Herbert S. Subin, Eric D. Subin, Jorge Arturo Gonzalez Lupi, and John Does 1-50. The court ultimately dismissed the RICO claims because the plaintiffs failed to adequately demonstrate direct injury and proximate causation as required under RICO law, finding their injuries too attenuated from the alleged fraud. Additionally, the court declined to exercise supplemental jurisdiction over the remaining state law claims and granted the plaintiffs leave to amend their complaint, while also addressing a minor issue of plagiarism by the defendants' counsel for which no sanctions were imposed.
