I did read the decision. It was seventy two pages.
I read it last night, boring very you know, technical
stuff because of the environmental impact statements and this kind

of thing and whether or not they were done. Don't
read it. I'll save you the trouble. I'll go through it,
but i'll tell you why it was a bad decision.
And I hope, I hope that the Third Circuit at
some point before midnight issues a stay. But this judge,
he was he was wrong, basically, but he also he

called out New Jersey. He definitely called out Governor Murphy,
and he said he kind of said everyonebody was wrong.
But I mean, it's anyway. I'll get to that in
a moment. Watching a little bit Jimmy Carter's funeral procession.
Actually it's not the funeral, but it's the ceremonies have

begun for Saint James, Earl of Georgia. He will have
his canonization on the ninth of January in DC. So
between now and then, it's going to be Jimmy Carter
all the time. And just think back of how much
fun it was standing in line to see if you

can afford groceries. I think it was bad now you
remember back then and the interest rates and checking your
license plate to see if you can go get gas today. Yeah,
all Jimmy Carter. But let's hail him as a hero. Look,
I think we should respect he has died. He served
our country in that way. I totally respect what's happening,

and he should be given a presidential sendoff. He was
the head of state of the US. He was our
chief executive. Whether you like him or not, I think
they all deserve those honors. But anyway, this will go on.

got to talk about Trump being sentenced. That's coming up

a little bit. The Medal of Freedom. Did you see
this today? I wanted to yack all over the place
when Joe Biden. Joe Biden gave the Presidential Medal of Freedom,
the highest civilian honor you can get in this country.
He gave it to I think it was seventeen or

nineteen people. Hillary Clinton was one of them. All right,
say what you want. I'm fine. Actually, even though I
can't stand her or disagree with her, at least she's
served as a US senator, she was Secretary of State.
That's fine, again, his prerogative. But to give it to

George Soros, a guy who has spent thirty two billion
dollars over the last ten years, twenty years to destroy
this country. All the mess that we're dealing with in
our cities, the lawlessness, the no cash bail, all these
district attorneys like Alvin Bragg were backed by George Soros.

That's the kind of America he wants. He wants to
take America apart. He hates America. And Joe Biden just
gave George Soros the Presidential Medal of Freedom Honor. What
a despicable act that is, if he even knew he
did it. All right, So let me just tell you

about this whole congestion pricing scheme, which starts tonight at
midnight again, unless there's an emergency stay issued by the
Third Circuit. Third Circuit is in Philadelphia, and there's a
reason why Randy Mastro, the attorney for the State of
New Jersey, went there. Actually, Leo Gordon, the judge sits
in Newark, so they went to Jersey. They went to Philly,

which is probably a little bit better than the second Circuit,
which sits in Manhattan. But either way, they're all bad.
But so let me just walk you through real quickly
what this decision said. All right, and I can take
your calls. One eight hundred three two one zero seven ten.

it gets down to whether or not the Feds and
the state did their job with regard to the studies,
all these environmental studies. I mean, have you ever tried
to do anything, by the way, on your own property,
like put a shed up or a deck up. You
know the rigamarole you got to go through on your
local zoning board or planning board or whatever to get

this approved. Multiply that by a gazillion for something like this.
So they had to do a two year study on
the traffic impacts as well as the air quality. And
then I love this the environmental justice issues, and this
is where it could actually come back to bite them.

(06:20):
So the Federal Highway Administration, they had determined that there
were no significant effects or would be after they gave
one hundred and fifty five million dollars over the next
five years for mitigation. So what are some of the
mitigating factors to some communities, more so in Jersey that
would be affected by congestion pricing, Because what they admitted

(06:43):
was that congestion pricing might might reduce some traffic in
the zone below sixtieth, but push traffic elsewhere. It's like
a water balloon. You squeeze it, it doesn't go away,
it just goes somewhere else. So in this case, the
somewhere else is likely parts of New Jersey, but also

(07:07):
other areas. So their way of saying, okay, we'll waive
our magic wand this is how we'll get it through.
We will fork over one hundred and fifty five million
dollars spread out over all these communities that are going
to be affected over five years. That's nothing. And what
are they gonna do? Of course, it's a green lover's agenda.

