of other dangerous people during the four years of the
Biden administration. I know we've got least six hundred thousand
as this country with criminal records walking the streets to
this country. The doctor who treated President Joe Biden for

four years had to plead the fifth in the investigation
into what was really happening in the government and who
was really running the government when Joe Biden was mentally
incapable to do so.

Now, let's talk more about the assassination attempt on President Trump,
which will be one year ago on Sunday. Don Mahalik
is the ABC News Law Enforcement contributor and a retired
senior Secret Service agent. Sarah, thank you so much for
spending time with us today.
Speaker 5 (02:41):
Thank you for having me. I'm happy to be back
in New York.
Speaker 1 (02:44):
So a year later, what do we know that's new
about that day in Butler, Pennsylvania.
Speaker 5 (02:53):
Well, there were multiple investigations launched. The Secret Service at
an eternal investigation, DHS did a special investigation, and then
both Chambers of Congress did separate investigations of as well,
and they all came down around the same basic points
that there was a failure broadly of command and communication
at the Secret Service at the time. Did not establish
(03:15):
enough command over the site, did not address site specific
issues like the roofline, communication interoperability between them and the locals,
did not establish clear enough instructions with the locals, did
not use enough technologies to deal with some of the
issues at the site like the roofline. The drones were
(03:39):
there but weren't operational. Broadly, that the Secret Service failed
to oversee the site and lined with their protocols policies
and procedures. So Congress came out and I think they
gave them DHS forty one recommendations to work on, and
I think the Service has since then been working on
fixing a lot of those recommendations, including clarifying policies related
(04:02):
to who's in charge of the site, who's responsible for
the site, who has to you know, the reporting chain
up through the supervisory ranks of the site, how they're
supposed to interact with local police, who's supposed to be
in the command center, how the radio communications are supposed
to work, and how they're supposed to mitigate potential issues
(04:23):
at the site with the use of different technologies that
are now available.
Speaker 1 (04:27):
What are the great failures seems to be, aside from
incompetence in not having a building covered that was in
the line of sight of the president, was arrogance because
it sounds like the local police had several meetings, including
their swap team, had meetings about that day that no
one from the Secret Service went to.

Is that correct?
Speaker 5 (04:52):
From what the reports and the investigation says, is there
were separate meetings that were ongoing, just like there were
separate command posts at the site, which typically is not
the way the Secret Service does business. Normally, when the
Secret Service comes in and is setting up a protective site,
all the meetings that are had are owned and operated
by the Secret Service. There's usually one command poster or

security rooms set up for a site. In this case,
for some reason, there were separate, separate meetings that were
going on that the Secret Services either weren't aware of
or were or didn't weren't holding. And the same thing
with the security room. There were two security rooms set
up where the Secret Service wasn't president one but was
president and another. Broadly speaking, the Secret Service should have

done the better job of managing and establishing command of
the site. That didn't happen. There's a bunch of reasons
why that didn't happen. I think a bunch of them
are legacy issues with the agency which are now being
addressed hopefully. But overall, a lot of the failures that
went on at Butler are things if you look back
(05:58):
in time, even as recently as the twenty fourteen Protection
Mission Panel, and the Secret Service was dealing with a
bunch of bench jumpers or issues within the agency that
were overdue to be addressed because of the expanded mission.
The agency has the personnel issues the agency has been
grappling with and trying to establish and use newer technologies
(06:22):
which the agency has struggled with throughout my time there.
Speaker 1 (06:25):
Don I know, there's been suspensions, but no one was
fired over this, and it was an incredible failure that
the whole world got to see. Why is that? Why
wouldn't someone be let go if they were part of
this kind of failure.
Speaker 5 (06:42):
Well, as we all know, Director Chieto was forced to resign,
so she resigned. She was ultimately responsible for the site
to protection that day. The acting deputy director was recently
forced out. And you know, the government has a pretty
wonky discipline process, and from my understanding, when the incident happened,

the agency launched an investigation. They proposed discipline to those
that they found responsible for gaps in the security plan.
There was appeals that took place, and what we heard
the other day is the end result of the appeals.
The bottom line is, if it were me, I would
have preferred it handled like most law enforcement agencies handily
(07:25):
shooting incident, where right afterwards everybody is put on leave,
an investigation occurs, and during that investigation you either clear
people where you establish responsibility and then you established discipline.
I think had that happened last year, people would have
been held accountable and we wouldn't be talking about it now.
Speaker 1 (07:44):
How come we don't know a lot about Thomas Crooks
to this day? He had burner phones. Who was he
talking to?
Speaker 5 (07:51):
Everybody asked that question. I don't know if that's more
conspiracy theory or what, but I know the FBI recently
reefed the President about their investigation into Thomas Crook. And
the bottom line is, from my understanding and from the
five investigations that went on that involved also looking at
Thomas Crook, is it all comes down to he was
(08:13):
a mentally challenged young man who had an unusual direction
of interest towards President Trump, who came to the site,
found a gap and a security plan including one of
the gaps, was ninety minutes prior. The local police had
identified him as suspicious and communicated within their own chain,
(08:33):
but didn't communicate that to the Secret Service until almost
the last minute, which goes to the communication introoperability that
the Secret Service is supposed to have at these sites
and that he managed because he was able to take
advantage of the security gaps, he was able to take
the shot at President Trump. From my understanding, all the
investigations the FBI all agree on that is who Thomas
(08:55):
Crook was.
Speaker 4 (08:56):
But he did have Burger phones, right, He had a.
Speaker 5 (08:59):
Bunch of cell phones. I would assume that both the
FBI and a Secret Service during their investigation went through
those phones and figured out who he was talking to
and established whether it merited more investigation or not. But
there was evidence to support a broader conspiracy. But it
seems to me that all five reports have come down
(09:20):
the same way, and as recently as a couple of
weeks ago, when the FBI briefed the President, which it's
his own, FBI Director Patel and Deputy Director by Gina,
they also established the same thing that there was nothing
more than what we saw at Butler as far as
Matthew Crooks and at a broader conspiracy.

