you know,
hopefully this is a circumstance where it's a bump in
the road. He's either able to continue to pay monthly
or if so, he can get back in good graces
pretty quickly. Because frankly, child's child supports there for a reason.
Speaker 1 (16:53):
And so if he, say, was on unemployment, then the
child support would come out of that as well.
Speaker 9 (16:59):
Theoretically, you know, it gets a little bit more challenging
there because certainly if it's unemployment, do they have the
ability to garnish it. Yeah, but there's there's all these
machinations that have to happen internally, and asking one department
of the state to deal with another department of the
state sometimes is a bit random.

And so one last question about this.

If Meghan's ex gets a job he was making one
hundred thousand dollars and now he's making fifty thousand dollars,
would he then go to court and say I'm not
paying as much money.

Exactly right, He needs to go to court and say
I'm looking to a just child support based on these
new numbers.

All right, so Meghan is hoping he gets a good job.

Meighan's hoping he doubles his income and that she can

I have an interesting one. My husband owned our house
when we got married, and like the house was just
its own house, but then after living there for a while,
we ended up actually building a little back house mother
in law unit kind of as they call it for
in fact my mom.
Speaker 2 (18:26):
But now who lives there right now?
Speaker 12 (18:28):
So she lives in that back house now we are
going through a divorce and my question is twofold can
he kick her out? And am I entitled to half
of that house or value of it or whatever since
we built it while we were married together?
Speaker 9 (18:46):
Yeah, I mean, great questions it's not as simple as
you know yes or no on either of those questions.
Let's first talk about the home value, whether there's any
community equity in it, and to the extent that that
when you get married, the home was owned outright and
meaning that there wasn't an existing mortgage or obligation on it.
If it was owned outright, at that point, it was
(19:07):
his separate property. But let's go forward to the extent
that community funds or community efforts elbow grease was used
to make improvements that are that are monetarily valued on
this house, then that's a community in road. So ultimately,
what you're going to want to do is have an
attorney kind of go through that with you and say, Okay,
we recognize that there's some portion of separate property here,
(19:29):
but you need to recognize that there's a portion of
community property. So that's the way to drill down on
the finances of the home. Now, when it comes to
your mother, you know, the first question and going through
a divorce is whether or not there's any temporary orders
in place, because right now the two of you are,
you have presumably equal access to the home, so he
can't simply kick her out anymore, then you can kick
(19:51):
him out. But there may be a temporary orders argument
to say, hey, listen, if the two of us can't
be under the same roof, who's it going to be temporarily?
And if he prevails, maybe on the argument that that's
you know, predominantly a separate property home, then he would
have the rights of any other tenant excuse me, then
he would have the rights of any other landowner, and
(20:12):
he would have the ability to basically boot her out. Yeah.
So I mean the key is, you know, either prolong
this to the extent that there's not the ability for
him to do that, or maybe even prevail at temporary orders,
which is leaving you in the house, because one of
your arguments is well, why don't why don't we leave
me in the house for now, given that my mom
lives on the property, So use that as a as
(20:35):
a as a pro not a con.

They're going to get a divorce and his mother in
law's going to stay living on property.