(07:30):
Will put ev charging stations, will renovate some parks, will
make plantings, all this bull crap. So they have to
do two things. What's called a final environmental assessment and
what's called a fonsie. Everything is an acronym and all

(07:50):
this government speak. But that's a final finding of no
significant impact. Okay, So they do all these studies, they
listen to all these people come up, and then they
just basically come to their own conclusion. Anyway, it really
doesn't matter what you say. They were gonna do this
no matter what. So, no matter what their studies came
out to be, basically, they were gonna get this through.

(08:11):
And that is how you can win based upon Okay,
your study said this, but you're still making this decision.
It shows that it's not going to reduce traffic. In fact,
it's gonna make it worse in certain areas, but you
still come to the conclusion that this is a good thing.
That's what Jersey was kind of saying in this lawsuit.
But Judge Leo Gordon, a George W. Bush appointee by

the way, who's retired but still sitting on the bench,
he basically came through with all these reasons why, yeah,
the deference has to be given to the agencies, blah
blah blah. Now the EPA, ironically, and this is where
if we can get this over the next twenty days
into the Trump administration, then there's hope that this can

(08:58):
be stopped. That's why hopefully there's a stay tonight stops
the clock, pauses everything. And if we can get across
that finish line and let Lee Zeldn take over the
EPA and let the Trump administration get in there, they
can figure out why this can stop. They can say, well,
wait a minute, we need to take another look at this,
and obviously we have questions. So the EPA wanted more study.

(09:23):
By the way, this is Biden's EPA wanted more study
on the entire region, the entire region, and especially though
in New Jersey like Bergen County, Fort Lee, those areas.
But the environmental assessment that was done only studied four

(09:44):
intersections believe it or not, out of one hundred and
two that they identified. So that's what they're saying, Wait
a minute, there's more to do here. And even the
judge admitted that and let it. But yet he let
to go past, he let to continue to go. Now
the environmental justice nonstine, which the progressives love to push,
that actually might be a saving grace here because they're

looking at ten counties. You got the five boroughs and
then you got five different counties Bergen Essex, Hudson, and
Union in New Jersey, and then Nasau on Long Island.
I don't know why they didn't look at Westchester or
others in part of this. But then they looked at
some of these minority communities, minority majority communities like Fort Lee, Newark, Bayonne, Elizabeth,

Perth Amboy, and they're saying, hey, these people are gonna
be the impacted the most. And so this is where
the environmental justice comes in. But look at these good
little white liberals like Kathy Hochel and all these others.
They don't care. They never care. It's all about the shutole,
it's all about the money, it's all about getting their
green agenda. In all this environmental justice. Were all for

the little guy. We're all for minorities. It's such bs.
And this proves it because these communities will be impacted.
They say so in their own studies. So the court
says that, and here's where it really takes a shot
at Murphy. The court says that the New Jersey governor

and his Transportation Department and their agencies like the New
Jersey Turnpike Association, whatever it's called, that they failed in
their job to go to these local communities and get
their input and have them part of the studies. So
Jersey was screwing itself anyway, that's in a nutshell what

the decision was. And even though Gordon at the end
in his conclusion basically said, well, I agree they didn't
do some of this stuff, so they have then he
puts a timetable, you have X amount of days to
come back, weeks or months to come back and tell
that's how you get okay. So if they haven't done everything,
why the hell did you give them the green light?
Because once this starts tonight at midnight, it ain't stopping.

It's not so unless that there is an emergency, stay
pause to get these things answered and get us across
the finish line in fifteen days to when Donald Trump
takes the oath of office, and the Trump Administration, the
Trump Department of Transportation, the Trump's Federal Highway Administration, Trump's EPA.

(12:31):
Until they get in there, it's we're dead, and it's
just it's it's this is Kathy Hokeel, who is the
most inept governor I have I think I've ever seen,
and I've seen some bad ones. And say what you
want about Cuomo who was horrific and deserves to have

resigned because he put this in. Congestion pricing is because
of Andrew Cuomo. She's just a nebt. He would have
been smart enough to put the pause on indefinitely. She's
she doesn't have a brain cell in her body. She
is so stupid, but she's gonna screw you good tonight

at midnight one and one hundred and three two one
zero seven ten. I can't believe this is happening, honestly,
and you have the Democrats all circling around the wagons,
and you've got way too many county executives have been silent.
Both parties, by the way, have been silent on this

because their appointee to the MTA voted for it. Only
one one member of the MTA voted against this, and
that is Bruce Blakeman's appointee in Nasau. Everyone else, every
other county, their representative voted for congestion pricing because they

forgot actually who they were working for and representing. You're
not representing the MTA when you put on the MTA board,
you are representing the people of your county or city
who put you there. This is it's not congestion pricing,
because we know it doesn't work. It's been tried in

