In this episode, we talk about a third case of
suicide reported in Kalinga Institute of Industrial Technology within this year.
We also talk about the government and the opposition agreeing
on two separate discussions on one day Matrum and electoral reforms.
But we begin today by talking about the Election Commission
and its ongoing Special Intensive Revision where voter roles are

being prepared. Afresh, Hi, I am Aherri Kananda and you
are listening to three things in an Express News show.
When the Election Commission had first announced that it would
be conducting a Special Intensive Revision across India, one of

(00:43):
the immediate concerns raised by the opposition was that this
would disenfranchise thousands of voters and that it was an
exercise similar to the NRC, which was introduced under the
Citizenship Act in two thousand and three.

Speaker 2 (00:57):
Now it turns out.

Speaker 1 (00:58):
That these fears did have a valid ground because in
the Election Commission's draft Order it had made an explicit
mention of the Citizenship Act, and in fact Election Commissioners
Sukwir Sing some who had even reaised concerns about it
on record. In this segment, Michael League Shashank Barger speaks
to the Indian Express's Domini Nat.

Speaker 2 (01:18):
Who broke the story for the paper.

Speaker 3 (01:21):
So, Dominie tell us, in what way did the draft
order mention the Citizenship Act?

Speaker 4 (01:27):
So in the draft order, the EC first tried to
give its justification for doing an SR, first giving the
legal reasons, and in that it cited its authority under
Article three twenty four of the Constitution and under Article
three twenty five, which basically says that any adult citizen
is entitled to be registered as an elector. In that argument,

(01:49):
the EC also cited the Citizenship Act in the draft.

Speaker 3 (01:53):
Order, and later, of course, this reference was taken out.
So what do we know about what prompted the EC
to do this?

Speaker 4 (02:01):
So what we know from the records is that the
mention of the Citizenship Act was removed after Election Commissioner
san who made a note on the file expressing a
concern that genuine voters or citizens should not be harassed
by this process. We do not know the reasoning behind
the EC's decision to drop the Citizenship Act because that

(02:23):
has not been mentioned, but we do know that it
happened after sandhose note was replaced on file.

Speaker 5 (02:30):
Right.

Speaker 3 (02:30):
In fact, in your piece you point out that the
sentence from where it has been removed. That sentence has
been left abruptly in the final order.

Speaker 4 (02:39):
So this entire thing basically started on June twenty fourth,
when the order was put out on the EC's website.
If you see that order in Para eight, the sentence
just ends abruptly. So paragraph eight of the order, which
is in the public domain, it ends with this line. Consequently,
the Commission has a constitutional obligation to ensure that only

persons who are citizens and that's where the sentence ends.
It is obviously an error which is there in the order,
and the Election Commission has not commented on it, has
not issued a correction so far. So we knew that
there was something that was cut from that paragraph which
made it to the final order. Then when we look
at the records and we see the draft order, then
we come to know that this is where the Election

(03:22):
Commission was going to invoke the Citizenship Act, which eventually
decided against.

Speaker 3 (03:28):
And you know, petitioners have argued that matters such as
citizenship do not actually fall under the ambit of the
EC and that this is actually the Home Ministry's job.
How has the Commission responded to that?

Speaker 4 (03:41):
So in its entire argument for the Sir, the Election
Commission has maintained that it is only doing its job
under Article three twenty four. In Article three twenty six
of the Constitution, it's been saying since June twenty four
that it is only trying to make sure that electoral
roles do not have non citizens, which is what the
Constitution says. That you know, only citizens are entitled to

be voters. So the Election Commission has said that it
is only checking the citizenship of people applying to be electors.
It is not the one that is determining whether those
people are citizens or not. And in fact, in its
counter Aforitever in the Supreme Court, the Election Commission has
said that if you are found ineligible in the Sir,
and your name is cut from the electoral role, that

(04:24):
does not mean that your citizenship will be revoked. So
it has gone out to point this out and to
make this clear that though it is checking for citizenship
of people who want to be voters, it is not
the authority that is determining whether those people can be
citizens or not.

Speaker 3 (04:40):
But you know, when you see that the draft order
had a reference to the Citizenship Act, you immediately think
of the NRC. So has the Easy said anything directly
addressing this concern.

Speaker 4 (04:53):
So the Election Commission hasn't talked about the NRC. It
has not invoked the Citizenship Act in its order as
we know. But there are certain things in the order
and in the instructions to states which align with the
Citizenship Act. So, for instance, there are three categories in
the sir form which basically decide what kind of documents
an elector has to submit. Those categories are based on

(05:15):
the categories for citizenship by birth in the Citizenship Act.
So if you're born before July first, nineteen eighty seven,
you only have to submit a document for yourself. If
you're born after July first, nineteen eighty seven and between
that and December two, two thousand and four, you have
to give one document for yourself and for one parent.
And for all those who are born after December second,
two thousand and four, they have to give documents for

(05:37):
themselves and both their parents. Now, these categories are the
categories in the Citizenship Act itself, So in that way
it is aligning with the requirements of the Citizenship Act
without naming it. And secondly, and importantly, the Election Commission's instructions,
which is along with the order that it had issued.
The instructions say that the Electoral Registration Office the RO

(06:01):
of a constituency will refer all suspected foreign nationals to
the concerned authority. Now in that case, it hasn't mentioned
exactly what it means, but it implies that cases of
suspected foreign nationals would be referred to the Home Department,
which is the one which is authorized to take action
in these matters.

