(00:44):
I don't need bottled, no stinkingbottle war. By the way, you
can get yours for fourteen hundred bucks. Fully ass saw three oh three eight
six two five five five war.He texted me and said, dude,
you don't look right in the studio. You know, people are so used
to now seeing me and my otherstudio. So anyway, welcome. We
got Mark Schamanski with us from GenesisTotal Xteriors dot com. We have a
(01:07):
deputy doc in the studio, anddid Mark sign on you? He's on
I am here, He's in partsunknown. He's actually out in California.
He's they're on an extended motor hometrip. He signs in every now and
then, and it's it's fun.He posts videos if you ever want to
look at him. So anyway, let's talk. I just want to say
one thing. So today, thisnews conference would normally just be a normal
(01:30):
news conference, right because he hasworld leaders and he's meeting with world leaders,
and he's gonna just do a newsconference. But now they're turning it
into an entire referendum on the man'sfitness and health. And I'm talking about
the president. And I just Isaid something at dinner last night because I
was out with a bunch of oldfarts, and I said, how many
(01:53):
normal scripts do we have in aday? Just normal? You know,
I brain fart here and there. Now, this guy who's eighty one,
just if he just has a normaljust a normal kind of slip up,
just normal, like nothing major, right, it's going to be it's going
to be terrible for him. Thisthe pressure that he's under right now is
(02:14):
not just normal pressure. He hasto be perfect. It's not only the
slip ups. It's to look onhis face. Well, it says vacant
look of somebody who has dementia. It does he does have that look and
you can't hide that. Gill No, that that's what I'm saying. It's
more than just his verbal it's it'shis physical appearance. Well, it certainly
would help if he just closed hisdamn mouth, because there's looking over at
(02:38):
Trump and it would just be Butsee, I think they set him up
at this point, guys. Ithink they set him up to fall hard.
I think the Obamas are behind it. I can't even imagine anyone wanting
someone to fail like that. Theyknew he wouldn't. They knew he wouldn't
step out. He already had thedelegates. I think they totally set him
up. I know that sounds conspiracy, but we find out today George Clooney
(03:01):
ran all that op ed that hewrote by Obama before it was released to
the paper. That's that's insane, and Obama didn't care. And also,
I I remember, you know,I'm on mailing list for both sides,
being independent, and I get theBiden Harris emails, and George Clooney was
(03:23):
a part of those. In thebeginning. He would say, this is
George Clooney joined me and Julia Roberts, and you know we're going for Clinton,
and I'm excuse me for Biden andbab blah blah. See that little
normal scrupt right there. That wouldbe a death noel for him anyway.
So but in how fake? Howfake? Was that op ed? And
when I say fake, how fakeis George Clooney that three weeks ago he
(03:47):
was sitting there saying how bad theguy was, but he was raising money
for the campaign. Now he throwsthem under the bus. That with it
itself is remarkable. Yeah. Sothey're calling this news conference and I'm just
making mention of this. By theway, I'm not making fun of the
guy. I actually feel bad forhim. I don't feel bad in that
he needs to do something, butI do I feel bad for him.
(04:10):
Mark, would allow your husband togo through this? Now? Some people
say she's the reason because she shewants the White House daycare. I don't
know what's Oh his MIC's unplugged.Hold on, okay. I wondered why
that was going. Why we couldhear? Go ahead? Mark, you
say, I just said, youknow, to have Jill Biden. What
wife would do that? Right?Yeah? I mean, you know,
you honor and protect your your spouse, you know, and like like she
(04:34):
doesn't apply once does she say,Honey, you know you've accomplished. You've
been in government for fifty years now, nearly fift whole life. He's never
had a real job. He neverand you but you guys don't realize he
has to mention. He's not thinkinglike you guys are thinking right now.
He's thinking he's doing a great job. No, but his wife does not
(04:54):
have dementia, and she she justdoesn't want to leave the White House.
Of what the Trump d OJ isgoing to do, I don't think so.
I although although I will say this, I mean, I mean that's
what I hear from people, uh, including my own family, that Trump
now is gonna assassinate his enemies.I'm assassinated. But the DOJ is gonna
(05:16):
go after I don't think they wentafter they should. So wait a minute.
You don't believe in tit for tatteringfor I mean they went after him,
They at the whim just perpetuates.I just think it perpetuates that crap.
I and you know, truly,to be honest with you, And
again, this has nothing to dowith politics. I don't believe that Joe
(05:38):
Biden is an evil person. Ithink he's just like every other politician.
See, I don't think anyone isas good or as bad as anyone says
anyway. I just I think they'reall really they all do what they have
to do. They all do.I mean, we just don't know about
all of them. You know, there's no there's no saint in office anywhere.
(05:59):
I mean, the only saint closeto a saint we had in office
was the worst president of it inall history. And but he was the
Carter. He is the best man, but the worst president. I mean,
you know, I don't know ifyou can't have a good person.
And look, every one of thecongress people, men and women go in
with X amount of dollars and theyexit is multimillionaires. Everyone. Look at
(06:19):
what AOC did. She was abartender, I know, and bro a
multimillionaire right right, or in theBronx or wherever. Anyway, I want
to talk to Janet loud crap.Janet's got a medical issue, and then
we have other calls. Let's getthose calls up, Katchina Glori, We'll
get that done here. Okay,Now we have Janet, Hey, Janet,
(06:40):
welcome to the show. And whatis going on with you, Janet.
We solve problems, answer questions, take complaints, and I hope we
can help you. Well, lastyear I had my thy right removed.
I had a big noise on thebottom of it. The doctor removed it
that It is a really easy procedure. It ended up lasting like five hours.
(07:03):
Wow. Yeah, Now, bythe way, was that was that
cancerous? That that nodule? Itcould have been, but it wasn't,
by the grace of God. Well, well, why didn't they do a
biopsy and leave it alone? Orwas it interfering with you? It was
interfering with my swallowing Okay, okay, I see and Doc, they don't
(07:23):
just do those lumpectomies. They takethe whole thing out. Yes, when
it depends if it's interfering with usswallowing right, they'll take the whole thing
out. Okay. If it wasjust a small nodule, they would do
a quick biopsy and then decide whatto do. Okay. So it was
pretty big because they had to openup my chest a little oo. So
(07:44):
wow, anyway, we get thatdone one hour, Susan ended up being
four to five hours. Okay,So we got it out. Well,
we thought we got it out,She said, I did really good.
Three four months later, I'm stillhaving trouble swallow really and yeah, stuff
like that go back, she says, Okay, it's normal, You're okay.
(08:05):
It's gonna get better. It's gonnaget better. I go on hormone
pills, and I keep gaining moreand more weight. I go from one
fifty to two hundred and eight pounds, she says, start exercising, starts
doing all this different stuff, andI still keep getting bigger and bigger,
selling worse and worse, hires higher, and keep up being the hormone pills,
(08:28):
end up doing one hundred and fiftymiligraunds a day of hormone pills.
Wait, whoa, whoa, whoa, So hold on, I have a
fear. I have a fear. You're going to tell me that they didn't
take out your thyroid. They lefta piece in there. They left Wait
wait, they left a piece ofthyroid. Is it enough of a thyroid
that is actually producing hormones exactly?Wait a minute, really, Mark,
(08:56):
is that possible dot that a partialthyroid can still function? Well? Yeah,
but I can't imagine that it producesenough to make it. Is it
like a liver where you can actuallyhave parts of it. Well, she's
taking thyroxin apparently, So what doesn'tmake sense is that if she's complaining that
that the thyroxin isn't enough, No, she's complaining that she was overdoing it
(09:18):
and gaining weight because of it.Right, No, it's usually the other
way around. Oh, the otherway around. So thyroid, you tend
to gain weight a little bit.So anyway, let's going to keep going
with your story. Okay, SoI'm a yuriant to the surgery. So
I'm having a lot of trouble swallowingagain. I could actually cough up the
(09:41):
pills. I could cough up myfood. I can't lay down because it
feels like you know how you filla water balloona and you put it on
a flat water. Okay, haveyou seen I'm going to ask a logical
question. Have you seen another doctor? Yes? I have. I went
to my thyroid doctor and they dida swallow study and she said said,
Janet, you still have a thyroid. And I said what And she said,
(10:03):
she's left to pick your thyroid inthere you and we're overdosing you,
over maxim you on thyroid pills andThat's why your face is numb. That's
why you're just as sure sky high. That's why you're getting in all this
wage. You need to go seethe surgeon, make an apployment, get
in their astaff and talk to her. All right, hold on, we've
(10:24):
got to figure out what to dowith this. Is this now practice?
Is this what? And is it? Is it actionable? I mean?
Or do you just go in andhave it done? Is it a normal
risk? All of this will talkabout coming up on the Troubleshooter Show.

