In de Digital Services Act (DSA) staan nieuwe en strenge regels die gelden voor de online advertentiemarkt. Zo moet duidelijk zijn wie er achter een advertentie zit en moeten grote platforms zoals Facebook of YouTube een openbare database bijhouden van alle advertenties. Maar de online advertentiemarkt staat in de schaduw van Big Tech.
Daardoor laat de handhaving van deze regels te wensen over. Volgens de DSA is de online advertentiemarkt namelijk een zeer groot onlineplatform, waardoor hier de strengste categorie aan regels opgaat. Het is een van de belangrijkste conclusies uit het onderzoek van onder andere Pieter Wolters, hoogleraar Burgerlijk Recht aan de Radboud Universiteit in Nijmegen.
Advertentienetwerken die advertenties tonen op websites en apps van derden, moeten dus ook beschouwd en behandeld worden als online platforms en zelfs VLOP's: Very Large Online Platforms. Het gaat dan om online diensten met meer dan 45 miljoen gebruikers per maand binnen de EU. Maar wat blijkt? Momenteel is nog geen van hen als zodanig aangewezen door de Europese Commissie.
