free analysis of your home. It'sreally important. A lot of people are
wondering about selling right now. Peoplehave got used to the mortgages and they
know that eventually they might come down. They can refive, but people are
still buying houses. If you're thinkingabout listing and you want to know what
(01:08):
it will sell for, give Franka call free of charge three h three
nine two zero sixteen twenty two.I'm going to tell you a little story
about a family. The tale oftwo houses, two houses to sell.
The mom goes to Frank Duran inthe real estate man. The daughter goes
to a friend, not one.I'm telling you it's this is a true
(01:36):
story. It's the most amazing thingin the world. But the mom went
to Frank Duran. She gets howmany offers, three four, five,
within a couple of weeks, chosean offer and that's it. They're going
to close. It's sold. Theother ones. Do you hear that?
(02:01):
You know what that is? Crickets? Crickets. I don't know if you
can hear crickets, but they're soquiet because they are crickets. But I'm
going to give it to you againbecause that's my own fault. I'm going
to do it again. Here's whatthey hear. Yep, that's not using
(02:23):
Frank. True story. So thenthey figured, okay, we're going to
rent the house. We'll just rentit. So the same broker. Did
they get any tenants? No?So people, this thing about using friends,
(02:43):
I like friends. Friends are nice. Family is nice, but they're
not always the best people to usefor anything. I just want you to
know that. Now we have hada lot of hail damage I want to
speak to that, but first letme let me pimp for calls here.
I'm always amazed at how many peoplewait too long to call me. So
if you have the just the inklingof a problem, or you want to
(03:06):
prevent a problem, call before youenter into a contract or a problem,
or buy something without knowing anything aboutit, give us a call. Three
all three seven one three talk sevenone three eight two five five. Some
people love calling, Some people hesitate, some people say, you know,
I don't want to be hollered atlisten. This show is stick, but
their help is real, Okay, the stick meaning I want people to remember
(03:28):
a call and to use the informationthey learn to prevent problems. I really
want them to so I might doa little stick, but don't ever,
ever, ever, ever believe Idon't want to help. Sometimes I can,
but I try. That's my firstgoal. But then I really need
to ask you questions to see howit happened and if there's any way out.
(03:50):
So many times people do not reallyknow, you know, they don't
how do I say it? Theydon't have any hope because they've screwed up
so much. Three L three sevenone three talk seven one three eight two
five five. Also, you cancall and this is a great number three
(04:12):
L three Martino three L three sixtwo seven eight four sixty six. And
the reason I give that number isbecause it's a number that you can call
and uh twenty four to seven andleave a message and we will get back
to you. Now, Katrina, you remember there we got another call on
(04:34):
that murder. You're yeah, yougot me, You got me, Kachina,
Okay, now you remember that callabout the murder. Thank you.
Well, we have someone who calledup part of the family that didn't get
on the air, and they wantto talk too, So why don't we?
Uh? I I have already lefta messagekat I know exactly what you're
(04:56):
talking about, and we I havenot heard anything yet, but I will
definitely get It was a shocking story, it really was. Now as I
remember it, I'm looking for theoriginal caller here. I don't remember their
name, but well it was theI believe the brother of that. But
do you remember the name of theguy anyway? What happened was this these
(05:21):
two brothers there it is these twobrothers had a furniture moving company or used
furniture company. They were buying andselling furniture, and he says that this
is James who called, and Jamessaid we somehow his brother went back to
(05:43):
a home that they had gone toearlier to pick up more furniture, and
they said that something happened and afight ensued and the brother Gilbert, who
went back for that furniture, endedup killing the homeowner or the renter whoever
(06:04):
ended up killing him. He claimedit was self defense. The witnesses there
say the Gilbert brutally attacked the guy. So Gilbert sitting in jail right now
awaiting a hearing in court and allthat, you know. Meanwhile, the
brother James says, my brother Gilbertcould never kill anyone never, He's a
(06:28):
great guy. Now, the peopleat the scene said that Gilbert was high
and obnoxious and flirting with a fifteenyear old girl and even you know,
was talking crap to the girl. And when this other guy came over and
(06:49):
said, you know, you betterleave, you better leave her alone,
he put threw him out of thehouse. The guy pulls the gun and
shoots him. That's the story, and that guy was arrested. Meanwhile,
somehow a third brother, who isa guitar player, he heard the story
(07:11):
and said he has more to addto it, but it was a wild
story in a Rapo County. Jamesand his brother Gilbert, you know they
now. James said, of course, his brother's one hundred innocent never happened.
He wasn't there. He just saidthat. Everyone else said Gilbert was
(07:35):
a tweaker, high on drugs, violent, vile, and a murderer.
Now, just to let you know, Gilbert has been in trouble before.
The guy accused him murder the otherguy. The other guy, they said,
was not a bad guy. Butthis is the tale of different eyes
(08:00):
witness Well, there were no othereyewitnesses. I mean, all the eyewitnesses
there said Gilbert did it. Gilbert'sbrother said there's no way his brother could
have done it. See, thisis the problem with crime. You never
want to believe someone could do something. I understand that, and I do
believe people should be should be adjudicatedby a jury, and there's should be
(08:22):
a trial and all that, andthese eyewitnesses should be vetted. But when
you have eyewitnesses, I mean it'spretty difficult to refute all of them.
I mean, I don't think theyall get together and want to screw people.
Eyewitnesses I think are pretty dependable. There's some other stuff going on in
the news that I think of note, okay, really important stuff. First
(08:50):
of all, I don't know ifyou heard this story, but about Mandisa,
the American idol star who also she'sshe's really cool. Also, well,
she's passed away and she was ayoung woman, and they said that
she died from obesity, from morbidobit complications from morbid obesity more and they
(09:18):
said that it was her body massindex was high and it led to a
lot of complications. I think thisis probably one of the first times I
actually heard somebody declare someone you know, as a cause of death obesity.
Most of the time they see naturalcauses. These guys said obesity. And
(09:45):
so what's the difference between being fatand obese and being morbidly obese. What's
the difference they're saying right now thatpeople are carrying around more weight than ever
Now I thought just the opposite.I thought people were trying to be more
fit. So this is called classthree obesity, Class three, and they
(10:09):
say about nine percent of the populationhave class three obesity. Now here's the
problem. Ninety percent of them wearspandex tights. That's what I don't understand.
That's the part that I could neverfigure out. Do they own mirrors?
(10:31):
Now, I'm not making fun ofpeople, but come on, when
you put on Spandex and you areso fat you literally have to stuff yourself
into it, and then you lookat yourself? Are you thinking you look
good? What goes through your mind? I've often wondered that is it even
(10:52):
comfortable? I would think a mumuwould be more comfortable, but I could
be wrong. Three O three sevenone three eight two five five. We're

is with us from the Art ofgrant And by the way, I'm going
to give anyone a gift, areally fun gift if you can guess where
he grew up. Okay, yougotta guess where he grew up. It's
(12:30):
not on your website, is it, Mitch? Just don't say that.
Is it on your website? No? No, good good So they can't
google it or anything. Okay, people, I'm telling you you will not
believe it. Okay, And we'regoing to talk about it. Where did
Mitch grow up? Now we obviouslyI say in the commercials he came here
as a Romanian immigrant years ago acouple bucks in his pocket built the company
(12:56):
the American Dream while that met hima beautiful woman from Chicago, I excuse
me, Ohio, and then hasthree kids. And here's the deal,
where did he grow up? Iwant the village for the town or the
city. Is it a village, town or city? What would you classify
it as the region? A region? But it's actually a real region called
(13:20):
what you might call it? Yes, okay, very famous region, folks,
very very famous. But you can'tYouTubers. I'm not gonna I'm not
gonna put that on there. I'mnot going to take your answers on there.
I'm going to I'm going to onlytake phone calls on it. What
(13:41):
gift should I give people? Idon't one hundred bucks a gift certificate,
one hundred buck gift card? Hey, deputy doc, you got to follow
up. But I want to goto Joe Cano first. Joe Canno is
a certified financial planner. That's afiner designation for a real, actual thing.
People can't just call themselves that. And Joe this question by text,
(14:07):
and I don't give out that numberand a five seven, seven, three
nine. You can text me fiveseven seven three nine. Anyway, people
want to know why do we downgradeor could we explain that? Well,
they're not asking to explain. I'masking that. They're asking why do we
downgrade variable annuities? And what I'dlike to do is ask you if you
(14:33):
could give a simple explanation of thedifference a variable annuity versus a fixed indexed
annuity. It's really important. Variableannuities used to be very popular and they
did allow people to invest inequities acrossthe stock market. They still do actually
(14:54):
and and have tax deferred profits. But of course they also have losses too.
They're not protected. Well no,no, they are protected, I
believe from negative even with a variable. Can you explain a very basic explanation
of it. I'm not trying topush them, but I want to give
some understanding, Joe, and you'rereally smart, go ahead, sure,
(15:16):
Well, well, thank you,Tom. You know, I'm really familiar
with veriable annuities, and like yousaid, you know, just briefly.
You know the variable annuities. Theyhave equities, they have mutual funds,
so they're a good product for somebodythat is young. Now, a variable
(15:37):
annuity can grow tremendously along with thestock market, but they can also drop.
Okay, there's no guarantees anything thatyou see when you see the word
variable. There's no guarantees. Itdeals with the stock market. They cannot
guarantee you. Again, they cannotguarantee you that you will never lose you
(16:00):
or principle. Now, the otherpoint about a variable annuity, So joe,
hold on one, So joe,Joe, Joe. There is no
such thing then as a variable annuitythat has zero downside? Are you sure
of that? I'm just curious.I mean, they have, they have
like let's say, twenty to fiftyto one hundred different things you can invest
(16:21):
in, and as you make money, it ratchets up. But are you
saying you can lose all of ittoo? A plane a plane veriable annuity?
Yeah, there's no downside protection okay, god less unless unless you know,
you put a writer on those annuities. But it will cost the consumer
(16:41):
more money to put a writer. It's almost like an insurance policy basically,
and annuity if it drops, youknow their principle, we've been protected,
but it will cost them money addingto the fees of the variable annuity.
So about a plane variable annuity withno writers, just a plane old fashioned
veriable annuity. They have no downsideprotection. But it's like a stock deferred
(17:06):
it's like a stock deferred investment account. Excuse me, a tax deferred uh
stock account? Right right. Annuitiesare nuities. You know, they're meant
for retirement, so there's nothing wrongwith them. All I'm saying is that
the younger generations should be looking atthat if they want to have potential for
(17:27):
growth and they have the time torecover if the market goes down. Now,
can you can you convert a variableannuity into a fixed one as you
get older? Right? But theonly of course you can. But the
only thing is, you know you'regoing to be the person that has a
(17:47):
veriable annuity will be incurring some expensesto sell the mutual funds inside the annuity.
It's gonna they're gonna lose a littlebit of money. It's just like
if you have a stock broker's onthem and you want to sell the stock.
You know the broker is they're goingto do it for zero dollars.
They're going to charge you a feeto sell your stocks and sow it's with
(18:11):
a mutual fund on the annuity. So does that also mean when you have
a variable annuity through your life andyou invest and you change investments and get
in and out, you are actuallycharged commissions within that annuity. Absolutely,
absolutely, that's what I'm talking about. The high fees. Oh, so
you are charged every time you changeinvestments, and then plus you have the
(18:34):
downside of the market. And soit's really for sophisticated investors. Well,
it is, it is, andit's really I mean a good product for
younger people if they want to.Again, it takes time and money.
You have a good retirement, soif you have the time to play with
the stock market, it can doreally well. Mutual funds are stocks.
(18:56):
However, though, if you're nearingretirement, or you're closer, or you're
a conservative person like I am,and I think you are. Now basically
you know what happens. We wantto have something guaranteed. We want to
have something that is fixed. Nothingto do with a downside of the script.
Now I understand that part we wantto have we want to have protection
(19:18):
and growth. Now do they also, And for those listening, both fixed
annuities and variable annuities, you don'tparticipate one hundred percent in growth, right,
aren't you kind of here's what you'redoing with an annuity. Yeah,
with like a fixed rate annuity, you're saying to the professionals, you guys,
(19:40):
take this money and make it grow, and as a result, I'm
going to be satisfied with ninety percentparticipation. In other words, if it
goes up, you know, tenpercent, I'm going to be satisfied with
nine percent. Is that basically whatyou're saying is right? And then and
then there's that cap. Right,Well, there's there's two things. There's
(20:03):
the participation rate and then there's thecap. Because you could have a cap
of fifteen percent, but you couldhave a participation rate of ten percent,
but you'll always be capped at fifteen. And that's because and it's very easy
people ask why do these annuities guaranteethings? That's why, because they make
(20:25):
money above that is that that's reallywhat they're doing. That is that is
exactly right, tom. You know. So for somebody that is conservative,
they fixed annuity, or somebody that'snearing retirement, a fixed annuity is the
way to go. Somebody that wantsto protect their nest egg. So very
annuity. There's nothing wrong with them. We're not downplane right now. I
(20:48):
understand. We just want to makesure that they're suitable. You know,
they're suitable, right, or somebodythat is young, because they can be
expensive, They can be expensive andvolatile. That is right, all right,
Joe Cano, thank you. Ireally do appreciate you. Three oh
three seven seven nine sixty six hundred. Now Jim has A has the answer
to our trivia question, where didMitch Fluria grow up? Go ahead,
(21:14):
Jim, it be it be Transylvania. You saw it? Wait you wait?
Is this your cousin? Come on, Mitch? This is ridiculous,
is this sir? Come on man? I thought he was kidding when he
told me where he grew up,and I said, wait a minute,
is this for sure? This guyis come on, Oh my god,
(21:40):
Mitch, come on man, howdid you know that? Jim? Well,
you get some pretty good closes heras the most famous place, and
I didn't, did you know?I didn't. I didn't know that was
a real I didn't know it wasa real place until just now. I
think, Wow, like midicle, people talk about Transylvania more than Yeah,
(22:04):
he says, it's not even famousback there. Well it's yeah, people
know it's fair. Do they havea tourist thing? Now, yeah,
there's the Cassidy's the museum. Thereis a Draculus castle was there. There
wasn't a real Count Dracula, right, well he was yeah, well he
was uh he rolled into fourteen hundredsand there's nothing creepy about that guy except
(22:26):
how he was wearing the beat people. Okay, so hold on, there
was a Count Dracula who lived there, but he didn't suck blood, nothing
I know of. But what waswhat? Why did this legend start?
Do you know? By the way, Jim, do you know no,
(22:47):
I was going to make a commentabout the second Blood business by the while,
go ahead, go ahead, Whatwere you going to say about it?
You're going to say that You're goingto say he's running for president or
what? Yeah? Power pan.So yeah, anyway, Jim, thank
you. So Mitch, Mitch, how did this start with this poor guy,
Count Dracula in his family? Youhad? Was Dracula a real name?
(23:07):
Well, Dracula is not a realname. His name was blood Sippish
and he rolled in fourteen hundreds. He was eventually assassinated. But uh,
yeah, by the way, nowadays, well he like a Robin Hood or
was he evil? No? Hewell he wasn't evil for us. He
was you know, he was hewas punishing, he was catching and punishing
the bad people. And oh hewas ok he was impaling him. And
(23:30):
that's a name, Blood the Impaler. Okay, but yeah, we make
these jokes nowadays where we say, yeah, you know, with all the
things going on in the world,we need another you know, impeller impaler.
Yeah, to put people in place. No, I see. So
so the Blood thing was that anAmerican thing? Do you think? Oh?
Yes, it was. Yeah. They they just seized on this opportunity.
(23:53):
And so when you tell people you'refrom translame really you tell? I
mean, that's raise an eyebrow here, what beg is like, Eh,
so your kids when you're your parentsback there, Yes, yeah, in
Transylvania. So when they say mygrandfather and grandma are from Transylvania, that
must be something for them to bragabout. Yes, yeah, my Keith
(24:14):
and I took them back to thecastle and two pictures and they brag the
body. Then oh my god, anyway, I got to give that guy
a gift card, get his nameand number. Damn it, I can't
believe it. This Come on,Deputy Doc has it? Follow up?

