went to pay their taxes and let'sjust say it was one thousand bucks.
They paid their but instead of applyingto that tax here of twenty twenty two,
they applied it to quarterlies. Basically, they applied it to the future.
How do you unwind something like thatso she can get her money applied?
Right? So, yeah, it'sa that's a mess, and it's

not not super easy. I actuallyhave to submit something in writing to the
irs and I ask you made it. I'm interrupting you because I forgot to
tell you this and Linda, youcan kind of explain what but she they
requested fourteen pages of stuff that she'sapparently already sent, correct, Linda,

that's correct. Okay. How longago did you send it? That was
in April? Okay, you knowthat's that's probably about right. As far
as coming to the RS application ofpayment, what I would do if you've
already sent in writing verifications of paymenthow you wanted to apply, how those
credits should have been applied to youraccount, the best thing you can do

is call and just verify that theyreceived that fourteen pages and they're processing it.
If they haven't received or process thosepayments, then I would recommend getting
the fact number from the you know, the agent you call that second time
around and like literally got up youknow, Kinko's or something and facts that
directly in. I can't believe theystill accept faxes. Yeah, that's the

most secure way to send documentation.That's amazing. That is it was known
as an ephax, so I Ifact for my computer, but most people
have to go to you know,fed X or whatever. Nobody uses those

you got to give it a littlemore time. One of the things though,

the time, that owe a lotof back taxes and whatever's going on.

connected with them, but uh foryou know what's called the uh Automated collections
system. This is the people thatwe typically you know, call to deal
with you know, issues like thisor really any sort of collection issue.
It's eight hundred uh eight nine threenine o three, So eight hundred eight
nine three nine o three And thenthat number was she there and she can

figure out if they got the paperwork. That's really her next step. Yeah,
that person is the hey did youreceive it? And they can say
yes, we've got record, it'sreceived and being reviewed, or once they
apply it possible they say they didget it. Once they apply the way
she wants to apply, and let'ssay they agree to it, and that
creates a refund. How much longer. Do you think she's going to end

(43:21):
up waiting for that refund? Well? What, Mark? Go ahead?
I go ahead, Linda. I'msorry. They sent me the in one
check. They sent me the fifteenhundred and nine dollars that we were due
plus interest plus paining us the moneythat went to them to pay twenty twenty
two taxes in February of twenty twentythree. So they've overpaid us. My

husband wants to cash the check.I feel like if we cash the check,
then pretty zone. Irs. IfI ever get this settled, is
going to say, well, nowyou owe us that money and you owe
us interest. How do you knowthey overpaid? Because how do you know
they overpaid your refund? They finallysent us the check, and they sent

us a form along with it,and looking at the form, they've included
our twenty twenty two tax payment withpayments received for twenty twenty three. Oh,
I see what you're saying. Soso Steve, it goes back to
the exact same thing. So theysaid back, they sit back the money
because they applied the credit. Andthen yeah, so really, so really

(44:37):
just I would call that number.I would call that number and then get
with and ask them to send youare to call account transcripts eight under at
eighteen nine three nine oh three.So, hey, I've got this check.
I think you guys have actually refundedmoney that is still owed. And
they can look on their system andthen say, okay, well we see
the credit, we see the refundation. We see now that that created a

(45:00):
a balance, and it's like okay, well you know, then you ask
and say should I just should Ijust avoid out this check because right now,
the IRS, when they send youa check, they go ahead and
subtract that from the account ledger.Right so they're showing probably a negative on
your twenty twenty two ballons, andso if you can avoid the check,
it'll still show a balance ode untilthe IRS figures out that the cash with

(45:22):
the check was never cashed. That'scrazy that they'll advise say, hey,
cash the check, go online andmake a payment for the difference, and
then that kind of resolves it.But you'll want to get that verification from
that agent because the systems don't youknow, it's it's the blind leading the
blind over there. You know,the system will change, the agent will
see something different, they'll send acheck I've had clients who've had, you

(45:43):
know, add four zeros to whatyou received, right, and they're like,
what should I do with this?He was like, hold on,
you know, before you do anything, I need to touch base with them.
And inevitably, what they typically willadvise say, hey, cash the
check, go online, make apayment of the amount that's owed, and
then that will solve it, asopposed to holding onto the check, which
could extend this thing for six monthsto a year. And she can go

(46:04):
on in fact step In fact,what she could do is cash the check,
go on and then literally apply itto where it should be applied,
right, She could almost do thatherself. Yeah, I mean I would
just want to confirm the numbers,you know, to make sure because in
course you cash it and you justtry to do it on your own with
instruction from now you've just you're backon the hamster wheel. So you want

to sell so, Linda, Imean, really that's what you need.
You should probably just cash it becauseit doesn't matter. I'm baffled at our
IRS operates off of a cash basis. I mean when they write the check
before it's cashed or before you receiveit and cash it they already have it
on the ledger. That's like,that's really strange to me, but okay,

it is what it is. Theystill take faxes. Now, lind

payments and they're not going to doanything, which generally is true. But
she's got about two hundred and fiftythousand dollars in equity that she wants to
try to get out of there toactually put back into the house, because
the house is in shambles. Theproblem, though, is she's retired.
I'm sure she doesn't have the incomeneeded for another loan. Plus she doesn't

(51:59):
want you probably hear this all thetime. She doesn't want to get out
of that three percent mortgage. Herparents were locked into because interest rates are
higher. Now, I know youguys can handle that problem because you have
the interest rate guarantee. But ifshe can't qualify, can you think of
any way she can continue to makepayments on the first and squeeze some of