actual interview with Professor Dershowitz happened before all of the
hubbub came out. So when he's talking about I've seen
the list, he means it and it's it's not in
light and that's that's what the real interesting thing is
that he's not trying to jump into current events and

make news. This was said before the announcement came out,
that the DJ said there was nothing further, which frankly,
in my opinion, makes it even more powerful that, you know,
you can't make the case that he was trying to
influence the situation, et cetera. So this was a big
deal and it was funny because when we pushed it
out last night, I put it out on Twitter. I

put it out on Twitter yesterday, and it's you know,
closing in on two million views. Because this is a
guy is as most people recall, who was accused, you know,
had had some accusations made by a woman that was supposedly,
you know, had been associated with Jeffrey Epstein, had been
there and after further evidence had been provided, according to

Professor Dershowitz, see we can't in her story, but in
the process, and this is where it gets good, is
that Dershowitz because you've been involved as a lawyer and
all this says, I've seen the list. I know who's
suppressing the list. And if you go to my Twitter
feed or I've got it up on Instagram or obviously
you pointed out on the show, you on my YouTube page.
The show last night we played it. But like he

makes it very clear, he says, and I think you've
been talking about this morning like it's being suppressed. I
know who's seen it, I know who's on it. I
know who's suppressing the list. I think this is a
very interesting thing as far as you know, for people
who care about Epstein, you know, this is obviously a
big deal for them.

Yeah, and I agree with you.

It gives them more credibility the fact that it happened
before all of this, all of this controversy. Right now,
did you press him on who was on the list?
Did he did he give up anything more than what
we've been hearing.

No, Well, if you if you listen to the whole thing,
right And that's why I think if people want to
hear it, because he says, look, i am legally I'm
not legally allowed to discuss it. I'm under X number
of confidentiality agreements and non disclosure agreements because he was
the lawyer in some of these instances. He says, I
am duty bound. I can I cannot do it. But

he says, but I've seen it. I know who's on it.
And further, he says, you know, and this is the key.
I know who's suppressing it. And I think that's that's important.

And look, I.

Think I don't Obviously I've not seen anything. I don't
know anything. But I will tell you that if you
think about who the people are that have been rumored,
who have been around Jeffrey Epstein, President Clinton, and a
lot of other people that were cited as being on
that plane. Business leaders, you guys there in New York
know this better than anyone. I mean, you start going

through your head and think, if you've got twenty thirty
major CEOs, I mean, like the economic impact of a
list like this could be catastrophic. And I just you know,
when you think about the depth and breadth of people
that are on this list, it's something that like a
Netflix movie could you know, be made.

Of Yeah, do you have any guesses as to who's
suppressing it? Any any number of those people?
Speaker 5 (23:25):
Well?
Speaker 12 (23:25):
Yeah, I mean, I look, I mean, just assume for
a second that the the CEO of major corporation X
or Y is on there, and and my guess is
that there's like thirty or forty of them. And so again,
whether it's a list or or a you know, five
different I mean, I guess we use this word colloquially,

but the bottom line is we all know that there
are people. And so whether it was kept as a
list or on a sprash piece of paper, I don't know,
but I'm saying that I think there are people that
have now gone to jail. We prosecuted Jeffrey Epsteince, so
obviously there's there.

There had to have been.

If you're going to prosecute somebody for these crimes, right
then there has to have been victims and and and
so therefore we know that something happened along the way. Obviously,
how it manifested itself, whether it was a list or not,
is somewhat incidental to this.

What I want to know, though, hey Sean, what I
want to know is they promised this, and they and
they talked about this during the campaign, and Pam Bondi
a couple of times has promised this how did she
not know?

How did this administration not know?

So so so here's here's my guess, and and and
again it's just pure speculation. But remember you only there's
a couple of things. One. There could be a lot
of stuff that is not in the hands of d
J specifically, like in other words, there are things that
could have gone missing. H if you get my drift
between one administration and the next, sure there could be
(24:52):
things that are watered down. And the other thing to
keep in mind, Larry, is this and this is something
that was pointing out to me by some lawyer friends
of mine. Let's just say hypothetic. And I'll use me
and you as the example, because it's neither one of us.
I don't think I know, I've never even met Jeffrey.
I've seen a river, so we can. But let's just
say that there's a piece of paper out there and
it says Larry Mentin Schaun Spicer on it. And if
(25:13):
you release that list without any due process, without anything,
I'm going to say, hey, wait a second, I'm sorry,
my name is on a piece of paper and you're
releasing a list that's going to destroy my life, like
entirely and yet I've done nothing wrong. I don't have
a chance to to, you know, go through a legal process,
and so the only other thing that can happen is
is that you could say, however, this manifested is some point. Yeah,
(25:35):
maybe it's fifteen different pieces of paper stuffed into a bag.
I don't know, But I'm just saying that when you
start to think about the consequences of when the government
does things and you realize that, hey, look, if you
were to release these twenty names without context and without
due process, you would obstensibly be ruining the lives of
individuals who may or may not have committed a crime.
(25:58):
And I I am sort of as people have walked
me through this from the legal standpoint, I do again,
I feel for the victims of this whole thing. Sure,
right to me, there are there are young women that
are the real victims here that deserves some justice, but
barring them seeking legal recourse. I also see it from
(26:18):
the other side, which is if you're an individual and say, hey,
I have I may or may not be on some
piece of paper because I went to a dinner or
did something that doesn't allow me to you know, the
consequences that I'll face would be cataclysmic.