(11:52):
getting it. We're getting it onfor uh uh Janet, and listen,
Janet, this is a weird oneand I want to know what an attorney
thinks about this as far as goingforward and what you should ask for or
deserve. And I know you haveother questions, but just hang on.
Yesterday somebody called up and said,Tom, I went to this place I
(12:13):
found on Facebook called Ticket Secrets andI ordered tickets. And then after that
the floodgates opened. People started callingus. Natasha was the original caller.
We have her on the line. And then Natasha sent me an email.
I couldn't believe. But before Natasha, you're up. But I want you
(12:35):
to listen to Terry. Terry,go ahead, what's going on with you?
Terry? Hi? How are yougood? Terry? What's happening?
Okay? So I'm going to tellyou my story with Ticket Secrets. Yes,
I first tried to purchase from heryears ago. I asked her for
tickets to a Bruno Mars concert andthe price that she gave me was unbelievable,
(12:58):
and I was like, you know, I don't feel right about this,
So I didn't buy from her,and I moved on with my life
whatever. So years went by.I had friends, Hey, have you
ever heard of tickets secrets? AndI was like, yeah, I heard
of them, and they're like, you should do business with them. They're
great. So, you know,I always hesitated. And then I bought
some Denver Nuggets tickets from Okay. You know, she sent me the tickets.
(13:22):
Everything was fine. Granted I wantthe tickets like twenty five minutes before
the game started, but I hadtickets. So that was experienced one.
It was great. So I decidedto buy more tickets from her to justin
Timberlake, out of town, Okay. So I fly out of town and
(13:43):
you know, two days before theshow, I write her, Hey,
I'm checking out on my tickets. No response. You know, time keeps
going. I write her again,Hey, any news on my tickets?
Concerts coming up? No response? You know that seems to Terry. That
seems to be the how it worked. People had used her before successfully and
(14:07):
then all of a sudden something happened. Right, so you know, now
I have, like I bought ushertickets from her. I'm not going to
get those. So you know,it's just a point of you know,
you trust somebody you have right, right? And so when did you ever
get to talk to her? No? Well, there was time before the
(14:28):
concert and I was like, hey, you know, I know I paid
you this much for these tickets, but you know, can I pay a
little bit more and maybe get thesetickets? And she was like, well,
you only paid this much and Isaid, yeah, I understand what
I'm telling you. I'm going topay you more if you can get me
better seats. And she said, well, well that's my deal is,
I'll get you the best seats Ican. Okay, now let's talk hold
(14:50):
on, Okay, Natasha, thissounds familiar to you, doesn't it,
a sir, Now, Natasha, you did manage to talk to her,
right. I was in communication withher up until right after the Morgan Wallen
concert when she ghosted everybody else.I have about four or five different phone
(15:13):
numbers for her. Also the Facebookmessenger. I tried to research through TikTok.
I tried to when I asked youyesterday, when I said, you
know, we have to show ifshe's going through a bankruptcy or a legal
problem, she has an attorney onall that. I said, how do
we know she scanned a lot ofpeople? And you said, well,
it's all over Facebook and this,And I said, well, could you
(15:35):
get me three or four names? And you come back with a spreadsheet.
Now, listen, I'm not exaggeratingwhen I say this, who organized this?
I mean this is a spreadsheet ofone hundred people. I mean Diana
Marie had reached out to me backwhen I had posted something on Tulia's Ticket
Secret Facebook and she said something aboutgetting everybody together. Did this woman put
(16:00):
this? It's such a comprehensive list. It's the amount of money At first,
it's their name, the amount ofmoney, the date, the invoice,
transaction number, and the event. So every single one of us individually
go on there and put the informationin and she is keeping that spreadsheet so
that way we can try to doeither small claims, but now seeing how
(16:25):
much she took from everybody, wedon't know if we should file a class
action lawsuit against her. Here's wehaven't even mentioned the amount, but tell
people how much it is. Tom, Okay, well, the if you
add up just what she has here, it's fifty five thousand dollars. But
fifty five thousand bucks. No,no, But here's what I want to
(16:45):
say. Oh, that's not enough. Since I have sent that to you,
there is now ninety people on thatlist, okay instead of seventy.
Okay, let me explain something toyou. That's what I said around one
hundred. So listen, here's whatI want to tell you that forget class
action. Okay, class action peopleonly go after class action if the corporation
(17:07):
is big enough, where the awardis big enough, because the attorneys have
to get paid at the end.But also it has to be big I
mean fifty five and an ability topay. There's nobody in the world that
will do a class action for ninetypeople and the woman doesn't have ability to
pay. I mean, you're notgoing to get it, and there's no
(17:30):
benefit. Here's the other weird thing. There's no benefit to a joinder suit,
which means you just all get together. It's not a class action.
It's just that you all get togetherand sewer and here's why. Because the
chances of getting paid again are nextto nothing, so then you end up
with nothing. The best way toget paid is for one person. I
know this sounds crazy and selfish, but for one person. Let's, for
(17:52):
example, we have somebody on hereO six grand. They go on,
I think it was it six wellalmost, they go on, let's say
if they're owed three grand, fogand whatever it is, and they see
her in small claims court, geta judgment and try to scare her into
paying up. But I don't thinkshe has money, and I think she's
a crook and or she fell onbad times. But I can't believe that
(18:18):
these dates are so extensive. Ican't believe that she did not know she
was in trouble and she or sheknew, and she kept collecting money.
And it looks like her trouble startedback in fall of twenty twenty three,
and she was collecting money through noyeah, even as far back as September
(18:41):
twenty twenty three, and then throughJune I see as the latest date,
and June she was still collecting money. And when did she finally tell you,
Natasha, this scumbag? When didshe finally tell you she retained an
attorney. She posted it on herFacebook page. Oh, it is on
(19:07):
her Ticket Secrets Facebook page, sayingthat she retained legal counsel and that we
will get some sort of letter. And we were all waiting on this letter,
and we reached out to the attorneyafter looking into that Richard Growth.
He is a divorced separation attorney. He is not even a bankruptcy attorney.
(19:33):
Okay. So, and I sentyou over three more emails as well about
her business. It was delinquent foralmost two years. Does anyone have a
picture of this woman? I wouldlike to warn she has a personal Facebook
page as well, under Talia Jeger. Okay, under, I'll have Suzanne
(19:55):
pull some pictures. Yeah, Howarddo that? What's the name again,
Paulia Jaeger? Okay Jaeger coll here. I can't believe I didn't write that
down yesterday, okay, okay. And I looked. I searched bankruptcy records
yesterday. There's been nothing filed underher personally or that company. Yeah.
I think most of us yesterday onthat Facebook group were watching you guys live
(20:21):
on YouTube, and a lot ofthem were saying, what do we do?
Now like, well, well,we got to come up with a
plan. I mean, I thinkwe get law enforcement involved. It sounds
to me like a scam. Imean, you know, what did she
know? When did she know it? Did she still collect money? You
know, when you collect money knowingyou're not going to fulfill a contract,
(20:41):
that's that's fraud. And I can'tbelieve this list. Holy crap. So
we're gonna stay in touch with you. We're going to get an attorney on
to talk about this. But really, first and foremost, I'd like to
reach out to Richard Gross. Didyou do that? H Kitchina? Did
you ever call this dick Gross?Yeah? She did, and there was
(21:03):
no answer and the voicemail was full. Oh really, so the attorneys everything
that one of us are running intocorrect. And also the Talia her voicemail
is also full on the one number, Kalia Talia with a tea Talia,
Oh Talia. Okay, So Taliais is some kind of weirdo. I
(21:30):
mean, she's went It sounds likea Ponzi scheme to me. Yeah,
but but she was doing tickets atone time. Well, I think she's
collecting money from people to purchase ticketsfor other people to give to people to
bait them into thinking that she's legitimate, and then they fall into a trap.
And it's kind of like this bigPonzi scheme. Can I mention one
(21:55):
more thing while I still have youguys? Go ahead. I want everyone
to hear this guy. I wantwe got to do something about this woman.
Go ahead. She also during likethe Nuggets playoff games, she would
do giveaways on like she had aseparate Facebook thing and she would charge people
(22:15):
anywhere from one hundred, like twentyfive to one hundred dollars and say,
hey, pay me this money.Yeah, and I'm going to give away
tickets to somebody whoever. This wheelsright right? Gotcha? Do did these
people ever get these tickets? Idon't know. So that's like a whole
nother thing that she was pulling. You know. Again, this goes,
(22:37):
this goes beyond a simple bankruptcy orsomething. And this attorney, I mean,
if she retained an attorney, heowes it to these victims to talk
to them or to talk to me, And we got to get word out.
Try him again, this gross dick, and see if see if we
can get them on the phone.Hold on, folks, this is a
(23:02):
scam, a big one and aswith many many scams. My god,
they they this Facebook marketplace, theyshould call it Facebook scam place. That's
really what they should call it.Go with a sure thing Denver's Best Roofer

here your troubleshooter. Three oh threeseven to one three talk three three seven
one three eight two five five.Let's get to the phones. And were
you able to get Marco Bittendonelli onfor that one uh malpractice issue? He
(24:08):
has not answered me back yet,But I did talk to Gross Stick.
You did talk to Gross Dick Heythe attorney I did, Richard Gross,
the attorney for four OxyS me forthis scam scammer talia. Yes, he
he will not come on. No, that's okay, he won't come on.
But did he have a comment forthese people. Yes, the Lord
(24:30):
came down from heaven and gave usthe law that also offers bankruptcy. He
said that, uh huh, theLord huh came down. It just means
he's going to file bankruptcy on herbehalf. That's what it sounds like.
Yep. Okay, so he saidand gave us the law of bankruptcy.
Now bankruptcy is and he said thatall victims will get whatever that the bankruptcy
(24:56):
court will guner ate or ward.Well, so in a bankruptcy, here's
what they do. They look atyou know what. Let's get wink On,
get Mike wink On. I wantto ask him about that. Because
there's a certain intent you can challengebankruptcies and bankruptcies. People think when a
(25:19):
bankruptcy is discharged that's a bad thing. That's a good thing for the person
filing. If you file bankruptcy andthe bankruptcy is discharged, it means that
all of your debts are discharged. They go away. If the bankruptcy is
dismissed, you're screwed. That meansor the creditor is dismissed. It means
that that they are not part ofthe bankruptcy and you must pay them.
(25:42):
It is possible when you go bankruptto have some debts that are discharged and
some debts that are dismissed, dependingon your culpability. If you are simply
the victim of a bad economy orwhatever. Like, if a business was
(26:04):
collecting deposits with every intention of finishingthe work and then they went bankrupt,
that's different than a guy who says, I better collect as many as possible
before I go out of business. And that's the age old challenge of bankruptcies.
(26:26):
Really. Now, I want toanswer a question for Gary, Gary
welcome, What is your question onsmall claims court? Yeah, I'd like
to know how to go about doingit, and plus I want to know
if it's seasable. I've got Ithink I must be one of the number
one I mean not people having troublewith Camping World. Oh, there's a
(26:52):
ton of people having trouble. Whatwas your problem with Camping World? I
needed on it for a motor Ibought, and I called around a lot
of different people around my area andthey were all a month plus out.
So I thought, well, I'llcall Camping Roll see what they are.
(27:14):
And they said, yeah, wecan get a right to it as soon
as we get it ordered and doit. I said a lot, I'm
fine. So she craved it allup and she and the girl that I
talked to said that if it wasn'tavailable to her, I'd have to go
to their online store and order itand they could ship it Camping World their
(27:36):
online service to them, and theywould solve it. So they give me
an askimate and all this and tothe whole process. They asked me,
what link is it from? Youknow where the arm was, because there's
no audion at all. All thereis is just I guess the guy I
bought and said he had got blownoff. I don't know if it's been
(27:59):
blown off. Looks like to mebesides white something and took it off.
But that's but anyhow, Uh yeah, so let me let me get right
to it. Did you ever endup ordering an Awning? Yes, I
got the audi delivered to them. They give you an estimate, uh of
(28:22):
six hundred dollars installed. I said, yes, go ahead. Well,
I took the motor home there.Okay? How much was the awning itself?
How much was the awning itself? Two thousand dollars okay, which I
paid for. And but my thingwas is they wanted six hundred dollars install
(28:47):
it. Yeah, fine, Andthen once I brought my motor home there,
they called it back to we needanother four hundred dollars install it.
Okay, hold on, I wantto find out why I got to take
this break, or dragon will comein here and drag me out of here.
(29:10):

Now we got a lot of people. Be patient. I will get

(29:56):

So what I want to know isthis, where does it stand?
Did you have them do the workor not? No? I didn't.
I thought it would. They giveme an ast an. It's not a

we can install it for six hundredbucks, that's not a contract. Okay.
But you're saying you would have neverordered the awning if you knew it

(30:40):
totally agree. And therefore I wouldask them to take the awning back.
Won't they just take it back? They're like, but they're not calling me

to go to Michael Wink, anattorney at law, because I don't want
them to wait during the break. He's with the wink Lawfirm dot com a
bankruptcy attorney. Mike, I needto ask you something. If a ticket
(31:25):
broker took a bunch of money tobuy tickets and amassed creditors, who are
people waiting for tickets of about youknow, sixty thousand or whatever, and
they go bankrupt? Can can theyget away with it if they knew they
like? How would you challenge it? Would you have to show they kept
(31:48):
taking deposits knowing they were in trouble? Or is it almost impossible to challenge?
It is certainly possible to challenge. And what he would do is file
an objection to discharge in the bankruptcy. So the key here is, while
there's certain kind of debts that don'tgo away in bankruptcy, like student loans,
(32:08):
and a student loan lender doesn't haveto do anything in a bankruptcy to
have its debt survive discharge, ifyou're claiming that you've been defrauded, you
have to file an objection to discharge, And I could tell you that in
those kinds of facts, you're goingto have a very strong case, especially
if there's a pattern and practice ofyou know, a lot of angry customers
(32:30):
who paid and didn't get the goods. Yeah, there are like ninety customers
and there's a pattern there. Overseveral months, she was collecting deposits and
I mean it went on from Septemberof twenty twenty three all the way through
June of twenty twenty four. Andyou got to ask yourself, Wait a
(32:52):
minute, why would someone do this? What if she simply says, I
don't know. She may have anexcuse, but you answered what we wanted,
which is pretty cool, and thatis that they Well, well,
I'm I'm a little confused, Mike. Would each person, let's say there's
one hundred different people, does eachone of them have to do that?
(33:13):
Or can one person go to thetrustee with a list of names? I
mean, how does it work?Yeah? So so each person, each
person has a claim. If there'senough of them, you don't even need
them all You can object the dischargewith Marge and make it sure that there
is no discharge. So there's onethere's one case where you say my debt
(33:35):
doesn't go away, and there's anothercase for you take because you brought a
ninety people you don't know. Okay, okay, we got that. We
gotta we gotta take this break. That's Wink Law Firm dot com. And
we have more coming up on thisand your other calls. Stay tuned.

