And I'm so happy to see people,business owners come in and go
through the same thing thatwe're all experiencing.
And so that's your work is yoursneakers, correct?
But you've also experienced thefamily court corruption and the
pain in that.
So tell me a little bit aboutjust like a basic, when did you

realize family court was notprotecting our children?

UNKNOWN (02:10):
Yeah.

SPEAKER_00 (02:10):
the moment they read that corrupted verdict against
me where it was all turned 180without explanation whatsoever.
And the kids being completelygone 3,000 miles away to
California while we lived in thestate of New Jersey.

SPEAKER_02 (02:24):
And so they just took your kids away and they
were allowed to go from NewJersey to all the way to
California with their parent,with the mother?

SPEAKER_00 (02:34):
Well, in other words, it started off with going
to vacation Mm-hmm.

And I filed for divorce aftershe blocked me.
I filed for divorce and to havethe children seek to be returned
back to the state of New Jersey.
An amazing judge named JudgeJames Jimmy Guida was awesome.
Great judge.

SPEAKER_02 (03:23):
Is this a New Jersey judge?

SPEAKER_00 (03:25):
Correct.
Bergen County.
Great judge.
He was awesome.
As soon as he took the case, hewas seeing it right through the
bullshit.
And he ordered for the kids tobe returned back to the state of
New Jersey after denying.
like half of the business, thisand that.
They were going aftereverything, basically.
So in other words, on February22nd, 2022, Judge James Jimmy

got up, put in an order sayingthe kids must be returned back
to the state of New Jersey byMarch 23rd, 2022, which under
the circumstances, I had to geta two year paid off, like two
bedroom or a single family homefor her to stay like for free.
So she could come back becauseshe was claiming she didn't have

the funds to support herself.
And the reason why she notreturning is because she's
staying at her parents' houserent free.
and that the parents werehelping her with the kids.
Now, I'm over here looking witha real estate agent a place for
her to stay.
March 22nd comes around.
An order to show cause has beenput in place saying the reason

why she's not returning back tothe state of New Jersey tomorrow
with the children is becauseshe's scared for her life and
that I was abusing her everysingle day.
Now, this is happening with allthe brand new attorneys.
So...
So basically...

So tell me what was it like before you guys got
involved with it?
How were you as a father?
Were you both involved parents?
What was it like before you gotinto family court?

SPEAKER_00 (05:04):
It was just regular couple.
Basically, I go to work.
She stay at home mom with thekids.
Everything was just fine.
It just came out of nowhere.
The whole situation is just hitout of nowhere.
Moves quick, stuff like that.
Maybe she wasn't happy with themarriage any longer or she was
missing her family over there.
Whatever the case could havebeen.

(05:25):
So once you have kids, it's allabout the kids, not about me or
you at this point.
And she just...
So the Judge James Jimmy got herand said, I'm not buying this.
We've been going back and forthto court for a whole year.
We basically wanted the soul outof this guy while keeping his
kids 3,000 miles away.
And now you're telling me this.

(05:46):
However, we're going tobasically appoint Dr.
David Gomberg into the case.

SPEAKER_02 (05:52):
Who's Dr.
David Gomberg?
Who's that?

SPEAKER_00 (05:54):
Super smart, intelligent person that I ended
up meeting through the court.
He's a psychiatrist that's likewell known in Connecticut, New
York and New Jersey.
Well, very well respected aswell.
I mean, you could tell the manis all there.
You know what I mean?
When you have a conversationwith him.
And

SPEAKER_02 (06:11):
you're getting him involved.

SPEAKER_00 (06:13):
The judge gets him involved.
They refused.
to hire him because we weresupposed to hire him jointly.
I was supposed to put 15 grandin an account.
She was supposed to put 15 grandin an account because he's not a
biased person.
It's basically all about thechildren and that's what he's
known for.
And he doesn't even take all thecases that whoever wants to hire
him.
So if he feels like, hey.

SPEAKER_02 (06:33):
Wait a second.
$15,000 each?
You have to put it in an accountfor

SPEAKER_00 (06:36):
him?
There was something above thoselines.
You know what I mean?
From what I remember.
Because it's like a nine-month.
He had to fly out to California.
He had to do an investigationthere.
There was so much going on overhere.
The number was up.
It wasn't a low numberwhatsoever.
They refused.
They basically said.
Who's they?