London and other cities. It doesn't work. Congestion pricing. Just
call it a toll that you need money, because if
this really were about congestion pricing and alleviating congestion, we
would turn off the tolls at night. There's no congestion

other than construction. Basically, there is no congestion at three
am in Manhattan. This is nothing more than they want
to gobble up more of your money to feed a broken, bloated,
and corrupt MTA that can't do anything right. All right now,

Speaking of cars, Nissan City, I would buy a brand
new Nissan from Nissan City, and I would stop right
at sixty first Street. I wouldn't even drive lower than that.

I mean, if you have to, you have to. And
that's the problem. They think everyone's gonna jump on mass transit. Now,
mass transit is so inconvenient to a lot of people
if they have to go somewhere. Do you know how
many lanes that they've cut off in New York city
for bike paths and pedestrian paths and the restaurant sheds.

How about going back to what it normally was and
maybe we'd have less congestion.

people like it. It's a real Italian thing too. You
put it in with you know, with tomato, sauce and everything.
But if you like tripe, you can't find it a

once she's explain how you're going to do the mitigating factors,

you can appeal. You can appeal if if they messed up,
and they did, I mean, there's a million things you
could appeal on here. And most people understand that even
in the legal field that are left this case never
should have been brought. I mean, there's so many different

avenues where they can go. And you know, when you're convicted,
and you're not convicted until the sentence is handed down,
so technically he is not a convicted felon, but there
is a sentence attached to it no matter what it is,
then you're the convicted fella that they want you to be.

But they should never allow that can to continue. And
hopefully the appellate courts in New York will do the
right thing and not be not be the junkyard that
they are, and they're they're terrible in New York, but
I think I think they will be throwing this out

has made a ruling on the emergency appeal by New Jersey,

It would be the right thing to do again, because
once something is started, it's nearly impossible to stop, and
you have to prove that there will be harm once
it starts. And I think there will be harm, and
based on again the environmental studies and even the ruling
of the court, there was admission that there will be harm.
They haven't said how they're going to fix it, and

he set a timetable in the future to come back
and tell us how he's how they're going to do that. Well,
when you want to know before this starts. It is
so outrageous, by the way, I don't know if you
had a chance to watch it. Joe Biden giving the
Presidential Medal of Freedom to a whole bunch of people

most of which I have no problem with. I mean,
every president's been doing this since nineteen sixty three. They're
going to give it to the people they like. They're
going to reward some people and their party. You know,
it's it's not uncommon. And I mean Obama gave it
to Bill, Bill Cosby and then couldn't take it back

or didn't take it back. And Trump gave one to
Bill Belichick, believe it or not. And Belichick was the
only one that chose not to accept it because it
was after January sixth happened, and so for whatever reason,
he didn't want to He didn't want to go to
the White House, obviously with as hot as it was
back then. But you know, there's so there's a lot

of actors and actresses and musicians and entertainers and people
who have contributed to society. You may not agree with this,
but of this list today again Hillary Clinton got it.
She's not my favorite. And you know, trust me, what

was a trailblazer, she was a US senator, all Right, fine,

this country with his far left Open Society Foundation. Look
that one up. They're the ones doling out money to

violent animals run free and care more about not the
victims of crime, but are making victims out of those
that not only have been accused, but have been convicted

George Latimer, who's now a Congressman, has a full appointment
to the MTA board and their MTA representative Westchester's voted
for it. Every single member of the MTA board voted
for congestion pricing except the Nassau County executives vote.

So then that makes an interesting issue for the special
election coming up to replace Latimer. Yeah, and that's in February.

screen that this is a specific question. I want to
ask you. Is it legal for Kathy Hockle to dispatch
large amounts of National guardsmen who have no ability to
do certain forms of law enforcement in subway cause and
in the subway platforms, and also block the ability for

the head of a Guardian Angels to do his safety patrols.
Because I assume that only law enforcement and volunteers that
support law enforcement are allowed to enforce the law rather
than the National God civil defense issue.

but if you really see what they're doing, they're standing around.
It's meant to be a physical presence that is supposed
to deter crimes. Did it deter a guy, an illegal
alien from lighting up and killing a homeless lady from