Right? Yeah? He did.I thought I had that, right,
Gary. So the good news isI have a deputy here who will have
(35:59):
hassle them about your refund. Butthey did not really refuse the refund,
right, They just said you hadto go through a few procedures. Is
that right? Yeah? And wellhere's the thing is, I've just heard
all the problems you're having, andI think they're trying the same thing to
me that they do to every else. Well, no, they are pretty
(36:21):
damn and competent. But here's thedeal. If you're calling me because you
want to force them to install itfor six hundred, it's not going to
work because they didn't create a contract. They didn't create a binding thing where
they have to do it no matterwhat. And the last thing you want
is work. What's called specific performance, where you're forcing someone to do something
(36:43):
for a price they don't want todo it. I just think this they
do, they should make it.However, since they induced you to buy
that awning, they should refund themoney with no question. So what do
you have to do? Do youneed us to get that refund or are
they going to do it for youyou? I don't know. Like I
say, it just seems like I'mgetting the run around. I mean when
(37:06):
I when I went to pick itup, I shaid I ask you the
refund, and they said, well, we can't get the reef fund.
You need to call right because youbought it online. That's right, you
bought it online from camping World, which is different from the Camping World that
you were at for installation. Butwhat here's here's the thing. I want
(37:27):
you to call me back. I'mjust gonna mark this. Call me back.
We'll put somebody on it if youcan't get a refund. Okay.
I don't think you should bother goinga small claims court at this time.
It's premature. They haven't refused yourrefund. I want to move on.
Three oh three seven one three talkseven one three eight two five five.
Now we can't get Janet. Ican't get my malpractice attorney right yet.
(37:49):
But I do want to go backto you so you're not left hanging.
Okay, see if John Fuller's available, John can also weigh in on this.
He actually could, uh hold on, I just thought of that.
I'll be right back to you.Let's try to get John to weigh in
on this. And then I wantedto talk to be about the tenant landlord
thing. Hi, be what's happening? By Yes, I have a question.
(38:10):
Yeah, do I have to howlong a period of time do I
have to notify my tenants of arent increase? Okay, Now that's a
loaded question. You're a landlord, right, yes, Okay. Now,
if you're a landlord and you haveno written lease, right, you have
(38:35):
what's called a month, you havewhat's called a month to month tenancy.
I do, okay, So youhave no written no written lease, right,
no, okay, in a monthto month. And I say it
used to be, or it maybe because I think there were some recent
changes. But and we can getBrad O'Brien. We can get in fact,
we should get Brad O'Brien. ButI believe that it's specified by law,
(39:00):
which means I think you have todo it within a certain number of
days of the rent cycle. AndI'm thinking it's the full thirty, but
it could be it could be tendays. I gotta find I'm confused.
There there are some things that onlyrequire ten days. So rather than speculate
(39:21):
here, let's get Brad O'Brien onOkay, this is a great question for
him. And also whether there's limitson how much you can raise it.
I don't think there are are thereright now? Oh wait, wait,
wait, wait, thanks, I'masking you know what, that's a good
question there be right now. Beinga landlord has gotten so complicated, you
know that, Right, Yeah,That's why I'm calling, because I know
(39:43):
laws have change. All right, hold on, we'll get an answer for
you. All right, We gotthat one pending. Let me make a
note there for Brad O'Brien, andthen we have the other one. Let
me go to Lentcho. Is thathow I'm saying your name Lenko or Lentcho
or how do I say your nameLento lent show? What is happening?
Yeah? Hi? So unfortunately,I you know, with the hailstorms last
(40:07):
July, I there was a contractorin my neighborhood who had did my neighbor's
reff. I called him and gothim going, I know, and so
with that saying, I talked withhim and he, you know, we
signed a contract to have my reffdone. And this was in August of
last year. In January are inNovember of last year, I gave him
(40:30):
the check that the insurance company hadgiven me. Oh oh you paid you
paid him up front? Yeah,oh god? And was just just the
roof by the way this was, well, there was supposed to be some
gutter work done with it, likedown spouts. Yeah, and so with
that being said, that was thatthe bill came up to like thirteen thousand.
(40:51):
The insurance company gave me a checkfor eleven and then they sent me
a supplemental check that I still thatI deposited. But with that and said
he did the riff was completed. And oh so he did at least do
the roof. Yes, yes,so he did the roof. And then
I haven't talked with him. Icalled him a few times. Finally in
(41:12):
March he reached out to my insurancecompany saying that there was supplemental money because
his bill was thirteen thousand, andthey sent me the check. But he
never touches base with me. Solenchkra I, I've got a couple questions.
The initial check he took was howmuch a little over eleven thousand.
I don't have that right in handright now? Okay, around eleven grand,
(41:34):
okay? And then what and thenthey supplemental is for how much?
It was like thirty eight hundred?Okay, Now the supplemental check is thirty
eight hundred, So what are youasking me so with this. So he
hasn't been in touch with me,and I've called him a few times.
Yeah, and the last time Italked with him of his March and I
didn't I didn't give him the supplementalmoney because he hadn't had a riff inspection
(41:58):
done. He kept telling me that, oh, they're months behind, they're
months behind. Well, finally, you know, months of my wife jumping
on my back. I called onlike the seventeenth of June, and within
and I scheduled the inspection for thetwenty fourth because I'm not going to give
them the rest of money unless Iget the final inspection, saying the riff
is done. I get it.The inspect The inspector came out on the
(42:22):
twenty fourth and it failed. Itsaid b vans need storm callers. And
so the riff inspection failed. Andthen what does that mean, Mark Schmanski,
do you know what part they're talkingabout. It's just the bottom of
the vent coming out of the roof. Not a big deal. Yeah,
no, it's not a big deal. Okay. And with that though,
also they had when the riffers hadput my swamp cooler back on after they
(42:45):
did the rift, it was totally. It was about eight inches off of
the center. So when I wentto put it, I had some water
run down. Luckily there was nodamage in that, but I noticed that
they didn't do a good job ofputting the swamp coller back on. And
so then I get a call onMonday and they're talking to the insurance company
(43:06):
because they want their money. Whilethe lady goes, I have sent him
a check, and she said,uh, the depreciation for the completed repairs
was released to me in March, but I didn't know I had to give
that to him until I could getthat final riff inspection. And now he
and I'm scared out of my way? What are you scared at? You?
You haven't told me anything? What? What? What? What's going
on? I mean, you haven'ttold me anything. Now he wants now,
(43:29):
he wants the money that the insurancecompany at sent but my roof is
not done. And he's you ownthe money. That's right, you own
the money, but he should fixthose deficiencies that you're absolutely right. You're
both right. He needs you tellhim very giving him the money. Well,
I wouldn't give him the money untilhe fixes it and gets a final
(43:51):
inspection. Did you tell him that? Well, yeah, I tried to,
and she called. She scrammed atsures. They called my wife,
scrammed at my wife, and sothen she called me and I go and
she was really screaming at me.Put it in writing. Put it in
writing, You'll be happy to pay. Or what you can do is get
a good faith estimate from someone onfixing that stuff, because it seems pretty
damn minor to me. Mark,Yeah, to fix that vent, and
(44:14):
then what else has to be done? Does your does your swamp cooler have
to be reset or what? Well? I end up paying to get a
new one set because wait, well, well, hold hold on, what
are you talking about? A newone? A new swamp cooller? Yeah,
because they had reseaid it it wasso bad. He's not paying for
a new swamp coller. No,And I'm not asking him for that.
(44:35):
I'm not asking him for that.I'm just saying on my own, I
end up paying for that. Butwell, if I get that, then
then all you're looking at. Really, come on, man, let's just
be reasonable. What you're looking atis the vent that needs to be covered
on the bottom, right, Yeah, yes, And I just need communication
with him because how much you holdon around, how much it doesn't need
flashing or what? What did theysay? I just told him I from
(44:59):
the they sent me in, fromthe envoy or the contract I signed with
them. I owe them a littleover two thousand dollars, which I have
and I'm ready to pay them. But there's just no communicating because all they
keep telling me like I talked toher and she goes, we're gonna put
a lien on your house. Mylay and I go, let's reset.
I go, Heather, the nameHeather is the wife. I told her,
(45:19):
tell me what you need, andthen I kept quiet. She told
me exactly bla. You know, she was really upheated. And I go,
I have and I go, okay, are you done? And she
says yes, like okay, Ihave no problem, but the riff inspection
failed and I just need you tocome and fix it. Oh, you'll
just be hearing from my lawyer. And we're putting a lien on the house.
And that's what really scared me isbecause I try to be well,
(45:39):
they can put a lien on thehouse because they give outleans like candy.
So I'm only going to say this. I'm only going to say this.
Once they can put a lean onthe house, you can fight it and
do all that. Okay, youcan also put in writing that you'll cappily
pay them for what they need theremaining part that needs to be done on
(46:00):
I'm just trying every time I tryto get this from Mark Schamanski from Genesis.
You you come in with something new, how much would it cost approximately
to fix that? A couple hundredbucks? A couple hundred bucks. What
I suggest you do is withhold fivehundred dollars and and and have or have
an estimate done on what needs tobe done, and pay the rest to
(46:20):
this roofer and say that you're goingto have it done if he doesn't do
it in a certain number of days, and be done with it. That's
what I would do. Three ohthree seven to one three talk seven one
three eight two five five. Soinstead of holding the whole thing out,
hold out what it will take tofix it. That's that's I don't see
the big deal. I don't seethe big deal. Three oh three seven
one three eight two five five. Now John Fuller is on and I wanted
(46:44):
to talk to him. I gotit to Brad O'Brien too. Damn,
I got both of these experts andI have to take a break. Let
me let me go to Brad realquick here, Brad, this is a
very simple question, so we canprobably answer it on a month to month
lease under the law, it's justmonth month now, I don't know.
Hold on, let me find outfrom her. B Is this a written
lease or a verbal lease. It'sa written lease, a month to month
(47:08):
written lease. Does it say inthat lease anything about rent increases? No?
Oh yeah it does. It doessay that the rent can be increase.
Does it say what you do whenyou increase the rent? Brad?
What? What's the Is there ashort answer on how much notice she has
(47:30):
to give to raise the rent?Uh? Well, rntgrees once every twelve
months, and it's totally advanced noticeto give a rent increase on a month
to month there's no advanced notice.I'm sorry, twenty one days okay,
but it can only be raised onceevery twelve months, right and then twenty
(47:51):
day twenty one day's notice? Howmuch can you increase it? That's really
not especially as the statue, Okay, it's not specified. So this is
the uh, this is the attorney'snumber here. This is Brad O'Brien and
he is a real estate expert,a real estate attorney olslaw dot com and
(48:14):
he has all kinds of issues. But again you know he's in business of
real estate law. And it's sevento zero three seven zero seventy three eighty
eight. So b the answer is, you have to give twenty one days
notice and unless, of course thelease says something more than that, but
twenty one day's notice and you canonly do it every twelve months. We