Speaker 3 (06:21):
And considering what happened in Bihar and what's happening now
with the kind of pressure that blos are under and
the concerns that people have, one what do we make
of some who's warning and what do we make of
EC's arguments now?

Speaker 4 (06:36):
So from the records we can see that what Sandhu
warned about was added in the final order that voters
should not feel harassed, particularly the old and sick, persons
with disabilities and vulnerable groups. That was incorporated. So the
Election Commission did take his concerns seriously in that respect.

(06:56):
What we saw on the ground in Bihar is that
there was a lot of fusion. There was a scramble
for documents. The Election Commission had to change its procedure
a couple of times to make it simpler. So we
can see that those concerns actually did play out during
the Bihar SR.

Speaker 3 (07:12):
And also Domini, could you give us a little background
about the Citizenship Act and what were the concerns it
was trying to address back in two thousand and three.

Speaker 4 (07:21):
So the Citizenship Act nineteen fifty five was amended in
two thousand and three, and the amendment brought in the
concept of illegal migrants. So before that there was no
concept of illegal migrants in the Act. In terms of
citizenship by birth, the amendment now says that anybody who
wants to claim citizenship by birth after December two, two

(07:42):
thousand and four, should of course be born in the
country and at the time of their birth, one parent
should be a citizen and the other one cannot be
an illegal migrant. So this was a change that was
brought in two thousand and three.

Speaker 3 (07:54):
And talk about the challenges that the SIR is facing
now on the ground and also in the courts.

Speaker 4 (08:02):
So the SII has basically been challenged pretty much from
the get Court. So there are several petitions in the
Supreme Court that were filed soon after the order was
first issued. The Supreme Court is still hearing the matter
and those hearings are still ongoing. In terms of the
practical issues that officials are facing right now, the SII
is going on in nine states and three Union territories

(08:23):
where there is a focus on matching the current electoral
role with the electoral role of the last intensive revision.
So basically it means that you have to trace either
yourself or your parents or grandparents to the electoral role
of the last intensive revision, which is done sometime in
the early two thousands across states. So that has basically

(08:45):
increased the amount of work that blos have to do.
In the first month of the sir vlos have to
trace all electors to the last intensive revision. In the
case of Bihar, they had an option of either tracing
themselves back to the two thousand three electoral role or
submitting a document. But in the current SII, the easiest

(09:05):
tweak this process a little bit where it says that
you don't have to submit documents in the first phase,
so that means you have to trace yourself back to
the last intensive revision, which is what is taking a
bit of time.

Speaker 1 (09:21):
Next, we shift our focus to a suicide case in Bubneshuar.
Over the past few years, instances of students dying by
suicide on college campuses appear to have become much more frequent.
On Sunday night, for example, a first year student at
the Kalinga Institute of Industrial Technology University in Bubneshuar was
found dead in his hostel room. Preliminary inquiry suggests that

his alleged relationship with the girl may have played a role.
But what's important to note is that this actually is
the third suicide case reported from kid this year, following
the deaths of two students from Nepal in February and May.

To learn more about the case and the.

Speaker 1 (10:01):
Ongoing investigation, we spoke to the Indian Expresses Sujibisoe, who
began by telling us what exactly happened on Sunday.

Speaker 6 (10:09):
So on Sunday late winning at around ten forty five pm,
the police said they received a call from the kit
hostel authorities. They suspected that something unusual happened after the
room in which the eighteen years first year student was
staying remained locked for an unusual long time, so there

(10:30):
was some doubt in their mind and they informed the police.
So when the police reached there, they brought the lock
that was locked from inside the room and they found
that the body of the student, who is a native
of Brygart in Chetti's God was found hanging from the
sailing fan in his room and.

Speaker 5 (10:48):
They recovered the body.

Speaker 6 (10:50):
They seized the body and the police taken the body
to the Kim's Hospital that is very close to the
KIT campus where the doctors declared dead.

Speaker 2 (11:01):
And Je what do we know about this particular student?

Speaker 6 (11:05):
So as for the police record that this student is
identified as Rahul YadA. He's an eighteen year old boy
from Raggart town in Chattisgat and he was pursuing computer
science engineering in the Kat University. And after mother and
her maternal grandfather reached here, they said that he had

sifted to the hostel three months back only.

