Hi, Gail, Hello, Hello, I just have a quick question.

Now the divorce is done, how do I make sure
he complies with the order.

Speaker 3 (06:39):
Well, there's no compliance police out there, so to speak, right,
it's like most we have out there, like you know,
speed limits, et cetera. So uh, you know, the facts
are going to have to speak for themselves. Either he
does or he doesn't. Now that now, The question though,
is enforcing if he doesn't. And the good news is
you now have coret orders even if it was done

(06:59):
by a agreement. The fact that it's judge signed means
that it's enforceable, but it also means you have to
take that extra step of going back to court, or
even the threat of taking him back to court may
be sufficient as kind of a deterrent to hopefully get
him get him complying, because if you do have to
take him back from court to court on what's called

(07:20):
a contempt action, you're also very likely to be, you know,
if successful, to be able to have him be responsible
for your attorning fees. So there definitely is a hammer
when it comes to the threat of contempt.

Is there a certain form I need to file it
the court?

Speaker 5 (07:36):
Like, do you know the fore name so I can
file it?

Speaker 3 (07:39):
Well, gosh, I wish it was that easy. You wouldn't
need people like me. But yeah, the the what you're
looking for, it's called a contempt motion or emotion for contempt,
and you know, it's less about a form and it's
more about the story.

Hi, Rick, I'm leaning towards divorced. I think my wife
and I are both feeling it. My buddy told me
that I have to be proactive and be the first
one file. Just wondering why that would be the case.

Speaker 3 (08:30):
Is he right?

Speaker 5 (08:31):
Is he crazy? Yeah?

Speaker 3 (08:34):
Well, I'm going to give you a solid maybe on
whether whether he's right or not. But let's let's work
you know, down the list a little bit.

Speaker 5 (08:42):
Uh.

Speaker 3 (08:42):
Do the two of you have children together?

Speaker 5 (08:45):
No?

Speaker 3 (08:47):
Okay? And is there any sort of allegations of domestic
violence going on?

Speaker 2 (08:54):
No?

Speaker 5 (08:55):
Just I guess you're a consolable differences, you know.

Speaker 3 (09:00):
Okay, Well, here's why your friend told you that. You know,
Number one, he probably sees that on any you know,
TV shows he watches. But the one, you know, the
one thing it does do is, especially in a very
contested divorce, where there's going to be an immediate what's
called motion for temporary orders, you know, meeting, not a trial,

(09:20):
but getting into court within even a couple of weeks
to resolve some issues. You know, that are fires that
need to be put out. And if you're the party
that files, you're the one that basically sets the motion
in place. The other side gets served. They have to
respond to your motion, and then you get the last
word too, you get to do or reply to that motion.

(09:41):
So procedurally, in a pretty contested divorce, there's an advantage. Yes,
you just get more airtime, so to speak, in a
circumstance you know, like yours. Unless I'm missing something, I
don't see it as as a significant advantage. In fact,
if the two of you are are able to ultimately

(10:01):
discuss this and are kind of on the same page,
it actually may be harmful to have the first strike
be haha, here I file right. So maybe it's more
of a problem that you can both you know, turn
and look at and say, hey, here's one more thing
we have to get through.

Hey, hell, hey, how's it going.

Well, here's my question.

Speaker 10 (10:52):
My wife had a five year old child when we met,
and the kids biological father's deceased, and we've been married
now for seven years, and I'm just wondering if I'm
going to be on the hook for child support even
though I didn't adopt her, you know, my wife's child.

Speaker 3 (11:07):
Yeah, Well, is there any sort of social security benefits
the child is receiving from from the biological father? No? Okay, yeah,
you know, the there's a little bit of a tough one.
The court certainly does have the ability to kind of

(11:30):
create a a an obligation like that for you. Generally speaking,
they're not likely to because you know, there was a
father that had a responsibility in place at one point
in time, so there is you know, there was no
allegations of of hey, you know you were the father.
It was only discovered later through a DNA test type

(11:52):
of thing, which is what we see commonly unfortunately. So
I don't expect you to be on the hook for
child out support, but I can't rule it out either
if it comes up in argument.