(49:42):
too much exterior stuff right now.How many people are converting to stucco,
you know, not not as manyas i'd like, that's for sure.
I mean, great, it's notthat expensive. I think people are I
think that's gonna be really super expensive. They think it's going to be.
Yeah, And so that you know, we don't get as many call as
i'd like because I think it's greatoption. How is the expense? Let's
say, if I have some vinylarstuff I don't like and I want to
(50:05):
convert to stucco, how much moreis it? Then? Let's say,
using James Hardy. James Hardy,is you know you're in the fifteen dollars
a foot range and you're probably talkinga couple bucks extra. That's it.
Yeah, okay, three three sevenone three eight two five five. John
(50:25):
Fuller's on the line. He's anattorney at law now he does personal injury
and mostly auto accidents. My accidentlawyer dot Co. But John, this
is an interesting question, very interesting. Now. Janet had her thyroid problem,
a thibroid problem, a large noduleon her thyroid, and she went
to a surgeon and had it removed, and she still had trouble swallowing.
(50:49):
Now, the swallowing was before thesurgery, end after the surgery, and
the surgeon kept assuring you, Janet, nothing was wrong, right right,
saying, now it's in Jennet, you're cutting way up there. I gotta
I got to establish this. Atfirst they kept telling you there's nothing wrong.
You went to another opinion who toldyou they didn't get all of it
(51:14):
out? Is that right? No, she told me the surgeon that did
it, Oh, she had beenyou. Why did she? But why
does she wait so long to tellyou? Because what happened was I went
to have a swallow study because itwas bothering me. And uh then my
my syroid doctor said there's still some. There's still some, there's still some
(51:37):
in you some, Sir, inyou. Now, did the surgeon offer
to go in and take it out? Yes, she said, we're going
to. She knows, I havebad news for you. There's still sirraate
in you. And I go,well, right, they told me already,
my my syraid doctor. So thenshe says, she said, but
I have even more bad news, and I go with that. She goes,
(52:00):
it might be in your chest cavity. She said, it's grown so
much that it's going it might bein your chest cavity. So I'm going
to have a cardiologist on board. She knows already it's in my chest cavity
because I've been having chest pain, thinking I have uh, you know,
having heart attacks and stuff, andthey're saying, no, your chest,
(52:20):
you know your car The cardiologist said, your chest heart is fine. But
the whole time it's been this thyrideissue. So she said, I'm going
to have a cardiologist on board, and if it is in your chest cavity,
you're going to have to have abetter plate put in with screws.
And then she keeps that but JanetJanet, Janet, Janet, Jennet,
(52:42):
hold on, Okay, let's analyzethis, and I know John Fuller is
going to ask the proper questions. But there is a big difference listen to
this, between having surgery and themnot getting at all where it was there
anyway, or by not getting atall it turned out worse than it would
(53:07):
have been. In other words, you had that problem going in there and
and the invasion into your chest. How much was already invaded into your chest?
I don't know or should they haveknown? And these are all big
questions, John, how do youeven begin to tackle something like this?
Well, Tom helped me understand whatmoved into the chest? What was it
(53:28):
that they were trying to remove? That has now all well? The thyroid?
The thyroid is right, Okay, let's say we point to the bottom
of our threat. Right, Okay, so I've never heard I've never heard
of a thyroid grow a nodule growinginto the chest cavity. But let's say
what that's what they're saying that Ihaven't died of it? Worth You's that
(53:50):
you have never heard of a docNo, no, it could it be.
It doesn't sound anatomically possible. Andalso, if if he did,
John, if you agree with methat if he left the thyroid and jump
surgery, it has to be sosmall that it could not be causing all
of these problems after the fact.Well, I mean what doc is getting
(54:15):
at is, and this is kindof the lawyer's approach to it, is,
you know, there's always this duty, breach, causation and damage it.
Let's just say, for the argumentthat the duty was to remove the
entire thyroid, and they breached itby not doing that. So then you
have to get to the next twoprompts, which is, did that failure
(54:36):
to remove all of the thyroid causeher to be in the condition that she
is today? Or is it perhapstrue that whatever was there had already metastaicized
into other parts of the body, including the lungs of the chest cavity.
And if so, how do youever prove that it never metastasized before the
(54:57):
surgery and it only metastasized as aresult of them leaving what That's what I'm
getting at, right, thyroid?Right? And so the burden of proving
that is going to fall on you, the plaintiff, and it's only going
to be something that you can satisfyby having a doctor of the same basic
credentials saying doctor number one screwed upand cause this, and I can testify
(55:20):
to a reasonable degree of medical probabilitythat your condition today was caused by the
failure of doctor one to remove enoughor all of the thyroid in that original
surgery. Now, now, Iowe me, seems like a big task.
I asked my girlfriend co pilot here, who says that it is rare
(55:42):
but possible that thyroid nodules grow outof the glane itself into the upper chest
cavity. And the condition is knownas substernal thyroid or substernal goiter. And
what happens is it grows. Nowsurgery is recommended, and if they can
(56:05):
extract it through the thyroid, theydo it. But then there is something
more, they said, a substantialinvasive surgery, a stern a stern ectomy
or stern taking out the sternum.Yeah, they're gonna have to think nothing
out but taking out part of it. They have to open that up and
then the plate would have to replaceit. So that's what they're talking about,
(56:28):
a major surgery. Now. ButJanet, your contention, In other
words, here's what you would haveto convince somebody that, Because I know
you're pissed off about this, butJanet, it could be that that was
there that was going to have tobe done anyway, and she just instead
of doing it once, you haveto do it twice. That that is
(56:49):
that could be the situation. Inother words, if you're having the same
symptoms then they took out, youknow, ninety nine or ninety eight percent
of it on top, then itcould be that when she did that original
surgery, she should have done theyshould have gone further in that surgery,
but the fact that they did notgo further did not cause necessarily the condition
(57:14):
I mean you need. And theonly way to get it done you would
have to have a doctor say theyscrewed up and it's malpractice. You have
to get another similar doctor to saythat. She told me, if you
want a second opinion, I won'tbe mad. I have my friend you
could go see. Yeah, youdon't want to go see a friend.
I don't want to go see yourfriends. And she said, well,
(57:35):
have you seen anybody else? Haveyou talked to anybody else about this?
I go no, there are plentyof doctors. There are plenty of doctors
that will be happy to give youanother opinion, and you're going to tell
them I had this done a yearago. And you know, could they
have seen it a year ago?How much imaging did they do? Can
it doesn't show up on it?After I have this done. When she
(57:55):
came out and talked to my daughter, she goes, it was a rough
surgery, she said. And whenI talked to her now, I told
her, why didn't you if itwas such a resurgery to begin with,
why didn't And I came complaining thatI was still having two symptoms. How
come you didn't do another cat scanor something to make sure? Janet?
Right, Janet, you are mistaking. You're mistaking lack of care for malpractice.
(58:17):
Listening, I'm not saying she's thegreatest person in the world. What
I'm saying is, did that inaction to catch it the first time?
Cause it or wasn't there to beginwith? Martia, Yeah, and if
it was there to begin with, that's what you need someone to determine for
you. Now. I don't knowhow you do that, but John,
(58:39):
as with any malpractice case, shehas to get another doctor right independent Exactly.
One of the laws we have inColorado when it comes to professional malpractice
is called a Certificate of Review statute, and what it basically says, is
that, but when you go tofile a complaint against a professional like a
(58:59):
doctor, you have to already haveon board another expert of the same credentials
that will say that the first doctoractually breached the standard of care. We
call it a standard of care expert. It's not absolutely required before you file
the complaint, but it is requiredwithin a very short period of time after
you file the complaint. So yourfirst step is going to be to find
(59:22):
a doctor that feels like doctor numberone definitely deviated from the standard of care,
and that and this is really important, and that that deviation from the
standard of care caused you to theend the situation that you're in today.
If you can do both of thosethings, then you may very well have
(59:42):
a malpractice case. However, keepin mind there's only a two year statutal
limitation, so all of this needsto happen within this next year ahead of
you, if it's already been ayear by right now, Janet, A
quick question, A quick question,Janet, are they are they willing to
do the follow up surgery at nocost to you? Did they mention that
(01:00:02):
she didn't mention that she's just she'sjust already wants me to see a scheduler.
She said, if I want asecond opinion, she won't be mad,

(01:01:36):
Tom Martino, you're a troubleshooter.Now. Earlier in the show, we
talked about ticket secrets. The womanis going bankrupt, but she collected tons
of deposits on tickets tons and Mark, did you say that sus can probably
(01:01:57):
get some pictures of her. We'llget her on Sleeze Brigade from Facebook In
anyway, Carlos is one of thevictims. Now, we got so many
calls from people who have been scammed. How did your scam happen, Carlos?
When and how? Hey Tom,thanks for having me well. I
bought tickets back in November for theKenny Chesney concert that's supposed to happen here
(01:02:20):
at the end of the month, and then I also bought other tickets for
Miss the Elliott this month, Ithink next week. And I found out
the beginning of June, beginning ofJuly that she went out of business,
and she posted on her Facebook thatshe retained legal counsel. So I'm in
the process right now of trying toget my money back from the bank or
PayPal. But I think since thetransaction happened so long ago, they're I'm
(01:02:46):
having trouble. So I'm trying tofind that a little bit. But there's
I'm a part of a group onFacebook right now, and I think there's
a well over three hundred members now, there's quite a bit of people.
They're putting together a spreadsheet of allthe different transactions that they've lost on that.
I have the spreadsheet. It's amazing. It's amazing to me. And
(01:03:09):
I don't know how you know shekept taking deposits. Did she find out
at the last deposit she was introuble or did she know? Should she
have stopped taking deposits? I mean, that's a lot of money to take
for nothing, right, And Ihave used her before and I've gotten tickets.
That's right. Everyone says that, and the trouble. The earliest trouble
(01:03:32):
I could trace was September twenty twentythree, and then all hell broke loose.
She didn't fulfill anything from September twentytwenty three through June. Now,
I don't know how you go September. Let's see September, October, November,
December, January, February, March, April, May, June.
(01:03:54):
So she went ten full months takingdeposits and not fulfilling tickets. So come
on, I mean that, Ican't see how she goes bankrupt on this.
Yeah, I think the catalyst wasthe Morgan Wallen concert. Apparently she
was right before the concert, shewas asking for tickets for folks to sell
(01:04:15):
her the tickets, and I thinkit's because she had promised others the tickets,
so she was trying to keep itahead a flow. But suddenly,
you know, everybody started asking shewas able to deliver those tickets, and
people started asking for their money back, and it kind of just snow vault.
I bet. I'm not sure exactlyhow she collected so much money and
nothing to show for it right now, I guess, or maybe she does,
(01:04:36):
I don't know. You know,it's gonna, like I said,
it's going to be very difficult, very difficult to prove. But she's going
to have some explaining to do.And I'm hoping that you guys all get
together as creditors and maybe you canship in for an attorney to object to
the bankruptcy in general. Yeah, one person right now is meeting. Actually
(01:04:59):
this morning, they met at teno'clock with an attorney. I haven't heard
any word on what you want tomake sure it's an attorney that is well
versed in challenging bankruptcies, not justany attorney. No good point. And
some of the best for challenging bankruptciesare the ones that file bankruptcies for clients.

