the Troubleshooter Show. Now Tom Martino. Hey, I'm Tom Martino. Welcome
to the show. Three O threeseven one three talk three all three seven
one three eight two five five.As you can see, I got all
my goons in the studio. Uhand uh, welcome goons. We got
Chief Mark and uh, Kevin Caulkin, got Jeff Vic camera transmission and then
(00:48):
who's got their back to me?And I'm sorry, Deputy Doc, Deputy
doc. Well, I was rightwhat I said, goons, welcome.
Hey, I got some interesting yousince today is Car Friday, car Day,
whatever you want to call a day. You don't have to call it
just about cars, but you cancall about cars and of course anything to
(01:10):
do with cars. And I havesomething I found quite interesting that Stephanie found
on Facebook. And I do findit very interesting. I normally don't find
anything interesting on Facebook, but itseems this person did some pretty good research.
Now, maybe they're just reposting it, but I checked out with my
(01:32):
professor Bing, Deputy Copilot Bing, and all of these facts are true.
Listen to this kind of disappoints me. And they're not just against Tesla,
but they're looking at electric cars. But they took one Tesla battery one and
(01:55):
they analyzed it. By the way, give us a call. By the
way, if you have a problem, question, you can plan. I'll
go right to your calls. Threeh three seven to one to three talk.
I digress when I just want tomake sure you know that three h
three seven one three eight two fivefive, and we'll talk about anything you
want. Make sure you don't waittoo long. If you have a problem,
a question, or complain, itfesters and it becomes worse. Now,
the Tesla model Y battery. Thisguy took a look at this and
(02:21):
said it takes up all the spaceunder the passenger compartment. Oh, that's
not so bad. But this iswhat I find fascinating. Guys, listen
to this. It takes twelve tonsof rock for lithium to be extracted five
tons of cobalt minerals. This isone battery, one battery. Most coalbalt
(02:46):
is made as a byproduct of processingcopper. Five tons of coalbalt minerals.
Now listen, so three tons ofnickel or twelve tons of copper ore.
You must move two hundred and fiftytons of soil to obtain the twenty six
pounds of lithium, the thirty poundsof nickel, and the forty eight point
(03:08):
five pounds of manganese, then andfifteen pounds of cobalt. To manufacture the
batteries also requires four hundred and fortyone pounds of aluminum, steel and plastic
one hundred twelve pounds of graphite. This is one battery. The caterpillar to
(03:30):
move this earth is a nine tonine to four h a and by the
way, that caterpillar consumes two hundredand sixty four gallons of diesel in the
twelve hours it takes the bulk ofnecessary minerals for manufacturing the batteries come from
(03:53):
China and Africa. Much of thelabor in Africa is done by children.
When you buy an electric car,China makes the most profit from these batteries.
The twenty twenty one Tesla model yOEM battery alone, which is the
cheapest Tesla battery, is currently onsale for four nine hundred and ninety nine
(04:16):
dollars, not including shipping and insallation. The battery weighs one thousand pounds and
the cost of the Tesla batteries areas follows, and they go through It
takes seven years for an electric carto reach net zero CO two seven years,
(04:39):
seven years because of one battery. The life expectancy of the battery is
around ten years, so that givesyou three years to reduce your carbon footprint.
The net result, you are addingto pollute, You are adding to
(05:01):
climate change. When you go tothe Church of Climate Change this weekend,
make sure when you kneel down atthe altar and you pray to Al Roker
and the rest of them, thatyou let them know that you're sinning.
So can you believe this? Now? The energy required to process all those
(05:26):
raw materials we didn't even talk aboutthat, and to haul the batteries to
the US, all of this meansthat your electric car is actually, unfortunately
adding to climate change. Well, even when you charge it, though tom
out of New York and other placeson the East Coast with heating oil,
(05:48):
it costs more to create the electricityto charge it than what the emissions from
the gasoline would be. All goodpoints. So why doesn't anyone look at
this? Why aren't we woke tothis? Why are we making electric cars
(06:10):
the standard you are because you're goingfast as hell and they drive themselves.
I love, by the way,I should mention this. I love electric
cars. I love regular car well, I hate all cars. Okay,
first, let me say that, but if I had to hate less,
I hate electric cars less or theleast. I don't have an electric car,
but I wish you did. Andthat's only because of Kevin and Jeff.
(06:30):
They just poisoned me. I wasthinking having a luxury German car would
be really cool, and these guyssaid, no, no, Tom,
they last fifty or sixty thousand milestruly before you have major problems. You
can get an American car to lastlonger, and you can get so I
started thinking this oil thing, theseals, the all that crap. An
(06:55):
electric motor, that's one thing. You don't have all that maintenance and all
that. But if you look atthe carbon footprint of someone driving an electric
car, one battery, now therest of the stuff. Okay, it's
like a regular car, right, almost a little lighter weight. But think
about this. If you think you'rehelping the environment buying an electric car,
(07:15):
you are actually hurting the environment. You're hurting the environment. Now. That
disappoints me too. So what thehell are we going to do? Horse
and buggy? But horses fart, that's methane gas like cow's do. Right,
That's why we're trying to do awaywith meat. And we're going to
be eating chocolate crickets. Maybe weare going to be eating chocolate crickets on
(07:43):
bicycles. Won't that be a Californian'sdream? Think about that, crickets and
bicycles. I'm gonna run on thatplatform, I really will. Mary.
You have a problem here, Mary, what's going on? Mary? High?
Hi, good morning. I'm gratefulthat people like you are here to

I'm eighty years old. I'm awidow who just moved to Denver abound month
ago to live closer to a familymember and to my church home. Okay,
I bought a house online from anopen door agency. No wait a
(08:35):
minute, you did it everything onlinewithout looking at it. I was in
Saint Louis at the time. Iwas living in Saint Louis, so I
could not come to Wow. Ican't even there's a lot of stuff that
can go wrong doing a house totallyonline. Mark was looking at one time
(08:56):
a vacation house online that looked perfect, and he said, it was a
amazing when you actually get there. How things are just different. I mean,
they're just different. So tell meabout it, Mary, what's wrong
with the house? Well, holdon, I should say this was it
misrepresented? Oh? Yes? Ohyes, you did you use you said
(09:20):
the online agency? Or not theor the agency? What's the name of
it? Open door? Open door? Yeah, they were in the news
recently because just last year they werefined by the government sixty two dollars to
(09:43):
return money to people who sold theirhomes. Tool did you know that before
you got a hold of that?I did not know. And that is
it called open door real estate? What is it called open door? Is
the name of the comty? Andhow were they acting? Were they your
agent? I don't understand. Now, That's what I'm trying to explain to

Hi Tom Martino, your troubleshooter threeall three seven to one three talks seven
one three eight two five five.Welcome to the show. Mary says,
we have a I have a problembuying a house. I bought a house
from Saint Louis and I bought itin Colorado. Recently widowed and went to
(11:16):
Open Door real Estate. I'm lookingat him online, and so Mary,
I want to know something. Ifyou you had friends here, you had
people here. I want you totell your story. But I want this
to be a cautionary tale for peoplelistening. Never buy real estate or anything
sight unseen ever ever, ever,So go ahead, tell your story.
(11:37):
So you went online, you foundthis house. Continue, Okay, I
don't have families, So my sonin law, who lives here was one
person I needed to be near, plus my church home. So I did
put my house up for sale. It's sold very very quickly, and I
(12:00):
had only a short window of timebefore the buyer wanted possession and I could
get moved over here. So openDoor was the only listing that my agent
could find. The other listings herewere not available when she looked for them.
They o their listings I picked. They did not provide what's called the
(12:24):
seller's disclosure statement when I bought ahouse, and I was told by a
number of realtors and attorneys I talkedto here in Denver that Colorado law mandates
a seller disclosure statement for every purchase. Well, first of all, that's
(12:45):
not completely true. Oh, butI want to I want to examine this.
What was not disclosed to you.And first of all, where how
did you close by? Did youclose online? Yes? Okay? Now
what I want to know is this, You closed online and there was not
(13:09):
a property disclosure statement? Is thattrue? Yes? Okay? Did you
have the house inspected? Yes?Okay? And what did you inspect?
Your fine? Oh well he foundeleven red flags and forty nine orange flags.
(13:33):
Well then, well then tell mewhy you bought the house. Then
you had your own notice? Whydid you buy the house? For one
thing, I did not see thedisclosure something in the email, but I
have the Okay, Harry, forgiveme. Forgive me for this, okay,
And I understand your eighty which,in my opinion is not an excuse
(13:56):
because and being a widow is notan excuse. However, I feel for
you, I really do. Anddespite my demeanor on radio and TV many
times people don't think I care,I do. But I have to tell
you something. You're painting yourself intoa corner and you want someone to help
you out. You bought a housesight unseen, you had it inspected,
(14:18):
but you bought it anyway because youdidn't see the inspection report. Well,
what do you mean? Why didyou have it inspected. If you weren't
going to read the report because Idid not have enough time, don't love.
That doesn't matter Mary. If youhave something inspected, tell me this
he found? How many red flags? Oh eleven? You know what?