on? What jepity doc is on? But I'm getting the caller on.
That's Oh, thank you, Keith. What's going on with you? What's
(26:15):
going on? Man? Yeah?Hi? I subscribe to centry Link a
while back for their package for Dishnetwork and their phone service, internet service,
all that stuff. When I gottired of having direct TV, I
(26:37):
turned in the equipment to them becauseI called up a direct TV. They
told me what to do. Idid it. And the lag time between
when they received the receiver and suchand when they notified Sentry Link centry Link
built me for time that I didn'thave the receiver. I refused to pay
(27:00):
it now. This is hold on, hold on, let me let me
get this straight. You went fromwho to who. Well, what happened
was that Sentry Link has their theirbundling where you could get the site TV
yes I want. I didn't wantto direct TV anymore. Okay, so
(27:21):
when you were okay, so youdidn't want direct TV, you went with
Sentry Link. But how did Idon't understand the part where you got billed?
Yes, exactly, that's that's thething here. Well what did you
get who billed you that you're disagreeingwith? Tell me about the bill you're
disagreeing with. It's Century Link becausethey started billing you too soon. Well,
(27:45):
what happened was that during that lagperiod when I turned in the equipment
from direct TV, right, therewas a there was a time in between
where they didn't contact Centry Link fastenough to say that they got their equipment
or whatnot. So it went intoanother billing cycle with sentry Link. So
(28:06):
Sentry Link charged me for direct TVservice that I didn't have a receiver nor
could I watch all right, Sohold on, now you switched to century
Link from who? No, Ialways had century Link. It was part
of their bundling service. Okay, right, Mark, can you take this
(28:30):
over because I am so confused.I don't know what I'm doing honestly.
So did you get Dish Network throughCentury Link? Well? Yeah, it
was Direct TV. Yes, that'sour Direct TV. So basically they just
you would only pay Century Link, but you would also have Direct TV included
in the package. Yes, that'scorrect. And then what happened is you
(28:53):
never got a receiver, so youcouldn't watch it. Well, what happened
was that when I no longer wantedto have Direct TV anymore, I see
that keep going. I turned inthe equipment because I called Sentry Link.
They told me to get contact DirectTV. I contacted Direct TV, turned
(29:18):
in that equipment to them. Okay, but you continue to get billed by
century Link for Direct TV. Yes, I did for one month. So
I'm trying to nip this in thebud because they keep on adding late charges
because I refused to pay for somethingthat I didn't have any thing to watch
because it was the lag and thetime that they received the equipment back.
(29:44):
They charged me for a month whenI didn't have the receiver because it was
in the process of going back.Yes, that's correct. Okay, Well,
we have an angel over there wecan reach out to, but I
I don't know how they're going tolook at that. Did you have a
contract at all? In other words, in order when you first signed up,
(30:06):
did you have like a two yeardeal you had to commit to?
So that's with them for seven years. So so you mean to tell me
that in this bundle they won't makean adjustment for you on that one on
that one thing. That's what Iasked for because and even some of the
(30:27):
customer service representatives that has understood whatI was talking about, I was telling
them and I said, I'd wantto get this result by a manager,
and they said that there was nothingthat they could do about that that I
would have to pay for it,even though I didn't have that service.
So how much more? How muchmore did that add to your bill?
That service? Well, well, what happened was that it was about one
(30:51):
hundred and seventy dollars, but withthe late seeds now it's come up to
two fifteen. But hold on,I know I'm talking about on a monthly
basis, how much extra do youpay for that one service? That one
service was I don't have that informationwith but you wanted to discontinue. You
wanted to keep Sentry Link but nothave the satellite part. Right, Yes,
(31:17):
that's correct. Okay, that's whatI'm asking. They couldn't. So
right now, what are you rightnow? What are you paying for?
Right now? I totally closed theaccount. And are they recognizing that or
are they still billing you? They'restill trying to get their money out of
me? No, hold on,now, I don't want misunderstanding. Are
(31:38):
they billing you monthly for your contractor are they just trying to get that
pass due amount? They're just tryingto get that past due amount. And
the past due amount is it justfor the direct TV part or is it
also for regular Sentry Link. No, just for the direct TV part plus
(32:01):
the late service seas or whatever.I get it charged that. So all
you wanted to do was take outthe sense, take out the satellite part.
You wanted to take it out,and they would not do it,
that's the bottom line. Well, they what they wouldn't do was that they
wouldn't credit the part the month whereyou didn't have where you didn't have a
(32:22):
receiver, and it's all so yougave up the entire service over one month
of a partial bundle. Well, what happened was was that I tried to
resolve this back in November. I'mjust asking you. You gave up the
whole service because they would not adjustfor one month for that one service.
(32:45):
Yes, okay, that's why Iasked you what your damages were. There's
a reason I'm asking, and Iasked it in the beginning. What is
the one month of that one servicethat you wanted credited? It can't be
a hundred seventy a month? Whatwas it? How much that was there?
That was their I think their theirthing for their satellite options. You're
(33:08):
telling me that in a century Linkbundled package, you're paying one hundred and
seventy a month just for the satellitepart. Yes, that is the worst
bundled package I've ever heard of inmy entire life. Go with a sure

