it was so bad twenty years agothe whole patio collapsed on top of
my car downstairs under the car poard. So you're on the second floor.
I am on the second floor,but I don't have anyone above me below
me. My car is below me. I'm the only one up here.

know why we're going back twenty years, but I want to understand. All
the rain pulls up on your patioand it got so heavy and it rotted
the wood I assume or did somethingand all of a sudden or maybe created
a sink hole under the patio.But the patio collapsed onto your car port.

fixed the water issue. Now I'mthinking that the water issue is the problem.
Well what is the water issue?I'm not understanding. So it rains

have probably ten times tried to patchit. Okay, so they patched it
with the last manager for the lasttime. That lasted for maybe two years.

It got behind this hold on,It got behind the siding, and
they sent someone out to repair it. So what's going on? Okay?

They fixed that and it ended,but that the contractor talked to me because
I had an onon. I hadan onon over that place, that area,
and he said, but he finishedit, I would be able to
put the onon back. Okay,So now they're telling me after they fixed
it Monday, it rained a littlebit yesterday. I didn't see any water

because it wasn't that much. Sowhen they repaired it, they had to
take the awning off and then theyrepaired the siding. Is it siding or
is it brick? What is it? Yeah? Okay, so they repaired
the siding. Then they went toput the awning back, and then what
well they did it. They won'tput the onton back up. That's the

someone out the HOA send someone outto repair it. Did they repair more
than just the siding by your houseor were they repairing siding everywhere? No,
it was just my house, okay. And they had to take the
awning down and then they repaired it. They go to put the awning back
up, and you said they can't. Why, Well, they're telling me

because it's too heavy, because it'sa motorized on in okay, and it's
too large. It's too large forthe area to hold it, and I
have to get it modified. Well, what do you mean modified? How
would you modify a mechanical awning?I don't understand. Well, it's not

the honing that needs to be modified. That the place where they positioned it
up the honon whether but that holdsthe onon on top. Oh okay,
So they have to strengthen where they'regoing to mount the awning to your yes,
okay. So what's the problem.Well, this guy that took contractor,

because he's standing in front of themanager, he's saying he can do
it, but he don't want tobe allowed before it in case it falls,
because they didn't build this place thatway. Yeah, So what's wrong?
With that, I'd probably do thesame thing. So what's the issue.
Well, the issue is they're tellingme that I got to write another

letter asking them to give permission toget somebody to come out and modify and
they don't want to approve it.Well, hold on, Jane, you
totally lost me there. You saidthe contractor was right there in front of
whomever, the head of the HOA, and they were ready to do it.

came. He told me before hestarted to work. Yeah, I would
be able to he would be ableto monitor to fix it where it was
secure enough to hold the honings.Now they have punked to him, okay,

he's saying it's a lot. Sowhat does the HOA? Okay, So

what does the HOA want you todo? I mean if they determined that
that awning was too heavy or therewas some kind of issue, I mean,
what else what would you expect?Well, I just want to be
able to fix it, the tobsecure the place. So what are they
telling you? Now, Jean,are they saying you absolutely can't do it?

Or did they give you instructions totry to get it done? Well,
she's trying to tell me if Isend a letter through, they gonna
probably not approve it because I'm theonly one that's asking for this structure,
this modification to be done. Ifyou paid for it, would they allow

I just called him today because Iwant to sell it, and he never
did it. So what do youdo? And when a leanholder just blows

you off and won't finish the paperwork, I would guess a quiet title action.

it. I'm sorry he has not. The last email, he's like,
yep, I got it. It'snotarized and I'm gonna send it off.

you think he's just lazy, hedoesn't have time to do it.
What do you think is going on? You think he's tried it seems like
it just seems odd. I mean, why do you think just in your
brain he's not doing it? Youknow, Mark, I have no idea.
Initially, it took a few emailsback and forth to say hey,
I need you to do this tofinalize this, and even made like a