Hey, I'm here, Sorry, guys. Yeah, So my question for
Rick is, you know, he says, when it comes to
divorce in Washington, it doesn't really matter if somebody cheats
or not. But I'm wondering if, like, can it factor
in at all? Because my story is pretty crazy. You know,
my wife has been basically our family fortune in buying

(12:50):
clothes and stuff like psychics, and she even paid for
the rent of like her side piece. So I find
it hard to believe like none of that matter.

Speaker 3 (13:01):
Sure, well, let me dive in the you know, some
of some of the angles that you have. Well, let's
go back to the basics. I think almost all the
listeners have heard that Washington considers itself a no fault
divorce state, and the purpose for that is is, you know,
maybe to avoid absolutely every you know, single case that
gets filed be people at each other's throats. So I

(13:25):
get that. Now, there are, though legal angles to try
and address some of the things you're talking about. One
is what's called waste of community funds. So, for example,
I'll take you know, one of the examples we actually
see a fair amount and can be most egregious, which
is somebody goes on a gambling bender and all of

(13:46):
a sudden, one hundred thousand dollars is gone from the
savings account over the course of two weekends in a row.
You know, that's something where in a divorce case, especially
if you hit this early, the argument is, hey, look,
this person has just wasted this community asset. They should
be responsible for replenishing that or or allowing me to

(14:07):
have my share of what should have been there. So
it sounds like, you know, we've probably just touched the
surface of some of the stories you've got. But what
you probably want to ask yourself for somebody else is
whether any of these are recent enough and egregious enough
to be able to make those same arguments.

Speaker 2 (14:24):
All right, good luck Peter. Sounds like he might have
a leg to stand on there.

Speaker 3 (14:29):
Well, And it's also one you know, and something like this.
What I hear is, you know, how frustrating and how
harmed he's already been. Yeah, but it also tells me
how harmed he would be if he doesn't get out
of this situation for sure.

Speaker 1 (14:42):
All right, Gene and Mary's Hill, you were on with

Speaker 8 (14:47):
Hello Jene, Yeah, Hey Rick, how you doing good? Unfortunately
I'm gonna probably be in need of your services soon.
But ahead of that, I've been married ten years now.
My wife didn't work for the first six years because
we had a kid. But now she is in the workplace,
and so when it comes to paying her spousal support,

(15:09):
is that going to matter?

Speaker 3 (15:11):
Oh heck yeah. You know. One of the keys is
now you're no longer in the stereotype of stay at
home mom that doesn't have either a work history or
a recent work history. So at least what you now
have is a target that's not moving. She's got a
recent history of income. So when it comes to spousal

(15:33):
support or alimony, like a lot of people know it,
the test really is sort of looking at, you know,
if there's still a significant difference of income between the
two of you, at somebody's relative need versus somebody's you know,
relative ability to pay, and so that's you know, to
the extent that she's earning money, that can only be

(15:53):
helpful to you if you're worried about your exposure.

Speaker 1 (15:56):
So had she not gone back to the workplace, then
he'd be on the hook for a while whole lot
of money. But because she's working again, this will work
out likely in Jean's favor.

Speaker 3 (16:05):
Yeah, I mean sort of. There's there's a lot of
things I don't know. I didn't ask about what sort
of numbers we're talking about, but certainly, yeah, it's no
longer in that stereotype because when somebody doesn't have an
income history or recent income history, not only is there
an issue of how much, but there's also an issue
of how long you know. Somebody can make the argument
of hey, listen, I don't have income. I need to

(16:27):
go to school for another three or four years to
be able to get a degree, to you know, to
earn sufficient income. So there's a lot of arguments that
can be harmful to the person that's exposed.

So, my wife and I we have a house here
in Washington, and we also have one in Arizona, and
we weren't, for lack of better words, we weren't getting along,
you know. So we decided to separate for a little bit.

Speaker 3 (17:03):
And she stayed in Arizona.