This is the Troubleshooter Show. NowTom Martino. Hey, I'm Tom Martino.
Welcome Mitch Felurious here from the Artof Granted. Mitchell, I want
to I want to ask you straightup I want to ask you straight up,
and of course I know the answer. But if I don't ask these
questions, people think I'm pussy footingaround. You are at advertising free materials,
(36:29):
Now, there are some conditions. All they pay for is fabrication and
installation. You'll do the small job. Why is the material free? Number
one? Question number two? Honestto god, you charge the exact same
installation and fabrication. You're not markingthat up to make up for it.
So first, why are the materialsfree? When we cut into the large
(36:54):
slabs, those full sheets of graniteancourts for larger kitchens and projects, we
usually we end up with some leftoverpartial slab pieces. We have them when
they are there. They were ten, and there were one hundred, and
now we have many many there hundreds, hundreds, now some of them.
You have some big pieces, somesmall pieces all in between. So what
(37:15):
okay, So you want to getrid of that boneyard we do, yes,
okay. So if people hire youthen to fabricate it and install it,
you're charging the exact same prices ifthey paid for the material. Yes,
we want to charge for fabrication andinstallation. If they don't have seen
and what is fabrication. Explain thatthat's the edge treatment, that's the polishing,
(37:37):
that's the whole process of us comingout your house. We take measure
Okay, templates, we go backto the fabrication shop. We cut and
we polish them. We open thescene, cutouts, faucet holes. We
go back and we install the countertops, the little backs o keys.
Now, yes, they can dovanities. They can do parts of kitchens
or maybe small kitchens, smaller kits, islands, islands okay, counters yes,
(38:00):
bars can they do. Okay, somebody wanted to know what if they
wanted to do an end table literally, I mean a big end tape or
a big coffee table. We dothat. Yes, sometimes small tables.
Customers will just well yeah them themselves. You're of course you're gonna have here.
We deliver it. We said itfor them, okay. Yeah.
And so these remnants would be perfectfor that kind of stuff. Yes,
(38:23):
And a lot of them are thatcourts that white courts with a little bit
of gray vein, like everyone reallypretty is. Yes, so it's not
it's not just grantitede. It's naturalcourt site and cortz. Okay, there's
all sorts of sizes, and I'mtrying to think what I could use it
for. I'm serious now when Isay this, because I think that's a
cool idea. So so if okay, wow, that's pretty cool anyway.
(38:45):
So that's the art of Granite dotCom. He's here today if you have
any questions. Now, I wantto go to a serious case here,
and I want to I want torecap this because Gabriel says, I want
to give my side down. Letme explain. The original call comes to
this show May twenty ninth, andit was from a guy named James Vermilion,
and James says, my brother isin jail and he's an innocent man.
(39:10):
Now, you know. Good, good on James for sticking up for
his brother. James and Gilbert werein business together. They just started buying
and selling furniture. Gilbert went Gilbertwent to this house supposedly to pick up
some furniture and while there, now, by the way, they had been
(39:32):
there earlier, but supposedly there wasmore stuff to get. Gilbert went back
and supposedly, according to the reportsof the women in the house and some
eyewitnesses, the women in the housesay Gilbert got obnoxious and vulgar. He
was high and he was flirting witha fifteen year old and the other guy
(39:58):
who was murdered, he kicked himout of the house, basically threw him
out. He said, get out. And then the guy when they got
outside Gilbert for a million, pullsa gun out and shoots him dead.
Gilbert says it was self defense, and his brother James said it was self
(40:22):
defense, even though James wasn't there. And the guy who died, they
claim he was the one who wastweaking and high and attacking Gilbert. So
that was the story. And thena bunch of people called in, people
who knew eyewitnesses, and then peoplewho knew people, and blah blah blah,
(40:46):
and there was a mixed bag. Many people said Gilbert was nothing but
a drug addicted brute. Others saidGilbert was a good guy. Then other
people said about them, and I'msorry, I don't have his name right
handy, but the victim was agood guy. And then other people said
the victim was a tweaker. Soit depends on who you ask. But
(41:09):
during the course of this conversation, somebody mentioned they had a brother, James
and Gilbert had another brother, Gabriel, and Gabriel was in a band,
and for some reason, Gabriel weighedin on this with one of the band
(41:29):
members who called the show, andGabriel said something supposedly to one of the
band members that he wasn't surprised bythis. So, Gabriel, you wanted
to speak for yourself, so goahead, enough said for me, Go
ahead, all right. So Ialso start from the beginning, like you
(41:50):
said, I'm in a band.Where called which hearty? I can find
us everywhere on Like, oh mygod, is this a commercial for your
band? I mean, let's talkabout the murder, sir, Go ahead
up, all right. So Iwas talking to Demetrius. He comes to
band practice one day. He's like, hey, guys, I'm not really
going to be feeling it too muchtoday. My uncle just got shot.
(42:12):
He died. You know, thewhole family's a mess right now. So
you know, I'll come in getall my stuff recorded and done. So
if you guys wonder why I'm youknow, not too into it today,
that's why I was like, it'sall good, broach, come in.
Can you tell me the victims nameso I don't keep calling it him?
What was the victim's name. Doyou recall Aaron Dafner? Aaron Dafner,
(42:34):
Okay, go ahead, sir.Yeah. So as soon as I hang
up the phone with Demetrius, Iget a bunch of links from all my
friends and family about Gilbert murdering somebody, and it just like kind of hit
me like there's no way this,Like what are the chances that this is
(42:55):
real? Right now? And soI called Demetrius back and I'm like,
does your uncle live in Aurora? And he goes yeah, And I'm like
at such and such address and hegoes yeah. And I'm like, bro,
you are not going to believe this, but I'm pretty sure with my
brother who did it. And Iwas like really, And I'm like,
So we get to talk and we'retrying to figure it out because you know,
(43:20):
neither of them are saints, sowe don't know if it was self
defense, because that was, youknow, one of the first things that
came to mind, Yeah, couldfully be self defense, you know.
And he was asking me. Iwas like, do you think he could
have done it? And I waslike, well, you think he was
really in fear for his life.So the time went halfway and half way
sure, you know, it's youknow, I'm trying to figure out what
(43:44):
you're adding to this, GID.I don't mean to insult you, but
I don't understand what you're adding tothis since neither of you were there,
and these are private conversations you had. But are you going to get to
a point here? Well? Yeah, it's it's I'm sorry, it's just
(44:04):
still surreal to me to think aboutyou know, this still going on.
What did you want to say thoughabout your brother? Uh? Well,
like the restraining order and everything thatwe had going on order because what restrained?
(44:25):
My mom has a restrained Me andmy mom both have restraining orders against
him. Okay, well that doesn'tbode well for a guy when his own
mom has a restraining order. Yeah. So the last time I saw Gil,
I was, you know, holdinghim back, trying to keep him
from attacking my mom. Cops camelike four or five times. All these
(44:45):
reports are made. You know, when he when he's a sober guy,
like, yeah, he's awesome, but when he gets drunk, he's wild
and crazy. And if anybody, you know, even he looks up his
rap sheet, they're going to seeall that. So obviously we know that
he has, you know, gota history of violence, so you you
could see him doing this is whatyou're saying. Yeah, and that must
(45:07):
piss off your brother. Do youget along? Did you talk to your
brother James about this? Yeah,me and him did not see eye to
eye because I'm I'm more like situatedin reality of this actually happened. And
yeah, you know it's okay.So so where do you stand when you
(45:30):
said you wanted to give your sideof the story. Did you feel anything
that we said on the air earlierwas was not accurate or unfair? You
know, every I think everything wastotally fair. I was really upset that,
you know, the victim's family hadto deal with this, you know,
especially when they're traveling down and they'rein mourning. I thought, you
(45:52):
know, I just I couldn't believethat. And now here's what I want
to know. Have you talked toyour brother Gilbert. No, we tried
to. Well, we're actually tryingto get a hold of him at the
hospital. I'm pretty sure was rightwhen we had heard that he had assaulted
(46:13):
a nurse, so we were prettysure that's why they took him from the
hospital to the jail. And Iguess his wounds were so severe that he
ended up going back to the hospital. Okay, and did you hear there
were eyewitnesses? Yeah? Matter offact, at today at work, a
(46:34):
lot of people like know about thestory now, and like we've heard so
many different rumors because apparently I guessthere was more than three eye witnesses.
There's only those times that came toit. And like we heard that there
was nobody there, and then weheard that they were having a hole.
Now if you look at that, there are there were people there who saw
it. And then the fifteen yearold girl said that the fifteen year old
(46:58):
girl said that your brother was obnoxious. Yeah, So anyway, thank you
for calling. And again, wheredoes it stand right now? Is your
brother awaiting what he can't come upwith bail? So what's going on?
So I guess they dropped some chargesand they're just trying to go just after
(47:22):
the just the murder charge. Andis your brother still saying it was defense?
Yeah, but even if he somehowmagically got self defense, I'm pretty
sure it's manslaughter because he's like notsupposed to have any firearms. Oh,
why, well, he's got amultiple dvs. You know, he's he's
(47:45):
got a record like people with histype of sheep. See, James,
your brother, James said, Yourbrother James said, Gilbert didn't even own
a gun. I mean, Ithink your brother James is delusional. Yeah.
Do you think your brother Gilbert's goingto prison for life? Oh yeah,
(48:06):
I don't think he's getting out ofthis one. Like even if he
I bet the DA would just lovea recording of this. Although what good
would it do? James called theradio station. I'm pretty sure they are
what good would it do? It? No, these are people. They
don't care what you say or whatJames says. You guys are both You
(48:27):
know you weren't there, you didn'tsee anything. You're just giving your opinions.
Nobody cares about that. James sayshis brother's a saint. You're saying
your brother's not a saint. Nobody'sgoing to care about that. But I
thank you for calling three oh threeseven to one three talks seven one three,

(48:49):
to add. I guess he justwanted to get it off his chest.

