Speaker 1 (00:09):
Around Dodd City and in the territory on West. There
is just one way to handle the killers and the spoilers.
And that's where the US Marshall and The Smell of
Gun Smoke gono starring William Conrad, the story of the
(00:40):
violin that moved west with Young America and the story
of a man who moved with it. I'm that man,
Matt dllon United States Marshall, the first man they look
for and the less they want to meet. It's a
chancy job and it makes a man watchful and a
little lonely.
Speaker 2 (01:15):
Matt, Oh, Matt, what is that you?
Speaker 3 (01:18):
Doc? Uh?
Speaker 1 (01:20):
I'll be right in.
Speaker 2 (01:21):
Thank you.
Speaker 1 (01:25):
Ya coffee?
Speaker 4 (01:31):
M all right, you doc? How's the coffee time?
Speaker 2 (01:40):
I pull yourself a couple.
Speaker 1 (01:42):
Well, gee, thank you?
Speaker 2 (01:45):
What were you doing out there, Matt walking the prisoners.
Speaker 4 (01:48):
I haven't got any presidents rank and you're.
Speaker 2 (01:51):
Falling down on the job off hend. I can think
of a desertman around Dodge and ought to be in June.
Speaker 4 (01:56):
You give me a list. I'm gonna need somebody to
bring the trial next week.
Speaker 2 (02:00):
You are, well, what do you mean?
Speaker 1 (02:02):
There is a new Circuit court judge coming. He's going
to be disappointed if there's nothing for him to do.
Speaker 2 (02:06):
A new judge. What happened to Judge Brooking?
Speaker 1 (02:09):
I just needed help, I guess, after all he has
to cover about the whole of western Kansas.
Speaker 2 (02:14):
Well, who is this new man? What's his name?
Speaker 1 (02:17):
It will be named of Stokes, Judge Stokes. That's all
I know about him. I hope he's a good one.
Speaker 2 (02:23):
I've seen some remarkably unlearned judges in my That is.
Speaker 1 (02:28):
Not an easy job, Doc, and out here it doesn't
pay enough to make it worthwhile than most men. Enough,
Judge Brooking could probably do twice as well back east,
and so could I. I'm know, Doc, But then he
wouldn't have anything to complain about it. If you didn't
have anything to complain about, you would just shrivel up
and die.
Speaker 2 (02:45):
Well, at least I wouldn't go to the pauper's grave.
I'm headed for.
Speaker 1 (02:48):
Now, I say, Doc, how about loan on my one
hundred dollars home?
Speaker 4 (03:03):
You got?
Speaker 1 (03:04):
Well, this is Homer Tisdale. What you're done?
Speaker 5 (03:07):
They complained to gaining.
Speaker 1 (03:08):
Oh complain, Yes, sir, you know Van Walcott who's took
over that little store next to the stage office.
Speaker 5 (03:14):
Yeah, I know, well, he's coming over here in a
few minutes. He claimed Homer was trying to rob him. Oh,
I figured it'd be best to settle a thing right
here at Hugh.
Speaker 1 (03:26):
Now, Uh were you trying to rob him Omer? Yes,
I see, whether a gun or what.
Speaker 3 (03:38):
I ain't got no gun.
Speaker 1 (03:39):
You were trying to steal something out of his store? Yes,
where you're from, I haven't seen you a Dodge before, Nurse.
Speaker 3 (03:52):
I've been Homestead and Saline River, but I got starved
out I had to quit.
Speaker 1 (03:59):
They had no luck at all. Yeah, well you sure
don't look as though you'd been eating very regular No, sure,
I ain't. Where's you got him here? Well, of course
I got him here, Walkett, churty little thief, Marshal. I
want to sign a complaint against his man. Mister Walkett,
(04:20):
you've been a Dodge about a month now, haven't you.
Speaker 4 (04:24):
What's that got to do with it? Back East, I
guess they're.
Speaker 1 (04:27):
A little more formal in the way they handle things.
Why don't you just tell me what happened? Well, I
was next door at the stage office on the Jay Buford.
Speaker 4 (04:37):
We heard a.
Speaker 1 (04:38):
Crash over in my store or something falling, so we
run out there he was. We caught him red handed, Marshall,
caught him doing what stealing? That's what you haven't told
me what he stole. He had a whole handful of potatoes. Marshall,
man's the thief. He belongs in jail. Oh handful of potatoes?
(04:58):
Is that true, Homer?
Speaker 6 (05:00):
That what happened, Yes, Sir Marshall, Yes, sir, it's true.
I was hungry and I seen the potatoes. I thought
he wouldn't miss a couple. I could pay him back later.
Speaker 1 (05:13):
Man who steals belongs in jail. Look walk and he
shouldn't have done it. I admit that, but didn't throw
him in jail. And I can't do that.
Speaker 4 (05:24):
Why uh?
Speaker 1 (05:25):
For one thing, Chester and I have to write up
to Fort LINEA for a few days, and there wouldn't
be anybody here to watch him and feed him, lead
him some water, that's all he needs. Chester, See you
take Homer over to the long Branch. Maybe Sam Nowtan
can put him to work sweeping out or washing glasses
or something. Look here, Marshall, you ain't gonna make a
fool of me. I'd go one Chester, Marshall, I'm telling you,
(05:48):
mister Walcott, why don't you get back to your store.