(52:20):
that equity out or just no cando? Yeah, you know, Unfortunately,
there's not going to be a wayfor her to get that equity outity.
The only option with that existener placewould be to go get a second
or a home equreliine of credit,and she'd have to qualify to do that,
you know, And so depending onAgain, the one key in this
is that mortgage without standing on thehouse now is not in her name and

(52:44):
is not going to report on hercredit. Yeah, well hold on though,
but how would she get a secondif there's a first on the property
out there not in her name?I mean, would anybody actually give?
Is that even possible? You know? So here's the thing, Yes,
it is possible, and we haveseen it done. It's you know,

it's it's one of those things thatit just depends on what her financial situation
looks like, what you know,what other bills she's got, what income
she's got coming in. You know, if she doesn't have anything else,
then it may work to go getthem. Hold hold on, hold on,

you talking about? I mean,do you have Social Security? Do you
have a pension? What are youpulling in a month's cash? SSI about

you know, listen, there's varyingdegrees of houses in shambles. You
know. I do know with reversemortgages they're a little pick here on the
appraisals, but I've seen some fairlyaggressive things get done that may be the

best option. We Look, We'rehappy to take a look at. It
doesn't cost you anything. It's somethingthat you know will do a inquiry on
your credit so it doesn't hit yourcredit report, and see what we can

thousand dollars vehicle to twenty twenty three, still under manufacturer's warranty, Dodge Ram

thirty five hundred diesel. He bringsit over there because it's under warranty.
And the next thing he hears backfrom these characters, and I say that
term even loosely at Castle Rock ChryslerDodge Jeep Ram, is that it's not
going to be covered under warranty becausehe neglected and abused his engine or something

happened. Because there's only three courtsof oil in it now. First of
all, I would assume this vehicletakes possibly eight to twelve courts. He
had an oil change done at BigO' tires about eight months before, in
about eight nine thousand miles before,and they're saying, if you really did

have an oil change, this isan assumption of what they're telling him.
But if you really did have anoil change, big O' screwed up and
only put three quarts of oil init. But regardless, it's not our
problem. It's not under warranty.And you know what this Castle Rock Chrysler
died odds jeep Ram did. Theyflagged it in the system, So no

dealership in the country will do anyengine warranty to it. Generally, it
would be flagged by someone at Chrysler. To the best of my knowledge,
I happen to know someone entrenched overthere, and sure enough, this dealership,
this Castle Rock Chrysler dodged jeep Ramdealership. They flagged it in the

system, no more warranty, andit was under warranty, So they're basically
blaming this guy. Now they tellhim he needs an engine and it's going
to be forty one thousand dollars.You go forty one grand. Well,
remember it's a brand new truck andit's a diesel. I don't even know
what that engine would cost, nordo I care, But they're not going
to cover it under warranty because there'sonly three quarts of oil in it and

its customer abuse. Does everybody,my automotive guys sitting there, does everybody
follow this story so far? NowI get involved, and I called over
and I talked to someone at Dodge, someone that I know, and he
verified everything. I just said thatit was flagged and there's no warranty left

I talked to this guy Ryan,he's the caller, and we got a
game plan together. Then I endedup talking to I believe. Once again,
I'm sorry. I talked to theGM down there. I don't know

there, but he was either thesales manager or the the general partner or
the manager down there. And hesaid, Mark, I'm gonna go back
and we're gonna check it, andwe're going to make sure that everything's done
right. And I'm going to tryto fight for this guy to have Dodge
do something for him. And Ikind of took him at his word.
I mean, I don't know theguy from anybody else. Next thing I

hear back from Ryan is Nope,they're not going to do anything. I
said, Ryan, I need somethingin writing why they're not going to do
it. They have got to giveyou something in writing why they avoided the
warranty on this vehicle in the entireDodge system, and get it out of
there, Get it somewhere else.So then Ryan ends up. This is
where this thing gets so unbelievable.Ryan ends up getting the caller. One

of the Dodge reps actually call himback, and the Dodge rep says,
you know what, We're gonna paya little money to prove to you that
there was only three quarts oil.We're gonna go ahead and pay a little
bit out of our own pockets totear it down, and then we'll figure
out exactly where the oil went,because remember, there's only three quartz oil
in it, even though that oilchange was eight months ago. In other

words, they're claiming that he droveon three quarts of oil and ruin the
engine eight nine thousand miles ago,in eight or nine months ago. Hey,
Jeff, can you tell us whata flex plate is? Yeah,
if it was a standard transmission he'sin the clutch, it would be called
a flywheel. So the flex platesits in between the engine and transmission.

Uh the torqueovert bolt up to it. The reason they called it a flex
place because as the torquever heats up, it does swell, so it has
to actually be able to move toin order to accommodate that Okay, Now,
if a flex plate happened to breakin a twenty twenty three Dodge Ram
thirty five hundred, could it soundlike an engine knocking? Most definitely guess

what That's all it was, Andit's one hundred percent covered under warranty.
These guys at castle Rock Dodge,whatever the hell it's called, did one
of two things, and I'm notsure which one one. They simply didn't
even look at the vehicle, butyet they said there was only three quarts

dollars engine or are they just inept? They're so stupid they can't read a
dipstick? Is that possible? They'reso stupid. They tell the guy there's

actually moving, how many RPMs you'redoing. I'm when I'm down to below
forty miles an hour, the radioworks just fine, because I wonder if
you're picking up electrical interference from thecharging system. They've got capacitors that are