what's going on? Let's talk,Deputy Doc and this oudy situation.
(49:57):
Leslie had called in about her AUDIand let's see, let me just summarize
this if I can. I thinkI can find this original call here.
And it was about a twenty twentyAudi, I believe, and it was
an A four and she said shehad to wait six months for a computer
(50:20):
model, and the dealer offered one, Am I getting this right? One
thousand dollars a month while the caris down and they paid for four months,
not for the six Was that it, Leslie? And a Niche?
Exactly. I'm actually shocked that yougot that much. I mean, is
this the dealer where you bought thecar? Yes, I have bought a
(50:44):
number of Audi stealer Yeah, butman, that is pretty aggressive to say
we're going to pay a thousand bucksa month. I mean think I think
it's fine. So anyway, doc, what happened? Well, Leslie,
why don't you tell him what happened? I spoke to to Imagine over there,
and his plottum line was, look, we gave her four thousand dollars.
(51:07):
We bent over backwards, that's all. She's gay and just sorry.
Yep. And he keeps saying thatyou can a movement up the ladder to
their attorneys, and I'm like, fine, because in writing they said that
they were going to pret wait,so you do, Leslie? You do
have this in writing? Yes,in writing for the time down waiting on
(51:34):
part. So when I talked toKeith, he was like, oh,
well, it was only downs forfour months? It was six months.
He knows that. I know that. He's oh wait, wait, wait,
but why but why would he saysuch an obvious error? Why would
he say four months if it wassix months? Why would he at one
(51:54):
point he said, well, wegot the module in earlier. I said,
I would have not contacted. Waita minute, was the car hold
on? Leslie? I'm not askingif you were contacted, because they could
always say they contacted you. Youcould say they didn't. Here's what I'm
asking. Was the car ready forpickup in four months? It was not?
(52:20):
Tom, Yes, you get thepark into the shop. So is
he saying once the part arrived, then the clock stopped. Right. But
if it but listen, well, even if it did arrive, Leslie,
it took them two months to putit in. But it Yeah, Doc,
(52:45):
Are they admitting that the car wasout of service for six months?
Yes? Then how can they denypaying her if it's in writing? Did
you see it in writing? Doc? I did not? In what form
of Leslie? I mean, I'vehad a lot of people tell me they
have things in writing, and theydon't tell me what form of writing was
(53:06):
it? I sent this into youand on the fourth page it said,
uh, this day, the mileageprovided car payments to guess for the time
down waiting on parts in writing onthis piece of the paper. Just read
(53:27):
it exactly the way it's written.Go ahead provided car payments to the guests
for the time down waiting on parts. And what was your car payment a
month? How much is your carpayment? It's like a thousand bucks a
month. And we actually backed downbecause when you include the insurance, which
(53:51):
is another couple underment, we agreedit one thousand dollars months. And when
I contacted them at four months, they hadn't gotten the party. Man,
it seems weird. It seems weird. It just seems weird they would go
all this way and just end uppissing you off anyway. I mean,
(54:13):
it just doesn't make sense to me. What's the name of the dealer.
It's Audi Denver, And I meanI have friends that weren't there, and
I've bought so many cars from them. I just want them to stand up
to what they agree to. AndI mean, first of all, let
me let me just explain this toeveryone. First of all, they've gone
(54:37):
far beyond any other dealer. I'veever heard of. Okay, I want
to make that one clear. Now, did they do what they promised?
No? But trust me, thereare not many people that would get four
grand because their car was waiting forparts. Now, I'm not saying you
should be satisfied, Mark, Whatwould you do if this was you?
Would you do the small claims court? If she has it in right now?
(55:00):
With that, I think, doyou think what she was see marcle
Markle grab onto that because of hesee his strategy is most of the time
these people don't want to fight itanyway, right, Well, in the
in this case, it's ridiculous ifthey actually said that and then they backed
out of it. Now, ifshe got the car back early or something,
(55:21):
we're not hearing, that's a totallydifferent deal. But man, if
they said we're going to do this, they need to do it, and
they're going to be That's That's whatI'm going by, and it's in writing,
and if it takes I want.I didn't drive a car for six
months. They told me the firsttime when they found it was broken,
(55:42):
that it wasn't safe for me toleave the dealership with my car, and
they set me off with a rentalcar. Which is fine. And then
at that point when they found outit was going to be multiple months,
they didn't know how long yet waitwait, wait, let me let Leslie.
I forgot this is a good pointduring that entire six months where you
(56:04):
provided a loaner, no, andthat my car sat and just waited for
the part because I didn't feel safedriving it. And I told them that
no, hold on, hold on, hold on, hold on, Leslie.
How long did they provide a loaner? Probably with a week? Okay,
(56:27):
okay, Leslie, here's here's anotherquestion. And I'm not asking if
you agree or not. I'm askingthis question. At any point during this
six months, did they say,you know, Leslie, it's taking longer
than we thought, or words likethis, your car was fine to drive
now until the park comes in,or did they make any mention at all
(56:49):
that you could probably drive your carbut they did after that first week when
Leslie, here's what I'm here,That's what I'm saying. Did they put
that in writing, and then afterthey put that in writing, told you
that the car does not have tosit. So my problem was is that
(57:17):
I almost kept getting Leslie. Leslie, I'm not asking you if you agree.
Here's what I'm asking. After theyput that in writing, did anyone
have second thoughts and say, youknow what, you can drive your car.
They said that once they found outthat the module wasn't going to be
(57:38):
in for Okay, I understand that. I'm just asking because here's why,
here's why. Here's I'm just goingto prepare you for their defense. They're
going to say that, yes, they agreed to pay you while the car
was down and then reconsidered because theyfound out from the service department that in
(58:06):
fact you could drive your car andyou refused to. I'm not arguing with
you, and I'm not asking youto agree with that, but trust me
when I tell you that will betheir defense understood. So be ready for
it, because I don't know whatyou're gonna say about it. If they
(58:28):
say, you know what, wewere going to do that while the car
was down, but our service departmentsaid, on second thought, she could
drive it and it posed no safetythreat. Now what reason did you not,
Leslie? I'm asking what reason didyou not want to drive it?
(58:52):
Because I kept almost getting an accidentevery time I backed up because I couldn't
seen there was no pau and thecars on the side of you and you're
in a parking lot. Okay,Leslie, people, Leslie this mark.
I don't know how you feel aboutthis mark, but I think this could
go either way because I'm not surenot having a backup cam is a reason
(59:16):
not to try it. But that'sI don't I disagree. Well, I
agree with you there, but Idisagree on the premise. It can go
either way. If they put inwriting, We're going to pay you this
amount of money per month until wildcarbackwhile the cars down, but then they're
gonna claim but tom It says thatthey would pay me the money while the
(59:39):
while the part, while they werewaiting on the part. Well, if
you want to split hairs, thenthat when they Then they're saying when they
received the part is when they stoppedpaying you. But well, how are
you going to prove when they gotthe part? How are you gonna do
(01:00:00):
that? Leslie? Are you sayingit took more than four months to get
the part? Yes, how areyou going to prove, Leslie? How
are you going to prove it?That's all I'm asking? How other than
when I called and they said itwasn't in yet, Well, I mean
(01:00:21):
what did they say it was inLook at I am just trying to explore
all possibilities. I'm trying to explore. Hold on, are you asking me
if people would lie? Are youreally asking me that. I'm saying,
if they would lie, then Ihave no case to go against them,
(01:00:44):
because you can't. I don't knowif they keep receipts on when parts were
there. Look, I think,no matter what, and I know you
don't want to hear this, butno matter what, I think you're four
thousand dollars ahead. I'm not tellingyou not to pursue this. As Mark
said, if they put anything likethat in writing, let a judge figure
(01:01:04):
it out. You know you havenothing to lose. I just think,
as I said, they went alot farther than any other dealer I know
of, And I'm not giving themkudos for it. I'm just saying,
worst case scenario is not that bad. Three oh three seven one three eight

here three oh three seven one threetalks seven one three eight two five five.
Deputy doc has another follow up doc? What is it? So,
Craig. Craig called up about hisparents, the Sigmunds, who having a
(01:02:12):
job done by Evolved Roofing and howlong ago was this bro It's gotten about
two weeks ago. Okay, EvolveRoofing and what happened? Well, this
is really interesting. He wasn't gettinganywhere. I left some messages and Craig
put up a bad review on oneof the sites. They called him said
(01:02:37):
we're doing the roofs. They wentover and did the roof and then they
were trying to get him to changethe rating. He gave them a one
star because of the issues, andthey got really upset and they were trying
to blackmail him into doing a fivestar review by telling him they were going
(01:02:57):
to sue him, and they hadno right to give him a bad review.
So what's really interesting, Tom,is that apparently these on on site
on the reviews really make a differenceto these companies. Oh they really do.
Yeah, the making is the root. Didn't he pay didn't they pay
twenty six grand up front? Yes? But he said the roof got done,
(01:03:22):
it was fine. You just gotto review saying that the customer service
was terrible and it took them allthis time, but it is it is
done right right, And I toldthem, look, as long as you
tell the truth, if there's nothingthey can do, well, hold on.
Now, let's let's clarify that.Yeah, they still can sue,
(01:03:43):
but the chances of success or nilare nil. But here's here's the problem.
I don't know if they would bothersuing. I mean, come on,
first and foremost, let me explainthis to people. What's the word
I'm thinking of? Take a guestmark. If they want to sue these
people for this review, well, what's the one thing they have to prove?
Of course we know they have toprove damages, So what the hell
(01:04:05):
are they going to say? Justbecause even if something is untrue unless there
are damages. As a business, you don't get to sue because your feelings
are hurt. You have to havea damage. That's something that people don't
understand. I once was sued bya giant snowmobile company and they sued me
(01:04:32):
because they said within minutes of thephone call they had people yelling and driving
by and saying terrible things. Andthis was in another state, and it
was where my show was tape delayed, which we proved that there was no
(01:04:53):
way within minutes of that phone callcould someone go by and do that because
it was tape delayed and wasn't untillater that night. So they were lying,
and that night they're closed. Notonly were they lying, but they
had no they could trace, notone sale, not one negative thing that
happened as a result. So whathappened. I won, and I got
(01:05:15):
attorneys fees under what's called anti slaplawsuits. And I'll explain that to people.
If you are sued like this personfor a review for exercising your freedom
and it is not malicious or false, and you are sued for it,
it's called a lawsuit against public somethingpublic interest, and then it's called a
(01:05:45):
slap lawsuit and that then there iswhat's called anti slap legislation. What anti
slap did, and this was aliberal thing. Okay, Liberals passed this
in California and then it spread aroundthe country called anti slap. What it
meant was it was a oh,I know what slap stood for a strategic
(01:06:09):
lawsuit against anyway public interest or something. It's just a slap. And so
they did not like corporations or peoplesuing others for freedom of speech. So
and this was long before COVID becausenow liberals don't want freedom of speech,
but they used to like it.And they put out rulings called anti slap
(01:06:34):
rulings, meaning if you sued someoneto try to shut them up and what
they were saying was true, youcould be sued for that, or if
someone sued you for it, youcould collect attorneys fees. So basically those
laws are still on the books thatyou can't sue someone for expressing their opinion.
(01:06:57):
Well you can, but then yourisk losing not only losing the lawsuit,
but you risk having to pay theother party's legal fees. And again
that was a good thing that cameout of freedom of speech fighting and battling
and crusading. But isn't that funnyhow things change? Because that was meant
(01:07:19):
to protect freedom of speech and expression, which now those same people are fighting
against. Isn't that weird how thingscan change. I'm Tom Martine Moore coming

(01:08:23):
Artigranite dot com says yeah, businessesman, that really means something. How
do you know it means something?I'm asking you, as a business owner,
do you get feedback from the feedback. I often wonder. I know
people put a lot of stock,a lot of business owners put a lot
of stock or a lot of emphasison positive reviews, but I wonder if
(01:08:45):
they have any feedback to justify thatwell. I think anymore, if you
need something, a service or ora product, you just look up a
company in your neighborhood are on aset of down and you just look up
their reviews and the rating, andif it's cool, you go. Then
but one or two bad ratings,I can pick out the ones who are
just malcontents if they have a bunchof good ones. Where it really is
(01:09:09):
suspect is where there are a lotof bad ones, and then you hear
a few great ones, the thethe extreme or the other way around.
You know, the extreme company thathas you know, a thousand and five
star reviews and one Yeah, that'swhat I mean. Why would you care?
No, I'm serious. If youhad all these great reviews and then
(01:09:30):
you had you get a bad one. I think one of the worst things
you can have is milk toast themiddle. Oh yes, yeah, I
think if I see a guy witha bunch of great ratings or a business,
I mean, and then I seea couple of bad ratings, I
don't care. If I see aguy with a bunch of bad ones and
just a few good ones, Ido care, and I won't use them.
If I see a lot of mediocrereviews, I'm not sure i'll use
(01:09:55):
them. So But but anyway, have you ever had anyone call you,
though, Mitch and say, becauseof your great reviews they picked you.
No. Generally people see the goodreviews we have and they just call.
Of course, it's only all,but they don't actually mention it. Do
they ever mention it? A lotof times they mentioned that we have great
(01:10:16):
reviews and gred reputation and that's whythey want to work. Now. I
know, once in a while overthe years, you've had a couple of
people are very difficult. I meanI know thatuction. Yeah, of course,
and I know and we've been throughthem, and there's I've never found
a problem with you. I'm goingto be straight. But when you do
get one of those, what dopeople ever mention it to you? Do
(01:10:40):
people ever say, you know,Mitch, I've seen you got a lot
of great reviews, but what aboutthis one person? Did they ever ask
you about it? Once in awhile they will bring that out there.
That's good because you want to beable to explain explain what they were exactly,
and I think that's a good thing. So reviews are popular, But
there's another trend in reviews. Iwant to talk about. Come up,