(14:43):
You actually you actually hurt yourself byhaving an inspection. You see, a
disclosure statement is technically required. However, the form of this seller disclosure statement
is not standard or universal. Andthe problem is if you don't demand it
(15:09):
and then you have your own inspectiondone, they can claim that you were
in fact informed. So, inother words, if you did not read
your own report, what good wouldhave a disclosure statement have made to you?
They're going to make all kinds ofarguments. And here's what I need
to know right now, because youdid so many mistakes that we can't I
(15:33):
can't. We can't possibly go afterthose people. I mean unless you talk
to an attorney, and they're goingto tell you the same thing. And
it's way A disclosure is so expensiveit's almost better to fix the thing.
So we need to go to thereal problem. What's wrong with the house?
Well, I have seven pages ofwork orders that were supposed to have
(15:56):
been done by Open Door choose abefore I bought it. Now that's different,
that's a that's a misrepresentative. Sothey agreed in contract to do seven
pages of repairs. No, it'sbeen in house work order seven pages of
work orders in house at Well, what does this mean? Was it a
(16:21):
contract? In other words? Mary, did they promise you they were going
to do seven pages of repairs? No? Did they present this is important,
Mary, Did they present those thoseseven pages of repairs to you before
you bought it, saying, bythe way, we had these done.
(16:42):
No? Then how did you findout about those seven pages of repairs?
The agents at open Door? Evidentlymy agent asked for a full disclosure and
that the work order. Well,Mary, if open Door has bad employees
(17:04):
and screwed themselves, and if theysaid they did a thousand repairs and did
not do any that's not a misrepresentationto you. You didn't rely on those
That wasn't detrimental reliance. They didn'tsay to Mary. And this is after
the fact, you're saying, afterthe fact you found out they were supposed
(17:27):
to have done seven repairs or sevenpages of repairs and they did none of
them. So what they never promisedyou? They were going to do them.
They didn't promise anyone. In fact, they never told your agent they
did them. I'm I'm hitting youwith some truth here so you don't waste
time and money. What I wantto know is this, Is there anything
(17:48):
they told you that was a lie? Is there anything that your inspector did
not find that they knew about andthat could be something? Was there anything
that they knew about that your inspectordid not Yes, I believe. So
give me the biggest thing. Theroof leaks. Okay, the roof leaks.
(18:15):
How do you know they knew thatbecause there was a stain on the
carpet that I even asked, said, why didn't your inspector? Why didn't
your inspector see it? Wait, you don't even let me finish this sentence.
Okay, go ahead, go ahead. There was a stain on the
carpet. Go ahead, stain onthe carpet when I saw the video tour
(18:41):
that my agent created and I askedabout it and she did not know the
source. And when on this lastFriday, Saturday and Sunday when it was
raining so much here, that wasexactly where the roof was leaking. And
okay, Mary, I know youthink you need to finish this, but
(19:03):
I heard enough. There's a spoton the rug. Here's why I heard
enough. You saw that spot ina video. Your agent and your inspector
did not go further. You againscrewed yourself by seeing it. You actually
saw the spot. The roof leaked. They didn't tell you. Now,
your agent didn't know the roof leaked. You didn't know the roof leaked.
(19:25):
Your inspector didn't know the roof leaked. And I asked, why should the
seller know the roof leaked? Andyou said, because there was a stain
on the carpet. But that verysame stain your own agent didn't call to
your attention. Your own inspector didn'tsay the roof might be leaking. But
you expect the seller to know that. Do you have any records that the
(19:45):
seller tried to fix it and failed? You know you might go, And
I fully expect your I fully expectyou're gonna hang up the phone and hate
me. But I'm gonna tell yousomething. Those who are truly listening will
know what I'm trying to do,and that is get to the essence.
Because you have nothing right now,all I hear is you your agent and
(20:08):
your home inspector were negligent. Negligent, and now you want to go back
and try to hook the cellar. Now, this seller might be a scumbag,
I don't doubt it. However, you walked right into the trap and
let them rip you off. Youhad an inspection with eleven red flags.
(20:29):
You had a spot on the carpetthat you brought up to your agent,
and your agent didn't have the senseto have your roof inspected. Neither did
your inspector. And now you're sayingthey should have told you the roofleet.
Please tell me Mary that you understandthat you have a very difficult uphill battle.
(20:53):
Actually you're not correct in your conclusion. Go ahead, tell me where
I'm incorrect. Go ahead. Aquarter included some of the work orders which
I only received very recently a coupleof days ago. Included clean that stain
from the roof flake and repair thesteam lane from the roof flake. And
(21:15):
that was open doors awareness well beforethe stamp. Okay, how much will
it cost to fix the roof?Someone just did that the other day and
I have not been built for it. Okay, Yeah, so that is
one thing that you can prove theyknew about that they did not disclose.
(21:41):
So let's go after them for thatrepair. Oh, there are a number
of other things. There are manymore items town that they had known about
that they did not correct, andthey include live wires, electrical problems,
plumbing problems. Get up all yourrepairs. What will they come to?
Do you think, Well, I'vealready spent over ten thousand dollars on this
(22:07):
move in the first place, whatI've spent here, So Mary, I
need to know specifically the repairs youhad to make that they knew about and
did not disclose. I have iton a document I can email it to
if you went good reason, tellme the ones where you can prove they
knew and you had those repairs tomake. Those are something that will work
(22:33):
if you can prove that they knewabout them and did not tell you.
However, I'm going to tell youwhat their defense is going to be.
You had noticed. In fact, that means that even though they didn't tell
you, you had an inspector whotold you. If those problems that you
(22:55):
say they knew about and did nottell you about are his inspection report,
you will have a very difficult timegoing after them. For example, if
they if they knew about a foundationproblem and did not tell you, and
your inspector has that in the report, then they could they could make the
(23:17):
claim that even though they did notdisclose it, you were in fact disclosed
in fact, and it's your faultyou didn't pay attention. So here's what
I need. The inspection report andthen the things they knew about that you
can prove that they knew about andwithheld. If any of those two things
(23:37):
match, then you're out of luck. If your inspector knew about him,
that means you knew about him,and even though they didn't tell you about
him, you still knew about him. So you're not allowed to walk into
a trap and get injured and saythey never told you about it. If
you knew the trap was there,If you knew a dangerous condition exists and
(24:00):
were injured, you can't go backto the person who created the dangerous thing
and say you should have never donethat. It's a very it's a very
delicate matter, but it's not aseasy as you think. The point I'm
trying to make is this, Iam looking for something solid we can go
after open Door for for an eightyyear old widow, because I do want
(24:22):
to help you, but you gotto be able to show us something that
we can nail them on, andyou say you have it, so I'm
going to wait until you send itto us. Here's what I need.
The inspection report and the stuff thatyou say they knew about that they did
not tell you about. Okay, and we'll match them up. And if
(24:44):
you were uninformed of any of those, then I think we can call open
door and say, listen, youlisted this home and did not do this.
I don't know what else to say, and I hope people listening understand
the point I'm try trying to makewith this call. It is this.
If you if you claim someone didnot inform you but you knew about it,
(25:10):
you're screwed. So you need togo after the people that did not
tell you about something that there wasno way for you to know about.

thing working? Three all three sevenone three talk. I guess they're not,
like, no, we got you. Okay, what's going on?
What's going on? What did youthink of the real estate deal? What
(26:44):
did I think of it? Ithink she's screwed. Okay, Now can
we get that information? And let'sgo over it. I mean I can't
what could we possibly change. Let'slook at it from that standpoint. Let's
put it this way. Let's saysomething. Let's say there was a problem
that her inspector did not see.And let's say it was a serious problem.
(27:08):
And let's say that they lie onthe objection or the inspection objection or
whatever they knew about it. Let'ssay they knew about it and they didn't
disclose it. I think we cango after them for that one issue,
or two issues or three issues. She says there are multiple ones. So
remember, these have to be problemsthat she did not know about it.
I want to see, let's gether to send the disclosure. There was
(27:32):
no disclosure mark out. Oh mygod, that's the point. But see,
here's the point. Even if there'snot a disclosure, technically, if
you knew about it on your own, if the inspector brought it up,
that's still a defense. I knowthat sounds crazy, but it's still because
she hired someone to go out thereand look at it. Right. So
(27:53):
if an inspector goes out to ahouse and says, you have a bad
sewer and a bad foundation, andlet's just say those two things, let's
see your inspector writes that in there, or there's a serious red flag for
the foundation and a red flag forthe sewer system or the septic let's just
say that. Now you go througha closing and you don't get a disclosure
(28:17):
statement, and you find out youdidn't read your report. Now you find
out you have a problem with thesewer and the foundation, and you go
after the real estate company saying younever told us. If she hadn't had
an inspection, that would be areally legitimate argument. But they can make
(28:38):
the defense as crazy as this sounds, Yes, we did not tell you.
We missed it. We did nottell you. We're sorry. However,
it's in your own inspection report,so you did know about it.
It's and what dollar figure are wetalking about? Did you crank dad out
(28:59):
of her? Yeah, we wentover all that marchy. How much does
it? Here's the bottom line, she said, thousands of dollars. The
point is this, Well, mypoint is a lawsuit if it came up
to that could be way more thanthousands of dollars. Well, she's hoping
not to have a lawsuit. She'shoping we can help her get the money,
and we probably can. If ifthere was a if there was a
(29:21):
serious problem that they did not disclose, that her inspector did not find.