Maybe somebody has found a few pennies and wants to
buy that handful of potatoes.
Speaker 4 (06:00):
Who Doc was right? There probably were.
Speaker 1 (06:07):
A doesn't matter on Dodge that should have been in jail.
But if the law was going to start locking up
men like Homer Tisdale, I figured they wouldn't need me
to handle a job. At least that's what I thought
on the way to Fort Line. Had it was four
days later when we got back and I found out different.
We were riding up Front Street past the stage office
(06:28):
when Jay Buford, the stage company manager, and Van walkertt
spotted us and started yelling. I had Chester take my
horse while I got down and went over to see
what they wanted.
Speaker 7 (06:39):
Ah, he's come back, just in time.
Speaker 1 (06:42):
Marshall has done what I said.
Speaker 4 (06:43):
It wouldn't have happened.
Speaker 1 (06:44):
I was just telling Walkett, if you didn't get back today,
we'd have to do something. Marshall's that's the trouble. Buford murder,
murder and Robberie Marshall right there in the stage office.
Charlie Reynolds is dead and ten thousand dollars is gone.
Happ this morning about eight o'clock, Marshall. I just opened
up the store and gone into the stage off at
(07:06):
say good morning to Jay. He was standing there talking
to Charlie Reynolds, and well, I no sooner got inside
than the voice out back yelled at us to throw
up her hand, and we did too. And then this
gunman come forward wearing a mask. He knew right where
the money was too.
Speaker 7 (07:22):
I had it in a treasure box waiting for the
stage to go north, Marshall.
Speaker 4 (07:26):
This gunman opened it up.
Speaker 1 (07:28):
It was all bills, and he scooped him out into
his pocket. And then he stood there, Marshall, and he
told us not to try to.
Speaker 4 (07:35):
Follow him, And before we could even move.
Speaker 1 (07:38):
He pulled the trigger on poor old Charlie Reynolds and
killed him, just like that.
Speaker 4 (07:42):
No reason to call you didn't follow it.
Speaker 1 (07:43):
He got away.
Speaker 2 (07:45):
Now, who's gonna follow a killer like that?
Speaker 1 (07:47):
Wein' crazy? Any idea?
Speaker 4 (07:48):
Who it was? You bet we do?
Speaker 1 (07:50):
That mask that didn't hide nothing? Well, who wasn't Omer Tisdale?
Speaker 7 (07:56):
Well, just as plain as day, even if he hadn't spoken.
Speaker 1 (08:00):
Omar Ain's a meek as he looks, Marshall. He's a killer,
that's what he is.
Speaker 4 (08:05):
All that.
Speaker 1 (08:05):
Others just pretended you should have put him in jail
first off, any idea where he is? He must be
half way to Texas by now, but you better find
them Marshall.
Speaker 8 (08:15):
Yeah.
Speaker 1 (08:29):
Yeah, And Homer's a mighty cool if he is still
in dugness you maybe he hasn't heard about it yet, Jester,
you don't think he did do He will ascap if
he's in.
Speaker 5 (08:40):
Here there he is sweeping out back then table Yeah.
Oh oh, Marshalls kick, oh, Homer, this fella's.
Speaker 3 (08:57):
Looking for a drink. Dain ten o'clock yet, Homer, h
how long have you been here? Oh? Come in to
work about all about eight thirty? Marshall?
Speaker 1 (09:09):
Why where were you before that?
Speaker 4 (09:12):
Out back? Sam?
Speaker 3 (09:14):
Leave me sleep in that shed?
Speaker 1 (09:15):
He got out there? Oh, but can you prove that
you were out there at eight o'clock this morning? Proved it?
Did anybody see it?
Speaker 3 (09:22):
No? Nobody ever come out there? Why I'm Marshall.
Speaker 1 (09:28):
Well, the stage office was robbed this morning and a
man was shot and killed. Jay Beureford and Van Walk
had witnessed it. Yeah, they say you did it me.
They're willing to swear to it.
Speaker 2 (09:44):
Well, I.
Speaker 3 (09:47):
Didn't rob her. I didn't kill nobody. I wouldn't do
nothing like that.
Speaker 4 (09:53):
Marshall.
Speaker 3 (09:54):
You don't believe him, do you?
Speaker 1 (09:56):
Doesn't matter what I believe home and there are two witnesses.
You haven't even got an alibi.
Speaker 3 (10:01):
Well, I was right out back there, Marshall. I was
eating a little bread and some bacon.
Speaker 1 (10:06):
Well, you promised me something, Homer, for sure? Marshall, what
you promise me that you won't leave Dodge?
Speaker 3 (10:14):
I mean bad trouble isn't there? Yeah, I won't run,
I promise.
Speaker 4 (10:26):
Three days later Judge Stokes circuit.
Speaker 1 (10:28):
Brought him the Dodge. I want over and talk to
him about Homer Tisdale, And it was like talking into
a rain barrel or brother a whiskey barrel. Judge seemed
to have more interest in corn a.