My attorney, defense, and myex-wife, yeah, saying we're
going to hire our own, eventhough Judge James Jimmy got it
said, I'm still going to dowhatever Gombrich says, which
doesn't make any sense.
First, you didn't have thefunds.
Now you want to hire your ownperson instead of just the
judge.
You know what I mean?
You don't go against the judge.
So...

They hired somebody else.
They did a nine-monthinvestigation.
Dr.
David Gomberg.
He did it?

Did he end up doing it?

SPEAKER_00 (07:25):
Yeah, he did it.
He took my case in.
After the nine-monthinvestigation, he, like, put a
capital letter saying, this iskidnapping.
Kids must be returned back tothe state of New Jersey
immediately for the bestinterest of the children.
You can't just keep the kids3,000 miles away from their
father for no reason.

Right.
I've

never been in trouble, never been arrested,
never just straight business.
You know, what I mean?

So...
4-27-2023 Intensive SettlementConference gets into place,
which Dr.
David Gomberg started talking tothe judge at 12 o'clock because
Judge James Jimmy Guida wantedto speak to him.
And he basically put in an ordersaying...

SPEAKER_02 (08:06):
Who put the order in your judge in New Jersey?

SPEAKER_00 (08:09):
Yeah, in New Jersey, again, Bergen County.
So he backed to the same thingas to what happened.

SPEAKER_02 (08:14):
So after you had this report come out, the
doctor, the psychiatrist said,nope, this is kidnapping.
You can't take children 3,000miles away.
The judge comes in and sayswhat?

SPEAKER_00 (08:26):
Goes back to careful.
You got 10 minutes to put 40grand in your attorney's account
so you could have two years ofstay.
Now...

SPEAKER_02 (08:33):
Wait, wait.
So he said that he wanted youguys to stay, meaning everything
to stay put, meaning she canstay in California and you
can...
Right?
What do you

SPEAKER_00 (08:41):
mean?
No, he basically just went backto what happened in February of
2022 where I had 10 minutesbreak room to go put 40 grand
into my attorney's account.
So she could have the two yearsof free stay.
He went back to before theallegations of the assault
because there was no assault.
So he's like, we're going backto it.
The kids are coming back.

Put$40,000 in your attorney'saccount so she could have two
years of stay.
And that's it.
So when we came back from thebreak room, the defense goes,
we'll give him$40,000 for him tomove to California for 50-50
custody.
And I said, absolutely not.
I have so much going on here tobegin with.
It's so much easier for me justto give her the$40,000 like the

judge asked to begin with.
She claims she works 15 hours aweek at a dental assistant to
answer phone calls.
We got a lot of dentalassistants around here, too,
where...

SPEAKER_02 (09:32):
And you have your business there and

SPEAKER_00 (09:33):
stuff.
Correct.
Yeah, business, house, it'sjust...
Always been a Jersey guy

to live as well.
Right.
And the kids used to go toschool there.

school.
They were just so young.
Yeah.
My son was January.
So he was like three months old.
My daughter was two years oldwhen all this was happening.
And are they

in school now?

SPEAKER_00 (09:52):
Yeah.
Over there, though, inCalifornia.

SPEAKER_02 (09:55):
Yeah.

Second grade.
My daughter started.
And that happens.
So judge goes, you know what,Kev, just save your money.
Trial starts first week ofSeptember.
No biased.
circumstances for the kids stillstaying in california until the
trial is fully concluded saveyour 40 grand i'm like a few
months away 40 grand hell yeahi'll save it you know what i

mean so july comes around judgejames jimmy guider retires then
right before trial date soseptember 18th

I was just notified, hey, the judge on the case has
been retiring in July.
There'll be a brand new judgeassigned to the case taking the
trial, not knowing anythingabout the case for the past
three years that's been goingback and forth.
Okay, I mean, in my mind, Istill got Gombrich's report.
Well, and you still have

SPEAKER_02 (11:00):
trial coming up and you have an attorney ready.
So you have all your stuffready.
So, okay.

