Athena Hope (00:15):
Hello everyone,
welcome to the Transgenders at
War podcast, the show thatfocuses on transgender people,
politics and how transgenderpeople are affected by it.
I'm your host, athena Hope.
In this episode, we'll bediscussing how Donald Trump and
his administration arerelentlessly attacking the
judicial branch.
They are doing this in anattempt to gain more power.
Trump is not only challengingthe laws that have guided our
(00:37):
country for centuries, but he'salso risking a major crisis that
could change our politicalsystem for generations to come.
Project 2025 is the blueprintfor this nightmare scenario.
It's a sinister plan totransform Trump into a dictator
free from the constraints ofjudges and laws.
Our democracy is hanging by athread and the threat of
dictatorship is closer than youthink.
(00:58):
Join me as we expose thechilling details and explore
what this means for the futureof our nation.
America is on the brink ofchaos.
(01:18):
For the first time since theCivil War, a president has
brazenly defied court orders, and that president is Donald
Trump.
Trump is testing the limits ofour democracy, pushing against
the rules that keep ourgovernment balanced.
After America became independentfrom Britain, our founders
created a system to make sure noone part of the government got
too powerful.
They split the government intothree parts the legislative
branch, the executive branch andthe judicial branch.
(01:40):
The legislative branch, whichis our Congress, is the only
body that can create laws, control spending and declare war
.
The executive branch, led bythe president, enforces these
laws but cannot create new ones.
That power belongs to Congressalone.
The judicial branch, with theSupreme Court at its helm,
interprets the laws andsafeguards our constitutional
(02:00):
rights.
Each branch is designed to keepthe others in check, ensuring
that no one branch has too muchpower.
For example, if Congress passesa bill, it must go to the
president for approval or veto.
Even if the president vetoes, congress can override it with
the two-thirds majority.
Then, ultimately, the SupremeCourt can decide if the law is
constitutional or not.
(02:21):
Another example is that thepresident can nominate new
judges, but only Congress canput them in power.
Their president can also giveexecutive orders, but the courts
can cancel them if they breakthe rules of the Constitution.
But Donald Trump is relentlesslytesting these limits.
His strategy Do whatever hewants until the courts stop him.
Since the start of 2025, judgeshave had to intervene over 15
(02:42):
times to halt Trump's illegalactivities.
That's more injunctions inthree months than during the
entire separate presidencies ofboth Barack Obama and Joe Biden.
The courts have struck downmany of Trump's audacious moves,
like his attempt to endbirthright citizenship and his
plan to let Elon Musk dogeprogram raid social security.
They've even reinstated federalworkers that Trump tried to
(03:04):
fire, but Trump doesn't care.
He's on a power trip seeingwhat he can get away with.
This is all part of Project2025, designed to overwhelm the
courts with so many cases theycan't keep up.
Trump and Musk have been soenraged by the courts blocking
their schemes that they're nowcalling for the impeachment of
federal judges, something apresident has never done before.
The highest-ranking SupremeCourt judge, republican Chief
(03:27):
Justice John Roberts, hascondemned Donald Trump and his
team for the crude attacks onhis judges.
A day after Chief Justice JohnRoberts condemned Trump, trump's
team sent out a newsletter toall his followers titled Impeach
, impeach, impeach.
Donald Trump's administrationis telling his followers that
the judges are quote radicalleftists in disguise and if they
(03:48):
don't allow Trump to do what hewants, then the judges will
allow violent criminals to roamfree and put your families in
grave danger.
Trump is trying to scare hisbase into supporting the
impeachment of his enemies.
In reality, impeaching a judgeis very difficult because it
requires support from not justRepublicans but also Democrats,
making it very unlikely tohappen.
Vice President JD Vance haseven suggested that the judicial
(04:12):
branch is abusing its power.
He is very eager to dismantleour checks and balances.
These judges are our finalprotection against a complete
dictatorship.
The crazy thing about thejudicial branch is that all the
judges have are their own words, verbal or written.
When they issue an order, presidents must follow it.
If the president doesn't followit, then something will happen
that will be called aconstitutional crisis.
(04:33):
A president hasn't ignored ajudge's orders since the Civil
War, but Trump is pushing theboundaries of what he can get
away with more and more.
This is why he's kicking hislegs and crying like a baby
about the mean old judges.
Last week, trump's most alarmingpower grab yet occurred when he
invoked an obscure law calledthe Alien Enemies Act of 1798.
This act allows the presidentto detain or deport citizens of
(04:57):
a nation we're at war withwithout any due process.
Trump is using this law tobypass the courts and deport
anyone he deems a threat.
The Alien Enemies Act has onlybeen used during times of actual
war, and only Congress candeclare war.
Trump's use of this law is notonly wrong, but it's illegal.
The law clearly states it canonly be used if a foreign
government is invading ournation.
(05:17):
Congress hasn't declared war onany nation since World War II.
This law is meant to targetforeign governments, not random
gang members.
Random drug cartels and gangsdon't constitute as a government
that's invading us.
This means that the AlienEnemies Act of 1798 is invalid
and Trump is only using it as ameans to gain more power by
(05:37):
allowing him to bypass thecourts.