do a mold testing, he'll doa mold mitigation. And he says that
recently some mold has been showing upin addicts. Why is that ventilation?
(01:10:51):
And I'm not saying it's recent. What I'm saying is they've been discovered recently
ventilation, So poor ventilation. Walkme through that. So basically, you
want air to transfer in your atticspace every three to four hours, and
it comes in from the bottom throughthe you wanted to come in from the
bottom. It's the soft soft eventsand then come out out of your roof.
(01:11:13):

And so then they're air stagnanair isjust And then they had a water leak

it. You're allowed to take abreak. You don't have to have it
done. You don't have to doonce you file the claim. There's no
time limit on getting it done.Your mortgage company, if you had a
mortgage company, they might put atime limit on it. But no one
(01:12:48):
tells you you have to have itdone in a certain amount of time.
No. Oh, that's what Icalled about it, you know, because
I'm going to ask them that.I think they're starting to, uh the
second portion of it. Yeah, and they said this week coming up,
and I was going to ask somepostponings or and you're certainly listen, you
certainly can do that and no one'sgoing to force you to get it done.
(01:13:11):
Any quicker, James, what's goingon in your life? You have
an issue issue with a builder? What's going on? Hey? Tom?
Hey, So, so long storyshort, We've been in this house for
about three generations. Uh, demolishedthe house next door. They put a
large hole in it. I talkedto the for me. Wait yeah wait
(01:13:34):
wait did you have you talked tome before? Hell sir? Okay,
we had a similar case. Sothey're doing building next door and and and
when they did demolition, it didharm to your home? Correct? So
how old is your home? Oh? Man? I want to say fifty
years around maybe more. Okay,Now here's what I want to know.
(01:14:00):
What kind of damage do they do? So my grappa had it custom bills,
so he did have permits. Theyput the chain link into like concrete
on the bottom, so it's embedded. They started off with like a two
by foot two feet by two foothole. I had to cover that up
because I have dogs. No,no, what did they do to you?
(01:14:21):
What did they do to your property? That's not considered my property?
My fence? Okay, so theyput a hole in. Did they just
think they could do that? Oris it both fences? Whose fence is
it? It's our fence, myfence. We paid to have it built
and it's on your side of theproperty, correct, okay? And and
(01:14:45):
how much How old is that fencetoo? It's about thirty five years old?
What condition is it in? Itwas perfect condition to be when they
got started on the demolition. Andit's a privacy fence or is it a
split re? Well? What isit? So this one, it's only
a chain link which we built likea privacy up behind it just we kind
(01:15:06):
of kind of wanted to keep you. No, I get it, But
the chain link is what's broken.Correct. But the next day, after
I talked to the fore man,I come home after work and they took
about three and a half feet ofthe chain link and the concrete up.
Why I have no idea. Hesaid that. They said, I've talked
to the like the people at thecompany. They said that they would do
(01:15:28):
something about it, and that wasabout about two months ago. Oh,
this is ridiculous. So you,I mean, they don't give any reason
whatsoever. They just just one dayyou noticed that your damn fence is part
of is torn down. Correct,Yes, sir, and I have pictures
(01:15:48):
showing like the progress, the progress, but I mean they've damaged concrete in
the front using their heavy equim manwhich, well, whatever they did they
have to fix. They have tofix whatever they did. Now, are
you dealing with a property owner orare you dealing with the contractor? I
(01:16:09):
believe it is the contractor. Well, if you contacted, does anyone own
that property or is it being builtby the contractor to sell or? Who
owns it? I am not awareof that. I would assume the contractor,
but I'm not. I don't knowwho should I talk to about that.
(01:16:29):
If you have the address, youcan ask the assessor's office who owns
it. You can go online andresearch it. We'll find out who owns
it. Because if you threaten theproperty owner and you say, look,
you have people working there. I'mgoing to hold you responsible. They're going
to do something about it. Iappreciate that. That helps me a lot,
Tom, I appreciate you. Thankyou very much. But start there
(01:16:53):
and call us back because the owneris going to be ultimately responsible because they
hired that person and that that contract. So I will definitely follow through with
that. As soon as I getoff the line with call me back and
let us know how it goes.Thank you. Three oh three seven one
three eight two five five. Brittany, what's going on? Brittany? Bye.
(01:17:14):
It's kind of a long sturry,so I'll try to make it short.
My husband's car was going on Junesecond. We have insurance, Yeah,
we have insurance. It was givento one adjuster. She told me
this was on a Monday, thatby Wednesday we would have a car.
Of course, nobody calls me back. Wednesday, I find out I have
a new adjuster. She never calledme nothing. So then I don't get
a hold of her till the followingday and I couldn't give her another interview.
(01:17:40):
So then she tells me to Icall her back again later on that
day because I didn't have time.I'm at work. She didn't answer she's
in Arizona because I call her atthree o'clock our times, which is two
o'clock the time she's already at home. But our hours are Monday through Friday
eight to five. So then shecalls me back on Monday the tenth are
(01:18:00):
the following Monday to let me knowthat have you gotten a car? I
need to know did they ever giveyou a rental or anything? So they
finally gave us a rental two weekslater, and now we have to return
it because they're saying we've met ourmax and the car just got out of
impound, so they're not even anywherelooking at our car yet. Wait a
minute, so they did recover yourcar too, the police twenty six days
(01:18:24):
later after being an impound. Waithow many days was it an impound?
The car was found on six totwo. It was stolen on six to
one. Thank god, are youkidding me? So you mean to tell
me your car was stolen on thefirst and they found it the next day
and you didn't know about it.No, the police called us. It
(01:18:45):
was stolen in the ninth and itwas parked off to the side. We
live in a town home and soWe didn't realize it because we only have
a one car garage. So whenthey recovered it, they took it to
impound. Yes, and it wasan inpound for how long it was from
six to two to six twenty six? But why why was it there so
long? Is what I'm trying tofigure out. Yeah, they told us
(01:19:06):
that they were going to have theappraiser go there. Well, then they
could never get into the car thelock, but then nobody called us to
release the car until six twenty one, and then they didn't pick up the
car till six twenty six. Arethey paying for all those impound fees?
That's what she said. But theysent us a certified letter stating how much
it is. And now my husband'scar is not fixed and we have to
(01:19:28):
return the car on the thirteenth becausewe only had three thousand dollars limits.
Well tell me this, well, well tell me this. That limit is
what you're insured for. There's there'snot much you can do about that.
But are they suposed to give usa car match? And they didn't.
They gave us a car that costover one hundred and ten dollars a day.
What do you mean, what didyou want something less than that.
(01:19:50):
Yeah, so they were supposed togive us. My husband, he just
has a hun day like. It'sa little car like. They were supposed
to give us one that was supposedto match, but the Enterprise didn't have
it. So they told us thatthey were going to charge the insurance the
four hundred and twenty dollars a weekit was supposed to cost. But instead
they're charging them like eight hundred. So I told them they need to call
Enterprise and get that figured out.I see you're saying you would have been
(01:20:12):
able to have the car longer ifyou didn't have if you if you weren't
paid, if you didn't pay somuch. Yeah, they shouldn't have left
it in the impound. When yousigned the contract with Enterprise, does you
knew what the daily rate was rightor not? No, there wasn't.
They we didn't sign anything. Itwas all through the insurance. Wait,
you never signed You never signed forthis car. My husband did sign for
(01:20:38):
the car, but there was nothingabout the rate it so that it would
be built to insurance. Okay,oh man, what a mess. When
is your car going to be ready? They don't know. She said,
it's still on your appraisal. That'swhat They're not even moving their feet.
I've asked for supervisors. So yourmain deal is you need a replacement car
while they screw around with you.Yep, and they won't do it.
(01:21:00):
And you're saying they carelessly paid toomuch. Yeah, exactly. And then
I mean she said, who knowswhen it's going to be done, But
we're still paying the freemium, we'restill paying the car payment. And now
we have no car. And myhusband works in heavy construction. He goes
from site to site. They toldus to get a lift. Well,
(01:21:23):
okay, that's okay, that's ridiculous. Hold on a second. I gotta
figure this one out. We gotto figure out what we can do for
you. I want to call upour insurance experts and get their opinion.