SPEAKER_00 (11:04):
Yeah.
September 18th, 2023.
Dr.
David Gomberg is first becausehe was my witness.
You could tell once he was goingin, Julie Kim had no doubts that
the kids were coming back.
The new judge's name was JudgeJulie Kim.
She was a great woman as well.
I have no complaints about her.
She was very nice.

(11:26):
She was straightforward.
She was fair enough.
She did unite my family afterGombrich testified.
I went on the September 19th andshe ordered for the kids to be
in the state of New Jersey forbasically October, Halloween.
I get to spend my son'sbirthday.
He was born on November firstfor the first time and yeah and

then their fourth sibling wasborn so i moved on with somebody

not your fourth not yours

my my i have four in total two from my ex-wife and
two just moved on right afterthat

We have, now we're four.
We're all chilling.
They had to go back because Ihad them for Christmas of the
year before.
It was her turn to have them,which was fine.
Then January 25th was the lasttrial day to where it left off.
You could tell the whole timewe're winning, of course.
It's very simple how it was soeasy that they were bullshitting

the whole time.
And...
We left off.
We left January 25th that thekids weren't going back to
California.
That's where we stopped.
So at this point, were

SPEAKER_02 (12:36):
the kids in California or were they in New
Jersey?

SPEAKER_00 (12:40):
had them for Valentine's.
I got them back.
She was

SPEAKER_02 (12:45):
flying with the kids with all this.

So either I go pick them up, she brings them, or I
go get them and she...

So you fly out there, pick them up, and then
fly back.

Fly back, same day, the same.
It's a lot of hassle, you knowwhat I mean?
Now, I had the kids.
There was no order for them togo back.
They were in the state of NewJersey.
The last thing she said was Iwill read the final.
We'll have the final JOD beforeMarch 31st, which March 31st of
2024 was Easter.

I'm like, all right, take yourtime.
I don't care when you read it.
You know what I mean?
What do you mean read

Yeah, read the JOD, the final verdict.

But she hadn't read it yet.

There's no calf taking the kidsback.
We left the court flying as wewon.

And when you left, but thenthere was one and she said she
hasn't read it yet.

Yeah.
So basically I have the kidsJanuary.
I mean, March 30th comes around.
My own attorney calls me saying,I see an order in place here.
have to return the kids tomorrowon March 31st.
I'm like, what?
There was never an order inplace when we were in court
saying I've got to return thekids on March.

The only thing she said wasshe's going to have the verdict
by March 31st, implying thatthose kids weren't going back
because she didn't tell me totake them back.

SPEAKER_02 (14:23):
Well, but if Kay says she's going to have a
verdict, that means her decisionwill come out then.

SPEAKER_00 (14:27):
Yeah, but you could tell the whole time.
She united us in October,November.
She didn't care about the factthat the mother kept saying, oh,
they're going to school.
She's like, you're talking abouta first grade.
They're not in high school.
You know what I mean?
She was ripping the mother thewhole time.
Okay, so

then your attorney calls you and says, you got to
return the kids because theorder came.

SPEAKER_00 (14:45):
Yeah, I'm like, what?
He's like...
I was like, you telling me thistoday that I got to return the
kids tomorrow while there wasnever something like that in
place?
Because number one, if that wasthe case, I would have bought
the tickets.
I'm not going to leave it forthe last day.
Number two, that never tookplace.
Call and find out what's goingon.
Like, why is there?
I'm like bugging out.
And plus, the same judge thatunited me with my kids wants me

(15:09):
to fly on Easter day, not bewith my other family.
I celebrate Easter.
You know what I mean?
It's a huge holiday for us.
You want me to leave in themorning, forget the other two
kids, my whole family.
family, my parents and everybodyelse.
What judge is going to put anorder like that after uniting
the family?
I said, there's something wrong.
There's a foul play.
Something's not adding up.

(15:29):
He's like, I don't know.
I was like, I'm not returningthe kids on Easter.
I'm going to enjoy my Easterwith the kids.
And plus, it was my turn becauseshe had them the year before to
begin with.
So none of this is adding up.
He said, you don't take themback.
You're going to get arrested.
I'm like, fuck it.
We'll get arrested.
You know what I mean?
If that it is.
As long as I get to spend myEaster with my kids because I
know something is happening.
You know what I mean?
That's not what happened when wewere there.
That was never the situationbecause that being said, when I

was there on January 25th, JudgeJulie Kim's court clerk
obviously was watching the wholething going on.
When he was walking towards thebathroom, he just, like, looked
at me.
He's like, you know you won,right?
I was like, yeah, it wasobvious.