Donald Trump is trying tojustify this use by saying that
we are being invaded by a randomVenezuelan gang.
His advisors have even tried tosuggest that it's really the
drug cartels that are runningtheir countries, which is
blatantly false.
Trump's advisors have said thatthis doesn't just apply to
Venezuela, but to Mexico, elSalvador and any nation that
(05:58):
just so happens to have a drugcartel inside the US.
If the courts allow Trump touse this act against anyone he
deems a quote invader, it willbe catastrophic.
Imprisoning people without dueprocess is a cruel and evil
practice used by authoritarianstates.
If Trump gets away with it, hewill only expand this practice,
while Trump claims his currenttarget for the Aliens Act is
(06:19):
limited to the members of theTrenday Oagwa gang.
If the Supreme Court allows it,it could be expanded to
migrants from other countriesand anyone else he claims is
quote invading us.
Not only that, but Trump hasrecently threatened on Twitter
to deport not just immigrants, but any American citizen who
dares damage a Tesla.
With this law, trump coulddeport any American citizen,
(06:40):
since they do not have to go tocourt first or have any due
process.
He can even make the claim thatthe quote crazy gender ideology
is making an invasion againstus and that he needs to protect
the women and children, a claimthat he has previously made
multiple times.
Through his executive orders, trump has paid the Venezuelan
government $6 million toimprison those he deports using
(07:00):
this law.
The Venezuelan governmentgladly accepted it so they could
gain favor with hisadministration.
Trump's administration hasalready illegally sent almost
300 people straight toVenezuelan prison under this
Aliens Act.
The prison he's sending them tois known to be one of the worst
in the world, with horrificconditions and human rights
violations.
They are sent to prison whileTrump acts as judge, jury and
(07:21):
executioner.
Usually, deportees have theright to a hearing, but under
Trump, they're sent straight toprison without due process.
The Trump administration haseven admitted that many of those
deported have no criminalhistory or gang involvement.
Yet they are sending them to aplace where they may be
imprisoned for life.
And now there are dozens offamily members appearing on TV
wondering where their loved onesare, because Trump took them in
(07:43):
the middle of the night.
The family members stated thattheir loved ones have never been
involved in any such gang.
Trump refuses to release thenames of those he's deported,
fearing it would reveal hisfalse accusations.
He even deported a man known tobe a professional soccer player
for the only reason that he hada soccer tattoo that they
mistook for a gang tattoo.
That man is Jers Reyes Barrios, who came over to the US legally
(08:05):
and was working to gain hiscitizenship.
One night, trump's gang cameand deported him without
allowing him to contest Trump'sdecision.
The only reason we know whereDers Berrios is now is because
his mother recognized him in oneof the many ISIS-style videos
that the Trump administration ismaking.
Trump is too scared to releaseany names or explain what his
process is for choosing who hesends directly to prison, but he
(08:27):
has no issues creating videoswith dramatic music for his
followers to cheer on.
Right now, the only personstopping Trump's latest power
grab is federal judge James EBoasberg.
Boasberg has temporarilyblocked Trump's deportations
under this Alien Enemies Act sothat they're able to investigate
more of what's going on.
During Boasberg's hearing, heordered the last plane Trump
(08:47):
sent to a Venezuelan prison tobe returned to the US.
However, trump's administrationhas defied this order, claiming
that the plane was alreadyoutside the US airspace and
therefore outside thejurisdiction of US judges.
The Trump administration hasalso stated that they couldn't
return the plane due to privacyconcerns, but his
administration's logic doesn'tmake much sense.
You're telling me that as longas you're outside the country,
(09:10):
you can do whatever the hell youwant and not have to listen to
the judge's orders anymore.
The potential abuse of thatwould be insane.
If Trump was allowed to do this, he would be able to fly his
political enemies out of thecountry to kill and get away
with it, since, because they'reoutside of US airspace, they now
magically don't have to abideby law and order anymore.
Judge Boasberg is nowinvestigating whether Trump's
(09:30):
administration violated hisorder.
If found in contempt, trumpofficials could face fines or
jail time.
Everybody is worried of whatwill happen after a judge finds
a Trump official in contempt ofcourt.
It is the US Marshals from theDepartment of Justice who
carries out judges' orders forcontempt.
Recently, trump fired the headof the Justice Department and
then stated his loyalist, pamBondi.
Pam Bondi is a known electiondenier and a diehard Donald
(09:54):
Trump supporter.
She has already expressed muchoutrage that the judges are
treating Donald Trump sounfairly.
It's very unlikely she willallow the US Marshals to enforce
any punishment on Trumpofficials.
We're at a tipping point now.
If Trump continues to defy thecourts, we could face a
constitutional crisis WithRepublicans controlling Congress
.
Impeachment is a distant dream.
(10:14):
The world is watching, withmany countries issuing travel
warnings for the US.
A president has never broken ajudge's order since the Civil
War.
If Donald Trump and hisloyalist Pam Bondi were to
ignore the judicial branchcompletely, it would officially
mean the start of Trump'sdictatorship.
