She was killed by a fifteen year old, a legal
immigrant that crashed into a car and ended up getting
the severe punishment of probation when she went to court

young individual up and are working to deport him from
the country.

you know, they'll they'll finally get to think him three
hundred and sixty days because they know I have three

On this point, there are those that make an argument,

should have equal rights to American citizens. I disagree vehemently.

those of legal American citizens like Caitlin Weaver. That they

need to be marked for deportation, They cannot be shielded
or protected. They've committed a crime in this instance, and
yet the Democrats, Amy Padden being one of them, you
know her well, are bending over backwards to afford them
the opportunity to stay in this country.

Kennedy Junior and tracking down all these children that are
missing throughout the United States. Do you have faith that

Douglass County commissioners have started the process to become a
home rule county.

That means it has the power to govern itself independently
of state law.

The final decision, though, is going to be up to voters.

Speaker 11 (22:21):
December seventh, Alley General John is outside the government office
in Castle Rock this morning and Ali ahead of a
special election in June, there is a deadline coming up
for those interested in serving as a commission member.

Speaker 10 (22:34):
Yeah, April twenty fourth, that is the deadline, and each
of those people interested, they'll need to get twenty five
voter signatures to be placed on that ballot. Then that
special election will happen in two months. And here's the
two questions that voters will be asked. First, should Douglas
County form a charter commission? If they answer yes to that,
then they'll select twenty one commission charter Commission members. Now,

(22:55):
if that goes through, those Charter Commission members will have
two hundred and forty days is to create a charter
then voters will vote on that in the November fourth election.

Speaker 2 (23:05):
What is home rule though, We've been.

Speaker 10 (23:06):
Looking into that and put simply, it puts more power
back in the hands of the county, allowing them to
make governing decisions on local matters instead of defaulting to
the state law. Commissioner George Tels tells me there are
four main reasons that led the board to consider this,
their experience with COVID nineteen, precautions, gun regulations, taxation.

And immigration.

Speaker 10 (23:25):
Just using one of these as an example, Teal says
the county is charging too much for taxes because of
state law, but he says becoming a home rule charter
would allow them to dictate that tax bill.

Speaker 8 (23:36):
We think what we have going on here in Douglas
County right now is working, and so my goal is
to preserve what is working, preserve the things that we
actually value, and capture that in our home rule charter
and honestly give us a means to fight back and
push back against a legislature that is becoming more and

(23:58):
more out of touch with the people of Douglas County.

Speaker 10 (24:03):
Now, not everyone agrees this is the right move. Laura Thomas,
a former Douglas County commissioner, cleared up some confusion on
x saying, quote, home rule at a county level does
not provide a process to opt out of state laws,
and according to the Colorado Municipal League, some downsides of
becoming a home RL county could include citizens that try
to adopt amendments which can't be done without a vote,

(24:25):
legal uncertainties like if the issue at hand is truly.

Considered to be a local concern and it can be costly.

Speaker 10 (24:31):
Now just reiterating that the final decision will be up
to voters. If passed, the county of nearly four hundred
thousand people would become only the fifth county in Colorado

just in response to kind of those downsides, the negatives

you heard at the end of that package. I wanted
to give you the opportunity to respond to that, to retort.

Yeah, you know, listen, I really enjoyed the six and
a half And by the way, thanks for having me
on Ryan. I really appreciate it.

But I spent six and a half years on the
cast Rock Council and so I know CML very well.
I was on the CML Policy Committee for three years.
The problem with CML is they know municipal home rule
and that's detailed. The powers of municipal home rule are

detailed in a completely different section of the calar Revi Statutes,
and so I get it. They can talk about the
downsides of home rule for municipalities, but it's very rare
that we have people that know both the municipal home
rule powers and the county home rule powers. Our County Attorney,

(26:06):
Jeff Garcia, came to us from the City and County
of Denver and he knows. So that's kind of the
dirty little secret in Denver government is sometimes they try
to get things done by playing the nip home rule powers,
and when they get rejected and they get told no,
you can't do that, then they just switch over and
they say, well, actually, we're a city in a county,

(26:27):
and so then they play the county home rule powers
and that's how Denver kind of does a lot of
the stuff that they do that nobody else seems to
be able to do, either as Justice city or just
a county. So we've done in depth analysis of what
it means to go through and become a home rule

(26:51):
county and the additional powers, the additional rights and privileges
under the state countitution that a home rule county gets
is cmo Z different and municipal powers. But that's okay.
We're not a municipality. We're a county, right, And we've