with Remax Alliance three all three ninetwo zero sixteen twenty two. Hi Tom
Martine here three all three seven onethree eight two five five. I want
to bring up Brian Burns from CompassInsurance Group and also Brittany who's insured by
(01:22:29):
E Insurance. Hey, Brian, what do you know about E insurance?
I think it's just insurance, right, Oh, that's what I meant insurance.
That's right, okay, correct,You know, you just go directly
online and get quote yourself an issue, that kind of thing. Now,
so she she's uh uh insured bythem, and she has a certain amount
(01:22:51):
of rental car coverage. And thatrental car coverage here's the deal. He
thinks it should be extended because theypaid too much and exhausted her three thousand
dollars. So have you heard ofrental car insurance that has a dollar limit?
Brian? Yeah, yeah, Ido well, And it always has
(01:23:14):
a dollar limit. It's usually aper day limit, but I have seen
it where it's just a blanket amountfor you know, until it runs out.
Now, what she said was her. She has a car that if
they replaced it properly, would haveonly cost a certain amount. But they
didn't have that car, so theythey gave her an upgraded car, which
(01:23:36):
ran exhausted her funds sooner. Doesthat make sense? Do you think?
Do you think that's a legit objectionto get some extension of rental car coverage?
I don't think so. I mean, it wasn't there. I mean,
in other words, there wasn't anotheroption available, is what they were
probably going to say. Right,They just gave her the next best option
(01:23:59):
that they had available. What shesaid was that Enterprise promised to charge the
lower rate because they didn't have thatcar in stock. But Brittany, do
you did they actually say that toyou? Did Enterprise say we're going to
charge you less? Yeah. Whenwe spoke to them, we let them
know because all our insurance is carmatch guarantee, and we let them know
(01:24:23):
like this is a twenty twenty fourg Brangler. So and they because they
wanted us to wait a week, but we're understanding. So they said that
they would work it out with theinsurance. So you got an upgraded car
and ran out of coverage sooner,We get that. Yeah, but had
they charged you the proper amount, how much longer would you have that rental?
(01:24:45):
Probably at least another two and ahalf weeks. And is that going
to be enough time even to makeyou haul I don't think so. I
don't know. Nowadays's having a stolencar and it was recovered, Brian,
it sat an inpound for thirty days. Who knows what has to be done
to it to fix it. Butnowadays a stolen car, even after they
(01:25:10):
recover it, you're looking at twoor three months after that. Yeah,
so it's a long period of time. I'll tell you this, the only
time I've had luck getting an insurancecompany to extend like in this case,
I'd even it sounds more like anenterprise problem than it was the insurance company.
If they're being charged, I don'tknow that the insurance company isn't refusing
(01:25:30):
to pay. You're right, itis. And but you know, she
has no documentation that they didn't havethe other car. I mean, it
looks to the insurance company like thiswoman took advantage of them. Well,
but even if what I'm saying isreally that has nothing to do with the
insurance company, they don't they're justsaying it's a dollar amount, and is
what she said, right? Right, that's right. Yeah, so the
(01:25:53):
dollar amount is the dollar amount. They don't really care what kind of car
you get. Yeah, and thenyou're the if Enterprise said they were going
to do it for for less money. Her issue was with Enterprise. So
when you brought that up to enterprise, and you're right about that, Brian,
when you brought that up to enterprise, Brittany, what did they say
about that? That they would workit out with the insurance. But my
other problem is is I was toldthat they were going to go to the
(01:26:15):
impound lot five days after the carwas recovered. That's I'm saying there's more
to this than just the issue withthe rental car. They let it stay
an impound for so long because butI was told that they were going to
be working on it. It waslike that's where all Brian. You know,
we've heard this argument a lot frompeople. Does the insurance company have
a duty to get things done quickly? Well, I mean it's kind of
(01:26:41):
a gray area, and the policyit just says, you know, it
doesn't have a specific time in whichthey have to do things right now,
where I was starting to say thelast time was that. The only time
I've been successful in getting insurance comingto extend rental coverage is if I was
able to argue that it was purelytheir you know, negligence that extended the
(01:27:02):
loss. And that's kind of whatshe's saying here is, Hey, if
you guys would have gone over there, I wouldn't have run out. Why
are you taking so long? Sobut the problem is she doesn't have an
agent she's got to correctly with that'sright Assurance, that's right claim adjuster.
So she has no one to fighther case. That's the problem, and
Assurance couldn't care less if she decidesto cancel. They there's not one person
(01:27:26):
she can talk to there. Nobodycalls me. Nobody calls me, the
insurance adjuster, the supervisors. Iasked for the supervisor's boss. Nobody's called
me, like where I have minimalcommunication. So, yeah, how much
were you paying for this insurance?I'm curious our premium. It's five hundred
and ninety dollars a month. Wehave two cars, a twenty twenty Kia
(01:27:50):
and a twenty thirteen hundred that hasfull coverage. Like and they're fully covered
gap and all. Do you haveyoung drivers? No, that seems pretty
high. That seems way high. And I have no idea unless you have
tickets for actions. I mean,I don't know what do you understand?
(01:28:10):
You're you're you're paying a lot ofmoney, sister, You're you're paying a
lot of money. Is one ofthose Insurance is one of those companies that
I see people go to when they'rewanting minimum liability and just terrible. I
mean, you know, it's notusually good coverage. That's That's how I
will say it. And I'm notsaying that's because of inassurance, but it's
(01:28:30):
because of the coverage that that peoplepick when they do it. Uh.
But yeah, the problem you're havingis exactly the issue is that when there
is a problem, you have nobodyto go to. And that's I wish
I could help you, but they'renot going to listen to me. I
don't have any now here here's andyou don't have another party to go after,
Brittany. Now, so you're stuck. I mean, we're trying to
(01:28:55):
find a solution, but I meanI think you're gonna have to ask Enterprise.
If you said to them, youended up charging our insurance company more
than the rate we needed. Whatdo they say? I haven't called them.
I literally just found this out today. This is what I would call
them. I would call them andsay, your agent. Do you think
(01:29:18):
the agent will flat out deny it? Your agent said you didn't have a
similar car to ours available and wewere forced to upgrade, but they said
they would honor the lower rate.Just tell them flat out and see what
they say. Okay, and doyou do you know for a fact that
they did charge you more? Imean, are you able to see what
(01:29:40):
the do you have any idea whatthey were? Yeh, she knows that
that's what they did. We wantedto just pay for it. At this
point, my husband needs a car. He has to work, like,
we've lost so much money and hewas just working for dealing with this meant
and they're charging one hundred and tendollars a day. Yeah, I'm like,
oh, absolutely not so, Imean on this car, is that
(01:30:04):
what part of the cost is orthey charging you for insurance on it?
No, they told us that wedidn't need it because we have insurance.
Okay, Well, the one hundredand ten a day is just a lot
for just the actual realm car.It seems to me, Well it's a
jeep A twenty twenty four hybrid.Yeah, OK, you got way more
car. I think you got talkedinto it from this. I think that
(01:30:26):
enterprise person was not straight with you. I would call and complain to the
manager of that location. Call usback, tell you know, tell him,
Look, you know, even ifwe want to rent a car,
we need your very best rate becauseyou guys screwed us on this. And
see what they say to you,and then call us back. I'll mark
this. I mean, we needyou need to do something now to speed
(01:30:47):
up the claim. Good luck,There's not much you can do about it,
and you may be without a car, Brittany, I hate to tell
you this for ninety days easily days, and everyone listening needs to know this.
So Brian, what do you recommendI need to know that. What
(01:31:08):
do you recommend for adequate rental carcoverage? Well, I would say exactly
what I was trying to get outthere. If she was paying for their
insurance, I would tell her don'tdo it. I would just use your
own insurance, right, I knowthat, But what about coverage rental car
coverage in my policy? Like, for example, gotcha, yeah, yeah,
(01:31:30):
yeah, how many? What coveragedo I have? Well, yours
is different as a set amount aswell. I think it's five thousand dollars,
which is very abnormal. That's ahigh amount for rental car most companies,
though, I see people all thetime coming from State Farm and or
one of these captive carriers that haveyou know, twenty dollars a day,
thirty days max, or even fifteendays max. And if you have an
(01:31:55):
accident, you're going to run outreally really quick. You won't have enough
to do anything. So I wouldI would encourage going up to at least
if you can get a set amountwhere like she had, that's great,
or if it's a per day,I would. I wouldn't go less than
fifty a day. Yeah, Andthis is the problem. People are right
(01:32:15):

seven one three A two five fiveso on on we have a text here
(01:33:24):
one though, you said you youcan treat the mold and kill it by
the way Genesis tootalexteriors dot com. They do mold detection and mitigation in addition
to everything else on the outside ofyour house, and then when weather permits
or when it's they do shift toindoor stuff as well. But okay,
so what do you how do youtreat it? Are there special things you
(01:33:46):
can treat it with? There's there'sdifferent there's different chemicals that are designed for
this, you know, the onethat's like an inside of an attic space
we spray this on there, andwe come back the next day it's gone.
Wow. Now listen, this iscommercial grade stuff, right ye.
Now, what I want to knowis when do you have to actually replace
the wood stuff, like cut itout and replace if it's rotten. Okay,
(01:34:10):
yeah, I mean it's you knowit, it's rotten. But mold
in and of itself can be killedand treat it. So does mold get
inside the wood? I mean,I mean, I guess you know what.
Mold lives on the surface because that'swhy it does. Could have worked
the way in probably, and sothat's why we see it. When we're
done, that's we seal it.Okay, and you see so when you
(01:34:31):
get to but you can tell itsimply is if the wood's rotten or not.
Well, you see, there's alot of unscrupulous contractors, Mark who
we've handled these cases in the past, where they tell people, oh no,
no, once mold touched it,we got to cut out those studs
and cut out that dry wall andcut out this well not dry drywall maybe,
(01:34:53):
but when they start talking about cuttingout studs and crap like that,
come on, no, you justyou have to treat it and then encapsulate
it after that, you know, and we're all breathing mold right now.
You and I a breathing as we'regoing. And just this had an opportunity
to sit on side time of organiccompound, which allows it to give a
food source, moisture and heat.Again, the easiest won to eliminate is
(01:35:16):
is moisture. So we got tokeep water away and that stops molds growth.
And that's usually what starts it too, right right in cash when you're
doing this work, you have toset up barriers and everything, and you
have to have a negative air pressurein the in the area that you're doing
the work, so you know you'renot contaminating other parts of the house.
You got to get it out andthen you got to you baging it all
up, like all the insulation inan attic needs to come out. We
(01:35:38):
bag it all up and it getssent off to the dump, double bagged,
and then redo it. Yep,And so there's okay. Now,
can mold spread mold in other words, without a source of food or not?
Or does it just does it justdie? So let's let's say you
have molded at home. You founda spot in your house. It's one
(01:35:58):
little spot and you say, well, I'm just going to take care of
because I don't think it's anywhere elsein my house. You can take care
of it. You never want tospray it by using a spray bottle.
The mist that's going out to you'retrying to kill with us. They use
lyesol. Also in you're spreading sporesby doing okay, and what are those
That's what I'm asking those. Well, those spores spread out and get on
something, don't they still need afood source? They need a food source.
(01:36:20):
But you know, everything's a foodsource. I mean, so if
those spores went out and got onfurniture, it's not gonna do anything.
Well, no, I mean it'sit's some type of source. If there's
wood in that furniture, there's cottonthat it's made in the fact, does
it need continual moisture, needs continualmoisture, So if it doesn't get the
moisture, that will eventually just dieoff it, yeah, or just de
(01:36:43):
dormant. Yes, And okay, all right, And do you do air
testing? Yes, we do,Okay, So when you do air testing,
do you ever find that there's moldin a house in an attic or
somewhere, but it didn't get intothe air. Oh all the time,
okay, because if that area iscontained or closed, then it's not desinantly
(01:37:05):
going to go into other parts ofthe house. I'm not going to mention
this guy's name, but if hewants to, we can call in.
But he's a home inspector that saidthat mold. Now here's what he said,
not the spores in the air,but the actual mold itself. The
presence of mold affects your health. And I said that is not possible.
(01:37:30):
He said, Well, when Iwalk into a home, there could be
mold in the attic, or therecould be mold in the basement, and
I'll know I'll get sick right away, and it doesn't matter if it's in
the air or not. Well, that's ridiculous because the only thing that can
spread mold it's in the air oryou touch it right right. Yeah,
And so you know we always ourcontrol space that we checked to see if
(01:37:53):
you have a high levels of moldis outside your home. You know,
you'd be fifteen twenty five feet awayfrom your home, and we do an
air sam there. Why because that'sthe control that's what our environment is,
and you want to make sure youhave less mold inside the home than you
do on your from your control, because no matter what you do, if
you had a lot, if youwere in an area with a lot of
(01:38:14):
mold, nothing you do in thehouse is going to help. Right,
Have you found that ever? Sometimes? Yes? So I'm like, if
you live near bodies of water, can that contribute? It could? But
you know again, is it's stilla dry you know, okay, Arizona
it's even drier than here. Youlive near a lake, Well, it's
probably you're still not going to havehis mold issues again. Colorado on General's
dry also, so it's nothing likeyou down south that has a lot more
(01:38:39):
mold problems there that you maybe youcan't even control it because it's so bad.