I can't say that enough. I'llgive another analogy if I tell you if
there is a sinkhole in my backyardand I am or in the backyard or
in the street or somewhere, there'sa sinkhole, and your inspector says there's
(29:45):
a sinkhole there, don't go nearit. But you don't read that report
and you get injured in that sinkhole. You can't go back after the people
for not telling you about the sinkholeif your own inspector told you about it,
because you yourself were negligent. Mypoint is Mary, her agent,
and her inspector were all negligent. They have a shared responsibility, and I
(30:11):
hope she understands that. That's thepoint I'm trying to make. And I
emphasize this and can't emphasize it enoughbecause people, you must take responsibility.
I know that's a bad word intoday's world, responsibility. And people say,
well, my god, Tom,I thought you were a consumer expert.
(30:33):
How dare you talk about responsibility? How dare you? Well, that's
just life, and this show isabout helping people, real help, not

(35:15):
help come man, This is theTroubleshooter Show. No Tom Martino, Hi,

three talk seven one three eight twofive five. This hour brought to you

no gimmicks. Why will he dothis because he wants to know about the
area. He wants to know aboutthis market and know you give him access
to your home. He gives youa free analysis if you decide to ever
list in the future, he'd loveto help you. One of the best
people, most productive agents in thecountry. Three oh three nine two zero
(36:01):
sixteen twenty two. Franc around thereal estate man dot com. All right,
so listen, Mitzi said she hireda roofer, and I looked at
the email extensively, and I'm goingto tell you and then Mitsy's going to
finish her story. She said shewas assured she only had to pay her
deductible and they took a thirteen thousanddollars check from the insurance. Now it
(36:21):
turns out that her deductible is waymore than she thought because she only has
an actual cash value policy, whichmeans her deductiles is going to be a
lot of money, a lot ofmoney. In fact, she's only going
to be covered for ACV that's actualcash value. Now that's not the roofers
problem because technically they told her thetruth. She's only responsible for her deductible.
(36:45):
In this case, her deductible isgoing to be a lot of money
because they're only covering actual cash value. So they should just get If she
doesn't want to get the roof donebecause she can't afford it with the coverage
she had, then she should sendthat check back to the insurance company and
say I can't get the roof done, or at least take the money and
(37:07):
then deal with it in the future. But they shouldn't keep her money for
nothing. That's for sure. Nowtell me what part of the story I
missed or did I get it wrongfrom your email, missie. So at
this point, you know, whenhe came back to me with the additional
four thousand dollars plus, I wantedto cancel my contract. Sure, and
they I left a message no reply. I had a friend of mine who's
(37:32):
a lawyer, send a letter sayingthey weren't abiding by the contract. Ho,
ho, hold on, now, hold on. I need to know
this. How did this attorney figurethey're not abiding by the contract because I
sent him a copy of everything. What did What did the attorney think they
were not abiding by it? Iwould guess, I would guess because they
(37:52):
didn't realize Tom it was an ACVpolicy. It said they're going to do
it forever the proceeds of the insurancecompany. Like, oh, oh,
so they wait a minute. Sothey did sign a contract saying whatever the
insurance pays, we're gonna do itfor exactly. Oh, then they screwed
(38:13):
themselves because they agreed to take thelower of it. No, they screwed
her because they have her thirteen thousanddollars. No, I know, and
I have a roof. No sheneeds to get that back either. I
agree with her attorney friend, sheneeds to get her money back. Now.
Listen, had they put down inthere, had they put down a
price for the roof and she's responsiblefor whatever the insurance doesn't pay, then
(38:38):
then they'd be golden. But you'retelling me the contract says they will do
it for whatever the insurance pays. Then they either have to do the roof
for whatever the insurance pays, orthey need to give your money back.
But you understand, go ahead, miscy. Well here's the other thing.
So I them the letter to cancel. They wouldn't reply. I finally got
(39:05):
a hold of the VP of sales. She said that we'll be an additional
charge of thirty five percent to cancelmy contract. No, there won't,
not if they breached the contract.Well exactly and well in my contract that
I signed, there is nothing abouta thirty five percent charge. When I
asked her for all in for allpaperwork with my signature on it, she
(39:29):
provided me a paper that I'd neverseen before. Can I ask you something
on Mitzi, This is really important, This is really important. Are you
sure Mark? We don't have acopy of the contract, do we Mark,
No I am, I am takingher at her word. She said
it. So yeah, missy,Mitzi, the contract that you signed with
them, Are you sure? Thecontract said that they would complete the roof
(39:54):
for insurance proceeds. This agreement doesnot obligate the owner or Orange Elephant in
any way unless the damage is approvedby your insurance company and accepted by Orange
Elephant. The contract price by thissign contract owner authorizes Orange Elephant to pursue
owner's best interests of roofs, citingwindows and other gutter replacement that not repair.
(40:15):
That's not missi. MISSI, holdon letter, keep reading. I
think I want to get a copyof a mark. It's not going to
tell us everything because either they agreedto do it for insurance proceeds or they
didn't. Well, it says,it says the insurance. It says at
a price agreeable to the insurance companyand Orange Elephant, with new additional cost
(40:37):
to the homeowner except for the insurancedeductible. There you are, okay.
That is okay, MITSI. Yourinsurance deductible in your policy is whatever the
insurance doesn't pay. You think, technically that's right, That's how that would
be read in the in the contractuallanguage. Mark on her policy, on
(40:58):
her ACV policy, that's exactly theway it's written, that they will cover
the roof cost according to actual cashvalue, and she's responsible for the balance.
No, I understand that. WhatI'm saying is she probably has a
deductible as well. So let's sayher deductible is one thousand dollars or whatever
(41:19):
it is. I don't know ifyou can make the leap that the actual
that the depreciation is part of thedeductible. Oh no, No, I
don't think, And I think theyshould hold her the contract. I think
it's messy enough they need to giveher money back. But MISSI, do
you understand this is something I reallyneed to get across to you. Do
you understand that no matter who youget to do your roof, you're gonna
(41:43):
have way more to pay then? And I'm okay with that. I just
don't want them doing it, andI agree with you. You know what,
Mark, did you call Orange Elephantduring the break? Yeah? Unfortunately
they're based out of Illinois. Idid leave a message, but I mean
they're probably out of this statement. They're based out of Taxes. Well,
(42:04):
you know, Mitzi, why didyou hire them. It was they were
recommended by a friend of mine andI had from the day one. They
were not listened to any questions Ihad. I think, I think,
you know what, MITSI. Theyneed to just refund your money so you
can go somewhere else. But theywon't've been trying to do. They won't.
(42:28):
They will not answer my phone call, they will not answer my email
anything. Well, we need tohound them. We need someone and honest
to goodness, we need to houndthem. They need to give your money
back. You know, I couldsee that cancelation, Mitzi. I could
see them charging you the cancelation ifyou simply changed your mind or were willy
(42:50):
nilly. But this is this isa real issue that that contract is muddy.
It's saying you're deductible. It's sayingyou're deductible. And I did not
realize that your ACV policy not onlyis an ACV policy, but also has
a deductible. So they were kindof screwing themselves. They were saying,
we're going to do it for whateverthe insurance pays, and all you have
(43:13):
to pay is your deductible. You'regoing to make the argument that you're paying
way more than your deductible because ofthe ACV they won't accept. Now,
if they agreed to accept the ACV, then you would gladly pay your deductible,
right exactly? Uh huh? Sohow much did you say you're deductible?
Was? My deductible was twenty fivehundred and you would gladly pay that.
(43:37):
What you won't pay is the additionalmoney. Now, MISSI, do
you have the contract? You cansend us? We need to see it.
Yeah, all right, good,Hey, we need to assign this
someone to go kick their ass andto try to get this money. They're
not going to win this. They'renot going to win this. I mean,
I don't see how they win itif they if they wrote an ambiguous
(43:58):
contract. And by the way, way, did you get a three day
right to rescind in that contract?Yes? They did? Okay, and
did you? But you didn't.You never signed anything at all on that
contract that says they can keep acancelation fee. No, And I'll bet
you that contract. Does that contracthave an exact cost of the roof?
(44:20):
They're not allowed to put in thatcontract at a price agreeable to everyone that
they According to Colorado state law, they have to have a price in that
contract and they don't do they Theydo not see Mark in every way,
every way, shape or form. They did not comply to law in Colorado.
I agree one hundred percent. AllI'm saying is they don't care.
(44:44):
They're not even in this state. They're either an Illinois or Texas. So
we got to figure out a wayto let people know about it and to
get pressure on that. What's thatthat I gave you? That the number
that it gave you, Katie Gribbin, were you able to to get a
hold of her? I did notcall that number. Okay, let's try
(45:06):
that. And who should be givethis to? Really we should kick their
butts on this, that they can'tjust keep her money. Well, I
already left him a message, sowe'll see if we get a call back.
