in the US to have citizenship, a concept known as
birthright citizenship, a concept known as White House correspondent and
Supreme Court bar attorney John Decker is here to explain
this one will get people's attention.

Speaker 7 (28:27):
John, Well, it's getting people's attention. And you know, I
think that Donald Trump needs to consult the Constitution and
his White House legal counsel when that person assumes that position,
and he'll find out that this is not something that
he can do as president unilaterally. You can't do it
by executive action. You can't do it by executive order,

(28:49):
a stroke of a pen. You need to repeal the
fourteenth Amendment of the Constitution, because the fourteenth Amendment enshrines
this right of an individual born in this country to
have US citizenship. The language says all persons born or
naturalized in the United States are subject to the jurisdiction
thereof our citizens of the United States. And you know,

(29:12):
there are lots of things that Donald Trump, once he
assumes the presidency, can do on the issue of illegal immigration.
Certainly he will sign many executive actions in executive orders
start the process of mass deportations. But on this particular issue,
he's going to be prohibited from doing anything because of
the right that's enshrined in the Constitution.

Speaker 2 (29:32):
Now, as president, he could use his bully pulpit to
call for it, to encourage people to contact there, but
this would be an act of Congress. This is an
interesting piece of research. I don't know if you saw,
but it may point to the kind of things Donald
Trump can do and do constitutionally. And do with the
support of the American people. They asked the question, how

(29:53):
important is it for Trump to quickly find and deport
llegal immigrants with criminal records. This is making the distinction
of criminal records and being in the country illegally. The
possible responses were very important, somewhat important, not very important,
not important at all, and then not sure. We slap
in the face the not sure. But for the rest,
an overwhelming sixty nine percent of respondent said it was

(30:15):
either very important at forty one percent, or somewhat important
at twenty eight percent. More varied than somewhat but a
total of sixty nine percent, twenty six percent either not
very important, thirteen are not important at all thirteen percent.
When you look at it partisanly, Independence were sixty eight
percent important, Republicans were ninety percent important, even Democrats at

(30:35):
fifty percent important. But if it comes to doing sensible
things like finding criminal illegal immigrants and removing from the country,
he can't do it, and he's got the American people's support.

Speaker 7 (30:48):
Yeah, that doesn't surprise me. The poll that you just mentioned,
I mean, we saw that, you know, in a lot
of those polls that were taking pre election, it was
an important issue to so many people. I think it's
one just one of the many reasons why Kamala Harris
lost the presidential race to Donald Trump. And you know,
I think that on that front, he has the support

(31:08):
of most of the American public and that's something that
he can proceed with upon assuming the office on January
twentieth of next year.

Speaker 2 (31:16):
Interesting too, by the way, sixty three percent of Hispanics
agreed with that is very important, fifty three percent of
African Americans, only thirty one percent of Hispanics, thirty three
percent of Black Americans stood against that. So it's only
partisan for a narrative within one of the parties. The
rest of America sees the sensibility. Now you start going
after birthright citizenship, that may be. I don't even know

(31:37):
if that would be even wise. I think the first
order of business to secure the border, stop the bleeding.
Second order of business to port the criminals, that mean
the citizen's arm. And the president could do that and
he would have the backing of the American people. Be
wise to stick with that, I think. But what do
I know? Well, I said they hided him instead of
head go ahead. I heard about that that's right. I

(31:58):
got to you too. Now that hurt. The Decker knows
I try to impress him the rest. No, I'm a schmuck.
What do you make of that? Is he testing this?
Is he just throwing it out because he seemed to
be on point in his Meet the Press interview and
and focused on what makes sense and not some of
this more dramatic stuff. This feels more testing of the water.

Speaker 7 (32:20):
He throws a lot of ideas out there.

Speaker 2 (32:22):
You know that, Michael.

Speaker 7 (32:23):
You know, in order to repeal a constitutional amendment, it's
a real arduous effort. You need two thirds vote in
bothe the House and the Senate. You need two thirds
of all states to repeal that amendment. That's simply not
going to happen. The numbers are not there. That's why,
you know, concentrating on those other efforts, like the one
that you just mentioned, focusing on deporting criminal elements that

(32:45):
are here illegally.

Speaker 2 (32:46):
That makes the most sense.

Speaker 7 (32:48):
And the president, once he assumes that office, will have
the support of a majority of.

Speaker 2 (32:52):
The American public. I only have five seconds. You heard