Shannon took off and we got theDragon Dragon. I need your I need
your help on this show. Allright. There's one thing, and only
one thing that Brownie does better thanme. Only one thing, and change
light bulbs. And Brownie doesn't actuallydo it better. You do it better,
(01:12:40):
and that is I. Since Ihave a bunch of morons and YouTube
morons, but I have also abunch of listeners who are pretty creative.
What I'd like to do is Ilike to have more feedback on that that
audio feedback talk. So it's onthe iHeartRadio app. And it's obvious,
(01:13:04):
right, it's a button. We'venot used it a lot, But why
don't you explain to my moronic listenershow they do it. Yeah, when
you're listening to us on the iHeartapp, you'll see there's a little red
microphone button near the top, andyou just give a click on that.
You've got thirty seconds to leave aquick little voicemail, or as we refer
them to as a talkback and youcan say what you want about whatever you
(01:13:26):
want, and I'll get it withinseconds once you hit a post, and
then we can play it on theair if it's worth it. I really
do, I really do want tostart trying to get more of that,
because sometimes people they don't want tostand hold, but they want to make
a quick comment. They might bean expert even or they might want to
say something and Mark, I don'tknow if you've heard Brownie, but they
make really good use of this talkback. Really. In fact, I think
(01:13:48):
they're the only show, are youguys, the only show that really makes
such use of it, the onlyones I know of. We're definitely the
biggest, the show in the biggestshow in the cluster that deals with them,
so not many other people play withthem so much. I would recommend
for any of the Tom Martino moronsthat it would be more for like a
(01:14:08):
comment and not for any anybody thathas no, no, not if you
have a real long problem. Wellyou know, I took my car in
and then it went like that, and then it went like that. No,
no, you want to make acomment like tell her to do this,
tell him to do that. Ican do this. I did this
absolutely perfect? Or Tom, whyis Mark sounding so ridiculous? Stuff like
(01:14:29):
that? You can leave feedback andyou know so, and if you want
to do that that you don't callanywhere to do that. You just go
to the iHeartRadio app or we're onand hit that red microphone button. So
let well, I do want toexperiment more and more with that, So
keep me aware of that dragon whenpeople come in and we'll see I really
(01:14:51):
mean it. I love how peopleparticipate with Brownie in the morning on that,
especially on the opening of the shows, and it's kind of cool.
And yeah, we have a lotof fun with it. We can do
that here too. Yeah. Anyway, so anytime any kind of feedback at
all, people, let's experiment withthat. Now, let's talk to Dave,
(01:15:13):
and Dave has a problem with Ibelieve and I watch now is that
the are we talking about the smartwatch by Apple? Correct? What's going
on? Dave? Well, aboutfive months ago they had a software update
and I watched quit working. Waitdid it take the update or did it
not take the update? It didnot, So in other words, it
(01:15:38):
was never updated or it bricked whileit was being updated. What happened?
They did the software update. Afterthat, it wouldn't function. Okay,
so it took an update and stoppedworking. Yes, went to T Mobile.
T Mobile said you have to goto the Apple store. So well,
of course, the Apple store andLittleton said, you need a new
(01:16:01):
phone, may be happy to sellyou a new phone. I'm still paying
for it. I mean, wait, wait, a new phone? You
said the I watched I watch.I'm sorry, yeah, I'm sorry.
Okay, So now why did theysay you need a new one? How
old is that one? About ayear and a half. It was out
of warranty. Well, it mightbe out a warranty. But can't they
(01:16:25):
figure out what's wrong with it?They? It's the store, they and
how did it stop working? Well, let me let me ask you.
Does it does it come on atall? Or does it? Is it
what we call bricked? It's nothing? Yeah, let me go get it.
(01:16:47):
I mean, is it totally blackand done? Can you charge it?
Yes? I can charge it.Does it do everything but not connect?
It just simply won't connect to yourphone? No, it's just won't
do anything. I mean, doesit tell? Does it tell the time?
(01:17:09):
Or is it just black? No? It's is it black? It's
charging right now. Well, theletters come up. They're huge. They're
huge. I mean, like youknow, like the face of the watch.
You can't see the face of thewatch because the seven or the six
is just huge. Okay, it'sstuck in the zoom mode. It's stuck
(01:17:31):
in the zoom mode. No,no, yeah, whatever, Well,
I know that happened. I've hadthat, not to a smart watch.
I had it happen to my cellphone. And it happens sometimes during an
update if you touch it in thewrong way. Sometimes things zoom when you
touch them in the wrong way orin the right way. But here's the
deal. You got to figure outhow to undo that now, Now,
(01:17:53):
I'm serious. When I had itdone with my cell phone, there was
a specific sequence I had to doto get it to reboot. I just
can't believe the Genius bar would noteven impart information. Did you actually make
an appointment at Apple Store? Yeah. I went in there and showed them
(01:18:15):
what was going on. I said, you need a new I Watch.
Okay, that is ridiculous. Iknow, come on, I'm paying for
it and I haven't used it forthe last five months. I'm still paying
for it, and well that's nottheir fault. I mean, if it's
out of warranty, what else isgoing to happen? I mean, come
on, it's out of warranty.Man, Well I know that mark,
but come on, I mean, even if something's out of warranty, they
(01:18:39):
have to have seen problems like thisbefore. Okay, So here's what I'm
doing. I'm writing on the Applesite to see what comes up on the
search because well, no, I'vedone that before. Okay, Now have
(01:19:01):
you tried Okay, this is notuncommon. This is what's good. It's
caught. It's probably caught in thezoom mode and it was activated accidentally during
an update, and you can there'sa whole bunch of instructions. Have you
just tried a simple double tap withyour two fingers on the face. I'm
(01:19:30):
doing that now, just try it, and then the other one is pressing
whatever this means, I don't haveone of these pressing the digital crown quickly
three times on two crown yeah whatever, it says, press and hold both
side buttons. You got the digitalcrown until the screen turns black. Yeah.
(01:19:57):
If you you know what if yougoogle this? Yeah, but we're
forgetting he brought it into an Applestore and they said, mind to buy
a new one mark That doesn't matter. I've had things happen before where they
where the Apple store will not takethe time to go through it, and
they don't. You know, it'sthey're a genius bar meaning a genius in
(01:20:19):
selling stuff. They're not a geniusat fixing stuff necessarily. Now, I
should be fair. There were timeswhen there were certain updates happened with a
with a laptop that Stephanie's laptop. They took it and they were able to
fix it. But let's get Ited on to see if he has heard
(01:20:41):
about this. But did you trytoggling the zoom off and on like with
the way we said, and thendid you restart the whole watch? They're
still charging? Tom, Well, when it's not charging, try those things
double tap and then and then alsotry to on three times you you touch
(01:21:06):
the bezel three times quickly or whatthey call wait wait, wait, I
bet it's right here. Okay whatseries watch? Is it to A three
four? Well, it doesn't matterif it's a it's a three four or
five. I assume right. Itsays here if you want it to work
(01:21:29):
again and it's not working get ahammer. Do you have a hammer close
to you? Stop? Never mind, get a hammer, and then head
over to the Samsung store and buya real watch. You know what,
Let me see if Ted's around.I don't I want to see if he's
heard of this. And three Hthree seven one three talk seven one three
(01:21:55):
eight two five five. Let mejust see if Ted's around, and then
we'll be listening, okay, andthen try those other things. But here's
what I want you to do.If you have artificial intelligence like bing,
if you have copilot. I don'tgoogle anything anymore. But what I put
in I also put this in there. My I watch is took an update
(01:22:16):
and got stuck in a zoom modeanything like that. They come up with
procedures and answers. Again, Idon't, I don't know how I can
live without these this uh this stuffanymore. I love AI for certain things.
That is three L three seven toone three talk three L three seven
one three eight two five five. And by the way, mine is politically
(01:22:36):
incorrect. Dragon. You told meone time that there were some of these
AI image generators that were quite wokeand correct about generating images of past presidents,
and Washington was black. Yeah,And so you asked it to generate
(01:22:57):
certain images and they would come backAsian or black or Hispanic and not accurate.
And mine is just the opposite.Everything I ask for on an image
comes it comes as a middle aged, good looking white man everything if I
ask for, for example, I'mputting together some flash cards for something,
(01:23:19):
and I ask for a happy investoror a concerned investor, or an auto
mechanic, or an airline pilot,or even a server or a restaurant owner.
And so I'm putting I'm putting togethersome consumer presentations, and I'm asking
for technicians and different images. Youknow, I used to go out and
(01:23:41):
just buy images. Now you don'thave to. You just generate your own.
And I can't believe every single imageI've gotten, every one of them,
has been a middle aged, goodlooking white man. Maybe that's because
of me, I don't know,But do you get that, well,
what part of that description do youfit? I'm saying it's not middle aged,
(01:24:05):
cook, I it ain't good looking. It's because of who I am.
I am a white male. MaybeI don't you would think if it
was, you know, trying tosh mar shut up. You don't even
want to know who it looks likewhen I put in a hole. Look,
we'll pay dragon. Did we getany of that talkback? I was