There's no questions, there's nodoubts in my mind whatsoever.
Nobody could do that.
Nobody could just take the kids3,000 miles away or shouldn't be

Like, it could be a drug addict,alcoholic, none of that.
There's none of those above,never been arrested.
Nothing changed between that onemonth for you to go 180 against
me.

He kept on calling me on Easter.
I returned the kids April 1st.
I was like, it is what it is.

He said, let's wait for thefinal verdict.
April 24th comes around.
He's like, he calls me.
He's like, we have court today.
I'm like, well, I can't make itbecause I'm in Florida.
I have a little chicken store inFlorida, in Tampa, Florida, and

I'm running.
I had to be here.
Can you tell them to rearrange?
Because I can't just make itthere.
He's like, oh, no, don't worry.
This one's going to be on Zoom.
I'm like, this one's going to beon Zoom.
Every single court case was inperson.
The most important court casethat they're going to read the
final verdict is going to be onZoom.
That's strike number two.

Well, if you're just reading it, it could be on Zoom
because all you do is show upand you read and you leave.
You don't get to do anythingwith that.

SPEAKER_00 (17:38):
To me, I was already feeling something, you know what
I mean?

We get on a call.
A Zoom call starts.
Basically, the same judge whounited the family that was with
the whole time, ripping them,right off saying all previous
orders from previous judges havebeen uplifted and the kids are
now permanently Californiaresidents.
I turned yellow.
Wait, say that again.

talked really fast.

SPEAKER_00 (18:14):
Basically, previous order from previous judge, which
was Judge James Jimmy Guida, hasbeen uplifted, like none of the
whatever he said matters, andthe kids are now permanently
California residents.
Where the hell did this comefrom?
Not only that, my spring breakshave been taken away from me.
Christmas breaks, it went from,we had it to where the moment

they're done with school, I'llhave them until the day before
they start school, which wasthree weeks.
Somebody removed those orders,made it from December 21st till
December 26th.
I'm like, yeah, what a smartjudge.
Can't even play with yourChristmas toys?
2050, open your Christmas toys.
26th morning, we're going to geton a flight?

It's a day there and a day back,so...
After not seeing them for 180days, you want me to have them

He's the one who sold me out.

Well, this is how it all worked out.
This is where the most highlightof the part starts.
So they read this on me on4-27-2023.

And the first Saturday, which ison 4-27-2023, guess who shows up
to my store?
The same store I'm talking toyou with.
Judge Julie Kim's court clerk.

At the door.
My whole family is in here.
I'm pitched yellow just likethis.
Everyone's trying to make mefeel better.
The door opens up because I havetwo doors.
The first door opens up.
I always greet people just likebefore when somebody walked in.
The second door opens up.
I'm like to my employees, myfamily, get him.
He's the one who sold our kids.
You know what I mean?
He opens the door screaming inhere.

(20:02):
Get rid of your fucking attorneyright now.
I know who sold your kids.
I know what judge got paid off.
The whole situation.
It's like I need to speak to youin private.
It's Saturday.
It's Packwood store.
I'm like, what the fuck is goingon?
Brought him around the showcase.
This is all on video.
Brought him to the showcase,took him to the back room of the
store, tells me the whole storyfor 18 minutes.
He's like, I haven't slept forthree days.

(20:24):
And this is the lady.
I don't even know what she lookslike.
Obviously, I had to search herup.
The person responsible.

SPEAKER_02 (20:31):
I saw your website.