Speaker 4 (10:40):
Liquor, than in the wall.
Speaker 1 (10:43):
Now I could get out of him was that the
jury would have to decide the case. So the following
Monday morning court was opened and an old Dan's hall
across the railroad tracks, the jury was sworn in and
Judge Stokes took over. First he put van walkin on
the sand, and then.
Speaker 4 (11:01):
Chester and I.
Speaker 3 (11:02):
Sat with Homer and watched Marshall Marshall. Something I don't
understand what, Homer. Well, that judge he'd been talking to
world cut about me. Now he's gonna talk to Beaufort.
Is he going to ask me anything?
Speaker 1 (11:16):
Well, sure, Homer, he'll put you on the stand, but
you'll have you're a lawyer to help you. But what
that man is sitting right over there, he's a lawyer
that the judge woanted to defend it.
Speaker 3 (11:29):
How can he help me? He ain't talked to me.
He won't know what to say.
Speaker 1 (11:33):
Oh, he will talk to you. I guess it's no hurry,
mister doone. I never seen his ware before you. Now
he's a stranger to Maychester. But the judge stokes since now, sure,
I don't understand why it ain't no pursuit prosecutor Chester.
But I asked a judge about that. He said that
there's no need for one. Yes, he knows what he's doing.
Speaker 7 (11:54):
Yea god I.
Speaker 3 (12:02):
Mister Bilbert, we've heard the testimony in detail from mister Walkoff.
So to speed things up, and it allowed to tak
you if you question, Yes, you were at the stage
office when they hold.
Speaker 7 (12:15):

Speaker 3 (12:18):
You you saw everything, mister Wilkett saw that right, Yes, sir.
The bandit came in, took ten thousand dollars in bills
out of the box, then shot will.
Speaker 7 (12:28):
Killed the watching Charlie Reynolds. You're on a car all
right now.
Speaker 2 (12:34):
I want you to tell the gentleman.
Speaker 7 (12:36):
In the jury who that bandit was. It was Homer Tisdale,
your honor. How did you know it was?
Speaker 3 (12:45):
There were He had a mask on, but it didn't
really hide nothing with him, all right.
Speaker 7 (12:52):
Besides, it was his voice plain as day.
Speaker 3 (12:54):
Then you knew him before sure the day we caught him.
Robin Wilket's store's been a thief ever since he come
to dot.
Speaker 4 (13:03):
Look here, your honor, you're out of order, your honor.
He's giving the jury a wrong impression of this man.
I believe me.
Speaker 2 (13:09):
You sit down, Marshall, or I'll hold you in contempt.
Speaker 1 (13:12):
Your honor.
Speaker 4 (13:13):
Don't you understand?
Speaker 1 (13:16):
Ah, that's better.
Speaker 7 (13:21):
The jury is competent to judge the evidence. Marshall. All right,
mister you mis stepped down.
Speaker 3 (13:27):
Yes, Uh, we're all Uh, we're now here from the
defense take overship. Marshall. You didn't talk to me, didn't
ask me nothing. You said he will.
Speaker 1 (13:39):
Just wait a minute, Homer, we'll see what your defense
says about it plays the card and the gentleman of
the jury.
Speaker 7 (13:46):
You've had the evidence. I rest my case, Marshall.
Speaker 2 (13:53):
What does it mean, Marshall.
Speaker 3 (13:54):
He's sitting down, Lady Marshall, do.
Speaker 7 (13:57):
That all right, Tylers. I was in the court til.
Speaker 3 (14:03):
If you're able to retire, consider the evidence, and it'll
return with its verdict in uh say, a half hour,
and it'd better.
Speaker 2 (14:11):
Be the right verdict. Hold you all in contemporary now
it's work, Marshall.
Speaker 3 (14:18):
I don't understand, Marshall. I I thought a man had
a right to say something for himself.
Speaker 4 (14:23):
Yeah, said eye owner.
Speaker 3 (14:25):
I mean that defense failure. He didn't help none, of course.
Speaker 4 (14:28):

Speaker 2 (14:33):
Would you talk to him, Marshall, Tell him I didn't
do it.
Speaker 4 (14:36):
I'll be back doing nothing.
Speaker 2 (14:50):
Oh have a nip.
Speaker 4 (14:53):
Mercial No, thank you, judge.
Speaker 3 (14:56):
I always like to get the jury out. Gives a
man time for a refreshment.
Speaker 2 (15:03):
Ah, that's good. Corn make here.
Speaker 3 (15:09):
Yeah, you know, Marshall, I'm a drinking man, but I've
never been drunk in alive never once.
Speaker 1 (15:17):
Oh that's fine, Judge Marshall. I'm sorry I had to
sit you down so hard in there. But a court's
got to be run by one man or to get
out of hand. I know I've seen it happen. I've
seen some things happen in court to judge, I never
saw an accused man not get a chance to defend
himself before.
Speaker 3 (15:36):
Heard the evidence. Marshall, what defense could he make? We
just to waste time, I see. I want to get
this trial over with. I got to take the train
up Abuleen at midnight.
Speaker 2 (15:48):
That doesn't give me much time to see Dodge, does it.