Okay, I'm gonna I'm gonna putMark's nighting down on this for now,
and then if we have to gofurther, we'll see. But really,
we're with you on this one.I mean, this is a bad
one, and goodness gracious, fromnow on, don't go by what a
(45:31):
friend recommends, go by who werecommend. Please, I'm serious. You
should have called Excel Roofing and infact, if you went to their website
technically right now, you could goto excel Roofing right now and put your
address in you will get the priceof that roof as to what it really
should cost. You should do thatfor fun. Excelroofing dot com. You
(45:52):
really should you go there and thenput your address in there and then put
down the kind of roof you have, and you'll get a price, so
you'll know then what that should becosting you. And that's a real deal.

Let's talk and see what we cando for you. Okay, So
Lively Day today is card day, though we still have our people on so
(47:28):
so we want to talk about that. So guys, as far as the
discussion in the beginning about electric cars, and by the way, we have
some lines open three oh three sevento one three talks seven one three eight
two five out before you switch gearin there. I wanted to read something
to you I found on that firstcall with the lady that bought the house
sight unseen. Yeah, she actuallysent over listened to this, uh Colorado's
(47:52):
disclosure law and it says, andthis is right from my guess, Colorado
dot gov. Colorado State statues requirethat sellers of residential property disclose the following
to buyers. Okay, ready, right. The property might be in a
special taxing district, the property ispart of a common interest community, you
know, like in HOA, ifthe property has been used as a meth
(48:14):
lab, the home source of drinkingwater, poddible or what it has,
any exposed transportation projects such as lightrail or something that's coming into the neighborhood.
And that's pretty much it. Itdoesn't really say they have to disclose
anything else that I'm reading directly fromColorado State. Isn't that strange? Mark
(48:36):
That's what I said before when Isaid that there's a mixed bag here on
disclosures. A disclosure statement is required, but there is no standard form.
And Frank Durant told me that onetime that if it's not in the disclosure
statement, then it's not in there, and if it is, it is.
But they don't have to disclose what'snot in there. Now they're supposed
(48:58):
to by law, but not thedisclosure statement. But mark On, let
me explain this to you. Shewrote over some of the things she discovered.
Now, now listen to what wouldbe a problem with this. She
said, no landscaping. Okay, now now it was rocks. Now now
tell me this would would would wouldn'ther people be able to see that.
(49:21):
It's called zero escaping. But buteven it doesn't matter if it was nothing,
if it was mud. If youhave the house sitting out there with
no lawn, why do they haveto disclose to you there's no lawn.
That's what I'm getting at Mark,is that she has all kinds of things
here that are just common sense.Refrigerators do not have water line. Well,
(49:44):
I don't think that would be ina disclosure form anywhere. No matter
what she said, shed roof wasnot replaced, shed gutter was not fastened.
Well, she had a home inspector. She is believing this home should
be in perfect condition. I'm sorry, I really don't. I think she
(50:05):
bought a pig and a poke. That's what she bought. She says on
their refrigerator too small. That's crazyexactly. She's not going to be able
to do anything about this. Imean, I don't know what to tell
her. Vince. I listened tothis one vent's not painted the same color.
I mean, how where would youdisclose that? I know it.
(50:30):
I know it. It's just ridiculous. It's just ridiculous. Weeds in backyard.
She'd have a hell of a timein my house. Let's just sell
it back to open house. Okay. Interior floors were not mopped, Honest
to god, you want what?Who are you putting on this? Did
(50:54):
he drop dead? I know Iknow what you're saying. I udrey appliances
were removed rather than cleaned. Idon't even know what that means. Counter's
not cleaned. Counters. No,I know she's expecting perfection here. She's
expecting a brand new house. That'swhat she's expecting. I don't even have
(51:16):
them for you be a dead horsewho I'm going to give you some updates?
Yeah, yeah, go ahead,Okay, uh you remember the only
dead horse in that studio is you. By the way, I know,
all right, Just for that,I'm doubling my salary. Hey, Tom,
Okay, So Steve, Steve calledup. He was a forty five
(51:36):
year old vet who had some workdone, canceled it, and he was
owed to one thousand dollars from acontractor named ben or Tees. So we
got ben Ortez on the phone yesterdayand he said that he's waiting for his
credit card company to approve it andhe will send Steve a check on Tuesday.
(51:57):
Hey, oh, excellent, Holdon, doc, doc, Hold
on one second, I need tosay something. I'm thinking of this other
one in a different way. Nowhere's my understanding after reading this. She
bought this house using open door.Open Door said they would do all this
stuff before she moved in. Thatis a true gripe if that's true,
(52:20):
contract Mark, Yes, I alreadytalked to her about this when you guys
were there speaking among yourselves and didn'tlisten that we're doing a different show.
Listen that list that they said theywould do. That was an internal list
that open door was supposed to do. That was not given to her before
(52:43):
she bought the place. She happenedto see a sheet that is that open
door was supposed to hire people. She happened to cross this. They never
told her they were going to doit. Never. That was not part
of the sale though. That listof things, that's what she said.
And open Door didn't do a listof seven pages that they were supposed to
(53:06):
do. Well, who said theywere supposed to do? Did they tell
your real estate agent by the waythat agent she should know, whoever it
is. I'd like to put themon the sleeves brigade, because that buyer's
agent did her no favors on anything. But in any case, that internal
document mark is between open door andwhoever was supposed to do that stuff.
(53:29):
That wasn't a representation to the buyerman. You know, it doesn't matter
what I promised to do to myselfor for myself before I put something on
the market. If I made anote make sure I get the house painted
before I sell it, and Isell it and somebody sees that note to
myself, I mean, what differencedoes that make? It doesn't matter what
(53:52):
they wanted to do. I thoughtshe entered into an agreement with No,
she didn't. And that was thewhole point. She did not open it
to the agreement. And and that'sthe biggest problem of all. Geez,
three oh three seven to one threetalk. Okay, we got tom.
Now what other follow ups do youhave? Okay, so, uh,
(54:14):
this is goes back. Well,Jackie had a problem with Traylon Holmes and
her floors. Wait a minute,Wait a minute, I think I remember
that. Yeah, I'm looking forit, but go ahead what happened.
So apparently there was a problem withher floors, and she had them come
out literally four or five times. And now they've thrown up their hands and
(54:36):
said, look, we're just notgoing to deal with this. We tried,
we can't match your floors. Shewants to know if we can get
somebody out there to Okay, buthold on a second. What exactly Jackie
was complaining about her floors, ButI don't understand. Wasn't that something about
them not fit, not matching?Yeah, what happened was there was some
(55:00):
a brand new home and I thinkshe said that the LVP was damage,
it was wharping. But they replacedthe entire house full of the They did
the whole thing. And then shesaid, after five months the floor started
waving again. They replaced it again, and they attempted to fix it three
(55:21):
times, and now the warranty companysays they're done. Now what I want
to know is this is she beingunreasonable? Well, that's why she wants
someone. I thought, maybe simplyflows go out take a look at it.
But it's in Loveland. It's inLoveland. I'm not sure simply Floors
is going to drive to Loveland forthis. Okay, well that was all.
That was what I told us.I don't know what else we can
(55:43):
do. Well, here's what wecan. She needs to hire a floor
inspector. Really, we can't sendSimply Floors can't run up there. Okay,
I will tell her that. Andit's not that expensive to have a
floor inspector. There are and andBuddy and Karen Mitchell over at Simply Floors,
Inc. I think they would havean idea of who she could hire
and then figure out. If it'snot up to standards, then I think
(56:07):
that they should uh. I thinkthey should be able to do something right.
And she says that when they whenthey replaced the whopped you know,
uh boards, that it didn't match. And she said, it's a new
house. She wants everything to match. So I will tell her to call
(56:27):
Simply Flaws, get a floor inspecter, and we'll we'll take it from there.
Yeah, okod We got more comingup on the Troubleshooter Show three O

Three, I'm hey Kevin Golver andkick his ass for me? Please?
Can you do that? Or Jeffjust go over there, just just
give him a whack upside the head. Three three. I'm putting a poll
up right now on our Facebook. All right, I'm sorry, look at
(57:36):
me. I'm acting like an oldman on our YouTube channel. So people
should go join in and vote whetherthey think Tom leans to the left.
That's exactly how I'm gonna phrase it. Okay, Now here's the deal.
You really believe you really believe thatI demonstrate liberal tendencies on this show.
(57:58):
I just said I think you leanto the left. That's what I've said.
I'd actually you know what, I'dlike to believe I lean according to
the issue. Well I'll find out. Let me tell you polls are never
wrong. That's true. You knowI lean according to the issue. First
(58:20):
of all, if do you understandsomething, you can lean a certain way
without agreeing with it. Let meexplain this to you. Let me explain
this to you. My personal feelingsabout social issues, in my opinion,
have nothing to do with my politicalstance on social issues. Here's what I
mean. I believe everyone should livethe life they want to live if it
(58:43):
doesn't hurt anyone else, and wehave no business telling them how to live.
That's what I believe. Now.I might depart from that when it
comes to certain sub issues of theissue. For example, this big,
the big controversy right now, transgendermovement. Okay, I don't care if
somebody wants to be a he orsheet I mark, do you really care?
(59:05):
Could care less? I don't care. I mean I always say,
okay, I'll hire on, holdon, you ask me a question.
There's times I really care. There'stimes in women's sports I think it's marked.