don't think I ever seen such anold guy in my life when I was

right, Yeah, anyway, that'scorrect. So we're we're for you're just
tuning in. We did this,Uh. I wanted to start mimicking Brownie
(01:26:25):
Show, where they use this talkbacka lot. They do a really good
job, and Dragon works that show. So I asked them to let's do
it, and so I got acouple good more couple good more talkbacks.
If you want to go from here, yeah, well go ahead, Yeah,
let's hear something. Well, Martine, is this Bert near back time?
You start using them talkbacks. Oh, that's the usual. That's a
(01:26:46):
that's a talkbacker that normally does theBrownie Show. So if he's a good
guy, we like him. Andthen there's one more. I like this
one too, Dragon Redbeard is thegreatest radio producer in the history of radio.
We love you. Dragon said thatwith Shannon his uncle. Anyway,
(01:27:06):
anyway, Okay, we got MitchFleuriro with us from the Art of Granite,
and we were talking about a lotof stuff. Free materials Mark for
that and it's really cool stuff.Mitch he's doing people. I didn't get
to say this before, but Mitchis actually doing our master bath. Suzanne
went and picked out the uh.I always want to say marble, but
(01:27:29):
it's not marble. What is it? Courts. It's the courts, the
engineers. It's gonna look gorgeous. We're gonna surround the whole tub Tom in
courts. Oh man, that's beautiful. Now when it comes to have you
ever had people when you're doing akitchen or doing a job they say,
hey, Mitch, look at thisbuilt. Did they have these cubbies and
(01:27:50):
walls? I've seen them? Andthen the bottom of it instead of drywall.
They want to put a piece ofgranite there. Have you ever done
those? You know what I meanby these art what do they call coves
or cutouts in walls? You knowwhere they are they either have artwork that's
lit up or they have a likegulp shirt. You a wall, yeah,
a wall exactly. Can extell littleshelves in the niche, Yeah,
(01:28:12):
that's on those seals. And yes, we do a lot of that because
every time we have slaps assigned fora project, we end up with,
you know, small pieces here andthere, and you can cut them and
put them in it elsewhere in thehouse to match. Yes, so in
a kitchen for example, if you'redoing if you did the counter in a
backsplash or whatever, and you havesome left, you could do some window
sills in the kitchen. Yes.And wall caps. We wanted the wall
(01:28:36):
caps, just like if you havelike a pony wall or like a half
high wall. Oh yeah, yeah, yeah, just a cap on the
wall. Not necessarily a bar,but a cap or like at the entry
away. Sometimes we would cut youknow, these long, skinny pieces and
just set them on top and thatlooks really pretty. Oh. Yes,
so when you walk in sometimes thosehalf walls you have are basically hip walls
(01:28:58):
and there's just dry wall on top. Yeah yeah, yeah, just put
these caps on and maybe a littlebit wider than the walls and you can
set you know, plants or ours. I love that idea. So this
is where remnants would come in perfectly. And of course, if I have
a small one and I just wantto buy or or get the get the
free remnant and have you fabricate it. Can I just pick it up and
(01:29:19):
install it. If it's just asmall piece, we'll cut it and polish
it for you and then I'll pickit up and I can because I have
some. I actually have some. The more that I think about this now,
at the top of the stairs, have this wall where I hate it.
It's painted. It's just stupid becausehere's why you put stuff on there.
And when it's painted, I don'tknow why, but paint it is
(01:29:41):
after a while that the thing onit, the sculpture stuff, digs into
it a little and it kind ofgets stuck. I don't know if that
makes sense to you. But youdon't want to keep constantly cleaning and repainting
the data, Yes, and ifthese species are not very large home on
to pick them up and then toinstall it on something like that, you
just glue it down, just glued, just cacking liquid, which is are
not that thick right, How thickwould that be for a wall cap?
(01:30:04):
Three quarter three cord inch and aquarter We have the different thicknesses. This
is a great idea. See,people, you can actually get free free
pieces and just pay for that fabrication. And if it's small, like an
art niche or a wall cap orsomething a small piece or a windowsill,
you can just measure that and doit. Well. Actually, if I
(01:30:26):
wanted you, guys, like ona windowsill where it's a little more complicated,
would you do a small job?I mean we'll pay you pay for
that fabrication, that installation, butyou would do even a small job,
right, we would? And thisis small pieces even if they're in between
walls and walls are not always straight. And yeah, that's where you need
more professionals. Yes, yeah, even if it's a small project. We
(01:30:46):
go out, we take our measurementsand then and then install it. Yes,
Mitch, I got to ask this. I don't know why I got
to ask it, but I alwaysask people in the business what's the most
unusual place you've put granted? Havethere ever been any weird places you put
granit in? I know that Ihad granted one time before I knew you,
(01:31:09):
I had to put in a garage. And the reason I did is
because it was such a good dealback then that I just had the workshop.
I swear to God, I hadit done in granted. I mean,
have you ever had people do itin their garage? My God,
No, Mark, Mark, Itwasn't extravagant. I swear to you it
(01:31:30):
was. It was a deal.I think it was Courtney over at Buy
and Build had some remnants and thiswas like twenty years ago, and he
had some remnants, and I wasbuying some cabinets from him for the garage.
And again I bought him from himbecause these cabinets were literally cheaper than
buying the damn ironclad and metal cabinetsat home depot. And I bought these
(01:31:53):
cabinets and he says, you know, we can put granite on top of
that. And so have you everdone garages? Not very much? Well,
you got to get a class yourclientele, man, Okay, So
they maybe closets. We I don'tknow if we installed in closets before.
Maybe now I want to know iffloors ever granite floors for a landing or
(01:32:14):
something, or how about a shower. It's all floors. It's it's slippery,
so they're not They're not a goodidea for floors. They're too slippery,
right, Yes, yeah, Iguess you get that caress or the
leather it finish. But I don'tlike a shower. Yeah, we installing
showers. Yeah. We start iton the walls, so people you do
showers for people that need the walls. Yes, yes, some people don't
(01:32:34):
like the idea of having groud lines, and so we would just do slabs
on the walls and not just granite. But we do this either the courts
or now we can install these thinnerporcelain slabs porcelain slash. Yeah, those
are absolutely beautiful size. What colordoes there's all sorts? Yes? Are
(01:32:55):
they veined or are they just flat? Beautiful solid? You find everything nowadays
a lot of could you tell me, because I'm stupid here when it comes
to porcelain, What is it?What is porcelain? Is it a natural
stone? No, it's an engineerstone. Yes. So it was around
way before quartzite or quartz. Butit wasn't manufacturing in a form of large
slabs. It wasn't. No,it wasn't. So now now the suppliers
(01:33:18):
would would carry the very large tenten foot beautiful, aren't they? Are
they expensive? It's porcelain expensive.Fabrication can be a little bit more expensive,
but the product itself, it's notnecessarily more than granite or quartz.
But they work very well for wallapplications. Is it popular right now?
Portionly it's more popular yes, yeh? And what mainly for? For what?
(01:33:42):
For walls? I recommend it forwalls, not as much. For
countertops. It needs to be mitherthan the edges need to be thickened.
For that I recommend courts or graniteor quartzite. But for walls, in
shower walls, porcelain is a greatHave they ever done porcelain backsplashes? Yes?
Yeah, that must be pretty. And you can get a lot of
(01:34:03):
different colors in porcelain. Oh,there's an abundance of choices. No.
Yes, And on a hardness scale, is it pretty hardy? It's very
very hard and it's heat proof.Oh. Interesting. So on a porcelain
versus, let's say a quartz. They're both engineered, right, yes,
okay, So on these two, what would be heardier? What's stronger?
(01:34:28):
Well, they're both. I'd saythey're just as hard as the porcelain's heat
proof. Quartz is a heat resistantbut not proof. So you can if
you said something very very hot ona quartz lab he may burn, he
may leave, really okay, okay, and you can't burn granite at all,
can you? No? No?And okay? Three o three seven

talk back. By the way,go to the Ihart radio app press the
red micro we get you on theair, Mitch. Do you do a
concrete I think you one time yousaid no, no, we don't fabricate
contr That's the only thing you don'tdo, right. We also don't fabricate
lemonade like that for Mica. Well, of course not. That's like crap.
Yeah, but no, we don't. We don't. We don't fabricate
(01:36:19):
concrete. Do you remember the oldKorean we used to call it. It
was the it was the shizzness atthe time everyone wanted Korean. Well that
was the next step up from thelemonade from the four Mica back in the
day. Yes, does anyone doIs there anything like a Korean anymore?
Nah? No? Some some ofthe courts speckled colors look somehow like the
(01:36:42):
four. Now this is something Ireally want to know about. By the
way, our number three oh threeseven one three talk three oh three seven
one three eight two five five andthe talk box red microphone. We crashed
the server. So many people aretrying to get through. So if you
tried to do it, do itagain the iHeartRadio app. If you were
rejected for some reason and then youhit the microphone, but call us now
(01:37:04):
too. Three all three seven onethree eight two five five. I wanted
to ask something about quartz and quartzsite. There is a difference. Oh,
there's a big difference. Now whatis quartz is manufactured and it's perfect
right, It's like one solid colorwhatever. So we call it courts,
but I like to refer to itas engineer stone or a man made so
(01:37:27):
that the voice confusion the natural orthe quartz site. The natural quartz site
slabs are corried from the mountains, just like the granite the marble. And
what do they look like? Dothey look like quartz or do they look
more uneven? The natural quartzite slabsare really pretty. They're very they're they're
lighter than granite, a lot ofveining, a lot of pattern, very
(01:37:50):
nice flow, and those colors aretrending right now. So natural quartz site
is it is it more expense generallycan be a little more expensive than granite,
although not all the designs are,you know, very expensive now,
(01:38:11):
but but so, oh, Isee it looks somewhat like it. Could
you could almost think it's granited.Yes, yeah, it looks like marble,
but it's a lot harder. It'sharder. So marble is soft?
Is there a limestone or is thatnot? That's not a counter it is
but not No, it's not veryNo, it's not common because of how
soft it is. And again ifyou're now now, now, can you
(01:38:38):
order or can people order like walls, wallplates, wall switches, switch cover
switch plates, I think they callthem if they wanted to match or do
you make those? We don't makethem. I think there's somebody out there
that would maybe paint them so theyblend the okay, needs to be more
popular. But yeah, there issuch thing we can install backsplash and then
(01:39:00):
and some of these quartzite slabs I'mlooking at are really beautiful. But so
the reason people go with the quartzor the engineered stone is to get that
uniform color, right, yes, yeah, and then they also are covered
by the manufacturer's warranty and that's somehowor relief to homeowners. You know,
when you invest so much, youknow you get this, you know ten
(01:39:20):
fifteen or maybe even lifetime warranty onsome manufacturers. Then you know you feel
better about your investment, your remodel. So if something goes wrong with them,
like a crack or a scratch, then you know the manufacturer will fix
that. Someone wants to know ontext, can you redo your countertops?
(01:39:43):
Like? I don't know what theymean by that. I think they mean
do you sand and finish granite?Like, like, I know granite,
somehe granite gets old looking. Idon't know what happens to it. Is
there a coating that comes off orthe shine? What happens to granted anything?
Well, we steal the and whenwe installed we still all so that
sealer does last a long time,but that stella doesn't. It's not a
(01:40:05):
code that we apply, and thatthat that seiler is just the liquid.
It eventually evaporates, part of itpenetrates in a stonech. It protects it
and you can redo it. Youcan reapply the seiler, but that does
not redo the shine to polish granite, So it doesn't when you reseal it
won't bring the shine pack. Sometimes, you know, customers will reach out
(01:40:27):
and say, hey, I noticedyou know it's dull. Can you reseal
it? Well, the seiler doesnot redo the shine, so can you
do that in place? Though, very very difficult and it's messy, right,
yeah, it's very messy, butit's it's next to impossible to redo
the shine as uniform as you was, you know, in the fact effect,
like when you're playing. Okay,so if it's dull and flat,
(01:40:50):
can you just make it all thenflat to match? Is that? Does
that make sense? That takes polishing. Oh so that's hard to Yes,
it's difficult on site to polish surface. Now. I know someone who did
not like shine and they had yearsago their counters all buffed out or something
(01:41:13):
to where they took the shine downand they were all made flat, and
I think they look terrible. Butalso I noticed that if you look closely
at it, they spot they do. Yeah, so there's besides all the
polished then glossy slabs. Now youcan choose a home surface or a leathered
surface, but the home materials likethe flat colors. What some homeowners like
(01:41:38):
about it that they don't have theglare, right right, they don't want
the glare. They don't want toflat without the glare. Can it still
be sealed though, so it doesn'tspot it does, yes, yeah,
we seal it. However, it'sharder to clean and it leaves marks and
cuffs. Yes, yes, Inoticed that. In fact, it leaves
a lot of marks. And soif you so, So, if you
(01:42:00):
have a flat surface and it's andit's dull on purpose, can you can
that be treated on site and buffedout a little or not? Well,
yeah, we can give it abetter vesset on clean all the you know,
grease and marks and reasons. That'swhat I mean. Okay, you
can take out those little spots. That's okay, And that's not as hard
(01:42:20):
as it. So it's more cleaning, like deep cleaning more than polishing.
Right, and then you apply, now I see what you're saying, a
coat of sealer and then that seiler. The new seiler will prevent it from
spotting, yes, from staining fromspotting. Now the leather finish I like
a lot. Oh yes, yeah, it's it's a favorite. Yeah,
it's beautiful. And it's not shiny, is it? It's not as shiny?
(01:42:42):
No, but it's not flat. It's kind of this nice in between.
Yes. Yeah, and it's gotthe texture feel. Yeah, looks
very it looks more like a naturalstorm. No. I think it's absolutely
beautiful. Now someone wants to know. Can you actually apply? You can't
do it. Once it's installed. You have to get it like that.
Yeah, once it's installed, it'sit's not possible to leather the surface.
But if you find the slab.If you visit our store and you find
(01:43:05):
the slab and say, Mitch,I like this lab, but it's polished,
can you leather it? Yes,we can leather the slab and then
we fabricate it. All right. We got more coming up on the Troubleshooter