I have the email a weird comment. It's not in front of me,
but like, well, you know, because I only bought the property for
thirty five hundred dollars, And hegoes, well, it wouldn't be worth
you even suing me for this paperwork. And then I said, hey,
okay, well let's figure out youknow what you do. Let's figure out
from Brad O'Brien what he would doin this circumstance. Brad, first of

all, thanks for coming on theshow. You kind of heard the story.
What do you do when someone willnot sign that special warranty deed and
get it filed or send it toyou? What do you do in a
situation like this? To me clarify, he didn't the Brad did not get
a deed in twenty seventeen when hepurchased Brad did not. No, okay,

so you're supposed to make payments forhowever long, and then whenever you
finish the payments at that point,you were supposed to get the deed.
Well, when I finished the payments, I just said to him, look,
it's done. I called Park Countyand they need you to I think
I'm using the right verbiage that youneed to sign, you know, do
the release of a specialty warranty deed. And basically the treasurer said that they

would send it to him, hewould sign it, have it notarized,
and send it back. And Okay, that last email, he said,
I got it. I did it, and I just called him today.
I never followed up. I fearedit was a done deal. I called
him today. They're like, henever did it. Okay, it sounds
like you did get a special warrantdback in twenty seventeen, so the property

was put in your name right atthat point? Correct? Yeah, because
on the assessors off as Brad,it shows, Yeah, so what you
got to do everything? Well,I think what you're talking about it needs
to be released, is a deedof trust, which is a mortgage,
and so there's a release. There'sa form to release the deed of trust
or mortgage, and that's what hehas not returned. Right. Well,
hold on, Brad, that's probablyexactly right. But what do you do

and let's take it a little let'stake it one step further. He's saying
he paid it off in twenty twenty. If he doesn't give him that release,
just like when you pay a mortgageoff, you know, it's not
like Wells Fargo's going to die.But if you do do an owner carry
and this guy disappears off to baseof the earth, or it simply doesn't
want to do it, what doyou do. Well, there's a statute

in Colorado that provides that when aDIDA trust has been satisfied and paid off,
then upon request, the lender needsto timely provide the release of that
data trust. And if they don't, well, then then then you can
sue in court. See this isbut this is exactly what the guy told

Brad. This guy sounds like anass if he asked me, but that's
what the guy told him. Well, go ahead and sue me. It's
only thirty five hundred bucks. It'sgoing to cost them more to sue the
guy to get the lean release andhe paid for the entire property of thirty
five hundred bucks. Yeah, well, I may be able to recover attorney
fees on the back end if heprevails in court. What proof do you
have it's paid off? Brad?Well, just emails that said, you

know, it looks we're done.The payments are over and he said yep.
And I said where do we Youknow? I need you to?
Park County says that you need tofill out this paper cake and he said,
this is but it took like threeemails to do that. This is
this is nuts. Let me askyou about the guy in general. Is
the guy like super old? Ishe a jerk? What? Just tell

me your thoughts on the guy.The only thing I know about him,
I think back then he was buyingparcels and selling them, okay because he
had a few others. But nowI looked him up and I think he's
a drywall contractor. He does livein Georgia. So and I'm trying to
say who so so, Brad.A couple of things. One, do
you really think he could get attorney? Well, he's in Georgia. Where

the hell do you assume him,Brad? If if the property is here
or in Georgia, here in ParkCounty, Colorado? So, Brad,
where would you sue this guy?O'Brien? Uh, you could ssume here
okay, or I assume that there'sa promissory note that was in connection with
this he did trust right, Yeah, like you get my promise right now?

You know that note might be wellyou basical would sue him in Park
County. Here's the deal though,I just smell this is going wrong from
the beginning. The guy is nowa drywall contractor, and no offense to
anybody out there, but trying tochase this guy down if he's self employed,
you know, not a W twokind of guy. We don't know

if he's got any money. Hewas splitting parcels and selling them for thirty
five hundred bucks. Now he's doingdrywall. I mean, you could go
through this and even get court costsand there's not a nickel to go after.
I mean, really what I think? And Brad, I want your
opinion on this, O'Brien. Ithink I have someone very nice, not
myself, someone one of our deputiesand not Doc. By the way,

Doc can get a little aggressive.Maybe have Scott or Chopper call this guy
and just try to get him tosign it. Maybe we offer him fifty
bucks, buy him breakfast to dayand he's get him a grand Slam a
cup of coffee. There must bea way to get this done, Brad.
Don't you think that's the best wayto handle this with such a small
amount of money. Yeah, that'sa practical way, And I do normally

try to avoid court and do somethinglike this before starting a court action.
Yeah, that is crazy, Butthere's no way you could do a quiet
title action this guy could do.Huh, well, no, you'd see
on the statute. The statute requiresthe lendard to release the deda trust god
request and if they haven't, yousee, unto the statute, you can
get attorney fees and costs pursuing thestatute if you win. Yeah, if