That's right, because I'm not talkingabout that now. I was talking
about the general Then I said therewere sub issues. The sub issues I
agree with you on. I don'tbelieve you should if you're one hundred percent
(59:30):
mail, no matter what you thinkyou are, you should do that.
I agree with you on that. And what about prisons? Do you know
a man who has had his junkhis entire life and has had sex with
women his entire life, five minutesbefore he is sentenced or before he's sent
into prison, can declare he isa woman and go into a woman's suit
(59:52):
in Texas or Florida. Well, okay, but what I'm getting at is
there are general sub there are generalissues, and then subsets of those issues.
So in general, though you don'tcare if someone calls themselves a man
or a woman, right, Icare less? Right, I know you
don't care. In general, Iwant people to live the life they want
(01:00:14):
to live. But there are issues. I was I saw for it,
you supported us. I appreciate that. I thought we should throw them the
coming out party between them. Thehave enough loop for a long time.
Now here's the deal. Don't getdon't get vulgar. I think on social
issues, where are too hell benton Some people are too help bent on
(01:00:38):
telling people how to live, andI don't think it matters. But in
general I skew more conservative with economicissues for example, I do not believe
you can control outcomes, nor shouldyou try. However, I do believe
you should have one equal opportunity. Then if someone squanders the opportunity, just
(01:01:02):
say you're a libertarian. And that'sexactly what you're promulgating. I don't know.
I don't know what you call Idon't like labels, but Mark,
I disagree with you that I skewliberal. I mean, I don't even
understand what that means. Well youjust do. Oh, come on,
(01:01:22):
that is so ridiculous. And youput up a poll on Facebook, I
mean, excuse me on YouTube, and that's really told to give me an
example where I skew liberal. Goahead, give me an example. Everybody
should get free college. Okay, did you just hear what I said about
(01:01:43):
about opportunity. He asked me aquestion. I answer it. Now he's
asking me another question. Yes,I did hear that. I just said
everyone should have one d per equalopportunity. They should not have one hundred
percent equal outcome. And let meexplain something about college. It has no
nothing to do with poor people orliberal or conservative. Here's what it has
(01:02:04):
to do with the Colleges are greatripoffs. In this country any surprise,
you don't see that they have taxfree endowments that grow tax free, that
are supposedly charities, and they paytheir professors and administrators out the nose.
They have enough money, do youunderstand the security just on basic securities?
(01:02:27):
They could invest those endowments and theycould support one hundred percent free tuition for
the rest of their existence. It'sway worse than that. That is a
great point to bring up, andyou brought it up before. But in
New York right now, the copsgetting rid of all these protesters from hell,
these pieces of crap that are wishingJewish people dead, these people that
shouldn't be doing what they're doing.Guess who's paying for the police? The
(01:02:52):
taxpayers there, because those and thecolleges should pay property taxes. No,
these colleges are the great American ripoff. You know what I find funny about
liberals who say that rich people don'tpay taxes, they should start taxing these
colleges. These colleges have endowments ofbillions and billions and billions of dollars and
(01:03:15):
don't pay a penny of tax onthem, and then turn around and try
to influence social issues and students' minds, and that is not their Well,
actually, they can influence anything theywant, if the kids wanted. But
what I'm getting at is this isthat they are They are the biggest ripoffs
in history. So here's what's amazingto me. They talk about diversity right
(01:03:39):
now. They could have one hundredpercent free tuition for everyone, everyone,
for the rest of their existence andnever ever need a dime from outside help.
Yet they still beg for money. They are greedy, money hungry billionaires.
That's what they are. And that'swhy I say free college mark because
(01:04:01):
and here's another reason I say it. Okay, let's just say there is
an underprivileged person living in the projectssomewhere who would make a brilliant surgeon.
We may never know it because theycan never afford it. And I think
everyone should be given the opportunity. We've talked about this, and I love
(01:04:24):
everything you're saying, But the problemis a lot of those people don't grow
up with two parents. They don'tgrow up with enough food to even mature
their mind properly for that amount. So to actually say it should be fair,
at one point, it's never gonnabe fair because your kids and my
kids are gonna there's no doubt theyhave more of an opportunity. I agree
(01:04:45):
with would it would take a lot, You're right, it would take time.
But I think it's a shame. For example, when some kids grow
up never even thinking, never eventhinking about college because they think it's impossive.
Isn't it their damn parent fall fornever planning to see it or telling
them anything. Of course, fixthat, you don't. You don't fix
that by sacking take you. It'lltake time to free it, fixes by
(01:05:09):
fixing their damn bears mark, it'lltake time to fix it. It doesn't
mean it's impossible to fix. WhatI'm saying is if over time we believed
it was possible to go to college, we may strive to learn a different
career or something if we knew itwas possible. If you're from the projects
and you don't even think it isin the realm of possibility, you may
(01:05:32):
not shoot your goal there. Youmay not make it a goal. That's
all I'm getting at is that itshould be easier for kids to attain a
goal that they shoot for. Andyou're right, you are absolutely right.
If they said to people, youknow what if you can do the work,
you can have the education. Itwould take maybe a generation for that
(01:05:54):
to sink in where people actually startbelieving it that it would. But we
got to do something to change whatit is because all they will do this
these these I don't even know howI refer to. I guess the legist
is a good way to look atit, because if let's just say community
college was the first step and itbecame free, it wouldn't matter because that
(01:06:15):
would just be another extension of highschool and people would still drop out.
Its just the whole thing has tochange in a different way anything. The
difference is with community college they candrop out. When it comes to public
schools, they just push them throughthe system. Well, then, I
also, doc, I got tolook at it this way, like there's
plumbers and hvac guys and kids likemy kid that make great money and they
(01:06:39):
never went to college. But no, no, but let me finish this
now, when we talk about lettingeverybody in college, and the hell pays
for that, My kid that nevertook advantage of it, Me that never
took advantage of it, and hecould have zam that never took advantage of
it. Mak that's the point hecould have if he wanted to. Yeah,
sometimes some people could not. Butbut you're forcing me to pay for
(01:07:00):
somebody else. Doc Well, Mark, just like Mark Helthmar in this state,
Mark Colorado. Mark, can youstop making your speech right now.
All I'm saying is this. It'snot going to be easy, but there
I think in the long run,we literally would save money if we had
an educated mass. Now, thosewho want to be into trades, you
see what's going on in these collegesright now, are by a lot of
(01:07:24):
them. We're shut down these universitiesyou're talking about, Mark, I'm not
talking about radical students. I'm talkingabout people who want to learn. You
always go to the extreme. AllI'm saying is this, if someone wants
to learn and truly wants to dothe work, they should be allowed to
be able to do that, andthere should be a way a path for
them to do that. And ifsomeone wants to go into trades, there
(01:07:46):
should be a path for people todo that. But I'll bet you that
fix it or plumbline or any ofthose never hear from a kid in the
projects who doesn't even know there's apossibility. We got to change. We
got to start giving people a visionof opportunity, that's all, so they
have something to strive for. Idon't believe a lot of people have anything
(01:08:09):
to strive for. Your kids growingup, Mark, they saw a vision
of people who worked hard to kids, not all kids programming from public schools,
is my point. It's that's justit. They don't care. Their
only drive is to make our kidslefties. I'll say it for what it
is, and if you extend thatanother year, it's going to do nothing
(01:08:30):
else. That's my point. Theyindoctrinate our children. That's what they do.
Well, of course they do,and I'm proposing that we try to
change it to a point where kidsknow that they can take a path and
there won't be roadblocks. If gowith a sure thing Denver's Best Roofer Excel

Welcome to the show. Three Othree seven one three talk three oh
three seven one three eight two fivefive. Here to help you solve problems,
(01:11:21):
answer question, take complay to say'scard day. We haven't had much
car discussion, and that's because JeffVick and Kevin Colkin are sitting there and
not volunteering anything. They're just sittingthere like bumps on a log. Uh.
That's uh shared in autotech and cameratransmission. Let's talk about this.
Jeff, I do have a questionfor you. What do you think about
(01:11:44):
that electric car discussion we had andthe carbon footprint actually being ten times more
with an electric car? In electuality, those of us that live inside this
world of automotive been talking about thisfor years. We're more than aware of
it. But have you ever seenit put to pay pencil and paper like
this guy did, actually not seenot just the electrical part of it,
(01:12:05):
the recharging part of it, butthe manufacturer of batteries and something I never
thought of in mining the cobalt andall of the stuff needed, the lithium
and all of that for uh,these batteries. You now have diesels that
these these are not electric earth movers, they're diesel earth movers, actually contributing
(01:12:27):
more pollution to the environment. KevinJeffinite thought about that part of it,
not to mention some of the pollutantsof the byproducts of actually making it.
Some of the leasing fields where theyhave wet fields down in South America,
we're literally just destroying the lands anddestroying the water possibility. A How do
people justify it? No, seriously, does it just make them feel good
or what all they see is theend result. They're not contributing to that
(01:12:50):
that cat out there mining up theground. They're not seeing the kids that
are being forced into slave labor actuallygoing out and doing this stuff. They're
not inside the areas where all thesetoxic chemicals are just being dumped and laid
out outside. Yeah, I thinkthat. I don't know, Chandra.