(01:43:57):
Can you ask much what to doabout pits in my granite countertop? It's
very rough and scratchy. Can thatbe sealed? Thank you? That's a
good question, Mitch. What doyou do about that? How does that
develop over time? Well, ifthere's some slabs are more pores than others,
(01:44:18):
and if those pores are bigger, like you know, little pits,
they don't get bigger, do they? No, No, they shouldn't.
So we can fill them with thisepoxy glue. There's this penetrating epoxy that
that we apply and then we buffthe acess off and we reapply a coat
of seiler and it blends. Yeah, they they will blend. We we
(01:44:40):
mix color coordinated you know at POxy, Yeah, you know, to match
the slab. Then it depends onthe color of the slabs of the If
there's if the slabs have a lotof coloring and veining and movement, that
we can blend them in a littlebit more than if the colors are just
you know, a uniform. No, no, I hate answers, but
I have to on a practical standpoint. If you guys are busy doing countertops

and stuff, do you have arepair or service division? We don't have

the phone, and we're gonna goto him right now. Jack call,
what's going on? Or I hopeI'm pronouncing that right, but anykay,
Jock al what's happening? Okay,So I've got I've been using AT and
T for the longest time for phoneservice. And internet whatever. And it's
(01:47:39):
been the last fifteen months. Theinternet service got lots of but all around
where I live where it's like,I'm I'm not connecting. I'm in the
dead zone. And it's and it'sonly been recent that this has been happening
with your internet only. Yes,like fifteen months ago, I would go
(01:48:00):
outside in my house walk the dog. I could be listening to your show
streaming it since last year February oflast year, I walked twenty feet from
my house. I'm in the deadzone. I work half a mile I
reconnect and there's a lot of spotsor I live in Cassarrock, all around
Castle Rock, and it's just drivingme nuts. And I'm mind, what
(01:48:20):
do they say about it? Dothey when you ask about it? What
do they say? I asked themif they changed with their five g's or
whatever, and if I know, they haven't changed nothing. And the only
thing they said to get a newphone. So wait a minute, So
you have your phone and your service, So what kind of phone? Though?
(01:48:41):
It's an iPhone? Okay? Andwhat model? Well, my model,
but like I said, it's wehave in the family, were four,
so I got a ten. Mydaughters, and my wife's got a
twelve and that other daughter's got atouch in and they're all and are they
all the same? Yuh? Now, how is the internet connection at your
(01:49:03):
house? Well, at my house, I use like I said, I'm
connecting to uh, I've got Exfinitysigns. Okay, never mind, So
that that's a bad that's a badcomparison because at home you're connected, okay,
and it's only when you're on yourcellular service for data. Yeah.
Yeah, I go to Crystal Valley, there's spots in Crystal val there's no
(01:49:25):
connection. I go into the metals, there's Now are you going to areas
jack Halla? Are you going toareas that were previously good? Yeah?
It's like I said, it startedfifteen months ago. There must be something
there really must be. There mustbe something that changed, because you sound
like you really take you know thatyou really are noting this, and you
(01:49:47):
you keep talking about about fifteen monthsago, so you must have noticed it
right away. But pretty much likeI said, on one one day,
I'm walking to dog as, I'mlistening to the to whatever or streaming shows
on while I'm walking around my house, and then suddenly I walk wheny fit
(01:50:08):
from my house, boom, Igot nothing, and then if I drove
half a mile, I reconnect.Okay, so what obviously you've called them,
what do they say? Nothing?Right, nothing, nothing they said,
they haven't changed nothing to the service. And the only thing that they
said that you show up great towhatever iPhone fifteen or the latest moment.
I'm not, well, it's happeningon the twelve, on the thirteenth.
(01:50:30):
What and it's not listen and it'snot just in your area. You're saying,
it's elsewhere in the metro area too. Well, I'm mostly around Castle
Rock, but if I'm downtown CastleRock, right across from the town hall,
I get no reception. I walkfive blocks on each side of it.
I reconnect. I'm in the meadle, there's a spot, there's two
(01:50:55):
spots in the middle. There's it'sbeads on in founder same way in Crystal
Valley some way. So I'm andI'm like I said before, fifteen months
ago, it was no problem. So I'm not sure if switching to a
different company will do anything else. And I'm the few people that I know
they all use a T and T, so I'm not sure how to go
(01:51:17):
about huh, I just don't.I'm trying to figure out why this would
happen about fifteen months ago in thatsouthern area and if anyone else is experiencing
it. What I'm gonna do isask if anyone else is experiencing this kind
of thing, because if this isthe place to call, because people would
(01:51:41):
be noting it and saying, yeah, yeah, this has happened to me
too. And then Kachina, dowe have any contacts over at AT and
T? I know we have CenturyLink and some others. Do we have
anyone at AT and T? Youknow, sus would know better than I
knew that. I know that weused to, but I'm not sure if
that person is still available anymore.Okay, same thing with Verizon. I
(01:52:05):
think that was it, But Imean we can try. Okay, let's
just see what we can find outfrom AT and T and then what we'll
do is also ask people if they'veexperienced anything like that and see what happens.
I don't know, man, I'mI'm doing a search for a deep
(01:52:27):
search right now as far as cellservices, and what I find here is
that, let's see, there arethings going on and one of the things
is this They have been doing someupgrades to sell towers and that's the only
(01:52:48):
thing I could see. What didyou mention about five G? Do you
know anything specifically? You know,it's just I had heard one time that
was Mark saying that they were whenthey switched to five G. Maybe there
was a problem happening at that time, And so I asked them and they
(01:53:08):
were saying no. The only thingthey say that there's a lot of construction
going on around town, and they'resaying that sometime consistion blocks signal or something.
That's the only thing. Yeah, that would be only if they built
stuff up. It doesn't make senseto me. If anything, cell service
is getting better everywhere they're putting upthese I don't know if you saw these
(01:53:31):
these new mini mini towers. Imean they're like street lights. They are
something. In fact, some ofthem are only about six feet tall.
They're just little posts they put onthe side of the street. I mean
they're you hardly notice them. They'redark green. And but I'm gonna wait
to hear is to see we hearfrom anyone three oh three seven to one
three talk seven one three, Atwo five five or people you can call
(01:53:56):
three oh three Martino as well.Three oh three two seven, eight,
four six six. Let's find outif anyone else is having this Now,
I'm also inviting people. You cando a talk back with any kind of
comments, any kind, no complaints, no normal questions, well, I
mean short question, yes, butno problems. And then you can go
to the talk back at iHeart Radioapp and then hit the red microphone when
(01:54:21):
you're listening to my show and that'llput you right through. We were experimenting
trying to get as active in thatas as Brownie is. Now, speaking
of cells, let's talk about possiblescams with texts going on. Go on,
Troy, what's happening? Hi,mister Martino. A longtime listener,
(01:54:43):
Thank you, Troy, true fanof yours. Call out A native.
I've been listening to you my wholelife so well, thank you recently.
Yeah, thanks for all you do. Today I received a strange text message
and it was actually addressed to mywife and it said to prevent any future
confidential text messages are embarrassing emails,to please contact this number. But what
(01:55:11):
did it actually say? Read it? Can you read it to me?
Yes? It says this is SarahLevine, and I've just been assigned your
mediation file in my office. Lisa. At this time, I want to
avoid sending any embarrassing or confidential informationvia text message. Please contact me as
soon as Okay, Okay, itsounds like a collector to me or something
(01:55:35):
like that. Yeah, what Icalled. I tried to ask additional information
and they said the loan was froma payday loan from twenty fourteen. I
spoke to my wife, Well, hold on if it is a payday loan
from twenty fourteen, and they didnot get a judgment, it's over.
(01:55:58):
They can't collect on that. Well, actually, actually they can collect on
it, but they can't get ajudgment after six years. That's the statute
of limitations in Colorado. So arethey saying they have a judgment? What
are they actually saying about it?They said they were going to pursue a
garnishment. Well they're not going tounless they have a judgment. So does
(01:56:24):
your wife recall anything about this? Were you married to her then? Yeah,
we were, and we weren't infinancial situations where were we are obtaining
payday loans? And she has noREQ so you never she never got a
payday loan. No, Okay, listen, there are a couple things going
(01:56:45):
on here, Okay, maybe morethan a couple. First and foremost,
the most common thing is they havethe wrong number or name. Are they
addressing her by name? I thinkher by name, but the number that
they text me to is a numberI've only had since twenty roughly twenty eighteen.
(01:57:11):
Then that sounds like a scam. Then it sounds like a scam.
So number one, it could bea mistake. Number you look the wrong
number. Number two it could bethat they are simply fishing. They're trying
to threaten and intimidate. And thenthe next one is that your wife did
(01:57:31):
have something you guys forgot about, and there could be an out a judgment,
but I doubt it. You wouldprobably have some inkling unless you're totally,
you know, totally disorganized in yourstuff. Normally you'll have some inkling
of what's going on. But manytimes the only thing you can do is
block it and be done with it. And the only way anyone can do
(01:57:56):
garnishment or anything, no matter what, is to number one, take you
to court. Number two get ajudgment in their favor. So just keep
an eye out for summons. There'sno other way they can do anything to
you. And then once there isa summons, then you have the right
to know exactly time, date, matter when, what was it for and
all of that. Okay, Soreally there's nothing to worry about at this
(01:58:20):
point. Just leave it the wayit is now, hold on a sec.
I have a lot of comments onthis issue with UH with cell service.
I want to get to but Ihave to take this first. I'm
Tom Martinez. We have more comingright up. Go with a sure thing