the guy, well, of courseyou could get the judgment for it.
But that doesn't mean you're going toget any of the money. We all
know that. Well, I'm notworried about the money. I just want
to be able to resell it.I just want to know, Brad.
What I'm talking about is, ifyou hired someone like Brad O'Brien and he
did it, you're going to haveattorney's fees tied up into that. Then
if you get the judgment for theattorney's fees, you're simply you might not

be able to collect it. Buthere's the other thing. If you really
want to get the done, youcall it, Brad O'Brien. I mean,
he'll get it done. But I'mtelling you, if we're talking about
property that's only worth thirty five hundredbucks in twenty twenty, I mean,
my god, I have no idea, Brad, how much would that What
is the worst scenario if this guyfought it all the way? I mean,

how much he could have twenty grandinto this suit? Right? Yeah,
but if you find a complaint andget a default judgment because he doesn't
answer, it might be less thanfive. Here's what I think we should

there five grand to get this done? Yeah? I think so, because

we all know this now. It'scalled diminished value. You can't go after
your own insurance company. So inother words, if your wife ran into
a telephone pole, you're not goingto get diminished value. But Dave,

to twenty percent. You got afifty thousand dollars vehicle, that's an extra

people think. They don't even thinkof the diminished value part of it,

owe. Now here's one of thequestions I get a lot when it comes
to diminished value. One, youcan never go after your own insurance company
in any state as far as Iknow. Do you know of any state
where you can claim with your owninsurance company diminished value if you created the

problem. Yeah, there's there's sevenor eight states where the case law says
you can, Georgia being the mostprominent one where you can do that.
Nice fact, Colorado had some caselaw too. The problem with it is
that once that case law goes through, then the carriers submit for a policy

change to the Department of Insurance andthey exclude it. Got it, So
they normally excluded even in those stateswhere the case law says you could recover
it from your own company. Butwhen you sign that agreement or enter into
that policy with them, they excludediminished value. So therefore it doesn't matter
what the state law is. Youagreed not to go after them. That's

(01:46:30):
right. Yeah, you know what'skind of funny when you think of diminished
value. And I want to hearthis just from your perspective, then we'll
talk about Dave's case. But ifI get my vehicle repaired after an accident,
let's just say I backed into atelephone poll or something, and I
get it repaired perfectly, I usethe best body shop. In fact,
arguably the paint job when they're doneis better than the original paint job.

I guess what I'm saying, it'sperfect, the work was perfect. It's
funny how the car is worth flashStill, how do you justify that just
in your own mind? I mean, I realize why it's that way,
because when someone shopping for a carand they see it was in an accident
and they're comparing it to a likevehicle that wasn't in an accident, it's

more appealing the one that wasn't.But it's kind of crazy. If it
was repaired perfectly, why there wouldbe just diminish value? Kind of take
me down a quick road of whenthis really came about, because I don't
remember twenty years ago ever talking aboutdiminish value. How did it become so
prominent? Well, you know thehistory, services like car packs and an

auto check and things like that havehave not have not helped the I guess
what you would call the stigma associatedwith repairs there. But the reality is
that a car that's been repaired comeswith the higher risk of problems and an
unknown factor. You can't unred repairit and look and see did they repair

(01:48:01):
it right? You have to trustthat it was repaired properly. So it
comes with a higher risk and it'sjust a much higher risk purchase to purchase
one that's had any kind of collisionhistory and repair because you're not you can't
prove that it was done perfect.You know, you think you can.
That's a great point, and you'reright. I mean I thought I had

(01:48:23):
a little better argument than that,but you just shot it down. Now,
when we talk about diminish value,how do we break that down or
into simple terms? If you havea twenty ten that's got a let's just
call it a clean history, aclean carfax, and you have a twenty
twenty four that's got a clean carfax, so you basically got one that's almost

(01:48:45):
brand new and one that's fourteen yearsold. Would you assign the same percentages?
Generally? So if either of themget into an accident, we know
the value of the vehicles is goingto be way different because one costs more
or one's worth more. But whenyou talk about diminish value, would the
twenty ten maybe only have a tenpercent diminish value where the twenty twenty four

(01:49:08):
could have a twenty percent How isthat typically factored? Yeah, for sure.
The I mean there's a lot ofdifferent factors. I mean, you
can take the far extremes and lookat like, for example, a Lamborghini
versus a Toyota Corolla, both beingbrand new, they still on opposite ende
of the spectrum. And what you'rereally looking at is the difference in the

(01:49:30):
percentages are pretty similar across all vehicles. The older the vehicle gets, of
course, the less worry in yourmind. It's is typically expected, yeah,
from wear and tear, and mayalready have an accident history or a
minor bump here and there on it. So the stigma doesn't attach to the
older vehicles as easily as a newone or as a high end vehicle.