He is in the middle of divorceright now. And okay, he moved

we paid it, when we paidthe money, we were never told that
(01:40:33):
there was no hot water. Theysaid it'll be fixed, that it would
be fixed the next day. Howlong was it? How long has he
been there every day? We've beenthere a week and there are a lot
of people there. Do you thinkit's broken or the uh, the owner
or the manager's playing games? I'mnot really sure which. We were told

that that the city came out tofix it and lock the doors and won't
let them turn the gas on forsome reason. Now, this is what
we were told from the people atthe front desk. Okay, they were
told that is so they turned off. They would turn off the gas with
an unsafe situation. Correct, Butthe city when you said the city came
(01:41:19):
out to fix it, what doyou mean you mean a plumber came out
to fix it or what you know? All honesty, Tom, I don't
know the exact situation. I justknow that. Okay, let's have somebody

just want to ask a question, why don't you just move him to another
hotel? Because I've already paid andyou get your money back. Would they

How much did you pay up front? So the first week was four hundred

now, I'm gonna tell you something. This is the first time. Now
I've been doing the show for fortyfive years. Forty five years in Denver,
no longer, maybe, no,forty five in Denver. Right now,
(01:45:00):
I'm gonna tell you something. Andwe have never had a complaint.
Now, I'm not associated with thiscompany. I don't endure some I don't
think they're bad, but we've neverhad a complain about them. I just
wanted to say that never, andI'm shocked I've used them. Tom Yeah.
Now again, I'm not singing theirpraises, saying, you know,
it can't be possible. I'm notsaying. And they're not on my referral
(01:45:23):

is part marketing, of course. But but I just wanted to say that
because I was shocked when I sawwho you were complaining about So what's going
on, Drew? I know,I know, man, it's I thought
the same thing, and I couldbe overreacting, so I'm not sure.
So let me get your your take. Sure. And so I did a
(01:45:45):
kitchen remodel with them, And whydon't you say, since everyone's probably wondering,
it's done right, correct, doneright yep. Now, by the
way, they normally okay, okay, keep going, keep going. Well,
I just like a twenty thousand dollarskitchen remodel with them. And the
when a salesman came out, hebasically said, you know, you don't
(01:46:08):
you know, have to pay untilyou're one hundred percent satisfied, you know,
basically said, you know, we'vebeen in business for so long,
you know, our family run allthat kind of stuff. And ever since
basically I did the initial down payment, it hasn't really gone that well.
They've kind of been nickel and dimingme for every little thing. We're pretty
much at the end of it.Now hold on, I mean you are
(01:46:30):
you have a contract right that spelledout correct? Let me let me give
you just a couple of things. So when so I wanted to I have
all new appliances, but a microwave. So I wanted to add a new
microwave. Well, the sales guywho is out here said, we don't
sell just microwaves, but if youbuy one, we'll go ahead and sell
it for you when we do thewhole you know, renovation. So I
(01:46:54):
said great, So I bought oneand I want them to insall it.
But now they're saying it's not oncontract, so I have to pay extra
for that, even though the salesguy told me that he would do it.
What do you think, Mark,I mean in general? Well,
again, hold on, I wantto hear Mark Shmancy is a great guy
and he's been in the business, and he won't you know, he's not
going to slam anybody. He's notgoing to praise anybody. He'll give his
(01:47:15):
honest opinion. What do you think, Mark, And just the way you
were in the said it is likeyou know, he said, well,
yeah, well install it for you. But I don't think he was implying
he's going to do it for freeeither. And again I don't know.
Is it just you're gonna put thebracket up and you have to hang it.
It's it's about an hour job.Hour and a half job. But
they should be compensated for that. How much did they how much did they
want for it? Did they sayfor one hundred and fifty But I'm pretty
(01:47:39):
sure this is it's nothing, man, Okay, go ahead, No,
no, but go ahead, ButI want you to know something. I'm
not really sticking up for them.I'm just trying to give you perspective.
Go ahead, No, and that'swhat I that's what I want. That's
yeah. And then just another coupleother things. They all were small,
but just like after they came out, or actually after they gave me the
(01:47:59):
initial they came out and did somemeasurements and they found out that they had
to move another cabin in over afew inches, and they charged me for
that. And again it's not alot of money. Again, it was
just like another one hundred and fiftydollars. And why wasn't that on the
original contract? Did they say,no, he just didn't notice it,
(01:48:19):
the original the sales guy that didthe original contract. Okay, So I
mean that's about it. But I'mjust kind of wondering were those the only
were those the only two things? There's one section I also outside of the
kitchen I had a little desk areaalso done where I had the cabinets refinished
in a new piece of countertop putdown, and the countertop doesn't look very
(01:48:44):
good where they put it down. There there's some spacing in between the walls
and the countertop. Okay, now, hold on, hold on. When
it comes to the first two complaintsyou had, I think they're what's called
nothing burgers. You were charge onehundred and fifty bucks to assaw the microwave,
and then they had to move acabinet they didn't see on the original
(01:49:06):
or they didn't notice it, andthey charge you twenty five bucks another one
fifty Yeah, okay, I getit all right. So okay, they'll
say were change orders and you say, well, I do know what you
mean about the moving of the cabinet, not the microwave, but the moving
of the cabinet, and that isI'd feel like, wait a minute,
(01:49:27):
come on, man, you knowyou guys, I didn't hold you back
from seeing that. I mean,if they took measurement, I would have
eaten that if I was in thebiz. I'm with you on that.
So okay. So now you goto this countertop and that seems like the
first legit thing. And I saywith legit, they're all legit to you.
But I mean that's one would botherme. Now if they did a
(01:49:47):
countertop and didn't didn't space it properly, What were you mean saying I didn't
measure it right, didn't do thetempt correctly? Possibly, I mean,
you shouldn't have any gapping. Andwhat are they doing about it? Nothing?
But I think what the issue is. No, wait a minute,
wait, have you actually looked andasked them directly to do something about that?
(01:50:10):
No, because I'm actually not quitesure what to ask. Well,
then that's why they're not. Imean, so, so, Drew,
have you had home improven sone before? Oh? Yes, yeah. Have
you had issues in the past,Oh no, this is the first time
I've actually had anything come up.Okay, Now, when when you say
that you don't like the way thecounter looks, and that's on the outside
(01:50:33):
of the kitchen, correct? Andwhat what is it? What is it
outside of the kitchen? It's justa little desk area. And that's okay.
I wanted to kind of explain. So before there was like maybe like
a three inch I don't know ifit's called like backsplash, but little like
three inch thing going around it.And they took that out because the sales
(01:50:56):
guy told me at the desk area, it would look cleaner if you just
have just the solid death surface andnothing else there. So they ripped out
that three inches there and then justslid in ato countertop. So now all
around that three inches, you know, it looks terrible. Wait a minute,
I got to fix the dry wall. Wait, wait a minute,
Wait a minute, wait a minute. And they ripped out the backsplash and
(01:51:18):
put in a desktop, right correct. What was where the desktop was?
What was there before the desktop justold countertops okay, got it, got
top, And so they just puta like a granite countertop in between those
two walls there, right correct.Correct. They created a cubby with lake
(01:51:40):
space so you could sit there likea desk, right correct. Yeah,
okay, and before that you couldn'tbecause it was a cabinet. No before,
it was the same thing. Theydidn't change anything physically. The only
difference is they just took out likethat little three inch barrier that had the
backsplash going around and basically a wallon three sides. It's a wall on
three sides. They took the backsplashout and put a granite top in there,
(01:52:01):
right, correct, Yeah, that'sall they did. Well, and
they left a gap. Well again, it's not huge. I can send
you a picture but yet, butI don't care. They left the gap
between the back of your desk andthe wall. And did they fix the
drywall there too? Did they fixthe drywall? No? No, so
that's what wait wait wait wait waitwait, Well they don't expect to leave
(01:52:25):
it that way, do they.I mean they're they're done. The guy
he's finishing up now. No,wait a minute, wait a minute.
When you told them you wanted thedesk redone, they thought you just wanted
them shoving in a granite top andnot trimming it. Correct, that's what
they did that. Well, youcould fix the drywall and have the drywall
(01:52:45):
take care of that gap. Wellyou can, but they're not doing that.
How could you ever leave that unlessthey thought you were going to somehow
you said to them, oh,by the way, can you just put
a granite piece in here? Imean, I don't know how it was
worded. What does this say onthe contract? Well, I think that's
how the sales guy sold it,because he told me. He goes,
this is, you know, adesk area, So normally we don't do
(01:53:08):
backsplash or any kind of Well,it doesn't matter if you don't do bag,
they don't leave it just torn up. Okay, that's well, that
was my question. I don't know. I don't know that. Did you
did you actually call? Did youcall and ask to talk to one of
the chikkinis? No, but there'sa project manager. And I told him
I I didn't talk to him aboutthe countertop, but I told him I
(01:53:30):
wasn't happy about the microwave, andhe was just a real jerk and said
we're not in the business of doingthings for free, and just was a
real jerk. And I just said, okay, well I agree with that,
by the way, but I alsothink he missed price. Your job
missed the fact. I think thatthey should have eaten it if they missed
that they had to move a cabinet, right, I agree with you on
(01:53:53):
that. I agree. Yeah,I think the microwave's chargeable, the cabinet's
not. Okay, Yeah, didthey say on that cabinet they had to
move? He say, oops,we didn't realize we have to move this.
Yeah. Yeah, And he justdid it as a change order and
charged me for it. But didyou say to him, well, why
didn't you notice it? No,because that was the first thing that happened.
(01:54:13):
So I'm just like, all right, it's not a big deal.
I'll just go, you know,do it. What's one hundred and fifty
dollars? No? No, Ican see why seemingly small things to you
added up. And I think exactly, I think Dan Giukini would want to
know about it. I would callhim personally if I were you right now,
and say, listen, you knowwhat, I don't mind paying for
the installation of the microwave. Ithought he said he'd disslve, but that's
fine you guys. But I wouldnever have inferred when he said, but
(01:54:36):
we can assolve for you that itwas going to be free anyway. I
don't think they did anything wrong withthe microwave. I don't even know if
i'd bring that up. But whatI would say is this. Here's what
I would bring up. I'd say, you know, Dan, I hired
you guys, and you gave mea price. And then he says he
missed this, that he has tomove this cabinet and immediately. I paid
(01:54:58):
an extra one hundred and fifty bucks. Why didn't he see it? I
didn't hide it. I mean,it wasn't hidden from you. It's different
when change orders come from when youopen up or take remove a cabinet and
see a rotting floor joist. There'sall kinds of things that can happen that
are that are legit change orders.I don't think that was one of them,
if you're portraying it properly, thatthey saw that a cabinet needed to
(01:55:21):
be moved and they said, oh, sorry, we missed this. You
got to pay for it now onehundred and fifty bucks after they gave you
a price. And the other thingis the desk area. If the guy
says, oh, yeah, wecan put a granite piece in there,
but if it's going to be adesk, you don't want to backsplash.
But then to tear out the backsplashand leave it unfinished is unheard of.
(01:55:44):
I mean, what does the guysay about that? Well, Again,
to be fair, I haven't broughtup that part too. You need to
send me a picture. You needto send me a picture. I find
it. I'm actually finding a hardwell. But one thing I'll say the
desk is in a different area ofthe kitchen. They might have just forgot
and if they need to point itout, maybe okay. But here's what