Speaker 1 (11:32):
And Saje, this as we mentioned, is the third such
case in this university. So tell us what have been
the reactions to it and what have the authorities found
out so far?

Speaker 6 (11:42):
So the incident basically created chaos as soon as it
came to before. So police initially they said nothing. An
unnatural death case was registered by the police and they
started investigation, did the scientific procedure what was required. But
things become clear after mother atlast that the boy was

(12:04):
in a relationship with the girl from his hometown who
is studying in Marastra. And as for the victim's mother,
the father and the brother and mother of the elist girl,
they were harassing this boy. So in the evening also
police made it clear that as for the evidences and

(12:26):
statements from the hostelmates, then the family members and social
media accounts, the preliminary investigation mensor indicated that because of
her relationship with the girl, the student might have taken
the extrain state right.

Speaker 1 (12:42):
So have any arrests been made so far, any firs
that have been launched.

Speaker 6 (12:47):
Well, initially the police as for procedures, they launched one
unnatural death case and started investigation taken into consideration all
the evidences found during the scientific examination. Later mother police
complaint against the mother, father and brother of the Alis
call saying that they were harassing his son. So the

police launched one FI and they have started investigation based
on the mother's complaint.

Speaker 2 (13:15):
And have the university officials said anything about this given
that this is the third suicide case it has been
reported from the campus.

Speaker 6 (13:23):
Well, Niharika, absolutely, you are right that this is the
third incident because on February sixteenth, nineteen or twenty old
girl from Nepal, she committed suicide and that become a
big controversy and on bed name for the institution. Then
a similar incident happened in May when another student from
Nepal committed suicide.

Speaker 5 (13:44):
So this is the third incident.

Speaker 6 (13:45):
But we definitely tried to reach out to the university
authority after the recent incident, but they said is that
they had nothing to hide in this incident.

Speaker 5 (13:55):
They are fully cooperating.

Speaker 6 (13:57):
With the police and the law and forcement agencies to
do a proper investigation of the incident. And we spoke
to the mother who said that because she was ever
that the father of the girl who was threatening and
the mother said that his son was under tremendous mental pressure,
so she tried to reach out to the hostel authorities

(14:21):
to keep a tab on his son's behavior, but she
said that nobody responded to her calls. But we tried
to get a response from the university authorities on the allegations,
but the university is yet to say anything about this.

Speaker 1 (14:35):
Physically now, so gee, what are some of the next
steps that the authorities are planning.

Speaker 6 (14:41):
To take well, police saying that they would soon someone
the father, brother and mother of the aliged girl to
initial the investigation. But yes, as far as key T
is concerned, because after the previous two incidents, the University
Grants Commission also made some strong observations about the management

(15:01):
and the administrations and they had asked to explain and
re studoshow cause why illegal action will not be taken
against them for the illegal and onlaw full activities that
was found during the previous two cases.

Speaker 1 (15:20):
And in the end we talk about the ongoing winter
session of the parliament. After two days of disruptions, the
standoff between the government and the opposition in the parliament
finally eased yesterday. Both sides have now agreed to hold
separate discussions next week, one on the one to fiftieth
anniversary of the National Song one Day Matrum and another

(15:40):
on electoral reforms, where the opposition plans to raise issues
concerning the ongoing sir The Indian expresses minote cg Rights
that the breakthrough came after a series of meetings during
the day, including two rounds of talks between Lok Saba
Speaker umbrella and floor leaders, and another one between Parliamentary
Affairs Minister Karen Rijiju and the opposition. At the all

party meeting convened by the speaker, parties broadly agreed to
the government's proposal that Juan de Matram would be taken
up first, followed by electoral reforms. The Luksaba's Business Advisory
Committee has now allotted ten hours each for the two debates.
Prime Minister Nary Dramodi will open the full day discussion
on Juan da Maatram on eighth of December, with debates

on electoral reforms scheduled for the ninth and the tenth
of this month. Minoje writes that Home Minister Amitshah may
intervene in the reform's discussion and Law Minister Arjen ram
Megwhile is expected to reply. Meanwhile, the Raja Sabha is
also likely to mirror this timeline once the Luksaba completes
its debates. However, this agreement did not come without friction.

(16:45):
The opposition India Bloc has been demanding that electoral reforms
and specifically the sir exercise be discussed immediately. Parties like
the Renamoul Congress and the Samajwadi Party pushed for a
debate this week, while others include during the Congress were
willing to wait until next week. However, the United Opposition
insisted the reform's debate should come first, arguing that the

sir issue is urgent. The government, while dropping its earlier
resistance to discussing sir at all, held firm that Vanda
Matra must precede it eventually. Once the Prime Minister's availability
was confirmed, the schedule was locked in. Rijiju later told
reporters the discussion would allow members to raise a wide
range of issues related to elections. Derek O'Bryan signaled a

temporary truce, saying the opposition had been gracious and accommodating
to ensure Parliament functioned, and vowed to hold the government
to account in board debates.