Let's go to her. She wantsto talk about scleare therapy, or at
(01:13:12):
least that's what I think. She'stalking about. Sclerotherapy our injections in the
legs to try to get rid ofaerico's veins. But there is also a
more more detailed, not more indetail, more invasive therapy, which is
more of an oblasion of of Theydestroy the oor, inject into the veins
and actually make them go away.A lot of women, contrary to what
(01:13:32):
Mark things, a lot of womenlike this procedure. They love this procedure
for appearances, and it also helpsif you have tired legs and all of
that. And a lot of mensuffer from this but don't go and have
anything done about it. So what'sgoing on? What is your question,
(01:13:53):
Chandra? Mark, Mark's trying tomake fun of me saying we shouldn't discuss
vein therapy. It sounds like,Oh, I just loveased it. Coming
into this hour, I thought, yes, I took notes, Deputy Doc.
It's not just an old persons disease, is it. He's not listening
literally. Okay, well, ofcourse he's not. In fact, why
(01:14:13):
don't you would you do me afavorite? Mark, do me a favor,
seriously, Have a mirror near himso we can always check to see
if he's fogging it and then andthen if he's not fogging the mirror.
Have some defibrillators around. We shouldhave those next to him at all times.
Okay, Chondra, what questions didyou have? Well, this is
(01:14:35):
Chandra, a common woman want tobe and I've got come on in.
I would love to come in.Are you kidding me? Have lesson?
You know? Same old mine orever. I would love to come in there
and meet you guys. I'd holdthe mirror for deputy doc if I if
I could, so anyway, whatis your question that? So? I've
(01:15:00):
got bad Verko's veins. They usedto be really heavy and they're really unpleasant.
I don't know what Mark's got againstthe therapy, but I'd like to
get rid of them. And Ijust don't want to cold call a bunch
of plastic surgeons. I didn't knowif you knew anything about it or yeah,
I do. I know people,I know people who know people.
I'm just gonna I'm gonna cut rightthrough it. Colorado's skinning vein. Doctor
(01:15:25):
verbally, how does it work?Well, there's tooth therapy, but Doc,
you should is he? Is heawake? Or I'm fine? Tom?
I think they just inject the asclerosing agent into the vein, and
what does it do to the vein? It just closes it up and then
it just gradually dies and gets reabsorbed. Yeah, but then there's a more
(01:15:47):
invasive therapy where they go deep insidethe vein. Is that more of an
oblasion or what? I'm not sureabout that, Tom. There's two different
levels. Let's say there's one forjust the surface kind of stuff and then
there's one for deeper problems and theydo ultrasound to find them. Do you
have chondra? Do you have weaknessin the legs or tiredness as well as
(01:16:14):
an appearance or is it mostly forappearance? It's a vanity thing. My
legs are fine. I work outall the time that I just don't like
to do it. They look they'relumpy. Well, lumpy is a lot
different than just that vainy look likewhen you look at your legs, do
you see those little spider veins?Or do you actually see rope type stuff
coming through the you know, bulgingfrom the surface. Yeah, that's a
(01:16:36):
vil Tom. Yeah, well there, but some of them are some of
them doc are They don't actually comeout and swell out there. You can
just see them through the skin abit. I have both, so I'm
more interested in the lumpy ones toget both. Yeah, that's the more
(01:16:57):
that's the more invasive. Now theyused to do I'm stripping. You don't
need to do that anymore. Theyhave some really good therapy. I truly,
I truly would check out Colorado Skinlisten. I want to tell you
something. They're not sponsors here, nor are they on the referral list.
We don't have any Vain clinic onthe referral list yet, nor do we
have sponsors. However, Colorado Skinin Vain truly is. I don't want
(01:17:21):
to get into why, but Iknow that they work. Okay, I
don't want to violate anything. Gothrough the internet. What's that sounds good?
Now? Now, if you needthe number, I'm just I'm looking
at their website right now. Here'sthe number. Three zero three six'
eight three thirty two thirty five.Do any forms of insurance pay for that.
(01:17:46):
You know, I don't know.Actually I don't know that. I
don't know. I think I don'tknow. I think if that it was
medically necessary, they would if theythink it's cosmetic, I don't think they
would, DAC. Is it evermedically necessary? Not that I can think
of off the top of my head. Well, you know somebody who does
that might be. I'm telling youthat there are a lot of problems attributed
(01:18:09):
to that. Don't fully, theydon't get I mean it is good for
your health. I mean because itcould lead to blood clots and other things
in the future. It could leadto other problems. But again, here's
the deal. No matter what,he'll have an answer for I have an
(01:18:30):
answer for it. And that's great. Let me explain something to you.
And this is nothing against Colorado Skinin Vain or anyone else who does this.
But I'm just going to tell yousomething. Most of these clinics that
do skin in Vain, they doa lot of cosmetic stuff and sometimes a
lot of you know what's crass skinesthetician stuff. No, but don't just
(01:18:55):
say some of them sell like thatcold therapy and stuff like that. Okay,
you you took the words out ofmy mouth. What we're getting at
is this, there's a lot ofup selling in this business. Okay,
so be aware of that. I'mnot telling you what to do, but
they're and I'm not even telling youabout this clinic because i don't know that
(01:19:16):
much about it. I don't knowa lot of them. Yeah, they
have a lot of these clinics haveall kinds of stuff like that, Okay,
And I just want to warn youthat what's that is it? Even
the regular dermatolicists when you go in, it's trying to sell you every skin
(01:19:39):
product under the sun. Oh No, Dermatologists nowadays have become hustlers to ropractors
are man, there's some good ones. I don't want to get everybody.
That's true too. That's true too. You have some that do that.
You also, look, man,I'm telling you that that it is a
hustle there. Doc. I don'tknow if you know this or not,
(01:20:00):
but there is a lot of companiontherapy is going on with these clinics.
Whether they're skin or vein, orwhether they're dermatologists or there's all kinds and
you know, plastic surgery. Theyhave all kinds of upselling going on they
call them companion therapies or I callthem up selling. Anyway, Thanks for

Tom Martino Here, let's go toDeputy Marvel, who has a follow up.
Yo, Deputy Marvel, you havean update on sub subcontractor issue.
Who was the caller on that onethat was one Lopez and one said he
(01:21:32):
was owed money and had not beenpaid. Is that right? That is
correct? He had an initial proposalfor a basement finish that included framing and
drywall, plumbing and electrical work, just all this work. The initial proposal
was five thousand, with change orderstotaling three thousand. Jorge Sanchez is a
(01:21:54):
homeowner who hired one oh okay andhalf dollars in January. So I called
Hoorgey to follow up. I lefta message on Tuesday, Wednesday, and
actually he answered yesterday, late afternoon, and as soon as I identified myself,
(01:22:15):
he promptly hung up on me.Damn it. So Jorge is also
a contractor, even though this workwas being done on his personal basement.
Right, No, Horaey is nota contractor. Jorge Sanchez is a homeowner.
Okay. I thought jan said hewas a subcontractor for Hoorgey, who
was the contract Okay I misunderstood. So so Wan basically did work, can't
(01:22:38):
get paid. I told him todo a lean have did you talk to
him about that? I have notcalled one back, okay, because I
was just you know, I justhad the experience yesterday of getting hung up
on Yeah, welcome to the team. I was I have to be in
your boulder today. I was speakingof nice dropped in on his business.
(01:23:00):
But I be careful. Okay,Now listen, here's the deal. I
think I think he needs. Itmight be too late for him to put
a lien on that property. Whatis it marks? Four months? Four
months? Well, depending on ifit was labor or parts, it's either
ninety or one hundred and twenty days. I think the one hundred and twenty
(01:23:21):
is labor. If it's just materials, I think ninety a year ago.
Uh see, that's expired. Okay, so he's out of luck. He's
out of luck for a lean. But he can take him to small claims
court for let's see, it wasfive plus three for eight. He can
(01:23:42):
take him for seventy five hundred dollarsat least most of it to small claims
court. But let's see if youhave any luck. I mean, Jorgey
did wait wait wait, he alreadyhung up on you once. So he's
not going to talk to us,is he? Probably not? He hung
up on me. He didn't evenlisten to what you had to say.
No, no, I just identifiedmyself and you promptly hung up? How
(01:24:05):
do you identify yourself? Did itgo something like this, Hey, Slee's
bag, I'm with Tom Martine Click? Was it like that? But because
I left two previous messages, yeah, previous messages of saying who I was.
So I was with Tom Martino showhe promptly hung up on me.
(01:24:25):
So but he has a tax andaccounting business in Boulder. Well, well
that's right, that's right. Youknow what, maybe you should say hi
to him. But but Genie, just be careful, Genie, you know,
just in a nice way, saywe're just figuring out what we should
do. Should he you know,I don't know if you if you feel
like doing that, just be careful, like I know, I'm not sure
(01:24:50):
the guys that I don't think theguys are mad man and it's a public
business. Maybe, but I don'tknow. I think I think we got
you know, the good news isDeputy Marvel or Jeanie, here's the good
part. The good part is becausehe's public like that, he's going to
be easy to serve at his officefor Small Claims Court. So okay,
(01:25:15):
so I well I just tell thisthat, you know, tell jan you
know, we don't have any officialpower to make the guy to make the
guy call us. So here's thedeal. It's going to ask you something,
Jeanie. Why isn't this guy goingdown to where this guy is working.