(01:49:54):
So it's the percentages are pretty consistent. But yeah, diminish value, diminish
it over time, Okay, justnaturally. So we talked about accidents and
when I'm I'm going to bring upour caller, let me lock you in
and Dave, I'm going to bringyou up to join into this call.
Justin might have questions for you.I might ask you a question. So
I got you both up. Hisis interesting and I never thought about this

before. His vehicle he got rearended. There's damage there. He doesn't
know what the carfax is, butwe're going to help him figure that part
out. Oh and by the way, justin if a car fact shows two
accidents compared to one, arguably there'sstill diminished value, not as much,
But wouldn't there still be something toattempt to go after. Well, technically,

yes, two is worse than one. You know two is you know
one is bad, two is worse. Yeah, and you do have to
look at each one. It's harderfighting, very very difficult to get a
carrier to agree to that. Okay, the typical argument because it's already there.
They already paid out, or someone'salready paid out. So now,
but here's what's interesting about Dave's AndI don't know if you've ever run into

this when you pull a carfax andyou see the registered owner or you see
where it's gone through. But I'lljust cut to the question. Dave bought
it from Hurtz. I believe itwas Hurts rental car. So he bought
a former rental car directly from Hurtzor whomever it was. Does that show

up on a car fax? Andif it did, does that affect diminish
value? Because one could argue ifI went to look at a car and
found out it was an old rentalcar. I would consider that thing was
probably beaten up over the years.It was a rental car. So how
does that factor in If you buya rental car that's never been in an

accident, but we know it wasa rental car, and then someone buys
an individual like Dave and it getsinto an accident. Is there an argue
there the other insurance company could makebecause it was a car or Am I
totally off base? No? Imean they they routinely make that argument.
I've run into that a lot.It'll show fleet on the batterbacks or it'll

show a fleet vehicle. That doesn'talways mean that it was a rental car,
but with this one being Hurts,I would assume it was. Sometimes
fleet means it was a demo carfor a salesperson at a company, and
so that's a little different. Butyeah, tragedy of the commons with the
with the rental vehicles is a commonargument that's used that, oh, they're

(01:52:30):
going to rag out the rental carand so it was already on the lower
tier and it does affect it.I do take that into consideration. I
look at whether it was a rentalcar or not, because they're just less
desirable in general, but erect rentalcar is less desirable than the other rental
cars, so yeah, it dropsit still, but not as much.
So Dave, I would like youand tell me how much you would charge

for this. Dave's Dave. They'retrying to get it fixed at their own
shop and all this other crap.He doesn't know who the other carrier is,
but anyhow, the blame is there. It's definitely the other driver's fault.

think you would make up for ingetting him more money than he's ever going

we charge five hundred dollars for aformal appraisal. Yeah, but we have
other options for sort of lower valueclaims that are reports that we've produced.

sixteen and seventeen, I think youhad us with safe Co And I'm just

man, that's so many years ago, I just don't remember. But when
then when one of them turned sixteenand got their driver's license, you reshopped
us because Safeco at the time orwhomever it was, was so high.
We got the same coverage, ifnot better coverage from Progressive at the time

because they leaned more towards young driversand Safego. But then what I found
out a few years later at switchedback. In other words, all of
a sudden have an eighteen year olddriver. What's cheaper through Safeco than it
was through Progressive? I mean,why are they constantly changing what they do?

I just got off the phone withsomebody that is with USAAA, and they
have a young driver coming on andtheir rates were decent until they added the
young driver. So I shopped itaround and I found a carrier that would
do the young driver at a vehicleand their premium is actually two thousand dollars
less than we're paying before adding thekid, and it's the same coverage.

It's actually better coverage because I putan umbrella on them as well, So
it really if I could give anybodyadvice as far as when they're shopping,
the absolute necessity to shop. Whenyou're adding a sixteen year old on your
policy, you are crazy not tolook around at that point because there's just