SPEAKER_00 (20:32):
Correct.
So it was her.
She had no reason to enter her.
So basically, what he told mewas just like insane.
In the back room, how Julie Kimwas arguing with Mecca.
Mecca was saying, who's the bosshere?
I'm the boss here.
He got involved saying, youcan't do this.
Like, we know she's lying.
Like, it was he said it wasturned into like a complete.

political war shit show,whatever that means.
I don't know.
What has that had to do withkids or like my situation?

you have a video of him, the clerk, walking with you

It's funny because I have a video as well of my ex's
now wife plotting with a policeofficer.
I don't know if you've seen thatvideo.
She's plotting with a policeofficer because she used to be a
police officer and they'reliterally, it's a 45 minute cop
video and they're trying tofigure out a way to get me
arrested so she can take mytwins and call them her own.
And we, she's, we, they wouldn'tlet me do anything with this

video for years because it wasunder, you know, it's
investigation.
And, um, and so finally, I thinkit was five years later, they
finally got to, I finally gotit, got to talk about it.
And I sent it to the policestation, the detectives, and I
filed a report against thepolice officer that did that.
And, um, so that, but it wascrazy because they kept this

video forever and I couldn'ttalk about it because under
investigation, well, no one didanything.
So just be careful.

thought, okay, it's fine.

And then out of nowhere, there'sthis, all of a sudden, this
meeting, this court hearing onZoom and you're in Florida and

you can't, it's all on Zoom.
But then all of a sudden theyread off everything that you
thought was wrong and gone.
And your kids were gone.
They're residents of California.
And then you lost all yourholiday and your time and And
the calendar is so bad that youcan't even utilize your holidays
because it's not enough timeframe to go back and forth and
fly.

you're at home or you're at your work and all of a
sudden you're just that coloryellow and this person goes in
the front door and yells?

outside and you have a recording of this clerk
telling you how this judge waspaid under the table.

Now, not only that, so now Ihire the best attorney there is
in New Jersey.
I look up, of course, we needsomebody very powerful now
outside the county.

It has to be different powers ofcounties at this point.

what's going on.

One thing I learned is record everything that's
going on in there.
Record everything that's goingon, because my transcripts have
and tampered with.
There was never an order sayingI had to return the kids on
Easter.
So you're telling me a judgetold me I had to return the kids
on Easter and I sat there andsaid, sure, I'll ruin my Easter,
ma'am, and I'll return my kids.

No, I would have fought that.
You know what I mean?
And no judge in a right mindshould do that because it's
supposed to be 50-50 balance.
Why would I ruin your Easterwith your kids when it's a
holiday?
Do I want you to travel 3,000miles back and forth?
And what about your otherchildren and your wife or your
your family, you know, as ajudge that shouldn't be allowed

So, so I guess my point of thisis when people start this
process, you can say, I'm agreat father.
I'm a great mother.
There's nothing that I've donewrong.
I have no backbone, but this canhappen to anybody,

The Burden is a documentary series that takes listeners into the hidden places where justice is done (and undone). It dives deep into the lives of heroes and villains. And it focuses a spotlight on those who triumph even when the odds are against them. Season 5 - The Burden: Death & Deceit in Alliance On April Fools Day 1999, 26-year-old Yvonne Layne was found murdered in her Alliance, Ohio home. David Thorne, her ex-boyfriend and father of one of her children, was instantly a suspect. Another young man admitted to the murder, and David breathed a sigh of relief, until the confessed murderer fingered David; “He paid me to do it.” David was sentenced to life without parole. Two decades later, Pulitzer winner and podcast host, Maggie Freleng (Bone Valley Season 3: Graves County, Wrongful Conviction, Suave) launched a “live” investigation into David's conviction alongside Jason Baldwin (himself wrongfully convicted as a member of the West Memphis Three). Maggie had come to believe that the entire investigation of David was botched by the tiny local police department, or worse, covered up the real killer. Was Maggie correct? Season 2 - The Burden: Empire on Blood Empire on Blood is set in the Bronx, NY, in the early 90s, when two young drug dealers ruled an intersection known as “The Corner on Blood.” The boss, Calvin Buari, lived large. He and a protege swore they would build an empire on blood. Then the relationship frayed and the protege accused Calvin of a double homicide which he claimed he didn’t do. But did he? Award-winning journalist Steve Fishman spent seven years to answer that question. This is the story of one man’s last chance to overturn his life sentence. He may prevail, but someone’s gotta pay. The Burden: Empire on Blood is the director’s cut of the true crime classic which reached #1 on the charts when it was first released half a dozen years ago. Season 1 - The Burden In the 1990s, Detective Louis N. Scarcella was legendary.