Why isn't he shown up and fightingfor himself and saying, hey,
(01:25:38):
I want my money. Brother. That's what I wonder, because that's exactly
what I would do. Of courseyou would. Well, yeah, I
mean that's what I'm saying. What'swrong with this guy? I am?
I'll call him and ask him,Yeah, Mark, and ask him if
what's wrong with Small Claims Court. We can give him the legitistical advice on
(01:26:00):
that. So he did so.This Horge sent him a letter, I
think on March seventh of twenty twentythree, saying that he was going to
make payments of three hundred and fiftydollars every three or four weeks. But
he only made one payment. Sohe's he has a signed letter from this
guy. Oh that's good, he'sand he was pleased with the work.
(01:26:23):
It starts to cut problem. Yeah, no issues and no problems with one's
work. Wow, Okay, continuewith giving Let's just tell him to do
try this Small Claims Court thing man, that would be good. Okay,
and thank you. Do you haveanything else? I know that's it.
(01:26:45):
Okay, we're going to start stackingyou up with more stuff and make a
note of this. She likes confrontingpeople, now, I'm just kidding.
Three all three seven one three talksseven one three and two five five.
Robert, what's going on with you? Robert? Welcome to the show.
Thank you, sir. How youdoing? I'm doing good man. What's
going on with this scam? Issomebody stealing from your personal data? Well,
(01:27:13):
they're not only stealing data, butthey're stealing from checking accounts. They're
stealing other people's money from other peopleat the same time. Well, yeah,
I mean there's a lot of scamlike that going on. Are you
talking about anything specific that you knowabout. Yes, this is a scam
that happened to me just over thelast couple of days. Who is it?
(01:27:38):
What happened? Tell your story? All right? Well, at any
rate, I was in touch withone of my friends off of Facebook that
says, hey, I heard aboutyour problems me being a single parent with
two kids. He claimed that heknows my situation because I've talked to him
(01:27:59):
in the past about it, andhe said that, yeah, you know,
you should get in touch with thisguy and he can help you help
your situation out. Well, well, first of all, what is he
talking about your situation? Were youon Facebook talking about a particular problem.
I was talking about the fact thatI'm a single parent and two kids and
(01:28:21):
the fact that my ex left mefor some drug addiction and the way that
she left and this and that andother thing. I get it at any
Yeah, and he was like, well, I know you need help because
you had to quit your job,you don't have any income, You've got
two kids. You're about ready tobe a victied. That got it the
(01:28:42):
other thing. And then and whatthis, what this Facebook friend saw was
a pigeon waiting to be plucked exactly. But get this, the person that
I was talking to that I thoughtwas my actual friend apparently the guy that
does this scamming. He apparently didsomething to this friend of mine's Facebook account
(01:29:04):
to where he either mirrored it orhe copied it or something. But basically,
I was talking to this the scamartist himself the whole time instead of
talking to my friend about the actualsituation. Well, let me ask you
that how do you really know it? How do you know your friend wasn't
(01:29:26):
the scammer? Well, it's becauseof the simple fact I've known this guy
for quite some time. Did youknow him personally or only on Facebook?
No, I've known him personally. We hung out in long mind. Okay,
okay, good, okay. Didyou ever talk to him, Robert?
When you say you talked, youmean you texted? Right? No?
(01:29:49):
No, Doc, he's saying thisis a friend he's known before.
When he said he talked to himabout his problem, he texted him.
He didn't ever talk to him.It was on Facebook, right, Doc?
Right? Facebook chatting? Yeah?Okay, yes, Well, at
any rate, this scammer decided tocopy one of my friends' sofile off of
(01:30:13):
Facebook and he pretended to be myfriend. So the whole time I was
telling my story, I get it. Oh so, so anyway, tell
us rather than telling us you knowhow you got scam? What was the
scam? What did he do?Well? The scam was that he went
ahead and claimed that if I gavehim all this information, he would guarantee
(01:30:36):
that I was going to win onehundred and fifty thousand dollars. Well,
why did you believe that. Now, I didn't necessarily believe it. I
trusted myself that it was a scamall the way back to back. But
then again, you've got to remember, I'm a single parent, I'm in
the what does that? Okay?So what did you do? Did you
(01:30:59):
enter? Tell me what you did? Complete the story? Go ahead,
okay, So this is what Iended up doing. He kept after constant,
you know, conversation with my myso called who I thought was my
friend and the gentleman. I wentahead and gave him my whole life story.
(01:31:21):
I told him what my situation was, and he says, well,
if you do this and this andthis, I can guarantee that you're going
to go ahead and have at leasttwenty thousand in your bank account by tomorrow.
So what did what did you do? Continue? What did you do?
Okay? Okay? I went ahead, and I screwed up because I
(01:31:41):
gave him all of my information.I gave him my address. Yeah,
but what did it? I gavehim my Yeah, we're not hearing the
scam yet. You gave him yourinformation. But then what happened? Okay,
Well then is what happened is hestarted to ask me if I could
come up with one thousand dollars, and if I gave him one thousand dollars,
(01:32:03):
I had a chance of winning onehundred and fifty thousand dollars. Well,
every casino in the world does thesame thing. So I mean,
what happened? Did you give himone thousand dollars for instance? So exactly,
so I did that. He guaranteedthat I would get twenty thousand dollars
in my account the next day.Unfortunately that never happened. Well, carset
(01:32:28):
didn't or you wouldn't be Robert. So how much cash and total are you
out right? Now? Well,it gets even worse than this. Upon
my giving him the thousand dollars,I made a deal with another person with
some car parts that I was tryingto purchase online through Facebook, and I
(01:32:54):
went ahead and sent that person someof the Apple game cards. That's payment,
because you can. I don't believethem anymore. There's no no offense,
man, I find it hard tobelieve you're that stupid. Yeah,
that that Robert. You know.We don't mean to insult you. We
don't know you from anywhere, butit does sound pretty stupid. Now,
(01:33:14):
now tell me these gifts, Roberthold on a second, These gift cards
just came into the conversation. Whatdo you mean gift cards? Did this
scammer send you gift cards? No? When I was trying to buy the
parts from this other person, theytold me that if I go to the
store and get a gift card forthe amount that I owed. So you
(01:33:39):
were ripped off. You were rippedoff by two different is a whole other
deal. That's why I'm saying thisis really hard. Robert, you were
scammed twice? Is that what you'resaying? I'm sure there's a third time
coming up? Quick? Mark?Hold on, yes, right, it
is Robert. Hold on, Robert, Robert, hold on. Please.
(01:34:00):
The first guy you paid a thousandwith the assurance you were going to make
one hundred and fifty thousand. Thesecond guy for the auto parts? How
much did you pay the second guy? I paid him twenty one hundred dollars
with gift cards. With gift cards? How do you know it wasn't the
(01:34:20):
same guy. It wasn't because it'sa total different profile different. Oh okay,
now hold on, So then youyou paid a second guy twenty one
hundred dollars for car parts? Wasthere a third guy. No, not
okay business no, so right now, let me just get this straight before
(01:34:43):
we go to break right now,the total you're out right now is thirty
one hundred. Yes, okay, hold on and we'll come right back to
you. Please. I feel badfor you. I'm hoping. I don't
know. Let's figure it out rightafter that, go with a sure thing

left? Yeah, she's a reoccurringdrug user. We've had a lot of
problems in the past, restraining order, we were filing a divorce. She
Yeah, it's a long story, domestic violence, there was child abuse,
(01:36:39):
there was whole nine yards, that'sa whole You're just too trusting, are
you? You're just too trusting, very trusting, very very And I hate
myself for it, and I Idon't know how to deal with it.
And I just like I said,I was not thinking of the money at
(01:37:01):
the time, because at the timeI had a lot of money. But
obviously now I look back on itand I thank god. I really was
stupid. How could I possibly falleven even a small amount for this scam?
I'm still dealing with it today. It is. It is bad.
(01:37:23):
So when did all this scamming happen? This all happened within the last like
three weeks. So what do youwhat were you hoping you could do?
You bought these gift cards, andyou you gave the guy the number over
the phone, right or excuse me, over the internet right over? Yes,
(01:37:46):
over Facebook? So that I couldpay for the parts because you can
take your car. You're once youonce they're redeemed, they're untraceable. Yeah,
I know. And the other one, the one that I was doing
the deal with the car parks, was legit. I mean they phoned me
on the phone, they sent memultiple pictures. I mean they was legit.
(01:38:10):
Why are you calling, Robert?Yeah, if they were legit,
did you get your car parts? Then? No? Well hold on because
like I said, there's more. You guys are jumping way ahead of me.
Radio. Okay, go ahead,Robert, all right, tell us
more rate. Okay. So Isent the guy for the car parks,
I sent him gift cards. Hewas going to take the gift cards and
(01:38:33):
transfer them into his bank account orhis game, whatever he does with him.
I don't know. I didn't care. I just was trying to figure
out the best way to pay himfor the parts, so that I could
get my parts and he could gethis money at any rate. This other
guy, this agent, told methat once he found out that I because
(01:38:55):
he had access to my checking account, which was I know totally. I
don't know. Now, Hold Iwas the first guy you're talking about.
