Prosecutors are considering a fourth trial after a former Australian NRL star's rape convictions have been quashed again.

Jarryd Hayne has been released on bail, after spending a year behind bars for being convicted of two counts of sexual intercourse without consent last April.

The verdict has been overturned on the basis that the judge didn't allow further cross-examination on the complainant.

Australian lawyer Michael Bradley says it's in no one's interest for a rape case to be tried three times.

"It's appalling for everyone, it just underlines how broken the system is."

yet another twist in the Jared Haynes sex assault case.
The former NRL star has just had his conviction quashed
in the Court of Appeal for the second time. Michael
Bradley is a managing partner at Mark Lawyers and joins
me now from Sydney him Michael, Hi, is he getting
off on a technic technicality or is this fair enough?

Oh? Well, I mean these are all technicalities whichever way
it goes. The Appeal Court has overturned this conviction on
a couple of Yeah, those technical grounds to do with
the way that the judge, the trial judge conducted the
trial in terms of evidence that he allowed and his

directions to the jury, which the New Pearl Court obviously
came to the view, meant that the conviction was unsound.
So here we are.

Do you think he's going to go to trial because
if he goes to trial again, it'll be the full time,
won't it.

Speaker 2 (01:02):
Yeah, that's going to be in the hands of the
Director of Public Prosecutions. It would be surprising if they
take him to a fourth trial. Usually when it gets
to this sort of point, particularly because he's already served
prison time. There comes a point where, you know, in
terms of the public interest and also just sort of

(01:24):
basic fairness, they will pull the pin. So but yeah,
I mean that's it's a discretionary call for the TP.

Speaker 1 (01:31):
How do you feel about it if they decide to
go with that.

Speaker 2 (01:34):
Oh, look, I mean obviously the whole case has been
a debarcle. You know, it's in no one's interest for
a rape case to be tried three times and it's
appalling for everyone, clear up. Obviously, an ordeal for him,
an awful or deal for the complainant. You know, there

are no winners in this side just underlines how broken
the system is.