(01:57:10):
this picture the guy sent me.So I don't want to exaggerate on this
because done right. I mean, when I have been in this business for
forty five years and never get acomplaint, I got to figure out they're
doing something, are right right? And again they're not. They're not any
and I'm not connected to them inany way. But Drew said it was
pretty unpleasant and he had a coupleof things he didn't like. I think
(01:57:31):
one of them was not anything tothe sweat about. But I think he
has two legit problems. But hehasn't asked for anything yet, so I
think he needs to ask. Weshouldn't even be involved at this point.
He should ask Dane Shacchini or thefamily whoever at one of them say look,
here's the situation. This desk isclearly an oversight. If you paid
(01:57:53):
to have a desk put in there, and a and a granite slab be
put in there like they did orwhatever that is, quartz or whatever,
there's no way they should leave itlike that, No way in hell.
What it looks like is this. They took the cabinet out that was there,
or the desk, I mean thatwas there, whatever in that cubby
(01:58:14):
they tore out the backsplash and thenthey put in a piece of granite or
stone. They did not trim aroundit, they did not fix the drywall,
and they left it like that. Now, come on, that goes
without saying that should be fixed andthat should have been included when they quoted
it. The other thing is hesaid they had to move a cabinet that
(01:58:41):
they didn't see beforehand and charged inone hundred and fifty for that. In
my opinion of that, you signeda contract and that wasn't something you hid
from them. That was something theycould have seen and they missed it.
They should do it now. It'sdifferent, as I said, if they
uncover something and there's a chain thathas to be made or additional work that
(01:59:01):
has to be done. But ifthat cabinet was there the whole time and
they say, oh, we haveto move this cabinet, it's going to
be an extra one hundred and fiftybucks, well screw you. I don't
like that idea. But again hehasn't brought it up yet, and he
should. So this is Drew.So Drew, thanks for the picture.
I would be upset too, andI wouldn't be over the upset and I
(01:59:25):
wouldn't say the entire thing was abust experience if they did that whole job.
But I really want to know whatthey tell you. Do you have
a way I can get in touchwith Dan you mean the owner? I
mean if you call over there andask or shouldn't they let you talk to
him? Yeah? Yeah, butyou know what, I would start with
your sales rep. I mean, even though he sounded like he was a
jerk about the microwave, I'd givehim one more shot. And if you're
(01:59:48):
not happy with his response, thenyeah, go up the ladder. Yeah,
we'll do right. Okay, Sothen call us back and let us

Hi Tom Martino, you're troubleshooter,Kelly says, uh having an issue,
he bought a twenty eighteen four Runner, and UH bought an extended warranty.
So tell your story. What's goingon, man, Hey, Tom,
Just a real brief history on it. I went to Pueblo, Toyota t
(02:01:00):
get a pick up, and Ipicked up a Nissan Titan, and they
kept throwing check engine lights. Soeventually we took it back there, and
that's how I ended up in thefore Runner, Okay, and I didn't
even want, you know, theForerunner. But no other dealership would touch
the Titan because I took it inthere four times, and of course that
shows up on the service history forthem to fix the service engine light.
(02:01:23):
So the only thing I'd find worthtrading it in there was the a Toyota
four Runner, since no other dealershipwould touch the Titan. And then I
found a really good deal on anothertruck at a different dealership after picking up
the twenty eighteen four Runner a fewweeks later and traded it in and they
Uh, so I had barely evenused any of the extended warranty at all?
(02:01:45):
Oh wait a minute, so youyou don't have the twenty eighteen Toyota
four Runner anymore? No, sir, I traded it in. That's why
I need to. They're supposed torefund me the difference on the Okay,
and yeah, yes, yes theyshould, warranty, Yes they should.
How long did you own it?Just a few weeks? Oh? Man,
(02:02:10):
Okay and Pueblo Toyota. When youbought this extended warranty? Was it
on the fore Runner or was iton the previous car transferred to the fraor
Runner? What was it? Itwas strictly on the strictly on the fore
Runner. That makes things very easy. And how much How much of a
warranty is it? Like? Howlong? Oh? Gosh? I think
(02:02:32):
it was five year, one hundredthousand mile? Which ever came first,
I believe, okay? And howmuch did you pay for it? I
believe it was twenty nine to fifty. I unfortunately work, so I don't
have all the paperwork in front ofme, but I know it was right
at three thousand. I think itwas twenty nine and fifty. Kelly,
(02:02:53):
did did the contract specifically have anythingabout terminating the lease. No, no,
no, no, you mean that, I mean the extended warranty.
I mean the warranty. Normally, the attorney general in this state took a
grim view on people trying to keepmoney for an unused warranty that should be
(02:03:14):
pro rated. Yeah, how muchdid they say you had coming? They
won't give me an amount. Ican't never get anybody to Okay, did
you tell me? I may haveasked, how much did you pay for
this warranty? About grand Okay?Yeah, I think it was right at
three thousand dollars. Okay. Nowthey they're trying to keep your money.
(02:03:36):
That's pretty obvious. And there's acouple of reasons for this. Maybe you
never really bought a warranty and theyjust took that money from you. That
happens once in a while and youcaught them, or or they just want
to keep the money. So youhave proof you paid, you traded in
(02:03:57):
the car, And what does thecontract say about termination? I don't have
the contract. What I have asan e signed document, what does I
say it to them on? Itjust ows the termination of the contract and
the mileage and the date the vehiclewas traded in. Well, you need
(02:04:18):
to get a copy of the contractthat you signed. Wait a minute,
the original contract when you traded thisin, that extended warranty was discontinued,
right, correct. How do youknow that? Well, that's I called
them to tell them the vehicle wastraded in and I was canceling the worthy
(02:04:41):
and then they asked for proof.Okay, got it, I got it.
Okay, So they did ask forproof, and now they do owe
you, yes, sir, butyou can't calculate how much they owe you.
But you only had it a fewweeks. No, that is correct.
Well, they're going to owe youmost of that money. Yeah,
I believe. So when was thelast time you talked to him? At
(02:05:04):
Pueblo Toyota. I spoke to aguy named Chris Aragon, probably about two
and a half weeks ago, andthey've just stamled you and I, yes,
sir, yeah, I've got multipleemails. I've copied their general manager
on it. Chris Aragon is thedirector of finance and the initial person I
(02:05:27):
dealt with was a guy named DerekPeasley who was in finance but has been
moved to the sales floor. Andhe's the one that dropped the ball initially
on even submitting my paperwork for thetermination of the contract. Okay, I'll
give them a call to Yeah, yeah, I'm gonna we got a call
for you because I don't know whatthey're trying to pull here. Now they
(02:05:47):
and doc. If they say toyou, well, this is non cancelal
that's not true. You can't dothat in Colorado and it's been proven.
Now now you need to try toget Kelly a copy of your warranty or
your contract for the warranty. Imean you need to We need to see
that now. I We'll still callthem and they're gonna b ss though and
(02:06:10):
try to say it was non Didthey ever mention to you that you couldn't
cancel it? Did they ever say, well, we're not giving you a
refund because you can't cancel it.No, they have never stated that.
What they keep saying is it's sixto eight weeks, and then it changed
to eight to ten weeks, andit's been seventy six days, so they've
passed the ten week mark. Seeoh man, that yeah, they're trying
to keep your money. We'll geton nick case Kelly, all right,
(02:06:35):
hang on, okay, bro,and we'll we'll we'll talk about this.

(02:07:24):
troubleshooter. You know I have founda fascinating survey online. Oh man,
I'm telling you, I think evenDragon's gonna like this. One of what
people do in bed with gadgets. Now we're talking about toys. No,
(02:07:44):
no, no, no, no, I mean, hey, bro Kelly,
calm down. We're talking about nonsex gadgets. Tech oh tech gadget.
Yeah, So it's very very interesting. First of all, do you
use tech in bed? I usemy phone all the time in bed?
(02:08:05):
Oh yeah, I check the messageall the time. Right, okay,
Now what do you use your phonefor or your tech for in bed?
What? There were four countries wherethe far top countries for watching porn in
bed? You want to take astab at them. I know you're gonna
think, what. Well, thenumber one is US, but it's tied
(02:08:28):
with come on, Spain. Isdoes a US stand for Australia or Austria
Australia Australia so US and in Australiain the survey, fifteen percent admit to
watching porn in bed. Right behindthem is Canada, followed by the UK.
(02:08:50):
Now, let's talk about what peoplein the US do in bed with
their devices. The number one thingthey do would be what in the US?
The number one thing they do?They stroll social media on Facebook.
Wait a minute, it's not thenumber one thing. Damn it. They
don't have this arranged right, I'mgonna have to do it. No,
(02:09:11):
they check emails and messages first, that's number one. Then number two is
social media. They just look atsocial media. They like to look at
videos and all that and what doyou think. Do you know fifty four
percent of Americans okay, use inbed their device to watch YouTube. Yeah,
(02:09:39):
I'm not surprised. But here's thedeal. Who do you think in
the world uses their devices more inbed than any other country. I found
this shocking, although maybe not Mexicoreally interesting. Five seven percent of the
(02:10:01):
people surveyed in Mexico, well there, said they use their They say they
use their devices in bed. Yeah, they're freendy outside because of the cartels.
That's kind of like there are twodifferent people, those who use their
phone while pooping and liars. Ohyeah, I always use my phone.
I take my phone. I don'tgo to the restroom. Lists have my
phone. I look for my phonebefore I go. I do it at
(02:10:22):
night. I'll do it in bedand I'll go. There's the problem with
the problem with using your phone inthe restroom is you take too long because
you're looking at your phone. Andmy wife says, are you okay?
And I said, oh, nevermine, I just was I was playing
a game. Your legs get onnumb, I can I know? Yes,
your legs two kidnam, Holy crap, I use and I use yeah
(02:10:46):
yeah, yeah, So anyway, games are addictive. I never thought i'd
like games, but then I readsome research. This is true story.
I read research that there are certaingames that are good for your mind.
And let's face it, I'm seventyand I'm looking at Biden here thinking wait
a minute, No, seriously,I'm thinking, whoa. I want to
(02:11:07):
keep my mind sharp, and thereare games specifically I do for that,
and I love them. I absolutelylove them. I never thought it.
But I don't do gaming like youknow whatever have you ever tried. I
don't do gaming against you. Nocall of duty on your phone, no,
none of that. Now. Ido words games, a lot of
them, but not that one.No, I haven't. That's really good
(02:11:28):
because you play against anybody else.Oh no, I see I want to.
I don't know if I like that, playing against anybody for anything.
I used to do word with friends, but then you got people like Mark
that sheat, you know, becausehe can't put a sentence together and then
he comes out with the most extraordinarywords in the world. I'm just kidding
Mark, if he's listening. Butanyway, here's the deal, here's the
(02:11:48):
true deal. I love those undoingnots. You know, do you ever
see where all the chords are.Oh my god, undoing those chords.
I get a high off of that. That's a dopamine hit for me.
And then what else are I like? Oh? Man, I let you
know speak about words. Did youknow there's a whole subset of mathematics that
(02:12:09):
is devoted to not theory? Whatthere is? There's a branch of mathematics
devoted to not theory. Wow,I gotta I gotta read about that.