He found out you were ripped offby the second guy. Yeah, but
like I said, there was therewas gift cards exchange for the car parts.
(01:39:16):
Okay. Well, while I exchangedthe gift cards to the other guy
with the car cards, the guywho was this scammer, the agent,
he went ahead and told me that, hey, this other guy that you're
buying these car parts from is ascammer. You need to send me the
cards. So is what I didis I went ahead and copied the picture
(01:39:39):
of the cards to the agent andhe internally cashed him in. Now,
the guy with the car parts saysthat only two of the cards worked and
they were only good for one thousanddollars. Okay, Robert, agents,
Robert, stop everything, Robert, stop everything. Yeah, both of them
(01:40:01):
were ripoffs. You must understand this. Both of them are ripoffs. Okay.
The second thing you must understand youmust shut down that bank account,
immediately open a bank account in anotherbank, not even in the same bank.
(01:40:26):
Do you understand that? And thenget off of Facebook completely, please,
And Robert, I swear to God, Robert, if you do not
follow my directions, I don't careabout getting off of Facebook. However,
just don't communicate with people about yourpersonal crap and about money. You're never
(01:40:47):
gonna win anything, and you're notgonna buy stuff with gift cards. I'm
telling you right now. Both ofthem were ripping you off. The first
guy was upset the second guy orthey're working together. All I'm going to
tell you is this, do notDid you close that bank account? I
closed it after I found out thatthere was somebody hacked my checking account and
(01:41:14):
they stole another fifteen hundred dollars fromme. So wait a minute. I
asked you if hold on, Iasked you, if thirty one hundred dollars
was all you're out? But youlost another how much? Another fifteen hundred?
And that's not even the end ofit. Wait a minute, So
now you lost thirty Let me getstraight. You lost thirty one hundred plus
(01:41:40):
another fifteen hundred. Hello, Yes, so that brings us to a total
of forty six hundred. Now whatI need to know is this is there
any more? Is there any more? Sure? Is? Tell me what
(01:42:09):
happened? Oh, give him aminute, he's got to hold on.
Just hold on, Robert. Ifnothing else, you're helping other people who
hear this. But I swear toGod I you better make sure you're not
making this story up. Hold on, we have more coming up. Go

So good. I love Professor Bing, Deputy Bing. Here's the deal.
(01:45:26):
The Beatles sold albums worldwide two hundredthirty six million, five hundred seventy four
thousand and nine hundred twenty two albums. The Monkey sold eighteen million. Wah,
(01:45:49):
so Mark, so I was tryingto tease me about I don't want
to get into it anyway, sowe're I want to. I want to
talk about this though, the theguy that called about the aluminum wiring.
There are specialists marks that do illuminumwiring, and I think they might be
able to do it cheaper if youcalled like plumbline or fix it. I
(01:46:13):
mean, there's nothing wrong with thosecompanies are good companies, but I don't
think they're set out to do that. And by the way, George just
said yes they do electrical for sure, they do, because somebody was inquiring.
I think they do regularly cass Electricfor sure. Yeah, I think
they called still wrong number. Yeah, at least three seven one three talks
(01:46:34):
seven one three eight two five five. Okay, now I do have a
text or two about cars. Letme see right here, Okay, as
far as overheating, overheating, thepossible cause is outside of they had the
cool and flushed, They had theirthermostat checked and in fact replaced, what
(01:47:00):
would and a water pump. Ithink they're water pump checked as well.
What would cause overheating outside of thosethings? That to me sounds impossible.
But what do you guys think? They they changed the coolant, they have
a new thermostat, and he saidthe water pump was checked. Whatever that
means. What do you think?Well, the only thing didn't miss is
their circulation, you know, fansor anything like that. So tell me
(01:47:25):
what would happen if you had circulationof all the liquid and coolants. You
still need the fan, right, because that's what's cooling the coolant or the
car moving one of the two.Yeah, what about if the line from
okay, so oh yeah, whatabout if the line from the water pump
is crimpt or the radiator could beblocked? It could be only going halfway
through the radio thing. So there'sall kinds of things that have I mean,
(01:47:51):
I didn't think overheating would be sucha mystery. Now there's a lot
that goes into it. Because thecar is the parts and part they're smaller
or smaller every year, so theygot to be more efficient. One guy
said, this is a coincidence totwo texts about cooling. Somebody said that
their car runs cool all the time. Is that a problem? Well,
(01:48:13):
yeah, you're definitely gonna get lesserfuel economy if it's running too cool.
This is going to change your actualmixture. Usually, when they're running too
cool, you've got a thermostat tostay and stuck open. Oh so you
mean to tell me actually running coolis not good. No, they try
to heat that engine up, andI mean the same thing for the transmission.
They want to get them up tooperating temperatures so that they can work
(01:48:34):
at their optimum levels. Okay,so there's an ideal temperature range. You
don't want to go too hot,but you definitely don't want to stay cool.
Correct. Okay, we have acomment on aluminum wiring from ron Ron.
Go ahead, Hello, mister Martino, I had to sell. I
(01:48:55):
sold my apartment building and I hadI gave him one hundred fifty dollars per
outlet because their insurance company wanted pigtails. So you can find independent companies that
do it. How long ago wasthat? Man? Excuse me? How
long ago was that? Run?Twenty twenty one? And did you find
(01:49:20):
one that specialized? Yeah, it'sjust it was an independent electrical company.
That's all they did. I don'tremember the name of them. But the
other thing is they had to excel. Had to come to my house to
do something outside on my box.And when the guy was working on it,
(01:49:41):
I said, is that aluminum wiring? He says, yeah, that's
all we use. They use alumawiring from the power box to the breaker
box on the house. They don'tuse cobber. That sounds so backwards,
even Holmes. Wait a minute,so even homes that have a copper wiring
still have aluminum going to the service. Yes, now, my house was
(01:50:08):
built in seventy oh, it wasbuilt in I think eighty two. Listen
to this. What do you thinkthe average I just looked up this.
What do you think the average rewiringjob costs? They say only six grand?
This guy. This guy was sayingone hundred grand. He's sadly exaggerating.
(01:50:28):
They say the most. These specialistssay they can do most houses for
twelve thousand dollars. I mean fornot to exceed twelve thousand dollars. Yeah.
Yeah, And that's what happened. When I sold my apartment building.
Their insurance company said, well, you you got to have pigtails. And
I said that's BF And then Iwait a minute, wait a minute,
(01:50:51):
long with it. And I hada quote from an electrician that I had
worked with before, and he's I'lldo it for one hundred and twenty five
dollars a box. Yeah, yeah, yeah, but we're talking about pigtailing.
There are not a lot of companiesthey're insurance now. Brian Burns,
a Compass insurance group, said mostcompanies want complete rewiring. They do not
(01:51:15):
want pigtails. I'm sorry, butthat's bogus. Well, I think Compass
would know. I mean they're amajor insurance broker. Huh, Well,
Compass Insurance would know if that's trueor not true. But the carriers he's
dealing with don't want to do it. There's twenty six of them of all
(01:51:40):
the major carriers. Yeah, butthe caller said the same thing. He's
having trouble finding it. I realizethat, but you're just gonna have to
look. Well, okay, youcan't ensure a house in the mountains now
with all of the normal companies. They've all walked away from it. So
you have to look and find somebodythat will. And you can get pigtails.
(01:52:04):
Pigtails are fine, there's nothing wrong. And listen. Okay, that's
good. I'm going to tell myinsurance company that Ron says pigtails are fine,
so don't cancel my insurance. Wegot more coming up on the Troubleshooter
Show. Three O three seven onethree eight two five five. Go with

So the Lincoln I was in Floridaa week ago. My friend owns
the car. He has the trunkwhere you push a button and it opens
(01:53:13):
automatically and it will close automatically, okay, And I threw my backpack in
the trunk when I was standing backthere, and he was pushing the button
to close the trunk, and Ididn't know that, so I just grabbed
the trunk and closed it like anormal car. And after that, the
automatic open all the way, closeall the way button no longer works.
(01:53:36):
It doesn't work at all. Itwould pop the trunk, but you know,
kind of like the liftgates on theSUVs today, they open it.
You know, you push a buttonthat opens automatically, it would do The
trunk would do that. But allI did was grab the trunk close it
and then it quit. It quitdoing that. Hey, guys, guys,
let me take a guess at this, because I had something else automated
(01:53:59):
that worked similar to that, andwhen I forced it by hand, the
limitters were moved. I know thatthey were mechanical limiters that caused it not
to work, but it really wasstill working. It just was limited.
Does that make sense to any ofyou. Yeah, but they didn't move.
But you're right along that lines. You probably have to disconnect the battery
and reprogram, you know, justclear everything and restart it again. Yeah,
(01:54:25):
it's said in the book to disconnectthe battery thirty seconds and I did
that a couple of times and thatdidn't do anything. And then somebody else
said, you have to touch thebattery cable to a ground to discharge.
You touch them together. You're takingclear left the battery. You touch them
together and that should reset it.It really should. But we're out of
(01:54:47):
time right now. We can't getinto it, but we'll happily call you
back and he can research it.I'm Tom Martino. Don't forget three h