(27:12):
done this analysis. We've gone into it eyes wide open,
and we're trying to share that knowledge with as many
residents of Douglas County as we can to get us
through a yes vote on June twenty fourth.

the most liberal neighbor on my street has her no
on home rule lawn sign next to her black Lives
Matter lawn sign makes me skeptical about voting no. And
I replied to her that would make me a default
yes as a starting point. But then, George, I want

you to respond to Laura Thomas, who will be appearing
on my program in the next hour. She says, the
following Home rule does not allow counties to opt out
of state laws. We don't like immigration, gun control, grocery
bag fees. We must follow all state laws. All home
rule allows a county to do is change the structure,
such as extending term limits, increasing salaries, making some positions

appointed as opposed to elected.

What say you, I say, that's been Lord Thomas's opinion
for the last five years and she has neither listened
to nor has she allowed the thoughts and the ideas
and the facts to change that opinion. When Lord Thomas

was on the Border County Commissioners with us, she wouldn't
even sit still. She wouldn't even have a rational conversation
about home rule. She started no, just like that neighbor
with the Black Lives Matter sign, and she never left
know And I get it. She she what you just said,
and I'm sure she's going to say and actually that

because Lord Thomas has never bothered to sit through and
digest the facts the way to curt every elected official
at the county level in Douglas County has and when
they did, we have the support of every single elected
official at the county level right now in Douglas County.

Now, there's a humorous episode of Family Guy in which
Peter Griffin declares his own home lot Petoria, he wants
to be a totally independent nation. And I get the sense, George,
it's a ridiculous, extreme example. But however, it's not entirely
out of line that Doug CO wants as much as
possible to have autonomy, to have independence from a Colorado

(29:34):
General Assembly that is out of control, that has just
passed a law transing the kids and taking kids away
from you. If you disagree with affirming that gender, I mean,
this is madness. You and I both agree on that.
But in terms of actual power, the legality of this,
of what Doug CO will be able to do, just
kind of looking at this from that perspective that Laura has,

(29:56):
but where the courts might come down on Douglas County's
ability to govern itself, independent and free of various state laws,
or where state law might supersede or trump anything you're
trying to do with home rule.

Yeah. No, that's a great, great question, great example. It's
not a complete panacea. You know, none of us should
be fooled to think that there will be zero state
laws that apply in Douglas County. If we go home rule,
we're not succeeded. We are merely taking advantage of the
rights and privileges provided for in the state constitution that

was adopted in nineteen seventy and Wild County and Pitkin
County have taken advantage of those. And I think when
you talk to, you know, folks in Wild County, particularly
the elected officials, they will tell you the numerous advantages
that they have. And when you talk about, well, will
the courts will allow you to get away with everything?

(30:59):
The answer is no, the courts will not allow you
to get away with everything. But that's something very instructive there,
and it goes to the burden of who has to
do the work. Right now, we consider the sanctuary the
three sanctuary state laws that are on the books in
the state of Colorado unconstitutional. We sued the State of

(31:21):
Colorado in order to get those found to be unconstitutional. Well,
we're a satutary county. We are an agency of the
State of Colorado. We were told you don't have standing
to do that with home rule. As an independent legal entity,
we will have that standing. But it's better than that because,

(31:43):
as you'll find in Will County, they don't go suing
the state a lot. They don't hardly suit the state
at all. They just don't do it. State wants to
do regulation, maybe they do it, maybe they don't. The
burdens that on the state through Wild County or if
Douglas County goes home rule, the state to sue us

(32:06):
in order to compel our compliance instead of where we
are right now, where we need to sue, we need
to the burden is on us because we're an agency
of the state and as a homegle County. The burden
will then be on the state. They want to impose
something on Douglas County, well, then they got to impose

(32:29):
it on Well, they got to impose it on picking.
The state has to do that work to come after us,
and we can conduct our lives to our principles. So
I get what Laura's trying to say. I get what
she's trying to prove. I get what the naysayers are
trying to say and what they're trying to prove. But
the bottom line is home rule for Douglas County means

(32:53):
more more autonomy and more latitude to create the county
government we want and to have the any government that
we actually need.

My reflexive instinct, having endured this absolute insanity from the
Colorado Democrats. If it's good enough for Weld County and
Pitkin County, if I'm in Douglas County, then I want it.
That's my default position. I noticed George Teal's as well.
He as a Douglas County commissioner and the chair of
those commissioners pushing for this home rule concept. And George,
we really appreciate you kind of putting meat on the

bone here to the discussion, especially on a travel day