Speaker 11 (17:05):
But now she went the divorce. Is there a place
we should do it?

Speaker 3 (17:10):
Do we do it here?

Speaker 11 (17:11):
Do we do it in Arizona? Should I do it first?

Speaker 8 (17:13):
Here?

Speaker 11 (17:14):
Is one state better than the other one?

Speaker 3 (17:17):
Yeah? Well, let me ask about your history. You said
she stayed in Arizona. Were the two of you living
together in Arizona while married?

Speaker 11 (17:27):
No, we were living together in Washington. But she got
family in Arizona. So she just went home when we separated,
and then she just decided to stay while she was
there and maybe her mother in law or my mother
in law was talking to her.

Speaker 3 (17:39):
Okay, well, I think I've got good news for you
that the word we're dealing with is what's called jurisdiction,
which it means the power of any state court to
be able to address these things. And when it comes
to a marriage, jurisdiction is vested in the state that
you know, both of the spouses are living in, or
the last state that the spouse has lived in while

(18:00):
married together, and that one of you remains here. So
Washington is the state that has correct jurisdiction. Now what
could happen though? She could still attempt to file down there,
right because the court's not just going to kick her out.
They don't know any better at this point. If she does,
then you'll need to hire somebody to defend jurisdiction down

(18:22):
there and say no, court, it's rightfully in Washington. Because yes,
there is going to be an advantage to have a
divorce case go through someplace locally for you. You know,
you're able to go to your attorney's office, You're able
to get to court more conveniently. So yeah, you don't
want to let Arizona take jurisdiction.

Good morning?

Speaker 7 (18:52):
Just real quick.

Speaker 12 (18:53):
Washington being community property state. That being said, I was
married for about a year and a half, maybe close
to two years, not quite two, and he accumulated a
large medical bill while we were separated and never paid.
They came after me because he was working under the

(19:14):
table and refused to pay it. They garnished my wages.
How do I get out from underneath that?

Speaker 3 (19:21):
Yeah, you know this, this does fall outside I guess
of you know, my knowledge base, which is specifically divorce
family law. You know you were talking about this, you know,
being incurred post separation. There's a lot of things you know,
not to know whether or not there is something that
you signed, et cetera. So I wish I was in

(19:42):
a better position to answer your question. But it really
is going to be more of a you know, a
kind of a debt or a kind of a financed
lawyer debt collection issue that you're going to want to
consider as opposed to family law.

I'm calling for a friend.

Actually, she wants to know what she needs to do.
She just got recently separated. She's filing for a divorce
in the court, and her and her son and her
ex husband is on the deed for the house, and
she just wants to know what she needs to do
to get him off the house. There's an aim off
the deed.

Speaker 3 (20:27):
Okay, well the one.

Speaker 2 (20:28):
Do we need a real estate lawyer here?

Speaker 3 (20:30):
No, No, I can handle this one. You know, there's
a lot of water under the bridge that has to
happen first, right ultimately to be able to get him
off that title, it's going to depend on a couple
of things. Number One, who gets awarded it in the
divorce process. So, you know, we're jumping the gun in
terms of what's going to happen with the house. Rightfully,
we don't know what his or her argument's going to be.

(20:54):
Beyond that, there could be another wrench I guess in
the system, which is, let's the court says yeah, or
that they agree that she's going to be the one
that keeps the house. Well, you know, the question is
whether or not he's willing to sort of quit claim away,

(21:14):
you know, just kind of walk away from being on
that title. And one of the big questions he's going
to have is whether or not he's still on the
hook for that mortgage. You know, what you can't do
is just simply walk away without the agreement of the
lender choosing not to come after you or keep you
liable on it. So him signing away a quick claim

(21:35):
is really going to be dependent on whether or not
he has the incentive of also being able to be
off the mortgage.

Speaker 1 (21:41):
And if the house is paid for, do you then
just have to buy that person out, Like the house
is worth fifty dollars and here's your twenty five.

Speaker 3 (21:48):
Yeah, yeah, And doing a quick claim in that situation
is simple enough, absolutely all right.