Many countries like Canada, britain, germany, finland and
Denmark are all warning theircitizens to not visit the United
(10:36):
States.
Trump's strategic planner, steve Bannon, has stated that
MAGA operatives are alreadyworking on a third term for
Trump.
The stage is set for adictatorship by that point.
If you don't align with theRepublican Party's Christian
nationalist values, you will betargeted.
Trump has already fullyembraced the idea of him running
for a third term or more.
For all my transgender and LGBTplus people.
(10:58):
The warning signs are clear andthe writing is on the wall.
I urge all of you to get yourpassports ready now.
I'm in the middle of working ona survival guide for LGBT
individuals who needs to escapea hostile country.
I will have it linked in future.
Episodes In the 1930s, naziGermany, transgender and gay
people were the first ones thatwere targeted.
Things are more serious nowthan they've ever been.
(11:18):
In the past week, almost adozen countries have issued
travel warnings against visitingthe United States.
They are receiving a lot ofreports that not only is the US
rejecting entry for valid visas, but they are also arresting and
detaining citizens too.
A scientist was denied entryjust for being known to
criticize Trump.
The story about Trumpsubmitting to Judge Boasberg's
(11:38):
orders is still developing and Iwill continue to report on it.
Do not trust the mainstreammedia.
They will sugarcoat the truthuntil it's too late.
If Trump isn't impeached soon, the damage to our country will
be irreparable.
This podcast is always sogloomy when discussing the
current events around us, buttoday I want to take a little
(12:01):
time to end this episode with alittle bit of good news.
You've heard of Elon Musk right.
The billionaire who spentnearly $50 billion to buy
Twitter and gain influence inour government.
The same Elon Musk who nowreceives secret briefings from
the Pentagon about America'sfuture, despite being an
immigrant Pentagon aboutAmerica's future, despite being
(12:21):
an immigrant.
The guy who uses his Twitterplatform to spread transphobic
hatred far and wide andregularly insults his
transgender daughter for noreason that Elon?
Well, it's looking like thingsaren't going very well for Elon
Musk.
Before this month, tesla washis most valuable asset, but
since Elon Musk became head ofthe Doge department, tesla's
stocks and sales have been infreefall.
Reports from Australia, chinaand across Europe indicate a
(12:43):
dramatic drop in Tesla sales.
This isn't a mere coincidence.
Mass protests have erupted atTesla dealerships worldwide
condemning Elon's actions.
In February, australian Teslasales plummeted by nearly 80%
compared to the previous month.
A recent survey of over 100,000Germans revealed that 94% of
Germans refused to buy a Tesla, and this isn't due to a lack of
(13:05):
interest in electric vehicleseither.
German electric vehicle salesgrew by 27%, while Tesla profits
plunged by 47%.
Consumers are choosing anythingbut Tesla.
Germany is a country that takesits history a lot more
seriously than Elon does.
Who knew that performing Nazisalutes on TV and joking about
it on Twitter would offend somany people?
(13:25):
Elon Musk was recently spottedin Germany praising the
far-right AFD party.
He said quote only the AFD cansave Germany, and Germany needs
to overcome its past guilt.
This attitude towards Elon andTesla isn't just happening in
Germany.
Tesla sales worldwide arehitting record lows.
Here in the United States, teslahas gone from being the cool
(13:47):
electric car to now being seenas nothing but a symbol of
Nazism.
Many Tesla owners have tradedin their vehicles for something
less controversial, while otherones have placed a sticker on
their cars saying that theybought their Tesla before Elon
went crazy.
Tesla sales and stocks arefalling so badly that Donald
Trump himself is trying hishardest to get more people to
buy Teslas.
Last week, trump featured in aTesla ad that was on the White
(14:10):
House lawn, and after that hetweeted that he would deport
anyone seen destroying a Tesla.
It's pretty funny, becauseRepublican leaders used to go on
and on about how much theydon't like electric cars.
Now that Nazi Elon is on theirside, they have an entirely
opposite opinion.
But sadly, that won't be enough, because it isn't right-wingers
who buy electric cars.
It's Democrats and liberals whobuy them.
(14:31):
Starting next year, tesla willbe seen as nothing but a minor
footnote in history.
Elon Musk has brought this uponhimself.
He's now on Twitter blamingtransgender people for the
destruction of his dealerships.
No one forced Elon to alignhimself with harmful ideologies.
Elon's actions are the exactopposite of what an electric car
company owner should represent, and now he is facing the
(14:52):
consequences of his actions, consequences that mark the start
of the end for Elon Musk.
I want to thank all of you fortaking the time to listen to
this episode.
I'm sorry for the very erraticupload schedule.
Dealing with discharging fromthe army has been very stressful
for me.
I took a small break, but weare back on schedule now.
(15:15):
The good news is that I mightbe able to escape this fascist
state, texas Once I'm out of themilitary.

more activist things as well.
I am really enjoying thesupport from our community so
far.
You guys inspire me to go outand create change every single
day.
Many of our people are sufferingand it breaks my heart what our
government is allowing tohappen.
Let the destruction of Tesla bea symbol for all those who dare
(15:39):
act as fascists.
People want happiness andfreedom, and that's what we