Hi Tom Martina here three three sevenone three talks seven one three eight two
five five. So Rich has acomment on cell service, Go ahead,
Rich, what's going on? SoTom, here's the story is. I
(01:59:30):
dropped my iPhone fourteen a couple times. The back crack because the black is
made out of glass right around thecamera off. So I wanted to get
a different phone. It didn't affectthe service of the phone, but anyway,
so they told me that, yeah, you can get an eight hundred
dollar credit on This was a Verizonand they told me you can get an
(01:59:54):
eight hundred dollar credit on a newphone to trade dollen in and no conditions.
Well, that's fine. So helooked on the bill when it came
a month or so later, andI only got a four hundred dollar credit.
I called him back and said, what gives Well, you have to
have the premium service. You hadto upgrade to the premium service in order
(02:00:15):
to get the eight hundred dollars.Oh, so what happens with What happens
if I don't have the premium service? Well, and this is what Verizon
told me, We throttle you andwe restrict you during certain times of the
day for data. Don't have thefree for data. Yep, I heard
(02:00:36):
that before. Now a lot ofbarriers are starting to do that. I
got the premium, I got thepremium service. So it's a real thing
because I can sit there in thehouse on even on Wi Fi. I've
noticed it and the wife, thewife's bone will spin and not go anywhere.
(02:00:57):
But now that I have the premium, I can do anything any time.
So that's just one thing one ofmy comments. You know what that
is? That is really something thatcould be happening. They could have maybe
changed the plans. You're right, they do. They they are starting to
do that. It's it's called throddling. And because I'll tell you why,
(02:01:20):
because they're getting to capacities where theyhave to charge for the faster service and
they want to encourage people to paymore money. But thank you for that,
Rich. I mean, I don'tknow if that could be happening with
Mike. Maybe he missed a maileror two, or in with the bills,
or if you go online you seesome notices that from now on,
uh, you know, they're gonnahave legacy plans or they're gonna have upgrades
(02:01:43):
or different things. I don't knowif that's the case. It could be.
Now let's talk speaking of phones,Mike, what's going on with you?
Mike? Welcome to the show.Ut you know, just to confirm,
I'm having problems with my small phoneup here in a communist sarvaga for
about or four weeks. Now Iget this slash of no connection. I'll
(02:02:08):
be called the bank or something. Now this is recent, all of a
sudden, that started happening. Yeah, last few weeks. You know,
it's not the greatest reception here anyway. I got to go to certain places
in my house. Uh, youknow what, I make a call.
You know, I can get ashot at the tower. But here the
last few weeks, it's it's kindof ridiculous anyway to confirm, as with
(02:02:34):
miss Jackal you are talking to,yeah, have the problems and yeah once
you know, I'm starting to haveproblems there too. But anyway, I
guess it's the towers. Like yousay, well, if there's all kinds
of problems going on, but usually, I mean not usually. The whole
(02:02:56):
idea is service has been getting better? Are you saying? And by the
way, did the service tell youwhy this is happening? This is a
track phone? Is that a prepaidphone? I get it, you know
you buy, but is there aplace where you can call customer service and
(02:03:17):
ask them what's going on if Ican understand them. Yeah, that's right,
I know it isn't that that sucks? Mike? What what cellular service
is this track phone from? Whatdoes it work on? What network?
Oh? Jeez, because that's gonnathat's gonna matter, because that's the only
thing that matters. The track phoneworks on either AT and T or Verizon
(02:03:42):
or another one. There are only, basically, I believe, three main
networks. Do you know which oneyours is on? Okay, that that's
the answer right there. We gottawe gotta figure that out because it might
be AT and T. What whatpart of town are you in? Our
vaut or in I seventy? Hey, you know one thing I didn't tell
(02:04:02):
you they merged with last year.Okay, well, then that tells you
right there it's Verizon. Okay, yeah, yeah, that's exactly what it
is. I just looked it uphere. So did you call Verizon and
ask him about it? Hey?Tom, I'm seventy five. Don't to
(02:04:27):
push me too hard, Okay,So right now, listen, I'm just
going to tell you something I havenever found better Seltzer. I'm not saying
it's the best, but right now, if you don't how old is your
phone by the way, three threeto four years? Are you looking?
(02:04:47):
Are you looking to switch service ordo you want to keep it simple with
a track phone? Yeah? Iwant to keep it simple. Simple is
good with me. Okay, well, then you're right where you should be.
Again, Verizon's not terrible, butI have found AT and T had
I've tried them all and AT andT seems to be the best all around
(02:05:09):
service. Now. Of course Mikeis having problems with it lately, and
uh so thank the other Mike. So, Mike, thank you for calling.
I'm want to go to that otherMike right now with your AT and
T that started that started acting up. I wanted to ask you, Mike,
do you get dropped calls or doyou get no coverage? I don't
(02:05:32):
know if you're talking to me.I'm talking to the AT and T service
down in Oh. I'm sorry thatwas that was the other guy. I'm
sorry, No, no, Igot you. Now, go ahead,
I'm sorry, I'm talking Mike.It wasn't he was Jock Hall. I
was trying to go back to buthe's not there. Go ahead, Mike,
what is your comment on AT andT service? Well, for about
a year and a half two years, I started getting drops on my callers
(02:05:55):
the same thing. I can walkout my Yeah, I can walk out
my door right now, walk overto where I have some wooden stuff,
and it'll banjo or I'll lose itcompletely. As I'm coming down my little
driveway. And I live in acommunity of a home community. There's about
a twenty foot section I lose completely. Now where is this? Where is
this in the in the area?Where is it Thornton Open? I'd say
(02:06:19):
one hundred between one hundred Colorado Boulevardarea. You know, since since these
calls have come in, I'm gettingtexts and you got it. Seems like
AT and T in the past yearthey said has had connection and data problems.
And that's what you said. Inabout the past year this has started
(02:06:39):
happening. Yeah, and it toldme and I found out did some research.
Well, they did some work ona tower and they moved some stuff,
and they said, well, thatcouldn't be it because we test it
and I should it just should begood. But it's been since they did
work on the tower and I canactually see the tower where I'm at.
You know what's weird is I getperfect I'm getting way where I'm getting text
(02:07:00):
from all over where. It can'tjust be your area or Castle Rock.
Yet I have not I have nothad a problem, not one problem.
Uh so, and I have ATand T. I'd like to get others

let's speak to him about a commenton AT and T. Brian,
what's happening in Hey Tom? Igot the AT and T also, and
(02:08:13):
just about a month ago I startedreceiving well I do tethering for my iPad
for my work and yes, recentlyit's been right in the middle of me
writing my notes up it says hotspottethering is not available, and then it
kicks me off. Autumn. Ijust for I don't move or anything.
I'm sitting in one place. Howwould it know your tech? How does
it know your tethering? Well,it actually comes up and you link to
(02:08:39):
it. I guess, I don'tknow. It is kind of weird because
it's never used to do that andall of a sudden, Yeah, but
tethering, I understand what you're saying. Tethering usually goes from your device to
your phone, and then your phonesimply uses your regular data to get on,
you know, and it's a relay. And I don't even know how
the network would know your tethering.Yeah, I mean, I don't know.
(02:09:01):
Maybe there is some sort of threadin there that tells it. I
don't know how long has that beenhappening, Brian, but about a month,
right about a month ago. Iyou know what, I'm going to
start looking into AT and T andwhat's going on with them, because I'm
getting way too many calls about itand texts. There must be something going
on. I was going to say, I've been I've had a AT and
(02:09:24):
T for probably ten plus years andit's been great. Me too, I
absolutely have no complaints. I hatedVerizon, absolutely hated it, me too.
All right, thank you William.Welcome, Thank you Brian William.
What's happening? Oh yes, Tom, longtime listener, Thank you. Listen.
(02:09:45):
One time you had a guy thatI just had some hail damage.
And one time you had a guythat comes to you and it's like an
inspector that gets your more money fromthe insurance. I don't know what they
call, well called public adjusters. Now here's what happens. If you have
a simple hell claim on a roof, you know, a good roofer can
(02:10:07):
help you. But if you havelike more than a roof, if you
have other damages, especially windows orsiding or decks or anything like that,
it's really good to get a guyyou have all of that. Yeah,
then we had we got hit prettybad over here. So my sighting my
cover patio which is made like ofalumni. Now, I definitely if I
(02:10:31):
were you, I would definitely callMatt over at Paragon Services. Let me
explain this to you. There's nodownside because if he can't help you,
he's gonna let you know. He'ssimply gonna say I can't help you.
Okay. Now, Paragon Services,it's his name is Matt Stanford, and
(02:10:54):
it's and what he does is he'lltake look to see and then if you
have multiple areas, he will intercedefor you between you and your insurance company.
And that's what he does. They'recalled public adjusters, and he only
(02:11:15):
takes a small percentage of what hegets you extra. So many times he'll
say and call him and ask him. Sometimes what he'll do is say,
go and get your best offer, and then I'll come out and I will
whatever I increase. He takes asmall portion of, or he might do
(02:11:35):
it from the beginning if it's bigenough, and then you pay a smaller
percentage. So let me give youhis number. Sure, it's seven one
nine seven seven two six seven sixzero zero to zero zero zero two zero,
(02:11:58):
right, and it's called Paragon Services, Matt Stanford. Okay, Oh
good, let me know how,let me know how it works, okay,
because I'm sorry, I have oneof your referrals here to come and
check Genesis Total Exterior. Yes,of course, yeah, And you have
(02:12:18):
them right there checking on stuff.Yeah, so you know, and they
can take by the way, that'sa good that's a good combination right there.
In fact, they work together alot because Genesis can do all of
your damage and you only have todeal with him. You don't have to
call a bunch of different people exactly. Yeah, that's what he was saying.
So tell me something. Did yourwindows get pelted really bad? No,
(02:12:41):
just my screens, you know, but sighting the guy head, what
kind of siding do you have? The vinyl? Oh man, yeah,
yeah, yeah, and we yeah, we have golf hail side. Now
listen, something that's something that Genesiscan do, and anyone can do,
but not anyone as well as Genesis. But they do upgrades. So if
(02:13:03):
you ever want to switch over tosomething more hearty than that than that vinyl,
maybe even stucco for you know, the time to do it is when
you have damages and you're having itredone anyway, you may want to consider
that again, your insurances that ohmy god, if you could go to
stucco, it'll increase the value ofyour home dramatically. Yeah, I know
(02:13:26):
not. Does insurance work with youon that. No, here's what they
do. They pay you what theywould normally pay to replace the siding.
You would have to pay the upgrades. But here's the good news. If
you're doing an upgrade at the sametime you have an insurance loss, someone
like like Genesis can make you aspecial deal. Now they're not going to
(02:13:48):
achieve the insurance company. Insurance companyis going to pay what they're going to
pay Genesis because they're on site doingthe other work for you and they don't
have to mobilize just for that youcan You'll never Let's put it this way,
there's never a better time if you'regoing to do it. Anyway,
if you're not going to do it, then just go get your vinyl siding
and be done with it. Butit's a really good idea. If you
(02:14:11):
want to upgrade, the time todo it is when you are doing your
storm damage. Okay, So,and I'm glad you called Genesis. Mark's
a great guy. Genesis Total Exteriorsdot Com. Thank you well. Lionel,
what's going on? Lionel? Hey? Your time is? What's going
on again? Well? You knowat home, I have really good shrvish
(02:14:35):
I got or or I mean Igot a what is an ex spanity with
all of their gizmos and it worksgreat well to go visit. I'm retired,
so I go visit my grandkids everyweek by Buckley Air Force Base.
The minute I get there with mycricket phone, it doesn't work. I
call him and they said, oh, we're now on the H and T
(02:14:56):
towers now, And I said, well, wouldn't that mean it works better?
And he said, oh, Idon't know if you upgraded a five
G yet and I said, Ithink I have. I'm sure I have.
He said, oh, that mustbe a power problem. Well then
why would I get back to livebuild? Does it work perfectly? Well,
hold on, that doesn't make senseto me. So you actually have
(02:15:16):
better coverage? Well, and youget spotty coverage? And where is that?
Uh yeah, my granddaughter, well, my granddaughter, she lives right
by Bucket. I guess there's BuckleySpace. Yeah, but that's a main
that's a main area. See.That is what I don't understand. We're
going to have to get someone fromAT and T to talk about this.
Kichina. I hope you're taking anote of this because somehow, huh,
(02:15:41):
all they do is give me asong and dance about the towers. Yeah,
well, I don't know what's goingon, but I'm getting too many
calls right now that AT and Tis deteriorating. It can't be a coincidence.
There's just too many calls. Andlisten, Lionel. I promise you
I'm going to start looking into it. That's what I can promise you.
Three wait and just Tom and you'rea great man. Thank you, Lionel.

you're one of the few people thatdo that. Yes, measurements,
rough measurements and photos that would helpus put a price together. Yeah,
so when they call you, youmight have them take a pick on the
cell phone, certainly, and thenthe measurements and then you go out and
(02:19:11):
verify all that. But you canget them a pretty good price. How
do your prices fall in line withwhat it turns out to be. I
think we're very competitive. No,I meant like, how accurate are those
phone estimates when you get some picturesand square footages? Depends on the material
they choose. If they give usan idea of colors and type, whether
it's granite or quartz, we canbe eighty to ninety. Someone has a

quick question about overlays, whatever thatis. I think they mean the thinner
stuff to just go over an oldercounter You don't like doing that. No,
we reap all your counter tops andwe put in the new Yeah,
the overlays are just as much labor, in fact more labor, probably,
right, Yeah, I would,I would say so. Yeah, it's
easier to just reap that old fourmic out and start over. So remember