New Jersey? No, it didn't. And it's just it's like
Andrew Cuomo using the New York State Troopers to go
into Manhattan, Like the NYPD isn't capable of doing their
job in New York City. It was meant to flex
his muscle, flex her muscle by using the New York
Guard the National Guard. But the governor is in control

of the National Guard and can use them for domestic things,
and they have, you know, obviously they've used them for
natural disasters and everything. This is a complete misuse if
there's no reason for that, obviously, But she's doing it
to pretend she's doing her job, which she's not. But
the NYPD knows how to do it. They just need
the handcuffs taken off them, which is what Mayor Adams

is trying to do. But again, you want to have
a show of force. They're having a problem with the
NYPD recruiting people. They don't want to go. Why would
you want to go into law enforcement in New York
City when you're completely at risk And I'm not talking
about danger that comes with a job. Your whole life, savings,

your house, all of that is at risk because New
York State, New York City, they're not gonna protect you.
And with all these frivolous lawsuits against you by all
these leftists, it's tougher and tougher to do that New
York State. I was mentioning before another Kathy Hokel wonder

there's a Reparations Commission. I think I had mentioned this
about a year ago, but now they are studying reparations
and the impact of New York's role in the slave trade.
And this commission, which, of course it's just another joke
in New York, but the joke's on us. Nine members

of the States Community Commissions on Reparations Remedies. God, they
have six months to complete a five million dollar study
and they're having problems staffing up. Believe it or not,
they have staff members to do this. Of course they do.

(46:01):
They get to hire people to come up with this pablem.
So they want to make a quality report. So we
need more people to work on this commission, and we
need more time and more money. So then they're going
to have kind of public hearings. It's again, it's like
the congestion pricing. They know where they're going to go,

(46:24):
they have to get there, and they have to do
certain things to get there. But trust me, the final
chapter it's already written on this. So the commission, they're
going to have public hearings in Albany, Rochester, Ithaca, which
is the far left progressive capital of New York, Brooklyn,
and Utica. How about having some of these in I

don't know, Massapequa. How about having some of them in again,
I don't know, Putnam County. They don't want to hear
from you, uh huh. So they're going to go into
areas where they're going to be able to draw nice,
big crowds for reparation. And how are they gonna pay
for these who cares? Who cares? They they'll raise the

congestion pricing fee. You'll pay forty dollars to come in,
so we can pay off people who had nothing to
do with slavery. But everyone's hand is gonna go up.
And California, California did a two year study to study
reporate reparations and they did a final report. And even

they're rejecting this nonsense. Gavin Newsom, that slicked back Liberal
of California, he's rejected this because they know it is unaffordable.
Everyone wants something, they're never going to agree. It's just
it's more problems than it's worth. Stop the pandering. But
now New York can take California's study if they wanted

it and just put New York on it. And there's
your answer. But no, they have to hire people to
do this, then have sham public. Heerey to get to
the point where what what's gonna happen? We're gonna really
go through this process? Are you kidding me? And then
finally I did want to talk about. So tomorrow I'm

going to the Jets Dolphins game with my daughter. A
friend of mine was nice enough to give us tickets. Now,
normally I don't like sitting outside in the cold. I'll
be very honest with you. I go to Dolphins games
because I'm a big fan down in Miami. Yeah, who
doesn't want to sit in seventy five degree weather in
the winter. But my Dolphins need to win. The Jets

are gonna screw it up. I know Aaron Rodgers is
gonna have the like the game of his career tomorrow
on the way out. But I'm my daughter and I
are going down to the game. It's gonna be like
thirty degrees. The game starts at four to twenty five,
so it's gonna be dark, it probably be windy. I'm
gonna be so miserable, but I'm going, and it's gonna
be a nice, you know, for my daughter and I
to go. But these are one of those things where

I know, at some point tomorrow probably I'm entering the stadium,
I'm like, why didn't I just stay home and watch
this on TV. I hope you had a New Year's
That was fun. We went out. As I mentioned, I
did Mark Simone show. On Tuesday. My wife and I
went to Ohica Castle with two other couples. We had
a really nice dinner and then we went over to
the Paramount Theater and we saw the New York Begs

is what happens when you get middle aged people trying
to be cool. So we left at around one fifteen,
one thirty in the morning from from Huntington to get
to Westchester, an hour drive, so I was a designated drive.

I start driving, and not five minutes later, there are
five people in my car snoring. That's what happens when
